और यतः, जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के उप-जनयम (1) के तित, मुख्य जनवााचन अजिकारी, केरल स े उनके पत्र स.ं ईएल1/2/2021-ईएलईसी, दिनांक 24.08.2021 के तित प्राप्त जिला जनवााचन अजिकारी, कन्नरू की दिनांक 08.06.2021 की ररपोटा के अनुसार, सी.ओ.टी. नसीर, िो केरल के सािारण जनवाचा न, 2021 के 13-तलस्ट्सेरी जविान सभा क्षत्रे स े जनवााचन लड़ने वाले अभ्यथी ि,ैं जवजि के अंतगात यथा अपेजक्षत रीजत स े अपने जनवााचन व्यय के लेख े िाजखल करन े म ेंअसफल रि ेि;ैं और यतः, जिला जनवााचन अजिकारी, कन्नूर की उक्त ररपोटा के आिार पर, भारत जनवााचन आयोग द्वारा जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के उप-जनयम (5) के अंतगात सी.ओ.टी. नसीर को अपन े जनवााचन व्यय के लेख े प्रस्ट्तुत निीं करन े के जलए कारण बताओ नोरटस स.ं 76/केएल-एलए/2021/सीईएमएस-II, दिनांक 06 अक्टूबर,2021 िारी दकया गया था; और यतः, उपयुाक्त उक्त कारण बताओ नोरटस के िररए और जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के उप- जनयम (6) के अंतगात, सी.ओ.टी. नसीर को लेखा िाजखल निीं दकए िाने संबंिी कारणों को स्ट्पष्ट करत े हुए आयोग को जलजखत म ें अपना अभ्यावेिन प्रस्ट्तुत करने तथा नोरटस प्राप्त िोने की तारीख स े 20 दिनों के अंिर जिला जनवााचन अजिकारी, कन्नूर को अपने जनवााचन व्यय के लेख े प्रस्ट्ततु करने का जनिेि दिया गया था; और यतः, जिला जनवााचन अजिकारी,कन्नूर जिला ने अपनी दिनांक 16.12.2021 की ररपोटा स.ं 2058/2021- पी1(ई5) म ें बताया ि ैदक सी.ओ.टी. नसीर को उक्त नोरटस दिनांक 11.11.2021 को तामील दकया गया था; और यतः, जनवााचनों के संचालन जनयम,1961 के जनयम 89 के उपजनयम (6) के अिीन अभ्यथी का अभ्यावेिन दिनांक 26.10.2021 को केवल कुछ वाउचरों के साथ जनवााचन व्यय का एक भाग िमा करते हुए आयोग को प्राप्त हुआ; और यतः, जिला जनवााचन अजिकारी, कन्नरू ने अपनी दिनांक 20.04.2022 की अनपु ूरक ररपोटा स.ं 2058/2021- पी1(ई5) म ें सूजचत दकया दक सी.ओ.टी. नासीर ने खाता िमा दकया (लेदकन जनिााररत प्रपत्रों म ें निीं) और रोिमराा लेखा रजिस्ट्टर, रोकड़ रजिस्ट्टर, बैंक रजिस्ट्टर, सार जववरणी प्रस्ट्तुत निीं दकय े ि ैऔर कुल सूजचत व्यय रु.1,37,000/- म ेंस ेकेवल कुछ वाउचर रु.63,500/- के िी प्रस्ट्तुत दकय ेगय े ि।ै यतः, आयोग ने अपने पत्र स.ं 76/केएल-एलए/2021/सीईएमएस- II/पाटा-1, दिनांक 11.07.2022 के तित जिला जनवााचन अजिकारी, कन्नरू स े पछू ा दक क्या अभ्यथी ने जनवााचनों के संचालन जनयम, 1961 के जनयम 86 (1) के (4) की अपेक्षा को पूरा दकया ि ै एव ं जिसकी एक प्रजत उक्त अभ्यथी को भी जचजननत की गई थी जिसमें उसस े इस पत्र के िारी िोने के 20 दिनों के भीतर चूक को िरूु स्ट्त करवान े िते ु अनरु ोि दकया गया था। यतः, जिला जनवााचन अजिकारी, कन्नरू की एक और ररपोटा स.ं 2058/2021/पी1(ई5), दिनाकं 03.08.2022 के तित सूजचत दकया दक अभ्यथी को इतने लंबे समय तक नोरटस िारी िोने के बाि भी जनवााचनों के संचालन जनयम,1961 के जनयम 86(1) स े (4) के अनुसार कोई ररपोटा या रोिमराा लेखा रजिस्ट्टर, रोकड़ रजिस्ट्टर, बैंक रजिस्ट्टर और सार जववरणी निीं प्रस्ट्तुत दकय े ि।ै यतः, आयोग न े अपने पत्र संख्या 76/केएल-एलए/2021/सीईएमएस- II/पाटा-1, दिनांक 13.09.2022 के तित जिला जनवााचन अजिकारी, कन्नरू स े स्ट्पष्टीकरण मांगा दक क्या उम्मीिवार को चुनाव व्यय रजिस्ट्टर के साथ जिसम ें रोिमराा लेखा रजिस्ट्टर, रोकड़ रजिस्ट्टर, बैंक रजिस्ट्टर और सार जववरणी िाजमल ि ै आपूर्ता की गई ि ै और जिला जनवााचन अजिकारी, कन्नरू को उपरोक्त रसीि की एक प्रजत प्रस्ट्तुत करने का जनिेि दिया। इस संबंि म,ें जिला जनवााचन अजिकारी, कन्नूर ने अपनी ररपोटा संख्या 2058/2021/पी1(ई5), दिनांक 24.09.2022 द्वारा पावती रसीि की प्रजत प्रस्ट्ततु की जिसम ें सी.ओ.टी. नसीर स े नामांकन प्राप्त करन े के समय आपूर्त ा की गई चुनाव सामग्री की सचू ी िाजमल ि।