राष्ट्रीय राििानी क्षत्रे दिल्ली की जज़ला न्यायपाजलका के न्याजयक अजिकाररयों और पेंिनभोजगयों/पाररिाररक पेंिनभोजगयों को िेतन और पिें न के बकाया भुगतान सजित उनके िेतन, पेंिन, भत्त े और सभी संबद्ध मामलों 17, 1945 PART IV] िेतन आयोग (एसएनिेपीसी) की जसफाररिों के उजचत कायाषन्ियन के जलए, माननीय सिोच््च न्यायालय द्वारा यथा अनुमोदित, जनम्नजलजित मानक संचालन प्रदिया (एसओपी) तयै ार करती ि।ै मानक सचं ालन प्रदिया (एसओपी) 1. राष्ट्रीय राििानी क्षत्रे दिल्ली सरकार, सक्षम प्राजिकारी के अनुमोिन के बाि, माननीय सिोच््च न्यायालय द्वारा रर.या.(जस.) स.ं 643/2015 म ें पाररत जनर्षय दिनांक 04/01/2024 द्वारा यथा अनुमोदित भत्तों और अन्य संबद्ध मामलों स े समबंजित िसू रे राष्ट्रीय न्याजयक िेतन आयोग की जसफाररिों के कायाषन्ियन के संबंि म ें आिश्यक कायाषलय आिेि/अजिसूचना िारी करेगी और जनिाषररत समय-सीमा के अनुसार इस े तुरंत लागू करने के जलए सभी आिश्यक किम उिाएगी। सीएससीडीिे के जनिेिानुसार, अनुपालन ररपोटष इस न्यायालय के मिाजनबंिक को प्रस्‍टतुत की िाएगी। 2. यदि सीएससीडीिे को यि उजचत लगता ि ै दक दकसी भत्ते या संबद्ध मामल े के संबंि में कोई स्‍टपष्टीकरर् या आग े के जनिेि िारी दकए िाने की आिश्यकता ि,ै तो सीएससीडीिे: (i) ऐस े मामल े म ें उस प्राजिकारी/एिेंसी को आिश्यक दििा-जनिेि/ स्‍टपष्टीकरर् िारी कर सकता ि ै िो िि उजचत समझ े और िि ऐस े जनििे ों को तरु ंत लाग ू करेगा; या (ii) राष्ट्रीय राििानी क्षत्रे दिल्ली सरकार को ऐस े भत्तों या सबं द्ध मामलों के संबंि म ें ऐसी जसफाररिें कर सकता ि ै िो िि आिश्यक समझे। िि सीएससीडीिे की जसफाररिों की प्राजि के 14 दिनों के भीतर, सक्षम प्राजिकारी की अनुमजत लेन े के बाि, िैसा भी मामला िो, आिश्यक स्‍टपष्टीकरर्/परू क कायाषलय आिेि/अजिसूचना िारी करेगी और इस े तरु ंत लाग ू करन े के जलए सभी आिश्यक किम उिाएगी। 3. कायाषलय आििे /अजिसूचना म ें यथा अनुमोदित प्रत्येक भत्ते और संबद्ध मामलों के संबंि में प्रभािी िोने की जतजथयों और सभी प्रासंजगक जििरर्ों को स्‍टपष्ट रूप स े ििाषया िाएगा, साथ िी िात े के उस मुख्य/लघु िीर्ष को भी ििाषया िाएगा जिसम ें स े िाि/े भत्त े - ितषमान या बकाया, आिररत/प्रजतपूर्त ष दकए िाने ि।ैं 4. माननीय सिोच््च न्यायालय द्वारा जनिाषररत समय सीमा के भीतर भत्त/े लाभ/बकाया के आिरर् के जलए जिजि, न्याय और जििायी काय ष जिभाग और रा.रा.क्ष.े दिल्ली सरकार का जित्त जिभाग संबंजित जिभागाध्यक्षों/आ. एि ं स.ंअ. द्वारा जनयंजत्रत िाते के उजचत िीर्ष म ें समय पर पयाषि िनराजि उपलब्ि कराएगा। 5. यदि दकसी सेिारत न्याजयक अजिकारी/पिें नभोगी/पाररिाररक पेंिनभोगी को माननीय सिोच््च न्यायालय के जपछल े जनिेिों के अनुसार उनके संबंजित जिभागाध्यक्षों/आ. एि ं स.ं अ. द्वारा िेतन/पिें न/पाररिाररक पेंिन/लाभ/ बकाया, यदि िो, का संजितरर् निीं दकया गया ि ै तो इसका भुगतान तत्काल प्रभाि स े दकया िाएगा और अनपु ालन ररपोटष इस न्यायालय के मिाजनबंिक को प्रस्‍टतुत की िाएगी। 6. अनुसूची म ें जनर्िष्टष सरकारी प्राजिकारीगर् को एति ् द्वारा िेतन/पेंिन/पाररिाररक पेंिन/भत्तों/लाभों/बकाया आदि के सुचारू संजितरर् और िसू रे राष्ट्रीय न्याजयक िेतन आयोग की अन्य जसफाररिों के कायाषन्ियन के जलए नोडल एिेंसी के रूप म ें घोजर्त दकया िाता ि।ै 7. अनुसूची म ें जनर्िषष्ट प्राजिकारीगर् यि िेिगें े और सुजनजित करेंग े दक न्याजयक अजिकाररयों, सेिाजनिृत्त न्याजयक अजिकाररयों एि ं पाररिाररक पेंिनभोजगयों को भुगतान योग्य िये िेतन/पेंिन/पाररिाररक पेंिन/भत्त/ेलाभ/बकाया आदि का संजितरर् माननीय सिोच््च न्यायालय के जनिेिों के अनुसार समय पर दकया िाए ि न्याजयक अजिकाररयों/ पेंिनभोजगयों/पाररिाररक पिें नभोजगयों को कोई असुजििा न िो। 8. प्रिान जज़ला एि ं सत्र न्यायािीि (मुख्यालय), तीस िज़ारी न्यायालय, दिल्ली के कायाषलय म ें एक “जिकायत जनिारर् प्रकोष्ठ” का गिन दकया िाएगा। प्रिान जज़ला एि ं सत्र न्यायािीि (मख्ु यालय) उक्त प्रकोष्ठ के अध्यक्ष िोंगे। प्रकोष्ठ म,ें प्रिान जज़ला एि ं सत्र न्यायािीि (मुख्यालय) द्वारा नाजमत एक या एक स े अजिक न्याजयक अजिकारी भी िाजमल िोंगे। जिकायतों के जनिारर् िते ु प्रकोष्ठ के नोडल अजिकारी के रूप म ेंकाय ष करेगा। 