1. सजं क्षप्त नाम और प्रारंभ.- इन जनयमों का नाम भारतीय पि ु जचदकत्‍ सा पररषि ्(पि ु जचदकत्‍ सा महाजिद्यालयों और पिु जचदकत्‍ सा अहतह ाओं की मान्य ता तथा मान् यता िापस लेन ेकी प्रदिया) जनयम, 2026 ह।ै

(2) य ेरािपत्र में उनके प्रकािन की तारीख को प्रिृत्‍ त होंगे।

2. पररभाषाएं.- िब तक दक इन जिजनयमों म,ें संिभह स ेअन्यथा अपेजक्षत न हो, — (क ) से "अजधजनयम" भारतीय पि ुजचदकत्‍सा पररषि ्अजधजनयम1984 (1984 का 52) अजभप्रेत ह;ै (ख) "सलाहकार सजमजत" से केंद्रीय सरकार द्वारा इन जनयमों के जनयम 16 के अधीन गरित सजमजत अजभप्रेत ह;ै (घ ) से इन जनयमो से उपबंध प्ररूप अजभप्रेत्त ह ै“ प्ररूप” ;

(ङ) "पहली अनुसूची" से अजधजनयम की पहली अनुसूची अजभप्रेत ह ै ; (च) "एमएसिीई जिजनयमों" स े (भारतीय पिु जचदकत्‍ सा पररषि ्द्वारा यथा अजधसूजचत समय-समय पर यथा संिोजधत या अजधिांत भारतीय पिु जचदकत्‍सा पररषि ्पिु जचदकत्‍सा जिक्षा के न्यूनतम मानक (पिु जचदकत्‍सा जिज्ञान और पिुपालन स्नातक-जडग्री पाठ्यिम) जिजनयम, 2016 अजभप्रेत ह;ै (छ) "अध्यक्ष" स े पररषि ्का अध्यक्ष अजभप्रेत ह;ै (ि) "अनंजतम रूप से मान्यताप्राप्त पिु जचदकत्‍सा महाजिद्यालय" से ऐसा पिु जचदकत्‍सा महाजिद्यालय अजभप्रेत ह ै जिसको पहली अनसु ूची में िाजमल नहीं दकया गया ह ै और िहां पर जिद्यार्थहयों के िाजखल े को केंद्रीय सरकार द्वारा इन जनयमों के अधीन अनुज्ञा पत्र अनुित्त करने और उसके निीकरण द्वारा अनुज्ञात दकया गया ह;ै (झ) "मान्यताप्राप्त पिु जचदकत्‍सा महाजिद्यालय" केंद्रीय सरकार द्वारा अजधजनयम और इन जनयमों में जिजहत रीजत में पहली अनुसूची में िाजमल करके मान्यता प्रिान दकया गया पिु जचदकत्‍सा महाजिद्यालय अजभप्रेत ह;ै (ञ) "मान्यताप्राप्त पिु जचदकत्‍सा अहतह ा" से अजधजनयम की धारा 2 के खंड (छ) म ेंयथा पररभाजषत मान्यताप्राप्त पि ु जचदकत्‍सा अहतह ा अजभप्रेत ह;ै (ट) से इन जनयमो “अनुसूची” से उपाबद्ध अजभप्रेत्त ह;ै (ि) "जिश्वजिद्यालय" स े दकसी केंद्रीय अजधजनयम, प्रािेजिक अजधजनयम या राज्य अजधजनयम के अधीन या उसके द्वारा स्ट्थाजपत या जनर्महत जिश्वजिद्यालय अजभप्रेत है, िो दकसी संपटक या संबद्ध पिु जचदकत्‍सा महाजिद्यालय के माध्यम से पि ु जचदकत्‍सा अहतह ा अनिु त्त कर रहा है;

(ड) स े कोई महाजिधालय य “पि ु जचदकत्‍सा महाजिधालय” संस्ट्था अजभप्रेत्त ह ै िो या तो दकसी जिश्वजिद्यालय का संपटक महाजिधालय या दकसी जिश्वजिद्यालय स े संबद्घ ह ै और िो पिु जचदकत्‍सा जिज्ञानं स्नातक और पिु पालन म ेंजडग्री पाठ्यिमया कोई अन्य पिु जचदकत्‍सा अहतह ा की जिक्षा प्रिानकरने म ेंलगा हुआ ह ैl[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (ढ) "पि ु जचदकत्‍सा संस्ट्था" स ेअजधजनयम की धारा 2 के खडं (झ) में यथापररभाजषत संस्ट्थाएं अजभप्रेत है;

(2) िब्ि और पि, िो इन जनयमों में प्रयोग दकए गए ह ैं और पररभाजषत नहीं ह ैं ककंत ु अजधजनयम में पररभाजषत हैं, का िही अथ हहोगा िो उनका अजधजनयम में ह।ै

3. पि ुजचदकत्‍सा महाजिद्यालयों की मान्यता— कोई व्यजि दकसी पि ु जचदकत्‍सा महाजिद्यालय की स्ट्थापना नहीं करेगा और दकसी पिु जचदकत्‍सा महाजिद्यालय म ें जिद्यार्थहयों को िाजखला नहीं िगे ा या जिद्यार्थहयों की संख्या में अनुज्ञात संख्या से परे िृजद्ध नहीं करेगा जसिाय तब िब िह इन जनयमों के अनुसार केंद्रीय सरकार से पूिह अनुज्ञा अजभप्राप्त ना कर ले।

4. पि ुजचदकत्‍सा महाजिद्यालयों को मान्यता प्रिान करन ेके जलए पात्रता मानिडं — जनम्नजलजखत संगिन दकसी पि ु जचदकत्‍सा महाजिद्यालय, पिु जचदकत्‍सा अहतह ा की मान्यता के जलए प्ररूप-1 में आिेिन करन ेके पात्र होंगे, अथाहत:् —

(i) कोई राज्य सरकार या संघ राज्य क्षेत्र का प्रिासन;

(ii) कोई जिश्वजिद्यालय;

(iii) दकसी कानून द्वारा या उसके अधीन केंद्रीय और राज्य सरकार द्वारा स्ट् थाजपत स्ट्िायत्त जनकाय;

(iv) सोसायटी रजिस्ट्रीकरण अजधजनयम 1860 (1860 का 21) या राज्य में दकसी अन् य अजधजनयम के अधीन रजिस्ट्रीकृत सोसायटी;

(v) दकसी राज्य में लागू अजधजनयम के अधीन सृजित और रजिस्ट्रीकृत लोक धार्महक या पूत ह न्यास या िक्फ अजधजनयम 1995 (1995 का 43) के अधीन रजिस्ट्रीकृत िक्फ;

(vi) कंपनी अजधजनयम, 2013 के अधीन जनगजमत धारा 8 की कंपनी।

5. अहकह मानिंड— जनयम 4 के अधीन पात्र सगं िन पि ु जचदकत्‍सा महाजिद्यालय या पि ु जचदकत्‍सा अहतह ा की मान्यता के जलए आिेिन करन े के जलए अहकह होंग ेयदि िह जनम्नजलजखत ितों को परू ा करत े हैं, अथाहत:् - क. आिेिक के जनयम 4 के खंड (i), खंड (ii) और खंड (iii) के अधीन िगों से जभन्न दकसी एक प्ररूप म ें अजस्ट्तत्‍ि रहन े की ििा म ें उसका एक प्रमुख उद्दे‍य पि ु जचदकत्‍सा जिक्षा और प्रजिक्षण प्रिान करना होना चाजहए ;

ख. आिेिक के पास MSVE जिजनयमों म ेंयथा जिजनर्िहष् ट आकार की उपयुि समीप् य भूजम होनी चाजहए, जिस पर सभी भिन और सुजिधाएं बनाई िा सकें; यह भूजम आिेिक के स्ट् िाजमत्‍ ि और कब् िे में होनी चाजहए या आिेिक के पास तीस िषह या उससे अजधक के पट्टे के अधीन होनी चाजहए। परंतु जिक्षा संबंधी पिुधन फामह पररसर, पिु जचदकत्‍ सा महाजिद्यालय पररसर से तीस दकलोमीटर की पररजध के भीतर होगा। परंत ु यह भी दक पि ु जचदकत्‍ सा महाजिद्यालय, जिसके अतं गतह पिु जचदकत्‍ सा अस्ट् पताल या पिु जचदकत्‍ सा नैिाजनक पररसर और जिक्षा संबंधी पिधु न फामह पररसर भी है, के संजनमाहण, स्ट् थापना, अनुरक्षण और प्रचालन के जलए सभी अनुज्ञा, िो आि‍ यक हो, सक्षम सरकारी अजभकरण से प्राप् त कर गई ह;ैं ग. पिु जचदकत्‍ सा नैिाजनक पररसर या पि ुजचदकत्‍ सा अस्ट् पताल स्ट् िाजमत्‍ ि और प्रबंधन करना या िसै ा दक MSVE जनयमों में अजभकजथत दकया गया है, दकसी राज्य के पिु जचदकत्‍ सा अस्ट् पताल और दकसी जिक्षा संबंधी पिुधन फामह पररसर, िो उसमें जिजनर्िहष् ट सभी अिसंरचनागत सुजिधाओं के साथ4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] सुसजित हों, इंतिाम होना चाजहए और पि ुजचदकत्‍ सा अस्ट् पताल या पिु जचदकत्‍ सा नैिाजनक पररसर, यदि आिेिक के स्ट् िाजमत्‍ ि म ेंहो, तो पि ुजचदकत्‍ सा महाजिद्यालय पररसर के भीतर होगा; यदि आिेिक की कोई व्यिस्ट्था ह,ै तो पि ु जचदकत्‍ सा महाजिद्यालय पररसर स े बीस दकलोमीटर की पररजध म ेंहोना चाजहए;

घ. पहल े िैजक्षक िष ह के जलए MSVE जिजनयमों म ें यथा जिजनर्िहष् ट अपेजक्षत जिक्षण और गैर-जिक्षण कमहचारीिृंि की भती कर ली गई ह;ै ङ. पहले और िसू रे िैजक्षक िषह के जलए MSVE जिजनयमों और अनुसूची II म ें यथा जिजनर्िहष् ट अपेजक्षत अिसंरचनागत सुजिधाएं स्ट्थाजपत कर ली गई हैं;

च. पिु जचदकत्‍सा महाजिद्यालय 'सरकार' या 'भारतीय' या 'राष्ट्रीय' या 'अजखल भारतीय' या संप्रतीक और नाम (अनुजचत प्रयोग जनिारण) अजधजनयम, 1950 के अधीन प्रजतजषद्ध िब्िों का उसके नाम के एक भाग के रूप में प्रयोग नहीं करेगा तादक यह प्रभाि न पडे दक उि पिु जचदकत्‍सा महाजिद्यालय सरकारी ह ैया उसका प्रबंधन सरकार द्वारा दकया िा रहा ह ैया उसे सरकारी संरक्षण प्राप्त ह ैतथा यह जनबंधन उन पिु जचदकत्‍सा महाजिद्यालयों पर लागू नहीं होंगे जिनकी स्ट्थापना राज्य या केंद्रीय सरकार द्वारा या उनके द्वारा अनुमोदित नाम के अधीन की गई ह।ै

