As per the schedule, Date of Counting was 23rd May, 2019. AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer, from the date of election of returned candidate; AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including 02-Paschim Champaran Parliamentary Constituency on 23rd May, 2019. As such the last date for lodging of account of election expenses was 22nd June, 2019.[भाग II—खण् ड 3(iii)] भारत का रािृ्र : मार्च 6, 2021/फाल् गनु 15, 1942 51 AND WHEREAS, as per the report dated 25th June, 2019 submitted by the District Election Officer, Paschim Champaran, Bettiah District, forwarded by Chief Electoral Officer, Bihar vide letter No. EXP-09/2019 (Part-26)-5704, dated 5th July, 2019, Shri Rakesh Kumar contesting candidate of Bahujan Samaj Party from 02-Paschim Champaran Parliamentary Constituency of Bihar, has failed to lodge any account of his election expenses as required by law. AND WHEREAS, on the basis of the reports of the District Election Officer, Paschim Champaran District, Bihar and the Chief Electoral Officer, Bihar a Show Cause Notice dated 12th February, 2020 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Rakesh Kumar for non-submission of Election expenses; AND WHEREAS, as per Sub Rule(5) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice, dated 12th February, 2020, Shri Rakesh Kumar was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice; AND WHEREAS, the said notice was received by Shri Rakesh Kumar on 9th March, 2020. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Paschim Champaran, Bettiah vide his letter 274/Ele-dated 21st April, 2020. AND WHEREAS, in the supplementary report submitted by District Election Officer, Bilaspur vide his letter No. 274@fuokZ. dated dated 21st April, 2020 has stated that Shri Rakesh Kumar has not submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well; AND WHEREAS, the Commission satisfied that Shri Rakesh Kumar failed to lodge an account of election expenses and has no good reason or justification for the failure; AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :- ‘‘If the Election Commission is satisfied that a person: (a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and (b) Has no good reason or justification for the failure the Election Commission shall by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the order; NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh Rakesh Kumar, R/o Hariwatika, Pokhra, Bettiah, Post-Bettiah, Dist- West Champaran and the contesting candidate of Bahujan Samaj Party for General Election to Lok Sabha of Bihar 2019 from 02-Paschim Champaran Parliamentary Constituency of the state of Bihar to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Parliamentary or legislative Council of a State or Union Territory for a period of three years from the date of this order. BUTOLIA, Senior Principal Secy. ubZ fnYyh] 5 ekpZ] 2021 यतः, भारत निर्ााचि आयोग द्वारा छत्तीसगढ़ राज्य में नर्धाि सभा के साधारण निर्ााचि 2018 की घोषणा प्रेस िोट संख्या ईसीआई/प्रे.