पाररजस्ट्थजतकी संवेिी िोन के रूप म ें पैरा 1 में जवजनर्िष्टा ह,ैं िैव जवजवजधता की िजृ ष्ट सुरजक्षत और संरजक्षत करना और उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों के वगों के प्रचालन और प्रसंस्ट्करण करने को प्रजतजषद्ध करना आवश्र्क ह;ै अतः, अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इस अजधसूचना म ें इसके पश्चात पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 धारा 3 की उपधारा और (1) उपधारा (2) के खंड (v) और खंड (xiv) तथा धारा 3 की उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, ओजडिा राज्र् के गिपजत जिला के लखेरी घाटी वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर 3 (तीन) दकलोमीटर तक जवस्ट्ताररत क्षेत्र को पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके पश् चातप पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप म ेंअजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाात प :- 1. पाररजस्ट्थजतकी संविे ी िोन का जवस्ट्तार और सीमाए.ं -(1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार लखेरी घाटी वन्र्िीव अभर्ारण्र् की सीमा के चारों 3 (तीन) दकलोमीटर तक जवस्ट्तृत ह ै और पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल 244 वग ा दकलोमीटर ह।ै (2) लखेरी घाटी वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण उपाबधं -I के रूप म ें उपाबद्ध ह।ै (3) सीमा जववरण और अक्षािं ों और िेिांतरों के साथ पाररजस्ट्थजतकी संवेिी िोन के सीमांदकत होते हुए लखेरी घाटी वन्र्िीव अभर्ारण्र् के मानजचत्र उपाबधं -IIक, उपाबधं -IIख, उपाबधं -IIग, उपाबधं -IIघ, और उपाबधं -IIङ के रूप म ें उपाबद्ध ह।ै (4) पाररजस्ट्थजतकी संवेिी िोन और लखेरी घाटी वन्र्िीव अभर्ारण्र् की सीमा के भू-जनिेिांकों की सूची उपाबधं -III के सारणी क और सारणी ख म ेंिी गई ह।ै (5) मुख्र् सबंिओंु के भू-जनिेिांकों के साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगता आने वाले ग्रामों की सूची उपाबधं IV के रूप म ेंउपाबद्ध ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना–(1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख स े िो वषा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और राज्र् के सक्षम प्राजधकारी के अनुमोिन के जलए इस अजधसूचना म ें दिए गए अनुबंधों का पालन करत े हुए आंचजलक महार्ोिना तैर्ार करेगी। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत से िो इस अजधसूचना म ें जवजनर्िष्ा ट दकए गए ह ैं के अनसु ार तथा सुसंगत केंद्रीर् और राज्र् जवजधर्ों के अनुरुप और केंद्रीर् सरकार द्वारा िारी मागाजनिेिों, र्दि कोई हों, द्वारा तैर्ार होगी । (3) आंचजलक महार्ोिना, उि र्ोिना म ें पाररजस्ट्थजतकी और पर्ाावरणीर् बातों को समाकजलत करन े के जलए राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ासे तैर्ार होगी.- (i) पर्ाावरण; (ii) वन और वन्र्िीव; (iii) पर्ाटन; (iv) ससंचाई और जनमााण जवभाग (सड़क और भवन); (v) रािस्ट्व जवभाग और ओजडिा राज्र् प्रिषू ण जनर्ंत्रण बोड;ा (vi) कृजष; (vii) रािस्ट् व; (viii) िहरी जवकास; (ix) ग्रामीण जवकास; (x) नगरपाजलका; (xi) पंचार्ती राि; और4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (xii) लोक जन मााण जव भाग। (4) आंचजलक महार्ोिना अनुमोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगी िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िष्ा ट न हो और आचंजलक महार्ोिना सभी अवसंरचना और दक्रर्ाकलापों म,ें िो अजधक िक्षता और पाररजस्ट्थजतकी अनुकूल हों, का संवधान करेगी । (5) आंचजलक महार्ोिना म ें अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण से संबंजधत ऐसे अन्र् पहलओंु , जिन पर ध्र्ान िेना आवश्र्क ह,ै के जलए उपबंध