िारा 78 के अनुसार, जनर्ााचन लडने र्ाल े प्रत्येक अभ्यथी जनर्ााजचत अभ्यथी के जनर्ााचन की तारीख से तीस ददनों के
भीतर अपन े जनर्ााचन व्यय का लेखा जिला जनर्ााचन अजिकारी के पास दिा कराएगा िो िारा 77 के अंतगात उसके द्वारा
अथर्ा उसके जनर्ााचन अजभकताा द्वारा रख ेगए लेखे की सत् य प्रजतजलजप िोगी
और यतः, जनर्ााचनों का संचालन जनयम, 1961, के जनयम 89 (2) के अिीन, मख्ु य जनर्ााचन अजिकारी, ददल्ली
के ददनांक 26.05.2020 के पत्र सं. सीईओ/सीओई/102/(77)/डीएलए-20/गोपनीय टरपोि/ा2020/37927 के िटरए, प्राप् त
जिला जनर्ााचन अजिकारी, केन्द्रीय जिला, की प्रस्ट्तुत टरपोि ा के अनुसार, रा.रा.क्षे. ददल्ली के 21-मटिया मिल ददल्ली
जर्िानसभा जनर्ाचा न क्षत्रे स े जनर्ााचन लडन े र्ाल े अभ्यथी श्री िोएबउद्दीन जर्जि द्वारा यथापेजक्षत रीजत से अपन े जनर्ााचन
व्ययों का लेखा दाजखल करने म ेंअसफल रि ेि ैं
और यतः, जिला जनर्ााचन अजिकारी, केन्द्रीय जिला और मुख्य जनर्ााचन अजिकारी, ददल्ली की टरपोिों के आिार
पर भारत जनर्ााचन आयोग द्वारा जनर्ााचनों का संचालन जनयम, 1961 के जनयम 89 के उप जनयम (5) के तित जनर्ााचन
व्ययों का लेखा दाजखल करने में असफल रिन े पर, श्री िोएबउद्दीन को ददनांक 28.09.2020 को कारण बताओ नोटिस
िारी दकया गया था;
और यतः, जनर्ााचनों का संचालन जनयम, 1961 के जनयम 89 के उप जनयम (6) के अनुसार,
ददनांक 28.09.2020 के उपयक्तुा कारण बताओ नोटिस के माध् यम स,े श्री िोएबउद्दीन को जनदेि ददया गया था दक र् े इस
नोटिस के प्राप्त िोने के 20 ददनों के भीतर लेखे न प्रस्ट्ततु कर पाने का कारण स्ट्प्ट करत े ुएए आयोग को जलजखत में अपना
अभ्यार्ेदन प्रस्ट्तुत करें और यि भी दक जनर्ााचन व्यय का अपना लेखा दाजखल करें/अपन े लखे े म ें त्रुटियों को सिी करें और
उसे संबंजित जिला जनर्ााचन अजिकारी को प्रस्ट्ततु करें;
और यतः, श्रीिोएबउद्दीन को उक्त नोटिस ददनांक 05.10.2020 को ताजमल कराया गया था औरअभ्यथी से प्राप्त
पार्ती रसीद, एसडीएम(ई), केन्द्रीय जिला द्वारा ददनांक 13.10.2020 के अपन े पत्र सं.डीईओ/सी/75/जनर्ाचा नव्यय
/डीएलए-20/1150 द्वारा आयोग को प्रस्ट्तुत कर दी गई थी
और यत:, एसडीएम (जनर्ााचन), केन्द्रीय जिला, ददल्ली ने ददनाकं 03.11.2020 के अपने पत्र
सं. डीईओ/सी/75/जनर्ाचा नव्यय/डीएलए-20/1273 द्वारा सूजचत दकया दक श्री िोएबउद्दीन ने अनेक जर्संगजतयों के साथ
ददनांक 12.10.2020 को अपने जनर्ााचन व्ययों का लेखा प्रस्ट्ततु दकया ि ै आयोग ने अपन े पत्र स.ं 76/डीएल-
एलए/21/2020/3356 ददनाकं 29.11.2021 के माध्यम से श्री िोएबउद्दीन को जर्लंब के जलए कारण/औजचत्य दने े और
उक्त त्रुटियों को सुिारन े का अर्सर प्रदान दकया
और यतः, श्री िोएबउद्दीन ने पत्र सं. एफ.डीईओ/सी/75/जनर्ाचा न व्यय/डीएलए-20/भाग-I/154,
ददनाकं 18.01.2022 के माध्यम स े प्राप्त अपन े अभ्यार्ेदन, ददनांक 17.01.2022 के माध्यम से न तो अपनी असफलता के
जलए कोई उजचत कारण या औजचत्य प्रदान दकया ि ैन िी अपन े जनर्ााचन व्ययों के लेख ेको सुिारा ि ै
और यत:, भारत जनर्ााचन आयोग का यि समािान िो गया ि ै दक श्री िोएबउद्दीन जनर्ााचन व्यय का लेख े के
जर्संगजतयों के जनर्ारण दाजखल करने में असफल रि ेि ैंऔर असफलता के जलए उनके पास कोई समुजचत कारण या औजचत्य
निीं ि;ै
और यत:, लोक प्रजतजनजित्र् अजिजनयम, 1951 की िारा 10क में यि अनुबंजित दकया गया ि ैदक:-
"यदद जनर्ााचन आयोग का यि समािान िो िाता ि ैदक कोई व्यजक्त-
(क) जनर्ााचन व्ययों का लेखा उस समय के भीतर और उस रीजत म ें िैसी इस अजिजनयमके द्वारा या अिीन
अपेजक्षत ि,ै दाजखल करने म ेंअसफल रिा िै; तथा
(ख) उसके पास उस असफलता के जलए कोई समुजचत कारण या औजचत्य निीं ि,ैतो जनर्ााचन आयोग िासकीय
रािपत्र म ें प्रकाजित आदेि द्वारा उसको जनरर्िता घोजषत करेगा और ऐसा कोई भी व्यजक्त उस आदिे की
तारीख से तीन र्षा की काला र्जि के जलए जनरर्िता िोगा;
अब इसीजलए, लोक प्रजतजनजित्र् अजिजनयम,1951 की िारा 10क के अनुसरण में, भारत जनर्ााचन आयोग

No. CEO/COE/102(104)/2019/23076.—The following is published for general information:—
‘‘SECRETARIATE OF THE ELECTION COMMISSION OF INDIA
ORDER
New Delhi, the 18th August, 2022
No. 76/ECI/ORD/TERR/NS-II/DL-LA/21//2020.—WHEREAS, the Commission had declared to hold the
General Election to the Legislative Assembly of NCT of Delhi from 21-Matia MahalAssembly Constituency vide
its Notification dated 14.01.2020 and Shri Shoaibuddinhad contested the aforesaid election, as an Independent
Candidate.
AND WHEREAS, as per Section 77 (1) of the Representation of the People Act, 1951, every candidate at
