CEO/COE/102/(77)DLA-20/Scr.Rep/2020/37927 ददनाकं 26.05.2020 के िररए जिला जनर्ााचन अजिकारी, केन्द्रीय जिला, रा.रा.क्षेत्र, ददल् ली द्वारा प्रस्ट्तुत ररपोिा के अनुसार, राष् रीय राििानी क्षेत्र, ददल् ली के 02- बरु ाड़ी जर्िानसभा जनर्ाचा न क्षत्रे से जनर्ााचन[PART II - Sec. 1 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: AUGUST 26, 2021/BHADRA 4, 1943 85 लड़ने र्ाले (जिर् सेना) के अभ्यथी, श्री िमर्ा ीर जर्जि द्वारा यथापेजक्षत रीजत से अपने जनर्ााचन व्यय का कोई लेखा दाजखल करने में असफल रि ेिैं; और यतः, जिला जनर्ााचन अजिकारी, केन्द्रीय ददल् ली, रा.रा.क्षे. ददल् ली और मुख्य जनर्ााचन अजिकारी, ददल् ली की ररपोिों के आिार पर भारत जनर्ााचन आयोग द्वारा जनर्ााचनों का संचालन जनयम, 1961 के जनयम 89 के उप जनयम (5) के तित जनर्ााचन व्यय का लेखा दाजखल न करने पर, श्री िमर्ा ीर को कारण बताओ नोरिस ददनांक 28.09.2020 को िारी दकया गया था; और यतः, जनर्ााचनों का संचालन जनयम, 1961 के जनयम 89 के उप जनयम (6) के अनुसार, ददनांक 28.09.2020 के उपयुाि कारण बताओ नोरिस के माध्य म से, श्री िमर्ा ीर को जनदिे ददया गया था दक र्े इस नोरिस के प्राप्त िोने के 20 ददनों के भीतर लेखे प्रस्ट्तुत न कर पाने का कारण स्ट्पष्ट करते हुए आयोग को जलजखत में अपना अभ्यार्ेदन प्रस्ट्तुत करें और साथ िी, जनर्ााचन व्यय का अपना लेखा दाजखल करें/अपने लेखे में त्रुरियों को सिी करें और उसे संबंजित जिला जनर्ााचन अजिकारी को प्रस्ट्तुत करें; और यतः, उि नोरिस श्री िमर्ा ीर के घर के बािर ददनांक 04.10.2021 और 06.10.2021 को ‘चस्ट्प ा’ददए गए थ,े क् योंदक ददए गए पते पर न तो र्े स्ट् र्यं न िी उनका पररर्ार रिता जमला। दो पड़ोजसयों से चस्ट्प ा ररपोिा की प्राप्त पार्ती एसडीएम(ई), केन्द्रीय ददल्ली द्वारा ददनाकं 13.10.2020 के पत्र सं.DEO/C/75/E.Expenses/DLA-20/1150 द्वारा आयोग को प्रस्ट्त तु कर दी गई थी। और यत:, एसडीएम (ई), केन्द्रीय ददल्ली द्वारा ददनांक 04.08.2021 के अपने पत्र सं. AND WHEREAS, as per the report under rule 89(2) of the Conduct of Election Rules, 1961, submitted by the District Election Officer, Centra District, NCT of Delhi through the Chief Electoral Officer’s letter No. CEO/COE/102/(77)/DLA-20/Scr.Rep/2020/37927 dated 26-05-2020, ShriDharam Veer contesting candidate from 02- Burari Assembly Constituency of NCT of Delhi, has failed to lodge an account of his election expenses as required by law. AND WHEREAS, on the basis of the reports of the District Election Officer, Central District Delhi, NCT of Delhi and the Chief Electoral Officer, Delhi, a Show Cause notice dated 28-09-2020 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Dharam Veer for non submission of account of Election expenses; AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show Cause Notice dated 28-09-2020, ShriDharam Veer was directed to submit his representation in writing in the Commission explaining the reason for non submission of accounts and also to lodge hisaccounts of election expensesrectify the defects in his accounts and submit the same to the District Election Officer concerned within 20 days from the date of receipt of the notice; AND WHEREAS, the said notice was made to serve to ShriDharam Veer from 04-10-2020, to 06-10-2020 through ‘CHASPA’ as he himself or his family was not found residing at the given address. Dharam Veer has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers.