ै यतः, आयोग ने अपन े आगामी पत्र संख्या 76/केएल-एलए/13/2021/सीईएमएस-II दिनांक 07.02.2023 के माध्यम स े दफर स े उम्मीिवार को जिला जनवााचन अजिकारी, कन्नूर के पास 25 दिनों के भीतर चनु ाव खचा के ििे वाउचर रु. 73,500/- िमा करने के जलए किा। इस संबंि म,ें जिला जनवााचन अजिकारी, कन्नरू न े अपनी परू क ररपोटा संख्या 2058/2021/पी1(ई5)(1), दिनांक 28.03.2023 म ें उम्मीिवार के खाते के संबंि म ें बताया दक उम्मीिवार न े जनिााररत तरीके स े खाता िमा निीं दकया ि ै और जनवााचनों के संचालन जनयम, 1961 के जनयम 86 के तित रोिमरा ालेखा रजिस्ट्टर, रोकड़ रजिस्ट्टर, बैंक रजिस्ट्टर और सार जववरणी और रु. 73,500/- के िेि वाउचर अभी तक िमा निीं दकय े ि ै । इसजलए,[भाग II—खण् ड 3(iii)] भारत का रािपत्र : जसतम् बर 2, 2023/भाद्र 11, 1945 307 आयोग के नोरटस और उसके बाि के पत्राचार की प्राजप्त के बाि, सी.ओ.टी. नसीर ने कानून के तित जनिााररत खात े को िि ा करने म ेंजवफलता के जलए भारत जनवााचन आयोग को न तो कोई कारण और न िी स्ट्पष्टीकरण दिया ि;ै और यत:, लोक प्रजतजनजित्व अजिजनयम, 1951 की िारा 10क म ेंयि उपबंजित दकया गया ि ैदक:- यदि जनवााचन आयोग का समािान िो िाता ि ैदक कोई व् यजक्त- (क) जनवााचन व्ययों का लेखा उस समय के भीतर और उस रीजत म,ेंिैसी इस अजिजनयम के द्वारा या अिीन अपेजक्षत ि,ै िाजखल करन ेम ेंअसफल रिा ि;ै तथा (ख) उस असफलता के जलए कोई अच्छा कारण या न्यायोजचत्य निीं रखता ि,ै तो जनवााचन आयोग िासकीय रािपत्र म ेंप्रकाजित आििे द्वारा उसको जनरर्िता घोजित करेगा और ऐसा व् यजक्त उस आिेि की तारीख स ेतीन वि ाकी कालावजि के जलए जनरर्िता िोगा।"; यत:, तथ्यों और उपलब्ि अजभलेखों के आिार पर आयोग का यि समािान िो गया ि ै दक सी.ओ.टी. नसीर अपन े जनवााचन व् यय के लेख े जनिााररत रीजत स े िाजखल करन े म ें असफल रि े ि ैंऔर उनके पास ऐसा करन े म ें असफल रिन े के जलए कोई भी उजचत कारण अथवा औजचत् य निीं ि;ै और अत:, अब, लोक प्रजतजनजित्व अजिजनयम, 1951 की िारा 10क के अनुसरण म,ें भारत जनवााचन आयोग एतद्द्वारा घोिणा करता ि ै दक केरल के 13-तलस्ट्सेरी जविान सभा जनवााचन क्षत्रे के जलए सािारण जनवााचन, 2021 स े जनवााचन लड़ने वाल े अभ् यथी सी.ओ.टी. नसीर, जनवासी िािरा मंजिल- कय्याथ रोड, तलस्ट्सेरी-670101 इस आिेि की तारीख स े तीन विा की अवजि के जलए संसि के दकसी भी सिन अथवा राज्य अथवा संघ राज्य -क्षत्रे की जविान सभा अथवा जविान पररिि का सिस्ट् य चुन े िान े अथवा िोने के जलए जनरर्िता िोंग।े [फा. सं. 76/केएल-एलए/2021/सीईएमएस-II] आिेि स,े सुिीत कुमार जमश्र, सजचव ELECTION COMMISSION OF INDIA ORDER New Delhi, the 1st May, 2023 O.N. 132.—WHEREAS, the General Election to Legislative Assembly of Kerala, 2021 for 13-Thalassery Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/KL- LA/2021, dated 12th March, 2021; and WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within thirty days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be a true copy of the account kept by him or by his election agent under Section 77 of the said act; and WHEREAS, the result of the election for 13-Thalassery Assembly Constituency of Kerala, 2021 was declared by the Returning Officer on 02nd May, 2021 and hence the last date for lodging the account of Election Expenses was 01st June, 2021; and WHEREAS, the Commission having regard to the then prevailing pandemic situation of Covid-19, decided to condone any incidence of late submission of account by the candidate till 31st July, 2021; and WHEREAS, as per the report dated 08.06.2021 of the DEO, Kannur under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961 received through the CEO, Kerala vide his letter no. EL1/2/2021-ELEC, dated 24.08.2021, stating that C.O.T. Naseer, a contesting