AND WHEREAS, as per the report under rule 89(2) of the Conduct of Election Rules, 1961, submitted by the District Election Officer, Central Delhi District, NCT of Delhi through the Chief Electoral Officer’s letter No. CEO/COE/102/(77)/DLA-20/Scr.Rep/2020/37927 dated 26-05-2020, Shri Sonu Kaushik {Apki Apni Party (Peoples)} contesting candidate from 03-Timarpur Constituency of NCT of Delhi, has failed to lodge an account of his election expenses as required by law. AND WHEREAS, on the basis of the reports of the District Election Officer, Central District Delhi, NCT of Delhi and the Chief Electoral Officer, Delhi, a Show Cause notice dated 21-09-2020 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Sonu Kaushik for non submission of account of Election expenses; AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show Cause Notice dated 21-09-2020, Shri Sonu Kaushik was directed to submit his representation in writing in the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses rectify the defects in his accounts and submit the same to the District Election Officer concerned within 20 days from the date of receipt of the notice; AND WHEREAS, the said notice was made to serve to Smt Vimla, mother of Shri Sonu Kaushik on 28-09-2020 and acknowledgment receipt obtained from the mother of candidate was submitted to the Commission by SDM(E), Central vide his letter No. DEO(C)/75/E. Expenses/DLA-20/1150 dated 13-10-2020. AND WHEREAS, in the supplementary report submitted by SDM (E), Central Delhi vide letter No. No. DEO/C/75/E. Expenses/DLA-20/2931 dated 04-08-2021, it has been stated that Shri Sonu Kaushik has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice of the Election Commission of India as well;110 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: SEPTEMBER 23, 2021/ASVINA 1, 1943 PART II - Sec. 1] AND WHEREAS, the Commission is satisfied that Shri Sonu Kaushik has failed to lodge an account of election expenses and has no good reason or justification for the failure; AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:- “If the Election Commission is satisfied that a person- (a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act; and (b) Has no good reason or justification for the failure the Election Commission shall by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the order; NOW THEREFORE, in pursuance of Section 10 A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Sonu Kaushik, r/o House No. 709, Landa Panda Village, Burari, Delhi the contesting candidate for the General Election to the Legislative Assembly of NCT of Delhi, 2020 from 03- Timarpur Assembly Constituency to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order. Chief Electoral Officer fnYyh] 17 flrEcj] 2021 (104)/2019/pt.file/16248-&fuEufyf[kr dk s loZlk/kkj.k dh tkudkjh gsrq izdkf'kr fd;k tkrk gS %— भारत जनर्ाचा न अयोग सजचर्ालय अदिे नइ ददल् ली, 9 जसतम् बर, 2021 स.ं 76/भा.जन.अ./अद.े/प्रा./ई.ऄन.ु-II/दद.-जर्.