का भौगोशलक क्षेत्र ओखला तक यमन ा बेशसन म ें आता िै, 12 मई, 1994 को ओखला तक यमन ा के सतिी बिाि के आिंटन िेत एक समझौता
ज्ञापन पर िस्ताक्षर दकए थ,े शजसम ेंक्लाज-7 म ेंलाभाथी राज्यों के बीच साल की औसत उपलब्धता के आधार पर यमन ा निी के उपयोग योग्य
जल के संसाधनों आिटं न का प्रािधान िै।
2. और जबदक अशिभाशजत उत्तर प्रिेि को यमन ा निी के 4.032 बीसीएम उपयोग योग्य जल संसाधन शजसका मूल्यांकन औसत िार्षुक
उपलब्धता के आधार पर दकया गया ि,ै आिंरटत दकया गया िै।
3. और जबदक उत्तर प्रिेि पन गुठन अशधशनयम, 2000 के अन सार 9 निंबर, 2000 स ेउत्तरांचल राज्य (बाि म ेंशजसका नाम बिलकर
उत्तराखंड कर दिया गया) बनाया गया िै।
4. और जबदक उत्तर प्रिेि पन गुठन अशधशनयम, 2000 की धारा 79(1) म ेंप्रािधान ि ैदक ऊपरी यमन ा निी और ओखला तक उसकी
सिायक नदियों से सबं ंशधत जल संसाधन पररयोजनाओं के संबधं म ेंितमु ान उत्तर प्रिेि राज्य के अशधकार और िाशयत्ि, शनयत दिन को, उत्तरिती
राज्यों के अशधकार और िाशयत्ि िोंगे, ऐसे अन पात म ेंजो शनयत दकया जाए और ऐसे समायोजनों के अधीन रिते हुए जो दकए जाएं; उक्त राज्यों
द्वारा केन्र सरकार से परामिु के पश्चात दकए गए समझौते द्वारा, या यदि शनयत दिन से िो िषु के भीतर ऐसा कोई समझौता निीं दकया जाता िै,
तब केन्र सरकार, आििे द्वारा, पररयोजना के उद्दश्े यों को ध्यान म ेंरखते हुए, एक िषु के भीतर शनधाुररत कर सकती िै।
5. और जबदक उत्तर प्रिेि प नगुठन अशधशनयम, 2000 की धारा 84(1) में यि प्रािधान ि ैदक यमन ा निी के ओखला तक के उपयोग
योग्य जल ससं ाधन, जो शनधाुररत तारीख से पिल े12 मई, 1994 के समझौता ज्ञापन के तित मौजूिा उत्तर प्रििे राज्य को आिंरटत दकए गए थ,े
उन्िें उत्तराशधकारी राज्यों के बीच आपसी सिमशत से िो िष ुके अंिर बांटा जाएगा, और अगर ऐसा निीं िोता ि,ै तब केंर सरकार अगले िषु की
अिशध के भीतर, आिेि द्वारा, बाि म ेंबन ेराज्यों के बीच ऐसे जल ससं ाधन का बंटिारा शनधाुररत करेगी।
6. और जबदक यम ना निी के उपयोग योग्य जल संसाधनों के प न: बंटिारे के शलए िोनों राज्यों के बीच कोई सिमशत निीं बनी िै और

