सड़क पररवहन और राजमागग मंत्रालय की ऄजधसूचना संखयांक सा.का.जन. 136 (ऄ), तारीख 25 फरवरी, 2021 द्वारा भारत के राजपत्र ऄसाधारण, भाग II, खंड 3, ईपखंड (i) में प्रकाजित दकया गया था, जजसमें ऐसे सभी व्यजियों से, जजनकी ईससे प्रभाजवत होने की संभावना थी, ईस तारीख से, जजनको ईि ऄजधसूचना को ऄंतर्ववष्ट करने वाले राजपत्र की प्रजतयां जनता को ईपलब्ध करा दी गइ थीं, से तीस ददन की ऄवजध के भीतर अक्षेप और सुझाव मांगे गए थे; और, ईि राजपत्र की प्रजतयां 25 फरवरी, 2021 से जनता को ईपलब्ध करा दी गइ थीं ; और, ईि प्रारुप जनयमों के संबंध में जनता से प्राप्त अक्षेपों और सुझावों पर केन्द्रीय सरकार द्वारा जवचार दकया गया; ऄतः ऄब केन्द्रीय सरकार मोटर यान ऄजधजनयम, 1988 (1988 का 59) की धारा 137 के साथ परित धारा 136क द्वारा प्रदत्त् िजियों का प्रयोग करते हुए केन्द्रीय मोटरयान जनयम, 1989 का और संिोधन करने के जलए जनम्नजलजखत जनयम बनाती है ऄथागत् : 1. संजक्षप्त नाम और प्रारंभ (1) आन जनयमों का संजक्षप्त नाम केन्द्रीय मोटर यान (सत्रहवााँ संिोधन) जनयम, 2021 है । (2) ये राजपत्र में ईनके प्रकािन की तारीख को प्रवृत्त होंगे । 4603 की आलक्ट्े राजनक मानीटररग और प्रवतगन—(1) चालान जारी करने के जलए ईपयोग दकए जाने वाले आलेक्ट्राजनक प्रवतगन युजि को राज्य सरकार के नामजनर्ददष्ट प्राजधकारी द्वारा हस्ट्ताक्षररत ऄनुमोदन प्रमाण पत्र रखना होगा, जो यह प्रमाजणत करेगा दक युजि सही है और ईजचत रुप से दियािील है तथा ऄनुमोदन प्रमाणपत्र वार्विक अधार पर नवीनीकृत होगा । स्ट्पष्टीकरण—(1) आस जनयम के प्रयोजन के जलए, आलेक्ट्राजनक प्रवतगन युजि से कैमरा, कलोज्ड-सर्दकट टेलीजवजन कैमरा, स्ट्पीड गन, िरीर में पहना जाने वाला कैमरा, डैिबोडग कैमरा, स्ट्वचाजलत नंबर प्लेट पजहचान (एएनपीअर), वेट आन मिीन (डब्ल्यूअइएम) और राज्य सरकार द्वारा जवजनर्ददष्ट कोइ ऄन्द्य प्रौद्योजगकी ऄजभप्रेत है । (2) िरीर में पहने जाने वाले कैमरे को पुजलस ऄजधकारी, पररवहन पदधारी या राज्य सरकार द्वारा प्राजधकृत कोइ ऄन्द्य पदधारी द्वारा पहना जा सकेगा और ऐसा ऄजधकारी या पदधारी ऄपराधी को ऄजधसूजचत करेगा दक वह िरीर कैमरा द्वारा ररकाडग कर जलया गया है और आसी प्रकार से, डैिबोडग कैमरों को दकसी पुजलस यान के डैिबोडग पर लगाया जा सकेगा या यातायात जनयमों को लागू कराने के जलए राज्य सरकार द्वारा यथा प्राजधकृत दकसी ऄन्द्य यान में लगाया जा सकेगा और ऐसा ऄजधकारी या पदधारी ऄपराधी के रुप में ऄजधसूजचत दकया जाएगा दक वह डैिबोडग कैमरे के द्वारा ररकाडग कर जलया गया है । (2) राज्य सरकारें यह सुजनजश्चत करेंगी दक राष्ट्रीय राजमागों और राज्य राज्यमागों पर ईच्च-जोजखम और ईच्च- घनत्व वाले गजलयारों पर तथा कम से कम दस लाख से ऄजधक जनसंखया (दस लाख से ऄजधक िहरी संघट्टीकरणों या िहरों पर अधाररत ईपलब्ध अंकड़ों के ऄनुसार : भारत की 2011 की जनगणना या नवीनतम जनगणना के ऄनुसार) नीचे दी गइ सारणी जजसमें यथा जवजनर्ददष्ट 132 िहरों को िाजमल दकया गया है पर ईजचत आलेक्ट्राजनक प्रवतगन युजियों को लगाया जाएगा और हुइ संसूचना युजियां प्रयुि करना, जवजध के जवरुद्ध रीजत में ऄन्द्य यानों को पार करना या ईनसे अगे जनकलना, यातायात के प्राजधकृत प्रवाह के जवरुद्ध यान चलाना, दकसी ऐसी रीजत में यान चलाना जो सक्षम और सावधान साथ चलाना जो ईसकी बोडी दोनों ओर या ईसके अगे या पीछे जनकला हो ऄथवा ईसकी ईंचाइ ऄनुज्ञेय सीमा से ऄजधक हो (धारा 194 की ईपधारा (1क); (xii) अपात यान को मुिमागग प्रदान करने में ऄसफलता (धारा 194ङ); (4) (क) राज्य सरकारे यह सुजनजश्चत करेंगी दक आलेक्ट्राजनक प्रवतगन युजि द्वारा माजनटर दकए गए जहस्ट्सों के समक्ष ईजचत चेतावनी जचन्द्ह दृश्यमान रूप से लगाए जाएं, जनता को यह ऄजधसूजचत दकया जाए दक ऐसी युजि प्रयोग में है तथा संबंजधत प्राजधकारी यह सुजनजश्चत करेंगे दक भौजतक संकेत, भौजतक जवराम रेखाएं तथा पैदल यात्री िोलसग सड़क पर स्ट्पष्ट रूप से जचजन्द्हत हो । (ख) खराब मौसमी दिाओं जैसे विाग, ओल,े कोहरा वाले मौसम अदद के साथ साथ मागग