होंगे । (6) आंचजलक महार्ोिना जवद्यमान और प्रस्ट्ताजवत भूजम उपर्ोग जविेषताओं के ब्र्ौरों से अनुसमर्थात मानजचत्र के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों, कृजष क्षेत्रों, ऊपिाऊ भूजम, हररत क्षेत्र िैसे उद्यान और उसी प्रकार के स्ट् थान, उद्यान कृजष क्षेत्र, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभ्र्कंन करेगी। (7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन म ें जवकास को जवजनर्जमत करेगी और परै ाग्राफ-4 में सारणी म ें सूचीबद्ध प्रजतजषद्ध और जवजनर्जमत दक्रर्ाकलापों का अनपु ालन करेगी और स्ट् थानीर् समुिार्ों की िीजवका को सुरजक्षत करन े के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजश्चत और उसकी अजभवृजद्ध भी करेगी। (8) आंचजलक महार्ोिना प्रािेजिक जवकास र्ोिना की सह जवस्ट्तारी होगी । (9) इस प्रकार अनुमोदित आंचजलक महार्ोिना इस अजधसूचना के उपबंधों के अनुसार मानीटरी के अपने कार्ों को करन े के जलए मानीटर सजमजत के जलए एक संिभा िस्ट्तावेि तैर्ार करेगी । 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करने के जलए जनम्नजलजखत उपार् करेगी, अथाातप:- (1) भू-उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन म ें वनों, उद्यान कृजष क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के प्रर्ोिनों के जलए जचजन्हत दकए गए पाकों और खुल े स्ट्थानों का वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक संबद्ध जवकास दक्रर्ाकलापों के जलए उपर्ोग र्ा संपररवतान नहीं होगा: परंत ु र्ह दक पाररजस्ट्थजतकी संवेिी िोन के भीतर इस खंड म ें जवजनर्िष्टा प्रर्ोिनों से जभन्न प्रर्ोिन के जलए कृजष और अन्र् भूजम का संपररवतान मानीटरी सजमजत की जसफाररि पर और र्था लागू और क्षेत्रीर् नगर र्ोिना अजधजनर्म और केन्द्रीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन स,े और इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करन े के जलए अनुज्ञात दकर्ा िाएगा, िैस:े - (i) जवद्यमान सड़कों को चौड़ा करना और उन्ह ेंसुिढृ करना तथा नई सड़कों का संजनमााण; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रिषू ण उत्पन्न न करने वाल े लघ ुउद्योग; (iv) कुटीर उद्योगों जिनके अंतगता ग्रामीण उद्योग भी ह;ैं सुजवधािनक भण्डार और स्ट्थानीर् सुजवधाए ं सहार्क पाररजस्ट्थजतकी पर्ाटन जिसके अन्तगता गहृ वास सजम्मजलत ह;ै और (v) पैरा 4 के अधीन दिए गए संवर्धात दक्रर्ाकलाप: परंत ु र्ह और दक प्रािेजिक नगर र्ोिना जवजध और राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन और संजवधान के अनुच्छेि 244 के उपबंधों र्ा तत्समर् प्रवृत्त जवजध के उपबंधों के अनुपालन के जबना, जिसके अधीन अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म,[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 2006 (2007 का 2) भी ह,ै वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का उपर्ोग अनुज्ञात नहीं होगा: परंत ु र्ह और भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भू-अजभलेखों म ें उपसंिात कोई गलती, मानीटरी सजमजत के जवचार प्राप्त करन े के पश्चात प राज्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार ठीक होगी और उि गलती के सुधार की सूचना केंद्रीर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह और भी दक गलती के संिोधन म ें इस उप पैरा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा म ें भू-उपर्ोग का पररवतान सजम्मजलत नहीं होगा; (ख) वनीकरण तथा वास िीणोद्धार दक्रर्ाकलापों सजहत अनप्रर्ुक् त र्ा अनुत् पािक कृजष क्षत्रे ों में पुन: वनीकरण करने के प्रर्ास दकए िाएंगे। (2) प्राकृजतक िल स्रोतों.