और स्ट्थापना की सहमजत के संबंध में दििाजनिेि िारी करन े के जलए जवजनर्म लाने हते ु िारी करन े का प्रस्ट्ताव करती है, जिसे एतद्द्वारा आम िनता और अन्र् जहतधारकों की िानकारी के जलए प्रकाजित दकर्ा िाता है, जिनके इससे प्रभाजवत होन े की संभावना ह।ै इसके अलावा, इसके द्वारा र्ह नोरिस दिर्ा िाता ह ै दक उि अजधसूचना को केंद्र सरकार द्वारा भारत के रािपत्र म ें मसौिा अजधसूचना प्रकाजित होन े की तारीख से साठ दिनों की समाजि पर र्ा उसके बाि जवचार म ेंजलर्ा िाएगा; मसौिा अजधसूचना में जनजहत प्रस्ट्तावों पर कोई आपजत्त र्ा सुझाव िेने में रुजच रखने वाला कोई भी व्यजि जनधााररत अवजध के भीतर सजचव, पर्ाावरण, वन और िलवार्ु (सीपीसीबी) से परामिा दकर्ा था; और चूंदक, इस अजधसूचना का उद्देश्र् न केवल व्यापार करन े म ेंसुगमता बढाना, उद्योगों के अनुपालन भार को कम करना ह,ै बजल्क राज्र् प्रिषू ण जनर्ंत्रण बोड ा (एसपीसीबी)/प्रिषू ण जनर्ंत्रण सजमजत (पीसीसी) स्ट्तर पर कार्ा म ें िोहराव को कम करना भी ह;ै और चूंदक, इस अजधसूचना को तैर्ार करते समर् र्ह ध्र्ान रखा गर्ा ह ैदक प्रिषू ण जनर्ंत्रण की समुजचत जनगरानी और दििाजनिेिों का अनुपालन सुजनजित दकर्ा िाए। अत: अब, वार्ु (प्रिषू ण जनवारण एवं जनर्ंत्रण) अजधजनर्म, 1981 की धारा 21क , तथा िल (प्रिषू ण जनवारण एवं जनर्ंत्रण) अजधजनर्म, 1974 की धारा 27क के तहत प्रित्त िजिर्ों का प्रर्ोग करत े हुए, केन्द्र सरकार एतद्द्वारा सहमजत िुल्क तथा स्ट्थापना हते ु सहमजत एवं संचालन हते ु सहमजत प्रिान करने, अस्ट्वीकार करने र्ा रद्द करन े से संबंजधत दििाजनिेि अजधसूजचत करती हैःै एकसमान िल्ु क के जलए दििाजनिेि िल (प्रिषू ण जनवारण एवं जनर्ंत्रण) अजधजनर्म, 1974 (आि की तारीख तक संिोजधत), वार्ु (प्रिषू ण जनवारण एव ं जनर्ंत्रण) अजधजनर्म, 1981 (आि की तारीख तक संिोजधत) के अतं गता राज्र् प्रिषू ण जनर्ंत्रण बोडों (एसपीसीबी)/प्रिषू ण जनर्ंत्रण सजमजतर्ों (पीसीसी) में र्ुजिसगं त/एकरूप सहमजत िुल्क और जवजभन्न पर्ाावरण संरक्षण जनर्म, 1986 (आि की तारीख तक संिोजधत) के तहत प्राजधकरण के जलए दििाजनिेि जनम्नानुसार ह:ैं 1.1 पिूं ी जनविे (क) औद्योजगक पररसरों (र्ा) िाउनजिप, संर्ंत्रों और मिीनरी र्ा उपकरणों के भीतर अचल पररसंपजत्तर्ों अथाात भूजम, भवन जिसमें स्ट्िाफ क्वािार, गेस्ट्ि हाउस आदि िाजमल ह,ैं पर दकर्ा गर्ा जनवेि, जिसमें मल्ू र्ह्रास के जबना प्रिषू ण जनर्ंत्रण के जलए दकए गए जनवेि की लागत भी िाजमल ह।ै[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (ख) पट्टे की भूजम और/र्ा भवन र्ा दकसी अन्र् पररसंपजत्त पर संचाजलत दकसी उद्योग के मामले में, वार्षाक पट्टा मूल्र् का िस (10) गनु ा जलर्ा िाना ह,ै िो पूंिी जनवेि (र्ा) संपजत्त/भूजम के पर्ावेक्षण मल्ू र्, इनमें से िो भी अजधक हो के बराबर होगा। 1.2 स्ट्थापना हते ुसहमजत की वधै ता अवजध एव ंइसका सहमजत िल्ु क (क) स्ट्थापना हते ु सहमजत (सीिीई) की वैधता अवजध, पूवा पर्ाावरण मंिरू ी जलए िान े वाली पररर्ोिना के मामल े में, पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् (एमओईएफ और सीसी) / राज्र् पर्ाावरण प्रभाव आकलन प्राजधकरण (एसईआईएए) द्वारा िारी पर्ाावरण मंिरू ी (ईसी) के अनुसार होगी। (ख) र्दि पररर्ोिना/गजतजवजध ईसी आवश्र्क नहीं ह,ै तो आरंभ म ेंसीिीई न्र्ूनतम पांच (05) वष ाकी अवजध के जलए िी िाएगी और पररर्ोिना प्रस्ट्तावक के अनुरोध पर इसे अजधकतम िो (02) वषों तक बढार्ा िा सकता ह,ै जिससे सीिीई िारी होने की जतजथ से वैधता की बाह्य सीमा सात (07) वष ा हो िाएगी। (ग) सी.िी.ई. के जलए सहमजत िुल्क, िल अजधजनर्म और/र्ा वार्ु अजधजनर्म के अंतगता वार्षाक सहमजत िुल्क का िोगुना होगा, िो पररर्ोिना की स्ट्थापना की सम्पूणा अवजध के जलए पररर्ोिना गजतजवजधर्ों पर लाग ूहोगा। 1.3 जवजभन्न गजतजवजधर्ों के जलए सहमजत िल्ु क का अनमु ान पूंिी जनवेि स्ट्लैब, उद्योग का वगीकरण, औद्योजगक क्षेत्रों, स्ट्थानीर् जनकार्ों, खनन पररर्ोिनाओं, कॉफी पलल्पगं , एक्वा कल्चर और एकल वार् ु प्रिषू ण स्रोत के रूप म ें डीिल िने रेिर (डीिी) सेि के जलए सहमजत िल्ु क, सहमजत के नवीकरण के जलए छूि और जवलंब िल्ु क, उद्योग को प्रोत्साहन, सहमजत िल्ु क और प्राजधकरण िल्ु क में संिोधन, पररजिष्ट के रूप में दिए गए ह ैं। 1.4 एसपीसीबी/पीसीसी द्वारा उच्च सहमजत िल्ु क एसपीसीबी/पीसीसी स्ट्थानीर् पर्ाावरणीर् मुद्दों और स्ट्थानीर् पररजस्ट्थजतर्ों को ध्र्ान म ें रखते हुए, इस दििा- जनिेि में उजल्लजखत कार्ाप्रणाली के आधार पर सहमजत िल्ु क की राजि तर् कर सकते ह ैं िो अनुमाजनत सहमजत िुल्क स े अजधकतम 20% अजधक हो सकती ह।ै हालांदक, एसपीसीबी/पीसीसी इससे कम भी सहमजत िुल्क ल े सकते ह।ैं 1.5 सामान्र् सहमजत और प्राजधकरण प्रपत्र एसपीसीबी/पीसीसी िल अजधजनर्म, वार्ु अजधजनर्म के तहत सामान्र् सहमजत और प्राजधकरण (सीसीएंडए) िारी करने और ईपीए जनर्मों के तहत प्राजधकरण जनर्मों के जलए एकल-चरणीर् प्रदक्रर्ा अपनाएंगे। तिनुसार, सामान्र् सहमजत और प्राजधकरण फॉमा के जलए एक मॉडल िेम्पलेि अनलु ग्नक I म ेंदिर्ा गर्ा ह ै । 2.0 सहमजत िेन,े अस्ट्वीकार करन ेर्ा रद्द करन ेस ेसबं जं धत दििाजनिेि: 2.1 स्ट्थापना हते ुसहमजत (सीिीई) प्रिान करन ेके जलए दििाजनिेि (क) सीिीई आवेिन (सामान्र् सहमजत प्रपत्र) से संबंजधत िानकारी आवेिक द्वारा जनर्िाष्ट प्रदक्रर्ाओं के अनुसार पूवाापेजक्षत िानकारी/िस्ट्तावेिों के साथ भरी िाएगी। (ख) सीिीई प्राि करने के जलए जनधााररत पर्ााि िुल्क का भुगतान राज्र् सरकार/संघ राज्र् क्षेत्र द्वारा जनधााररत िरों के अनुसार आवेिन के साथ ऑनलाइन/ऑफलाइन रूप से दकर्ा िाएगा। (ग) स्ट्थान जनधारा ण मानिंड: i. औद्योजगक प्रजतष्ठान को र्था प्रर्ोज्र् केन्द्र/राज्र्/संघ राज्र् क्षेत्र के क्षेत्र-जवजिष्ट स्ट्थल जनधाारण मानिंडों, माननीर् राष्ट्रीर् हररत अजधकरण (एनिीिी)/न्र्ार्ालर् द्वारा पाररत आिेिों तथा पर्ाावरण, वन एवं िलवार्ु पररवतान मंत्रालर्/सीपीसीबी/एसपीसीबी/पीसीसी द्वारा ऐसे आििे ों/जनर्मों के अनुपालन म ेंिारी दििा-जनिेिों का अनुपालन करना होगा। ii. क्षत्रे -जवजिष्ट स्ट्थल जनधाारण मानिंड उपलब्ध न होन े की जस्ट्थजत में, संबंजधत राज्र्/संघ राज्र् क्षेत्र द्वारा तैर्ार दकए गए सामान्र् दििाजनिेिों का पालन दकर्ा िाएगा, अन्र्था, जनम्नजलजखत मानिडं (न्र्ूनतम िरू ी) का अनुपालन दकर्ा िाएगा। (क) रािस्ट्व रेखाजचत्र के अनुसार सतही िल जनकार् (बाढ के मिै ान/एचएफएल/लाल रेखा) की जनकितम सीमा से: • लाल श्रेणी : 500 मीिर स ेआग े4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] • नारंगी