2. संजक्षप्त नाम और प्रारंभ-(1) इन जिजननमक को नई दिल्ली नगरपाजलका पररषि (एलोपथै ी) भती (संिोिन)
जिजननम, 2022 किा िाएगा।

2. नई दिल्ली नगरपाजलका पररषि (एलोपथै ी) भती जिजननम, 2007 में, जिजननम 5 म,ें उप-जिजननम (2) के
बाि, जनम्नजलजखत उप-जिजननम अंतःस्ट्थाजपत दकना िाएगा, अथाशत्: -
"(3) 31 िनिरी, 2017 को ना उससे पिले अनुबंि के आिार पर ना तिथश आिार पर जननुि दकए गए सभी
अजिकाररनक को आनोग द्वारा उनक उपनुिता के मल्ू नांकन के आिार पर और पि के जलए जिजित अपेजक्षत िैजक्षक
नोग्नता और अनुभि रखने और उपनुि पाए िाने पर, संबंजित ग्रेडक म ें इन जिजननमक के अिीन जननिु दकना गना माना
िाएगा, और िे नई दिल्ली नगरपाजलका पररषि (एलोपथै ी) भती (संिोिन) जिजननम, 2022 के प्रारंभ क तारीख स े सेिा
म ें माने िाएंगे।

Delhi, the 20th May, 2022
F. No. A-42015/4/2017-H (Estt.)-II/D-213.—In exercise of the powers conferred by clause (c) of sub-
section (1) of section 43 of the New Delhi Municipal Council Act, 1994 (44 of 1994) and after consultation with the
Union Public Service Commission, as required under sub-section (2) of the said section 43, and with the approval of
the Central Government in terms of sub-section (2) of section 387 of the said Act, the New Delhi Municipal Council
hereby makes the following regulations to amend the New Delhi Municipal Council (Allopathy) Recruitment
Regulations, 2007, namely :-
1. Short title and commencement.– (1) These regulations may be called the New Delhi Municipal Council
(Allopathy) Recruitment (Amendment) Regulations, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the New Delhi Municipal Council (Allopathy) Recruitment Regulations, 2007, in regulation 5, after sub-
regulation (2), the following sub-regulation shall be inserted, namely:-
“(3) All the officers appointed on contract basis or ad-hoc basis on or before the 31st January, 2017, on the basis
of their suitability to be assessed by the Commission and possessing requisite educational qualifications and
experience prescribed for the post and being found fit, shall be deemed to have been appointed under these
regulations in the respective grades, and they shall be members of the Service from the date of commencement
of the New Delhi Municipal Council (Allopathy) Recruitment (Amendment) Regulations, 2022.”

1. In the said notification, after the opening paragraph and before the ‘Annexure-I’, the following shall be
inserted, namely:-
“Initial Constitution.- All the officers appointed on contract basis or ad-hoc basis to the posts of Ayurvedic
Physician, Senior Ayurvedic Physician or Chief Ayurvedic Physician, as the case maybe, on or before the
31st January, 2017, on the basis of their suitability to be assessed by the Commission and possessing requisite
educational qualifications and experience prescribed for the post and being found fit, shall be deemed to have
been appointed under these regulations in the respective grades, and they shall be members of the Service
from the date of commencement of the amendment notifications number F. A-42015/4/2017-H (Estt.)-II/D-
214 dated the 20th May,2022”.
(2) This notification shall come into force on the date of their publication in the Official Gazette.

