As per the schedule Date of Counting was 23.05.2019. AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer, from the date of election returned candidate; AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including 04- Dhubri Parliamentary Constituency on 23.05.2019. As such the last date for lodging of account of election expenses was 22.06.2019. AND WHEREAS, as per the report dated 25.06.2019 submitted by the District Election Officer, Dhubri District, Assam and forwarded by Chief Electoral Officer, Assam vide letter No. ELE 94/2018/225 dated 05.07.2019, Shri Uttam Kumar Ray, independent contesting candidate from 04-Dhubri Parliamentary Constituency of Assam, has failed to lodge any account of his election expenses as required by law. AND WHEREAS, on the basis of the reports of the District Election Officer, Dhubri District, Assam and the Chief Electoral Officer, Assam, a Show Cause notice dated 08.08.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 Shri Uttam Kumar Ray for non submission of Election expenses; AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 08.08.2019, Shri Uttam Kumar Ray was directed to submit his representation in writing in the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice; AND WHEREAS, the said notice was received by Shri Uttam Kumar Ray on 29.08.2019. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Dhubri vide his letter No.DEL-19/2019/112 dated 30.08.2019. AND WHEREAS, in the supplementary report submitted by District Election Officer, Dhubri vide his letter No.DEL-19/2019/112 dated 30.08.2019 has stated that Shri Uttam Kumar Ray, has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well; AND WHEREAS, the Commission satisfied that Shri Uttam Kumar Ray has failed to lodge an account of election expenses and has no good reason or justification for the failure; AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that :- “If the Election Commission is satisfied that a person- (a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act; and (b) Has no good reason or justification for the failure the Election Commission shall by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the under; NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Uttam Kumar Ray, resident of Vill Debottor Hasdaha PT-II, P.O. [No. 82/UP-HP/18/2019(Alld.)] By Order, ANUJ JAIPURIAR, Senior Principal Secy. भारत जनवार्च न आ ग सजर्वाल आििे नई दिल् ली, 16 मार्च, 2020 आ. अ. 20.— तः, भारत जनवाचर्न आ ग द्वारा प्रेस न ट सं्‍ ा ईसीआई/ृीएन/3/2018 दिनांक 18.01.2018 के तित जत्रृुरा जविान सभा के सािारण जनवाचर्न, 2018 की घ षणा की गई थी। अनुसूर्ी के अनुसार, मतगणना की तारीख 15.03.2018 थी; और त:, ल क प्रजतजनजित्व अजिजन म, 1951 की िारा 78 के अनुसार, जनवाचर्न ल़ने वाले प्रत् ेक अयर थक क , जनवाचजर्त अयर थक के जनवाचर्न की तारीख से 30 दिनों के भीतर अृने जनवाचर्न व्य ों के लेखे की मूल प्रजत जिला जनवाचर्न अजिकारी क प्रस्ट्तुत करनी ि ती िै; और तः, 44-राईमावैली (अ.ि.िा.) जविान सभा जनवाचर्न क्षेेत्र सजित उक्त जनवाचर्न के ृररणाम संबद्ध ररटर्निंग ऑदफसर द्वारा दिनांक 03.03.2018 क घ जषत दकए गए थे। इस प्रकार जनवाचर्न व्य ों के लेखे िाजखल करने की अजन्तम तारीख 02.04.2018 थी; और तः, जिला जनवाचर्न अजिकारी, थलाई जिला, जत्रृुरा द्वारा प्रस्ट्तुत दिनांक 31.03.2018 की ररृ टच के अनुसार श्री खगेंर रर ांग, ि जत्रृुरा के 44-राईमावैली (अ.ि.