श्रेणी : ✓ अपजिष्ट सृिन के साथ : 75 मीिर स ेआग े ✓ अपजिष्ट सृिन के जबना : 30 मीिर स ेआग े • हरी श्रेणी : 30 मीिर से आग े (ख) बस्ट्ती, िैजक्षक संस्ट्थान, पूिा स्ट्थल, परु ाताजत्वक स्ट्मारक, राष्ट्रीर् उद्यान, आरजक्षत वन, जवरासत स्ट्थल से अंतरराज्र्ीर् सीमा को बनाए रखा िाएगा: • लाल श्रेणी : 500 मीिर स ेआग े • नारंगी श्रेणी : 250 मीिर स ेआग े • हरी श्रेणी : 100 मीिर स ेआग े (िोर/कंपन उत्पन्न करने वाली) मिीनों वाले उद्योगों के जलए) नोि: उपरोि मानिंडों के अलावा, सबं जं धत एसपीसीबी/पीसीसी अपन ेमौिूिा जनर्मों/मानिंडों के अनुसार र्दि राज्र् सरकारों/संघ राज्र् क्षेत्र के संबजधत जवभागों र्ा केंद्र सरकार के संबंजधत जवभागों द्वारा कोई जनर्िाष्ट दकए गए हों, िल जनकार्ों/उपर्ुाि स्ट्थानों से िरूी का पालन करेंगे। iii. उपरोि िरू ी संबंधी मानिंड जविेष आर्थाक क्षेत्रों / िनू घािी / धानुका / ताि-रेपेज़िर्म, अरावली पवातमाला आदि पर लाग ू नहीं होंगे, िहा ं इसे संबंजधत अजधसचू ना के तहत जनधााररत प्रावधानों के अनुसार िाजसत दकर्ा िाएगा। iv. तिीर् जवजनर्मन क्षेत्र (सीआरिेड) जवजनर्मन, आद्राभूजम जनर्म, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 के तहत अजधसूजचत अन्र् अजधसूचनाओं र्ा इनके तहत समर्-समर् पर िारी अन्र् कानूनों/जनर्मों/अजधसूचनाओं के तहत अजधसूजचत पाररजस्ट्थजतकी-संवेिनिील क्षेत्रों, आद्रभा ूजम क्षेत्रों आदि स े संबंजधत गरै -अनुकूल क्षेत्रों र्ा प्रजतबंजधत/जनजषद्ध क्षेत्रों म ें दकसी भी उद्योग को स्ट्थाजपत करन े की अनुमजत नहीं िी िाएगी। v. अन्र् प्रचजलत कानूनों, जनर्मों और जवजनर्मों की प्रर्ोज्र्ता, िहां भी लागू हो, का सत्र्ापन दकर्ा िाएगा और उनका अनपु ालन दकर्ा िाएगा। vi. दकसी भी प्रस्ट्ताजवत स्ट्थल से गिु रने वाल ेप्राकृजतक/तूफानी नाले को बाजधत नहीं दकर्ा िाएगा। vii. समर्-समर् पर र्था संिोजधत पर्ाावरण प्रभाव आकलन (ईआईए) अजधसूचना 2006 के प्रावधानों के अनुसार ईसी की प्रर्ोज्र्ता का सत्र्ापन दकर्ा िाएगा और उसका अनुपालन दकर्ा िाएगा। (घ) स्ट्थल का सत्र्ापन: i. एसपीसीबी/पीसीसी के संबंजधत अजधकारी, िजिर्ों के प्रत्र्ार्ोिन के अनुसार, प्रस्ट्ताजवत स्ट्थल का जनरीक्षण करेंग े तथा स्ट्थान, मानव आवास, ऐजतहाजसक स्ट्मारक और संवेिनिील क्षेत्र, र्दि कोई हो, की वतामान पर्ाावरणीर् जस्ट्थजतर्ों के संबंध म ें प्रस्ट्ताजवत गजतजवजध आरंभ करन े के जलए स्ट्थल की उपर्िु ता का सत्र्ापन करेंगे। ii. आस-पास की पर्ाावरणीर् जस्ट्थजतर्ों को िानने के जलए, तथा आवेिन/प्रस्ट्ताव में प्रस्ट्तुत िानकारी के सत्र्ापन के जलए जनरीक्षण भी दकर्ा िा सकता ह।ै तिनुसार, बोडा/सजमजत के नाजमत अजधकारी को जनणार् लेन े के जलए जवस्ट्ततृ अवलोकन ररपोिा प्रस्ट्तुत की िाएगी। iii. उल्लघं न/गरै -अनुपालन के कारणों को जलजखत रूप में ििा दकर्ा िाना चाजहए तथा जनरीक्षण अजधकारी द्वारा उद्योग को सूजचत दकर्ा िाना चाजहए। (ङ) सीिीई प्रिान करना: सत्र्ापन ररपोिा और नाजमत अजधकारी/सहमजत हते ु सजमजत की जसफाररिों के आधार पर, प्रस्ट्ताजवत गजतजवजधर्ों और स्ट्थल की अवजस्ट्थजत के आधार पर र्था प्रर्ोज्र् सामान्र् ितों और जवजिष्ट ितों के साथ िल अजधजनर्म की धारा 25/26 और वार्ु अजधजनर्म की धारा 21 के तहत इकाई को सीिीई िारी की िाएगी। ।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (च) अत्र्जधक प्रिषू णकारी उद्योगों की 17 श्रजे णर्ों अथाात लुगिी और कागि, आसवनी, चीनी, चमा िोधन उद्योग, जबिली संर्ंत्र, लोहा और इस्ट्पात, सीमेंि, तेल ररफाइनररर्ां, उवारक, क्ट्लोरल क्षार संर्ंत्र, रंग और रंिक मध्र्म इकाइर्ा,ं कीिनािक, िस्ट्ता, तांबा, एल्र्ुमीजनर्म, पेरोकेजमकल्स और फामाा क्षेत्र, तथा साझा अपजिष्ट उपचार संर्ंत्र (सीईिीपी), मलिल िोधन संर्ंत्र (एसिीपी), साझा िवै -जचदकत्सा अपजिष्ट और साझा खतरनाक अपजिष्ट भस्ट्मक को ऑनलाइन सतत अपजिष्ट गुणवत्ता और उत्सिान जनगरानी प्रणाली (ओसीईएमएस) स्ट्थाजपत करनी होगी। (छ) श्वते श्रणे ी: इन्ह ें सीिीई/सीिीओ प्रदक्रर्ा स े छूि िी गई ह।ै हालांदक, श्वेत श्रणे ी के उद्योगों को स्ट्व-घोषणा के आधार पर जनधााररत प्रदक्रर्ा के अनुसार एक बार अनुमजत िारी की िाएगी। अनुमजत के जलए एक मॉडल नमूना अनलु ग्नक II में दिर्ा गर्ा ह।ै नोि : उद्योग को, संचाजलत करने से पहले संबंजधत एसपीसीबी/पीसीसी से उत्पािों र्ा प्रदक्रर्ाओं के जवस्ट्तार/आधुजनकीकरण/पररवतना के मामले म ेंसीिीई भी प्राि करना होगा। 2.2 प्रचालन की सहमजत और इसका नवीकरण प्रिान करन ेके जलए दििाजनिेि उद्योग र्ा प्रदक्रर्ा संर्ंत्र के अपेजक्षत प्रिषू ण जनर्ंत्रण प्रणाजलर्ों के साथ स्ट्थाजपत हो िाने और प्रचालन के जलए तैर्ार हो िान े पर, अजधभोगी को प्रचालन की सहमजत प्राि करनी अपेजक्षत होती ह।ै तिनुसार, िल अजधजनर्म और वार्ु अजधजनर्म के तहत प्रचालन की सहमजत और इसका नवीकरण प्रिान करने संबंधी दििाजनिेि जनम्न प्रकार से ह ैं: 2.2.1 प्रचालन की सहमजत (सीिीओ) : सीिीओ िारी करन े के जलए जनम्नजलजखत प्रदक्रर्ा का अनुसरण दकर्ा िाएगा : क. आवेिक द्वारा सीिीओ आविे न (सामान्र् सहमजत प्रपत्र) से संबंजधत िानकारी, पूवाअपेजक्षत िानकारी/िस्ट्तावेिों के साथ भरी िाएगी। ख. सीिीओ प्राि करने के जलए एसपीसीबी/पीसीसी द्वारा जनधााररत िरों के अनुसार िाजस्ट्त/जवलंब िल्ु क, र्दि कोई जनधााररत हो, के साथ पर्ााि िल्ु क का भगु तान दकर्ा िाएगा। ग. एसपीसीबी/पीसीसी द्वारा िारी सीिीई म ें जनधााररत ितों के अनुपालन संबंधी ररपोिा, अजधभोगी द्वारा दक्रर्ाजन्वत ऑनलाइन सतत बजहस्राव जनगरानी प्रणाली (ओसीईएमएस), र्था लागू, के स्ट्व-जवजनर्मन तंत्र के साथ प्रस्ट्ततु की िाएगी। घ. पर्ाावरणीर् स्ट् वीकृजत म ें और संबंजधत अजधकाररर्ों द्वारा िारी जनधााररत ितों, र्था लाग,ू के अनपु ालन संबंधी ररपोिा प्रस्ट्तुत की िाएगी। ङ. सत्र्ापन : i. एसपीसीबी/पीसीसी का संबंजधत अजधकारी, िजिर्ों के प्रत्र्ार्ोिन के अनुसार, जवजनर्िाष्ि जनस्ट् सरण/उत्सिान/अपजिष्ट प्रबंधन संबंधी मानिडं ों, ओसीईएमएस, आदि का अनुपालन सुजनजित करन े के जलए सीिीई के अनुपालन तथा जवजभन्न संर्ंत्रों और र्ंत्रों, प्रिषू ण जनर्त्रं ण उपकरणों, अपजिष्ट प्रबंधन सुजवधाओं और अन्र् अवसंरनाओं की संस्ट्थापना के संबंध म ें उद्योग का जनरीक्षण और सत्र्ापन करेगा। ii. सीिीई ितों/पर्ाावरणीर् स्ट् वीकृजत की ितों की जनगरानी के अनुपालन की जवस्ट्ततृ ररपोिा, एसपीसीबी/पीसीसी के नाजमत अजधकारी को जनणार् लेन े के जलए प्रस्ट्ततु की िाएगी। जनरीक्षण अजधकारी द्वारा उल्लघं न/अनुपालन न करने के कारणों को जलजखत रूप में ििा करके उद्योग को दिर्ा िाना अपेजक्षत ह।