में अगे कोइ ऄवरोध दर्वित करने के जलए सड़क पर गजतसीमाएं ऄजधसूजचत करने के जलए ईजचत जनयत और सदिय गजतसीमा जचन्द्ह भी प्रयोग दकए जा सकेंगे । (5) (क) जवजध प्रवतगन ऄजधकाररयों जैसे पुजलस और यातायात पदधाररयां द्वारा यातायात का प्रबंध करते समय या कोइ प्रवतगन ऄजभयान चलाते समय िरीर पर धारण करने योग्य कैमरा स्ट्पष्ट रूप से प्रयोग दकए जाएंगे और ऐसी युजियां दकसी घटना की कायगवाजहयों को ररकोडग करने के जलए प्रयुि की जाएंगी, जजन्द्हें ऄपराध करने वाले चालक या व्यजि के जवरुद्ध साक्ष्य के रूप में न्द्यायालय में प्रयोग दकया जा सकता तथा यह भी सुजनजश्चत दकया जाए दक जवजध प्रवतगन पदधारी में ऄपराध करने वाले चालक या व्यजि को दंजडत करते समय जवजध के ईपबंधों के ऄनुसार कायग दकया है । (ख) बोडी कैमरा के जवजडयो और अजडयो फंक्ट्िन दोनो तभी सदिय होंगे जब जवजध प्रवतगन पदधारी ड्यूटी पर है तथा पदधारी ईन व्यजियों को ऄजधसूजचत करेगा दक ईन्द्हें बोडी कैमरा द्वारा ररकोडग दकया जा रहा है । (6) आलेक्ट्राजनक माजनटरी और प्रवतगन प्रणाली के माध्यम से चालान के स्ट्वत: सृजन का प्रयोग करते हुए जनयम 167 के ऄधीन आलेक्ट्राजनक रूप में जारी सभी चालानों के साथ जनम्नजलजखत सूचना होगी, ऄथागत् :- (i) ऄपराध और यान की ऄनुज्ञजप्त प्लेट को दिागने वाला स्ट्पष्ट फोटोग्राफी साक्ष्य; (ii) आलैक्ट्राजनक प्रवतगन युजि से मापन; (iii) ऄपराध की तारीख, समय और स्ट्थान; (iv) ऄजधजनयम के ईस ईपबंध को जवजनर्ददष्ट करने वाला नोरटस जजसका ईल्लंघन दकया गया है; (v) भारतीय साक्ष्य ऄजधजनयम, 1872 (1872 का 1) की धारा 65ख की ईपधारा (4) के ऄनुसार प्रमाण पत्र, जो, -- (क) आलैक्ट्राजनक ऄजभलेख की पहचान करता है तथा ईस रीजत का वणगन करता है जजसमें आसे तैयार दकया गया; (ख) आलैक्ट्राजनक ऄजभलेख को तैयार करने में ऄन्द्तवगजलत दकसी युजि की ऐसी जवजिजष्टयां देता है जो यह दर्वित करने के प्रयोजन के जलए ईजचत हो दक आलैक्ट्राजनक ऄजभलेख कम्प्यूटर द्वारा तैयार दकया गया; (ग) राज्य सरकार द्वारा आस जनजमत्त प्राजधकृत ऄजधकारी द्वारा हस्ट्ताक्षररत दकया गया । (7) ईपजनयम (1) और (2) के ऄधीन चालान यान के रजजस्ट्रीकृत स्ट्वामी के नाम से जारी दकए जाएंगे और ईनके साथ ऄपराध का नोरटस आलैक्ट्राजनक रूप जैसे एसएमएस या इ-मेल या भौजतक रूप में संलग्न होना चाजहए । (8) (क) चालान का संदाय जनयम 167 के ईपजनयम (5), (6) और ईपजनयम (7) में जवजनर्ददष्ट समयावजध के भीतर दकया जाएगा । (ख) इ-चालान का संदाय राज्य सरकार द्वारा जवजनर्ददष्ट अनलाइन पोटगल पर आलैक्ट्राजनक ढंग से या यातायात पुजलस स्ट्टेिनों पर नकद या काडग प्रयुि करके ऄथवा राज्य द्वारा यथाजवजनर्ददष्ट ऄजभजहत स्ट्थानों पर या इ-चालान प्रणाली के इ-संदाय गेटवे पर दकया जा सकता है । (9) ऄपराध का नोरटस ऄपराध होने के पन्द्रह ददन के भीतर भेजा जाएगा तथा आलैक्ट्राजनक माजनटरी द्वारा संग्रहीत आलैक्ट्राजनक ऄजभलेख चालान के जनपटारे तक रखा जाना चाजहए तथा ईस दिा में जहां आलैक्ट्राजनक ऄजभलेख दकसी ऄपराध से संबंजधत है, ईसे अरम्भ की गइ कायगवाजहयों के पूणग होने तक रखा जाना चाजहए, जजसके ऄन्द्तगगत ऄपीलें भी हैं ।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 7 (10) ईस मामले में जहां यान का स्ट्वामी ऄपराध के समय यान को नहीं 2021 G.S.R. 575(E).—Whereas the draft rules further to amend the Central Motor Vehicles Rules, 1989, were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Ministry of Road Transport and Highways, Government of India, numbered G.S.R. 136 (E), dated the 25th February, 2021 published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to public; And, whereas, copies of the said Gazette notification were made available to the public on the 25th February, 2021; And, whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 136A read with section 137 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:— 1. Short Title and commencement.