1. संजक्षप्त नाम और प्रारंभ- (1) इन जिजननमक को नई दिल्ली नगरपाजलका पररषि, िंत जचदकत्सा संिगश, श्रेणी 'क' पि,
भती जिजननम, 2022 किा िाएगा।
(2) ने रािपत्र में उनके प्रकािन क तारीख को प्रिृत् त िकगे।
2. पररभाषाएं.- इन जिजननमक म,ें िब तक दक संिभश स ेअन्नथा अपेजक्षत न िो।
(क) “आनोग” से संघ लोक सेिा आनोग अजभप्रेत ि;ै
(ख) "पररषि" से नई दिल्ली नगरपाजलका पररषि अजभप्रेत (एनडीएमसी) िै;
(ग) “जननंत्रक प्राजिकारी” से पररषि के अध्नक्ष अजभप्रेत ि;ै
(घ) "जिभागीन पिोन्नजत सजमजत" से पिोन्नजत के मामलक पर जिचार करने के जलए अनुसूची-III में जिजनर्िष्टश
सजमजत अजभप्रेत ि;ै
(ङ) "ड्यूटी पोस्ट्ट" से कोई भी पि, चाि े िि स्ट्थानी िो ना अस्ट्थानी, िैसा दक अनुसूची-I में जनर्िष्टश दकना गना
ि,ै अजभप्रते ि;ै
(च) "डाननाजमक एश्नोडश कैररनर प्रोग्रेसन (डीएसीपी) स्ट्क म" से जचदकत्सा और िंत जचदकत्सकक के जलए
स्ट्िास्ट््न एिं पररिार कल्नाण मंत्रालन, भारत सरकार के द्वारा आिेि संख्ना ए-45024/2/2008-
सीएचएस.िी, दिनांक 29 अिूबर, 2008 के तित पररकजल्पत डीएसीपी स्ट्क म अजभप्रेत ि।ै
(छ) "ग्रडे " से अनुसूची-I में जनर्िष्टश ग्रडे म ेंसे कोई भी ग्रेड अजभप्रते ि;ै
(ि) "उप-संिगश" स े कोई भी उप-संिगश अजभप्रेत ि,ै अथाशत,् जििेषज्ञ ग्रेड (िंत) और जचदकत्सा अजिकारी (ितं ),
िैसा भी मामला िो;
(झ) 'अनुसूजचत िाजतना'ं, 'अनुसूजचत िनिाजतनां', 'अन्न जपछडा िग'श, 'आर्थशक रूप स े कमिोर िग'श और
'दिव नांगिन' पिक का ििी अथ श िोगा िो उनके जलए संजििान और संसि के लाग ू अजिजननमक में दिना गना
ि;ै
(ञ) "अनुसूची" से इन जिजननमक क अनुसूची अजभप्रेत ि;ै
(ट) "जिभागीन पुजष्टकरण सजमजत" से पुजष्ट के मामलक पर जिचार करने के जलए अनुसूची-III में जनर्िष्टश सजमजत
अजभप्रेत ि।ै
3. संिग श का गठन- (1) इन जिजननमक के लागू िोने क तारीख से, नई दिल्ली नगरपाजलका पररषि में एक िंत जचदकत्सा
संिगश का गठन दकना िाएगा, जिसमें इन जिजननमक क अनुसूची-I में जिजनर्िष्टश पिक क श्रेजणनां िाजमल िकगी।[PART III DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: MAY 26, 2022/JAISTHA 5, 1944 17
(2) उि संिग श म ें श्रणे ी, िेतन मैररक्स म ें स्ट्तर और पिक क संख्ना अनुसूची-I में नथा-जिजनर्िष्श ट के अनुसार
िकगी।
(3) उि संिगश म ेंिाजमल सभी ड्यूटी पोस्ट्टक को श्रेणी ‘क’ के पिक के रूप म ेंिगीकृत दकना िाएगा।
4. प्राजिकृत संख् ना- (1) इन जिजननमक के लागू िोन े क तारीख से संिगश के जिजभन्न ग्रडे क में िाजमल ड्यूटी पि क प्राजिकृत
संख्ना अनुसूची-I म ें जिजनर्िष्टश के अनुसार िोगी।
(2) जिजभन्न ग्रेडक में ड्यूटी पिक क प्राजिकृत स्ट्थानी संख्ना िि िोगी िो समन-समन पर पररषि द्वारा अििाररत
क िाएगी।
(3) पररषि समन-समन पर जिजभन्न ग्रेडक में ड्यूटी पोस्ट्टक क संख्ना में आिश्नकता पडने पर अस्ट्थानी पररििनश
ना कटौती कर सकती ि।ै
