Claimant Anoop Shankar Tiwari (hereinafter stated as the claimant) has filed the statement of claim with averments which may be concisely stated as hereafter:2706 THE GAZETTE OF INDIA : AUGUST 12, 2023/SHRAVANA 21, 1945 [PART II—SEC. 3(ii)] Claimant joined the O.P. company on 19.05.2008 as sales manager. His duty was to promote sales and business of the O.P. company. It is averred by the claimant that he did continue to work till his illegal termination on 03.08.2010. He had rendered continuous work for 240 days during preceding one year prior to his termination. It is averred that his job was terminated by oral order without due compliance of the provisions under sections 25-F, 25-G, 25-H of the Industrial Disputes Act, 1947. He claims to be a workman under Section 2(s) of the Industrial Disputes Act, 1947. It is pleaded by the claimant that he was assigned with job which was neither managerial nor administrative. His job was not of supervisory capacity. It is stated that he was not paid notice pay in lieu of the one month notice required to be served under section 25-F of the ID Act. Claimant has prayed for direction to the O.P.s to reinstate him in the job with full back wages and for continuity of services w.e.f. the date of oral termination 03.08.2010 along-with compensation and for subsisting wages. 3. O.P. side has submitted the written statement with averments which may be summarized as stated below: The claimant was employed as the sales manager of its Kanpur office with monthly salary of Rupees 34,096/-. His job was administrative in nature and as such he was not a workman under section 2(s) of the Industrial Disputes Act, 1947. The claimant was employed to discharge managerial, administrative and supervisory work. He was assigned the work of exercising his supervisory control over his subordinates. He was vested with the responsibility of recommending promotion and confirmation of the subordinate staff. It is averred by the O.P.s that the claimant had remained absent from duty without any intimation to the employer company from 17.05.2010 onwards. On 28.05.2010 claimant submitted medical certificate and he was allowed to resume duty. It is stated by the O.P.s that the claimant failed to achieve the targets. In substance it is averred by the O.P.s that the performance of the claimant was not up to satisfaction and the management had to terminate his service by letter dated 01.07.2010 in accordance with the terms of his contract of employment. 4. In the rejoinder the claimant has reiterated his stand taken in the statement of claim. For adjudication of this industrial dispute the following point is to be answered: 1. Whether Anoop Shankar Tiwari falls within the category of workman under the Industrial Disputes Act, 1947 (hereinafter stated in short as the Act). The claimant has challenged termination of his services with effect from 03.08.2010 by the O.P. management as illegal and the claimant claims to be a workman. Claimant in his statement of claim has submitted that he was appointed by the erstwhile company as a sales manager with effect from 19.05.2008. He has pleaded that he was employed to do the work of a sales promotion employee. The stand of the claimant is that his termination w.e.f. 03.08.2010 was in violation of the provisions enshrined in section 25- F, 25-G and 25-H of the ID Act. In course of hearing of this industrial dispute attention of the Tribunal was drawn to documents at paper no. 19/4, 19/5, 19/6. These documents filed by the O.P. management have been admitted by the claimant workman and as such the said documents with the contents therein can be admitted into evidence as uncontroverted documents with uncontroverted contents. From a cumulative reading of the contents of the said documents it is crystal clear that the claimant appointed as sales manager was entrusted with the duty of recruiting business associates and the claimant had made the recommendation for recruiting Mr. Irshad Alam as a Tata AIG Life Insurance Company Ltd. Advisor. The aforesaid documents clearly prove that the assignment of the claimant was not mere sales promotion work but he was assigned with the task of recruiting other workers and such work of recruiting the persons clearly kept the claimant away from the category of workman enshrined in section 2(s) of the ID Act, 1947. Since the aforesaid unchallenged documents prove that a claimant was employed mainly in a managerial or administrative capacity he was not a workman and the dispute raised by him challenging his termination with effect from 03.08.2010 cannot be industrial dispute. The answer to this point goes against the claimant. 