candidate from 13-Thalassery in General Election to legislative Assembly of Kerala, 2021 failed to lodge his account of election expenses, as required under law; and WHEREAS, on basis of the said report of the District Election Officer, Kannur a Show-Cause Notice No. 76/KL-LA/2021/CEMS-II, dated 06th October, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to C.O.T. Naseer for not lodging the account of his election expenses; and WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, C.O.T. Naseer was directed to submit representation in writing to the Election Commission308 THE GAZETTE OF INDIA : SEPTEMBER 2, 2023/BHADRA 11, 1945 [PART II—SEC. 3(iii)] explaining the reasons for not lodging the account and also to lodge the account of his election expenses with the District Election Officer, Kannur within 20 days from the date of receipt of the said notice; and WHEREAS, the District Election Officer, Kannur in his report no.2058/2021-P1(E5), dated 16.12.2021 has reported that the said notice was served to C.O.T. Naseer on 11.11.2021; and WHEREAS, the candidate’s representation dated 26.10.2021 under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961 was received in the Commission submitting a part of election expenses with a few vouchers only. WHEREAS, the District Election Officer, Kannur in his Supplementary Report on account of the candidate, received vide letter no.2058/2021-P1(E5), dated 20.04.2022 reported that C.O.T. Naseer submitted the account (but not in prescribed forms) and has not submitted the Day to Day Account Register, Cash Register, Bank Register, Abstract Statement and only a few vouchers of Rs.63,500/- out of total reported expenditure Rs.1,37,000/- have been submitted. WHEREAS, the Commission vide its letter no.76/KL-LA/2021/CEMS-II/Pt.1, dated 11.07.2022 asked the DEO, Kannur as to whether the candidate has fulfilled the requirement of Rule 86(1) to (4) of the Conduct of Elections Rules, 1961 and a copy of which was also marked to the aforesaid candidate with the request to get the default corrected within 20 days of issuance of the letter. WHEREAS, the DEO, Kannur vide his further report no.2058/2021/P1(E5), dated 03.08.2022 intimated that the candidate has not submitted any report or Day to Day Account Register, Cash Register, Bank Register and Abstract Statement as per Rule 86(1) to (4) of the Conduct of Elections Rules, 1961 even after issuing notice for such a long while. WHEREAS, the Commission vide its further letter no.76/KL-LA/2021/CEMS-II/Pt.1, dated 13.09.2022 sought a clarification from the DEO, Kannur as to whether the candidate has been supplied with Election Expenditure Register containing Day to Day Account Register, Cash Register, Bank Register & Abstract Statement and directed the DEO, Kannur to produce a copy of the receipt of aforementioned. In this connection, DEO, Kannur vide his report no.2058/2021/P1(E5), dated 24.09.2022 submitted the copy of Acknowledgement Receipt which includes the list of Election materials which were supplied to C.O.T. Naseer at the time of receiving his Nomination. WHEREAS, the Commission vide its subsequent letter no.76/KL-LA/13/2021/CEMS-II, dated 07.02.2023 again asked to the Candidate to submit the remaining vouchers of election expenses of Rs.73,500/- with the DEO, Kannur within 25 days of issuance of the letter. In this