ै च. सीिीओ िारी करना : i. जनरीक्षण ररपोिा और नामोदद्दष्ि अजधकारी/सहमजत संबंधी सजमजत की संस्ट्तुजतर्ों के आधार पर, इकाई को िल अजधजनर्म की धारा 25 एव ं 26 और वार्ु अजधजनर्म की धारा 21 के तहत सीिीओ िारी की िाएगी।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ii. सीिीओ में अपेजक्षत प्रिषू ण जनर्ंत्रण उपार्ों तथा संबंजधत औद्योजगक सेक्ट्ि र और क्षेत्र के जलए पर्ाावरण की सुरक्षा को ध्र्ान में रखत े हुए प्रदक्रर्ा, प्रचालनों, बजह:स्राव जनपिान, पर्ाावरणीर् मानकों, दििा-जनिेिों, स्ट्थल-जनधाारण मानिडं , न् र्ार्ालर् के जनिेिों, अजधसूचना आदि में जभन्नता के आलोक म ेंसामान्र् ितें और संगत जवजिष्ट ित ें समाजवष्ि होंगी। छ. इकाई को समर्-समर् पर र्था जनणीत उद्योग की श्रणे ी के आधार पर दकसी जवजिष्ट अवजध के जलए िल अजधजनर्म की धारा 25/26 और वार्ु अजधजनर्म की धारा 21 के तहत सीिीओ िारी की िाएगी। ि. एसपीसीबी/पीसीसी द्वारा लाल, नारंगी और हरी श्रेणी के उद्योगों के अनुपालन की जनगरानी तथा उनके नमून े लेन े की आवृजत्त, क्रमिैः अधावार्षाक, वार्षाक और िो (02) वषों में एक बार होगी। 2.2.2 नवीकरण हते ुसहमजत सीिीओ के नवीकरण के जलए जनम्नजलजखत प्रदक्रर्ा का अनुसरण दकर्ा िाएगा : क. जपछल े सीिीओ म ें जनधााररत ितों/बैंक गारंिी की ितों (र्दि कोई हो)/समर्बद्ध अनुपालन के जलए सीपीसीबी/संबंजधत एसपीसीबी/पीसीसी द्वारा िारी जनिेिों (र्दि कोई हों) के अनपु ालन की जस्ट्थजत का अवलोकन दकर्ा िाएगा। ख. पर्ाावरण (संरक्षण) जनर्म, 1986 के अनुसार पर्ाावरणीर् जववरण (प्रपत्र V) तथा खतरनाक और अन्र् अपजिष्ट (प्रबंधन और सीमापारीर् संचलन) जनर्म, 2016 के अनुसार वार्षाक जववरणी (प्रपत्र-4) का प्रस्ट्तुतीकरण सुजनजित दकर्ा िाएगा। ग. जवजनमााण प्रदक्रर्ा, उत्पािन क्षमता, प्रिषू ण भार, मात्रा, और बजह:स्राव और उत्सिानों के जनस्ट् सरण के तरीके में पररवतान न करन े संबधी उद्घोषणा प्राि और सुजनजित की िाएगी। घ. एसपीसीबी/पीसीसी का संबंजधत अजधकारी, िजिर्ों के प्रत्र्ार्ोिन के अनुसार, उद्योगों में िल के उपभोग और अपजिष्ट िल प्रबंधन के संबंध में सगं त ररकॉडा के सत्र्ापन, बजहस्राव िोधन संर्ंत्रों (ईिीपी)/वार्ु प्रिषू ण जनर्ंत्रण उपकरणों (एपीसीडी) के प्रचालन, खतरनाक अपजिष्ि ों के उत् सिान और जनपिान के अजभलेखों, ओसीईएमएस के कार्ाकरण और इसके डेिा लॉलगगं , स्रोत पर उत्सिान और बजह:स्राव जनस्ट् सरण के जवजनर्िाष् ि मानकों से अजधक होने का ररकॉडा रखने, लोक/वीआईपी जिकार्तों का जनराकरण करने आदि सजहत सीिीओ की ितों का अनपु ालन सत्र्ाजपत करेगा और जनणार् हते ु बोडा/सजमजत के नामोदद्दष्ि अजधकारी को जवस्ट्तृत अवलोकन ररपोिा प्रस्ट्ततु करेगा। ङ. की गई अनपु ालन संबंधी जनगरानी और जलए गए नमूने के अनुसार बजह:स्राव और उत्सिान जनस्ट्सरण संबंधी मानिंडों का अनुपालन न होने के मामले म ें संबंजधत अजधकारी द्वारा प्रिषू कों/उत्सिानों (रासार्जनक अजभदक्रर्ा/सामग्री संतलु न) का जववरण, ईिीपी और एपीसीडी/प्रणाली के जडिाइन और प्रचालन संबंधी ितों का ब्र्ौरा सत्र्ाजपत दकर्ा िाएगा और सहमजत का नवीकरण करत े समर् जनधााररत मानिंडों को पूरा करन े के जलए पर्ाावरणीर् प्रबंधन प्रणाजलर्ों के उन्नर्न/आिोधन को िाजमल दकर्ा िाना अपेजक्षत होगा। च. उल्लघं न करन/े अनपु ालन न करने के कारणों को अजभजलजखत दकर्ा िाना अपेजक्षत ह।ै जनरीक्षण ररपोिा म ें अनुपालन की जनगरानी संबंधी अभ् र्ुजिर्ों, अजभलेखों के जनष्कषों और सहमजत संबंधी ितों के अनुपालन पर उनके जवचारों को अजभजलजखत दकर्ा िाएगा। जनरीक्षण ररपोिा के आधार पर, जनणार् लने े वाला प्राजधकारी, संजवजध में र्था जवचाररत समुजचत कारावाई आरंभ करेगा। छ. समर्-समर् र्था जनणीत उद्योग की श्रेणी के आधार पर दकसी जवजिष्ट अवजध के जलए िल अजधजनर्म की धारा 25/26 और वार्ु अजधजनर्म की धारा 21 के तहत इकाई की सीिीओ का नवीकरण दकर्ा िाएगा। ि. उद्योगों के जनरीक्षण को कम करने के जलए, एसपीसीबी/पीसीसी द्वारा लाल, नारंगी और हरी श्रेणी के उद्योगों के अनुपालन की जनगरानी तथा उनके नमून े लने े की आवृजत्त क्रमिैः अधावार्षाक, वार्षाक और िो (02) वषों में एक बार होगी।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 2.3 सहमजत को अस्ट्व ीकार और रद्द करन ेसबं धं ी दििाजनिेि एसपीसीबी/पीसीसी द्वारा लगाई गई सहमजत संबंधी ितों का पालन न करन े के जलए िल अजधजनर्म की धारा 27 और वार्ु अजधजनर्म की धारा 21 के अनुसार सहमजत को अस्ट्व ीकार र्ा रद्द दकर्ा/ वापस जलर्ा (जितनी अवजध के जलए इस े प्रिान दकर्ा िाता ह ैउसकी समाजि से पहल े र्ा उक्ट्त अवजध की समाजि के बाि आग े की अवजध के जलए सहमजत को अस्ट् वीकार करना) िाता ह।ै जनम्नजलजखत कारणों से सहमजत की अस्ट् वीकृजत लाग ू की िाती ह/ैइस पर जवचार दकर्ा िा सकता ह ै: क) स्ट्थल-जनधारा ण मानिडं का उल्लंघन करना, उद्योग सीिीई के मामल े में केन्द्र/राज्र् के स्ट्थ ल-जनधाारण संबंधी मानिंडों को परू ा नहीं करता ह।ै ख) सहमजत और पर्ाावरणीर् स्ट् वीकृजत की ितों का अनपु ालन न करना। ग) उनकी प्रदक्रर्ा और इसके प्रचालन में जभन्नता। घ) बजहैःस्राव जनपिान/उत्सिान मानकों को पूरा नहीं करना और ईिीपी/एपीसीडी/अस्ट्थ ार्ी उत्सिान जनर्ंत्रण प्रणाली र्ा दकसी अन्र् जवजनर्िष्ा ि उपकरण को उन् नत करने म ेंजवफलता। ङ) न्र्ार्ालर् के जनिेिों, दििाजनिेिों तथा अजधसूचनाओं और मानक प्रचालन प्रदक्रर्ाओं (एसओपी) का पालन न करना। च) पर्ाावरण और मानव स्ट्वास्ट््र् को गंभीर क्षजत पहुचं ान े वाला बजह:स्राव/उत्सिान का िघु ािनावि जनस्ट् सरण होना। छ) िघु ािना होन े के पररणामस्ट्वरूप मौिूिा ईिीपी/एपीसीडी प्रणाजलर्ों को क्षजत पहुचं ना। ि) सीपीसीबी और संबंजधत एसपीसीबी/पीसीसी द्वारा अजधरोजपत अपेजक्षत सहमजत िुल्क, पर्ाावरणीर् मुआविा/जवलंब िल्ु क/बैंक गारंिी का भुगतान न करना। झ) केंद्रीर्/राज्र् सरकार द्वारा अजधसूजचत प्रजतबंजधत क्षेत्रों म ेंप्रस्ट्ताजवत उद्योग। ञ) अधूरी िानकारी र्ा गलत िानकारी प्रस्ट्तुत करना र्ा प्रस्ट्ताजवत संर्ंत्र स े संबंजधत कोई भी महत् वपणू ा त्र् जछपाना। ि) दकसी भी मौिूिा जनर्म/जवजनर्म का उल्लंघन। सहमजत प्रिान करने संबंधी दकसी भी आवेिन को सुनवाई का अवसर दिए जबना अस्ट्वीकार नहीं दकर्ा िाएगा और अस्ट् वीकार करन े के कारणों को जलजखत रूप म ें िि ा दकर्ा िाएगा तथा आवश्र्क जनिेिों, िो भी उजचत हों, के साथ आवेिक को जवजधवत सूजचत दकर्ा िाएगा। 3.0 सहमजत सबं धं ी आविे नों के प्रक्रमण हते ुसमर्-सीमा : 3.1 िल अजधजनर्म और वार्ु अजधजनर्म में कार्ाकलापों/उद्योगों द्वारा स्ट्थापना/प्रचालन के जलए सहमजत प्राि करने का उपबंध दकर्ा गर्ा ह।