िो./66/2018 नििांक 6 अक्टूबर, 2018 के जररए की गई थी । कायाक्रम के अिसु ार, मतगणिा की तारीख 11 निसम्बर, 2018 थी । और यतः, लोक प्रनतनिनधत्र् अनधनियम, 1951 की धारा 78 के अिुसार, निर्ााचि लड़िे र्ाले प्रत्येक अभ्यथी को, निर्ाानचत अभ्यथी के निर्ााचि की तारीख से 30 नििों के भीतर निर्ााचि व्यय के अपिे लेखे की सही प्रनत नजला निर्ााचि अनधकारी को िानखल करिी होती है;56 THE GAZETTE OF INDIA : MARCH 6, 2021/PHALGUNA 15, 1942 [PART II—SEC. 3(iii)] और यतः, 32 - मस्ट्तरू ी (अ िा ) नर्धाि सभा निर्ााचि क्षेत्र सनहत संबंनधत ररटनििंग अनधकारी द्वारा उक्त निर्ााचि के पररणाम 11 निसम्बर, 2018 को घोनषत नकए गए थे । इस प्रकार, निर्ााचि व्यय के लेखे िानखल करिे की अनततम तारीख 10 जिर्री, 2019 थी; और यतः, नजला निर्ााचि अनधकारी, जिलासृुर नजला, छत्तीसगढ़ द्वारा प्रस्तुत और मख्ु य निर्ााचि अनधकारी, छत्तीसगढ़ द्वारा अपिे नििांक 29 जिर्री, 2019 के पत्र सं. 21/चार/नर्.स.चु./ई.ई.एम/2019/85 के जररए अग्रेनषत नििांक 11 जिर्री,2019 की ररपोटा के अिसु ार श्री संि टण्डन, जो छत्तीसगढ़ के 32 - मस्ट्तूरी (अ. िा. ) नर्धाि सभा निर्ााचि क्षेत्र से निर्ााचि लड़िे र्ाले जनिचली अभ्यथी ह,ैं नर्नध द्वारा यथापेनक्षत रीनत से अपिे निर्ााचि व्यय का कोई भी लेखा िानखल करिे में नर्फल रह ेहैं । और यतः, नजला निर्ााचि अनधकारी, जिलासृुर नजला, छत्तीसगढ़ और मुख्य निर्ााचि अनधकारी, छत्तीसगढ़ की ररपोटों के आधार पर भारत निर्ााचि आयोग द्वारा निर्ााचिों का संचालि नियम 1961 के नियम 89 के उप नियम (5) के अंतगात निर्ााचि व्यय प्रस्तुत िहीं करिे के नलए श्री सिं टण्डन को कारण बताओ िोनटस नििांक 30 िनवरी , 2020 जारी नकया गया था; और यतः, निर्ााचिों का संचालि नियम 1961 के नियम 89 के उप-नियम (6) के अिसु ार, नििांक 8 अगस्त,2019 के उपयाक्तु कारण बताओ िोनटस के जररए श्री संि टण्डन को नििेश निया गया था नक र्े इस िोनटस के प्राप्त होिे के 20 नििों के अंिर लेखे ि प्रस्तुत कर पािे के कारणों को स्पष्ट करते हुए नलनखत रूप में अपिा अभ्यार्ेिि प्रस्तुत करें और साथ ही, निर्ााचि व्यय का अपिा लेखा िानखल करें; और यतः, उक्त िोनटस श्री संि टण्डन, द्वारा 01 िुलाई, 2020 को प्राप्त नकया था । अभ्यथी से प्राप्त पार्ती रसीि नजला निर्ााचि अनधकारी, जिलासृुर द्वारा अपिे नििांक 05 अगस्त, 2020 के पत्र संख्या जन. ृ. /जव. स. जन./व्य लेखा /2020/182 के जररए आयोग को प्रस्तुत कर िी गई है; और यतः, नजला निर्ााचि अनधकारी, जिलासृुर द्वारा अपिे नििांक 25 अगस्ट्त, 2020 के पत्र संख्या जन. ृ. /जव. स. जन./व्य लखे ा /2020 के जररए प्रस्तुत की गई अिपु रू क ररपोटा में यह बताया गया ह ैनक श्री संि टण्डन िे आज की तारीख तक ि तो कोई भी अभ्यार्ेिि और ि ही अपिे निर्ाचा ि व्यय का लेखा िानखल नकया ह ै। इसके अनतररक्त उतहोंिे भारत निर्ााचि आयोग का सम्यक िोनटस नमलिे के उपरांत भी उक्त नर्फलता के नलए ि तो कोई कारण बताया ह ैऔर ि ही कोई स्पष्टीकरण निया ह;ै और यतः, आयोग का यह समाधाि हो गया है नक श्री संि टण्डन निर्ााचि खचों का लेखा िानखल करि में नर्फल रहे ह ैंऔर उिके पास इस नर्फलता के नलए कोई भी उनचत कारण अथर्ा औनचत्य िहीं है, और यत:, लोक प्रनतनिनधत्र् अनधनियम, 1951 की धारा 10क में अिबु ंनधत नकया गया ह ैनक :- "यनि निर्ााचि आयोग का समाधाि हो जाता ह ैनक कोई व्यनक्त - i. निर्ााचि व्ययों का लेखा उस समय के भीतर और उस रीनत में जैसी इस अनधनियम के द्वारा या अधीि अपेनक्षत है, िानखल करिे में असफल रहा है; तथा ii. उस असफलता के नलए कोई अच्छा कारण या तयायोनचत्य िहीं रखता है, तो निर्ााचि आयोग शासकीय राजपत्र में प्रकानशत आिेश द्वारा उसको निरनहता घोनषत करेगा और ऐसा व्यनक्त उस आिेश की तारीख से तीि र्षा की कालार्नध के नलए निरनहता होगा; अतः, अब लोक प्रनतनिनधत्र् अनधनियम, 1951 की धारा 10क के अिसु रण में भारत निर्ााचि आयोग एतिद्व् ारा घोषणा करता ह ैनक छत्तीसगढ़ राज्य के 32 - मस्ट्तूरी (अ. िा. ) नर्धाि सभा निर्ााचि क्षेत्र से छत्तीसगढ़ राज्य में नर्धाि सभा के साधारण निर्ााचि, 2018 में निर्ााचि लड़िे वाले जनिचली अभ् थी श्री संि टण्डन, निर्ासी ग्राम - डगजन ा, ृ .- मल्िार , ति.