सा.का.जन. 693(अ).—केंद्रीय मोटर यान जनयमावली, 1989, जनम्न जलजखत प्राूपप जनयम, जिसे केंद्र सरकार,
मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 64 के खंड (त) द्वारा प्रित्त िजियों का प्रयोग करते हुए और
संिोधन करन े का प्रस्ट्ताव करती ह।ै इसको उक्त अजधजनयम की धारा 212 की उप-धारा (1) द्वारा यथापेजित उनके द्वारा
प्रभाजवत होने की संभावना वाले सभी व्यजियों की िानकारी के जलए प्रकाजित दकया िाता है और एति्द्वारा नोरटस दिया
िाता ह ै दक प्राूपप जनयमों को उस तारीख से तीस दिन की अवजध समाप्त होने के बाि जवचाराथग स्ट्वीकार कर जलया िाएगा
जिसको सरकारी रािपत्र में यथा-प्रकाजित इस अजधसूचना की प्रजतयां िनता के जलए उपलब्ध करायी िाती ह;ैं
इन प्राूपप जनयमों के प्रजत आपज तयों एवं सावावों, यदि कोई हो, को संयाि सजचव (एमवीएल, पररवहन और टोल),
सड़क पररवहन और रािमाग ग मंत्रालय, पररवहन भवन, संसि माग,ग नई दिल्ली-110001 या ईमेल: comments-

जवजनर्िष्टग अवजध समाप्त होने के पहल े उक्त प्राूपप जनयमों के संबंध म ें दकसी भी व्यजि से प्राप्त होन े वाली आपजत्तयों
या सावावों पर केंद्र सरकार द्वारा जवचार दकया िाएगा।
मसौिा जनयम
1. (1) इन जनयमों को केन्द्द्रीय मोटर यान (... ...संिोधन) जनयमावली, 2022 कहा िाएगा।
(2) य े रािपत्र म ेंइनके प्रकािन की तारीख से प्रवृ त होंगे।
2. केन्द्द्रीय मोटर यान जनयमावली, 1989 (यहां इसके पश्चात् उि जनयम के ूपप म ेंउजल्लजखत) के जनयम 52 म,ें
(1) "मोटर वाहन के स्ट् वामी" िब्िों के पश् चात् "या पंिीकृत वाहनों के अजधकृत डीलर" िब्ि प्रजतस्ट् थाजपत दकए िाएंगे।

(2) एक व्याख्यामक पैराग्राफ अतं :स्ट्थ ाजपत दकया िाएगा, "पंिीकृत वाहनों का कोई अजधकृत डीलर एक ऐसा डीलर
होगा िो पंिीकृत वाहनों की जबक्री या खरीि में िाजमल होन ेके जलए अजधकृत ह।ै "
3. उि जनयमावली म ें जनयम 53 के उप जनयम (1) के स्ट् थान पर जनम्नजलजखत उप जनयम को प्रजतस्ट् थाजपत दकया िाएगा,
अथागत:्-
"(1) यदि दकसी समय, पिं ीकरण प्रमाण पत्र खो िाता या नष्ट हो िाता ह,ै तो मोटर वाहन का स्ट् वामी या पंिीकृत
वाहनों का अजधकृत डीलर उस राज्य, िहां वाहन वतगमान म ें पंिीकृत ह,ै के दकसी भी पंिीकरण प्राजधकारी को
जलजखत ूपप म ेंइस तथ्य की सचू ना िेगा।"
4. उि जनयमावली के जनयम 55 के उप-जनयम (1) म ें "हस्ट्त ांतरणकताग" िब् ि के स्ट्थान पर "मोटर वाहन के स्ट् वामी या
पंिीकृत वाहनों के अजधकृत डीलर" िब् ि को प्रजतस्ट्थाजपत दकया िाएगा।
5. उि जनयमावली के जनयम 55 के पश् चात् जनम्नजलजखत जनयम अंत:स्ट्थाजपत दकए िाएगं ,े अथागत् -
"55क. पिं ीकृत वाहनों के डीलरों की प्राजधकृजत -
1. कोई भी व्यजि, जिसके पंिीकरण प्राजधकारी द्वारा प्रपत्र 29ख में िारी दकए गए वैध प्राजधकृजत प्रमाण पत्र के जबना,
दकसी पंिीकृत वाहन के डीलर के ूपप में कायग नहीं करेगा।