(4) पररषि, आनोग के परामिश से, इन जिजननमक में िाजमल पिक से जभन् न दकसी भी अन्न पिक को िाजमल कर
सकती ि ैना इन जिजननमक में िाजमल दकसी पि को िटा सकती ि।ै
(5) पररषि, आनोग के परामि श स,े ऐसे अजिकारी को उपनिु ग्रेड म ें अस्ट्थानी िजै सनत म ें ना िास्ट्तजिक िजै सनत
म,ें िैसा दक उजचत समझा िाए, जननुि कर सकती ि ै जिसका पि इन जिजननमक के उप-जिजननम (4) के अिीन िाजमल ि,ै
और अनरूु प ग्रडे म ेंजनरंतर जननजमत सेिा को ध्नान म ेंरखते हुए ग्रडे म ेंउसक िररष्ठता जनिाशररत कर सकती ि।ै
5. प्रारंजभक सजं ििान- (1) इन जिजननमक के लाग ू िोने ना उससे पिले पररषि म ें जननजमत आिार पर िंत जचदकत्सा संिगश
के श्रेणी 'क' पिक को िारण करने िाल े सभी मौिूिा अजिकाररनक को इन जिजननमक के अिीन संबंजित ग्रडे क म ें जननुि दकना
गना समझा िाएगा, परंतु नि दक उनके पास अपेजक्षत अितश ाएं िक।
(2) इन जिजननमक के लागू िोन े से पिले उप-जिजननम (1) में जनर्िष्टश अजिकाररनक क जननजमत जनरंतर सेिा को
पररिीक्षा अिजि, पिोन्नजत और पुजष्टकरण के जलए अितश ा प्राप्त सेिा, पेंिन ना राष्ट्रीन पेंिन नोिना के प्रनोिन के जलए
जगना िाएगा।
(3) तारीख 31 िनिरी, 2017 को ना उससे पिल े अनुबंि ना तिथ श आिार पर जननुि दकए गए सभी अजिकारी,
िो आनोग द्वारा उनक उपनुिता का मूल्नांकन दकए िाने के आिार पर इन जिजननमक के प्रारंभ क तारीख को पररषि म ें
सेिा िारी रखते ि ैं और पि के जलए जनिाशररत आिश्नक िैजक्षक नोग्नता और अनुभि रखते ि ैं और उपनुक्त पाए िाते ि,ैं
नि समझा िाएगा दक उन् ि ें इन जिजननमक के अिीन संबंजित ग्रेड म ें जननुि दकना गना ि,ै और ि े इन जिजननमक के लाग ू
िोने क तारीख स ेसंिगश के सिस्ट्न िकगे।
6. संिग श का भािी अनरु क्षण- (1) अनुसूची-I में जनर्िष्टश दकसी भी ग्रेड में ररजिनक को इन जिजननमक के अिीन इसके उपरांत
नथा-उपबंजित रीजत स ेभरा िाएगा।
(2) संिगश में िाजमल पिक पर जननुजि ना पिोन्नजत के जलए ठीक नीचे के ग्रडे ना ग्रडे क, िैसा भी मामला िो, म ें
न्नूनतम अिकश सेिा सजित भती क प्रजिजि, पिोन्नजत के जलए चनन का क्षेत्र अनुसूची-II में नथा-जिजनर्िष्टश िोगा।
(3) संिगश में उच्च पिक पर जिभागीन पिोन्नजत अनुसूची-III में जनर्िष्टश जिभागीन प्रोन्नजत सजमजत क जसफाररिक पर
ठीक नीचे के ग्रेड ना ग्रेडक, िैसा भी मामला िो, म ेंसंिगश के अजिकाररनक में से क िाएगी।
(4) जििेषज्ञ ग्रडे -II (कजनष्ठ स्ट्केल) और जचदकत्सा अजिकारी (िंत) के ग्रेड म ें ररजिनक को आनोग के परामि श से अनुसूची-II

(5) संिगश में ड्यूटी पिक क जननुजि के जलए आनु-सीमा के साथ-साथ न्नूनतम जिक्षा एिं अन्न अितश ाएं अनुसूची-
IV में नथा जिजनर्िष्श ट िोगा।
(6) जििेषज्ञ ग्रेड-II (कजनष्ठ स्ट्केल), जििेषज्ञ ग्रेड-II (िररष्ठ स्ट्केल), जििेषज्ञ ग्रेड-I (गैर-कानाशत्मक चनन ग्रेड) और
जििेषज्ञ ग्रडे -I (िररष्ठ प्रिासजनक ग्रडे ) के पि पिोन्नजत के उद्देश्न से उप-संिगश के भीतर अंतर्िजश नमेन िकगे।
