लेखा रखेगा और लोक प्रजतजनजित्र् अजिजनयम, 1951 की िारा 78 के अनुसार, जनर्ााचन लडने र्ाले प्रत्येक अभ्यथी, जनर्ााजचत अभ्यथी
के जनर्ााचन की तारीख से तीस ददनों के भीतर अपने जनर्ााचन व्यय का लेखा जिला जनर्ााचन अजिकारी को दिा करेगा िो िारा 77 के

रा.रा.क्षेत्र, ददल् ली द्वारा प्रस्ट्तुत ररपोर्टा के अनुसार, रा रीय राििानी क्षेत्र, ददल् ली के 20- चादाँ नी चौक जर्िानसभा जनर्ाचा न क्षत्रे से
जनर्ााचन लडने र्ाले (असख्ं य समाि पार्टी) के अभ्यथी, श्री सतपाल जर्जि द्वारा यथापेजक्षत रीजत से अपने जनर्ााचन व्यय का कोई लेखा
दाजखल करने में असफल रि ेिैं;
और यतः, जिला जनर्ााचन अजिकारी, केन्द्रीय ददल् ली, रा.रा.क्षे. ददल् ली और मुख्य जनर्ााचन अजिकारी, ददल्ली की ररपोर्टों के
आिार पर भारत जनर्ााचन आयोग द्वारा जनर्ााचनों का संचालन जनयम, 1961 के जनयम 89 के उप जनयम (5) के तित जनर्ााचन व्यय का
लेखा दाजखल न करने पर, श्री सतपाल को कारण बताओ नोरर्टस ददनांक 24.09.2020 को िारी दकया गया था;
और यतः, जनर्ााचनों का संचालन जनयम, 1961 के जनयम 89 के उप जनयम (6) के अनुसार, ददनांक 24.09.2020 के उपयुाक्त
कारण बताओ नोरर्टस के माध्य म से, श्री सतपाल को जनदिे ददया गया था दक र्े इस नोरर्टस के प्राप्त िोने के 20 ददनों के भीतर लेखे प्रस्ट्तुत
न कर पाने का कारण स्ट्पष्ट करते हुए आयोग को जलजखत में अपना अभ्यार्ेदन प्रस्ट्तुत करें और साथ िी, जनर्ााचन व्यय का अपना लेखा
दाजखल करें/अपने लेखे में त्रुरर्टयों को सिी करें और उसे संबंजित जिला जनर्ााचन अजिकारी को प्रस्ट्तुत करें;
और यतः, अभ्यथी की बिन श्रीमजत सध्ं या द्वारा उक्त नोरर्टस ददनाकं 06.10.2020 को प्राप्त दकया गया था। अभ्यथी से प्राप्त
पार्ती एसडीएम(ई), केन्द्रीय ददल्ली द्वारा ददनाकं 13.10.2020 के पत्र स.ं DEO/C/75/E.Expenses/DLA-20/1150 द्वारा आयोग
को प्रस्ट्त तु कर दी गई थी।
और यत:, एसडीएम (ई), केन्द्रीय ददल्ली द्वारा ददनांक 04.08.2021 के अपने पत्र सं. DEO/C/75/E.Expenses/DLA-
20/2931 के द्वारा प्रस्ट्त तु अनपु ूरक ररपोर्टा म ें यि किा गया ि ै दक श्री सतपाल ने न तो कोई अभ् यार्ेदन ददया ि ै और न िी मूल र्ाउचस ा
सजित जर्जिर्त रूप से िस्ट् ताक्षररत जनर्ााचन यय के सिी लेखे प्रस्ट् तुत दकए िैं। इसके अजतररक् त, उन् िोंने भारत जनर्ााचन आयोग के सम् यक
नोरर्टस की प्राजप्त के बाद भी उक् त असफलता िते ु न तो कोई कारण बताया न िी स्ट्प र्टीकरण ददया ि;ै
और यत:, भारत जनर्ााचन आयोग का यि समािान िो गया ि ैदक श्री सतपाल जनर्ााचन व्यय का लेखा दाजखल करने में असफल
रि ेि ैंऔर असफलता के जलए उनके पास कोई समुजचत कारण या न्यायोजचत्य निीं ि;ै
और यत:, लोक प्रजतजनजित्र् अजिजनयम, 1951 की िारा 10क में यि अनुबंजित दकया गया ि ैदक:-
"यदद जनर्ााचन आयोग का यि समािान िो िाता ि ैदक कोई व्यजक्त-
(क) जनर्ााचन व्ययों का लेखा उस समय के भीतर और उस रीजत में िैसी इस अजिजनयम के द्वारा या कानून के अिीन अपेजक्षत
ि,ै दाजखल करने में असफल रिा िै; तथा
(ख) उसके पास उस असफलता के जलए कोई समुजचत कारण या न्यायोजचत्य निीं ि,ै तो जनर्ााचन आयोग िासकीय रािपत्र में
प्रकाजित आदिे द्वारा उसको जनरर्िता घोजषत करेगा और ऐसा कोई भी व्यजक्त उस आदिे की तारीख से तीन र्षा की
कालार्जि के जलए जनरर्िता रिगे ा;
अब इसीजलए, लोक प्रजतजनजित्र् अजिजनयम, 1951 की िारा 10क के अनुसरण में भारत जनर्ााचन आयोग एतद्द्वारा रा.रा.क्षेत्र
ददल् ली राज्य के 20- चादाँ नी चौक जर्िानसभा जनर्ााचन क्षेत्र स े जर्िानसभा के सािारण जनर्ााचन, 2020 में जनर्ााचन लडने र्ाले

