N. 122 .— WHEREAS, the Commission had declared to hold the General Election to the House of the People of NCT of Delhi to 06–West Delhi Parliamentary Constituency vide its Notification dated 16.04.2019 and Shri Vikas Kumar Mohal had contested the aforesaid election; AND WHEREAS, as per Section 77 (1) of the Representation of the People Act, 1951, every candidate at election shall, either by himself or by his election agent, keep a separate and correct account of all expenditure in connection with the election incurred or authorized by him or by his election agent between (the date on which he has been nominated) and (the date of declaration of the result thereof), both dates inclusive & as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within thirty days from the date of election of the returned candidate lodge with the District Election Officer (DEO) account of his election expenses which shall be in a true copy of the account kept by him or by his election agent under Section 77. AND WHEREAS, as per the report under rule 89(2) of the Conduct of Election Rules, 1961, submitted by the District Election Officer, West Delhi District, NCT of Delhi through the Chief Electoral Officer’s letter No. CEO/EEM(102)/(49)GE-2019/49970 dated 09.07.2019, Shri Vikas Kumar Mohal Aapki Apni Party (Peoples), contesting candidate from 06 West Delhi Parliamentary Constituency of NCT of Delhi, has failed to lodge any account of his election expenses as required by law. AND WHEREAS, on the basis of the reports of the District Election Officer, West Delhi, NCT of Delhi and the Chief Electoral Officer, Delhi, a Show Cause notice dated 25.07.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Vikas Kumar Mohal for non submission of account of Election expenses; AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 25.07.2019, Shri Vikas Kumar Mohal was directed to submit his representation in writing in the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice; AND WHEREAS, the said notice was received by Shri Vikas Kumar Mohal on 08-08-2019. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by SDM(E) West Delhi vide his letter No. PC-06(WDPC-06)/DEO (W)/2019/6086 dated 21.08.2019. AND WHEREAS, in the supplementary report submitted by SDM(E), West Delhi vide his letter PC-06(WDPC-06)DEO(W)/2019/8667-69 dated 30.09.2019, it has been stated that Shri Vikas Kumar Mohal, resident of House No. 04, Block No. 6, Village Tosham, Tehsil Tosham, Distt. Bhiwani, Haryana has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well; AND WHEREAS, the Commission satisfied that Shri Vikas Kumar Mohal has failed to lodge an account of election expenses and has no good reason or justification for the failure; AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:- ―If the Election Commission is satisfied that a person- (a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act; and (b) Has no good reason or justification for the failure the Election Commission shall by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the under; NOW THEREFORE, in pursuance of Section 10 A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Vikas Kumar Mohal, resident of House No. 04, Block No. 6, Village Tosham, Tehsil Tosham, Distt. Bhiwani, Haryana, the contesting candidate for the General Election to the Lok Sabha of NCT of Delhi, 2019 from 06-West Delhi Parliamentary Constituency of the state of NCT of Delhi to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order. [No.76/ECI/ORD/TERR/NS-II/DL-HP/06/2019] By Order, AJOY KUMAR, Secy.340 THE GAZETTE OF INDIA : JANUARY 2, 2021/ PAUSHA 12, 1942 [PART II—SEC. 3(iii)] अदिे नइ ददल्ली, 22 ददसम् बर, 2020 अ. ऄ. 123.