L.-33004/99 सी.जी.-डी.एल.-अ.-12102021-230377 xxxGIDHxxx CG-DL-E-12102021-230377 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 3867] नई दिल्ली, मगं लवार, अक्त बू र 12, 2021/आज‍व न 20, 1943 No. 3867] NEW DELHI, TUESDAY, OCTOBER 12, 2021/ASVINA 20, 1943 सड़क पररवहन और रािमाग गमत्रं ालय अजधसचू ना नई दिल्ली, 11 अक् तूबर, 2021 का.आ. 4214(अ).—िबदक, केन्द्र सरकार ने राष्ट्रीय रािमाग ग अजधजनयम, 1956 (1956 का 48) की धारा 5 के अधीन िारी की गई भारत सरकार के सड़क पररवहन और रािमाग ग मंत्रालय की अजधसूचना स.ं का. आ. 4155(अ), दिनांदकत 23 दिसंबर, 2016 के द्वारा मध् य प्रििे राज्य म ें राष्ट्रीय रािमागग 59ए (नया रारा-47) को मध् य प्रिेि राज्य सरकार को सुपुि गकर दिया ह;ै अत: अब, राष्ट्रीय रािमाग ग फीस (िरों का जनधागरण और संग्रहण) जनयम, 2008 (िो इसके आग े ‘जनयम’ के रूप म ें उजल्लजखत ह)ै के जनयम 3 के साथ परित राष्ट्रीय रािमाग ग अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रित् त िजक्त यों का प्रयोग करते हुए, केन्द्रीय सरकार, एतिद्वारा मध् य प्रिेि राज्य म ें राष्ट्रीय रािमागग स.ं 47 (पुराना रारा-59ए) के जडिाइन दकमी 129.000 से दकमी 271.400 तक 137.34 दकमी जनवल सड़क खंड लबं ाई के जलए और 2.10 दकमी (0.210 दकमी की लंबाई वाली) की समतुल् य सरं चना लंबाई (60 मीटर स े अजधक की लंबाई वाले) के जलए ताजलका 1 के कॉलम (2) म ें जवजनर्िष्ग ट िर के 60% िर पर नीच े िी गई ताजलका 1 के कॉलम (1) म ें जवजनर्िष्ग ट वाहनों के प्रकार पर फीस उिगृहीत करती ह ै तथा भारतीय राष्ट्रीय रािमागग प्राजधकरण को उसके अजधकाररयों अथवा दकसी िेकेिार के माध्यम स े उक्त फीस के संग्रहण के जलए प्राजधकृत करती ह,ै अथागत:् - 5818 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ताजलका-1 वाहन का प्रकार आधार वर् ग 2007-08 के जलए प्रजत दकमी आधार फीस िर (रु. म)ें (1) (2) कार, िीप, वैन या हल्के मोटर वाहन 0.65 हल्के वाजणिज् यक वाहन, हल्के माल वाहन या जमनी बस 1.05 बस या रक (िो धुरी) 2.20 तीन धुरी वाजणजज्यक वाहन 2.40 भारी जनमागण मिीनरी (एचसीएम) या अथ ग मूववंग उपसक् र (ईएमई) या बहु धुरीय 3.45 वाहन (एमएवी) (चार स ेछ: धरु ी) जविाल आकार के वाहन (सात या अजधक धुरी) 4.20 1. इसके अंतगगत उिगृहीत और संगृहीत फीस ऐसे पथकर प् लािाओं के अंतगगत जवजनर्िष्ग ट िरू ी हते ु जनम्नजलजखत पथकर प्लािाओं म ेंिये और संिेय होगी:- ताजलका-2 लबं ाई (दकमी म)ें जिसके जलए फीस पथकर प्ल ािा (चनै िे ) की अवजस्ट्थजत िर, जिस पर फीस सिं ेय ह ै। सिं ेय ह ै 137.34 दकमी मध् य प्रिेि राज्य के बेतुल जिल े म ें पेव्ड िोल्डर सजहत िो लेन के जलए [बाइपास की लंबाई (>10 करोड़ रु. धनोरा गांव के जनकट रारा-47 के दकमी ऊपर ताजलका-1 म ें उलज् लजखत आधार लागत वाले) और संरचना की लंबाई 252.500 पर िरों का 60% (>60मी) को छोड़कर] 2. उपयुगक् त के अजतररक्त , जनम्न जलजखत टोल प् लािा (प् लािाओं) पर 60 मीटर से अजधक लंबाई वाली जनम्नजलजखत अवसंरचनाओं के उपयोग के जलए 10 के समतुल् य गुणक द्वारा ऐसी अवसंरचनाओं की लंबाई को गुणा करके रािमाग ग की समतुल् य लंबाई म ेंअवसंरचनाओं की लंबाई को पररवर्तगत करके जनम्नजलजखत फीस भी िये और संिेय होगी:- ताजलका-3 समतलु य् सड़क लबं ाई म ें पथकर पल् ािा की पररवर्ततग दकए िान े के जलए