2. Since the claimant is not a workman as held in the foregoing paragraph, effect of his termination without notice or notice pay will amount to mere academic discussion which may not be relevant in this proceeding. The terms of the contract of appointment of the claimant may confer civil rights on the claimant but since the claimant is not a workman jurisdiction of this Tribunal to consider legality of his termination w.e.f. 03.08.2010 stands ousted. In view of the nature of dispute claimant is not entitled to get any relief in this proceeding. Parties are left to bear their respective costs. Award This award arises in respect of the case raised under section 2A of Industrial Disputes Act, 1947 on 26.10.2018. The averments of the claimant workman may be concisely stated as hereafter: Claimant workman was recruited by the management no. 1 on the post of peon in the year 1983 in the month of January. Claimant workman worked continuously for the management. Even claimant workman worked overtime for the management but was never paid for overtime duty. Management took duty of 12 hours but paid wages which were much less than minimum wages. Claimant workman continuously raised the matter of wages for overtime but management in exasperation developed a malicious attitude towards the claimant workman. On 25.04.2018 O.P. management terminated the service of the claimant workman. Claimant workman was neither served with any notice before termination nor was paid wages for one month in lieu of notice nor was paid retrenchment nor gratuity compensation or any other benefit. At the time of termination the salary of the claimant workman was Rupees Seven Thousand Two Hundred which was less than minimum wages. During the period of service served by the claimant workman there was no complaint or charge sheet against the claimant workman. The record of the claimant workman was unblemished. Hence it can corroborate that the act of2708 THE GAZETTE OF INDIA : AUGUST 12, 2023/SHRAVANA 21, 1945 [PART II—SEC. 3(ii)] terminating the claimant workman was done with malicious intention. It is stated by the claimant workman that the termination was illegal and had been done in a wrongful manner. It is violation of Industrial Disputes Act, 1947. It is prayed by claimant workman to reinstate him in service with continuity with back wages and other benefits deemed fit in the eyes of the law. The averments of the O.P. side are summarized as stated below: The posts of class IV employees in the O.P. company are filled up by rigid selection procedure. The O.P. is a Public Sector Undertaking of the Government of India and there is no room for back door entry. In-directly it has been pleaded by O.P. management side that the claimant had not undergone any selection procedure and that no letter of appointment was issued in his favour and he was never paid monthly wages by the O.P. In the rejoinder the claimant has reiterated his claim for reinstatement with continuity in job with back wages. The following points are to be answered for adjudication of this industrial dispute: 1. Whether the termination of the claimant can be treated as illegal. 2. Whether the claimant is entitled for reinstatement with back wages. 3. To what other relief the claimant is entitled. Point No. 1 & 2: The point no. 1 & 2 are taken up together for discussions for convenience. Though the claimant has averred in statement of claim that he was appointed in the post of class IV of the O.P. in course of cross-examination he has admitted that no advertisement was published. His deposition in course of cross-examination further reveals that he had never submitted any G form 17 before his engagement in insurance company and that he is unable to state his employee number and pay slip number and the exact date of his joining in January, 1983 and that he has not submitted any documents showing his PF membership and that no authority of the insurance company had issued any letter of appointment in any post of the insurance company. He has admitted that the vouchers submitted by him were written by him. The self-serving documents are not of huge evidentiary worth. The above stated depositions otherwise indicate that he was not appointed by the O.P. management by any regular selection process. His deposition that the vouchers submitted by him contained his hand writing otherwise makes the vouchers not totally reliable documents in support of his claim for reinstatement with regularization. It is clear from the deposition of the claimant that he has not submitted any paper showing that he had worked for two hundred forty days during the preceding twelve months prior to his disengagement. Such deposition of the claimant disentitles him the protection as per section 25-B of the Industrial Disputes Act, 1947. In other words the claimant fails to prove that he was in continuous service for not less than one year under the O.P. management and as such the claimant is not protected under section 25-F of the Industrial Disputes Act, 1947. Since the claimant has failed to establish that before his termination he was entitled for the benefits flowing out of section 25-F of the Industrial Disputes Act, 1947 his termination cannot be held as illegal under the Industrial Disputes Act, 1947. The above statement of the claimant in course of cross-examination weakens his claim for reinstatement or absorption in any permanent post. In view of the case law Harinandan Prasad Vs. FCI Management