No. 222, 233 भाग —IV PART –IV भाग- I्म्ेंजजममजलत्अजधजचू नाओं्को्छोड़कर्राष्‍टर्ीय्राजधानी्राज्य् ्््रे , ददल्ल् ी्जरकार्के््जिभागों् की्अजधजचू नाए ् Notifications of Departments of the Government of the National Capital Territory of Delhi other than Notifications included in Part-I राष्‍टर्ीय्राजधानी्राज्य् ्््रे , ददल्ल् ी्जरकार GOVERNMENT OF NATIONAL CAPITAL TERRITORY OF DELHI राज्य् ्चनन ाि्ययोग राष्‍टर्ीय्राजधानी्््रे ्ददल्ल् ी्जरकार्एि ्चड ीग यदिे ददल््ली, 21 अक््तूबर, 2021 ज. ्एफ.1(578)/प्रिा./् रा.च.नय./2021/1203F/1571.—जबदक, ददल्ली के तीन नगर जनगमों के जलए यम चननाि 23.04.2017 को हुए थे। और जबदक,्चननाि लड़ने िाले प्रत्येक उममीदिार को ददल्ली नगर जनगम (पार्षदों का चननाि) जनयमािली, 2012 के जनयम 104 के प्रािधानों के अननजार चननाि के पररणाम की घोर्णा के 10 ददनों के भीतर ज ब जधत ररटर्ननग अजधकारी के पाज अपने चननािी खचष का लेखा-जोखा दाजखल करना यिश्यक था। नामा कन दाजखल करते जमय ररटर्ननग अजधकारी द्वारा उममीदिारों को ददए गए चननाि व्यय के जनदिे रजजस्‍टटर में जनजित ि।ैं 6235 DG/2021 (69)70 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: OCTOBER 28, 2021/KARTIKA 6, 1943 [ PART IV और जबदक, ज ब जधत ररटर्ननग अजधकारी द्वारा अपनी ररपोटष में यि जूजचत दकया गया था दक उममीदिार श्रीमती्गन जन्गोयल् िाडष्न बर्99-N (कमषपनरा) ने जमय पर अपन े खचष का लेखा-जोखा प्रस्‍टतनत दकया, लेदकन यि दखे ा गया दक ददना क 29.04.2017 का िपथ प्र प्रस्‍टतनत दकया गया था, परन्तन्नोटरी द्वारा जत्याजपत निीं दकया गया था। ददल्ली नगर जनगम (पार्षदों का चननाि) जनयम, 2012 के जनयम 104 के तित इजकी यिश्यकता िोती ि।ै और जबदक,्उपरोक्त्जनयमािली्के जनयम 108(5) के तित ददना क 24.04.2020 को कारण बताओ नोरटज स्‍टपीड पोस्‍टट न बर ED169730608IN के माध्यम जे भेजा गया था, लेदकन इजे 28.08.2020 को इज्रटप्पणी के जाथ ययोग में िाजपज कर ददया गया था दक्ितषमान्में्प्राथी्ददए्गए्पते्पर्निीं्रिता्िै। और जबदक, जैजा दक िि जनधाषररत तरीके और जमय के अननजार चननाि व्यय खातों को दजष करने में जिफल रिी थी, ददना क 25.01.2021 को एक यदिे माननीय राज्य चननाि ययनक्त, ददल्ली द्वारा पाररत दकया गया था जजजके्द्वारा्उममीदिार्को्6्िर्ष्के् जलए्अयोग्य्घोजर्त्दकया्गया्था्और ददल्ली जरकार के जाधारण राजप्र में यि किते हुए प्रकाजित दकया गया था दक उममीदिार जनधाषररत तरीके और जमय में चननाि खचष का लेखा-जोखा जमा करने में जिफल रिा ि।ै और जबदक,्श्रीमती गन जन गोयल ने अपने अयोग्यता यदिे ददना क 25.01.2021 के जखलाफ एक अपील दायर की ि ैजजजम ें किा गया ि ै दक चू दक उन्िोंने 2018 में अपना यिाज स्‍टथाना तररत कर जलया था, इजजलए राज्य्चननाि्ययोग द्वारा भेजे गए नोरटज उन्िें प्राप्त निीं हुए थे। उन्िोंने्किा ि ैदक यदद्उन्ि्ेंिो्नोरटज्प्राप्त्हुए्िोते तो नोटरी द्वारा जिजधित रूप जे प्रमाजणत एक और्िपथ- प्र प्रस्‍टतनत कर्ददया्िोता।्उन्िोंने अब नोटरी द्वारा जिजधित प्रमाजणत एक नया िपथ-प्र प्रस्‍टतनत दकया िै और इज प्रकार नोरटज में बताई गई कमी को पूरा कर्ददया्गया ि।ै और जबदक मैं, एज.