(6) पि ु जचदकत्‍स ा महाजिद्यालय या पि ु जचदकत्‍स ा अहतह ा िरूु करन े के जलए आििे न.- पिु जचदकत्‍ सा महाजिद्यालय या पिु जचदकत्‍ सा अहतह ा िुरू करने के जलए आिेिन, जनयम 4 के अधीन पात्र दकसी भी संगिन द्वारा इन जनयमों के अधीन यथा जिजनर्िहष् ट िस्ट् तािेिों के साथ, सजचि, पिुपालन और डेयरी जिभाग, भारत सरकार को प्ररूप-I में िमा दकया िाएगा। आिेिन िो प्रजतयों म ेंिमा दकए िाएंगे और एक प्रजत सजचि, भारतीय पि ु जचदकत्‍ सा पररषि ्को िी िाएगी।

(2) जनयम 6 के उप-जनयम (1) के अधीन आिेिन के साथ प्ररूप-I म ेंयथाजिजनर्िहष् ट िस्ट्तािेज़ भी संलग् न करन े होंगे।

(7) पि ुजचदकत्‍स ा महाजिद्यालय या पि ुजचदकत्‍स ा पाठ्यिम िरूु करन ेसबं धं ी आििे न के मल्ू याकं न की प्रदिया.- पररषि ् सभी आिेिनों की संिीक्षा करेगी और कोई आिेिन, िो दकसी भी रूप से अपूणह पाया िाता ह ै या िहां आिेिक पात्रता या अहतह ा मानिडं को परू ा नहीं करता ह,ै को पररषि ् द्वारा आििे क को केंद्रीय सरकार को जचजननत प्रजत के साथ संिीक्षा के िौरान आिेिन में पाई गई त्रुरटयों को इंजगत करते हुए तथा आिेिक को ऐसी त्रुरटयों को अनुसूची 1 म ें जिजनर्िहष् ट समय के भीतर िरू करने का अिसर प्रिान करते हुए लौटाया िाएगा। परंत ु यदि पररषि ् अनुसूची I के अनुसार दकसी आिेिन पर कारहिाई करन े में जिफल रहती है, तो केंद्रीय सरकार मामले को जनयम 16 म ेंबताई गई सलाहकार सजमजत को भेि सकती ह।ै

2. िह आिेिन, िो पणू ह पाए िाते ह ैं या िहां आिेिक जनयम 4 और जनयम 5 के अधीन मानिंड को पूरा करता है, को अजधजनयम की धारा 12 के अधीन गरित पररषि ् की कायहपालक सजमजत के समक्ष रखा िाएगा, िो इन जनयमों और पिु जचदकत्‍ सा जिक्षा जिजनयमों के न् यनू तम मानकों के अधीन उपिर्िहत अपेक्षाओं के आधार पर उक्त आिेिनों की िांच करेगी।

3. आिेिन की िांच पर यदि कायपह ालक सजमजत यह जिजन‍ चय करती ह ै दक िह पि ु जचदकत्‍ सा महाजिद्यालय के भौजतक जनरीक्षण को संचाजलत करने के जलए एक उपयुक् त मामला ह ैतो िह उतनी संख् या म ेंजनरीक्षकों को, िो पिु जचदकत्‍ सा महाजिद्यालय के जनरीक्षण के जलए अजधजनयम की धारा 19 और MSVE जिजनयमों के अधीन आि‍ यक समझे, तैनात करेगी। जनरीक्षकों की जनयुजि ड्रॉ ऑफ लॉट के ज़ररए की िाएगी।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5

4. िहां पररषि ् की यह राय ह ै दक आिेिन को भौजतक जनरीक्षण दकए जबना अस्ट् िीकार कर िने ा चाजहए, तो िह केंद्रीय सरकार को इस ेअस्ट् िीकार करने की जसफाररि करेगी और साथ ही ऐसी जसफाररि का कारण भी बताएगी। केंद्रीय सरकार मामले को िोबारा जिचार के जलए पररषि ्को िापस भेि सकती ह ैजिसका जलजखत कारण बताया िाएगा, या दफर केंद्रीय सरकार मामले को परामिह के जलए जनयम 16 में उजल्लजखत सलाहकार सजमजत को भेि सकती ह।ै

5. जनरीक्षण परू ा होने के प‍ चात् जनरीक्षक पि ुजचदकत्‍ सा जिक्षा के मानकों की पयाहप् तता, जिसके अधीन अिसंरचना, कमहचाररिृंि, उपस्ट् कर, आिास, प्रजिक्षण और पि ु जचदकत्‍ सा जिक्षा महाजिद्यालय म ें उपलब् ध अन् य सुजिधाएं ह,ैं की एक ररपोटह तैयार करेंग ेऔर उसे पररषि ्की कायहपालक सजमजत को प्रस्ट्त ुत करेंगे।

6. कायहपालक सजमजत उप-जनयम (6) म ें िर्णहत ररपोटह पर जिचार करन े के प‍ चात ् उक्त ररपोटह की एक प्रजत ऐसी अभ् यजु ियों, िो आि‍ यक हों, के साथ उक्त ररपोटह की अतं िहस्ट्त ु पर रटप् पजणयों की ईप् सा करते हुए आिेिक को भेिेंगे और जनरीक्षण ररपोटह की एक प्रजत पररषि ्द्वारा संबंजधत जि‍ िजिद्यालय को भी अग्रेजषत की िाएगी।

7. पररषि,् पिु जचदकत्‍ सा महाजिद्याल स े रटप् पजणयों की प्राजप्त के प‍ चात ् उप-जनयम (6) म ें िर्णहत जनरीक्षकों की ररपोटह के साथ कायहपालक सजमजत की अभ् युजियों को तथा आिेिक से प्राप् त रटप् पजणयों को केंद्रीय सरकार को अनुज्ञा पत्र िारी करने के संबंध में जसफाररि के साथ अग्रेजषत करेगी।

8. िहां पररषि ्केंद्रीय सरकार को अनुज्ञा पत्र िारी करन े के जिरुद्ध जसफाररि करती है, तो िह ऐसी जसफाररि के जलए अपने कारणों को जलजखत में प्रस्ट् तुत करेगी। केंद्रीय सरकार मामले को दफर से जिचार करने के जलए पररषि ् को िापस भेि सकती ह ै जिसका जलजखत कारण बताया िाएगा, या केंद्रीय सरकार मामले को परामि ह के जलए जनयम 16 म ेंउजल्लजखत सलाहकार सजमजत को भेि सकती ह।ै

9. केंद्रीय सरकार जनयम 15 के उप-जनयम (2) म ें उजल्लजखत बैंक गारंटी िमा करने पर आिेिक को इन जनयमों के अनुसार पि ु जचदकत्‍ सा महाजिद्यालय म ें छात्रों को िाजखला की अनज्ञु ा िते े हुए अनुज्ञा पत्र िारी कर सकती ह;ै और अनुज्ञा पत्र की एक प्रजत केंद्रीय सरकार द्वारा पररषि ् और संबंजधत जि‍ िजिद्यालय को भी भेिी िाएगी। परंत ु केंद्रीय सरकार जनयम 4 की श्रेणी (i) और (ii) में आन े िाले आिेिकों को जनयम 15 के उप-जनयम (2) म ें बताई गई बैंक गारंटी िमा करने से छूट िगे ी।

10. यदि केंद्रीय सरकार अनुज्ञा पत्र िारी न करने का जिजन‍ चय करती ह ै तो िह अपन े जिजन‍ चय को पररषि ् को ओर संबंजधत जि‍ िजिद्यालय को प्रजत के साथ आिेिक को सूजचत करेगी। परंतु आिेिन के साथ आिेिक द्वारा संित्‍ त फीस को लौटाया नहीं िाएगा।

8. अनज्ञु ा पत्र – पहले अिसर पर अनुज्ञा पत्र पहले िो िैजक्षक िषह के जलए अनुित्‍त दकया िाएगा और पिु जचदकत्‍ सा महाजिद्यालय को केिल पहले और िसू रे िैजक्षक िष ह के जलए जिद्यार्थहयों को िाजखला करने के जलए अनज्ञु ात दकया िाएगा।

9. अनज्ञु ा पत्र का निीकरण.-

1. अनुज्ञा पत्र के निीकरण के जलए आिेिन, अनुज्ञा पत्र रखने िाले दकसी भी संगिन द्वारा इन जनयमों म ें बताए गए िस्ट्तािेिों सजहत प्ररूप-I म,ें सजचि, पिुपालन और डेयरी जिभाग, भारत सरकार को िमा दकया िाएगा। आिेिन िो प्रजतयों म ें िमा दकए िाएगं े जिसकी एक प्रजत भारतीय पि ु जचदकत्‍ सा पररषि ् के सजचि को िी िाएगी।

2. जनयम 9 के उप-जनयम (1) के अधीन आिेिन के साथ प्ररूप-I म ेंजिजनर्िहष् ट िस्ट्तािेि भी संलग्न दकए िाएंगे।

3. अनुज्ञा पत्र के निीकरण के जलए इन जनयमों के अधीन सभी आिेिनों पर अनुसूची III में जिजनर्िहष्ट समय- सीमा के अनुसार कारहिाई की िाएगी।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

10. अनज्ञु ा पत्र के निीकरण के जलए आििे न के मल्ू याकं न की प्रदिया.- पररषि ्आिेिनों की िांच करेगी और यदि कोई आिेिन दकसी भी तरह स ेअपणू हपाया िाता ह ैया आिेिक पात्रता या अहतह ा मानिडं ों को परू ा नहीं करता ह,ै तो पररषि ्उस आिेिन को आिेिक को िापस कर िगे ी। साथ ही, इसकी एक प्रजत केंद्रीय सरकार को भी भेिी िाएगी, जिसमें िांच के िौरान आिेिन में पाई गई कजमयों का उल्लेख होगा और आिेिक को अनुसूची II म ें बताए गए समय के भीतर उन कजमयों को िीक करने का अिसर दिया िाएगा। परंत ु यदि पररषि ् अनुसूची I के अनुसार दकसी आिेिन पर कारहिाई करन े में जिफल रहती है, तो केंद्रीय सरकार मामले को जनयम 16 म ेंउजल्लजखत सलाहकार सजमजत को भेि सकती ह।ै

2. िो आिेिन पूण हपाए िाएगं ेऔर जिनम ेंआिेिक अनुसूची II और MSVE जिजनयम म ेंबताई गई ितों को परू ा करता ह,ै उन्ह ें पररषि ् की कायहपालक सजमजत के समक्ष रखा िाएगा। यह सजमजत इन जनयमों और MSVE जिजनयमों में जनधाहररत अपेक्षाओं के आधार पर उन आिेिनों की िांच करेगी।

3. आिेिन की िांच पर यदि कायपह ालक सजमजत यह जिजन‍ चय करती ह ै दक पिु जचदकत्‍ सा महाजिद्यालय का भौजतक जनरीक्षण को संचाजलत करने के जलए एक उपयुक् त मामला ह,ै तो िह उतनी संख् या म ें जनरीक्षकों को, िो अजधजनयम की धारा 19, पिु जचदकत्‍ सा के न्यूनतम मानिंड जिजनयमों और भारतीय पिु जचदकत्‍ सा पररषि ् (जनरीक्षक और आगंतुक) जिजनयम, 1991 के उपबंधों के अधीन आि‍ यक समझे, तैनात करेगी। जनरीक्षकों की जनयुजि ड्रॉ ऑफ लॉट के िररए की िाएगी।