ै संिोजधत वार्ु और िल अजधजनर्म के उपबंधों के अधीन, सहमजतर्ां िारी करन े की समर्-सीमा इस पैरा द्वारा िाजसत होगी। 3.2 एसपीसीबी/पीसीसी द्वारा स्ट्थापना के जलए सहमजत, प्रचालन के जलए सहमजत, सहमजत के नवीकरण, जवस्ट्तार संबंधी कार्ाकलापों के जलए सहमजत, संिोधन, सहमजत के जवस्ट्तार संबंधी आिेि िारी करने भीतर प्रिान र्ा अस्ट्वीकार की िाएगी। 3.4 एसपीसीबी/पीसीसी के उपरोि समर्-सीमा के भीतर सहमजत प्रिान र्ा अस्ट्वीकार करन े में जवफल रहने के मामल े में आवेिन, नीचे पैरा 5.2 म ें संिर्भात राज्र् स्ट्तरीर् जनगरानी सजमजत (एसएलएमसी) को प्रस्ट्तुत दकर्ा िाएगा। र्ह सजमजत, ऐसे प्रस्ट् तुतीकरण के 30 दिनों, र्ा वार्ु और िल अजधजनर्मों म ें उपबंजधत समग्र सीमा, िो भी पहल े हो, के भीतर आवेिन का जनपिान करेगी। संबंजधत एसपीसीबी/पीसीसी के सिस्ट्र् सजचव, सजमजत के समक्ष उक्ट्त मामले को प्रस्ट्तुत करेंगे। 3.5 ऐसे आवेिन के संबंध म ें जनणार् लेत े समर् सजमजत, एसपीसीबी/पीसीसी द्वारा सहमजत प्रिान/अस्ट् वीकार करने म ें हुए जवलंब के कारणों को भी ध्र् ान में रखगे ी। र्दि र्ह पार्ा िाता ह ै दक जवलंब के कारण औजचत् र्सम् मत नहीं ह,ैं तो सजमजत एसपीसीबी/पीसीसी के उत् तरिार्ी अजधकारी (अजधकाररर्ों) के जवरुद्ध समुजचत अनुिासनात्मक कारावाई की जसफाररि कर सकती ह।ै सजमजत, वार्ु/िल अजधजनर्म के उल्लघं न के मामल े को िल अजधजनर्म की धारा 48(2) और वार्ु अजधजनर्म की धारा 38क(2) के तहत संबंजधत न् र्ार्जनणाार्क अजधकारी के समक्ष प्रस्ट्तुत करने की जसफाररि कर सकती ह।ै 3.6 सजमजत का जनणार् सबं ंजधत एसपीसीबी/पीसीसी पर बाध्र्कारी होगा। सजमजत की एक माह की अवजध म ें कम स े कम एक बैठक होगी। 3.7 उपरोक्ट्त सजमजत इन दििा-जनिेिों के अनुपालन के सबं ंध में एसपीसीबी/पीसीसी की जनगरानी भी करेगी और िहा ं भी अपेजक्षत होगा, उजचत कारावाई करेगी। 3.8 सहमजत तंत्र के संबंध में एसपीसीबी/पीसीसी द्वारा बनाई गई कोई भी नीजत, इन दििाजनिेिों के अध् र्धीन होगी। 4.0. इन दििाजनिेिों के कार्ान्ा वर्न हते ुपोिला : 4.1 एसपीसीबी/पीसीसी के परामिा स े सीपीसीबी, इन दििाजनिेिों के दक्रर्ान्वर्न के जलए अजधमानतैः छह (06) महीनों के भीतर और इस अजधसूचना की तारीख से एक (01) वषा से पूवा एक ऑनलाइन पोिाल जवकजसत करेगा। 4.2 र्ह पोिाल, सभी जहतधारकों के बीच अनन् र् इंिरफेस होगा और इसका उपर्ोग िल अजधजनर्म और वार् ु अजधजनर्म के तहत सीिीई/सीिीओ प्रिान करने, अस्ट्वीकार करन े और वापस लेने, प्रदक्रर्ा की जनगरानी तथा एसएलएमसी द्वारा उनके समक्ष प्रस्ट्ततु मामलों के जनपिान के जलए दकर्ा िाएगा। 4.3 र्ह पोिाल, इन दििाजनििे ों के प्रबंधन और दक्रर्ान्वर्न के संबधं में एकल लबंि ुडेिा सग्रं ह के रूप म ेंकार्ा करेगा। 4.4 िब तक अन्र्था उपबंजधत न हो, सभी राज्र्ों/संघ राज्र् क्षेत्रों म ें वार्ु और िल अजधजनर्म के संबंध म ें सीिीई/सीिीओ से संबंजधत सभी पद्धजतर्ां और प्रदक्रर्ाएं, केवल इस पोिाल के माध्र्म से की िाएंगी। तथाजप, िब तक पोिाल प्रचालनात् मक नहीं हो िाता, सीिीई/सीिीओ के जलए आवेिनों के प्रक्रमण हते ु वैकजल्पक तरीके का उपर्ोग दकर्ा िा सकता ह।ै 5.0 जनगरानी सजमजतर्ा ं: 5.1 इन दििा-जनििे ों के दक्रर्ान्वर्न का पर्ावेक्षण और जनगरानी करने तथा इस संबंध में आने वाली दकसी भी करठनाई को िरू करने के जलए राष्ट्रीर् स्ट्तर पर एक जनगरानी सजमजत होगी। इस सजमजत में नारंगी और हरे रंग की श्रेणी के उद्योगों के जलए सहमजत िल्ु क सग्रं ह क्रमिैः 5, 10 और 15 वषों की अवजध के जलए होगा, िैसा दक सीपीसीबी द्वारा औद्योजगक क्षेत्रों के वगीकरण के िस्ट्तावे़ि में अनुिंजसत दकर्ा गर्ा ह।ै ग) औद्योजगक क्षत्रे ों के जलए सहमजत िल्ु क: सहमजत िुल्क का आकलन केवल पूंिी जनवेि और उद्योग के वगीकरण के आधार पर दकर्ा िाता ह।ै तिनुसार, उद्योग के जलए वार्षाक सहमजत िल्ु क (सीएफ) का आकलन करने का सूत्र इस प्रकार ह:ै सीएफ = सीआई * एसएफ * पीआईएफ िहााँ • सीएफ : वार्षाक सहमजत िुल्क (रु./वष ा में) • सीआई : पूंिी जनवेि (रु. म)ें • एसएफ : स्ट्केल फैक्ट्िर (सीआई पर आधाररत) • पीआईएफ : प्रिषू ण ह:ै सहमजत िल्ु क (सीएफ): जपछल ेस्ट्लबै का अजधकतम िल्ु क + {(सीआई का अतं र)*एसएफ*पीआईएफ} संबंजधत क्षेत्र में पूंिी जनवेि के प्रत्र्ेक स्ट्लैब पर न्र्ूनतम सहमजत िल्ु क रखन े की भी अनिु ंसा की गई है, क्ट्र्ोंदक उच्च जनवेि पर स्ट्केल फैक्ट्िर कम हो िाता ह।ै तिनुसार, इसके ऊपर न्र्ूनतम सहमजत िुल्क र्ानी मूल िुल्क 5,000 रुपर् े प्रजत वषा और पीआईएफ फैक्ट्िर औद्योजगक क्षेत्र की श्रणे ी के अनुसार ऊपर लागू होगा। (हरा: 1, नारंगी: 1.5 और लाल: 2)। घ) स्ट्थानीर् जनकार्ों और अवसरं चनात्मक पररर्ोिनाओं (आवासीर् और अन्र्) के जलए सहमजत िल्ु क: ईआईए के अंतगात आने वाली अवसंरचनात्मक पररर्ोिनाओं िैसे आवासीर् के बाविूि आद्रा और िष्ु क पलल्पगं के जलए केवल मलू िल्ु क और पलल्पगं फैक्ट्िर रखन े का सुझाव दिर्ा िाता है, क्ट्र्ोंदक र्ह एक मौसमी उत्पािन ह।ै तिनुसार, पलल्पगं उद्योग के जलए वार्षाक सहमजत िुल्क (सीएफ) के आकलन का सूत्र इस प्रकार ह:ै सीएफ = बीएफ * पीएफ िहााँ, • सीएफ: वार्षाक सहमजत िल्ु क (रु./वषा में) • बीएफ: मलू िल्ु क (रु. म)ें • पीएफ: पलल्पगं फैक्ट्िर (पलल्पगं के प्रकार के आधार पर) तिनुसार, 2000 रूपए 4 > 1 MVA 5000 रूपए झ) सहमजत के नवीकरण के जलए छूि और जवलबं िल्ु क: िल एवं वार् ु अजधजनर्म के तहत 120 दिनों के जनधााररत समर् के भीतर सहमजत नवीनीकरण हते ु आवेिन प्रस्ट्ततु करने पर उद्योग को सहमजत िल्ु क पर 5% की छूि प्रिान की िाएगी। इसके अलावा, िेरी से प्रस्ट्तुत करने और सहमजत की समाजि के जलए क्रमिैः जवलंब िुल्क लगाने/ बंि करने के जनिेि िारी करन े की जसफाररि की िाती ह।