समतलु य् सड़क लबं ाई (दकमी िर, जिस पर फीस सिं ेय ह ै अवजस्ट्थजत (चनै िे ) अवसरं चनाओं* की लबं ाई म)ें (दकमी म)ें मध् य प्रिेि राज्य के बेतुल पेव्ड िोलड् र सजहत िो लेन जिले म ें धनोरा गांव के जनकट के जलए ऊपर ताजलका-1 म ें 0.210 दकमी 2.10 दकमी रारा-47 के दकमी 252.500 उलज् लजखत आधार िरों का पर 60%[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 ^ ब् यौरा जनम्न ानुसार ह:ैं - चनै िे सरं चना का प्रकार लबं ाई (दकमी म)ें दकमी स े दकमी तक 1 185.380 185.590 बड़ा पुल 0.210 िोड़ 0.210 3. गैर-वाजणजज्यक प्रयोिनों के जलए पंिीकृत यांजत्रक वाहन के स्ट्वामी और पथकर प् लािा स े बीस दकमी की िरू ी के भीतर जनवास करन े वाले व् यजि के जलए माजसक पास की िर वर्ग 2021-22 के जलए 285.00 रु. (िो सौ जपचासी रुपए मात्र) ह ैऔर उक्त जनयमों के प्रावधानों के अनुसार प्रजतवर्ग संिोधन के अध् यधीन ह।ै 4. रािमाग ग खंड पर बहुल यात्राओं के जलए जनम्न जलजखत िरों पर पास िारी दकए िाएंग,े अथागत ् :- ताजलका-4 भगु तान-योग्य धनराजि अनमु त एकतरफा यात्राओं की वधै ता की अवजध अजधकतम सख्ं य ा एकतरफा यात्रा के जलए फीस का डेढ़ िो भुगतान के समय स े चौबीस घंटे गुना पचास एकल यात्राओं के जलए पचास भुगतान की तारीख स े एक महीना भुगतान-योग् य फीस की राजि का िो- जतहाई 5. फीस प्लािा जस्ट्थत होन े वाले जिले म ें पंिीकृत वाजणजज्यक वाहनों (राष्ट्रीय परजमट के अधीन प्रचाजलत दकए िा रह े वाहनों को छोड़कर) के जलए फीस उस श्रेणी के वाहन हते ु जनधागररत िर की 50% होगी, बित े दक ऐसे वाजणजज्यक वाहनों के प्रयोग के जलए कोई सर्वगस रोड या वैकजल्पक सड़क उपलब्ध न हों। 6. संबंजधत श्रेणी के वाहनों के जलए जवजनर्िष्ग ट अनुज्ञेय भार स े अजधक भार लि े यांजत्रक वाहन का चालक या स्ट् वामी या प्रभारी व् यजि, राष्ट्रीय रािमाग ग पर अजतभार लि े वाहन के प्रवेि के जलए टोल संग्रहण एिेंसी को ऐसी श्रेणी के वाहनों के प्रवेि जलए, कजथत जनयमों के जनयम 10 के उप-जनयम 1ए के अनुसार अनुप्रयोज्य फीस के समतुल् य फीस का भुगतान करन े के जलए उत् तरिायी होगा और वह रािमागग खंड का प्रयोग करन े के जलए तब तक हकिार नहीं होगा िब तक ऐसे यांजत्रक वाहन स ेलिा अजतभार हटाया नहीं िाता। 7. सभी पररभार्ाए,ं यांजत्रक वाहनों की श्रेणी, इनके अनज्ञु ेय भार, छूट प्राप् त वाहनों की श्रेणी, सर्वगस रोड, वैकजल्पक सड़क इत् यादि पूवोक्त जनयमों में जवजनर्िष्ग ट पररभार्ाओं के अनुरूप होंगी। 8. फीस की िरें उि जनयमों के जनयम 12 के अनुसरण म ें प्रयोक्त ाओं के सूचनाथ ग प्रिर्िगत करनी होंगी। 9. यांजत्रक वाहनों स े फीस की वास्ट् तजवक राजि उपयुगक् त ताजलका-1 म ें यथा-उजल्लजखत आधार वर्ग 2007-08 के जलए प्रजत दकमी फीस की आधार िर के आधार पर प्रभाररत होगी और छूटों की गणना भारतीय राष्ट्रीय रािमाग ग प्राजधकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की िाएगी और उसे उक्त जनयमों के जनयम 5 के अनुसार प्रजत वर्ग संिोजधत4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] दकया िाएगा तथा तिनुसार उसे अंग्रेिी और क्षेत्रीय भार्ा के कम स े कम एक-एक समाचार पत्र म ें प्रकाजित दकया िाएगा। 10. इस पररयोिना की प्राक्क जलत पूंिीगत लागत 415.331 करोड़ रु. ह।