- आचंजलक महार्ोिना म ें सभी प्राकृजतक झरनों के आवाह क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीकरण के जलए र्ोिना सजम् मजलत होगी और राज्र् सरकार द्वारा ऐसे क्षेत्रों पर र्ा उनके जनकट जवकास दक्रर्ाकलाप प्रजतजषद्ध करने के बारे म ें िो ऐसे क्षेत्रों के जलए अजहतकर हो ऐसी रीजत से मागाििाक जसद्धांत तैर्ार दकए िाएंगे । (3) पर्टा न र्ा पाररजस्ट्थजतकी पर्टा न.- (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी संवेिी िोन के जलए होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् पर्ाटन जवभाग द्वारा राज्र् पर्ाावरण और वन जवभाग के परामि ा स े तैर्ार होगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना के एक घटक के रूप म ेंहोगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िाएगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबधं ी दक्रर्ाकलाप जनम्नानुसार जवजनर्जमत होंगे, अथाात:प- (i) संरजक्षत क्षत्रे की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट ह,ै नर् ेवाजणजज्र्क होटल और ररिॉटा के सजन्नमााण अनज्ञु ात नहीं होंग:े परंत,ु र्ह दक संरजक्षत क्षत्रे की सीमा से एक दकलोमीटर की िरू ी से परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक होटलों और ररिॉट ा का स्ट्थापना केवल पूवा पररभाजषत और नामजनर्िष्टा क्षेत्रों में पर्टा न महार्ोिना के अनुसार पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए ही अनज्ञु ात होगा; (ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार केंद्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् के मागाििाक जसद्धांतों के द्वारा तथा राष्र ीर् ा र्ाघ्र स संरक्षण प्राजधकरण, द्वारा िारी पाररजस्ट्थजतकी–पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेते हुए (समर्- समर् पर र्था संिोजधत) िारी मागाििाक जसद्धांतों के अनुसार होगा; (iii) आंचजलक महार्ोिना का अनुमोिन दकए िाने तक, पर्ाटन के जलए जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्िष्टा संवीक्षा और मानीटरी सजमजत की जसफाररि पर आधाररत संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नर्े होटल र्ा ररसोटा र्ा वाजणजज्र्क स्ट्थापना का संजनमाणा अनुज्ञात नहीं दकर्ा िार्ेगा ।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) नसै र्गका जवरासत.-पाररजस्ट्थजतकी संवेिी िोन म ें महत्वपूणा नैसर्गाक जवरासत के सभी स्ट्थलों िैसे िीन कोि आरजक्षत क्षत्रे , िैल जवरचनाएं, िल प्रपातों, झरनों, घाटी मागों, उपवनों, गुफाए,ं स्ट्थलों, भ्रमण, अश्वरोहण, प्रपातों आदि की पहचान की िाएगी और जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रुप म ें परररक्षण और सरं क्षण के जलए तैर्ार की िाएगी । (5) मानव जनर्मता जवरासत स्ट्थ ल.-पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, जिल्प-तथ्र्, ऐजतहाजसक, स्ट्थापत्र्, सौंिर्ापूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और उपक्षेत्रों पहचान और उनके संरक्षण के जलए जवरासत र्ोिना आंचजलक महार्ोिना के भाग के रुप में तर्ै ार की िाएगी। (6) ध्व जन प्रिषू ण.-पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रिषू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 म ें जनर्त उपबंधों के अनुसार में पाररजस्ट्थजतकी सवं ेिी िोन में ध्वजन प्रिषू ण के जनर्ंत्रण और जनवारण का अनुपालन दकर्ा िाएगा। (7) वार् ु प्रिषू ण.-पाररजस्ट्थजतकी संवेिी िोन म,ें वार्ु प्रिषू ण के जनवारण और जनर्ंत्रण का वार् ु (प्रिषू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार अनुपालन दकर्ा िाएगा। (8) बजहस्राव का जनस्ट्सारण.-पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत बजहस्राव का जनस्ट्सारण, साधारणों मानकों के उपबंधों के अनुसार पर्ाावरणीर् अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आने वाले पर्ाावरणीर् प्रिषू ण के जनस्ट्सारण के जलए साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक कठोर हो, के उपबंधों के अनुसार होगा। (9) ठोस अपजिष्ट.