ै इसे िेखते हुए, उद्योगों द्वारा सहमजत नवीनीकरण हते ु आवेिन पत्र अंजतम समर् में प्रस्ट्तुत करने स े बचन े और उद्योग को इस संबंध म ें अजधक सतका रहन ेके जलए जनम्नजलजखत जवलंब िुल्क लगान े की अनुिंसा की िाती ह:ै नवीकरण के जलए आविे न प्रस्ट्ततु करन ेकी अवजध जवलम्ब िल्ु क के रूप म ेंअजतररि िल्ु क सहमजत की अवजध समाि होन ेके 120दिन पूव ा न् र्नू तम (-) 5% सहमजत की समाजि के 120स े 45 दिनों के बीच 25% सहमजत की समाजि जतजथ से 45दिनों के बीच 50% सहमजत की समाजि जतजथ के बाि जवद्युत आपूर्ता बंि करने के जलए नोरिस िेना तथा उसके बाि नवीनीकरण हते ु आवेिन को एक वषा के जलए %100अजतररि सहमजत िल्ु क के साथ नए आवेिन के रूप म ेंमाना िाएगा। ण) उद्योग को प्रोत्साहन: िल, वार्ु और भूजम प्रिषू ण को कम करने के जलए पर्ाावरण सरं क्षण उपार्ों को अपनाने वाले, प्राकृजतक संसाधनों के संरक्षण (उत्पािन की प्रजत इकाई में संसाधन की खपत) और सवोत्तम प्रौद्योजगदकर्ों, स्ट्वछछ प्रौद्योजगकी का उपर्ोग करके पर्ाावरण की रक्षा के जलए एसपीसीबी/पीसीसी के जनिेिों/सहभाजगता के जबना स्ट्वैजछछक पहल, राष्ट्रीर्/स्ट्थान जवजिष्ट मानकों को जनचल े स्ट्तर तक लान े की उपलजब्ध हाजसल करने वाल े उद्योगों की पहचान की िाएगी और तिनुसार ग्रीन पुरस्ट्कार, नकि परु स्ट्कार के रूप में प्रोत्साहन दिर्ा िाएगा। ि) सहमजत िल्ु क म ेंसिं ोधन: कई वषों से एसपीसीबी/पीसीसी द्वारा सहमजत िल्ु क म ें सिं ोधन नहीं दकर्ा गर्ा है, जिसके पररणामस्ट्वरूप रािस्ट्व हाजन हुई ह।ै इस े िेखत े हुए, भारत सरकार द्वारा प्रत्र्ेक पााँच वष ा म ें एक बार समर्-समर् पर िारी दकए िान े वाल े थोक मूल्र् सूचकांक (डब्ल्र्ूपीआई)/उपभोिा मूल्र् सूचकांक (सीपीआई)/आरबीआई लक्ष्र् मद्रु ास्ट्फीजत के संिभा में वार्षाक वृजद्ध िर के आधार पर सहमजत िल्ु क म ें संिोधन करने का प्रस्ट्ताव है, जिसके जलए नीच े दिए गए सूत्र का उपर्ोग दकर्ा िाएगा: संिोजधत सहमजत िल्ु क = मौििू ा सहमजत िल्ु क * (िुल्क में 1 + % की वृजद्ध) उपरोि सभी पहलओंु पर जवचार करत े हुए, एसपीसीबी/पीसीसी द्वारा प्रत्र्ेक पांच वष ा में एक बार सहमजत िुल्क में 20 प्रजतित की वृजद्ध करन ेकी अनुिंसा की गई ह।ै ठ) ईपीए के जवजभन्न जनर्मों के अतं गता प्राजधकार प्रिान करना: वे गजतजवजधर्ााँ िो िल एवं वार्ु अजधजनर्मों के अतं गता नहीं आती हैं, लेदकन उन्ह ें पर्ाावरण (सरं क्षण) अजधजनर्म 1986 के अतं गता अजधसूजचत जवजभन्न जनर्मों के अतं गात प्राजधकार प्राि करना आवश्र्क है, एसपीसीबी/पीसीसी उन्ह ें 5 वषों के जलए प्राजधकार िारी करन े पर जवचार कर सकते ह ैंऔर प्राजधकार िारी करन े के जलए “प्रिासजनक िल्ु क” के[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 25 रूप में 10,000/प्राजधकार वसूलने की अनिु ंसा कर सकते ह।ैं इस िुल्क को वसूलने के जलए राज्र् सरकार द्वारा इसे अजधसूजचत दकर्ा िा सकता ह ैक्ट्र्ोंदक ईपीए के अतं गता अजधसूजचत जनर्मों के अंतगात ऐसा कोई प्रावधान नहीं ह।ै एसपीसीबी/पीसीसी पर्ाावरण (संरक्षण) अजधजनर्म, 1986 के तहत अजधसूजचत जवजभन्न जनर्मों के तहत आवश्र्कतानुसार प्राजधकार के साथ समेदकत सहमजत (िल और वार्ु) िारी कर सकत े ह।ैं इसके अलावा, िहा ं सीिीओ के साथ प्राजधकार िारी करना आवश्र्क है, वहां आकजलत सहमजत िल्ु क म ें1.1 का फैक्ट्िर (b) In the case of an industry operating on lease land and / or building or any other assets, ten (10) times the annual lease value is to be taken as equivalent to Capital Investment (or) Guidance Value of property / land, whichever is higher. 1.2 Validity period of Consent to Establish & its Consent fee (a) The validity period of Consent to Establish (CTE) shall be as per the Environment Clearance (EC) issued by the Ministry of Environment, Forest and Climate Change (MoEF&CC) / State Environment Impact Assessment Authority (SEIAA) in case of a project attracting prior Environment Clearance. (b) In case the project / activity does not attract EC, then CTE shall be given for a minimum of five (05) years period initially and may be further extended by a maximum period of two (02) years on request of the project proponent, thereby making the outer limit for validity seven (07) years from the issue of CTE. (c) The consent fee for CTE shall be twice the Annual Consent fee under the Water Act and / or Air Act, as applicable to the project activities for the entire period of establishment of the project. 1.3 Estimation of Consent fee for various activities The capital investment slabs, categorization of industry, consent fee for industrial sectors, local bodies, mining projects, coffee pulping, aqua culture and Diesel Generator (DG) set as single air pollution source, rebate & late fee for renewal of consent, incentives to the industry, revision of consent fee and authorization fee, are given as Appendix. 1.4 Higher Consent fee by SPCBs / PCCs SPCBs / PCCs may decide the quantum of consent fee which may be maximum up to 20% higher than the estimated consent fee based on the methodology suggested in this guideline, taking into account local environmental issues and local conditions. However, SPCBs / PCCs can charge any consent fee lower than that. 1.5 Common Consent and Authorization Form SPCBs / PCCs shall adopt a single-step procedure for issuing Common Consent and Authorization (CC&A) under the Water Act, the Air Act and Authorization under the EPA Rules. Accordingly, a model template for Common Consent and Authorization form is given at Annexure I. 2.0 GUIDELINES RELATING TO GRANT, REFUSAL OR CANCELLATION OF CONSENT : 2.1 Guidelines for grant of Consent to Establish (CTE) (a) Information related to the CTE application (common consent form) shall be filled up by the applicant with prerequisite information / documents as per the procedures specified.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 27 (b) Adequate fees prescribed for obtaining CTE shall be paid along with the application online / offline as per the rates prescribed by the State Government / UT. (c) Siting Criteria: i. The industrial establishment shall comply with the sector-specific siting criteria of the Central / State / UT as applicable, orders passed by the Hon’ble National Green Tribunal (NGT) / Courts, and Guidelines issued in compliance with such orders / rules issued by MoEF&CC / CPCB / SPCB / PCC. ii. In case of non-availability of sector specific siting criteria, the General Guidelines framed by the respective State / UT shall be followed, otherwise, the following criteria (minimum distance) shall be maintained a) From the nearest boundary of surface water body (flood plain/ HFL / Red line) as per the revenue sketch: • Red Category : Beyond 500 meters • Orange