-(1) These rules may be called the Central Motor Vehicles (Seventeenth Amendment) Rules, 2021 (2) They shall come into force on the date of their publication in the Official Gazette. 2. In Central Motor Vehicle Rules, 1989, after rule 167, the following rule shall be inserted, namely:— “167A. Electronic Monitoring and Enforcement of Road Safety.-(1) The electronic enforcement device used for issuance of a challan shall have an approval certificate signed by a designated authority of the State Government certifying that the device is accurate and operating properly and the approval certificate shall be renewed on a yearly basis. Explanation.- (1) For the purpose of this rule, “electronic enforcement device” means a speed camera, closed-circuit television camera, speed gun, body wearable camera, dashboard camera, Automatic Number Plate Recognition (ANPR), weigh in machine (WIM) and any such other technology specified by the State Government. (2) Body wearable camera may be worn by police officer, transport official or any other official authorised by the State Government and such officer or official shall notify to the offender that he is being recorded by the body camera and similarly, dashboard camera may be placed on the dashboard of any police vehicle or in any other vehicle as authorised by the State Government for enforcing the traffic rules and such officer or official shall notify to the offender that he is being recorded by the dashboard camera. Faridabad* *Million plus cities but not part of non-attainment cities (3) For sub-rules (1) and (2), the footage from an electronic enforcement device having electronic stamp for location, date and time, can be used to issue challan for the following offences, namely:— (i) not driving within the prescribed speed limit (sections 112 and 183); (ii) stopping or parking vehicle at an unauthorised location (section 122); (iii) not undertaking Safety measures for drivers and pillion riders (section 128); (iv) not wearing protective headgear or helmet (section 129); (v) jumping a red light, violating a stop sign, using of handheld communications devices while driving, passing or overtaking other vehicles in a manner contrary to law, driving against the authorised flow of traffic, driving in any manner that falls far below what would be expected of a competent and careful driver and where it would be obvious to a competent and careful driver that driving in that manner would be dangerous(section 184); (vi) driving vehicle exceeding permissible weight (sub-section (1) of section 194); (vii) driving without safety belt (section 194B); (viii) contravention of rule 6 (pertaining to lane driving) of the Motor Vehicles(Driving) Regulations, 2017 (section 177A); (ix) Goods carriage carrying passengers (section 66); (x) contravention of rule 36 (pertaining to Registration plates) of the Motor Vehicles(Driving) Regulations, 2017 (section 177A);12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (xi) driving vehicle with load that extends beyond the sides of body or to the front or to the rear or in height beyond the permissible limit (sub-section (1A) of section 194); (xii) failure to provide free passage to emergency vehicle (section 194E). (4) (a) State Governments shall ensure that appropriate warning signs are conspicuously placed before the stretches monitored by electronic enforcement