2. पंिीकृत वाहन की जबक्री के जलए प्राजधकृजत प्रमाण पत्र प्रिान करन े या नवीनीकरण के जलए आवेिन जनयम 81 म ें
जनर्िष्टग उजचत िाल्क के साथ प्रपत्र 29क में पोटगल पर इलेक्रॉजनक ूपप से पंिीकरण प्राजधकारी, जिसके अजधकार िेत्र म ें
व्यवसाय का स्ट्थान ह,ै को दकया िाएगा।
3. उप-जनयम (2) के तहत कोई आवेिन प्राप्त होने पर, पंिीकरण प्राजधकारी, यदि संताष्ट ह,ै तो इस तरह के आवेिन के प्राप्त
होने की तारीख से तीस दिनों के भीतर पोटलग पर इलेक्रॉजनक ूपप से डाउनलोड और प्प्रंट करन े योग्य प्रपत्र 29ख में
आवेिक को प्राजधकृजत प्रमाण पत्र िारी कर सकत े ह।ैं यदि आवेिन का जनपटान उि तीस दिनों की अवजध के भीतर नहीं
दकया िाता ह,ै तो आवेिन को स्ट्वीकृत माना िाएगा और पोटलग के माध्यम से प्राजधकृजत प्रमाण पत्र को स्ट्वीकृत/नवीनीकृत
माना िाएगा।
4. िब तक आवेिक को अपना पि रखने का अवसर नहीं दिया िाता ह ैऔर इस तरह के इनकार के कारण को जलजखत ूपप
में नहीं दिया िाता ह,ै तब तक पंिीकरण प्राजधकारी द्वारा प्राजधकृजत प्रमाण पत्र प्रिान करन े या नवीनीकरण के जलए दकसी
भी आवेिन को अस्ट्वीकार नहीं दकया िाएगा।
5. प्रिान दकया गया या नवीनीकृत प्राजधकृजत प्रमाणपत्र प्रारंभ म ें प्रिान दकए गए या नवीनीकरण की तारीख स े 5 वर्षों के
जलए वैध होगा।
6. प्राजधकृजत प्रमाण पत्र को पंिीकृत वाहन के अजधकृत डीलर के व्यवसाय स्ट्थल पर जवजिष्ट स्ट्थान पर प्रि्िगत दकया
िाएगा।
55ख. पिं ीकृत वाहनों के अजधकृत डीलर की वाहन की आप्ू त गके तथ्य के बारे म ेंपिं ीकरण प्राजधकारी को सचू ना-
1. मोटर वाहन का पंिीकृत स्ट्वामी पंिीकरण प्राजधकारी को, वतगमान में वाहन जिसके पास पंिीकृत ह,ै पंिीकृत वाहनों के
अजधकृत डीलर को पोटलग पर इलेक्रॉजनक ूपप से िमा दकए गए उसके और पंिीकृत वाहनों के अजधकृत डीलर द्वारा
हस्ट्तािररत प्रपत्र 29ग के माध्यम से वाहन की आपू्तग के तथ्य के बारे में सूजचत करेगा। पोटगल पर प्रपत्र 29ग को
सफलतापूवगक िमा करने पर पोटगल के माध्यम से पावती सख्ं या स्ट्वतः उपन्न हो िाएगी।
2. मोटर वाहन का पंिीकृत स्ट्वामी पंिीकरण प्राजधकारी, जिसे उप जनयम (1) के तहत सूचना िी गई ह,ै को पंिीकृत
वाहनों के अजधकृत डीलर से वाहन वापस लेने के तथ्य को पोटगल पर इलेक्रॉजनक ूपप से िमा दकए गए उसके और पंिीकृत
वाहनों के अजधकृत डीलर द्वारा हस्ट्तािररत प्रपत्र 29गक के माध्यम स े सूजचत करेगा। पोटगल पर प्रपत्र 29 गक को
सफलतापूवगक िमा करने पर पोटगल के माध्यम से पावती सख्ं या स्ट्वतः उपन्न हो िाएगी।
55ग. पिं ीकृत वाहनों के अजधकृत डीलर की िजि और जिम्मिे ारी-
1. प्रपत्र 29ग िमा करने के बाि, पंिीकृत वाहनों के अजधकृत डीलर को मोटर वाहन का स्ट् वामी माना िाएगा और वह ऐस े
वाहन से संबंजधत सभी घटनाओं के जलए पूरी तरह से जिम्मेिार होगा।
2. पंिीकृत वाहनों के अजधकृत डीलर प्रपत्र 29ग के माध्यम से अपन े अजधकार वाले वाहनों के संबंध में पंिीकरण प्रमाण