Category : ✓ With effluent generation : Beyond 75 meters ✓ Without effluent generation : Beyond 30 meters • Green Category : Beyond 30 meters b) From the Settlement, Educational Institute, Worship place, Archaeological Monuments, National Park, Reserve Forest, Heritage site, interstate boundary shall be maintained: • Red Category : Beyond 500 meters • Orange Category : Beyond 250 meters • Green Category : Beyond 100 meters (Having noise/vibration generating machineries) Note: Other than the above criteria, the respective SPCB /PCC shall follow the distance from the water bodies / above-mentioned places, as per their existing rules / norms if any specified by the concerned departments of State Governments / UT or Central Govt. Department. iii. The above distance criteria shall not be applicable to Special Economic Zones / Doon Valley / Dhanuka / Taj–Trapezium, Aravalli Range, etc. where it shall be governed as per provisions laid down under the respective notification. iv. No industry will be allowed to set up in non-conforming areas or restricted / prohibited areas pertaining to Eco-Sensitive Areas, Wetland areas, etc. as notified under Coastal Regulation Zone (CRZ) Regulations, Wet Land Rules, other notifications notified under the Environment (Protection) Act, 1986 or other laws / rules / notifications issued therein from time to time. v. Applicability of other prevalent laws, rules, and regulations, as applicable shall be verified and complied with. vi. The natural / storm drain passing through any proposed site shall not be disturbed. vii. The applicability of EC as per the provisions of Environmental Impact Assessment (EIA) Notification 2006, as amended from time to time, shall be verified and complied with. (d) Site verification: i. The respective officer of SPCB / PCC, as per the delegation of power, shall conduct inspection of the proposed site and verify the suitability of the site for establishing proposed activity with respect to present environmental conditions of location, human habitation, historical monument, and sensitive area, if any. ii. Inspection may also be carried out to capture surrounding environmental settings, and verification of information submitted in the application / proposals. Accordingly, the detailed observations report will be submitted to the designated officer of the Board / Committee for taking decision. iii. The reasons for violations / non compliances are to be recorded in writing and communicated to the industry by the inspecting officer.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (e) Grant of CTE: Based on the verification report and recommendations of the designated officer / consent committee, CTE shall be issued to the unit under Section 25 / 26 of the Water Act and under Section 21 of the Air Act, along with general conditions and specific conditions, as applicable based on the proposed activities and site location. (f) 17 categories of Highly Polluting Industries i.e. Pulp & Paper, Distillery, Sugar, Tanneries, Power Plants, Iron & Steel, Cement, Oil Refineries, Fertilizer, Chloral Alkali Plants, Dye & Dye Intermediate Units, Pesticides, Zinc, Copper, Aluminum, Petrochemicals, and Pharma Sector, and Common Effluent Treatment Plants (CETP), Sewage Treatment Plants (STPs), Common Bio-Medical Waste and Common Hazardous Waste Incinerators will have to install Online Continuous Effluent Quality and Emission Monitoring Systems (OCEMS). (g) White Category: These are exempt from CTE/CTO procedure. However, One-time endorsement shall be issued to the White Category Industries based on self-declaration, as per the procedure laid down. A model template for endorsement is given in Annexure II. Note: The industry shall also obtain CTE in case of expansion / modernization / change of products or processes from the respective SPCB /PCC before commissioning. 2.2 Guidelines for Grant of Consent to Operate & its Renewal Once the industry or process plant is established with the requisite pollution control systems and ready to operate, the occupier is required to obtain Consent to Operate. Accordingly, the guidelines for Grant of Consent to Operate & its Renewal under the Water Act and Air Act are as follows: 2.2.1 Consent to Operate (CTO): The following procedure shall be followed for issue of CTO: a. Information related to the CTO application (common consent form) shall be filled up by the applicant with prerequisite information / documents. b. Adequate fees along with penalty / late fee, if any prescribed for obtaining CTO shall be paid as per the rates prescribed by the SPCB / PCC. c. Compliance with the conditions stipulated in CTE issued by the SPCB / PCC shall be submitted along with the self-regulation mechanism Online Continuous Effluent Monitoring System (OCEMS) implemented by the occupier, as applicable. d. Compliance with the conditions stipulated in EC as applicable and issued by the concerned authorities shall be submitted. e. Verification : i. The respective officer of SPCB / PCC, as per delegation of power, shall inspect and verify the industry w.r.t. compliance of CTE and installations of various plants & machineries, pollution control devices, waste management facilities and other infrastructures required to ensure compliance of stipulated discharge / emission / waste management norms, OCEMS, etc. ii. The detailed report of compliance of monitoring with CTE conditions / EC conditions will be submitted to the designated officer of the SPCB / PCC for taking a decision. The reasons of violations / non-compliances are to be recorded in writing to the industry by the inspecting officer. f. Issue of CTO : i. Based on the inspection report and recommendations of the designated officer / consent committee, CTO shall be issued to the Unit under Section 25 &26 of the Water Act and under Section 21 of the Air Act. ii. The CTO will contain general conditions and relevant specific conditions in view of variation in process, operations, effluent disposal, environment standards, guidelines, siting criteria, court directions, notification, etc. taking into account required pollution control measures and safeguard of environment for respective industrial sector and area. g. CTO shall be issued to the Unit under Section 25/26 of the Water Act and under Section 21 of the Air Act, for a specific period based on the category of industry, as decided from time to time. h. The frequency of compliance monitoring and sampling of the Red, Orange and Green category industry shall be half yearly, annually, and once in two (02) years respectively by the SPCBs / PCCs.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 29 2.2.2 Consent for Renewal: The following procedure shall be followed for renewal of CTO: a. Compliance status to the conditions stipulated in previous CTO / Conditions of Bank Guarantee (if any) / Directions (if any) issued by CPCB / respective SPCB / PCC for time-bound compliance shall be observed. b. Submission of Environmental Statement (Form V) as per Environment (Protection) Rules, 1986 and Annual Returns (Form- 4) as per the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 shall be ensured. c. Declaration on no Change in the Manufacturing Process, Production capacity Pollution Load, Quantity, and mode of discharge of effluent and emissions shall be obtained and ensured. d. The respective officer of SPCB / PCC, as per delegation of power, shall verify the industry w.r.t. compliance of CTO conditions which includes verification of relevant records on water consumption and waste water management, operation of Effluent Treatment Plants (ETP) / Air Pollution Control Devices (APCD), Records of generation and disposal of hazardous wastes, functioning of OCEMS and its data logging, record of exceedance of stipulated standards of source emission and effluent discharge, addressing Public / VIP complaints etc. and submit the detailed observations report to the designated officer of the Board / Committee for taking decision. e. In case of non-compliance of effluent and emission discharge norms as per the compliance monitoring and sampling carried out, the details of pollutants / emissions (chemical reaction / material balance), design and operating conditions of ETPs and APCDs / System to be verified by the respective officer and upgradation / modification of environmental management systems required to be incorporated while renewing consent to meet the norms prescribed. f. The reasons for violations / non-compliances to be recorded. The inspection report shall record, the observations of the compliance monitoring, findings of the records and his / her view on the compliance of consent conditions. Based on the inspection report, the decision-making authority will initiate appropriate action as contemplated in the statute. g. CTO will be renewed to the Unit under Section 25/26 of the Water Act and under Section 21 of the Air Act, for a specific period based on the category of industry, as decided from time to time. h. In order to minimize inspection of industries, the frequency of compliance monitoring and sampling of the Red, Orange and Green category industry shall be half yearly, annually, and once in two (02) years respectively by the SPCBs / PCCs. 2.3 Guidelines for Refusal and Cancellation of Consent Refusal or Cancellation / Withdrawal of consent (before the expiry of the period for which it is granted or refusing further consent after such expiry) is done as per Section 27 of the Water Act and Section 21 of the Air Act, for non-compliance with consent conditions imposed by the SPCB / PCC. The refusal of consent may be effected /considered for the following reasons: a) Violation of siting criteria, the industry does not satisfy the sitting criteria of the Central / State in the case of CTE. b) Non-compliance of Consent and EC conditions. c) Variation in their process and its operations. d) Not meeting the effluent disposal / emission standards and failure to upgrade the ETP / APCDs / Fugitive Emission Control Systems or any other prescribed equipment. e) Non-compliance of Court directions, Guidelines, and Notifications and Standard Operating Procedures (SOPs) f) Accidental discharges of effluent / emission causing grave injury to the environment and human health. g) Occurrence of accident resulting in damage to the existing ETP / APCD systems. h) Non-payment of requisite consent fee, Environmental Compensation / Late fee / Bank Guarantee imposed by the CPCB and respective SPCB / PCC. i) Industries proposed in the ban areas notified by the Central / State Government. j) Submission of incomplete information or false information or concealment of any material facts pertaining to the proposed plant.30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] k) Violation of any prevailing rules/regulations. No application for grant of consent will be refused without giving an opportunity of being heard and the reasons for refusal recorded in writing and duly communicated to the applicant with necessary directions, as deemed fit. 3.0 TIMELINE FOR PROCESSING