9. यदि राष्ट्रीय राििानी क्षत्रे दिल्ली के दकसी न्याजयक अजिकारी/पेंिनभोगी/पाररिाररक पेंिनभोगी को िेतन, भत्त,े पेंिन, पाररिाररक पेंिन, बकाया, लाभ या अन्य संबद्ध मामलों के भुगतान के संबंि म ें कोई जिकायत िो तो िि प्रिान जज़ला एि ं सत्र न्यायािीि (मुख्यालय), तीस िज़ारी न्यायालय, दिल्ली को अपना जलजित अभ्यािेिन ि े सकते ि।ैं अभ्यािेिन/ जिकायत को “जिकायत जनिारर् प्रकोष्ठ” द्वारा जनपटाया िाएगा, िो आिश्यकतानुसार ऐस े संबंजित प्राजिकारीगर् की रटप्पजर्या ं मांग सकता ि ै और उसके बाि जिकायत/अभ्यािेिन का जनपटान कर सकता ि।ै प्रिान जज़ला एि ं सत्र न्यायािीि (मुख्यालय) आिश्यकतानुसार ऐसे अन्य प्राजिकारीगर् के साथ समन्िय स े जनर्षय को लागू कराएंगे। 10. यदि न्याजयक अजिकारी/पेंिनभोगी/पाररिाररक पेंिनभोगी अब भी अपनी जिकायत/अभ्यािेिन के संबंि म ें प्रिान जज़ला एि ं सत्र न्यायािीि (मुख्यालय) के जनर्षय स े संतुष्ट निीं ि ैअथिा यदि जिकायत जनिारर् प्रकोष्ठ के जनर्षय को पयाषि समय के भीतर लागू निीं दकया गया तो िि ‘सीएससीडीिे’ को एक और अभ्यािेिन ि े सकता ि।ै ऐस े अभ्यािेिन म ें इस न्यायालय के मिाजनबंिक को संबोजित दकया िाएगा। ‘सीएससीडीिे’ का प्रस्‍टतुतकताष अजिकारी, मिाजनबंिक की मंज़ूरी स े ि मामल े म ें आिश्यकतानुसार, संबंजित प्राजिकारीगर् स े रटप्पजर्यां मांगगे ा और उसके बाि मामल े को ‘सीएससीडीिे’ के समक्ष रिगे ा। ‘सीएससीडीिे’ समबंजित एिेंजसयों द्वारा कायान्ष ियन िते ु इस मामले म ें उजचत जनििे पाररत कर सकता ि।ै ् ‘सीएससीडीिे’ का प्रस्‍टतुतकताष अजिकारी ऐसे कमषचाररयों की सिायता लेगा, जिसे मिाजनबंिक द्वारा जनिेजित दकया गया िो। 11. प्रत्येक जज़ल े के प्रिान जज़ला एि ं सत्र न्यायािीि संबंजित जज़ले के सेिाजनिृत्त न्याजयक अजिकाररयों और पाररिाररक पेंिनभोजगयों का एक डेटाबेस तैयार करेंग े और उसे कम स े कम त्रैमाजसक आिार पर समय-समय पर अद्यतन करने की प्रदिया के साथ बनाए रिगें े और इस े दिल्ली जज़ला न्यायालयों की िेबसाइट पर अपलोड दकया िाएगा। प्रिान जज़ला एि ं सत्र न्यायािीि (मख्ु यालय) सभी जज़लों के सेिाजनिृत्त न्याजयक अजिकाररयों और पाररिाररक पेंिनभोजगयों का एक केंद्रीकृत डेटाबेस बनाएंग,े जिसे भी दिल्ली जज़ला न्यायालयों की िेबसाइट पर अपलोड दकया िाएगा। 12. यदि कोई न्याजयक अजिकारी/पेंिनभोगी/पाररिाररक पिें नभोगी/दिल्ली न्याजयक सेिा संघ/ दिल्ली का कोई सेिाजनिृत्त न्याजयक अजिकारी संघ, कोई सामान्य जिकायत करता ि ै या न्याजयक अजिकाररयों की सेिा ितों या पेंिनभोजगयों/पाररिाररक पेंिनभोजगयों स े संबंजित कोई अन्य सामान्य मामले म ें अभ्यािेिन प्रस्‍टततु करता ि ै तो इस े ‘सीएससीडीिे’ के समक्ष भेिा िाएगा। इस प्रकार का अभ्यािेिन इस न्यायालय के मिाजनबंिक को संबोजित दकया िाएगा। ‘सीएससीडीिे’ का प्रस्‍टतुतकता ष अजिकारी, मिाजनबिं क की मंज़ूरी स,े प्रिान जज़ला एि ं सत्र न्यायािीि और/या दकसी अन्य संबंजित प्राजिकारी की रटप्पजर्यां मांगगे ा और उसके बाि मामले को ‘सीएससीडीिे’ के समक्ष रिेगा। ‘सीएससीडीिे’ संबंजित एिेंजसयों द्वारा कायाषन्ियन के समबन्ि म ें उजचत जनिेि िारी कर सकता ि ैया सक्षम प्राजिकारी की मंज़ूरी और उसके कायाषन्ियन के जलए रा.रा.क्ष.े दिल्ली सरकार को उपयक्तु जसफाररिें कर सकता ि।ै 13. ‘सीएससीडीिे’ समय-समय पर, ऐस े जनिेि िारी कर सकता ि ै िो उसके जिचार म ें एसओपी के उजचत 14/CFM/DHC/2024.—In compliance of the directions given by the Hon’ble Supreme Court of India vide Judgment dated 04.01.2024 passed in W.P.(C) No. 643 of 2015 titled as All India Judges’ Association v. Union of India, the ‘Committee for Service Conditions of the District Judiciary’ (CSCDJ), constituted by Hon’ble the Acting Chief Justice of the High Court of Delhi, formulates the following Standard Operating Procedure (SOP) for the proper implementation of the recommendations of the Second National Judicial Pay Commission (SNJPC) , as approved by the Hon’ble Supreme Court, with respect to pay, pension, allowances and all allied matters and to facilitate settlement of claims and disbursal of allowances, including the payment of