4. िहां पररषि ्की राय ह ैदक आििे न को जबना भौजतक जनरीक्षण के ही अस्ट् िीकार कर िने ा चाजहए, तो िह केंद्रीय सरकार को इसे अस्ट् िीकार करने की जसफाररि करेगी और साथ ही ऐसा करने का कारण भी बताएगी। केंद्रीय सरकार मामले को िोबारा जिचार करने के जलए पररषि ्को िापस भेि सकती ह ैजिसका जलजखत कारण बताया िाएगा या केंद्रीय सरकार मामल े को परामि हके जलए जनयम 16 म ेंउजल्लजखत सलाहकार सजमजत के पास भिे सकती ह।ै

5. जनरीक्षण पूरा होने के प‍ चात्, जनरीक्षक पि ु जचदकत्‍ सा जिक्षा के मानकों की पयाहप्तता, जिसके अंतगतह अिसंरचना, कमहचारीिृंि, उपस्ट्क र और पि ुजचदकत्‍ सा महाजिद्यालय म ेंउपलब् ध अन् य सुजिधाओं सजहत पर एक ररपोटह तैयार करेंगे और उसे पररषि ्की कायहपालक सजमजत को सौंपेंगे।

6. कायहपालक सजमजत, उप-जनयम (5) म ें िर्णहत ररपोटह पर जिचार करन े के प‍ चात्, उक्त ररपोटह की एक प्रजत ऐसी अभ् यजु ियों, िो आि‍ यक हों, के साथ उक्त ररपोटह की अतं िहस्ट् तु पर रटप् पजणयों की ईप् सा करत ेहुए आिेिक को भेिेंगे और जनरीक्षण ररपोटह की एक प्रजत पररषि ्द्वारा संबंजधत जि‍ िजिद्यालय को भी अग्रेजषत की िाएगी।

7. पररषि,् पिु जचदकत्‍ सा महाजिद्याल से रटप् पजणयों की प्राजप्त के प‍ चात् उप-जनयम (5) में िर्णतह जनरीक्षकों की ररपोटह के साथ कायहपालक सजमजत की अभ् युजियों को तथा आिेिक से प्राप् त रटप् पजणयों को केंद्रीय सरकार को अनुज्ञा पत्र िारी करने के संबंध में जसफाररि के साथ अग्रेजषत करेगी।

8. िहां पररषि ्केंद्रीय सरकार को अनज्ञु ा पत्र िारी करन े के जिरुद्ध जसफाररि करती है, तो िह ऐसी जसफाररि के जलए अपने कारणों को जलजखत में प्रस्ट् तुत करेगी। केंद्रीय सरकार मामले को दफर से जिचार करने के जलए पररषि ्को िापस भेि सकती ह ैजिसका जलजखत कारण बताया िाएगा, या केंद्रीय सरकार मामले को परामिह के जलए जनयम 16 म ेंउजल्लजखत सलाहकार सजमजत को भेि सकती ह।ै

9. केंद्रीय सरकार आिेिक को अनज्ञु ा पत्र का निीकरण िारी कर सकती है, जिससे आिेिक इन जनयमों के अनुसार पिु जचदकत्‍ सा महाजिद्यालय में तीसरे और चौथ े िषह के जलए जिद्यार्थहयों को िाजखला िे सके, साथ ही केंद्रीय सरकार अनुज्ञा पत्र के निीकरण की एक प्रजत पररषि ्और संबंजधत जि‍ िजिद्याल को भी भेिगे ी।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7

10. यदि केंद्रीय सरकार अनुज्ञा पत्र का निीकरण िारी न करन े का जनणहय करती है, तो इस जनणयह की िानकारी आिेिक को िी िाएगी और इसकी एक प्रजत पररषि ्और संबंजधत जि‍ िजिद्यालय को भी भेिी िाएगी।

11. पि ुजचदकत्‍स ा महाजिद्यालय या पि ुजचदकत्‍स ा अहतह ा को पहली अनसु चू ी म ेंिाजमल दकए िान ेके द्वारा मान्यता िने े के जलए आििे न- (1) पिु जचदकत्‍ सा महाजिद्यालय या पिु जचदकत्‍ सा अहतह ा को मान्यता िने े के जलए आिेिन, MSVE जिजनयमों में यथा जिजनर्िहष् ट सभी अपेक्षाओं को परू ा करने िाले या जिनके पास अनज्ञु ा पत्र का निीकरण है, ऐसे दकसी भी संगिन द्वारा प्ररूप-I में सजचि, पिुपालन जिभाग, भारत सरकार को प्रस्ट् ततु दकया िाएगा। आिेिन िो प्रजतयों में िमा दकए िाएंगे और एक प्रजत सजचि, भारतीय पि ु जचदकत्‍ सा पररषि ्को िी िाएगी।

2. जनयम 11 के उप-जनयम (1) के अधीन आिेिन के साथ प्ररूप-I म ें यथा जिजनर्िहष् ट िस्ट्तािेज़ भी सलं ग् न करन े होंगे।

3. इन जनयमों के अधीन पि ु जचदकत्‍ सा महाजिद्यालय या पिु जचदकत्‍ सा पाठ्यिम को मान्यता िेने के जलए सभी आिेिनों पर अनुसूची III म ेंजिजनर्िहष् ट समय-सूची के अनुसार कारहिाई की िाएगी।

4. पिु जचदकत्‍ सा महाजिद्यालय या पिु जचदकत्‍ सा अहतह ा को पहली अनुसूची में िाजमल दकए िाने के द्वारा मान्यता िेने के जलए आिेिन के मल्ू यांकन की प्रदिया.- पररषि ्आिेिनों की िांच करेगी और यदि कोई आिेिन दकसी भी तरह से अपूण ह पाया िाता ह ै या आिेिक पात्रता या अहतह ा मानिंडों को पूरा नहीं करता है, तो पररषि ् उस आिेिन को आिेिक को िापस कर िगे ी। साथ ही, इसकी एक प्रजत केंद्रीय सरकार को भी भेिी िाएगी, जिसमें िांच के िौरान आिेिन म ेंपाई गई कजमयों का उल्लेख होगा और आिेिक को अनुसूची III में बताए गए समय के भीतर उन कजमयों को िीक करने का अिसर दिया िाएगा। परंतु यदि पररषि ्अनुसूची III के अनुसार दकसी आिेिन पर कारहिाई करने में जिफल रहती ह,ै तो केंद्रीय सरकार मामले को जनयम 16 म ेंउजल्लजखत सलाहकार सजमजत को भेि सकती ह।ै

2. िो आिेिन पणू ह पाए िाएगं े और जिनमें आिेिक अनुसूची II और MSVE जिजनयम में बताई गई ितों को पूरा करता ह,ै उन्ह ें पररषि ् की कायहपालक सजमजत के समक्ष रखा िाएगा। यह सजमजत इन जनयमों और MSVE जिजनयमों में जनधाहररत अपेक्षाओं के आधार पर उन आिेिनों की िांच करेगी।

3. आिेिन की िांच पर यदि कायहपालक सजमजत यह जिजन‍ चय करती ह ै दक पि ु जचदकत्‍ सा महाजिद्यालय का भौजतक जनरीक्षण को संचाजलत करन े के जलए एक उपयुक् त मामला ह,ै तो िह उतनी संख् या में जनरीक्षकों को, िो अजधजनयम की धारा 19, पिु जचदकत्‍ सा के न्यनू तम मानिंड जिजनयमों और भारतीय पि ु जचदकत्‍ सा पररषि ् (जनरीक्षक और आगंतुक) जिजनयम, 1991 के उपबधं ों के अधीन आि‍ यक समझे, तनै ात करेगी। जनरीक्षकों की जनयुजि ड्रॉ ऑफ लॉट के िररए की िाएगी।

4. िहां पररषि ्की राय ह ैदक आििे न को जबना भौजतक जनरीक्षण के ही अस्ट् िीकार कर िेना चाजहए, तो िह केंद्रीय सरकार को इसे अस्ट् िीकार करने की जसफाररि करेगी और साथ ही ऐसा करने का कारण भी बताएगी। केंद्रीय सरकार मामले को िोबारा जिचार करने के जलए पररषि ्को िापस भेि सकती ह ैजिसका जलजखत कारण बताया िाएगा या केंद्रीय सरकार मामले को परामिह के जलए जनयम 16 में उजल्लजखत सलाहकार सजमजत के पास भेि सकती ह।ै

5. जनरीक्षण परू ा होने के प‍ चात,् जनरीक्षक पि ुजचदकत्‍ सा जिक्षा के मानकों की पयाहप्तता, जिसके अतं गहत अिसंरचना, कमहचारीिृंि, उपस्ट् कर और पि ुजचदकत्‍ सा महाजिद्यालय में उपलब् ध अन् य सुजिधाओं सजहत पर एक ररपोटह तैयार करेंग ेऔर उसे पररषि ्की कायहपालक सजमजत को सौंपेंगे।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

6. कायहपालक सजमजत, उप-जनयम (5) म ेंिर्णहत ररपोटह पर जिचार करन ेके प‍ चात,् उक्त ररपोटह की एक प्रजत ऐसी अभ् यजु ियों, िो आि‍ यक हों, के साथ उक्त ररपोटह की अतं िहस्ट्त ु पर रटप् पजणयों की ईप् सा करते हुए आिेिक को भेिेंगे और जनरीक्षण ररपोटह की एक प्रजत पररषि ्द्वारा संबंजधत जि‍ िजिद्यालय को भी अग्रेजषत की िाएगी।

7. पररषि,् पिु जचदकत्‍ सा महाजिद्याल स े रटप् पजणयों की प्राजप्त के प‍ चात ् उप-जनयम (5) म ें िर्णहत जनरीक्षकों की ररपोटह के साथ कायहपालक सजमजत की अभ् युजियों को तथा आिेिक से प्राप् त रटप् पजणयों को केंद्रीय सरकार को अनुज्ञा पत्र िारी करने के संबंध में जसफाररि के साथ अग्रेजषत करेगी।

8. िहां पररषि केंद्रीय सरकार को पिु जचदकत्‍सा महाजिद्यालय या पिु जचदकत्‍सा पाठ्यिम की मान्यता न िेने के संबंध में जसफाररि करती ह,ै िहां िह ऐसी जसफाररि के कारणों को जलजखत में प्रस्ट्ततु करेगी। केंद्रीय सरकार इस संिभह म ें जलजखत में कारण बतात े हुए इस संिभ ह मामल े को पुनर्िहचार के जलए पररषि को िापस भेि सकती ह ैया जनयम 16 में उजल्लजखत सलाहकार सजमजत को सलाह के जलए मामला भेि सकती ह।ै