OF CONSENT APPLICATIONS: 3.1 The Water Act and the Air Act provide for obtaining Consent to Establish / Operate by Activities / Industries. Subject to the provisions of the amended Air and Water Act, the timeline for issuing consents will be governed by this para. 3.2 The maximum time limit for processing of the applications received from the date of receipt in all respects for issue of consent to establish, consent to operate, renewal of consent, consent for expansion activity, amendment, extension of consent by the SPCB/PCC will be as follows: Timeline for issue of Consent Time Line (Days)* S. This Committee shall dispose of the application within 30 days of such presentation, or the overall limit provided in the Air and Water Acts, whichever is earlier. The Member Secretary of the concerned SPCB / PCC will present the case before the Committee. 3.5 While deciding on such application, the committee will also look into causes of delay in grant / refusal of the consent by SPCB / PCC. If it is found that the reasons of delay are not justified, the Committee may recommend appropriate disciplinary action against the responsible officer(s) of the SPCB / PCC. The Committee may also recommend presenting the case for contravention of the Air / Water Act before concerned adjudicating officer under Section 48 (2) of the Water Act and Section 38 A (2) of the Air Act, as amended. 3.6 The decision of the Committee shall be binding on the concerned SPCB / PCC. The Committee will have at least one meeting in a month’s period. 3.7 The above committee will also monitor the SPCBs / PCCs with regard to adherence of these guidelines and take appropriate action wherever required. 3.8 Any policies framed by SPCBs / PCCs regarding consent mechanisms will be subject to these guidelines. 4.0. Portal for implementation of these guidelines: 4.1. CPCB, in consultation with SPCBs / PCCs, develop an online portal for implementation of these guidelines, preferably within six (06) months, and not later than one (01) year from the date of this notification. 4.2 The portal will be exclusive interface between all the stakeholders and will be used for grant, refusal and withdrawal of CTE / CTO under the Water Act and Air Act, monitoring the process and by SLMC for disposal of cases presented before them. 4.3 The portal shall act as single point data repository with respect to management and implementation of these guidelines. 4.4 Unless otherwise provided, all the procedures and processes pertaining to CTE / CTO in respect of the Air and Water Act will be done through this portal only, in all the States / UTs. However, until the portal becomes operational, the alternative mode may be used for processing the applications for CTE / CTO. 5.0 Monitoring Committees:[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 31 5.1 There will be a Monitoring Committee at the National Level to oversee and monitor the implementation of these guidelines and remove any difficulties in this regard. In view of this, it is recommended to impose the following late fee, to avoid last minute submission of a consent renewal application by Industries and also to be more watchful by the industry. Period of applying for Renewal Additional Fee as Late fee Before 120 days of expiry of consent Minus (-) 5% Between 120 – 45 days of expiry of consent 25% Between 45 days to till the date of expiry 50% After expiry date of consent Closure Notice for disconnection of power supply and subsequent application for renewal shall be treated as new application with 100% extra consent fee for one year. j) Incentives to the Industry: The industries adopting Environmental Conservative measures to reduce water, air and land pollutions, conservation of natural resources (resource consumption per unit production) and voluntary initiatives without SPCBs / PCCs directions / involvement to protect the environment using best technologies, cleaner technology, achieving below the National / Location specific standards shall be identified and incentives may be given in the form of a Green award, Cash award accordingly.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 45 k) Revision of consent fee: Consent fees are not revised by the SPCBs / PCCs for many years resulting in revenue loss. In view of this, it is proposed to revise the consent fee based on an Annual Growth Rate arrived with reference to Wholesale Price Index (WPI) / Consumer Price Index (CPI) / RBI Target Inflation issued periodically by Government of India once in every five years by applying formula as below: Revised Consent Fee= Existing Consent Fee * (1 + % increase in fee) Considering all above aspects, it is recommended to increase consent fee by 20% once in every five years by SPCB/PCC. l) Authorization under various Rules of EPA: The activities which are not covered under the Water & Air Acts, but required to obtain authorization under various Rules notified under Environment (Protection) Act, 1986, SPCBs/PCCs may consider to issue authorization for 5 years and recommend charging Rs. 10,000 as an “Administrative Charge” for issuing Authorization. The same may be notified by the State to collect the same as there is no provision under Rules notified under EPA. The SPCB/PCC may issue consolidated consents (Water & Air) along with Authorization as required under various Rules notified under the Environmental (Protection) Act, 1986. Also, recommends adding a factor of 1.1 to the estimated consent fee where authorization is required to be issued along with CTO.
