िथा एमपीर्ीपीके अतधतनयम की धारा 11/13 के अांिगिि अपराध क्र.सां. 49/2003 की जाांि में व्यस्ि थे और िभी उन्ह ें एक िैनाि मुितिर से एक तवश्वसनीय सूिना प्राप्त हुई दक कुख्याि फरार वकीला गुजिर तनवासी र्ाांर्ा तिरक और उसके साथ िीन-िार अज्ञाि सशस्त्र ििमाश सैन्य विी पहने हुए तपछले िीन-िार दिनों से लगािार र्ाांर्ा तिरक गाांव से सटे 3/4 दकलोमीटर िरू घने जांगल में हनुमान और तसद्ध िािा के मांदिर के पास ििे े गए हैं, जो लगािार ग्रामीणों को प्रिात़िि करिे ह ैंऔर पास के जांगल में तस्थि िनन ठेकेिारों के तलए जिरन पैसा वसूलिे हैं। स्थलाकृतिक तस्थति की पुति करने िथा टोह लेने के तलए, एसएिओ श्री तववेक कुमार िौहान, मुितिर और सहयोगी सैतनक सीिाराम के साथ ििाए गए स्थान पर पहुांिे। जि वे टोह ले रह ेथे, िो अज्ञाि हतथयारिांि ििमाश िारह (12) िोर की िांिकू ों के साथ वहाां पहुिां े, तजनमें से एक ने सैन्य विी पहनी हुई थी और उन्होंने िांिकू की नोक पर एसएिओ और उनकी टीम को रोका और उनसे उनकी पहिान पूछी। एसएिओ ने ििाया दक वे िनन अतधकारी ह।ैं इसी िीि, एक हतथयारिांि ििमाश ने सांिेह होने पर एसएिओ श्री तववेक कुमार िौहान पर गोली िला िी, तजसमें वे िाल-िाल ििे और उन्होंने आत्मरक्षा में गोली िलाई। इसके िाि र्कैि ने एसएिओ के साथ हाथापाई शुरू कर िी और उन्ह ें जमीन पर तगराकर उन पर कािू पाने की कोतशश की िथा उनके िाएां कांधे और िाएां गाल िथा िोनों हाथों पर िाांिों से काट कर िोटें पहुिां ाईं, और र्कैि ने दफर से जमीन पर तगरे एसएिओ पर गोली िलाने की कोतशश की लेदकन श्री िौहान झपट्टा मारकर र्कैि के िांगुल से िाहर आ गए। इस िीि मुितिर आगे आया और उसने र्कैि के तसर पर िो-िीन िार ि़िा पत्थर मारा, तजससे र्कैि की मौि हो गई। िसू री ओर िसू रा र्कैि होमगार्ि सैतनक सीिाराम के साथ हाथापाई कर रहा था तजसमें र्कैि ने होमगार्ि सैतनक पर गोली िला िी और उससे सर्विस ररवॉल्वर छीनने की कोतशश की तजसमें होमगार्ि सैतनक ने िुि को ििाया और आत्मरक्षा म ेंगोली िलाई िथा हमले से तवितलि हुए तिना उसने ि़िे पत्थर को र्कैि के तसर पर िो-िीन िार मारा तजससे उसकी मौि हो गई। मृि र्कैिों के पास से िो 12 िोर की ससांगल िैरल िांिकू ें, 11 सजांिा कारिूस और 03 िाली कारिूस िरामि दकए गए। आगे की जााँि में िोनों की पहिान (1) तशव नारायण पुत्र गेंिालाल पाठक तनवासी उटीला (2) रामेश्वर पुत्र गेंिालाल पाठक तनवासी उटीला के रूप में हुई, जो गाांव से फरार थे और फरार वकीला गुजिर से तमल गए थे। िोनों र्कैिों ने वर्ि 1987 में उटीला गााँव में एक हत्या की थी, तजसमें उन्ह ें सत्र न्यायालय ग्वातलयर द्वारा आजीवन कारावास की सजा सुनाई गई थी और िाि में दिसांिर 2002 में उच्च न्यायालय द्वारा भी इसकी पुति की गई थी, लेदकन िोनों जमानि से वापस नहीं आए और फरार हो गए थे। छह महीने के भीिर उन्होंने एक िजु ेय स्थानीय तगरोह िना तलया था और पुतलस स्टेशन उटीला, िेहट, घाटीगाांव, पतनहार, तिगरा आदि क्षेत्रों में सदक्रय थे। जनवरी 2003 में पुतलस अधीक्षक ग्वातलयर द्वारा िोनों पर 5000/- रुपये का इनाम घोतर्ि दकया गया था। लगभग 20 तमनट की इस आमने-सामने की मुठभे़ि के पूरे िरण में श्री तववेक कुमार िौहान की भूतमका उच्च कोरट की रही, तजसम ें र्कैिों ने श्री िौहान के शरीर के तवतभन्न तहस्सों पर िाांिों से काटकर िथा िांिकू की नली व िट से िोटें पहुिां ाईं, लेदकन हमले से तवितलि हुए तिना िथा अपनी जान जोतिम में र्ालकर वे फरार र्कैिों से ल़ििे रह ेऔर यह उनकी व्यतिगि वीरिा व साहस िथा Seetaram was busy in the investigation of crime No. 49/2003 u/s 394 IPC 11/13 MPDPK Act at village Danda Khirk and they received a reliable tip from a deployed informer that the notorious absconder Waqila Gurjar resident of Danda Khirk alongwith three to four unknown armed Badmash dressed in