(7) जचदकत्सा अजिकारी, िररष्ठ जचदकत्सा अजिकारी, मुख्न जचदकत्सा अजिकारी, मुख्न जचदकत्सा अजिकारी (गैर-
कानाशत्मक चनन ग्रेड) और मुख्न जचदकत्सा अजिकारी (िररष्ठ प्रिासजनक ग्रेड) के पि पिोन्नजत के उद्देश्न से उप-संिगश के
भीतर अतं र्िशजनमेन िकगे।
(8) उप-जिजननम (4) में जिजनर्िष्टश 'प्रिेि ग्रेड के जभन् न' ग्रेडक म ें पिोन्नजत डाननेजमक एश् नोड श सुजनजश्चत कररनर
प्रोगेसन नोिना के अनुरूप ररजिनक से जबना दकसी अंतसंबंि के िोगी।
7. अल्पकाजलक सजं ििा सजित प्रजतजननजु ि द्वारा ड्यटू ी पिक को भरना- (1) जिजननम 6 में अंतर्िशष्ट दकसी बात के िोते
हुए भी, ििां एनडीएमसी का मत ि ै दक ऐसा करना आिश्नक ना समीचीन ि,ै िि जलजखत रूप म ें िि श दकए िान े िाल े
कारणक से और आनोग के परामिश से केंद्रीन सरकार ना राज्न सरकार ना संघ राज्न क्षेत्रक के अिीन सििृ पिक पर पिस्ट्थ
उपनुि अजिकाररनक क प्रजतजननुजि द्वारा और सांजिजिक जनकानक, स्ट्िानत्त जनकानक, सािशिजनक क्षेत्र के उपक्रमक,
जिश्वजिद्यालनक ना मान्नता प्राप्त अनुसंिान संस्ट्थानक के अिीन सििृ पिक पर पिस्ट्थ उपनिु अजिकारी के अल्पकाजलक
संजििा द्वारा िंत संिग श में जचदकत्सा अजिकारी और जििेषज्ञ ग्रेड- II (कजनष्ठ स्ट्केल) के ग्रडे में ड्यूटी पिक को, िो दक पांच
प्रजतित स ेअजिक न िो, भर सकता ि।ै
(2) प्रजतजननुजि आिार पर ड्यूटी पि पर जननुजि के जलए, अजिकारी को, अन्न बातक के साथ, अनुसूची-IV म ें
पिक के जलए जिजित न्ननू तम जिक्षा और अन्न नोग्नताओं को पूरा करना िोगा।
(3) नि प्रजतजननुजि तीन िषश से अजिक क अिजि के जलए निीं िोगी, जिसे जििेष पररजस्ट्थजतनक में और जलजखत
रूप म ेंििश दकए गए कारणक स,े एनडीएमसी द्वारा उजचत समझे िाने पर पांच िष श तक बढाना िा सकता ि।ै
8. पररिीक्षा- (1) सीिी भती द्वारा संिग श म ें जचदकत्सा अजिकारी (ितं ) और जििेषज्ञ ग्रेड-II (कजनष्ठ स्ट्केल) के स्ट्तर पर
जननुि व्यजि, िैसा भी मामला िो, िो िषश क अिजि के जलए पररिीक्षािीन रिगे ा:
परंतु नि दक एनडीएमसी इस संबंि में भारत सरकार द्वारा समन-समन पर िारी अनुििे क के अनुसार पररिीक्षा
अिजि को बढा सकता ि:ै
परंतु नि और दक, दकसी अजिकारी क पररिीक्षा अिजि के जिस्ट्तार के जलए कोई भी जनणशन प्रारंजभक पररिीक्षा
अिजि क समाजप्त के तुरंत बाि और आमतौर पर आठ सप्ताि के भीतर जलना िाएगा और सबं ंजित अजिकारी को जलजखत
रूप म ेंउि अिजि के भीतर ऐसा करने के कारणक के साथ सूजचत दकना िाएगा।
(2) पररिीक्षा अिजि ना उसके दकसी जिस्ट्तार के परू ा िोन े पर, अजिकारी को, नदि स्ट्थानी जननुजि के जलए

सरकार द्वारा इस संबंि म ेंसमन-समन पर िारी सामान्न अनिु ेिक के अनुसार अििाररत क िाएगी।
(3) जिजननम 4 के उप-जिजननम (5) के अनुसार जननुि अजिकाररनक क ज्न ेष्ठता उि उप-जिजननम में नथा
उपबंजित रीजत में तन क िाएगी।
(4) उन मामलक म,ें िो उप-जिजननम (1) (2) और (3) के अिीन निीं आत े ि,ैं आनोग के परामिश से पररषि द्वारा
