Actions should be taken within the time and manner specified by the Commission in the Joint Electricity Regulatory Commission for State of Goa and Union Territories Appointment and Functioning of Ombudsman Regulations, 2009 read along with 1st and 2nd Amendments Regulations.

NOTIFICATION
Gurgaon, the 30th January, 2015
No. JERC-4/2009.—In exercise of powers conferred under Section 181 read with Section 45(5) of the
Electricity Act, 2003 (36 of 2003) and all other powers enabling it in this behalf, the Joint Electricity Regulatory
Commission (for the State of Goa and Union Territories), based on experience gained over a period of time and
administrative and operational expediency, makes the following amendments to Joint Electricity Regulatory
Commission for the State of Goa and Union Territories (Establishment of Forum for Redressal of Grievances of
Consumers) Regulations, 2009 and Joint Electricity Regulatory Commission for the State of Goa and Union Territories
(Establishment of Forum for Redressal of Grievances of Consumers) First Amendment Regulations, 2013.
1. Short title and commencement
(i) These Regulations may be called The Joint Electricity Regulatory Commission for Goa & Union Territories
(Establishment of Forum for Redressal of Grievances of Consumers) (Second Amendment) Regulations,
2015.
(ii) These Regulations shall be applicable in the State of Goa and the Union Territories of Andaman & Nicobar
Islands, Chandigarh, Dadra and Nagar Haveli, Daman and Diu, Lakshadweep and Puducherry.
(iii) These Regulations shall come into force from the date of their publication in official Gazette.
2. Following Regulation 1 (iv) is added:—
Regulation 1 (iv) These Regulations shall be construed harmoniously with Standards of Performance of distribution
licensees and with the Electricity Supply Code specified by the Commission under the provisions of clauses (x) and
(Za) of Sub-section (2) of Section 181 of the Electricity Act, 2003. In ‘case of any inconsistency with these
Regulations, the Standards of Performances of licensees and the Electricity Supply Code, shall prevail.’
3. Amendment in Regulation 3 :—
1. Regulation 3 (4) (i) in First Amendment Regulations, 2013 is substituted to read as under:
The Chairperson of the Forum shall be a retired person possessing a degree in engineering, preferably in
electrical/ mechanical engineering and having served as Executive Engineer or equivalent in the Power Sector
and having at least 20 years experience or Retired District Judge/ Additional District Judge or a retired judicial
officer having at least 15 years of experience in legal/judicial service.
2. Following ‘Note’ is added under Regulations 3 (4) (i) and 3 (4) (ii) in First Amendment Regulations, 2013:
“Note:- However, the Commission, in the case of Lakshadweep keeping in view the special circumstances
existing there, may for reasons to be recorded in writing relax the conditions specified herein with respect to the
eligibility criteria for the post of Chairperson and/ or Member.”
3. Following is inserted after the words ‘shall be’ in Regulation 3 (4) (iii) of First Amendment Regulations,
2013:
“A person possessing minimum Bachelor Degree in Law/Public Administration/Journalism/Economics/Political
Science or equivalent and”
4. The word ‘Member’ is substituted in Regulation 3 (5) of First Amendment Regulations, 2013 as under:—
“the Chairperson and the Member.”
5. Regulation 3 (6) of First Amendment Regulations, 2013:
Heading appearing against Sl. No. 8 in the first amendment of the principal Regulations is deleted. However,
the text as contained therein is added as a separate paragraph under Sl. No. 7 of the first amendment.
6. Regulation 3 (7) (ii) of First Amendment Regulations, 2013:
Under Regulation 3 (7) (ii), after the word ‘Chairperson’ the words “other than mentioned in Regulation 3 (7)
(i) above” have been deleted.
4. Following is added at the end of Regulation 4 (3) of First Amendment Regulations, 2013:
1. Under Regulation 4 (3) after the word ‘licensee’ the words “and will be allowed as a pass through expense” are
added.
2. Regulation 4 (4) of the Principal Regulations, 2009:

5. Amendment in Regulation 5 of the Principal Regulations, 2009:

Following is added in the end of Regulation 6 of the Principal Regulations, 2009:
“within such time and in such manner as specified by the Commission in Joint Electricity Regulatory Commission
for State of Goa and Union Territories (Appointment and Functioning of Ombudsman) Regulations, 2009 read
along with 1st and 2nd Amendments Regulations.
