(0.731 दक.मी. की संरचना जजसकी लम्बाइ 60 मी. से ऄजधक ह)ै की समतुल्य संरचना लम्बाइ के जलए ताजलका-1 के कॉलम-2 में जवजनर्ददष्ट अधार दर का 60 प्रजतित की दर पर यांजत्रक वाहन से फ़ीस ईदगृहीत करती ह ै तथा भारतीय राष्ट्रीय राजमागग प्राजधकरण को ईसके ऄजधकाररयों ऄथवा दकसी िेकेदार के माध्यम से ईि फ़ीस के संग्रहण के जलए प्राजधकृत करती है, ऄथागत्:— 4945 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ताजलका - 1 वाहन के प्रकार अधार वर् ग 2007-08 के जलए फीस की प्रजत दक.मी. अधार दर (रु. में) (1) (2) कार, जीप, वैन या हल्के मोटर वाहन 0.65 हल्के वाजणजज्यक वाहन, हल्के माल वाहन या जमनी बस 1.05 बस या रक (दो धुरी) 2.20 तीन धुरी वाले वाजणजज्यक वाहन 2.40 भारी संजनमागण मिीनरी (एचसीएम) या ऄथग मूववग ईपस्ट्कर (इएमइ) या 3.45 बहुधुरीय (एमएवी) (4 से 6 धुरी वाले) जविाल अकार के वाहन (7 या ऄजधक धुरी वाले) 4.20 1. आसके ऄंतगगत ईदगृहीत और संग्रहीत की जाने वाली फ़ीस ऐसे पथकर प्लाजा के जलए जवजनर्ददष्ट सड़क लंबाइ हते ु पथकर प्लाजा पर दये और संदये होगी, ऄथागत:— ताजलका - 2 पथकर प्लाजा का ऄवस्ट्थान (चैनजे ) लंबाइ (दक.मी. म)ें जजसके जलए िल्ु क दर जजस पर िल्ु क संदये ह।ै संदये ह ै 47.787 दक.मी. पेव्ड िोल्डर सजहत 2 लेन के जलए ईि ईत्तर प्रदिे राज्य के लखीमपुर-खीरी जजले के सीजसया गााँव में एन.एच.- ताजलका - 1 में ईजल्लजखत अधार दर 730 के जडज़ाआन 186.245 पर का 60 प्रजतित 2. ईपयुगि के ऄजतररि, जनम्नजलजखत संरचनाओं, जजनकी लम्बाइ 60 मीटर से ऄजधक ह,ै के ईपयोग के जलए ऐसी संरचनाओं की लम्बाइ को समकरण गुणक 10 से गुणा करके राजमागग की समकक्ष लम्बाइ में पररवर्ततत करते हुए, जनम्नजलजखत िुल्क प्लाजा (प्लाजाओं) पर जनम्नजलजखत िुल्क भी दये और संदये होगाः ताजलका - 3 पथकर प्लाजा का ऄवस्ट्थान सड़क की समकक्ष लम्बाइ म ें सड़क की समकक्ष दर जजस पर िुल्क संदये ह।ै (चैनजे ) पररवर्ततत दकए जान े हते ु लम्बाइ संरचनाओं की लम्बाइ (दक.मी. म)ें (दक.मी. म)ें ईत्तर प्रदिे राज्य के लखीमपुर- 0.731 दक.मी. 7.31 दक.मी. पेव्ड िोल्डर सजहत 2 लेन के खीरी जजले के सीजसया गााँव में जलए ईि ताजलका - 1 में एन.एच.-730 के जडज़ाआन ईजल्लजखत अधार दर का 60 दक.मी. 186.245 पर प्रजतित ब्यौरे जनम्नजलजखत हःै चैनजे संरचना का प्रकार लंम्बाइ (दक.मी.) से दक.मी. तक दक.मी. 1. मेजर जिज (दो लेन) 162.614 163.195 0.581 2. मेजर जिज (दो लेन) 182.125 182.275 0.150 कुल योग 0.731[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3 3. जजस व्यजि का ऄपना यांजत्रक वाहन, गैर-वाजणजज्यक प्रयोजनों के जलए पंजीकृत हुअ हो और वह िुल्क प्लाजा से 20 दक.मी. तक की दरू ी में ही रहता हो, ईसके जलए वर्ग 2020-21 के जलए माजसक पास की दर 275.00 रू. (दो सौ पचहत्तर रुपए मात्र) होगी और ईि जनयमों के ईपबंधों के ऄनुसार ईसमें प्रत्येक वर्ग संिोधन दकया जायेगा। 4. राजमागग खंड पर बहु यात्राओं के जलए जनम्नजलजखत दरों पर पास जारी दकए जाएंगे, ऄथागत् ताजलका-4 संदये राजि ऄनमु त एकतरफा यात्राओं की वैधता की ऄवजध ऄजधकतम सख्ं या एकतरफा यात्रा के जलए िुल्क का डेढ़ गुना दो भुगतान के समय से 24 घंटे पचास एकल यात्राओं के जलए भुगतान योग्य पचास भुगतान की तारीख से एक महीना िुल्क की राजि का दो जतहाइ 5. जजस जजले में िुल्क प्लाजा पड़ता ह ै ईस जजले में पंजीकृत वाजणज्यक वाहन (राष्ट्रीय परजमट के ऄधीन चल रह े वाहनों को छोड़कर) के जलए िुल्क ईस श्रेणी के वाहन के जलए जवजनर्ददष्ट िुल्क का 50 प्रजतित होगा, बिते दक ऐसे वाजणजज्यक वाहनों के ईपयोग के जलए कोइ सर्तवस रोड या वैकजल्पक सड़क ईपलब्ध न हों। 6. जो यांजत्रक वाहन ऄपनी श्रेणी के जलए जनधागररत ऄनुज्ञेय भार की ऄपेक्षा ऄजधक भार से लदा होगा ईसके चालक ऄथवा प्रभारी व्यजि को ऐसे ऄजधक भार से लद े हुए वाहन को राष्ट्रीय राजमागग में प्रवेि कराने के जलए िुल्क संग्रहण एजेंसी को ईि जनयमों के जनयम 10 के ईप-जनयम 1 ए में जवजनर्ददष्ट के ऄनुसार िुल्क का भुगतान करना होगा और ईसे राजमागग खंड का ईपयोग करने की तब तक ऄनुमजत नहीं होगी जब तक की ऐसे यांजत्रक वाहन से ऄजधक भार को हटा नहीं ददया जाए। 