—यतः, अय ग ने रा.रा.क्षेे. ददल् ली के 05-ईत्तर पजिम संसदीय जनवााचन क्षेे्र के जलए ददनांक 16.04.2019 की ऄपनी ऄजधसूचना के द्वारा ल क सभा के साधारण जनवााचन अय जित करने की घ षणा की थी और श्री राम कुमार न ेपूवोक् त जनवााचन ल़ा था; और यतः, ल क प्रजतजनजधत्व ऄजधजनयम, 1951 की धारा 77 (1) के ऄनुसार, जनवााचन ल़ने वाले प्रत्येक ऄभ्यथी, वह जतजथ िब ईसे नाम-जनदजे ित दकया गया ह ै और ईसके पररणाम की घ षणा की जतजथ, द नों तारीखें सजम्मजलत, के बीच ऄपने द्वारा या ऄपने जनवााचन एिेंट द्वारा ईपगत या ऄजधकृत जनवााचन संबंधी सभी खचों का, या त स्ट्वयं या ऄपने जनवााचन एिेंट द्वारा, एक पृथक और सही लेखा रखेगा और ल क प्रजतजनजधत्व ऄजधजनयम, 1951 की धारा 78 के ऄनुसार, जनवााचन ल़ने वाले प्रत्येक ऄभ्यथी, जनवााजचत ऄभ्यथी के जनवााचन की तारीख से तीस ददनों के भीतर ऄपने जनवााचन व्यय का लेखा जिला जनवााचन ऄजधकारी क दिा करेगा ि धारा 77 के ऄंतगात ईसके द्वारा ऄथवा ईसके जनवााचन एिेंट द्वारा रखे गए लेखे की सत् य प्रजतजलजप ह गी और यतः, जनवााचनों का संचालन जनयम, 1961 के जनयम 89(2) के ऄधीन मु्‍य जनवााचन ऄजधकारी के प्र सं. सीइओ/इइएम(102)/(49)िीइ-2019/49970 ददनाकं 09.07.2019 के िररए जिला जनवााचन ऄजधकारी, ईत्तर पजिम जिला, रा.रा.क्षेे्र , ददल् ली द्वारा प्रस्ट्तुत ररप टा के ऄनुसार, रा्‍ रीय रािधानी क्षेे्र , ददल् ली के 05-ईत्तर पजिम ससं दीय जनवाचा न क्षे्र े से जनवााचन ल़ने वाले भारतीय प्रगजतिील कांग्रेस के ऄभ्यथी, श्री राम कुमार जवजध द्वारा यथापेजक्षेत रीजत स े ऄपने जनवााचन व्यय का क इ लेखा दाजखल करने में ऄसफल रह ेह ैं और यतः, जिला जनवााचन ऄजधकारी, ईत् तर-पजिम, रा.रा.क्षेे. ददल् ली और मु्‍य जनवााचन ऄजधकारी, ददल् ली की ररप टों के अधार पर भारत जनवााचन अय ग द्वारा जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के ईप जनयम (5) के तहत जनवााचन व्यय का लेखा दाजखल न करने पर, श्री राम कुमार क कारण बताओ न रटस ददनांक 25.07.2019 िारी दकया गया था; और यतः, जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के ईप जनयम (6) के ऄनुसार, ददनांक 25.07.2019 के ईपयुाक्त कारण बताओ न रटस के माध्य म से, श्री राम कुमार क जनदिे ददया गया था दक वे आस न रटस के प्राप्त ह ने के 20 ददनों के भीतर लेखे प्रस्ट्तुत न कर पाने का कारण स्ट्पष्ट करते हुए अय ग क जलजखत में ऄपना ऄभ्यावेदन प्रस्ट्तुत करें और साथ ही, जनवााचन व्यय का ऄपना लेखा दाजखल करें/ऄपने लेखे में ्र ुरटयों क सही करें और ईसे संबंजधत जिला जनवााचन ऄजधकारी क प्रस्ट्तुत करें; और यतः, ईक्त न रटस श्री राम कुमार के घर के बाहर ददनांक 14-08-2019, 21-08-2019, 05-09-2019 और 23-12- 2019 क ‘चस्ट् पा’ ददए गए थ,े क् योंदक ददए गए पते पर न त वे स्ट् वयं न ही ईनका पररवार रहता जमला द जभन् न ऄवसरों पर द प़ जसयों से चस्ट्प ा ररप टा की प्राप्त पावती एसडीएम(इ), ईत्त र पजिम द्वारा ददनाकं 30.12.2019 के प्र स.ंडीइओ(एनडब्लल्य)ु / एसडीएम(इ)/ररप टा/2019/7808-7811 द्वारा अय ग क प्रस्ट्त तु कर दी गइ थी और यत:, एसडीएम (इ), ईत्तर पजिम द्वारा ददनांक 02.03.2020 के ऄपने प्र सं. डीइओ(एनडब्लल्य)ु / एसडीएम(इ)/ररप टा/2019/1526-1530 के द्वारा प्रस्ट्त तु ऄनपु ूरक ररप टा में यह कहा गया ह ै दक श्री राम कुमार, जनवासी-मकान न0ं - 207, ब्लल क न0ं -िी, पॉकेट-7, सक्ै टर-16, र जहणी, नइ ददल्ली ने न त क इ ऄभ् यावेदन ददया है और न ही मूल वाईचसा सजहत जवजधवत रूप से हस्ट् ताक्षेररत जनवााचन ‍य य के सही लेखे प्रस्ट् तुत दकए ह ैं आसके ऄजतररक् त, ईन् होंने भारत जनवााचन अय ग के सम् यक् न रटस की प्राजप्त के बाद भी ईक् त ऄसफलता