ै [भूजम अजधग्रहण, सावगिजनक िन सुजवधाओं के स्ट् थानांतरण, पेड़ों को काटने, आदि कायगकलापों को अभी पूरा दकया िाना ह ै इसजलए, पूंिीगत लागत पररवतगन के अध्यधीन ह ै और अंजतम पूंिीगत लागत को पृथक रूप से अजधसूजचत दकया िाएगा।] प्राप्त प्रयोक्त ा फीस के माध् यम स े वसूल की गई पूंिीगत लागत का भारतीय राष्ट्रीय रािमागग प्राजधकरण द्वारा ररकाडग रखा िाएगा तथा पूंिीगत लागत की वसूली के प‍यात ्उिग्राह्य फीस घटाकर िरों के 40% तक कर िी िाएगी और कजथत जनयमों के अनुसरण म ेंवार्र्गक रूप स े संिोजधत की िाएगी। [फा. स.ं सीई-आरओ/बीपीएल/15010/09/2019-20] अजमत वरिान, सयं ुक् त सजचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 11th October, 2021 S.O. 4214(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 4155(E) dated 23rd December,2016, issued under Section 5 of the National Highways Act, 1956 (48 of 1956), the Central Government has entrusted the National Highway 59A ( New NH 47 ) in the State of Madhya Pradesh to the State Government of Madhya Pradesh. Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the “rules”), the Central Government hereby levies the fee on mechanical vehicles at 60% of the rate specified in column (2) of the Table 1 for net road section length of 137.34 km and for equivalent structure length (having length more than 60m) of 2.10 km (having length of 0.210 km) on the type of vehicles specified in column (1) of the Table 1 below of the section from design kilometer 129.000 to kilometer 271.400 of National Highway number 47 (Old NH-59A) in the State of Madhya Pradesh and authorizes the National Highways Authority of India to collect, either through its officials or through a contractor, the said fee, namely:- Table-1 Type of vehicle Base rate of fee per km for the base year 2007-08 (in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (Two Axles) 2.20 Three-axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment 3.45 (EME) or Multi Axle Vehicle (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.20 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the fee plaza is Rs 285.00 (Rupees two hundred eighty five only) for the year 2021-2022 and is subject to revision every year as per the provisions of the said rules. 4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: - Table-4 Amount Payable Maximum number of Period of validity one way journeys allowed One and one-half times of the fee for Two Twenty four hours from the time of one way journey payment Two-third of amount of the fee Fifty One month from date of payment payable for fifty single journeys 5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules. 8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 10. The estimated capital cost of the project is Rupees 415.331 crore. [The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed and the final capital cost will be notified separately]. The National Highways Authority of India shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