9. केन्द्रीय सरकार पिु जचदकत्‍सा महाजिद्यालय या पिु जचदकत्‍सा पाठ्यिम को मान्यता िे सकती ह ै और अजधसूचना द्वारा पिु जचदकत्‍सा महाजिद्यालय या पि ु जचदकत्‍सा पाठ्यिम को अजधजनयम की पहली अनुसूची में िाजमल कर सकती ह।ै अजधसूचना की एक प्रजत केंद्रीय सरकार द्वारा पररषि और संबंजधत जिश्वजिद्यालय को भेिी िाएगी।

10. यदि केंद्रीय सरकार पि ु जचदकत्‍सा महाजिद्यालय या पिु जचदकत्‍सा पाठ्यिम को मान्यता नहीं िेन े का जनणहय लेती ह,ै तो उसके जनणहय के साथ-साथ कारण भी आिेिक को सूजचत दकया िाएगा और उसकी प्रजत पररषि और संबंजधत जिश्वजिद्यालय को भी भेिी िाएगी।

(12) मान्यताप्राप्त पि ु जचदकत्‍सा महाजिद्यालय म ें स्ट्थानों को बढान े के जलए आििे न.- मान्यता प्राप्त पि ु जचदकत्‍सा महाजिद्यालय या पिु जचदकत्‍सा संस्ट्थान म ेंजिद्यार्थहयों की संख्या बढाने के जलए आिेिन, अजधजनयम की पहली अनुसूची में िाजमल दकसी भी महाजिद्यालय या संस्ट्थान द्वारा प्ररूप—I में इन जनयमों द्वारा जनर्िहष्ट िस्ट्तािेिों के साथ सजचि, पिुपालन जिभाग, भारत सरकार को प्रस्ट्ततु दकया िाएगा। आिेिन िो प्रजतयों में िमा दकए िाएंगे, जिसमें से एक प्रजत सजचि, भारतीय पि ु जचदकत्‍सा पररषि को प्रिान की िाएगी।

(14) मान्यताप्राप्त पि ु जचदकत्‍सा अहतह ा का प्रस्ट्ताि करन े िाल े पि ु जचदकत्‍सा महाजिद्यालय या पि ु जचदकत्‍सा सस्ट्ं था की िाजखला क्षमता म ेंिजृ द्ध के जलए आििे न के मल्ू याकं न की प्रदिया: पिु जचदकत्‍सा महाजिद्यालय या पिु जचदकत्‍सा पाठ्यिम िरूु करन े के जलए आिेिन की समीक्षा और िांच, पिु जचदकत्‍सा महाजिद्यालय के जनरीक्षण के जलए जनरीक्षकों की तैनाती, पिु जचदकत्‍सा महाजिद्यालय का जनरीक्षण, पररषि द्वारा जनरीक्षण ररपोटह पर जिचार, जनरीक्षण ररपोटह को संबंजधत पिु जचदकत्‍सा महाजिद्यालय और जिश्वजिद्यालय को भेिना, जनरीक्षण ररपोटह पर पिु जचदकत्‍सा महाजिद्यालय से रटप्पजणयां प्राप्त करना, पररषि की जसफाररि और अनुज्ञा पत्र िारी करने के जलए जनयम 7 म ें जिजनर्िहष्ट प्रदिया आि‍यक उपांतरणों के साथ, जनयम 13 के अधीन िाजखला क्षमता म ेंिृजद्ध के जलए दकए गए आिेिन पर लाग ूहोगी

(15) िल्ु क और बकैं प्रजतभजू त - प्ररूप- I म ें आिेिन के साथ, केिल एक लाख पचास हिार रुपये मात्र का के िल्ु क िेय होगा, िो नई दिल्ली म ेंिेय भारतीय पिु जचदकत्‍सा पररषि के नामे जडमांड ड्राफ्ट या प ेऑडहर के माध्यम स ेिमा दकया िाएगा। जनयम 4 के खंड (i) और (ii) के अंतगहत आन े िाल ेआििे कों को ऐसे आिेिन िल्ु क स ेछूट िी िाएगी।

(2) अनुज्ञा पत्र िारी करने से पहले दकसी भी अनुसूजचत बैंक से 'भारतीय पिु जचदकत्‍सा पररषि' के नामे िस करोड रुपय े की बैंक प्रजतभूजत प्रस्ट्तुत की िाएगी िो पांच साल की अिजध के जलए िैध होगी।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 उि बैंक प्रजतभूजत को आिेिक द्वारा िष ह िर िष ह बढाया िाएगा और दकसी भी समय इस े व्यपगत नहीं होने दिया िाएगा।

16. सलाहकार सजमजत. - केंद्रीय सरकार, अनुज्ञा पत्र िारी करने, या अनुज्ञा पत्र के निीकरण, या दकसी िैक्षजणक िषह के जलए पिु जचदकत्‍सा योग्यता या पिु जचदकत्‍सा महाजिद्यालय की मान्यता के प्रयोिन के जलए, जिसमें पिु जचदकत्‍सा महाजिद्यालय या पिु जचदकत्‍सा अहतह ा को प्रथम अनुसूची में िाजमल करने की जसफाररि भी िाजमल है, या दकसी मान्यता प्राप्त पि ु जचदकत्‍सा महाजिद्यालय में िाजखल े की क्षमता म ें िृजद्ध के संबंध में, जििेषज्ञों की एक सलाहकार सजमजत का गिन कर सकती ह ैऔर जनणहय लेन ेसे पहल ेदकसी भी मामले को संिर्भहत कर सकती ह ैऔर तकनीकी सलाह प्राप्त कर सकती ह।ै

(2) उपजनयम 1 म ेंजनर्िहष्ट सलाहकार सजमजत जनम्नजलजखत सिस्ट्य से जमल कर बनगे ी, अथाहत््ः- i. पिुपालन आयुि, पिपु ालन और डेयरी जिभाग; ii. भारतीय कृजष अनुसंधान पररषि में पि ुजिज्ञान से संबंजधत उप महाजनिेिक;

iii. िो जिश्वजिद्यालयों के कुलपजत या जिनसे संम्बद्ध पि ुजचदकत्‍सा महाजिद्यालयों जिनको पहली अनुसचू ी में िाजमल दकया गया ह,ै को केंद्रीय सरकार द्वारा नाम जनर्िष्टह दकया िाएगा; iv. संबंजधत राज्य सरकार के पिुपालन जिभाग का प्रधान सजचि या सजचि;

(3) इन जनयमों के प्रयोिन के जलए, सलाहकार सजमजत केंद्रीय सरकार को अपेजक्षत सलाह िेन े के प्रयोिन से संबंजधत पि ु जचदकत्‍सा महाजिद्यालय का जनरीक्षण करने के जलए उजचत समझे उसमें पि ुजचदकत्‍सा जनरीक्षक उस संख्या म ेंजनयुि कर सकती ह,ै िैसा िह उजचत समझे।

(4) सलाहकार सजमजत द्वारा जनयिु पि ु जचदकत्‍सा जनरीक्षकों को अजधजनयम की धारा 19 तथा भारतीय पिु जचदकत्‍सा पररषि (जनरीक्षक और आगतं ुक) जिजनयम 1991 के अधीन पररषि द्वारा जनयिु पिु जचदकत्‍सा जनरीक्षकों के सभी अजधकार और कतहव्य होंगे।

(5) यदि दकसी जिजिष्ट मामल े में पररषि द्वारा पहले ही जनरीक्षण कर जलया गया ह ैऔर उसकी ररपोटह केंद्रीय सरकार को प्रस्ट्तुत कर िी गई ह ै तो सलाहकार पररषि नया जनरीक्षण संचाजलत करन े के स्ट्थान पर जिद्यमान जनरीक्षण ररपोटह के आधार पर केंद्रीय सरकार को अपनी सलाह िगे ी और यदि सलाहकार सजमजत आि‍यक समझती ह ैतो िह पि ु जचदकत्‍सा जनरीक्षकों को ऐसे स्ट्पष्टीकरण िने े के जलए समन कर सकती ह ैिो केंद्रीय सरकार को सलाह िेन ेके प्रयोिन के जलए अपेजक्षत हों।

(6) केंद्रीय सरकार द्वारा गरित सलाहकार सजमजत के ऐसे सिस्ट्यों की पिािजध और सेिा की ितें भारत सरकार के अजिभाभी जनयमों के अनुसार होंगी।

17. पहल ेही पहली अनसु चू ी म ेंसजम्मजलत पि ुजचदकत्‍सा महाजिद्यालय या पि ुजचदकत्‍सा सस्ट्ं थाओं का जनरीक्षण.- पिु जचदकत्‍सा संस्ट्थाएं या पि ु जचदकत्‍सा महाजिद्यालय िो पहल े ही सजम्मजलत ह ैंया पहली अनुसूची म ें पि ु जचदकत्‍सा अहतह ा का समय समय पर पररषि द्वारा अजधजनयम की धारा 19 या धारा 20 के उपबंधों के अनुसरण म ेंऔर भारतीय पिु जचदकत्‍सा पररषि (जनरीक्षक और आगंतुक) जिजनयम 1991 के अनुसार जनरीक्षण दकया िाएगा दक क्या इन जनयमों और पिु जचदकत्‍सा जिक्षा जिजनयमों उनके न्यूनतम मानक का अनुपालन दकया िा रहा ह।ै जनरीक्षक/आगंतुक लॉट के ड्रा द्वारा तय होंगे।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

2. जनरीक्षकों द्वारा जनरीक्षण संचाजलत दकए िाने की ििा म ेंजनरीक्षण ररपोटह को पररषि की कायपह ालक सजमजत के समक्ष रखा िाएगा, और आगंतुकों द्वारा जनरीक्षण की ििा में जनरीक्षण ररपोटह को पररषि के अध्यक्ष को प्रस्ट्तुत दकया िाएगा।

3. यदि जनरीक्षण ररपोटह पर जिचार करने के पश्चात पररषि का यह जनष्कष ह होता ह ै दक पररषि द्वारा जनरीक्षण की गई पिु जचदकत्‍सा संस्ट्था या पि ुजचदकत्‍सा महाजिद्यालय के संबंध में अजधजनयम की धारा 21 की उपधारा 1 के खंड क और ख म ेंअजधकजथत पररजस्ट्थजतयां जिद्यमान ह ैंतो पररषि केंद्रीय सरकार को इस प्रभाि का अभ्यािेिन करेगी।

4. यदि ऐसे अभ्यािेिन पर जिचार करने के बाि, केंद्रीय सरकार यह जनष्कषह जनकालती ह ैदक यह एक उपयुि मामला ह,ै तो िह संबंजधत सस्ट्ं थान से प्रजतदिया प्राप्त करन े के जलए संबंजधत राज्य सरकार को उि जसफाररि को भेि सकती ह,ै जिस राज्य में पिु जचदकत्‍सा महाजिद्यालय या पिु जचदकत्‍सा संस्ट्थान अब जस्ट्थत ह।ै

5. संबंजधत राज्य सरकार केंद्रीय सरकार से अभ्यािेिन होने के 30 दिन के भीतर ऐसी अजभयुजियों, िो िह करन े का चयन करें, के साथ उि अभ्यािेिन को संबंजधत पि ु जचदकत्‍सा महाजिद्यालय या पिु जचदकत्‍सक संस्ट्था से राज्य सरकार को उि अभ्यािेिन को राज्य सरकार से प्राप्त करने के 30 दिन के भीतर अपन े स्ट्पष्टीकरण को प्रस्ट्तुत करन े की अपेक्षा के साथ संबंजधत पि ु जचदकत्‍सा महाजिद्यालय पि ुजचदकत्‍सा संस्ट्था को अग्रेजषत करेगी।