सभा/03/2020.—यतः,अयोग ने रा.रा.क्षे. ददल् ली के 03-जतमारपुर जर्धानसभा जनर्ााचन क्षेत्र के जलए ददनांक 14.01.2020 की ऄपनी ऄजधसूचना के द्वारा जर्धानसभा के साधारण जनर्ााचन अयोजित करने की घोषणा की थी और श्री जर्िाल घन‍याम घोबाले (र्टीप ुसल्ु तान पार्टी) न ेपूर्ोक् त जनर्ााचन लडा था; और यतः,लोक प्रजतजनजधत्र् ऄजधजनयम, 1951 की धारा 77 (1) के ऄनुसार, जनर्ााचन लडने र्ाले प्रत्येक ऄभ्यथी, र्ह जतजथ िब ईसे नाम-जनदजे ित दकया गया ह ै और ईसके पररणाम की घोषणा की जतजथ, दोनों तारीखें सजम्मजलत, के बीच ऄपने द्वारा या ऄपने जनर्ााचन एिेंर्ट द्वारा ईपगत या ऄजधकृत जनर्ााचन संबंधी सभी खचों का, या तो स्ट्र्यं या ऄपन ेजनर्ााचन एिेंर्ट द्वारा, एक पृथक और सही लेखा रखेगा और लोक प्रजतजनजधत्र् ऄजधजनयम, 1951 की धारा 78 के ऄनुसार, जनर्ााचन लडने र्ाले प्रत्येक ऄभ्यथी, जनर्ााजचत ऄभ्यथी के जनर्ााचन की तारीख से तीस ददनों के भीतर ऄपने जनर्ााचन व्यय का लेखा जिला जनर्ााचन ऄजधकारी को दिा करेगा िो धारा 77 के ऄंतगात ईसके द्वारा ऄथर्ा ईसके जनर्ााचन एिेंर्ट द्वारा रखे गए लेखे की सत् य प्रजतजलजप होगी; और यतः, जनर्ााचनों का संचालन जनयम, 1961 के जनयम 89(2) के ऄधीन मुख्य जनर्ााचन ऄजधकारी के पत्र स.ं CEO/COE/102/(77)DLA-20/Scr.Rep/2020/37927 ददनाकं 26.05.2020 के िररए जिला जनर्ााचन ऄजधकारी, केन्द्रीय जिला, रा.रा.क्षेत्र, ददल् ली द्वारा प्रस्ट्तुत ररपोर्टा के ऄनुसार, राष्‍ट रीय रािधानी क्षेत्र, ददल् ली के 03- जतमारपुर जर्धानसभा जनर्ाचा न क्षत्रे स े जनर्ााचन लडने र्ाले (र्टीपु सल्ु तान पार्टी) के ऄभ्यथी,श्री जर्िाल घन‍याम घोबाल ेजर्जध द्वारा यथापेजक्षत रीजत से ऄपने जनर्ााचन व्यय का कोइ लेखा दाजखल करने में ऄसफल रह ेहैं;[PART II - Sec. 1 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: SEPTEMBER 23, 2021/ASVINA 1, 1943 111 और यतः,जिला जनर्ााचन ऄजधकारी, केन्द्रीय ददल् ली, रा.रा.क्षे. ददल् ली और मुख्य जनर्ााचन ऄजधकारी, ददल् ली की ररपोर्टों के अधार पर भारत जनर्ााचन अयोग द्वारा जनर्ााचनों का संचालन जनयम, 1961 के जनयम 89 के ईप जनयम (5) के तहत जनर्ााचन व्यय का लेखा दाजखल न करने पर,श्री जर्िाल घन‍याम घोबाले को कारण बताओ नोरर्टस ददनांक 21.09.2020 को िारी दकया गया था; और यतः,जनर्ााचनों का संचालन जनयम, 1961 के जनयम 89 के ईप जनयम (6) के ऄनुसार, ददनांक 21.09.2020 के ईपयुाक्त कारण बताओ नोरर्टस के माध्य म से,श्री जर्िाल घन‍याम घोबाले को जनदिे ददया गया था दक र्े आस नोरर्टस के प्राप्त होने के 20 ददनों के भीतर लेखे प्रस्ट्तुत न कर पाने का कारण स्ट्पष्ट करते हुए अयोग को जलजखत में ऄपना ऄभ्यार्ेदन प्रस्ट्तुत करें और साथ ही, जनर्ााचन व्यय का ऄपना लेखा दाजखल करें/ऄपने लेखे में त्रुरर्टयों को सही करें और ईसे संबंजधत जिला जनर्ााचन ऄजधकारी को प्रस्ट्तुत करें; और यतः, ईक्त नोरर्टस श्री जर्िाल घन‍याम घोबाल े के घर के बाहर ददनाकं 29.09.2021 और 01.10.2021 को ‘चस्ट्प ा’ ददया गए थ,े क्योंदक ददए गए पत े पर न तो र् े स्ट्र्य ं न ही ईनका पररर्ार रहता जमला। दो पडोजसयों से चस्ट्प ा ररपोर्टा की प्राप्त पार्ती एसडीएम(इ), केन्द्रीय ददल्ली द्वारा ददनाकं 13.10.2020 के पत्र स.ं DEO/C/75/E.Expenses/DLA-20/1150 द्वारा अयोग को प्रस्ट्त तु कर दी गइ थी। और यत:,एसडीएम (इ), केन्द्रीय ददल्ली द्वारा ददनांक 04.08.2021 के ऄपने पत्र सं. DEO/C/75/E.Expenses/DLA- 20/2931 के द्वारा प्रस्ट्त तु ऄनपु रू क ररपोर्टा में यह कहा गया है दक श्री जर्िाल घन‍याम घोबाल े ने न तो कोइ ऄभ् यार्ेदन ददया ह ैऔर न ही मूल र्ाईचसा सजहत जर्जधर्त रूप से हस्ट् ताक्षररत जनर्ााचन ‍ यय के सही लेखे प्रस्ट् तुत दकए ह।