हते ु न त क इ कारण बताया न ही स्ट्प ्‍ टीकरण ददया ह;ै और यत:, भारत जनवााचन अय ग का यह समाधान ह गया ह ै दक श्री राम कुमार जनवााचन व्यय का लेखा दाजखल करने में ऄसफल रह ेह ैंऔर ऄसफलता के जलए ईनके पास क इ समुजचत कारण या न्याय जचत्य नहीं है; और यत:, ल क प्रजतजनजधत्व ऄजधजनयम, 1951 की धारा 10क में यह ऄनुबंजधत दकया गया ह ैदक:- "यदद जनवााचन अय ग का यह समाधान ह िाता ह ैदक क इ व्यजक्त- (क) जनवााचन व्ययों का लेखा ईस समय के भीतर और ईस रीजत में िैसी आस ऄजधजनयम के द्वारा या कानून के ऄधीन ऄपेजक्षेत ह,ै दाजखल करने में ऄसफल रहा है; तथा (ख) ईसके पास ईस ऄसफलता के जलए क इ समुजचत कारण या न्याय जचत्य नहीं ह,ै त जनवााचन अय ग िासकीय रािप्र में प्रकाजित अदिे द्वारा ईसक जनरर्हहत घ जषत करेगा और ऐसा क इ भी व्यजक्त ईस अदिे की तारीख से तीन वषा की कालावजध के जलए जनरर्हहत रहगे ा; ऄब आसीजलए, ल क प्रजतजनजधत्व ऄजधजनयम, 1951 की धारा 10क के ऄनुसरण में भारत जनवााचन अय ग एतद्द्वारा रा.रा.क्षे्र े ददल् ली राज्य के 05-ईत्तर पजिम संसदीय जनवााचन क्षेे्र से ल क सभा के साधारण जनवााचन, 2019 में जनवााचन ल़ने वाले ऄभ्यथी, श्री राम कुमार, जनवासी-मकान न0ं -207, ब्लल क नं0-िी, पॉकेट-7, सैक्टर-16, र जहणी, नइ ददल्ली क संसद के दकसी भी सदन या राज्य[भाग II—खण् ड 3(iii)] भारत का रािप्र : िनवरी 2, 2021/पौष 12, 1942 341 या संघ राज्य-क्षेे्र की जवधानसभा ऄथवा जवधान पररषद के जलए सदस्ट्य चुने िाने या ह ने के जलए आस अदिे की तारीख स ेतीन वषा की ऄवजध के जलए जनरर्हहत घ जषत करता ह ै [सं. 76/भा.जन.अ./अद.े/प्रा./एनएस-II/डीएल-ल कसभा/05/2019] अदिे से, ऄिय कुमार, सजचव ORDER New Delhi, the 22nd December, 2020 O. N. 123.—WHEREAS, the Commission had declared to hold the General Election to the House of the People of NCT of Delhi to 05–North West Delhi Parliamentary Constituency vide its Notification dated 16.04.2019 and Shri Ram Kumar had contested the aforesaid election; AND WHEREAS, as per Section 77 (1) of the Representation of the People Act, 1951, every candidate at election shall, either by himself or by his election agent, keep a separate and correct account of all expenditure in connection with the election incurred or authorized by him or by his election agent between (the date on which he has been nominated) and (the date of declaration of the result) thereof, both dates inclusive & as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within thirty days from the date of election of the returned candidate lodge with the District Election Officer (DEO) account of his election expenses which shall be in a true copy of the account kept by him or by his election agent under Section 77. AND WHEREAS, as per the report under rule 89(2) of the Conduct of Election Rules, 1961, submitted by the District Election Officer, North West District, NCT of Delhi through the Chief Electoral Officer’s letter No. CEO/EEM(102)/(49)GE-2019/49970 dated 09.07.2019,Shri Ram Kumar, Bhartiya Pragatisheel Congress contesting candidate from 05-North West Parliamentary Constituency of NCT of Delhi, has failed to lodge any account of his election expenses as required by law. AND WHEREAS, on the basis of the reports of the District Election Officer, North West, NCT of Delhi and the Chief Electoral Officer, Delhi, a Show Cause notice dated 25.07.