िीर्ाक “प्रजतमा रानी गुप्ता र् अन्य बनाम ददल्ली उच्च न्यायालय एर् ं अन्य” तथा इस िता के भी अध्यिीन ि ैं
दक उपरोि जनणायों के दक्रयान्र्यन के पररणामस्ट्र्रूप यदद उनका र्ररष्ठता स्ट्तर अर्नत िोता ि ै तो र्े अपना
स्ट्थान अपने स े ऊपर आसीन अजिकारी(गण) िते ु छोड़ने के जलए बाध्य िोंगे एर् ं यदद कोई ररजि उपलब्ि निीं
िोती ि ैतो र् े प्रत्यार्र्तात िो िायेंगे|
2. सिायक जनबंिक संर्गा म ें श्री सुनील (क्र.स.ं 9) की र्ररष्ठता, श्री कौिल कुमार सचदेर्ा, जनिी सजचर्
(जनलंजबत) के जर्रुद्ध लंजबत िांच कायार्ािी के पररणाम तथा उनकी उपयिु ता के आकलन के अध्यिीन
िोगी।
3. सिायक जनबंिक के संर्गा म ें श्री नंदन ससंि (क्र.स.ं 10) की र्ररष्ठता, श्री कौिल कुमार सचदेर्ा, जनिी सजचर्
(जनलंजबत) के जर्रुद्ध लंजबत िांच कायार्ािी के पररणाम तथा उनकी उपयिु ता के आकलन के अध्यिीन ि ै
और साथ िी एस.एल.पी. (जसजर्ल) स ं 20313/2019 िीर्का "मनमीत ससंि एर्ं अन्य बनाम ददल्ली उच्च
न्यायालय, द्वारा मिाजनबंिक एर् ं अन्य” के पररणाम के भी अध्यिीन ि।ै
4. स्ट्थानापन्न सिायक जनबंिक के रूप म ें श्री कमलेि कुमार (क्र.स.ं 11) की जनयुजि और र्ररष्ठता श्री कौिल
कुमार सचदेर्ा (जनलंजबत) के जखलाफ लंजबत िांच कायार्ािी के पररणाम के अध्यिीन ि ै और उनके दोर्मुि
िोने र् पदोन्नजत के जलए उपयिु पाए िाने की जस्ट्थजत म,ें यदद सिायक जनबंिक का कोई पद उपलब्ि निीं
िोता ि,ै तो श्री कमलिे कुमार अपन े जपछले पद अथाात जनिी सजचर् के पद पर प्रत्यार्र्तात दकय े िाने िते ु
बाध्य िोंगे। सिायक जनबंिक के संर्गा म ें उनकी र्ररष्ठता एस.एल.पी. (जसजर्ल) स.ं 20313/2019 िीर्ाक
"मनमीत ससंि एर्ं अन्य बनाम ददल्ली उच्च न्यायालय, द्वारा मिाजनबंिक एर् ं अन्य” के पररणाम के भी

5. क्रम संख्या 12 र् 13 पर र्र्णता अजिकारीगण, अथाात् श्री रािेि कुमार मल्िोत्रा और सुश्री सफलता भािी
की स्ट्थानापन्न सिायक जनबंिक के रूप म ें जनयुजि इस ित ा के अध्यिीन ि ै दक श्री िोसगदं र कुमार बत्रा,
जनबंिक के इस न्यायालय म ें प्रत्यार्तान पर या माननीय भारतीय सर्ोच्च न्यायालय द्वारा जर्िेर् अनुमजत
याजचका (जसजर्ल) स.ं 20313/2019 िीर्ाक "मनमीत ससंि एर् ं अन्य बनाम ददल्ली उच्च न्यायालय, द्वारा
मिाजनबंिक एर् ं अन्य” म ें पाररत दकसी न्याजयक आदेि के अनुपालन के पररणामस्ट्र्रूप, यदद सिायक
जनबंिक की कोई ररजि उपलब्ि निीं िोती ि,ै तो र्े अपने जपछले पद पर प्रत्यार्र्तात दकय े िाने िते ु बाध्य
िोंगे। ऐसी दकसी जस्ट्थजत म,ें क्रम संख्या 13 पर र्र्णात अजिकारी (सुश्री सफलता भािी) को कजनष्ठतम िोने के
कारण सबस े पिले प्रत्यार्र्तात दकया िाएगा। यदद दसू री जस्ट्थजत भी उत्पन्न िोती ि,ै और यदद सिायक
जनबंिक की कोई ररजि उपलब्ि निीं ि,ै तो क्रम संख्या 12 पर र्र्णात अजिकारी (श्री रािेि कुमार
मल्िोत्रा) प्रत्यार्र्तात िोंग े |
6. इसके अजतररि, ये जनयुजियां सिायक जनबंिक के पद पर जनयुजि िते ु भती जनयमों म ें ददए गए अनुपात म ें
संिोिन/पररर्तना स ेसम्बंजित लंजबत अभ्यार्ेदनों के पररणाम के भी अध्यिीन ि ैं|

