और वह िुल्क प्लाजा से बीस दकलोमीटर तक की दरू ी म ें ही रहता हो, ईसके जलए वर् ग 2020-21 के जलए माजसक पास की दर 275.00/-रूपए (दो सौ पचहत् तर रूपए मात्र) होगी और ईि जनयमों के ऄनुसार ईसम ें प्रत्येक वर् ग संिोधन दकया जायेगा। 4. राजमाग ग खण्ड पर बहुयात्राओं हते ु पास जनम्नजलजखत दरों पर जारी दकया जाएगा, ऄथागत्ः सारणी – 4 सदं ये राजि ऄनमु त्य एकतरफा यात्राओं की वधै ता ऄवजध ऄजधकतम सख्ं या एकतरफा यात्रा के जलए िुल्क का डेढ़ दो संदाय के समय से चौबीस घंटे गुणा पचास एकल यात्राओं या ऄजधक के जलए पचास संदाय की तारीख से एक मास संदये िुल्क की राजि का दोजतहाइ- 5. जजस जजले में िुल्क प्लाजा पड़ता ह ै ईस जजल े में पंजीकृत वाजणजज्यक वाहन (राष्ट्रीय परजमट के ऄधीन चल रह े वाहनों को छोड़कर) के जलए िुल्क ईस श्रेणी के जलए वाहन के जलए जवजनर्ददष्ट िुल्क का 50% होगा बित े के ऐसे वाजणजज्यक वाहनों के ईपयोग के जलए कोइ सर्तवस रोड ऄथवा वैकजल्पक सड़क ईपलब्ध न हो। 6. जो यांजत्रक वाहन ऄपनी श्रेणी के जलए जनधागररत ऄनुज्ञेय भार की ऄपेक्षा ऄजधक भार से लदा हुअ होगा ईसके चालक ऄथवा माजलक ऄथवा प्रभारी व्यजि को ऐस े ऄजधक भार से लद े हुए वाहन को राष्ट्रीय राजमाग ग में प्रवेि करान े के जलए िुल्क संग्रहण एजेंसी को ईि जनयमों के जनयम 10 के ईप-जनयम 1ए के ऄनुसार िुल्क का भुगतान करना होगा और ईस े राजमागग खण्ड का ईपयोग करने की तब तक ऄनुमजत नहीं होगी जब तक दक ऐस े यांजत्रक वाहन से ऄजधक भार को हटा न ददया जाए । 7. यांजत्रक वाहनों की श्रेणी, ईनके जलए ऄनुज्ञेय भार, छूट-प्राप्त वाहनों की श्रेणी, सर्तवस रोड, वैकजल्पक सड़क अदद सजहत सभी पररभार्ाएं जनयमों में जवजनर्ददष्ट पररभार्ाओं के ऄनुसार होंगी । 8. ईि जनयमों के जनयम 12 के ऄनुसार, ईपयोगकतागओं की जानकारी के जलए िुल्क की दरों को प्रदर्तित दकया जाएगा । 9. उपर सारणी-1 म ें यथा-ईजल्लजखत, अधार वर्ग 2007-08 के जलए प्रजत दकलोमीटर िुल्क की अधार दर के अधार पर, यांजत्रक वाहनों से जलए जान े वाल े वास्ट्तजवक िुल्क और छूट की गणना राजमागग पररयोजना के पूरे कर जलए भाग की लम्बाइ के अधार पर प्राजधकरण द्वारा की जायेगी । ईस े प्राजधकरण द्वारा ररयायतग्राही के माध्य म से ऄंग्रेजी और स्ट्थानीय भार्ा के कम-से-कम एक समाचार पत्र में प्रकाजित करवाया जाएगा और तत् पश् चात ईक् त जनयमों के जनयम 5 के ऄनुसार तथा ररयायतग्राही के साथ हुए करार के प्रावधान के ऄनुसार ईसम ें वार्तर्क तौर पर संिोधन दकया जाएगा ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 10. आस पररयोजना की ऄनुमाजनत पूंजीगत लागत 1702.78 करोड़ रुपए ह।ै [पूंजी लागत में पररवतगन हो सकता ह ै क् योंदक भूजम ऄजगन, जन-ईपयोजगता सेवाओं का स्ट्थ ान बदलने, पेड़ों की कटाइ अदद जैस े दक्रयाकलाप ऄभी पूरे दकए जाने िर्े ह।ैं ऄंजतम पूंजीगत लागत को ऄलग से ऄजधसूजचत दकया जाएगा।] प्राजधकरण द्वारा प्रयोगकतागओं से वसूल दकए गए िुल्क के जररए पूंजीगत लागत की वसूली का ररकाडग रखा जाएगा और पूंजीगत लागत की वसूली हो जान े के पश्च सजचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 9th September, 2021 S.O. 3654(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O 977(E) dated 20.04.2009 issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from km 380.000 to km 440.000 (Pimpalgaon- Nashik-Gonde) of National Highway 3 in the State of Maharashtra of to the National Highways Authority of India (hereinafter referred to as the “Authority”); And whereas, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the “said Rules”) and in supersession of notification bearing S.O. 2694(E) dated 11.08.2016 , the Central Government hereby levies the fee on mechanical vehicles at 100% of the base rate specified in column (2) in Table 1 for net road section length of 49.414 km for the use of four or more lanes sections and for equivalent structure length (having length more than 60m) of 105.674 km (having length of 10.5674 km) on the type of vehicles specified in column (1) of Table-1 below of Pimpalgaon-Nashik-Gonde section from design chainage km 380.000 to km 440.000 of National Highway Number 3 in the State of Maharashtra and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely:- Table-1 Type of vehicle Base The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 275 .00 (Rupees Two Hundred and Seventy Five only) for the year 2020-21 and is subject to revision every year as per the provisions of the said rules. 4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:- Table-4 Amount Payable Maximum number Period of validity of one way journeys allowed One and half times of the fee for one Two Twenty four hours from the time of way journey payment Two-third of amount of the fee payable Fifty One month from date of payment for fifty single journeys 5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fees specified in sub-rule 1A of rule 10 of said rules and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc., shall be as per definitions specified in the said rules. 8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 10. The estimated capital cost of the project is Rupees 1702.78 Crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc. are yet to be completed and the final capital cost will be notified separately. The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