ज्न ष्ठे ता अििाररत क िाएगी।
(5) आरंजभक संजििान के अनसु ार जननुजि स े पिल े संजििा ना तिथ श आिार पर काम करने िाल े अजिकाररनक
द्वारा आिररत िते न िृजि के जलए िी गई सरु क्षा, नदि कोई िो, पर उि प्रारंजभक संजििान के अनुसार उनक जननुजि के
उपरांत टाइम स्ट्केल आिार पर पिोन्नजत पर जिचार करने िते ु सेिा क अिजि ना ज्न ेष्ठता के अििारण के जलए ध् नान म ें
निीं जलना िाएगा।
10. सिं ग शम ेंजननजु ि- िन्त संिगश में सभी जननुजिनां जननंत्रक प्राजिकारी द्वारा क िाएगं ी।
11. सेिा का िाजनत्ि- इन जिजननमक के अिीन दकसी भी पि पर जननिु कोई भी व्यजि पररषि ् क्षेत्रक क अजिकाररता म ें
किीं भी सेिा करने के जलए उत्तरिानी िोगा।
12. जनिी व्यिसान का प्रजतषिे - (1) इन जिजननमक के अिीन दकसी पि पर जननिु दकसी व्यजि को परामि श और
प्रनोगिाला कानश सजित जनिी व्यिसान क अनुमजत निीं िी िाएगी:
परंतु नि दक ऐसे व्यजि भारत सरकार द्वारा समन-समन पर जिजनर्िष्टश िरक पर गरै -व निसान भत्ते के िकिार

F. No. A-42015/4/2017-H (Estt.)-II/D-216.—In exercise of the powers conferred by clause (c) of sub-
section (1) of section 43 of the New Delhi Municipal Council Act, 1994 (44 of 1994) and after consultation with the
Union Public Service Commission as required under sub-section (2) of the said section 43 and with the approval of
the Central Government in terms of sub-section (2) of section 387 of the said Act, the New Delhi Municipal Council
hereby makes the following regulations regulating the method of recruitment to category ‘A’ posts of Dental Cadre in
the New Delhi Municipal Council, namely :-
1. Short title and commencement.– (1) These regulations may be called the New Delhi Municipal Council, Dental
Cadre, Category ‘A’ Posts, Recruitment Regulations, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions.- In these regulations, unless the context otherwise requires.-
(a) “Commission” means the Union Public Service Commission;
(b) “Council” means the New Delhi Municipal Council (NDMC);
(c) “Controlling Authority” means the Chairperson of the Council;
(d) “Departmental Promotion Committee” means a Committee as specified in Schedule-III for considering
cases of promotion;
(e) “Duty Post” means any post, whether permanent or temporary, as specified in Schedule-I;
(f) “Dynamic Assured Career Progression (DACP) Scheme” means the DACP scheme for medical and
Dental doctors as conceptualized, vide Ministry of Health and Family Welfare, Government of India,
Order No. A.45024/2/2008-CHS.V, dated the 29th October, 2008.