-ठोस अपजिष्ट का जनपटान एवं प्रबधं न जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें ठोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 1357(अ), तारीख 8 अप्रलै , 2016 के अधीन प्रकाजित ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों )ईएसएम (का प्रर्ोग करत े हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबधं न अनुज्ञात दकर्ा िा सकेगा। (10) िैव जचदकत्सा अपजिष्ट .-िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा.- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसचू ना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016 के अधीन प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनरूु प िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबधं न अनुज्ञात दकर्ा िा सकेगा। (11) प्लाजस्ट्टक अपजिष्ट प्रबधं न.-पाररजस्ट्थजतकी संवेिी िोन म ें प्लाजस्ट्टक अपजिष्ट प्रबंध का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (12) जनमाणा और जवध्वसं अपजिष्ट प्रबधं न.-पाररजस्ट्थजतकी संविे ी िोन में संजनमााण और जवध्वसं अपजिष्ट प्रबंध का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 स.ं सां.का.जन 317(अ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा । (13) ई–अपजिष्ट.-पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट प्रबंध का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् की समर्-समर् पर र्थासंिोजधत द्वारा प्रकाजित ई–अपजिष्ट प्रबधं जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) र्ानीर् र्ातार्ात.-र्ातार्ात की र्ानीर् गजतजवजधर्ां आवास के अनुकूल जवजनर्जमत होंगी और इस संबंध म ेंआंचजलक महार्ोिना म ें जविेष उपबंध सजम्मजलत दकए िाएंग े और आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित होने तक, मानीटरी सजमजत सुसंगत अजधजनर्मों और उसके अधीन बनाए गए जनर्मों और जवजनर्मों के अनुसार र्ानीर् दक्रर्ाकलापों के अनुपालन को मानीटर करेगी । (15) र्ानीर् प्रिषू ण.-लागू जवजधर्ों के अनुपालन म ें वाहन प्रिषू ण का जनवारण और जनर्ंत्रण दकर्ा िाएगा। स्ट्वच्छक ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ा.ं -(i) रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पश्चात पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रिजू षत उद्योगों की स्ट्थापना की अनुमजत नहीं िी िाएगी। (ii) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 म ें िारी मागाििाक जसद्धान्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ें इस प्रकार जवजनर्िष्टा न हो; पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर- प्रिषू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गरै प्रिषू णकारी उद्योगों को बढावा दिर्ा िाएगा। (17) पहाड़ी ढलानों को सरं क्षण.-पहाड़ी ढलानों का संरक्षण जनम्नानुसार होगा:- (क) आंचजलक महार्ोिना पहाड़ी ढलानों पर क्षेत्रों का संकेत होगा िहां दकसी भी संजनमााण की अनुमजत नहीं िी िाएगी; (ख) कटाव के एक उच्च जडग्री के साथ जवद्यमान खड़ी पहाड़ी ढलानों र्ा ढलानों पर दकसी भी संजनमााण की अनुमजत नहीं िी िाएगी । 4. पाररजस्ट्थजतकी संविे ी िोन म ें प्रजतजषद्ध और जवजनर्जमत दकए िान े वाल े दक्रर्ाकलापों की सचू ी.-पाररजस्ट्थजतकी संवेिी िोन म ें सभी दक्रर्ाकलाप पर्ाावरण संरक्षण अजधजनर्म, 1986 के उपबंधों और उसके अधीन बनाए गए जनर्मों जिसके अन्तगात तटीर् जवजनर्मन िोन अजधसूचना, 2011 और पर्ावा रणीर् प्रभाव आकलन अजधसचू ना, 2006 और अन्र् लाग ू जवजधर्ां के जिसमें वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53), सजम्मजलत ह ैं और दकर्े गर्े संिोधनों द्वारा िाजसत होंग े और नीच े िी गई ताजलका म ेंजवजनर्िष्टा रीजत म ें जवजनर्जमत होंग,े अथाात प :- सारणी क्रम स.