पत्र के नवीनीकरण/दफटनेस प्रमाण पत्र के नवीनीकरण, डाप्लीकेट पंिीकरण प्रमाण पत्र, अनापजत्त प्रमाण पत्र, मोटर वाहन
के स्ट्वाजमव के हस्ट्तांतरण के जलए आवेिन करन े के जलए सिम होंगे।
3. पंिीकृत वाहनों के अजधकृत डीलर पोटलग पर इलेक्रॉजनक ूपप से प्रपत्र 29घ म ें सूची का ररकॉडग रखगें े।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3
55घ. पिं ीकृत वाहनों के अजधकृत डीलर के अजधकार वाल े मोटर वाहन का उपयोग जिन उद्देश्यों के जलए दकया िा सकता
ह ै - पंिीकृत वाहनों का अजधकृत डीलर, उसके अजधकार वाल े दकसी भी वाहन का उपयोग जनयम 55ख के तहत सावगिजनक
स्ट्थान पर जनम्नजलजखत के अलावा दकसी अन्द्य उद्देश्य के जलए नहीं करेगा:
(क) उजचत परीिण या उसके द्वारा प्रििगन या प्रििगनी के जलए या दकसी संभाजवत खरीिार के लाभ के जलए; या
(ख) पेंटटंग या मरम्मत के उद्देश्य से सेवा केंद्र म ेंिाने या वापस आन े के जलए; या
(ग) पंिीकरण प्रमाण पत्र / दफटनेस प्रमाण पत्र / पीयूसीसी के नवीनीकरण के उद्देश्य से वाहन जनरीिण और प्रमाणन केंद्र
या पीयूसी केंद्र में िान े या वापस आन े के जलए;
बिते दक सावगिजनक स्ट्थान पर ऐसे वाहनों के उपयोग के िौरान, प्राजधकृजत प्रमाण पत्र को वाहन के जवजिष्ट भाग पर स्ट्पष्ट
ूपप से प्रि्िगत दकया िाएगा, जिसे आसानी से 15 मीटर की िरू ी से पढा िा सके।
55ड. वाहन यात्रा रजिस्ट्टर का रखरखाव - (1) पंिीकृत वाहनों का अजधकृत डीलर पोटगल पर प्रपत्र 29ड. म ें एक
इलेक्रॉजनक रजिस्ट्टर बनाए रखेगा।
(2) प्राजधकृजत प्रमाण पत्र धारक या उसके प्रजतजनजध द्वारा प्रयेक यात्रा के िूपा होन े से पहल े प्रपत्र 29ड. म ें जनर्िष्टग जववरण
को, कॉलम 7 म ें वापसी के समय को छोड़कर, ििग दकया िाएगा और ऐसे वाहन के जलए प्रपत्र 29ड. का प्प्रंट आउट यात्रा
के िौरान वाहन के चालक द्वारा अपन े पास रखा िाएगा और अजधजनयम के तहत िस्ट्तावेिों को प्रस्ट् तता करन े की मागं करन े
के जलए अजधकृत दकसी भी अजधकारी द्वारा मागं ने पर उसे प्रस्ट्त ात दकया िाएगा।
(3) प्राजधकृजत प्रमाण पत्र धारक, यात्रा के अंत में इलेक्रॉजनक ूपप से प्रपत्र 29ड. के कॉलम 7 को भरेगा और पंिीकरण
प्राजधकारी द्वारा जनरीिण के जलए प्रपत्र 29ड. उपलब् ध रहगे ा।
55च. प्राजधकृजत प्रमाणपत्र को खाररि या रद्द करना - यदि पिं ीकरण प्राजधकारी के पास यह मानने का कारण ह ैदक दकसी
भी प्राजधकृजत प्रमाण पत्र के धारक ने जनयम 55ग स े 55ड. के प्रावधानों का अनपा ालन नहीं दकया ह,ै तो वह उजचत सबूत के
साथ उि प्रावधानों के गैर-अनापालन के तथ्य के बारे म ें धारा 213 के तहत स्ट्थाजपत मोटर वाहन जवभाग के प्रमाख को
ररपोटग करेगा। प्राजधकृजत प्रमाण पत्र धारक को उसका पि रखने का अवसर िेन े के बाि, जवभाग के प्रमाख अपन े पास रख े
प्राजधकृजत प्रमाण पत्र को खाररि या रद्द कर सकते ह।ैं