connection, the DEO, Kannur in his Supplementary report no.2058/2021/P1(E5) (1), dated 28.03.2023 on account of the candidate reported that the candidate has not submitted the account in prescribed manner and Day to Day Account Register, Cash Register, Bank Register & Abstract Statement and the remaining vouchers of Rs.73,500/- has to submit yet as prescribed under Rule 86 of the Conduct of Elections Rules, 1961. Hence, after receipt of the Commission’s notice and subsequent correspondence, C.O.T. Naseer has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:- “If the Election Commission is satisfied that a person- (a) has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and (b) has no good reason or justification for the failure, the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order.”; WHEREAS, on basis of the facts and available records, the Commission is satisfied that C.O.T. Naseer has failed to lodge his account of election expenses in manner prescribed and has no good reason or justification for the failure to do so; and NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares C.O.T. Naseer, resident of- Hajara Manzil, Kayyath Road, Thalassery- 670101 and a contesting candidate from 13-Thalassery Assembly Constituency in General Election to Legislative Assembly of Kerala, 2021, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order. and WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be a true copy of the account kept by him or his election agent under Section 77 of the said act; and WHEREAS, the result of the election for 211-Ramanathapuram Assembly Constituency of Tamil Nadu, 2021 was declared by the Returning Officer on 02nd May, 2021 and hence the last date for lodging the account of Election Expenses was 01st June, 2021; and WHEREAS, the Commission having regard to the then prevailing pandemic situation of Covid-19, decided to condone any incidence of late submission of account by candidate till 31st July, 2021; and WHEREAS, as per the report dated 03.08.2021 of the DEO, Ramanathapuram under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961 received through the CEO, Tamil Nadu vide his letter no. 8339/Ele- IV/2021-11, dated 16.08.2021 stating that Asan Ali, a contesting candidate from 211-Ramanathapuram Assembly Constituency in General Election to Legislative Assembly of Tamil Nadu, 2021 has failed to lodge the account of his election expenses, as required under law; and WHEREAS, on basis of the said report of the District Election Officer, Ramanathapuram, a Show-Cause notice No. 76/TN-LA/2021/CEMS-II, dated 17th September, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Asan Ali, for not lodging of the account of Election Expenses; and WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Asan Ali was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of his election expenses with the District Election Officer, Ramanathapuram District within 20 days from the date of receipt of the notice; and WHEREAS, the DEO, Ramanathapuram in his report no. D2/6740/2021; dated 11.02.2022 has reported that the said Show Cause Notice was served to Asan Ali on 01.10.2021; and WHEREAS, the District Election Officer, Ramanathapuram in his Supplementary Report received through vide letter no. D2/6740/2021; dated 11.02.2022 on account of the candidate, has reported that Asan Ali has not submitted any representation or statement of account of election expenses. और यत:, उम्मीिवार अिी बी. रन्नी ने अपन े ई-मले दिनांक 24.04.2023 के माध्यम स े जवजभन्न मिों पर खचा दकए गए 1,36,256/- रुपय े के चुनाव व्यय का केवल सार जववरण प्रस्ट्तुत दकया, जिसम ें जनवााचनों के संचालन जनयम, 1961 के जनयम 86 (2) के तित आवश्यक संपूण ा चुनाव व्यय स े संबंजित वाउचर, उम्मीिवार रजिस्ट्टर और िपथ पत्र आदि िाजमल निीं थ;े और यत:, आयोग ने अपनी आगामी पत्र स.