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Ram Kumar for non submission of account of Election expenses; AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 25.07.2019,Shri Ram Kumar was directed to submit his representation in writing in the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice; AND WHEREAS, the said notice was made to serve to Sh. Ram Kumar on 14-08-2019,21-08-2019, 05-09-2019 and 23-12-2019 through ‘CHASPA’ as he himself or his family was not found residing at the given address. The Chaspa report acknowledgment receipt obtained from the two neighbors on two different instances submitted to the Commission by SDM(E), North-West vide his letter No. DEO(NW)/SDM(E)/Reports/2019/7808- 7811 dated 30.12.2019. AND WHEREAS, in the supplementary report submitted by SDM(E), North-West vide his letter No. DEO/NW/SDM(E)/Reports/2019/1526-1530 dated 02-03-2020, it has been stated that Shri Ram Kumar, resident of House No. 207, Block – G, Pocket – 7, Sector-16, Rohini, New Delhi, has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well; AND WHEREAS, the Commission satisfied that Shri Ram Kumar has failed to lodge an account of election expenses and has no good reason or justification for the failure; AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:- ―If the Election Commission is satisfied that a person- (a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act; and (b) Has no good reason or justification for the failure the Election Commission shall by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the under;342 THE GAZETTE OF INDIA : JANUARY 2, 2021/ PAUSHA 12, 1942 [PART II—SEC. 3(iii)] NOW THEREFORE, in pursuance of Section 10 A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Ram Kumar, resident of House No. 207, Block – G, Pocket – 7, Sector-16, Rohini, New Delhi, the contesting candidate for the General Election to the Lok Sabha of NCT of Delhi, 2019 from 05-North West Parliamentary Constituency of the state of NCT of Delhi to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by SDM Election East Delhi District vide his letter No. DEO(EAST)ACCTTS/3(5)/2018/14366-67 dated 19.08.2019. AND WHEREAS, in the supplementary report submitted by SDM Election East, Delhi District vide his letter No.DEO(EAST)ACCTTS/3(5)/2018/18283 dated 18.11.2019, it has been stated that Shri Shiv Kumar, resident of 485, Jwala Nagar, Delhi has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well; AND WHEREAS, the Commission to satisfied that Shri Shiv Kumar has failed to lodge an account of election expenses and has no good reason or justification for the failure; AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:- ―If the Election Commission is satisfied that a person-344 THE GAZETTE OF INDIA : JANUARY 2, 2021/ PAUSHA 12, 1942 [PART II—SEC. 3(iii)] (a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act; and (b) Has no good reason or justification for the failure the Election Commission shall by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the under; NOW THEREFORE, in pursuance of Section 10 A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Shiv Kumar, resident of 485, Jwala Nagar, Delhi, the contesting candidate for the General Election to the Lok Sabha of NCT of Delhi, 2019 from 03-East Delhi Parliamentary Constituency of the state of NCT of Delhi to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order. [No.76/ECI/ORD/TERR/NS-II/DL-HP/03/2019] By Order, AJOY KUMAR, Secy. अदिे नइ ददल्ली, 23 ददसम् बर, 2020 अ. ऄ. 125.—यतः, अय ग ने रा.रा.