िवतरण लाइस1सधारी ने िबजली के कने’ शन को हटाने या काटने क(cid:13) धमक(cid:13) दी ह ै या ऐसा करने क(cid:13) संभावना ह,ै और अिधिनयम या उसके अंतगत(cid:24) बनाए गए Fकसी िनयम एवं िविनयम के Fकसी (cid:25)ावधान या आयोग के Fकसी आदेश का उOल ंघन Fकया ह ै या ऐसा करने क(cid:13) संभावना ह,ै बशत M Fक लोकपाल को ऐसे मामल(cid:30) म1 िनण(cid:24)य दने े का अिधकार हो: बशतM आग े यह Fक उन मामल(cid:30) को ELECTRICITY REGULATORY COMMISSION (For the State of Goa and Union Territories) NOTIFICATION Gurgoan, the 1st January, 2015 No. JERC-3/2009.—In exercise of powers conferred under Section 181 read with Section 42(6) and (7) of the Electricity Act, 2003 ( 36 of 2003) and all other powers enabling it in this behalf, the Joint Electricity Regulatory Commission (for the State of Goa and Union Territories), based on experience gained over a period of time and administrative and operational expediency, recognized the need to review/amend some of the provisions of JERC (Appointment and Functioning of Ombudsman) Regulations, 2009 read along with the first amendment (of 4th April, 2013) to the principal Regulations. 1. Short title and commencement: 1. These Regulations may be called The Joint Electricity Regulatory Commission for Goa & Union Territories (Appointment and Functioning of Ombudsman) Second Amendment Regulations, 2015. 2. These Regulations shall be applicable in the State of Goa and the Union Territories of Andaman & Nicobar Islands, Chandigarh, Dadra and Nagar Haveli, Daman and Diu, Lakshadweep and Puducherry. 3. These Regulations shall come into force from the date of their publication in official Gazette. 2. Following Regulation 1 (4) is added: — Regulation 1 (4) These Regulations shall be construed harmoniously with Standards of Performance of distribution licensees and Electricity Supply Code specified by the Commission under the provisions of clauses (x) and (Za) of sub-section (2) of Section 181 of the Act. In case of any inconsistency with these Regulations, the Standards of Performances of licensees and the Electricity Supply Code, shall prevail. 3. Amendment in Regulation 3 (6) of the JERC (Appointment and Functioning of Ombudsman) First Amendment Regulations, 2013 Following is inserted prior to last sentence: — He shall also be entitled to Rs. 10,000/- per month as conveyance allowance. 4. Amendment in Regulation 5 (i) Following is added as a new para in Regulation 5 (1): — For avoidance of doubt, a licensee is not allowed to file a representation before the Ombudsman against the order of the forum. (ii) Regulation 5 (3) is renumbered as 5 (3) (a) (iii) Following Regulation 5 (3) (b) is added: — A complainant, Distribution licensee or any other person who is party to any proceedings before the Ombudsman may either appear in person or authorize any person to present his/her case before the Ombudsman and to do all or any of the acts for the purpose. (iv) Regulation 5 (6) is substituted with the following: — Upon request of the complainant, the Ombudsman may issue interim orders at any stage during the disposal of the representation as it may consider necessary: Provided that the Ombudsman shall have the powers to issue such an interim order in any proceeding, hearing or matter before it, as it may consider appropriate if the complainant satisfies the Ombudsman that prima facie the Distribution licensee has threatened or is likely to remove or disconnect the electricity connection, and has or is likely to contravene any of the provisions of the Act or any rules and regulations made thereunder or any order of the Commission, provided that the Ombudsman has jurisdiction on such matters: Provided further that, except where it appears that the object of passing the interim order is intended to delay the matter, no such interim order shall be passed unless the opposite party has been given an opportunity of being heard.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] 5. Amendment in Regulation 8 (i) Regulation 8 (3) is renumbered as 8 (3) (a) (ii) Following Regulation 8 (3) (b) is added: — Where the Complainant or the Licensee or their authorized representative, without reasonable cause, fails to appear before the Ombudsman on the date fixed for hearing on more than two occasions, the Ombudsman may decide the representation ex-parte. No adjournment shall ordinarily be granted by the Ombudsman unless sufficient cause is shown and the reasons for grant of adjournment have been recorded in writing by the Ombudsman. (iii) Regulations 8 (6) and (8) are deleted. Regulation 8 (7) is renumbered Regulation 8 (6) and substituted as under: — Regulation 8 (6) The licensee shall comply with the award within 30 days of the issue of the orders. Non- compliance shall constitute violation of these Regulations and shall be liable for action by the Commission under Section 142 and 146 read with Section 149 of the Act. (iv) Following is added as Regulation 8 (7) No party can file an appeal before the Commission against the order passed by the Ombudsman. However, this is without prejudice to the rights of the complainant and the licensee to seek appropriate remedy against the order passed by the Ombudsman before appropriate bodies /fora.