6. स्ट्पष्टीकरण प्राप्त करन े के 15 दिन के भीतर या इसम ें उपर जनयम 5 में जिजनर्िहष्ट अिजध के भीतर कोई स्ट्पष्टीकरण प्रस्ट्तुत ना करने पर उस अिजध की समाजप्त पर राज्य सरकार केंद्रीय सरकार को संबंजधत पि ु जचदकत्‍सा महाजिद्यालय पिु जचदकत्‍सा संस्ट्था की मान्यता को समाप्त करने के संबंध में अपनी जसफाररि करेगी।

7. केंद्रीय सरकार, राज्य सरकार से जसफाररि प्राप्त होने के बाि, जनयम 16 में उजल्लजखत सलाहकार सजमजत को संबंजधत पिु जचदकत्‍सा महाजिद्यालय या पिु जचदकत्‍सा संस्ट्थान के मानकों के बारे में आि‍यक िााँच करने के जलए मामला संिर्भहत कर सकती ह ैऔर रेफरल के तीस दिनों के भीतर उसकी ररपोटह िे सकती;

8. केंद्रीय सरकार, रािपत्र म ें अजधसूचना द्वारा जनिेि ि े सकेगी दक संबंजधत पि ु जचदकत्‍सा महाजिद्यालय या पिु जचदकत्‍सा संस्ट्था के जिरुद्ध समुजचत अनुसूची में एक प्रजिजष्ट की िााँच दक संबंजधत महाजिद्यालय पिु जचदकत्‍सा संस्ट्था द्वारा केिल जिजनर्िहष्ट तारीख से पूिह जिद्यार्थहयों को अनुित्त पिु जचदकत्‍सा अहतह ा ही मान्यता प्राप्त पिु जचदकत्‍सा अहतह ा होगी :

9. केंद्रीय सरकार द्वारा उपजनयम (8) के अधीन िारी अजधसूचना की प्रजतयां, पररषि,् सबंजधत राज्य सरकार, संबजधत पिु जचदकत्‍सा महाजिद्यालय या पिु जचदकत्‍सा संस्ट्था और संबंजधत जिश्वजिद्यालय को भेिी िाएंगी;

18. पि ु जचदकत्‍सा महाजिद्यालय पि ु जचदकत्‍सा सस्ट्ं था जिस की मान्यता समाप्त कर िी गई ह ैदक मान्यता की पनु ्ः बहाली.- दकसी ऐसी पि ुजचदकत्‍सा संस्ट्था या पि ुजचदकत्‍सा महाजिद्यालय द्वारा दकसी भी िैजक्षक िषह म ेंजिद्यार्थहयों को िाजखल नहीं दकया िाएगा िब तक दक उसकी मान्यता या उसके द्वारा प्रिान की गई पिु जचदकत्‍सा अहतह ा की मान्यता को पुन्ः बहाल नहीं कर दिया िाता ह।ै

(2) दकसी रद्द पि ु जचदकत्‍सा संस्ट्थान या पि ु जचदकत्‍सा महाजिद्यालय की मान्यता बहाल करन े के जलए, उन कजमयों को िरू करने के बाि, िो उसकी मान्यता रद्द होने का आधार बनी थीं, इन जनयमों द्वारा जनर्िहष्ट[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 11 िस्ट्तािेिों के साथ सजचि, पिुपालन जिभाग, भारत सरकार को आिेिन। आिेिन िो प्रजतयों में िमा दकए िाएंगे, जिसमें स ेएक प्रजत सजचि, भारतीय पिु जचदकत्‍सा पररषि को प्रिान की िाएगी।

(3) पिु जचदकत्‍सा संस्ट्था या पि ु जचदकत्‍सा महाजिद्यालय जिसकी मान्यता समाप्त कर िी गई ह ै की मान्यता बहाल करन े के जलए आिेिन पर जनयम 12 म ें जनर्िहष्ट अनसु ार प्रथम अनुसूची म ें िाजमल करके पि ु जचदकत्‍सा महाजिद्यालय को मान्यता प्रिान करन े के आिेिन के समान कारहिाई की िाएगी।

19. जिद्यार्थयह ों का स्ट्थानातं रण.- यदि कोई पि ु जचदकत्‍सा महाजिद्यालय जिसकी मान्यता समाप्त कर िी गई ह,ै अगले तत्‍काल िैक्षजणक िषह या इंटनहजिप िष ह के प्रारंभ से कम से कम तीन महीन े पहल े अपनी मान्यता बहाल करने म ें असमथह रहता ह ैया यदि कोई पिु जचदकत्‍सा महाजिद्यालय अनुज्ञा पत्र का निीकरण प्राप्त करन ेमें जिफल रहता ह,ै िैसा भी मामला हो, तो उसम ें पहले ही िाजखल दकए गए जिद्यार्थहयों का मूल्यांकन जिश्वजिद्यालय द्वारा उजचत परीक्षा संचाजलत करके ऐस ेमूल्यांकन परीक्षण के आधार पर दकया िाएगा, जिद्यार्थहयों को उसी जिश्वजिद्यालय स ेसंबंद्ध मान्यता प्राप्त पि ु जचदकत्‍सा अहतह ा प्रिान करन े िाल े दकसी अन्य मान्यता प्राप्त जचदकत्‍सा महाजिद्यालय या पि ु जचदकत्‍सा संस्ट्था में केंद्रीय सरकार के अनुमोिन से स्ट्थानांतररत दकया िाएगा्ः परंतु यदि दकसी जिश्वजिद्यालय के पास उस से संबद्ध कोई अन्य पिु जचदकत्‍सा महाजिद्यालय या पि ु जचदकत्‍सा संस्ट्था नहीं ह ै तो ऐसे पिु जचदकत्‍सा महाजिद्यालय जिस की मान्यता समाप्त कर िी गई है, के जिद्यार्थहयों को उसी राज्य जिसमें िह पि ुजचदकत्‍सा महाजिद्यालय जस्ट्थत ह ैजिसकी मान्यता समाप्त कर िी गई ह,ै में जस्ट्थत मान्यता प्राप्त पिु जचदकत्‍सा अहतह ा प्रिान करने िाले मान्यता प्राप्त पिु जचदकत्‍सा महाजिद्यालय या पिु जचदकत्‍सा संस्ट्था को स्ट्थानातं ररत कर दिया िाएगा;

परंतु यह और दक यदि राज्य के भीतर कोई अन्य पिु जचदकत्‍सा महाजिद्यालय या पिु जचदकत्‍सा संस्ट्था नहीं ह ै तो पररषि जिद्यार्थहयों को िेि में मान्यता प्राप्त पि ु जचदकत्‍सा अहतह ा प्रिान करने िाले दकसी अन्य मान्यता प्राप्त पि ु जचदकत्‍सा महाजिद्यालय या पि ु जचदकत्‍सा संस्ट्था म ेंस्ट्थानांतररत करन े के जलए सिि होगी्ः परंतु यह भी दक दक कोई भी पिु जचदकत्‍सा संस्ट्था या पिु जचदकत्‍सा महाजिद्यालय अपनी स्ट्िीकृत सीटों की संख्या के पंद्रह प्रजतित से अजधक छात्रों को िाजखला नहीं िगे ा। यदि मान्यता समाप्त कर िए गए पि ु जचदकत्‍सा महाजिद्यालय की मान्यता बहाल नहीं की िाती ह ै या अनुमजत पत्र का निीकरण नहीं दकया िाता ह,ै िैसा भी मामला हो, तब तक िब तक दक उसमें िाजखल जिद्यार्थहयों को मान्यता प्राप्त पि ु जचदकत्‍सा अहतह ा प्रिान करने िाले दकसी मान्यता प्राप्त पिु जचदकत्‍सा महाजिद्यालय या पिु जचदकत्‍सा संस्ट्था में स्ट्थानांतररत दकए िाने तक िो ऐसे महाजिद्यालय द्वारा प्रस्ट्ततु बैंक प्रजतभूजत को पररषि द्वारा भनु ाया िाएगा, इन जनयमों के तहत छात्रों को स्ट्थानांतररत करने की लागत जिसमें िल्ु क म ेंअंतर भी िाजमल ह,ै उि बैंक प्रजतभूजत के नकिीकरण से िसलू ा िाएगा। अनसु चू ी-1 प्ररूप-I म ेंआििे न प्राप्त करन ेकी अनसु चू ी िम सख्ं या जनपटान ेका स्ट्तर समयसीमा *

3. आिेिक द्वारा त्रुरटयों को िरू करने के पश्चात आिेिन को पुन्ः प्रस्ट्तुत करना आिेिन करन े की जतजथ से 45 दिन

5. केंद्रीय सरकार द्वारा अनज्ञु ा पत्र िारी करना आिेिन करने की जतजथ से 120 दिन जिन सभी महाजिद्यालयों के जलए िून के तीसिें दिन से पहल ेअनुज्ञा पत्र िारी दकया िाता ह,ै उन्ह ेंआगामी िैजक्षक िषह के जलए पाठ्यिम में छात्रों को िाजखला िेन े की अनुमजत िी िाएगी। *केंद्रीय सरकार समय सीमा में आि‍यक छूट ि ेसकती ह।ै अनसु चू ी - II

1. पि ुजचदकत्‍सा महाजिद्यालय की मान्यता के जलए आििे क द्वारा प्ररूप-1 म ेंआििे न प्रस्ट्ततु करन ेस ेपिू हन्यनू तम अपक्षे ाएं:— िैसा दक MSVE जिजनयमों में जिजहत ह।ै a. आिेिक के पास 15 एकड स ेअन्यून भूजम होनी चाजहए चाह ेस्ट्िाजमत्‍ि के माध्यम स ेया 30 िष ह या अजधक के पट्टे पर हो, जिस ेपि ुजचदकत्‍सा महाजिद्यालय के जलए जचजन्हत दकया गया हो। b. पि ु जचदकत्‍सा महाजिद्यालय के पास एक प्रिासजनक खडं होगा जिसमें जनम्नजलजखत सुजिधाए ं होंगी, अथाहत्ः् - i. डीन या प्राचाय हका कक्ष ii. िैयजिक कमहचारीिृंि कक्ष iii. सजमजत कक्ष iv. आगतं ुक कक्ष v. िैजक्षक, लेखा और स्ट्थापना अनुभागों के कमहचारीिृंि के जलए कक्ष vi. अजभलेख कक्ष vii. केंद्रीय भंडार कक्ष viii. आगतं ुकों और कमहचारी िृंि के जलए प्रसाधन सुजिधाएं c. पि ु जचदकत्‍सा महाजिद्यालय द्वारा MSVE जिजनयमों के अनुसार जनम्नजलजखत की भती की गई होगी, अथाहत ्:- i. डीन/प्राचायह और उनके िैयजिक कमहचारीिृंि। ii. महाजिद्यालय के जलए कमहचारीििृं ।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 13 iii. पुस्ट्तकालय के जलए कमहचारीिृंि। d. उपरोि के अजतररि पि ु जचदकत्‍सा महाजिद्यालय म ेंजनम्नजलजखत आम सुजिधाए ंहोंगीं अथाहत्ः-