ORDER
New Delhi, the 25th August, 2021
No.76/ECI/ORD/TERR/NS-II/DL-LA/20//2020.—WHEREAS, the Commission had declared to hold the
General Election to the Legislative Assembly of NCT of Delhi from 20-Chandni Chowk Assembly Constituency
vide its Notification dated 14.01.2020 and Shri Satpal (Asankhya Samaj Party) had contested the aforesaid
election;
AND WHEREAS, as per Section 77 (1) of the Representation of the People Act, 1951, every candidate at
election shall, either by himself or by his election agent, keep a separate and correct account of all expenditure in
connection with the election incurred or authorized by him or by his election agent between the date on which he has
been nominated and the date of declaration of the result thereof, both dates inclusive & as per Section 78 of the
Representation of the People Act, 1951, every contesting candidate at an election shall, within thirty days from the date
of election of the returned candidate lodge with the District Election Officer (DEO) account of his election expenses
which shall be in a true copy of the account kept by him or by his election agent under Section 77;
AND WHEREAS, as per the report under rule 89(2) of the Conduct of Election Rules, 1961, submitted by the
District Election Officer, Central District, NCT of Delhi through the Chief Electoral Officer’s letter No.
CEO/COE/102/(77)/DLA-20/Scr.Rep/2020/37927 dated 26-05-2020, Shri Satpal (Asankhya Samaj Party),
contesting candidate from 20-Chandani Chowk Assembly Constituency of NCT of Delhi, has failed to lodge an
account of his election expenses as required by law;
AND WHEREAS, on the basis of the reports of the District Election Officer, Central District, Delhi, NCT of
Delhi and the Chief Electoral Officer, Delhi, a Show Cause notice dated 24-09-2020 was issued by the Election
Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Satpal (Asankhya
Samaj Party) for non submission of account of Election expenses;
AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above
said Show Cause Notice dated 24-09-2020, Shri Satpal was directed to submit his representation in writing in the
Commission explaining the reason for non submission of accounts and also to lodge his accounts of election
expenses/rectify the defects in his accounts and submit the same to the District Election Officer concerned within 20
days from the date of receipt of the notice;
AND WHEREAS, the said notice was made to serve to Ms.Sandhya, sister of Shri Satpal on 06-10-2020
and acknowledgment receipt obtained from the Sister of candidate was submitted to the Commission by SDM(E),
Central vide his letter No. F. DEO/C/75/E. Expenses/DLA-20/1150 dated 13-10-2020.
AND WHEREAS, in the supplementary report submitted by SDM(E), Central Delhi vide his letter No.
DEO/C/75/E. Expenses/DLA-20/2931 dated 04-08-2021, it has been stated that Shri Satpal has not submitted any
representation or a statement of correct account of his election expenses, duly signed along with original vouchers.
Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice of
the Election Commission of India as well;
AND WHEREAS, the Commission is satisfied that Shri Satpal has failed to lodge an account of election
expenses and has no good reason or justification for the failure;
AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:-
“If the Election Commission is satisfied that a person-
(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or
under this Act; and
(b) Has no good reason or justification for the failure the Election Commission shall by order published in the
official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of
three years from date of the order;
NOW THEREFORE, in pursuance of Section 10 A of the Representation of the People Act, 1951, the
Election Commission of India hereby declares Shri Satpal, r/o House No. 35 Block I, Aruna Nagar Majnuka Tila
Delhi-110054 the contesting candidate for the General Election to the Legislative Assembly of NCT of Delhi, 2020
from 20-Chandni Chowk Assembly Constituency of of NCT of Delhi to be disqualified for being chosen as and for94 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: SEPTEMBER 2, 2021/BHADRA 11, 1943 PART II - Sec. 1]
being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union

जनर्ााचन लडने र्ाले (र्टीप ूसल्ु तान पार्टी) के अभ्यथी, श्री साददक मनु ीरोद्दीन िखे जर्जि द्वारा यथापेजक्षत रीजत से अपने जनर्ााचन व्यय का
कोई लेखा दाजखल करने में असफल रि ेिैं;
और यतः, जिला जनर्ााचन अजिकारी, केन्द्रीय ददल् ली, रा.रा.क्षे. ददल् ली और मुख्य जनर्ााचन अजिकारी, ददल्ली की ररपोर्टों के
आिार पर भारत जनर्ााचन आयोग द्वारा जनर्ााचनों का संचालन जनयम, 1961 के जनयम 89 के उप जनयम (5) के तित जनर्ााचन व्यय का
लेखा दाजखल न करने पर, श्री साददक मनु ीरोद्दीन िखे को कारण बताओ नोरर्टस ददनांक 24.09.2020 को िारी दकया गया था;
और यतः, जनर्ााचनों का संचालन जनयम, 1961 के जनयम 89 के उप जनयम (6) के अनुसार, ददनांक 24.09.2020 के उपयुाक्त
कारण बताओ नोरर्टस के माध्य म से, श्री साददक मनु ीरोद्दीन िखे को जनदिे ददया गया था दक र्े इस नोरर्टस के प्राप्त िोने के 20 ददनों के
भीतर लेखे प्रस्ट्तुत न कर पाने का कारण स्ट्पष्ट करते हुए आयोग को जलजखत में अपना अभ्यार्ेदन प्रस्ट्तुत करें और साथ िी, जनर्ााचन व्यय
का अपना लेखा दाजखल करें/अपने लेखे में त्रुरर्टयों को सिी करें और उसे संबंजित जिला जनर्ााचन अजिकारी को प्रस्ट्तुत करें;
और यतः, श्री साददक मनु ीरोद्दीन िखे द्वारा उक्त नोरर्टस ददनाकं 05.10.2020 को प्राप्त दकया गया था। अभ्यथी से प्राप्त
पार्ती एसडीएम(ई), केन्द्रीय ददल्ली द्वारा ददनाकं 13.10.2020 के पत्र स.ं DEO/C/75/E.Expenses/DLA-20/1150 द्वारा आयोग

और यत:, एसडीएम (ई), केन्द्रीय ददल्ली द्वारा ददनांक 04.08.2021 के अपने पत्र सं. DEO/C/75/E.Expenses/DLA-
20/2931 के द्वारा प्रस्ट्त तु अनपु रू क ररपोर्टा म ेंयि किा गया ि ैदक श्री साददक मनु ीरोद्दीन िखे ने न तो कोई अभ् यार्ेदन ददया ि ैऔर न िी
मूल र्ाउचसा सजित जर्जिर्त रूप से िस्ट् ताक्षररत जनर्ााचन यय के सिी लेखे प्रस्ट् तुत दकए ि।ैं इसके अजतररक् त, उन् िोंने भारत जनर्ााचन
आयोग के सम् यक नोरर्टस की प्राजप्त के बाद भी उक् त असफलता िते ु न तो कोई कारण बताया न िी स्ट्प र्टीकरण ददया ि;ै
और यत:, भारत जनर्ााचन आयोग का यि समािान िो गया ि ैदक श्री साददक मनु ीरोद्दीन िखे जनर्ाचा न व्यय का लेखा दाजखल
करने में असफल रि ेि ैंऔर असफलता के जलए उनके पास कोई समुजचत कारण या न्यायोजचत्य निीं िै;
और यत:, लोक प्रजतजनजित्र् अजिजनयम, 1951 की िारा 10क में यि अनुबंजित दकया गया ि ैदक:-
"यदद जनर्ााचन आयोग का यि समािान िो िाता ि ैदक कोई व्यजक्त-
(क) जनर्ााचन व्ययों का लेखा उस समय के भीतर और उस रीजत में िैसी इस अजिजनयम के द्वारा या कानून के अिीन अपेजक्षत
ि,ै दाजखल करने में असफल रिा िै; तथा
(ख) उसके पास उस असफलता के जलए कोई समुजचत कारण या न्यायोजचत्य निीं ि,ै तो जनर्ााचन आयोग िासकीय रािपत्र में
प्रकाजित आदिे द्वारा उसको जनरर्िता घोजषत करेगा और ऐसा कोई भी व्यजक्त उस आदिे की तारीख से तीन र्षा की
कालार्जि के जलए जनरर्िता रिगे ा;
अब इसीजलए, लोक प्रजतजनजित्र् अजिजनयम, 1951 की िारा 10क के अनुसरण में भारत जनर्ााचन आयोग एतद्द्वारा रा.रा.क्षेत्र

New Delhi, the 25th August, 2021
No.76/ECI/ORD/TERR/NS-II/DL-LA/20/2020.—WHEREAS, the Commission had declared to hold the
General Election to the Legislative Assembly of NCT of Delhi from 20-Chandni Chowk Assembly Constituency