7. यांजत्रक वाहनों की श्रेणी, ईनके जलए ऄनुज्ञेय भार, छूट प्राप्त वाहनों की श्रेणी, सर्तवस रोड, वैकजल्पक सड़क अदद सजहत सभी पररभार्ाएं जनयमों में जवजनर्ददष्ट पररभार्ाओं के ऄनुसार होगी। 8. ईि जनयमों के जनयम – 12 के ऄनुसार ईपयोगकतागओं की जानकारी के जलए िुल्क की दरों को प्रदर्तित दकया जायेगा। 9. उपर सरणी - 1 में यथा - ईजल्लजखत, अधार वर्ग 2007 - 08 के जलए प्रजत दकलोमीटर िुल्क की अधार दर के अधार पर, यांजत्रक वाहनों से जलए जाने वाले वास्ट्तजवक िुल्क और छूट की गणना भारतीय राष्ट्रीय प्राजधकरण द्वारा खंड की पूरी कर ली गइ लम्बाइ के अधार पर की जाएगी और जनयमों के जनयम - 5 के ऄनुसार वार्तर्क तौर पर संिोधन दकया जाएगा तथा ईसे, तद्नुसार, ऄंग्रेजी और स्ट्थानीय भार्ा के कम से कम एक-एक समाचार पत्र प्रकाजित दकया जाएगा। 10. पररयोजना की ऄनुमाजनत पूंजीगत लागत रु 296.50 करोड़ ह।ै [पूंजीगत लागत में पररवतगन हो सकता ह ै क्योदक भूजम ऄजगन, जनयोजगता सेवाओं का स्ट्थान बदलने, पेड़ों की कटाइ अदद जैसे दियाकलाप ऄभी पूरे दकये जाने ह।ै ऄंजतम पूंजीगत लागत ऄलग से ऄजधसूजचत की जायेगी]। भारतीय राष्ट्रीय राजमागग प्राजधकरण द्वारा वसूल दकये गये प्रयोिा िुल्क के जररये पूंजीगत लागत की वसूली का ररकाडग रखा जायेगा और पूंजीगत लागत की वसूली के बाद लगाये जाने वाले िुल्क की दरों को 40 प्रजतित कर ददया जायेगा और ईि जनयमों के ऄनुसार आसमें वार्तर्क तौर पर संिोधन दकया जायेगा। [फा. सं. सीइ-अरो/एलकेओ/730/यूपी/2015-16/534] ऄजमत वरदान, संयुि सजचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 6th September, 2021 S.O. 3620(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 2004(E) dated 30th August 2012 issued under Section 5 of the National Highway Act, 1956 (48 of 1956), the Central Government has entrusted the National Highway 730 as situated in the State of Uttar Pradesh to the State Government of Uttar Pradesh; Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee on mechanical vehicles at 60% of base rate specified in column (2) of the Table 1 for net road section length of 47.787 km and for equivalent structure4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] length (having length more than 60m) of 7.31 km (having length of 0.731 km) on the type of vehicles specified in column (1) of the Table 1 below of Lakhimpur – Sisiya section from design kilometer 140.000 to kilometer 188.826 (existing km 140.000 to km 188.800) of National Highway number 730 in the State of Uttar Pradesh and authorizes the National Highways Authority of India to collect, either through its officials or through a contractor, the said fee, namely:— Table 1 Base rate of fee per km. for the base Type of vehicle year 2007-08 (in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (Two Axles) 2.20 Three-axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) 3.45 or Multi Axle Vehicle (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.20 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometer from the fee plaza is Rs 275.00 (Rs. Two Hundred Seventy Five) for the year 2020-21 and is subject to revision every year as per the provisions of the said rules. 4. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules. 8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 10. The estimated capital cost of the project is Rupees 296.50 crores. [The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed and the final capital cost will be notified separately]. The National Highway Authority of India shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