ं दक्रर्ाकलाप वणना (1) (2) (3) अ. प्रजतजषद्ध दक्रर्ाकलाप 1. वाजणजज्र्क खनन, पत्थर उत्खनन और (क) वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेल ू आवश्र्कताओं अपघषणा इकाईर्ां । जिसमें जनिी उपर्ोग के जलए मकानों के संजनमााण र्ा8 THE (लघ ु और वृहत खजनि), पत्थर की खानें और उनकों तोड़न े की इकाइर्ां तत्काल प्रभाव से प्रजतजषद्ध होगी। (ख) खनन प्रचालन, माननीर् उच्चतम न्र्ार्ालर् की ररट र्ाजचका (जसजवल) स.ं 1995 का 202 टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले म ें आिेि तारीख 4 अगस्ट्त ,2006 और ररट र्ाजचका (सी) स.ं 2012 का 435 गोवा फाउंडेिन बनाम भारत संघ के मामले म ें तारीख 21 अप्रलै ,2014 के आिेि के अनुसरण म ें प्रचालन होगा । 2. प्रिषू ण (िल, वार्ु, मृिा, ध्वजन, आदि) पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान प्रिषू णकारी उद्योगों का जवस्ट्तार करने की अनज्ञु ा नहीं उत्पन करन े वाल ेउद्योगों की स्ट्थापना । होगी: परन्त ु र्ह दक केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा द्वारा फरवरी, 2016 म ें िारी मागा ििाक जसद्धान्तों म ें उद्योगों के वगीकरण के अनुसार िब तक दक अजधसूचना म ें ऐसा जवजनर्िष्टा न हों, पाररजस्ट्थजतकी संवेिी िोन के भीतर गैर-प्रिषू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि गैर-प्रिषू णकारी कुटीर उद्यागों को बढावा दिर्ा िाएगा। 3. ब ृहत िल जवद्युत पररर्ोिना की लागू जवजधर्ों के अनुसार प्रजतजषद्ध (अन् र्था उपबंजधत के स्ट्थापना । जसवार्) होंगे । 4. दकसी पररसंकटमर् पिाथ ा का उपर्ोग लागू जवजधर्ों के अनुसार प्रजतजषद्ध (अन् र्था उपबंजधत के र्ा उत्पािन र्ा प्रसंस्ट्करण। जसवार्) होंगे । 5. प्राकृजतक िल जनकार्ों र्ा क्षेत्र भूजम म ें लागू जवजधर्ों के अनुसार प्रजतजषद्ध (अन् र्था उपबंजधत के अनुपचाररत बजहस्रााव का जनस्ट्सारण । जसवार्) होंगे । 6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई और जवद्यमान आरा जमलों का जवस्ट् तार अनज्ञु ात नहीं होगा । 7. ईंट भट्टों की स्ट्थापना करना। लागू जवजधर्ों के अनुसार प्रजतजषद्ध (अन् र्था उपबंजधत के जसवार्) होंगे । 8. िलावन लकड़ी का वाजणजज्र्क उपर्ोग लागू जवजधर्ों के अनुसार प्रजतजषद्ध (अन् र्था उपबंजधत के । जसवार्) होंगे । आ. जवजनर्जमत दक्रर्ाकलाप 9. वाजणजज्र्क होटलों और ररसोटों की पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों लघ ु अस्ट्थार्ी संरचनाओं के स्ट्थापना । जसवार् संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनम ें िो भी जनकट ह,ै नए वाजणजज्र्क होटल और ररसोटों को अनुज्ञात नहीं दकर्ा िाएगा: परंत ु र्ह दक संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के परे[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक इनम ें से िो भी जनकट हो सभी नए पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान दक्रर्ाकलाप का जवस्ट्तार पर्ाटन महार्ोिना और र्था लाग ू मागाििी जसद्धांतों के अनुरुप होगा। 10. संजनमााण दक्रर्ाकलाप । (क) सरं जक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट हो, दकसी भी प्रकार के नर्े वाजणजज्र्क संजनमााण की अनुज्ञा नहीं होगी: परंत ु र्ह दक स्ट्थानीर् लोगों को अपनी आवास सम्बन्धी जनम्नजलजखत आवश्र्कताओं को परू ा करन े के जलए, परै ा 3 के उप पैरा (1) में सूचीबद्ध दक्रर्ाकलापों सजहत अपने उपर्ोग के जलए, अपनी भूजम में भवन उप-जवजधर्ों के अनुसार, संजनमााण करन े की अनुज्ञा होगी, िैसे:- परंत ु र्ह दक गैर–प्रिषू णकारी लघु उद्योगों से संबंजधत संजनमााण दक्रर्ाकलाप लाग ू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत से जवजनर्जमत दकए िाएंगे और वे न्र्ूनतम होंगे । (ख) एक दकलोमीटर क्षेत्र से परे र्े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे । 11. प्रिषू ण उत्पन्न न करने वाल े लघु फरवरी, 2016 म ें केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा द्वारा िारी उद्योग । उद्योगों में वगीकरण के अनुसार गैर-प्रिषू णकारी उद्योग और अपररसंकटमर् म,ें लघ ु और सेवा उद्योग, कृजष, पुष्प कृजष, उद्यान कृजष र्ा पाररजस्ट्थजतकी संवेिी िोन से िेिी सामग्री से उत्पािों को उत्पन्न करने वाले कृजष आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे। 12. वृक्षों की कटाई । (क) राज्र् सरकार म ें सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन, सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर र्ा वनों म ें वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई संबंजधत केंद्रीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंध के अनुसार जवजनर्जमत होगे । 13. वन उत्पािों र्ा गरै काष्ठ वन उत्पािों लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे । का संग्रहण । 14. जवद्युत और संचार टावरों का लाग ू जवजधर्ों के अधीन जवजनर्जमत होंगे (भूजमगत केबल के पररजनमााण और केबलों के जबछाए िाने जबछाए िाने को बढावा दिर्ा िा सकेगा)। और अन्र् बुजनर्ािी ढांचे । 15. नागररक सुख सुजवधाओं सजहत न्र्ूनीकरण उपार्ों को लागू जवजधर्ों, जनर्मों और जवजनर्मनों अवसंरचनाएं । और उपलब्ध मागाििाक जसद्धांतों के नवीन सड़कों तथा उपलब्ध मागिा िाक जसद्धांतों के अनुसार दकर्ा िाएगा । का संजनमााण । 17. पर्ाटन से संबंजधत अन्र् दक्रर्ाकलाप लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे । िैसे गम ा वार्ु गुब्बारें, हले ीकाप्टर, ड्रोन, माइक्रोलाइटस आदि द्वारा पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से उड़ना िैस ेदक्रर्ाकलाप करना। 18. पहाड़ी ढालों और निी तटों का लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे । संरक्षण । 19. राजत्र म ेंर्ाजनक र्ातार्ात का संचलन । लाग ू जवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत । 20. स्ट्थानीर् समुिार्ों द्वारा चल रही कृजष स्ट्थानीर् लोगों के उपर्ोग के जलए लाग ू जवजधर्ों के अधीन और बागवानी प्रथाओं के साथ अनुज्ञात । िग्ु धिाला, िग्ु घ उद्योग, कृजष और मछली पालन । 21. फमों, कंपजनर्ों द्वारा बड़े पमै ाने पर स्ट्थानीर् आवश्र्कताओं को परू ा करन े के जलए लाग ू जवजधर्ों के अधीन जवजनर्जमत (अन्र्था प्रिान दकए गए) होंगे । वाजणजज्र्क पिुओं और पोल्री फामों की स्ट्थापना । 22. प्राकृजतक िल जनकार्ों र्ा सतही क्षत्रे िल जनकार्ों म ें उपचाररत अपजिष्ट िल र्ा बजहस्रााव के म ेंउपचाररत बजहस्रााव का जनस्ट्तारण । जनस्ट्सारण स े बचा िाएगा और उपचाररत अपजिष्ट िल के पुन:चक्रण और पुन:उपर्ोग के जलए प्रर्ास दकए िाएंगे। अन्र्था लागू जवजधर्ों के अनुसार उपचाररत बजहस्रााव के पुनचक्रा ण र्ा प्रवाह के जनवाहन को जवजनर्जमत दकर्ा िाएगा। 23. सतही और भूिल का वाजणजज्र्क लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे । प्रर्ोग एवं जनष्कषणा । 24. ठोस अपजिष्ट का प्रबन्धन। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे । 25. जविेिी प्रिाजतर्ों को लाना । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे । 26. पाररजस्ट्थजतकी पर्ाटन। लाग ू जवजधर्ों के अनुसार जवजनर्जमत होंगे । 27. पोजलथीन बगै ों का उपर्ोग । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे । 28. वाजणजज्र् क साइनबोडा और होर्डंग। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे । इ. सवं र्धता दक्रर्ाकलाप 29. वषा ा िल संचर्न । सदक्र र् रूप स े बढावा दिर्ा िाएगा । िाएगा । 