7. गेम और िीडा सुजिधाएं जिसके अंतगहत इंडोर गेम्स सुजिधाएं भी िाजमल हैं

8. बालकों और बाजलकाओं के जलए अलग-अलग छात्रािास

9. पररिहन सुजिधाएं

10. केंद्रीय कंप्यूटर प्रयोगिाला

5. राज्य सरकार या यथाजस्ट्थजत, संघ राज्यक्षेत्र सरकार या प्रिासन द्वारा िारी अजनिायहता प्रमाणपत्र (प्ररूप III) (प्ररूप X)।

6. दकसी जिश्वजिद्यालय द्वारा िारी संबद्धता की सहमजत के पत्र (फॉमह IV)/(फॉमह-XI) की प्रमाजणत प्रजत या दकसी जिश्वजिद्यालय द्वारा िारी संबद्धता या अस्ट्थायी संबद्धता का पत्र/प्रमाणपत्र।

7. पिु जचदकत्‍सा महाजिद्यालय में उपलब्ध भौजतक और अन्य सुजिधाओं को सत्‍यापन करन े िाली संबंजधत जिश्वजिद्यालय की ररपोटह (प्ररूप V)।

8. पत्र या अनुज्ञा या अनुज्ञा पत्र के निीकरण या प्रथम अनुसूची म ेंिाजमल दकए िाने की अजधसचू ना की प्रमाजणत प्रजत।

9. एक जिस्ट्तृत पररयोिना ररपोटह, जिसमें भिन कायहिम, जिक्षण कायहिम, उपस्ट्कर कायहिम और िनिजि कायहिम सजम्मजलत हों।

10. सक्षम प्राजधकारी द्वारा िारी स्ट्िाजमत्‍ि के सबूत के रूप में उपलब्ध कुल भूजम के संबंध में हक जिलेख/जििय जिलेख/उपहार जिलेख/दकसी अन्य िस्ट्तािेि की प्रमाजणत प्रजत।

अनुमोदित दकया गया हो।

15. िास्ट्तुजिि ् पररषि (COA) के पास रजिस्ट्टीकृत िास्ट्तुजिि ् द्वारा प्रमाजणत सभी जिद्यमान जनयोजित भिनो की तल-िार योिना, और प्रत्‍येक कक्ष का कापेट क्षेत्र (िग हफुट में), और ऊंचाई।

16. आिेिक की पिु जचदकत्‍सा महाजिद्यालय में जनयोजित संकाय स ेघोषनाएं (प्ररूप VI)।

1. पिुजचदकत्‍सा महाजिद्यालय का प्रबंधन केंद्रीय सरकार द्वारा जिरजचत जनयमों में जिजनर्िहष्ट मानकों और दििाजनिेिों के अनुसार तथा समय समय पर भारतीय पिु जचदकत्‍सा पररषि द्वारा जिरजचत अभी जनयमों के अनुसार अिसंरचना, अनुिेिात्‍मक और अन्य सुजिधाओं को कराने के जलए िायी होगा।

2. जिद्यार्थहयों का िाजखला पात्रता ितों को पूरा करन े के पश्चात राज्य सरकार या जिश्वजिद्यालय द्वारा उसकी नीजत के अनुसार संचाजलत प्रििे परीक्षा में जिद्यार्थहयों द्वारा हाजसल योग्यता के आधार पर दकया िाएगा।

3. राज्य सरकार की नीजत के अनुसार अनुसूजचत िाजत/अनुसूजचत िनिाजत / अन्य जपछडे िगों या जनिि व्यजियों और अन्य प्रिगों के जलए स्ट्थानों का आरक्षण होगा।

4. पिु जचदकत्‍सा महाजिद्यालय में िाजखला केिल केंद्रीय सरकार द्वारा अनुित्त अनुज्ञा के पश्चात ही दकया िाएगा।

5. केंद्रीय सरकार और / भारतीय पिु जचदकत्‍सा पररषि द्वारा जिजनर्िहष्ट अहतह ा के अनुसार युजियिु रुप स ेव्यापक जिज्ञापन द्वारा और सम्यक रूप स ेगरित चयन सजमजत की जसफाररि के आधार पर या संबद्धकारी जिश्वजिद्यालय के मानकों के अनुसार जनयजमत आधार पर पणू हकाजलक कमहचारीिृंि की जनयुजि की िाएगी।।

6. अंिकालीन कमहचारीिृंि की जनयुजि राज्य सरकार या संबद्धकारी जिश्वजिद्यालय के दििाजनिेिों के अनुसार की िाएगी।

7. पिु जचदकत्‍सा महाजिद्यालय भारतीय पिु जचदकत्‍सा पररषि अजधजनयम 1984 के अधीन समय-समय पर जिजनर्िहष्ट सभी ितों और मानकों का पालन करेगा और सभी कायहिमों का संचालन ईमानिारी पूिहक करेगा तथा दकसी भी समय भारतीय पिु जचदकत्‍सा पररषि द्वारा जनरीक्षण के जलए स्ट्ियं को प्रस्ट्ततु करेगा।

8. ...... (सोसाइटी या न्यास या महाजिद्यालय या संस्ट्था आदि का नाम) द्वारा भारतीय पिु जचदकत्‍मा पररषि या केंद्रीय सरकार के सजन्नयमों और मानकों तथा अजधकजथत या जिजनर्िहष्ट अन्य ित ह के संबंध म ें अननुपालन की ििा में भारतीय पिु जचदकत्‍सा पररषि या केंद्रीय सरकार उसकी मान्यता या अनज्ञु ा को प्रभािी रूप से िापस लेन े के जलए दकसी अन्य मुद्दे पर जिचार दकए जबना सभी आि‍यक किम उिान े के जलए स्ट्ितत्रं होंग े और ऐसे मान्यता िापस लेन ेसे सभी प्रकार के उत्तरिाजयत्‍ि पिुजचदकत्‍सा महाजिद्यालय या उसके िासी जनकाय के होंगे।

9. पिु जचदकत्‍सा महाजिद्यालय के िासी जनकाय ने भारतीय पि ु जचदकत्‍सा पररषि द्वारा अनुज्ञा िने े या मान्यता प्रिान करने के जलए उपिर्िहत सभी संजनयमों और ितों को िेख जलया है, उनका अध्ययन कर जलया ह ै तथा उन्ह ेंसमझ जलया ह ैजिसके अंतगहत यथाजस्ट्थजत पिुजचदकत्‍सा जिक्षा के न्यूनतम मानकों द्वारा प्रस्ट्ताजित कायहिम के जलए उपिर्िहत जिजनयम भी ह ैं तथा िह उनको परू ा करत े ह ैंया जनरीक्षण के समय उनको परू ा कर सकत े हैं, िैसा भी मामला हो, जिसके ना हो सकने पर िह प्रजतकूल जिजनश्चय को स्ट्िीकार करन े के जलए तैयार ह।ै

10. िासी जनकाय स्ट्िीकार करती ह ैदक दकसी भी जनयम या जिजनयम के उल्लंघन पर भारतीय पिुजचदकत्‍सा पररषि को िमा बैंक गारंटी समपहृत कर ली िाएगी।

7. पिु जचदकत्‍सा महाजिद्यालय भारतीय पिु जचदकत्‍सा पररषि अजधजनयम 1984 के अधीन समय-समय पर जिजनर्िहष्ट सभी ितों और मानकों का पालन करेगा और सभी कायहिमों का संचालन ईमानिारी पूिहक करेगा तथा दकसी भी समय भारतीय पिु जचदकत्‍सा पररषि द्वारा जनरीक्षण के जलए स्ट्ियं को प्रस्ट्ततु करेगा।

NOTIFICATION New Delhi, the 8th October, 2026 G.S.R. 876(E).— The following draft rules, which the Central Government proposes to make In exercise of the powers conferred by sub-section (1) of section 64 read with sections 15 and 21 of the Indian Veterinary Council Act, 1984 (52 of 1984), is hereby published for information of persons likely to be affected thereby; after supersession of the Veterinary Council of India (Procedure for Recognition and De-recognition of Veterinary Colleges and Veterinary Qualifications) Rules, 2017; except as respects things done or omitted to be done before such supersession; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of thirty days from the date on which the copies of this notification as published in the Official Gazette, are made available to the public;

Objections and suggestions to these draft rules, if any, may be sent to the Additional Secretary to Government of India, Ministry of Fisheries, Animal Husbandry and Dairying, Department of Animal Husbandry and Dairying, Krishi Bhawan, Dr. Rajendra Prasad Road, New Delhi-110001 or on email jslh-dadf@nic.in;

Objections and suggestions, if any, received from any person in respect of said draft rules before the expiry of the a foresaid period of thirty days will be taken into consideration by the Central Government.

1. Short title and commencement.- These rules may be called the Veterinary Council of India (Procedure for Recognition and De-recognition of Veterinary Colleges and Veterinary Qualifications) Rules, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.- In these regulations, unless the context otherwise requires, — a. ‘Act’means the Indian Veterinary Council Act, 1984 (52 of 1984); b. ‘Advisory Committee’means the committee constituted by the Central Government under rule 16.

c. “Council”means the Veterinary Council of India established under Section 3 of the Act; d. “Form”means a form annexed to these rules; e. “First Schedule”means the First Schedule to the Act f. “MSVE Regulations” means the Veterinary Council of India Minimum Standards of Veterinary Education - (Bachelor of Veterinary Science and Animal Husbandry- Degree Course) Regulations, 2016 as notified by the Veterinary Council of India as amended or superseded from time to time.

g. “President” means the President of the Council; h. “Provisionally recognised veterinary college”means a veterinary college which is not included in the First Schedule and where admissions of students are allowed by the Central Government by grant and renewal of letter of permission under these rules.

i. “Recognised veterinary college”means a Veterinary College recognised by the Central Government by including it in the First Schedule in the manner specified in the Act and these rules; j. “Recognised veterinary qualification” means recognised veterinary qualification as defined in clause (e) of

Section 2 of the Act; k. “Schedule” means a schedule annexed to these rules; l. “University” means a university established or incorporated by or under a Central Act, a Provincial Act or a State Act granting veterinary qualification through its constituent or affiliated veterinary college;

m. “Veterinary College” means a college or institution, being either a constituent college of a University or affiliated to a University, and engaged in teaching of Bachelor of Veterinary Science and Animal Husbandry degree course or any other veterinary qualification;

i. “Veterinary Institution”means the institutions as defined in clause (j) of Section 2 of the Act;

(2) Words and expressions used in these rules and not defined but defined in the Act shall have the same meaning as assigned to them in the Act.40 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

3. Recognition of veterinary colleges.- No person shall establish a Veterinary College and no existing Veterinary College shall admit students or increase the intake of students beyond the permitted number, except after obtaining prior permission from the Central Government in accordance with these rules.