military uniform were spotted since last three four days continuously near the temple of Hanuman and Siddh Baba in the thick forest, 3/4 KM adjacent to village Danda Khirak are regularly torturing villagers and collecting money forcefully for mining contractors situated in nearby forest. To verify and recce the topographical situation, SHO Shri Vivek Kumar Chauhan along with the informer and associate Sainik Sitaram reached the pointed spot. No sooner they were recceing the situation two unknown armed badmash with twelve bore Guns out of which one dressed in military uniform came across and at gun point stopped the SHO and his team and asked about their identity. SHO responded to be mining officers. Meanwhile one of the armed badmash having suspicion opened fire on SHO Shri Vivek Kumar Chauhan in which he narrowly escaped and fired in self-defence. The dacoit then scuffled and started wrestling with the SHO and tried to overpower him by pulling him down on earth and inflicted injuries by teeth bite on the left scapular region and left cheek and on both the hands, he again tried to fire on the SHO who was lying on the ground but Shri Chauhan sparingly came out of the clutches of the dacoit. Meanwhile the informer came forward and struck a stone boulder over the head of the dacoit two three times, resulting in the dacoit's death. On the other hand, the other dacoit was scuffling with the Home Guard Sainik Sitaram in which the dacoit opened fire on the Home Guard Sainik and tried to snatch the service revolver from him in which he rescued himself and fired in self-defence but undeterred with the attack, he struck with a stone boulder two three times over the head of the dacoit resulting in his death. Two 12 bore single barrel guns with 11 live cartridges and 03 empty cartridges were recovered from the deceased dacoits. On further verification, both were identified namely as Shiv Narayan S/o Gendalal Pathak Rio Utila and Rameshwar S/o Gendalal Pathak R/o Utila who were absconding from the village and joined hands with absconder Waqila Gurjar. Both dacoits committed a murder in village Utila in 1987 in which they were sentenced life imprisonment by Session Court, Gwalior and subsequently confirmed by High Court in Dec 2002 but both of them jumped bail and absconded. Within a span of six months, they formed a formidable local gang and were operating in areas of P.S. Utila. Behat. Ghatigaon, Panihar. Tigra etc. A reward of Rs. 5000/- each was declared by S.P. Gwalior in January 2003. In the entire phase of this face to face encounter of about 20 minutes, the role of Shri Vivek Kumar Chauhan was of a high order in which the dacoits inflicted injuries by teeth bites and through the barrel and butt of the gun on the different part of the body of Shri Vivek Kumar Chauhan, but undeterred with the attack and at a great personal risk to his life he kept on fighting with the absconders and it was due to his personal valour and courage and with a sense of high devotion to duty and an extra ordinary leadership that both the dreaded dacoits were killed in this encounter. In this operation, Shri Vivek Kumar Chauhan, Sub-Inspector of Madhya Pradesh Police displayed conspicuous gallantry, courage and devotion to duty of a higher order.