pronounced by the Hon’ble Supreme Court of India the claimant petitioner is not entitled for reinstatement in the job under the O.P. management. Both the above stated points are answered against the claimant. Point No. 3: Though the claimant has raised the point that he was paid less than the minimum wages the claim of payment of minimum wages should have been raised before the proper Forum. Non-payment of wages for over-time has not been pressed with clear and cogent evidence. In other words the point of non-payment for over-time work has not been supported with adequate evidence. Since the claimant has failed to prove the number of days he had worked under the O.P. management within Twelve Calendar months prior to termination he is not entitled for any compensation. In view of the foregoing discussions the reference is answered against the claimant. The claimant workman is not entitled of any of the reliefs claimed by him. Parties are left to bear their respective costs. No.-K-10/1-12/2021-IR dt. 22.10.2021 present industrial dispute has been referred for adjudication to this Tribunal dispute, in exercise of the powers conferred by clause (d) of Sub- Section (1) and sub-Section (2A) of Section 10 of the Industrial Dispute Act, 1947 (14 of 1947) by the Central Government. “Whether the action of management of Green Gas Limited, Lucknow in terminating the services of Shri Sachin Upadhyay, Marketting Assistant w.e.f. 01.06.2020 who was engaged through contractor M/s M-Five Security private Limited, is Legal and justified? If not, to what relief the workman is entitled to and from which date? Accordingly an industrial dispute No. 100/2021 has been registered. From the perusal of record, the position which emerge out is that initially after registration of the case before this Tribunal notice was issued to claimant on 06.12.2021.2710 THE GAZETTE OF INDIA : AUGUST 12, 2023/SHRAVANA 21, 1945 [PART II—SEC. 3(ii)] Thereafter several opportunities was given to him lastly on 31.01.2023 an order was passed by which last opportunity was given to claimant to file statement of claim and notice was sent to him. On 09.06.2023 when the case was taken up for hearing in spite of notice, neither claimant/legal representative appeared nor claim statement was filed. Accordingly I have heard Sri B.P. Singh learned counsel for respondent and perused on record. Taking into consideration the fact that till date no statement of claim has been filed by the claimant in order to establish his claim as per the reference dated 22.10.2021 So in view of the said facts, as well as the law laid by the Hon’ble High Court in the case of V.K. Industries Vs. Labour Court (I) and others 1981 (29( FLR as under:- “It is well settled that if a party challenges the legality of an order, the burden lies upon him to prove illegality of the order and if no evidence is produced the party invoking jurisdiction of the Court must fail. Whenever a workman raised a dispute challenging the validity of the termination of service if is imperative for him to file written statement before the Industrial Court setting out grounds on which the order is challenged and he must also produce evidence to prove his case. If the workman fails to appear or to file written statement or produce evidence, the dispute referred by the State Government cannot be answered in favour of the workman and he would not be entitled to any relief”. In the case of M/s Uptron powertronics Employees’ Union, Ghaziabad through its Secretary V. Presiding Officer, Labour Court (II), Ghaziabad and others 2008 (118) FLR 1164 Hon’ble Allahabad High Court has held as under:- “The law has been settled by the Apex Court in case of Shankar Chakravarti Vs Britannia Biscuit Co. Ltd., V.K. Raj Industries V. Labour Court and Ors., Airtech Private Limited Vs. State of U.P. and Ors. 1984 (49) FLR 38 and Meritech India Ltd v. State of U.P. and Ors. 1996 FLR that in the absence of any evidence led by or on behalf of the workman reference is bound to be answered by the Court against the workman. In such a situation it is not necessary for the employers to lead any evidence at all. The obligation to lead evidence to establish and allegation made by a party is on the party making the allegation. The test would be, who would fail if no evidence is led.” And by the Hon’ble Allahabad High Court in the case of District Administrative Committee U.P. P.A. C.C.S.C. Services V. Secretary-cum- G.M. District Co-Operative Bank Ltd. 2010 (126) FLR 519; wherein it has been held as under:- “The submission is that even if the petitioner failed to lead the evidence, burden was on the shoulders of the respondent to prove the termination order as illegal. He was required to lead evidence first which he failed. A perusal of the impugned award also does not show that any evidence either oral or documentary was led by the respondent. In the case of no evidence, the reference has to be dismissed”. As the workman had not filed any statement of claim/oral/documentary evidence, so the present case is liable to be dismissed.