िा.) जविान सभा जनवाचर्न क्षेेत्र से जत्रृुरा ृीृुल्स ृाटक से जनवाचर्न ल़ने वाले अयर थक िं, जवजि द्वारा था अृेजक्षेत अृने जनवाचर्न व्य का क ई भी लेखा िाजखल करने में जवफल रि ेिं; और तः, जिला जनवाचर्न अजिकारी, थलाई जिला, जत्रृुरा की ररृ टच के आिार ृर भारत जनवाचर्न आ ग द्वारा जनवाचर्न का संर्ालन जन म, 1961 के जन म 89 के उृ-जन म (5) के अंतगचत श्री खगेंर रर ांग क जनवाचर्न संबंिी व्य प्रस्ट्तुत न करने के जलए दिनांक 08.01.2019 क कारण बता न रटस िारी दक ा ग ा था; और त:, दिनांक 16.09.2019 के उृ ुचक् त कारण बता न रटस के िररए जनवाचर्न के संर्ालन जन म, 1961 के जन म 89 के उृ-जन म (6) के अनुसार, श्री खगेंर रर ांग क अृना अयर ावेिन, जिसमें लेखों क प्रस्ट् तुत न दकए िाने संबंिी कारणों क स्ट् ृ्‍ ट दक ा ग ा ि , आ ग क प्रस्ट् तुत करने और जनवाचर्न व् संबंिी अृने लेखों क िाजखल करने/अृने लेखों में कजम ों क संि जित करने और इन्ि ेंइस न रटस के प्राप्त ि ने के 20 दिनों के अंिर जिला जनवाचर्न अजिकारी क प्रस्ट् तुत करने के जलए जलजखत में जनििे दि ा ग ा था और त:, उक् त न रटस श्री खगेंर रर ांग ने दिनांक 13.01.2019 क प्राप्त दक ा था। अयर थक स े प्राप्त ृावती रसीि जिला जनवाचर्न अजिकारी, थलाई द्वारा अृने दिनांक 25.02.2020 के ृत्र सं्‍ ाएफ.18(22)/डीएम(डी)/इले./ईईएम(आई.एस.)/2019/3656- 58 के तित आ ग क प्रस्ट् तुत की गई ि ै और म्‍ु जनवार्च न अजिकारी, जत्रृरु ा द्वारा अृन े दिनाकं 27.02.2020 के ृत्र स्‍ं ा एफ.19(60)-सीई /ईईएम/2018/1568 के तित अग्रेजषत की गई ि ै और त:, जिला जनवाचर्न अजिकारी, थलाई जिला द्वारा अृने दिनांक 25.02.2020 के ृत्र सं्‍ ा एफ.18(22)/ डीएम(डी)/इले./ईईएम(आई.एस.)/2019/3656-58 के तित अनुृूरक ररृ टच में ि बता ा ग ा ि ै दक र्ूककताच अयर थक द्वारा न रटस प्राप्त करने के बाविूि, इस का ाचल क आि की तारीख तक श्री खगेंर रर ांग से क ई भी अनुृूरक ररृ टच निीं प्राप्त ुएई ि।ै इसके अजतररक् त, उन् िोंने भारत जनवाचर्न आ ग का सय क न रटस जमलने के उृरांत भी अृनी उक् त जवफलता के संबंि में न त क ई कारण बता ा ि ैऔर न िी क ई स्ट्ृ ्‍ टीकरण दि ा ि ै62 THE GAZETTE OF INDIA : MARCH 21, 2020/CHAITRA 1, 1942 [PART II—SEC. 3(iii)] और त:, आ ग का ि समािान ि ग ा ि ैदक श्री खगेंर रर ांग अृने जनवाचर्न व् ों का लेखा िाजखल करने में जवफल रि ेिं और उनके ृास इस जवफलता के जलए क ई भी उजर्त कारण अथवा औजर्त् निीं ि।ै और त:, ल क प्रजतजनजित् व अजिजन म, 1951 की िारा 10क में ि जवजित ि ैदक: ‘‘ दि जनवाचर्न आ ग का समािान ि िाता ि ैदक क ई व् जक्त- (क) इस अजिजन म के द्वारा अथवा इसके अिीन अृेजक्षेत सम के भीतर और रीजत में जनवाचर्न व् लेखा िाजखल करने में जवफल रिा ि ै और (ख) उसके ृास इस जवफलता का क ई उजर्त कारण अथवा औजर्त् निीं ि ै त , जनवाचर्न आ ग सरकारी रािृत्र में आििे प्रकाजित करके उसे जनरि चघ जषत करेगा और ऐसा क ई भी व् जक्त इस आिेि की तारीख से तीन वषच की अवजि के जलए जनरि चरिगे ा अत:, अब ल क प्रजतजनजित् व अजिजन म, 1951 की िारा 10क के अनुसरण में भारत जनवाचर्न आ ग एतद्द्वारा घ षणा करता ि ैदक जत्रृुरा राज् के 44-राईमावैली (अ.ि.िा.) जविान सभा जनवार्च न क्षेेत्र से जविान सभा के सािारण जनवाचर्न, 2018 के जलए जत्रृुरा ृीृुल्स ृाटक के जनवाचर्न ल़ने वाले अयर थक श्री खगेंर रर ांग, जनवासी- ग्राम उररिम ृारा, ृी -बूलंगबासा, ृीएस गंिाोारा, जिला- थलाई, जत्रृुरा इस आििे की तारीख से तीन वषच की अवजि के जलए संसि के दकसी भी सिन अथवा राज् अथवा संघ राज् क्षेेत्र की जविान सभा अथवा जविान ृररषि का सिस्ट् र्ुने िाने अथवा ि ने के जलए जनरिच िोंगे। [सं. 76/टीृी-एलए/44/2018] आििे से, अरववंि आनंि, सजर्व SECRETARIAT OF ELECTION COMMISSION OF INDIA ORDER New Delhi, the 16th March, 2020 O.N. 20.