ैं आसके ऄजतररक् त, ईन् होंने भारत जनर्ााचन अयोग के सम् यक् नोरर्टस की प्राजप्त के बाद भी ईक् त ऄसफलता हते ु न तो कोइ कारण बताया न ही स्ट्प ष्‍ट र्टीकरण ददया है; और यत:,भारत जनर्ााचन अयोग का यह समाधान हो गया है दक श्री जर्िाल घन‍याम घोबाल ेजनर्ााचन व्यय का लेखा दाजखल करने में ऄसफल रह ेह ैंऔर ऄसफलता के जलए ईनके पास कोइ समुजचत कारण या न्यायोजचत्य नहीं है; और यत:,लोक प्रजतजनजधत्र् ऄजधजनयम, 1951 की धारा 10क में यह ऄनुबंजधत दकया गया ह ैदक:- "यदद जनर्ााचन अयोग का यह समाधान हो िाता ह ैदक कोइ व्यजक्त- (क) जनर्ााचन व्ययों का लेखा ईस समय के भीतर और ईस रीजत में िैसी आस ऄजधजनयम के द्वारा या कानून के ऄधीन ऄपेजक्षत ह,ै दाजखल करने में ऄसफल रहा है; तथा (ख) ईसके पास ईस ऄसफलता के जलए कोइ समुजचत कारण या न्यायोजचत्य नहीं है, तो जनर्ााचन अयोग िासकीय रािपत्र में प्रकाजित अदिे द्वारा ईसको जनरर्हहत घोजषत करेगा और ऐसा कोइ भी व्यजक्त ईस अदिे की तारीख से तीन र्षा की कालार्जध के जलए जनरर्हहत रहगे ा; ऄब आसीजलए, लोक प्रजतजनजधत्र् ऄजधजनयम, 1951 की धारा 10क के ऄनुसरण में भारत जनर्ााचन अयोग एतद्द्वारा रा.रा.क्षेत्र ददल् ली के 03-जतमारपरु जर्धानसभा जनर्ााचन क्षेत्र से जर्धानसभा के साधारण जनर्ााचन, 2020 में जनर्ााचन लडने र्ाले ऄभ्यथी, श्री जर्िाल घन‍याम घोबाल ेजनर्ासी-18 ख. न.ं 17/2014 श्री एन्क्लेर्, प्रहलादपरु ,बांगर गार्ं , ददल्ली-110042 को संसद के दकसी भी सदन या राज्य या संघ राज्य-क्षेत्र की जर्धानसभा ऄथर्ा जर्धान पररषद के जलए सदस्ट्य चुने िाने या होने के जलए आस अदिे की तारीख से तीन र्षा की ऄर्जध के जलए जनरर्हहत घोजषत करता है। अदिे से, ऄिय कुमार, सजचर् vkn's k }kjk vf[ky dqekj] la;qDr eq[; fuokpZ u vf/kdkjh112 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: SEPTEMBER 23, 2021/ASVINA 1, 1943 PART II - Sec. 1] OFFICE OF THE CHIEF ELECTORAL OFFICER, DELHI NOTIFICATION Delhi, the 17th September, 2021 No.CEO/COE/102 (104)/2019/pt.file/16248.—The following is published for general information:— SECRETARIAT OF THE ELECTION COMMISSION OF INDIA ORDER New Delhi, the 9th September, 2021 No.76/ECI/ORD/TERR/NS-II/DL-LA/03/2020.—WHEREAS, the Commission had declared to hold the General Election to the Legislative Assembly of NCT of Delhi from 03-Timarpur Assembly Constituency vide its Notification dated 14.01.2020 and Shri Vishal Ghanshyam Ghobale (Tipu Sultan Party) had contested the aforesaid election; AND WHEREAS, as per Section 77 (1) of the Representation of the People Act, 1951, every candidate at election shall, either by himself or by his election agent, keep a separate and correct account of all expenditure in connection with the election incurred or authorized by him or by his election agent between the date on which he has been nominated and the date of declaration of the result thereof, both dates inclusive & as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within thirty days from the date of election of the returned candidate lodge with the District Election Officer (DEO) account