4. Eligibility Criteria for recognition of veterinary colleges. - The following organisations shall be eligible to apply in Form—I for recognition of a veterinary college or veterinary qualification, namely:— i. a State Government or Union territory Administration;

ii. a University; iii. an autonomous body established by the Central and State Government by or under a statute; iv. a society registered under the Societies Registration Act, 1860 (21 of 1860) or a n y other Act in a State ;

v. a public religious or charitable trust created and registered under any Act, in force in the State or a waqf registered under the Waqf Act,1995 (43 of 1995); vi. a section 8 company incorporated under the Companies Act, 2013;

5. Qualifying criteria.- The organizations eligible under Rule 4 shall qualify to apply for recognition of Veterinary College or a Veterinary qualification, if the following conditions are fulfilled, namely:— a. in case the applicant falls in any of the categories other than the categories under clauses (i), (ii) and (iii) of

Rule 4, it should have imparting of veterinary education and training as one of its main objectives; b. having suitable contiguous land of the size, as specified under the MSVE regulations, to house all structures and encamp all the facilities, owned and possessed by the applicant or possessed by the applicant under a lease of thirty years or more.

Provided that, the Instructional Livestock Farm Complex may be, within a radius of Thirty Kilometers of the campus of the Veterinary College.

Provided further that, all such permissions as may be necessary for construction, establishment, maintenance and operation of the Veterinary College, including a veterinary hospital or veterinary clinical complex and instructional livestock farm complex, has been taken from the competent government agency;

c. owning and managing a veterinary clinical complex or a veterinary hospital or has an arrangement with a State veterinary hospital, and an Instructional Livestock Farm Complex, as laid down in the MSVE regulations, equipped with all infrastructural facilities as specified therein and the veterinary hospital.

Veterinary Clinical Complex, if owned by the applicant, shall be within the campus of the Veterinary College; In case the applicant has an arrangement it shall be within twenty kilometers from the campus of veterinary college;

d. recruited teaching and non-teaching staff required for the first academic year, as specified in MSVE regulations; e. have set up, the required infrastructural facilities for the first and second academic years, as stipulated in the MSVE regulations and Schedule II;

f. the Veterinary College shall not have the words such as, Government' or 'Indian' or 'National' or 'All India' or any other names prohibited under the Emblems and Names (Prevention of Improper Use), 1950 as part of its name in any form so as to give an impression that the said Veterinary College belongs to or is managed by the Government or has Government patronage and these restrictions shall not be applicable for those Veterinary Colleges which are established by or under and with the name approved by the State or Central Government.

(6) Application for starting of a Veterinary College or veterinary qualification.- The application for starting of a Veterinary College or veterinary qualification shall be submitted in Form—I by any of the organisations eligible under

Rule 4, along with the documents as may be specified by these rules, to the Secretary, Department of Animal Husbandry, Government of India. The applications shall be submitted in duplicate with one copy provided to the Secretary, Veterinary Council of India.

(2) The application under sub-rule (1) of Rule 6 shall be accompanied by the documents as specified in Form-I.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 41

(7) Procedure for evaluation of the application for starting of a veterinary college or veterinary course.- The council shall scrutinise the applications and any application that is found incomplete in any respect or where the applicant does not meet the eligibility or qualification criteria, shall be returned by the Council to the applicant, with a copy marked to the Central Government, pointing out the deficiencies observed in the application during the scrutiny and giving an opportunity to the applicant to rectify the said deficiencies within the time specified in Schedule I.

Provided the Central government may refer the matter to the advisory committee referred to in rule 16 if the council fails to take action on any application as per Schedule I.

2. The applications which are found complete and where the applicant fulfills the criteria under Rule 4 and 5, shall be placed before the Executive Committee of the Council constituted under Section 12 of the Act, which shall examine the said applications on the basis of the requirements stipulated in these rules and the requirements under the MSVE regulations.

3. Upon examination of the application, if the Executive Committee decides that it is a fit case for conducting physical inspection of the Veterinary College, it shall depute such number of inspectors as if deemed necessary for inspection of the Veterinary College in accordance with the provision of Section 19 of the Act, the minimum standard of veterinary education regulations. The deputation of the inspectors shall be by draw of a lot.

4. Where the Council forms an opinion that the application is liable to be rejected without conducting a physical inspection, it shall recommend to the central government for rejection along with the reasons for such recommendation. Central government may refer the matter back to the council for reconsideration stating the reasons for such reference in writing. or Central government may refer the matter to the advisory committee referred to in rule 16 for its advice.

5. After the inspection is completed, the inspectors shall prepare a report on the adequacy of the standards of veterinary education including infrastructure, staff, equipment and other facilities available at the Veterinary College infrastructure and shall submit the same to the Executive Committee of the Council.

6. The Executive Committee, after considering the report mentioned in sub-rule (6), shall send a copy of the said report, with such remarks as may be necessary, to the applicant seeking comments on the contents of the said report and a copy of the inspection report shall be forwarded by the Council to the concerned University.

7. after receipt of the comments from the Veterinary College, the Council shall forward the inspectors' report mentioned in sub-rule (6), along with the Executive Committee's remarks and the comments received from the applicant to the Central Government with a specific recommendation regarding issue a Letter of Permission to the applicant.

8. where the Council recommends to the Central Government against the issue of Letter of Permission to the applicant, it shall submit its reasons for such recommendation in writing. Central government may refer the matter back to the council for reconsideration stating the reasons for such reference in writing. or Central government may refer the matter to the advisory committee referred to in rule 16 for its advice.

9. the Central Government may issue a Letter of Permission to the applicant permitting the applicant to admit students to the Veterinary College in accordance with these rules, on submission of bank guarantee referred to in Sub-rule (2) of Rule 15 and a copy of the Letter of Permission shall also be forward by the Central Government to the Council and the concerned University. Provided the Central Government shall exempt applicants in category (i) and (ii) of rule 4 from submission of bank guarantee referred to in Sub-rule (2) of

Rule 15.

10. If the Central Government decides not to issue the Letter of Permission, its decision along shall be conveyed to the applicant, with a copy to the Council and the concerned University. Provided the fee paid by the applicant along with the application shall not be refunded.

8. Letter of Permission.- The Letter of Permission shall be granted for the first two academic years and the Veterinary College shall only be allowed to admit students for the first and second academic years.

9. Renewal of letter of permission.-

1. The application for renewal of letter of permission shall be submitted in Form-I by any of the organisations possessing letter of permission, along with the documents as may be specified by these rules, to the Secretary, Department of Animal Husbandry, Government of India. The applications shall be submitted in duplicate with one copy provided to the Secretary, Veterinary Council of India.42 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

2. The application under sub-rule (1) of Rule 9 shall be accompanied by the documents as specified in Form-I.

3. All applications under these rules for renewal of the Letter of Permission shall be processed according to the time- schedule specified in Schedule III.

10. Procedure for evaluation of the application for renewal of Letter of Permission.-The council shall scrutinise the applications and any application that is found incomplete in any respect or where the applicant does not meet the eligibility or qualification criteria, shall be returned by the Council to the applicant, with a copy marked to the Central Government, pointing out the deficiencies observed in the application during the scrutiny and giving an opportunity to the applicant to rectify the said deficiencies within the time specified in Schedule II.

7. after receipt of the comments from the Veterinary College, the Council shall forward the inspectors' report mentioned in sub-rule (5), along with the Executive Committee's remarks and the comments received from the applicant to the Central Government with a specific recommendation regarding issue a Letter of Permission to the applicant.

8. where the Council recommends to the Central Government against the issue of Letter of Permission to the applicant, it shall submit its reasons for such recommendation in writing. Central government may refer the matter back to the council for reconsideration stating the reasons for such reference in writing or may refer the matter to the advisory committee referred to in rule 16 for its advice.

9. the Central Government may issue a renewal of Letter of Permission to the applicant permitting the applicant to admit students to the Veterinary College for the third and fourth years in accordance with these rules and a copy of the renewal of Letter of Permission Letter shall also be forward by the Central Government to the Council and the concerned University.

10. If the Central Government decides not to issue a renewal of Letter of Permission, its decision along shall be conveyed to the applicant, with a copy to the Council and the concerned University.

11. Application for recognition of a Veterinary College or Veterinary Qualification by inclusion in the First Schedule.- (1) The application for recognition of Veterinary College or Veterinary Qualification shall be submitted in Form- I by any of the organisations possessing renewal of letter of permission or fulfilling all the requirements as specified in MSVE Regulations, along with the documents as may be specified by these rules, to the[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 43 Secretary, Department of Animal Husbandry, Government of India. The applications shall be submitted in duplicate with one copy provided to the Secretary, Veterinary Council of India.

2. The application under sub-rule (1) of Rule 11 shall be accompanied by the documents as specified in Form- I.

3. All applications under these rules for recognition of a veterinary college or a veterinary course shall be processed according to the time-schedule specified in Schedule III.

12. Procedure for evaluation of the application for recognition of a Veterinary College or Veterinary Qualification by inclusion in the First Schedule.-.- The council shall scrutinise the applications and any application that is found incomplete in any respect or where the applicant does not meet the eligibility or qualification criteria, shall be returned by the Council to the applicant, with a copy marked to the Central Government, pointing out the deficiencies observed in the application during the scrutiny and giving an opportunity to the applicant to rectify the said deficiencies within the time specified in Schedule III.

Provided the Central government may refer the matter to the advisory committee referred to in rule 16 if the council fails to take action on any application as per Schedule III.

2. The applications which are found complete and where the applicant fulfills the criteria specified in Schedule II and MSVE Regulations, shall be placed before the Executive Committee of the Council constituted under

Section 12 of the Act, which shall examine the said applications on the basis of the requirements stipulated in these rules and the requirements under the MSVE regulations.

3. Upon examination of the application, if the Executive Committee decides that it is a fit case for conducting physical inspection of the Veterinary College, it shall depute such number of inspectors as if deemed necessary for inspection of the Veterinary College in accordance with the provision of Section 19 of the Act, the minimum standard of The deputation of the inspectors shall be by draw of a lot.

4. Where the Council forms an opinion that the application is liable to be rejected without conducting a physical inspection, it shall recommend to the central government for rejection along with the reasons for such recommendation. Central government may refer the matter back to the council for reconsideration stating the reasons for such reference in writing. or Central government may refer the matter to the advisory committee referred to in rule 16 for its advice.

5. After the inspection is completed, the inspectors shall prepare a report on the adequacy of the standards of veterinary education including infrastructure, staff, equipment and other facilities available at the Veterinary College infrastructure and shall submit the same to the Executive Committee of the Council.

6. The Executive Committee, after considering the report mentioned in sub-rule (5), shall send a copy of the said report, with such remarks as may be necessary, to the applicant seeking comments on the contents of the said report and a copy of the inspection report shall be forwarded by the Council to the concerned University.

7. after receipt of the comments from the Veterinary College, the Council shall forward the inspectors' report mentioned in sub-rule (5), along with the Executive Committee's remarks and the comments received from the applicant to the Central Government with a specific recommendation regarding recognition of the veterinary college or veterinary course.

8. where the Council recommends to the Central Government against the recognition of the veterinary college or veterinary course, it shall submit its reasons for such recommendation in writing. Central government may refer the matter back to the council for reconsideration stating the reasons for such reference in writing or m a y refer the matter to the advisory committee referred to in rule 16 for its advice.

9. the Central Government may recognize the veterinary college or veterinary course and by notification include the veterinary college or the veterinary course in first schedule of the Act. A copy of the notification shall be forwarded by the Central Government to the Council and the concerned University.