- मस्ट्तूरी, जिला - जिलासृुर, छत्तीसगढ़, इस आिेश की तारीख से तीि र्षा की अर्नध के नलए संसि के नकसी भी सिि अथर्ा राज्य अथर्ा संघ राज्य-क्षेत्र की नर्धाि सभा अथर्ा नर्धाि पररषि का सिस्य चुिे जािे अथर्ा होिे के नलए निरनहता है । [Qk- la--N-x--fo-l-/iwoZ vuq--1@32/2018] vkns'k ls] ujsUnz uk- cqVksfy;k] ofj"B iz/kku lfpo ORDER New Delhi, the 5th March, 2021 O.N. 24.— WHEREAS, the General Election to Legislative Assembly of Chhattisgarh, 2018 was announced by Election Commission of India vide Press Note No. ECI/PN/66/2018 dated 6th October, 2018. As per the schedule, Date of Counting was 11th December, 2018. AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer, from the date of election returned candidate;[भाग II—खण् ड 3(iii)] भारत का रािृ्र : मार्च 6, 2021/फाल् गनु 15, 1942 57 AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including 32- Masturi (SC) Assembly Constituency on 11th December, 2018. As such the last date for lodging of account of election expenses was 10th January, 2019. AND WHEREAS, as per the report dated 11th January, 2019 submitted by the District Election Officer, Bilaspur District, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No. 21/चार/वि.स.च. ु/ई.ई.एम/2019/85 dated 29th January, 2019, Shri Sanjay Tondan, Independent contesting candidate from 32- Masturi (SC) Assembly Constituency of Chhattisgarh, has failed to lodge any account of his election expenses as required by law. AND WHEREAS, on the basis of the reports of the District Election Officer, Bilaspur, Chhattisgarh and the Chief Electoral Officer, Chhattisgarh, a Show Cause notice dated 30th January, 2020 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Sanjay Tondan for non- submission of Election expenses; AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 30th January, 2020, Shri Sanjay Tondan was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice; AND WHEREAS, the said notice was received by Shri Sanjay Tondan on 01st July, 2020. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Bilaspur vide his letter No. नि. प. /वि. स. नि./व्यय लेखा /2020/182 dated 05th August, 2020. AND WHEREAS, in the supplementary report submitted by District Election Officer, Bilaspur vide his letter No. नि. प. /वि. स. नि./व्यय लेखा /2020 dated 25th August, 2020 has stated that Shri Sanjay Tondan, has not submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well; AND WHEREAS, the Commission satisfied that Shri Sanjay Tondan has failed to lodge an account of election expenses and has no good reason or justification for the failure; AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :- "If the Election Commission is satisfied that a person: (a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and (b) Has no good reason or justification for the failure the Election Commission shall by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the under; NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Sanjay Tandon, resident of Daganiya, Post- Malhar, Tehsil- Masturi, Dist- Bilaspur, Chhattisgarh and the contesting independent candidate for General Election to Legislative Assembly of Chhattisgarh, 2018 from 32-Masturi (SC) Assembly Constituency of the state of Chhattisgarh to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or legislative Council of a State or Union Territory for a period of three years from the date of this order.