(g) “grade” means any of the grades as specified in Schedule-I;
(h) “Sub-cadre” means any of the sub-cadres, namely, Specialist Grade (Dental) and Medical Officer
(Dental), as the case may be;
(i) the expressions ‘Schedule Castes’, ‘Schedule Tribes’, ‘Other Backward Classes’, ‘Economically
Weaker Section’ and ‘Persons with Disabilities’ shall have the same meaning as assigned to them in
the Constitution and applicable Acts of Parliament;
(j) “Schedule” means a Schedule to these regulations;
(k) “Departmental Confirmation Committee” means a Committee as specified in Schedule-III for
considering cases of confirmation.
3. Constitution of the Cadre.- (1) With effect from the date of commencement of these regulations, a Dental Cadre
in the New Delhi Municipal Council shall stands constituted, consisting of the categories of posts as specified in
Schedule-I to these regulations.
(2) The category, level in the pay matrix and the number of posts in the said cadre shall be as specified in the
Schedule-I.
(3) All Duty Posts included in the said cadre shall be classified as Category ‘A’ posts.
4. Authorized Strength.– (1) The authorized strength of the Duty Post included in various grades of the cadre on the
date of commencement of these regulations shall be as specified in Schedule-I.
(2) The authorized permanent strength of the Duty Posts in various grades shall be such as may, from time to

(3) The Council may make temporary additions to, or reductions in, the strength of the Duty Posts in the
various grades as deemed, necessary from time to time.
(4) The Council may, in consultation with the Commission, include any posts other than those included in
these regulations or exclude a post included in these regulations.
(5) The Council may, in consultation with the Commission, appoint an officer whose post is included under
sub-regulation (4) of these regulations, to the appropriate grade in a temporary capacity or in a substantive capacity as
may be deemed fit, and fix his seniority in the grade after taking into account continuous regular service in the
analogous grade.
5. Initial Constitution.- (1) All the existing officers holding category ‘A’ posts of Dental Cadre in the Council on
regular basis on or before the commencement of these regulations shall be deemed to have been appointed under these
regulations in respective grades provided that they possess the requisite qualifications.
(2) The regular continuous service of officers referred to in sub- regulation (1) before the commencement of
these regulations shall be counted for the purpose of probation, qualifying service for promotion, confirmation and
pension or National Pension Scheme.
(3) All the Officers appointed on contract basis or ad-hoc basis on or before the 31st January, 2017, who
continue to render service in the Council on the date of commencement of these regulations, on the basis of their
suitability to be assessed by the Commission and possessing requisite educational qualifications and experience
prescribed for the post and being found fit, shall be deemed to have been appointed under these regulations in the
respective grades, and they shall be members of the cadre from the date of commencement of these regulations.
6. Future Maintenance of the Cadre.- (1) The vacancies in any of the grades referred to in Schedule-I shall be filled
in the manner as hereinafter provided under these regulations.
(2) The method of recruitment, the field of selection for promotion, including the minimum qualifying
service in the immediate lower grade or lower grades, as the case may be, for appointment or promotion to the posts
included in the cadre shall be as specified in Schedule-II.
(3) The departmental promotions to higher posts in the cadre shall be made from among the officers of the
cadre in the immediate lower grade or lower grades, as the case may be, on the recommendations of the Departmental
Promotion Committee referred to in Schedule-III.