क्षेे. ददल् ली के 04-नइ ददल् ली संसदीय जनवााचन क्षेे्र के जलए ददनांक 16.04.2019 की ऄपनी ऄजधसूचना के द्वारा ल क सभा के साधारण जनवााचन अय जित करने की घ षणा की थी और श्री सनु ील कुमार न ेपूवोक् त जनवााचन ल़ा था; और यतः, ल क प्रजतजनजधत्व ऄजधजनयम, 1951 की धारा 77 (1) के ऄनुसार, जनवााचन ल़ने वाले प्रत्येक ऄभ्यथी, वह जतजथ िब ईसे नाम-जनदजे ित दकया गया ह ै और ईसके पररणाम की घ षणा की जतजथ, द नों तारीखें सजम्मजलत, के बीच ऄपने द्वारा या ऄपने जनवााचन एिेंट द्वारा ईपगत या ऄजधकृत जनवााचन संबंधी सभी खचों का, या त स्ट्वयं या ऄपने जनवााचन एिेंट द्वारा, एक पृथक और सही लेखा रखेगा और ल क प्रजतजनजधत्व ऄजधजनयम, 1951 की धारा 78 के ऄनुसार, जनवााचन ल़ने वाले प्रत्येक ऄभ्यथी, जनवााजचत ऄभ्यथी के जनवााचन की तारीख से तीस ददनों के भीतर ऄपने जनवााचन व्यय का लेखा जिला जनवााचन ऄजधकारी क दिा करेगा ि धारा 77 के ऄंतगात ईसके द्वारा ऄथवा ईसके जनवााचन एिेंट द्वारा रखे गए लेखे की सत् य प्रजतजलजप ह गी और यतः, जनवााचनों का संचालन जनयम, 1961 के जनयम 89(2) के ऄधीन मु्‍य जनवााचन ऄजधकारी के प्र सं. सीइओ/इइएम(102)/(49)िीइ-2019/49970 ददनाकं 09.07.2019 के िररए जिला जनवााचन ऄजधकारी, नइ ददल् ली जिला, रा.रा.क्षेे्र , ददल् ली द्वारा प्रस्ट्तुत ररप टा के ऄनुसार, रा्‍ रीय रािधानी क्षेे्र , ददल् ली के 04-नइ ददल्ली ससं दीय जनवाचा न क्षे्र े से जनवााचन ल़ने वाले पीपल्स पाटी ऑफ आंजडया (डेम क्रेरटक) के ऄभ्यथी, श्री सनु ील कुमार जवजध द्वारा यथापेजक्षेत रीजत से ऄपने जनवााचन व्यय का क इ लेखा दाजखल करने में ऄसफल रह ेह ैं और यतः, जिला जनवााचन ऄजधकारी, नइ ददल् ली, रा.रा.क्षेे. ददल् ली और मु्‍य जनवााचन ऄजधकारी, ददल् ली की ररप टों के अधार पर भारत जनवााचन अय ग द्वारा जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के ईप जनयम (5) के तहत जनवााचन व्यय का लेखा दाजखल न करने पर, श्री सनु ील कुमार क कारण बताओ न रटस ददनांक 26.07.2019 िारी दकया गया था; और यतः, जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के ईप जनयम (6) के ऄनुसार, ददनांक 26.07.2019 के ईपयुाक्त कारण बताओ न रटस के माध्य म से, श्री सनु ील कुमार क जनदिे ददया गया था दक वे आस न रटस के प्राप्त ह ने के 20 ददनों के भीतर लेख े प्रस्ट्तुत न कर पाने का कारण स्ट्पष्ट करते हुए अय ग क जलजखत में ऄपना ऄभ्यावेदन प्रस्ट्तुत करें और साथ ही, जनवााचन व्यय का ऄपना लेखा दाजखल करें/ऄपने लेखे में ्र ुरटयों क सही करें और ईसे संबंजधत जिला जनवााचन ऄजधकारी क प्रस्ट्तुत करें; और यतः श्री सनु ील कुमार द्वारा ईक्त न रटस ददनाकं 10.12.2020 क प्राप्त दकया गया था ऄभ्यथी स ेप्राप्त पावती, एसडीएम, जनवाचा न, नइ ददल्ली जिला द्वारा ददनाकं 13.12.2020 के ऄपन े प्र सं- ओ/डीइओ(एसडीएम)/इ/एनडीडी/2019/4696-97 के द्वारा अय ग क प्रस्ट्ततु कर दी गइ है और यत:, एसडीएम (इ), नइ ददल् ली द्वारा ददनांक 28.02.2020 के ऄपने प्र सं. ओ/डीइओ(एसडीएम)/इ/एनडीडी/2019/ 1914-15 के द्वारा प्रस्ट्त तु ऄनपु रू क ररप टा म ें यह कहा गया ह ै दक श्री सनु ील कुमार, जनवासी-फ्लैट न0ं -248, जवध्या जवहार, वस्ट्े ट एन्कलैव, पीतमपरु ा, ददल्ली-110034 न े न त क इ ऄभ् यावेदन ददया ह ै और न ही मूल वाईचसा सजहत जवजधवत रूप से हस्ट् ताक्षेररत जनवााचन ‍ यय के सही लेखे प्रस्ट् तुत दकए हैं आसके ऄजतररक् त, ईन् होंने भारत जनवााचन अय ग के सम् यक् न रटस की प्राजप्त के बाद भी ईक् त ऄसफलता हते ु न त क इ कारण बताया न ही स्ट्प ्‍ टीकरण ददया ह;ै[भाग II—खण् ड 3(iii)] भारत का रािप्र : िनवरी 2, 2021/पौष 12, 1942 345 और यत:, भारत जनवााचन अय ग का यह समाधान ह गया ह ै दक श्री सनु ील कुमार जनवााचन व्यय का लेखा दाजखल करने में ऄसफल रह ेह ैंऔर ऄसफलता के जलए ईनके पास क इ समुजचत कारण या न्याय जचत्य नहीं है; और यत:, ल क प्रजतजनजधत्व ऄजधजनयम, 1951 की धारा 10क में यह ऄनुबंजधत दकया गया ह ैदक:- "यदद जनवााचन अय ग का यह समाधान ह िाता ह ैदक क इ व्यजक्त- (क) जनवााचन व्ययों का लेखा ईस समय के भीतर और ईस रीजत में िैसी आस ऄजधजनयम के द्वारा या कानून के ऄधीन ऄपेजक्षेत ह,ै दाजखल करने में ऄसफल रहा है; तथा (ख) ईसके पास ईस ऄसफलता के जलए क इ समुजचत कारण या न्याय जचत्य नहीं ह,ै त जनवााचन अय ग िासकीय रािप्र में प्रकाजित अदिे द्वारा ईसक जनरर्हहत घ जषत करेगा और ऐसा क इ भी व्यजक्त ईस अदिे की तारीख से तीन वषा की कालावजध के जलए जनरर्हहत रहगे ा; ऄब आसीजलए, ल क प्रजतजनजधत्व ऄजधजनयम, 1951 की धारा 10क के ऄनुसरण में भारत जनवााचन अय ग एतद्द्वारा रा.