Äksf’kr djrk gw¡A ;g vkns”k fnYyh uxj fuxe ¼ik’kZnks a ds pquko½ fu;ekoyh] 2012 ds fu;e 110 ds rgr jkti= eas Hkh izdkf”kr fd;k tk jgk gSA ca”k jkt jke] lfpo STATE ELECTION COMMISSION (NCT of Delhi & UT Chandigarh) ORDER Delhi, the 27th May, 2024 No. F. 1(148)/SEC/Admin/2022/16093.—WHEREAS General Election-2022 for the election of Councillors to the Municipal Corporation of Delhi was held on 04/12/2022 and the candidates were elected on declaration of result on 07/12/2022. 2. AND WHEREAS Rule 103 of the Delhi Municipal Corporation (Election of Councillors) Rules, 2012 (hereinafter called the Rules) prescribes that every candidate at an election to a ward shall, either by himself or by his election agent, keep a separate and correct account of all expenditure in connection with the election, incurred or authorized by him or by his election agent between the date on which he/she has been nominated and the date of declaration of the result; 3. AND WHEREAS Rule 104 of the Delhi Municipal Corporation (Election of Councillors) Rules, 2012 provides that; 104. Lodging of accounts with the Returning Officer: - (1) Every contesting candidate at an election of a ward shall, within ten days from the date of election of the returned candidate, lodge with the Returning Officer an account of his election expenses which shall be a true copy of the account kept by him or by his election agent. (2) Every contesting candidate at an election to a ward shall also file an affidavit in Form-20 in token of authenticity of the account of election expenses as maintained & submitted by him. 4. AND WHEREAS, the following 04 contesting candidates,specified in column No. 2 of the table hereunder, for election to the Municipal Corporation of Delhi and wards mentioned in column No. 3 of the said table hereunder against their respective names failed to lodge the account of their election expenses, as required under Rule-104 ibid, as per details shown in column No. 5 of the said table against their respective names; 1 2 3 4 5 S.No. Name & Address of Number and Dispatch No. & Ground of disqualification under Candidate Name of Ward date of show cause Rule 110 (Sh/Smt./Km.) notice 1. AND WHEREAS Show Cause Notices were issued to the above candidates under Rule 108(5) of the aforesaid rules, on the dates mentioned in Col.4 of the above table with the directions to submit their requisite documents and explanation with reason for not submitting account of election expenses as required under Rule 104 of the aforesaid Rules and that why action should not be taken against him / her as per provisions of Rule 110 of the said Rules for their failure to respond show cause notices. He/She was clearly informed that failure to lodge the Accounts of election expenses/explanation would disqualify him/her for being and to be chosen as a Councillor to Municipal Corporations of Delhi for a period of six years from the date of such disqualification. 6. NOW, THEREFORE, I, Bansh Raj Ram, Secretary, State Election Commission, NCT of Delhi having considered all the aspects of the matter andsatisfied that there is no good reason or justification for the aforesaid candidates for failure to lodge account of election expenses within the time and in the manner required mandatorily under the aforesaid Rules, hereby disqualify the candidates as specified in column No. 2 of the aforesaid table for a period of six years from the date of this order, under the provisions of Rule 110 of the said Rules.