(4) The vacancies in the grades of Specialist Grade-II (Junior Scale) and Medical Officer (Dental) shall be
filled by direct recruitment as provided in the Schedule-II, in consultation with the Commission.
(5) The minimum educational and other qualifications, along with the age-limit for appointment to Duty
Posts in the cadre by direct recruitment shall be as specified in Schedule-IV.
(6) The posts of Specialist Grade-II (Junior Scale), Specialist Grade-II (Senior Scale), Specialist Grade-I
(Non-Functional Selection Grade) and Specialist Grade-I (Senior Administrative Grade) shall be interchangeable
within the sub-cadre for the purpose of promotion.
(7) The post of Medical Officer, Senior Medical Officer, Chief Medical Officer, Chief Medical Officer
(Non-Functional Selection Grade) and Chief Medical Officer (Senior Administrative Grade) shall be interchangeable
within the sub-cadre for the purpose of promotion.
(8) Promotion to the grades ‘other than entry grade’ referred to in sub-regulation (4) shall be without linkage
to vacancies in accordance with Dynamic Assured Career Progression Scheme.
7. Filling of Duty Posts by Deputation including short term contract.- (1) Notwithstanding anything contained in
regulation 6, where the NDMC is of the opinion that it is necessary or expedient so to do, it may for reasons to be
recorded in writing and in consultation with the Commission fill up nor more than five percent of Duty Posts in the
grade of Medical Officer and Specialist Grade-II (Junior Scale) in Dental Cadre by deputation of suitable officers
holding analogous posts under the Central Government or State Government or Union Territories and by short-term
contract of suitable officer holding analogous posts under the Statutory bodies, Autonomous bodies, Public Sector
Undertakings, Universities or recognized Research Institutions.
(2) For appointment to Duty Post on deputation basis, the officer shall, among others, fulfill the minimum
education and other qualifications prescribed for the posts in Schedule-IV.
(3) The deputation shall be for a period not exceeding three years, which may, in special circumstances and
for reasons recorded in writing, be extended upto five years as the NDMC may thinks fit.
8. Probation.- (1) A person appointed to the cadre in the level of Medical Officer (Dental) and Specialist Grade-II
(Junior Scale), as the case maybe, by direct recruitment, shall be on probation for a period of two years:
Provided that the NDMC may extend the period of probation in accordance with the instructions issued by

Provided further, any decision for extension of the period of probation of an officer shall be taken
immediately after the expiry of initial period of probation and ordinarily within eight weeks and communicated in
writing to the concerned officer together with the reasons for so doing within the said period.
(2) On completion of the period of probation or any extension thereof, the officer shall, if considered fit for
permanent appointment, be confirmed in terms of the extant orders of the Government of India.
(3) Where, during the period of probation or any extension thereof as the case may be, NDMC is of the
opinion that an officer is not fit for permanent appointment, it may discharge such officer or revert him to the post
held by him prior to his appointment in the cadre, as the case may be.
(4) During the period of probation or any extension thereof, officer may be required by the NDMC to
undergo such courses of training or to pass such examinations or tests as may be deemed fit, as a condition of
satisfactory completion of the probation.
(5) As regard other matters relating to probation, the members of the cadre shall be governed by the orders or
instructions issued by the Government of India in this regard from time to time.
9. Seniority.- (1) The relative seniority of officers in the respective sub-cadre shall be determined in terms of the
initial constitution under sub-regulation(1) of regulation 5 on the commencement of these regulation:
Provided that if the seniority of any such officer had not been specifically determined on the said date, the
same shall be determined on the basis of the rules governing the fixation of seniority as where applicable prior to the
commencement of these regulations.
(2) The seniority of officers other than those appointed under sub-regulation (1) of regulation 5 shall be
determined in accordance with the general instructions issued by the Central Government in this regard from time to
time.
(3) The seniority of officers appointed in accordance with sub-regulation (5) of regulation 4 shall be fixed in
the manner as provided in the said sub-regulation.
(4) In the cases which are not covered under sub-regulations (1) (2) and (3), the seniority shall be
determined by the Council in consultation with the Commission.