55छ अपील - जनयम 55क या 55च के तहत दकसी आिेि से व्यजथत कोई भी व्यजि, ऐसे दकसी भी आिेि जमलने के तीस
दिनों के भीतर, राज्य सरकार/संघ राज्य िेत्र द्वारा अजधकृत संबंजधत प्राजधकारी के समि अपील कर सकता ह।ै
55ि अपील के जलए प्रदक्रया - (1) जनयम 55छ म ें जनर्िष्टग अपील को डाप्ल ीकेट म,ें पंिीकरण प्राजधकारी के आिेि पर
आपजत्तयों के आधार को जनधागररत करत े हुए और जनयम 81 में जनर्िष्टग उजचत िल्ा क और जिसके जवरुद्ध अपील की गई ह ैउस
आिेि की एक प्रमाजणत प्रजत के साथ एक ज्ञापन के ूपप म ेंप्राथजमकता िी िाएगी।
(2) अपील प्राजधकारी, पिकारों को उनका पि रखने का अवसर िेने के बाि और ऐसी िांच के बाि, यदि कोई हो, िैसा
वह आवश्यक समव,े ऐसी अपील प्राप् त होने की तारीख से तीस दिनों की अवजध के भीतर उजचत आिेि पाररत करता ह।ै "
6. उि जनयमावली म ें जनयम 58 के उप जनयम (1) में "मोटर वाहन के संबंध म ें दकया िाएगा" िब्िों के पश् चात ् "मोटर
वाहन के स्ट् वामी या पंिीकृत वाहनों के अजधकृत डीलर द्वारा" िब्िों को अंत:स्ट् थाजपत दकया िाएगा।
7. उि जनयमावली के जनयम 81 की ताजलका में क्रमांक 1 के पश् चात ् जनम्नजलजखत को प्रजतस्ट्थ ाजपत दकया िाएगा, अथागत्:
“1क प्राजधकृजत प्रमाणपत्र प्रिान करना या नवीनीकरण पच् चीस हिार रु. 55क(2)

वाहनों के अन्द्य वगों के संबंध में प्रयेक माह या उसके
भाग के जवलंब के जलए पांच सौ रुपए का िाल् क वसूला
िाएगा। ”
8. उि जनयमावली के प्रपत्र 26 म,ें -

दकसी प्राजधकारी द्वारा खाररि या रद्द दकया गया ह"ै िब्िों को अंत:स्ट् थाजपत दकया िाएगा;
(2) िब्िों "आवेिक के हस्ट्तािर/अगं ूठे का जनिान" के स्ट्थान पर "मोटर वाहन के स्ट् वामी या पंिीकृत वाहनों के अजधकृत

9. उि जनयमावली के प्रपत्र 28 म,ें -

NOTIFICATION
New Delhi, the 12th September, 2022
G.S.R. 693(E).—AThe following draft of certain rules further to amend the Central Motor Vehicles Rules,
1989, which the Central Government proposes to make in exercise of the powers conferred by clause (p) of section 64
of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the
said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules
shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as
published in the Official Gazette, are made available to the public;
Objections and suggestions to these draft rules, if any, may be sent to the Joint Secretary (MVL, Transport &
Toll), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001 or on the
email: comments-morth@gov.in;
The objections or suggestions which may be received from any person in respect of the said draft rules before
the expiry of the aforesaid period will be considered by the Central Government.