device, notifying the public that such device is in use and the concerned authorities shall ensure that physical markings, physical stop lines and pedestrian crossing are clearly marked on the road. (b) Appropriate fixed and dynamic speed limit signs may also be used to notify the speed limits on the road sections during adverse weather conditions, such as rain, hail, foggy weather etc. as well as for indicating any obstruction ahead in the route. (5) (a) Body wearable cameras shall be explicitly used by the law enforcement officers, such as police and transport officials, while managing the traffic or carrying out any enforcement drive and such devices shall be used to record the proceedings of an event, which can be used in the court as an evidence against the offending driver or person and also ensure that the law enforcement official has acted as per the provisions of law while penalising the offending driver or person. (b) Both the video and audio functions of the body camera shall be activated only when the law enforcement official is on duty and the official shall notify the subjects that they are being recorded by the body camera. (6) All challans issued under rule 167 in electronic form using auto-generation of challan through the electronic monitoring and enforcement system shall be accompanied with the following information, namely:— (i) clear photographic evidence highlighting the offence and the license plate of the vehicle; (ii) measurement from the electronic enforcement device; (iii) date, time and place of the offence; (iv) notice specifying the provision of Act that has been violated; (v) certificate as per sub-section(4) of section 65B of the Indian Evidence Act 1872(1 of 1872), which,— (a) identifies the electronic record and describes the manner in which it was produced; (b) gives such particulars of any device involved in the production of that electronic record as may be appropriate for the purpose of showing that the electronic record was produced by a computer; (c) signed by the officer authorised in this behalf by the State Government. (7) Challans, under sub-rules (1) and (2), shall be issued in the name of the registered owner of the vehicle and must be accompanied with a notice of offence in electronic form viz SMS or e-mail or in physical form. (8) (a) The payment of the challan shall be made within the time period specified in the sub-rules (5), (6) and (7) of rule 167. (b) The payment of e-challan can be made electronically on an online portal specified by the State Government or using cash or card at Traffic Police Stations or at designated places or the e-payment gateway of the e-challan system as specified by States. (9) The notice of offence shall be sent within fifteen days of the occurrence of the offence and the electronic record collected by way of electronic monitoring should be stored till the disposal of challan and in the case where the electronic record relates to an offence, should be stored till the conclusion of proceedings initiated, including appeals. (10) In case the owner of the vehicle was not driving the vehicle at the time of offence, he may claim innocence before the police officer or any officer authorised by the State Government, by providing appropriate proof that he was not the driver at the time of the offence, or that another person was the driver at the time of the offence.”.