NOTES: 1. The above appointments are subject to outcome of (i) SLP (Civil) No. 20362/2016 titled“Ravinder
Pahuja & Ors. Vs. High Court of Delhi & Ors.”, (ii) SLP (Civil) No. 19374/2016 titled “K.K.Sharma
& Ors. Vs. High Court of Delhi & Ors.”, (iii) SLP (Civil) No. 27418/2016 titled “Dinesh Manchanda
& Ors. Vs. High Court of Delhi & Ors.”, and (iv) SLP (Civil) No. 22722/2016 titled “Pratima Rani
Gupta & Others Vs High Court of Delhi and Ors.” and also subject to the condition that in case as a
result of implementation of above decisions their seniority position is depressed, they will be liable to
yield their position to the officer(s) placed senior to them and in case no vacancy is available, they will
stand reverted.
2. The seniority of Mr. Sunil (S.No.9) in the cadre of Assistant Registrar shall be subject to outcome of
the inquiry proceedings pending against Mr. Kaushal Kumar Sachdeva, Private Secretary (under
suspension) and assessment of his suitability.
3. The seniority of Mr. Nandan Singh (S.No.10) in the cadre of Assistant Registrar is subject to outcome
of the inquiry proceedings pending against Mr. Kaushal Kumar Sachdeva, Private Secretary (under
suspension) & assessment of his suitability and also subject to outcome of the SLP (Civil)
No. 20313/2019 titled “Manmeet Singh & Anr. Vs. The Delhi High Court through Registrar General &
Ors ”.
4. The appointment & seniority of Mr. Kamlesh Kumar (S.No.11) as Officiating Assistant Registrar is
subject to outcome of the inquiry proceedings pending against Mr. Kaushal Kumar Sachdeva (under
suspension) and in case of his exoneration and he being found fit for promotion, if no vacancy of
Assistant Registrar is available, Mr. Kamlesh Kumar shall be liable to be reverted to his previous post
i.e. Private Secretary. His seniority in the cadre of Assistant Registrar is also subject to outcome of
SLP (Civil) No. 20313/2019 titled “Manmeet Singh & Anr. Vs. The Delhi High Court through
Registrar General & Ors.
5. The appointment of officers at S.No. 12 and 13, namely Mr. Rajesh Kumar Malhotra and Ms. Saphalta
Bhati as Officiating is subject to the condition that in either case of repatriation of Mr. Joginder
Kumar Batra, Registrar to this Court or in case as a result of compliance of any judicial order passed
by Hon’ble Supreme Court of India in the Special Leave Petition (Civil) No. 20313/2019 titled
“Manmeet Singh & Anr. Vs. The Delhi High Court through Registrar General & Ors, if no vacancy of
Assistant Registrar is available, they shall be liable to be reverted to their previous post. In either
eventuality, the officer at S.No. 13 (Ms. Saphalta Bhati) will be reverted first, being the juniormost. In
the event the second eventuality also materialises, and if no vacancy of Assistant Registrar is available,

6. Further, the appointments are also subject to outcome of the pending representations with regard to
amendment/change in the ratio in the recruitment rules for appointment to the post of Assistant
Registrar.