(5) The protection, if any, accorded towards increments drawn by the officers who worked on Contract or
Ad-hoc basis, prior to placement in terms of the initial constitution, shall not be taken into account for determining the
length of service or seniority for consideration for promotion on time scale basis subsequent to their placement in
terms of the said initial constitution.
10. Appointment to the Cadre.- All appointments to the Dental Cadre shall be made by the Controlling Authority.
11. Liability for Service.- Any person appointed to any post under these regulations shall be liable to serve
anywhere in the jurisdiction of Council areas.
12. Prohibition of private practice.- (1) No person appointed to any post under these regulations shall be permitted
private practice including consultancy and laboratory practice:
Provided that such persons shall, however, be entitled to a non-practicing allowance at the rates specified by
Government of India from time to time.
13. Disqualification.- (1) No person,
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be
eligible for appointment to the Dental Cadre:
Provided that the Council may, if satisfied that such marriage is permissible under the personal law
applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any
person from the operation of this regulation.
14. Other conditions of Service.- The conditions of service of the members of the Dental Cadre in respect of matters
not expressly provided for in these regulations, shall, mutatis mutandis and subject to any special orders issued by the
Central Government in respect of the Cadre, be the same as those applicable to officers of the Council in general.
15. Power to relax.- Where Council is of the opinion that it is necessary or expedient to do so, it may, by order, for
reasons to be recorded in writing and in consultation with the Commission, relax any of the provisions of these
regulations with respect to any class or category of persons.
16. Saving.- Nothing in these regulations shall affect reservations, relaxation of age-limit and other concessions
required to be provided for the Scheduled Castes, Scheduled Tribes, Other Backward Classes, Economically Weaker28 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: MAY 26, 2022/JYAISTHA 5, 1944 PART III]
Section, Ex-servicemen and other special categories of persons, in accordance with the orders issued by the
Government of India from time to time in this regard.
17. Interpretation.- If any question relating to the interpretation of these regulations arises, it shall be decided by the
Central Government in consultation with the Commission.

2. The qualifications are relaxable at the discretion of the Commission in case of candidates otherwise well
qualified.
3. The qualification regarding experience are to be relaxable at the discretion of the Commission in case of candidates
belonging to Scheduled Caste or Scheduled Tribes, if any stage of selection, the Commission is of the opinion that
sufficient number of candidates from these communities possessing the requisite experience are not likely to be
available to fill up the vacancies reserved for them.
4. The qualifications referred to in section 10 of Dentists Act, 1948 (16 of 1948) as amended time to time shall be the
recognized dental qualifications.

NOTIFICATION
Delhi, the 20th May, 2022
F. No. A-42015/4/2017-H(Estt.)-II/D-215.—In exercise of the powers conferred by clause (c) of sub-section
(1) of section 43 of the New Delhi Municipal Council Act, 1994 (44 of 1994) and after consultation with the Union
Public Service Commission, as required under sub-section (2) of the said section 43, and with the approval of the
Central Government in terms of sub-section (2) of section 387 of the said Act, the New Delhi Municipal Council
hereby makes the following amendment in the notification No. F.4(22)/2001/UD/11528, dated the 6th August, 2002,
namely:-
1. In the said notification, after the opening paragraph and before the Schedule-I, the following shall be
inserted, namely:-
“Initial Constitution.- All the officers appointed on contract basis or ad-hoc basis to the posts of
Homoeopathic Physician, Senior Homoeopathic Physician or Chief Homoeopathic Physician, as the case
maybe, on or before the 31st January, 2017, on the basis of their suitability to be assessed by the Commission
and possessing requisite educational qualifications and experience prescribed for the post and being found
fit, shall be deemed to have been appointed under these regulations in the respective grades, and they shall be
members of the Service from the date of commencement of the amendment notifications number
F.A-42015/4/2017-H(Estt.)-II/D-215 dated the 20th May, 2022”.
(2) This notification shall come into force on the date of their publication in the Official Gazette.