ं 76/केएल-एलए/2021/सीईएमएस-2; दिनांक 12.06.2023 के माघ्यम स े अिी बी. रन्नी को जनवााचनों के संचालन जनयम, 1961 के जनयम 86(1) स े (4) का अनुपालन करन े और पत्र के िारी िोने के 25 दिनों के भीतर उम्मीिवार को रोिमराा लेखा रजिस्ट्टर, रोकड़ रजिस्ट्टर, बैंक रजिस्ट्टर, सार जववरणी और चुनाव व्यय के वाउचर आदि के साथ जिला चुनाव अजिकारी, पथनमजथट्टा के पास िमा करन े के जलए किा । इस संबंि म,ें जिला चुनाव अजिकारी, पथनमजथट्टा को भी अनुपरू क ररपोटा म ें यि रटप्पणी भी िने े के जलए किा गया दक क्या िोिी उम्मीिवार न े वांजछत आवश्यकताओं को पूरा दकया ि ैया निीं; Ranni, for not lodging the account of Election Expenses; and WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Aji B. Ranni was directed to submit his representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of his Election Expenses with the District Election Officer, Pathanamthitta within 20 days from the date of receipt of the notice; and WHEREAS, the District Election Officer, Pathanamthitta in his report no. E1-266504/2020; dated 22.11.2021 reported that in the absence of Aji B. Ranni, the Tahsildar & ERO of Ranni LAC pasted the notice on the wall of his house and got the signature of two witnesses on 30.10.2021; and WHEREAS, the candidate has represented to the Commission vide his e-mail dated 19th October, 2022 and has requested to grant him a few days more time to submit the account of his election expenditure; and Accordingly vide letter no. 76/KL-LA/2021/CEMS-II; dated 02nd March 2023 the Commission has forwarded his representation to the CEO, Kerala to obtain the remarks of District Election Officer, Pathanamthitta and submit Supplementary Report as to whether the candidate has lodged the account of his election expenses and a copy of which also marked to the District Election Officer, Pathanamthitta as well as the candidate Sh. Aji B. Ranni. WHEREAS, the candidate Aji B. Ranni vide his e-mail dated 24th April, 2023 sent only Abstract Statement of election expenditure of Rs.1,36,256/- spent on various items without accompanied by the vouchers related to election expenditure as required under Rule 86 (2) of the Conduct of Elections Rules, 1961, Candidate Registers & Affidavits etc.; and WHEREAS, the Commission vide his letter no. 76/KL-LA/2021/CEMS-II; dated 12th June, 2023 directed Aji B. Ranni to comply with the Rule 86(1) to (4) of the Conduct of Elections Rules, 1961 and to submit the Day to Day Account Register, Cash Register, Bank Register, Abstract Statement and accompanied by expenditure Vouchers with the District Election Officer, Pathanamthitta within 25 days of issue of letter and also requested District Election Officer, Pathanamthitta to submit a Supplementary Report indicating as to whether the defaulting candidate has fulfilled the requirements as desired or not; and WHEREAS, the District Election Officer, Pathanamthitta in his Report no. E1-266504/2020; dated 07.07.2023 informed that Aji B.