रा.क्षे्र े ददल् ली राज्य के 04-नइ ददल्ली संसदीय जनवााचन क्षेे्र से ल क सभा के साधारण जनवााचन, 2019 में जनवााचन ल़ने वाले ऄभ्यथी, श्री सनु ील कुमार, जनवासी-फ्लटै न0ं -248, जवध्या जवहार, वस्ट्े ट एन्कलैव, पीतमपरु ा, ददल्ली-110034 क संसद के दकसी भी सदन या राज्य या संघ राज्य-क्षेे्र की जवधानसभा ऄथवा जवधान पररषद के जलए सदस्ट्य चुने िाने या ह ने के जलए आस अदिे की तारीख से तीन वषा की ऄवजध के जलए जनरर्हहत घ जषत करता है [सं. 76/भा.जन.अ./अद.े/प्रा./एनएस-II/डीएल-ल कसभा/04/2019] अदिे से, ऄिय कुमार, सजचव ORDER New Delhi, the 23rd December, 2020 O. N. 125 .—WHEREAS, the Commission had declared to hold the General Election to the House of the People of NCT of Delhi to 04–New Delhi Parliamentary Constituency vide its Notification dated 16.04.2019 and Shri Sunil Kumar had contested the aforesaid election; AND WHEREAS, as per Section 77 (1) of the Representation of the People Act, 1951, every candidate at election shall, either by himself or by his election agent, keep a separate and correct account of all expenditure in connection with the election incurred or authorized by him or by his election agent between (the date on which he has been nominated) and (the date of declaration of the result thereof), both dates inclusive & as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within thirty days from the date of election of the returned candidate lodge with the District Election Officer (DEO) account of his election expenses which shall be in a true copy of the account kept by him or by his election agent under Section 77. AND WHEREAS, as per the report under rule 89(2) of the Conduct of Election Rules, 1961, submitted by the District Election Officer, North West District, NCT of Delhi through the Chief Electoral Officer’s letter No. CEO/EEM(102)/(49)GE-2019/49970 dated 09.07.2019, Shri Sunil Kumar, Peoples Party of India (Democratic) contesting candidate from 04-New Delhi Parliamentary Constituency of NCT of Delhi, has failed to lodge any account of his election expenses as required by law. AND WHEREAS, on the basis of the reports of the District Election Officer, New Delhi, NCT of Delhi and the Chief Electoral Officer, Delhi, a Show Cause notice dated 26.07.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Sunil Kumar for non submission of account of Election expenses; AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 26.07.2019, Shri Sunil Kumar was directed to submit his representation in writing in the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice; AND WHEREAS, the said notice was received by Shri Sunil Kumar on 10-12-2019. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by SDM(E), New Delhi vide his letter No. O/ DEO/SDM(E)/NDD/2019/4696-97 dated 13.12.2019. AND WHEREAS, in the supplementary report submitted by SDM(E), New Delhi vide his letter No. O/ DEO/SDM(E)/NDD/2019/1914-15 dated 28-02-2020,, it has been stated that Shri Sunil Kumar, resident of Flat No. 248, VidyaVihar, West Enclave, Pitampura Delhi-110034 has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers.