Draft Rules
1. (1) These rules may be called as Central Motor Vehicles (…. Amendment) Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), in Rule 52,
(1) after the words “owner of a motor vehicle” the words “or authorized dealer of registered vehicles” shall be
inserted.
(2) an explanatory paragraph shall be inserted, "An authorised dealer of registered vehicles shall be a dealer who is
authorised to engage in sale or purchase of registered vehicles."
3. In the said rules, in rule 53, for sub rule (1), the following sub rule shall be substituted, namely: -
“(1) If at any time, the certificate of registration is lost or destroyed the owner of a motor vehicle or authorized dealer
of registered vehicles shall intimate the fact in writing to any registering authority in the state in which vehicle is
currently registered.”
4. In the said rules, in rule 55, in sub rule (1), for the words “the transferor” the words “the owner of a motor vehicle
or authorized dealer of registered vehicles” shall be substituted.
5. In the said rules, after Rule 55, following Rules shall be inserted namely –10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
“55A. Authorisation of dealers of registered vehicles-
1. No person shall act as dealer of a registered vehicle without a valid authorization certificate issued in Form
29 B by the registering authority in whose jurisdiction, he has place of business.
2. An application for grant or renewal of authorization certificate for sale of registered vehicle shall be made
electronically on portal in Form 29 A, accompanied by appropriate fee as specified in rule 81, to the
registering authority, in whose jurisdiction he has place of business.
3. On receipt of an application under sub rule (2), the registering authority may, if satisfied, issue to the
applicant authorisation certificate, electronically on portal, in downloadable and printable form, in Form 29B
within thirty days from the date of receipt of such an application. If application is not disposed within said
period of thirty days, the application shall be deemed to be approved and authorisation certificate shall be
deemed to be granted/renewed through the portal.
4. No application for grant or renewal of authorization certificate shall be refused by the registering authority
unless the applicant is given an opportunity of being heard and reasons of such refusal are given in writing.
5. An authorization certificate granted or renewed shall be valid for 5 years from the date of initial grant or
renewal.
6. Authorisation certificate shall be exhibited at conspicuous place, at the business place of authorised dealer of
registered vehicles.
55B. Intimation to the registering authority, about the fact of delivery of vehicle to the authorized dealer of
registered vehicles-
1. Registered owner of a motor vehicle shall intimate the registering authority, with whom the vehicle is
currently registered, the fact of delivery of vehicle to authorized dealer of registered vehicles, through Form
29C, submitted electronically on portal, dually signed by him and authorized dealer of registered vehicles. On
successful submission of Form 29 C on the portal, acknowledgement number shall be auto generated through
the portal.
2. Registered owner of a motor vehicle shall intimate the registering authority, to whom the intimation under
sub rule (1) has been given, the fact of taking back vehicle from authorized dealer of registered vehicles,
through Form 29CA, submitted electronically on portal, dually signed by him and authorized dealer of
registered vehicles. On successful submission of Form 29 CA on the portal, acknowledgement number shall
be auto generated through the portal.
55C. Power and responsibility of authorized dealer of registered vehicles-
1. After submission of Form 29 C, authorized dealer of registered vehicles shall be deemed owner of the motor
vehicle and shall be solely responsible for all incidents related to such vehicle.
2. Authorized dealer of registered vehicles shall be competent to apply for renewal of registration certificate/
renewal of certificate of fitness, duplicate registration certificate, NOC, transfer of ownership of motor
vehicle, in relation to vehicles in his possession through Form 29C.
3. Authorized dealer of registered vehicles shall maintain the record of inventory electronically, in Form 29D on
portal.