—WHEREAS, the General Election to the Legislative Assembly of Tripura, 2018 was announced by Election Commission of India vide Press Note No. ECI/PN/3/2018 dated 18.01.2018. As per the schedule Date of Counting was 15.03.2018; AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his/her account of election expenses within 30 days with the District Election Officer, from the date of election of the returned candidate; AND WHEREAS, the result of the said election was declared by the concerned Returning Officers including 44-Raima Valley (ST) Assembly Constituency on 03.03.2018. As such the last date for lodging of account of election expenses was 02.04.2018; AND WHEREAS, as per the report dated 31.03.2018 submitted by the District Election Officer, Dhalai District, Tripura, Shri Khagendra Reang, a contesting candidate of Tripura People’s Party from 44-Raima Valley (ST) Assembly Constituency of Tripura, failed to lodge any account of his election expenses as required by law; AND WHEREAS, on the basis of the reports of the District Election Officer, Dhalai District, Tripura, a Show- Cause Notice dated 08.01.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Khagendra Reang for non submission of Election expenses; AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules,1961, through the above said Show Cause Notice dated 16.09.2019, Shri Khagendra Reang was directed to submit his representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same with the District Electoral Officer concerned within 20 days from the date of receipt of the notice; AND WHEREAS, the said notice was received by Shri Khagendra Reang on 31.01.2019. Acknowledgement receipt so obtained from the candidate have been submitted to the Commission by the District Election Officer, Dhalai, vide his letter No. F.18(22)/DM(D)/ELEC/EEM(I.S)/2019/3656-58 dated 25.02.2020 and forwarded by the Chief Electoral Officer, Tripura vide his letter No. F.19(60)-CEO/EEM/2018/1568 dated 27.02.2020;[भाग II—खण् ड 3(iii)] भारत का रािृत्र : मार्च 21, 2020/र्ैत्र 1, 1942 63 AND WHEREAS, in the supplementary report the District Election Officer, Dhalai District vide his letter No. F.18(22)/DM(D)/ELEC/EEM(I.S.)/2019/3656-58 dated 25.02.2020 has stated that despite of Notice being acknowledged by the defaulting candidate, no supplementary report has been received by his office till date from Shri Khagendra Reang. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well; AND WHEREAS, the Commission is satisfied that Shri Khagendra Reang has failed to lodge an account of election expenses and has no good reason or justification for the failure; AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:- “If the Election Commission is satisfied that a person- (a) Has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and (b) Has no good reason or justification for the failure the Election Commission shall, by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order; NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Khagendra Reang, resident of Vill-Uriham Para, PO-Bulongbassa, PS- Gandacherra, District-Dhalai, Tripura and the contesting candidate of Tripura People’s Party for the General Election to the Legislative Assembly, 2018, from 44-Raima Valley (ST) Assembly Constituency of the State of Tripura, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.