arrears of salary and pension to the judicial officers and pensioners/ family pensioners of the district judiciary of the NCT of Delhi: STANDARD OPERATING PROCEDURE (SOP) 1. The Government of NCT of Delhi shall, after approval of the competent authority, issue requisite Office Order(s)/ Notification(s), regarding implementation of the recommendations of the Second National Judicial Pay Commission with respect to allowances and other allied issues as approved by the Hon’ble Supreme Court of India vide Judgment dated 04.01.2024 passed in W.P. (C) No. 643 of 2015 and shall take all requisite steps to immediately implement the same as per the stipulated timeline. Compliance reports shall be submitted to the Registrar General of this Court as per the directions of the CSCDJ. 2. In case the CSCDJ deems it appropriate that any clarification or further directions are required to be issued in respect of any allowance or allied issue, the CSCDJ may: (i) issue necessary directions/ clarifications in the matter to such authority/agency as deemed appropriate which shall immediately implement such directions; or (ii) make such recommendations as it deems necessary with respect to such allowance(s) or allied issue(s) to the Government of NCT of Delhi which shall issue requisite clarificatory/supplementary office order(s)/ notification(s), as the case may be, after seeking approval of the competent authority, within 14 days of receipt of the recommendation(s) of the CSCDJ, and shall take all requisite steps to immediately implement the same. 3. The office order(s)/ notification(s), shall clearly reflect the effective dates and all relevant details with respect to every allowance and allied issue as approved along with the major/ minor heads of Account from which the claims/ allowances - current or arrears, are to be drawn/ reimbursed. 4. The Department of Law, Justice and Legislative Affairs and the Finance Department of the Govt. of NCT of Delhi shall timely place sufficient funds in appropriate head(s) of account at the disposal of the respective Heads of Department / DDOs for the drawal of the allowances/benefits/arrears within the stipulated timeline as fixed by the18 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: MARCH 7, 2024/PHALGUNA 17, 1945 PART IV] Hon‘ble Supreme Court of India. 5. In case salary/pension/family pension/benefits/arrears, if any, to any serving judicial officer/ pensioner/family pensioner have not been disbursed as per the previous directions of the Hon’ble Supreme Court, by their respective Heads of Department/DDOs, the same shall be paid with immediate effect and compliance reports shall be submitted to the Registrar General of this Court. 6. The Government Authorities specified in the Schedule are hereby declared as the Nodal Agencies for the smooth disbursement of salary/pension/family pension/allowances/benefits/arrears etc. and implementation of other recommendations of the Second National Judicial Pay Commission. 7. The authorities specified in the Schedule shall oversee and ensure that the disbursement on account of salary/ pension/ family pension/allowances/benefits/arrears etc. due and payable to the judicial officers, retired judicial officers and family pensioners is timely made as per the directions of the Hon’ble Supreme Court and without any inconvenience to judicial officers/pensioners/family pensioners. 