vide its Notification dated 14.01.2020 and Shri Sadeque Muniruddin Shaikh (Tipu Sultan Party) had contested the
aforesaid election;
AND WHEREAS, as per Section 77 (1) of the Representation of the People Act, 1951, every candidate at
election shall, either by himself or by his election agent, keep a separate and correct account of all expenditure in
connection with the election incurred or authorized by him or by his election agent between the date on which he has
been nominated and the date of declaration of the result thereof, both dates inclusive & as per Section 78 of the
Representation of the People Act, 1951, every contesting candidate at an election shall, within thirty days from the date
of election of the returned candidate lodge with the District Election Officer (DEO) account of his election expenses
which shall be in a true copy of the account kept by him or by his election agent under Section 77.96 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: SEPTEMBER 2, 2021/BHADRA 11, 1943 PART II - Sec. 1]
AND WHEREAS, as per the report under rule 89(2) of the Conduct of Election Rules, 1961, submitted by the
District Election Officer, Central District, NCT of Delhi through the Chief Electoral Officer’s letter No.
CEO/COE/102/(77)/DLA-20/Scr.Rep/2020/37927 dated 26-05-2020, Shri Sadeque Muniruddin Shaikh (Tipu
Sultan Party) contesting candidate from 20-Chandani Chowk Assembly Constituency of NCT of Delhi, has failed
to lodge an account of his election expenses as required by law.
AND WHEREAS, on the basis of the reports of the District Election Officer, Central Delhi, NCT of Delhi and
the Chief Electoral Officer, Delhi, a Show Cause notice dated 24-09-2020 was issued by the Election Commission of
India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Satpal (Asankhya Samaj Party)
for non submission of account of Election expenses;
AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above
said Show Cause Notice dated 24-09-2020, Shri Sadeque Muniruddin Shaikh was directed to submit his
representation in writing in the Commission explaining the reason for non submission of accounts and also to lodge his
accounts of election expenses/rectify the defects in his accounts and submit the same to the District Election Officer
concerned within 20 days from the date of receipt of the notice;
AND WHEREAS, the said notice was made to serve to Shri Sadeque Muniruddin Shaikh on 05-10-2020
and acknowledgment receipt obtained from the candidate was submitted to the Commission by SDM(E), Central vide
his letter No. DEO(C)/75/E. Expenses/DLA-20/1150 dated 13-10-2020.
AND WHEREAS, in the supplementary report submitted by SDM(E), Central Delhi vide his letter No.
DEO/C/75/E. Expenses/DLA-20/2931 dated 04-08-2020, it has been stated that ShriSadequeMuniruddinShaikh has
not submitted any representation or a statement of correct account of his election expenses, duly signed along with
original vouchers. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of
the due notice of the Election Commission of India as well;
AND WHEREAS, the Commission is satisfied that Shri Sadeque Muniruddin Shaikh has failed to lodge an
account of election expenses and has no good reason or justification for the failure;
AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:-
“If the Election Commission is satisfied that a person-
(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or
under this Act; and
(b) Has no good reason or justification for the failure the Election Commission shall by order published in the
official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of
three years from date of the order;
NOW THEREFORE, in pursuance of Section 10 A of the Representation of the People Act, 1951, the
Election Commission of India hereby declares Shri Sadeque Muniruddin Shaikh r/o 18 Khasra No. 17/20/4 Shri
Enclave Pralahadpur, Bhanger Gaon, Delhi-110042 the contesting candidate for the General Election to the
Legislative Assembly of NCT of Delhi, 2020 from 20-Chandni Chowk Assembly Constituency of the NCT of Delhi
to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative
Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.
