PURNENDU KISHORE BANERJEE Joint Secretary MINISTRY OF JAL SHAKTI (DEPARTMENT OF WATER RESOURCES, RIVER DEVELOPMENT AND GANGA REJUVENATION) RESOLUTION No. A-50013/236/2023-E-III—WHEREAS the States of Uttar Pradesh, Haryana, Rajasthan, Himachal Pradesh and National Capital Territory of Delhi having their geographical areas in the Yamuna basin upto Okhla have signed a Memorandum of Understanding on 12th May, 1994 regarding allocation of surface flow of Yamuna upto Okhla wherein Clause-7 provides the allocation of utilisable water resources of river Yamuna assessed on mean year availability amongst the beneficiary States. 2. And whereas undivided Uttar Pradesh has been allocated 4.032 BCM of utilisable water resources of river Yamuna assessed on mean year availability. 3. And whereas the State of Uttaranchal (later changed its name to Uttarakhand) has since been created with effect from 9th November, 2000 in accordance with the Uttar Pradesh Reorganisation Act, 2000. 4. And whereas Section 79(1) of the Uttar Pradesh Reorganisation Act, 2000 provides that the rights and liabilities of the existing State of Uttar Pradesh in respect of water resource projects in relation to Upper Yamuna River and its tributaries upto Okhla shall on the appointed day, be the rights and liabilities of the successor States in such proportion as may be fixed and subject to such adjustments as may be made; by agreement entered into by the said States after consultation with the Central Government, or, if no such agreement is entered into within two years of the appointed day, then, the Central Government may, by order, determine within one year having regard to the purposes of the Project. 5. And whereas Section 84(1) of the Uttar Pradesh Reorganisation Act, 2000 provides that the utilisable water resources of the Yamuna River upto Okhla, as allocated before the appointed day, to the existing State of Uttar Pradesh under the Memorandum of Understanding dated 12th May, 1994 shall be further allocated between the successor States by mutual agreement within a period of two years, failing which, the Central Government shall, by order, determine the allocation of such water resource between the successor States within a further period of one year. 6. And whereas no consensus has been achieved among the two States for reallocation utilisable water resources of the Yamuna River and Government of Uttarakhand has approached the Central Government for determination of the allocation. 7. And whereas a Committee formed by the Central Government under the Chairmanship of Chairman, Central Water Commission held deliberation and achieved consensus for allocation of utilisable water resources of the Yamuna River upto Okhla allocated to undivided Uttar Pradesh between successor States of Uttar Pradesh and Uttarakhand. 8. Now, therefore, as per the recommendation of the above said Committee the 4.032 BCM of utilisable water resources of the Yamuna River upto Okhla, as allocated to undivided Uttar Pradesh, is allocated to successor States of Uttar Pradesh and Uttarakhand as under:— 1.