7. और जबदक केंर सरकार द्वारा केंरीय जल आयोग के अध्यक्ष की अध्यक्षता म ेंबनाई गई सशमशत न ेयमन ा निी के ओखला तक उपयोग
योग्य जल संसाधनों को, जो अशिभाशजत उत्तर प्रिेि को आिंरटत दकया गया था, बाि के उत्तर प्रिेि राज्य और उत्तराखंड राज्यों के बीच आिंटन
के शलए चचाु की और सिमशत बनाई।
8. अतः अब उपय ुक्त सशमशत की शसफाररि के अन सार, यमन ा निी के ओखला तक 4.032 बीसीएम, उपयोग योग्य जल संसाधनों, जो
अशिभाशजत उत्तर प्रिेि को आिंरटत दकया गया था, उन्िें उत्तर प्रिेि और उत्तराखंड राज्यों को इस तरि आिंरटत दकया जाता िै:—
1. उत्तर प्रििे - 3.721 बीसीएम
2. उत्तराखंड - 0.311 बीसीएम
9. यि इसके अध्यधीन िै दक उपरोक्त आिंटन 1994 के समझौता ज्ञापन की समीक्षा के िौरान भशिष्य के दकसी िािों, यदि कोई िो,
के शलए िोनों राज्यों के अशधकारों को प्रभाशित निीं करेंगे।

Weekly, Part – I, Section – I dated 01-07 June, 2024, allowing Homi Bhabha National Institute (deemed to be University),
Mumbai, Maharashtra to start an off-campus centre at Varanasi is partially amended as given hereunder:—
The words “Homi Bhabha Cancer Centre” may be read as “Homi Bhabha Cancer Hospital”, wherever it appears in
the above said notification.

RESOLUTION
No. A-50013/236/2023-E-III—WHEREAS the States of Uttar Pradesh, Haryana, Rajasthan, Himachal Pradesh and
National Capital Territory of Delhi having their geographical areas in the Yamuna basin upto Okhla have signed a
Memorandum of Understanding on 12th May, 1994 regarding allocation of surface flow of Yamuna upto Okhla wherein
Clause-7 provides the allocation of utilisable water resources of river Yamuna assessed on mean year availability amongst the
beneficiary States.
2. And whereas undivided Uttar Pradesh has been allocated 4.032 BCM of utilisable water resources of river Yamuna
assessed on mean year availability.
3. And whereas the State of Uttaranchal (later changed its name to Uttarakhand) has since been created with effect
from 9th November, 2000 in accordance with the Uttar Pradesh Reorganisation Act, 2000.
4. And whereas Section 79(1) of the Uttar Pradesh Reorganisation Act, 2000 provides that the rights and liabilities of
the existing State of Uttar Pradesh in respect of water resource projects in relation to Upper Yamuna River and its tributaries
upto Okhla shall on the appointed day, be the rights and liabilities of the successor States in such proportion as may be fixed
and subject to such adjustments as may be made; by agreement entered into by the said States after consultation with the Central
Government, or, if no such agreement is entered into within two years of the appointed day, then, the Central Government may,
by order, determine within one year having regard to the purposes of the Project.
5. And whereas Section 84(1) of the Uttar Pradesh Reorganisation Act, 2000 provides that the utilisable water
resources of the Yamuna River upto Okhla, as allocated before the appointed day, to the existing State of Uttar Pradesh under
the Memorandum of Understanding dated 12th May, 1994 shall be further allocated between the successor States by mutual
agreement within a period of two years, failing which, the Central Government shall, by order, determine the allocation of such
water resource between the successor States within a further period of one year.
6. And whereas no consensus has been achieved among the two States for reallocation utilisable water resources of
the Yamuna River and Government of Uttarakhand has approached the Central Government for determination of the allocation.
7. And whereas a Committee formed by the Central Government under the Chairmanship of Chairman, Central Water
Commission held deliberation and achieved consensus for allocation of utilisable water resources of the Yamuna River upto
Okhla allocated to undivided Uttar Pradesh between successor States of Uttar Pradesh and Uttarakhand.
8. Now, therefore, as per the recommendation of the above said Committee the 4.032 BCM of utilisable water
resources of the Yamuna River upto Okhla, as allocated to undivided Uttar Pradesh, is allocated to successor States of Uttar
Pradesh and Uttarakhand as under:—
1. Uttar Pradesh - 3.721 BCM
2. Uttarakhand - 0.311 BCM
subject to the condition that the above allocations shall be without any prejudice to future claims of two States during
the review of MoU of 1994, if any.

Central Government for information.