55D. Purposes for which motor vehicle in possession of authorized dealer of registered vehicles may be used. –
An authorized dealer of registered vehicles shall not use any vehicle which is in his possession under rule 55B in a
public place for any purpose other than the following:
(a) for a reasonable trial or demonstration by or exhibition by or for the benefit of a prospective purchaser; or
(b) for proceeding to or returning from a service center with the objective of painting or for repairs; or
(c) for proceeding to or returning from vehicle inspection and certification center or PUC center for the purpose of
renewal of certificate of registration/ certificate of fitness/ PUCC;
Provided that during use of such vehicles in public place, authorisation certificate shall be exhibited legibly on
conspicuous part of vehicle, which can be easily readable from a distance of 15 meters.
55E. Maintenance of vehicle trip register. - (1) An authorized dealer of registered vehicles shall maintain an

(2) The particulars referred to in Form 29E, except the time of return under column 7, shall be entered before the
commencement of each trip by the holder of the authorisation certificate or his representative and print out of Form
29E for such vehicle shall be carried during the trip by the driver of the vehicle and shall be produced on demand by
any officer empowered to demand production of documents by or under the Act.
(3) The holder of an authorisation certificate shall, at the end of a trip, fill in column 7 of Form 29E electronically,
and Form 29E shall be open for inspection by the registering authority.
55F. Suspension or cancellation of authorisation certificate. - If the registering authority has reason to believe that
the holder of any authorisation certificate has not complied with the provisions of rules 55C to 55E, it shall report the
fact of non-compliance of the said provisions along with reasonable proof, to the head of the Motor Vehicles
department established under section 213. The head of the department may, after giving the holder of authorisation
certificate an opportunity of being heard, suspend or cancel the authorisation certificate held by him.
55G Appeal. - Any person aggrieved by an order under rule 55A or 55F may, within thirty days of the receipt of any
such order, appeal to the concerned authority as authorised by the state government/ UT.
55H Procedure for appeal. - (1) The appeal referred to in rule 55G shall be preferred in duplicate in the form of a
memorandum, setting forth the grounds of objections to the order of the registering authority and shall be
accompanied by appropriate fee as specified in rule 81 and a certified copy of the order appealed against.
(2) The appellate authority, after giving an opportunity to the parties to be heard and after such enquiry, if any, as it
deems necessary, pass appropriate orders within the period of thirty days from the date of receipt of such an appeal."
6. In the said rules, in rule 58, in sub rule (1), after the words “in respect of a motor vehicle shall be made” the words
“by the owner of a motor vehicle or authorized dealer of registered vehicles” shall be inserted.
7. In the said rules, in rule 81, in the table, after serial number 1, the following shall be substituted, namely:

Note 1: Additional fee of two hundred
rupees shall be levied if the certificate of
registration is a laminated card without chip or

Note 2: In case of delay in applying
for renewal of certificate of registration, an
additional fee of three hundred rupees for delay of
every month or part thereof in respect of motor
cycles and five hundred rupees for delay of every
month or part thereof in respect of other classes of
non-transport vehicles shall be levied. ”
8. In the said rules, in Form 26, -
(1) the words “I/We hereby declare that I/We on........................... (date) have filed a complaint (copy enclosed) with
the police about the loss of Certificate of Registration immediately after the loss has been noticed. I declare that the
certificate of registration is lost/ destroyed and it has not been impounded by any agency nor it has been suspended or
cancelled by any authority.” shall be inserted;
(2) for the words “Signature/ thumb impression of applicant” the words “Signature /digital signature/ e signature of
owner of motor vehicle or authorized dealer of registered vehicles” shall be substituted.
9. In the said rules, in Form 28, -
(a) for the words “Signature or thumb-impression of Registered owner” the words “Signature /digital signature/ e
signature of owner of motor vehicle or authorized dealer of registered vehicles” shall be substituted,
(b) in OFFICE ENDORSEMENT, for the words “To The Registered Owner” the words “To owner of motor vehicle /
authorized dealer of registered vehicles” shall be substituted,
10. In the said rules, in Form 29, for the words “Signature or thumb-impression of the Registered Owner (Transferor)”
the words “Signature /digital signature/ e signature of owner of motor vehicle or authorized dealer of registered
vehicles” shall be substituted,
11. In the said rules, in Form 30, -
(a) for the words “Signature or thumb-impression of the Transferor” the words “Signature /digital signature/ e