10. If the Central Government decides not to recognize the veterinary college or veterinary course, its decision along with the reasons shall be conveyed to the applicant, with a copy to the Council and the concerned University.

(13) Application for increasing the admission capacity in the recognised Veterinary College.-An application for increasing the number of intake of students in the recognised Veterinary College or Veterinary Institution shall be submitted in Form—I by any of the colleges or institutions included in the first schedule of the act, along with the44 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] documents as may be specified by these rules, to the Secretary, Department of Animal Husbandry, Government of India.

The applications shall be submitted in duplicate with one copy provided to the Secretary, Veterinary Council of India.

(14) Procedure for evaluation of application for increase in admission capacity of a recognised Veterinary College

or a Veterinary Institution offering a recognised Veterinary Qualification:- The procedure specified in Rule 7 for scrutiny and examination of the application for startingof veterinary college or veterinary course, deputation of inspectors for inspecting the Veterinary College, inspection of the Veterinary College, consideration of the inspection report by the Council, sending of the inspection report to the concerned Veterinary College and the University, receipt of comments from the Veterinary College on the inspection report, recommendation of the council and the issue of Letter of Permission shall apply mutatis mutandis to the application for increasing the admission capacity made under

Rule 13.

(15) Fee and Bank Guarantee-The applications in Form-I, shall be accompanied with a fee of rupees one lakh fifty thousand only to be deposited by way of a Demand Draft or Pay Order in the name of Veterinary Council of India, payable at New Delhi. Applicants falling under clauses (i) and (ii) of Rule 4 shall be exempted from such application fee.

(2) A bank guarantee of rupees ten crores shall be submitted in favor of ‘the Veterinary Council of India’ from any Schedule Bank valid for a period of five years before the issue of Letter of Permission. The said bank guarantee shall be extended from year to year by the applicant and shall at no point be allowed to lapse.

16. Advisory Committee. - The Central Government may, for the purpose of issue of letter of permission, or renewal of letter of permission, o r recognition of Veterinary Qualification or Veterinary College for any academic year, including the recommendation for inclusion of the Veterinary College or the Veterinary Qualification in the First Schedule, or in respect of an application for increasing the admission capacity of a recognised Veterinary College, constitute an Advisory Committee of experts and refer any matter and obtain technical advice before taking decision.

(2) The Advisory Committee referred to in sub-rule (1) shall comprise of the following members, namely:— i. the Animal Husbandry Commissioner, Department of Animal Husbandry and Dairying; ii. the Deputy Director General, Indian Council of Agricultural Research dealing with Animal Sciences.

iii. Vice Chancellors of two Universities which, or Veterinary Colleges affiliated to which, are included in the First Schedule, to be nominated by the Central Government; iv. Principal Secretary or Secretary, Department of Animal Husbandry, of the concerned State;

(3) For the purpose of these rules, the Advisory Committee may appoint such number of veterinary inspectors as it may deem fit to inspect the concerned Veterinary College for the purpose of rendering the required advice to the Central Government.

(4) The veterinary inspectors appointed by the Advisory Committee shall have all the rights and duties of the veterinary inspectors appointed by the Council under Section 19 of this Act and the Veterinary Council of India (Inspectors and Visitors) Regulations, 1991.

(5) If in a particular case, an inspection has already been conducted by the Council and report thereof submitted to the Central Government, the Advisory Committee may instead of conducting a fresh inspection, tender its advice to the Central Government on the basis of the existing inspection report and if the Advisory Committee deems necessary, it may summon the concerned veterinary inspectors to provide such explanations and clarifications as may be required for the purpose of tendering its advice to the Central Government.

(6) The terms and conditions of services of such members of the Advisory Committee constituted by the Central Government shall be as per the prevailing Rules of the Government of India.

17. Inspection of Veterinary Colleges or Veterinary Institutions already included in the First Schedule.- The Veterinary Institutions or Veterinary Colleges which are already included or Veterinary[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 45 Qualifications in the First schedule, shall be inspected by the Council from time to time, in accordance with the provisions of Sections 19 or 20 of the Act and the Veterinary Council of India (Inspectors and Visitors) Regulations, 1991, to oversee the compliance of these rules and minimum standard of veterinary education regulations. The inspectors/ visitors shall be by a draw of lot.

2. In the event of the inspection being conducted by Inspectors, the inspection report shall be placed before the Executive Committee of the Council, while in the event of inspection by Visitors, the inspection report shall be submitted to the President of the Council.

3. If upon considering the inspection report, the Council comes to a conclusion that the circumstances as laid down in clause (a) a n d ( b ) of sub-sections (1) of Section 21 of the Act exist in respect of the Veterinary Institution or Veterinary College inspected by the Council, the Council shall make a recommendation to that effect to the Central Government.

4. If upon consideration of such representation, the Central Government concludes it to be a fit case, it may, send the said recommendation to the concerned State Government the State in which the Veterinary College or Veterinary Institution is situated for obtaining the responses of the concerned institution.

5. The concerned State Government shall, within thirty days of the receipt of the representation from the Central Government, forward the said representation along with such remarks as it may choose to make to the concerned Veterinary College or Veterinary Institution, requiring the concerned Veterinary College or Veterinary Institution to submit its explanation to the State Government within thirty days of the receipt of the said representation from the State Government.

6. Within fifteen days of the receipt of the explanation or, where no explanation is submitted within the period specified in sub-rule (5) hereinabove, then on expiry of that period, the State Government shall make its recommendation to the Central Government regarding the de-recognition of the Veterinary College or Veterinary Institution.

7. The Central Government may, after the receipt of recommendation from the state Government refer the matter to Advisory committee referred to in rule 16 to make such inquiries into the standards of the concerned Veterinary College or Veterinary Institution as may be necessary and its report within thirty days of referral;

8. The Central Government may, by notification in the Official Gazette, direct that an entry shall be made in the appropriate Schedule against the concerned Veterinary College or Veterinary Institution declaring that a Veterinary Qualification granted to students of the concerned Veterinary College or Veterinary Institution shall be a recognised Veterinary Qualification only when granted before a specified date;

9. The copies of the notification issued by the Central Government under sub-rule (8) shall be sent to the Council, the concerned State Government, the concerned Veterinary College or Veterinary Institution and the concerned University;

18. Restoration of recognition of de-recognised Veterinary College or Veterinary Institution.- A de-recognised Veterinary Institution or Veterinary College, shall not admit students for any of its academic years until such time that its recognition or the recognition of the Veterinary Qualification granted by it is restored.

(2) An application for restoration of recognition of a de-recognised Veterinary Institution or Veterinary College after removal of the deficiencies which had formed the basis of its de-recognition along with the documents as may be specified by these rules, to the Secretary, Department of Animal Husbandry, Government of India. The applications shall be submitted in duplicate with one copy provided to the Secretary, Veterinary Council of India.

(3) An application for restoration of recognition of a de-recognised Veterinary Institution or Veterinary College shall be processed similar to the application for grant of recognition to a Veterinary College by its inclusion in the First Schedule as specified in Rule 12.

19. Shifting of students.- If a de-recognised Veterinary College fails to restore its recognition or if a veterinary college fails to obtain renewal of letter of Permission, as the case may be, at least three months before the commencement of the next immediate academic year or internship year, the students already admitted therein shall be assessed by the University by conducting appropriate tests and based on the results of such assessment tests, the students may be shifted to another recognised Veterinary College or Veterinary Institution granting a recognised Veterinary Qualification affiliated to the same University by the Council, with the approval of Central Government;46 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

Provided that if the University has no other Veterinary Colleges or Veterinary Institution affiliated to it, the students of the de-recognised Veterinary College shall be shifted by the Council to a recognised Veterinary College or Veterinary Institution granting a recognised Veterinary Qualification within the same State within which the de- recognised Veterinary College is situated;

Provided that further that if there is no other Veterinary College or Veterinary Institution within the said State, the Council shall be empowered to shift the students to any other recognised Veterinary College or Veterinary Institution granting a

recognised Veterinary Qualification in the country:

Provided also that no Veterinary Institution or Veterinary College shall not admit any more students than fifteen percent of its sanctioned number of seats.

(2) If the recognition of a de-recognised Veterinary College is not restored or the renewal of letter of permission is not obtained, as the case may be, till such time that the students admitted to it need to be shifted to a recognised Veterinary College or Veterinary Institution granting a recognised Veterinary qualification, the bank guarantee submitted by such college shall be enchased by the Council, the cost of transferring the students including the differences in the fees, under these rules shall be met with the amount realised from encashment of the said bank guarantee.

1. Minimum requirements prior to submission of the application in Form—I by the applicant for

recognition of Veterinary College:— as prescribed in MSVE Regulations. a. The applicant should have not less than 15 acres of land in its posession, whether by way of ownership or lease of 30 years or more, earmarked for the Veterinary College.

b. The Veterinary College shall have an Administrative Block with the following facilities, namely:— i. Dean or Principal's office room, ii. Room for personal staff, iii. Committee room, iv. Visitors' room, v. Rooms accommodating office staff of Academic, Accounts and Establishment Sections, vi. Record room, vii. Central store room, viii. Toilet facilities for visitors and office staff, c. The Veterinary College shall have recruited the following manpower, as per MSVE

Regulations namely:— i. Dean/Principal and his personal staff ii. Staff for the College iii. Staff for the Library d. In addition to the above, the Veterinary College shall have the following common facilities, namely— i. College Library equipped with books, journals and periodicals; internet connectivity and reading rooms with adequate seating facility.

ii. An auditorium with minimum seating capacity of 300; iii. A Canteen; iv. A Conference Hall with with minimum seating capacity of 100; v. Two lecture halls with minimum seating capacity of 100 each; vi. Facilities for games and sports including indoor facilities;

vii. Separate hostels for boys and girls; viii. Transport facilities ix. Central Computer lab; x. Photography Unit with all facilities • The following departments shall be established in the Veterinary College with teaching faculty, buildings, manpower and equipment as stipulated in MSVE Regulations:

i. Veterinary Anatomy, ii. Veterinary Physiology iii. Veterinary Biochemistry, iv. Livestock Production Management, v. Animal Nutrition vi. Animal Genetics and Breeding vii. Livestock Products and Technology viii. Veterinary Microbiology ix. Veterinary Pathology x. Veterinary Clinical Complex, xi. 2. Minimum requirements prior to submission of the application for renewal of Letter of

Permission:

The following departments shall be established in the Veterinary College with teaching faculty, buildings, manpower and equipment as stipulated in MSVE Regulations before submission of the application for Renewal of Letter of Permission to

the Central Government: i. Poultry Science, ii. Veterinary Pharmacology and Toxicology,

(3) Minimum requirements prior to submission of application in for Final Recognition of the Veterinary College The following departments shall be established in the Veterinary College with teaching faculty, buildings, manpower and equipment as stipulated in MSVE Regulations before

submission of the application for final recognition of the veterinary college to the Central Government: i. Veterinary Parasitology, ii. Veterinary Public Health and Epidemiology, iii. Veterinary and Animal Husbandry Extension Education.

iv. Veterinary Surgery and Radiology, v. Veterinary Medicine, vi. Veterinary Gynaecology and Obstetrics.