of his election expenses which shall be in a true copy of the account kept by him or by his election agent under Section 77. AND WHEREAS, as per the report under rule 89(2) of the Conduct of Election Rules, 1961, submitted by the District Election Officer, Central Delhi District, NCT of Delhi through the Chief Electoral Officer’s letter No. CEO/COE/102/(77)/DLA-20/Scr.Rep/2020/37927 dated 26-05-2020, Shri Vishal Ghanshyam Ghobale (Tipu Sultan Party) contesting candidate from 03-Timarpur Constituency of NCT of Delhi, has failed to lodge an account of his election expenses as required by law. AND WHEREAS, on the basis of the reports of the District Election Officer, Central District Delhi, NCT of Delhi and the Chief Electoral Officer, Delhi, a Show Cause notice dated 21-09-2020 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Vishal Ghanshyam Ghobale for non submission of account of Election expenses; AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show Cause Notice dated 21-09-2020, Shri Vishal Ghanshyam Ghobale was directed to submit his representation in writing in the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same to the District Election Officer concerned within 20 days from the date of receipt of the notice; AND WHEREAS, the said notice was made to serve to Shri Vishal Ghanshyam Ghobaleon 29-09-2020, to 01-10-2020 through ‘CHASPA’ as he himself or his family was not found residing at the given address. The Chaspa report acknowledgment receipt obtained from the two neighbours was submitted to the Commission by SDM(E), Central vide his letter No. DEO/C/75/E. Expenses/DLA-20/1150 dated 13-10-2020. AND WHEREAS, in the supplementary report submitted by SDM (E), Central Delhi vide letter No. DEO/C/75/E. Expenses/DLA-20/2931 dated 04-08-2021, it has been stated that Shri Vishal Ghanshyam Ghobale has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice of the Election Commission of India as well; AND WHEREAS, the Commission is satisfied that Shri Vishal Ghanshyam Ghobale has failed to lodge an account of election expenses and has no good reason or justification for the failure; AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:- “If the Election Commission is satisfied that a person- (a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act; and (b) Has no good reason or justification for the failure the Election Commission shall by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the order;[PART II - Sec. 1 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: SEPTEMBER 23, 2021/ASVINA 1, 1943 113 NOW THEREFORE, in pursuance of Section 10 A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Vishal Ghanshyam Ghobale, r/o. 18-Khassra No.17/2014 Shri Enclave Prahaladpur Bangar Gaon Delhi -110042 the contesting candidate for the General Election to the Legislative Assembly of NCT of Delhi, 2020 from 03-Timarpur Assembly Constituency to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.