8. A ‘Grievance Redressal Cell’ shall be constituted in the office of the Principal District and Sessions Judge (HQ), Tis Hazari Courts, Delhi. The Principal District and Sessions Judge (HQ) shall be the Chairperson of the said Cell. The Cell shall also consist of one or more judicial officers, to be nominated by the Principal District and Sessions Judge (HQ). The retired judicial officer, who is a nominated member of CSCDJ, shall function as the nodal officer of the Cell for the day to day redressal of grievances. 9. In case any judicial officer/pensioner/family pensioner of the NCT of Delhi has any grievance with respect of payment of salary, allowances, pension, family pension, arrears, benefits or other allied issues he may make a representation in writing to the Principal District and Sessions Judge (HQ), Tis Hazari Courts, Delhi. The representation/ grievance shall be dealt with by the ‘Grievance Redressal Cell’, which may seek the comments of the concerned authorities, as may be required and thereafter dispose of the grievance/ representation. The Principal District and Sessions Judge (HQ) shall get the decision implemented in coordination with such other authorities as may be required. 10. In case the judicial officer/pensioner/family pensioner is still not satisfied with the decision of Principal District and Sessions Judge (HQ) with respect to his grievance/representation or in case the decision of the Grievance Redressal Cell is not implemented within a reasonable time, he/ she may make a further representation to the CSCDJ. Such representation shall be addressed to the Registrar General of this Court. The Presenting Officer of the CSCDJ shall, with the approval of the Registrar General, seek the comments of the concerned authorities, as may be required in the matter and thereafter place the matter before the CSCDJ. The CSCDJ may pass appropriate directions in the matter for implementation by the concerned agencies. The Presenting Officer of the CSCDJ shall be assisted by such staff as may be directed by the Registrar General. 11. The Principal District and Sessions Judge of every district shall prepare and maintain a database of retired Judicial Officers and family pensioners of the concerned district with a process for periodical updating, at least on a quarterly basis and the same shall be uploaded on the website of the Delhi District Courts. The Principal District and Sessions Judge (HQ) shall maintain a centralized database of retired Judicial Officers and family pensioners of all districts which shall also be uploaded on the website of the Delhi District Courts. 12. In case any judicial officer/pensioner/family pensioner/Judicial Service Association of Delhi/any retired Judicial Officers Association of Delhi raises a common grievance or makes any other representation with respect to the service conditions of judicial officers or any other issue relating to pensioners/family pensioners in general, the same may also be made to the CSCDJ. Such representation shall be addressed to the Registrar General of this Court. The Presenting Officer of the CSCDJ shall with the approval of the Registrar General seek the comments of the Principal District and Sessions Judge(s) and/or any other concerned authority and thereafter place the matter before the CSCDJ. The CSCDJ may pass appropriate directions in the matter for implementation by the concerned agencies or may make suitable recommendations to the Government of NCT of Delhi for approval of the competent authority and implementation thereof. 13. The CSCDJ may, from time to time, issue such directions as it may consider necessary for the proper implementation of the SOP or for the purpose of removing any difficulty which may arise in the administration thereof or may amend/ modify the SOP.