election shall, either by himself or by his election agent, keep a separate and correct account of all expenditure in
connection with the election incurred or authorized by him or by his election agent between the date on which he has
been nominated and the date of declaration of the result thereof, both dates inclusive and as per Section 78 of the
Representation of the People Act, 1951, every contesting candidate at an election shall, within thirty days from the
date of election of the returned candidate lodge with the District Election Officer (DEO) account of his election
expenses which shall be a true copy of the account kept by him or by his election agent under Section 77.
AND WHEREAS, as per the report under rule 89(2) of the Conduct of Election Rules, 1961, submitted by
the District Election Officer, Central District, NCT of Delhi through the Chief Electoral Officer’s letter
No. CEO/COE/102/(77)/DLA-20/Scr.Rep/2020/37927, dated 26-05-2020, Shri Shoaibuddin, contesting candidate
from 21-Matia MahalAssembly Constituency of NCT of Delhi, has failed to lodge an account of his election
expenses as required by law.
AND WHEREAS, on the basis of the reports of the District Election Officer, Central District, Delhi,
NCT of Delhi and the Chief Electoral Officer, Delhi, a Show Cause notice dated 28-09-2020 was issued by the
Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to
Shri Shoaibuddinfor non submission of account of Election expenses;
AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the
above said Show Cause Notice dated 28-09-2020, Shri Shoaibuddinwas directed to submit his representation in
writing in the Commission explaining the reason for non submission of accounts and also to lodge his accounts of
election expenses/rectify the defects in his accounts and submit the same to the District Election Officer concerned
within 20 days from the date of receipt of the notice;
AND WHEREAS, the said notice was made to serve to Shri Shoaibuddinon 05-10-2020and
acknowledgment receipt obtained from the candidate was submitted to the Commission by SDM(E) Central District
vide his letter No. DEO/C/75/E.Expenses/DLA-20/1150, dated 13-10-2020.
AND WHEREAS, the SDM(Election), district Central, Delhi vide its letter No. DEO/C/75/E.
Expenses/DLA-20/1273, dated 03-11-2020 informed that Sh. Shoaibuddin has submitted his account of election
expenses on 12-10-2020 with a number ofdiscrepancies. The Commission vide its letter No. 76/DL-LA/21/2020/3356
dated 29-11-2021 provided an opportunity to Shri Shoaibuddin to give reasons/justification for the delay and to
rectify the said defects.
AND WHEREAS, Shri Shoaibuddin vide his representation dated 17-01-2022 received through the letter
No.F.DEO/C/75/E.Expenses/DLA-20/Pt. I/154, dated 18-01-2022 neither provided good reason or justification for

AND WHEREAS, the Commission is satisfied that Shri Shoaibuddinhas failed to rectify the discrepancy
of account of election expenses and has no good reason or justification for the failure;
AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:-
“If the Election Commission is satisfied that a person-
(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or
under this Act; and
(b) Has no good reason or justification for the failure the Election Commission shall by order published in
the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period
of three years from date of the order;
NOW THEREFORE, in pursuance of Section 10 A of the Representation of the People Act, 1951, the
Election Commission of India hereby declares Shri Shoaibuddinresident of 4329, Mirza Ahmad Ali Marg, Kucha
Pandit, Lal Kuan, Delhi 110006 the contesting candidate for the General Election to the Legislative Assembly of
NCT of Delhi, 2020 from 21-Matia Mahal Assembly Constituency of NCT of Delhi to be disqualified for being
chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council
of a State or Union Territory for a period of three years from the date of this order.