के. श्रीिास्‍टति, राज्य चननाि ययनक्त, ददल्ली उपरोक्त पररजस्‍टथजतयों में अब श्रीमती गन जन गोयल द्वारा की गई कारषिाई जे ज तनष्ट हूँ, कानून का्अननपालन्करते्हुए, ददल्ली नगर जनगम (पार्षदों के चननाि)्जनयमािली,्2012्के्जनयम्111 के तित प्रदत्त िजक्तयों के अननजार म,ैं एतद्द्वारा, श्रीमती गन जन गोयल की अयोग्यता ददना क 25.01.2021 के्यदिे ्को्तत्काल प्रभाि ज े जमाप्त करता्हूँ। एज.के. श्रीिास्‍टति, राज्य चननाि ययनक्त STATE ELECTION COMMISSION N.C.T. OF DELHI & U.T. CHANDIGARH ORDER Delhi, the 21st October, 2021 No.F.1(578)/Admn./SEC/2021/1203F/1571.—WHEREAS General Election to the three Municipal Corporations of Delhi were held on 23.04.2017. AND WHEREAS every contesting candidate was required to file his accounts of Election Expenses with the concerned Returning Officer within 10 days of the declaration of result of election in accordance with the provisions of Rule 104 of the Delhi Municipal Corporation (Election of Councillors) Rules, 2012 and the direction/instructions contained in the Register of Election Expenses supplied to candidates by the Returning Officer at the time of filing nomination. AND WHEREAS it was informed by concerned Returning Officer in his report, that the candidate Mrs. Gunjan Goel, Ward No. 99N (Karampura) submitted her accounts of expenditure in time but it was noticed that affidavit dated 29.04.2017 was submitted but not attested by Notary. The same is required under Rule 104 of Delhi Municipal Corporation (Election of Councillors) Rules, 2012. AND WHEREAS a Show Cause Notice dated 24.04.2020 under Rule 108(5) of the aforesaid Rules was sent to her vide Speed Post No. ED169730608IN but the same was returned back in this Commission on 28.08.2020 with the remarks “LEFT”. AND WHEREAS as she had failed to file the Election Expenditure Accounts as per prescribed manner and time, an order dated 25.01.2021 disqualifying the candidate for 06 years w.e.f. 25.01.2021 was passed by the Hon’ble State Election Commissioner, Delhi and published in an ordinary Gazette of Delhi Govt. stating that the candidate has failed to lodge Account of Election Expenses in the prescribed manner and time. AND WHEREAS Mrs. Gunjan Goel has filed an appeal against her Disqualification Order dated 25.01.2021 stating that as she had shifted her residence in 2018, notices sent by the State Election Commission office were not received by her. She has now submitted fresh affidavit duly attested by the Notary and thus deficiency pointed out in the Notices has since been made up. AND WHEREAS I, S.K. Srivastava, State Election Commissioner, Delhi am satisfied upon the action now taken by Mrs. Gunjan Goel under the above mentioned circumstances complies to the requirement of law. I, as per powers conferred upon me under Rule 111 of Delhi Municipal Corporation (Election of Councillors) Rules, 2012 do hereby remove the disqualification of Mrs. Gunjan Goel with immediate effect, as earlier ordered on 25.01.2021.