5. पाररजस्ट्थजतकी संविे ी िोन की अजधसचू ना की मानीटरी के जलए मानीटरी सजमजत- केंद्रीर् सरकार, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 3 की उपधारा (3) के अधीन इस अजधसूचना के उपबंधों की प्रभावी मानीटरी के जलए मानीटरी सजमजत का गठन करती ह,ै िो जनम्नजलजखत स ेजमलकर बनगे ी, अथाात:प - क्रम स.ं जनगरानी सजमजत का गठन पि (i) कलेक्टर, गिपजत पिेन, अध्र्क्ष; (ii) कलेक्टर, गंिम के प्रजतजनजध सिस्ट्र्; संगठन का प्रजतजनजध (vi) राज्र् सरकार द्वारा नाजमत िैव जवजवधता म ें एक जविेषज्ञ सिस्ट्र्; (vii) राज् र् के प्रजतजित सस्ट्ं थान र्ा जवश्वजवद्यालर् से पाररजस्ट्थजतकी म ें एक जविेषज्ञ सिस्ट्र्; (viii) डीए फओ, बेरहामपुर वन प्रभाग सिस्ट्र्; (ix) प्रभागीर् वनाजधकारी-सह-वन्र्िीव वाडान, परलाखेमुंडी वन प्रभाग सिस्ट्र्-सजचव। 6. जनिेि–जनबधं न.- (1) मानीटरी सजमजत इस अजधसूचना के उपबंधों के अनुपालन को मानीटर करेगी। (2) मानीटरी सजमजत का कार्ाकाल तीन वष ा तक र्ा राज्र् सरकार द्वारा नई सजमजत के पुन: गठन तक के जलए होगा और तत्पश्चात जनगरानी सजमजत राज्र् सरकार द्वारा गरठत की िाएगी। (3) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533 (अ), तारीख 14 जसतम्बर, 2006 की अनुसूची म ें सजम्मजलत ह,ैं और िो पाररजस्ट्थजतकी संवेिी िोन म ें आत े ह,ैं जसवार् इसके िो पैरा 4 के अधीन सारणी म ें र्था जवजनर्िष्टा प्रजतजषद्ध दक्रर्ाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िष्टा स्ट्थलीर् ििाओं के आधार पर सवं ीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त के जलए केद्रींर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को जनर्िष्टा दकर्ा िाएगा। (4) इस अजधसूचना के पैरा 4 के अधीन सारणी म ें र्था जवजनर्िष्टा प्रजतजषद्ध दक्रर्ाकलापों अनुसूची के अधीन ऐसे अनुसूची में दक्रर्ाकलापों, जिन्हें सजम्मजलत नहीं दकर्ा गर्ा ह,ै परंतु पाररजस्ट्थजतकी संवेिी िोन म ें आत े ह,ैं ऐसे दक्रर्ाकलापों की वास्ट्तजवक जवजनर्िष्टा स्ट्थलीर् ििाओं पर आधाररत जनगरानी सजमजत द्वारा संवीक्षा की िाएगी और उसे संबद्ध जवजनर्ामक प्राजधकरणों को जनर्िष्टा दकर्ा िाएगा । (5) मानीटरी सजमजत का सिस्ट्र्-सजचव र्ा संबद्ध उपार्ुि ऐसे व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लघं न करता ह,ै पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 19 के अधीन पररवाि फाइल करने के जलए सक्षम होगा। (6) मानीटरी सजमजत मुद्दा िर मद्दु ा के आधार पर अपेक्षाओं पर जनभार रहत े हुए संबद्ध जवभागों के प्रजतजनजधर्ों र्ा जविेषज्ञों, औद्योजगक संगमों र्ा संबद्ध पणधाररर्ों के प्रजतजनजधर्ों को अपन े जवचार-जवमि ा म ें सहार्ता के जलए आमंजत्रत कर सकेगी । (7) मानीटरी सजमजत प्रत्र्ेक वषा की 31 माचा तक के अपने दक्रर्ाकलापों की वार्षाक कारावाई ररपोट ा राज्र् के मुख्र् वन् र्िीव वाडान को उपाबंध V म ेंसंलग्न प्रोफामाा में उक्त वष ाके 30 िून तक प्रस्ट्ततु करेगी । (8) केन्द्रीर् सरकार का पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् मानीटरी सजमजत को अपन े कृत्र्ों के प्रभावी जनवाहन के जलए समर्-समर् पर ऐस े जनिेि िे सकेगा, िो वह ठीक समझे । 7. इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए केंद्रीर् 5 of the Environment (Protection) Rules, 1986 was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 2681 (E), dated the 26th July, 2019, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 26thJuly, 2019; AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification; AND WHEREAS, Lakhary Valley Wildlife Sanctuary is situated entirely within Gajapati district of Odisha under the administrative jurisdiction of Paralakhemundi Forest Division and Berhampur Forest Circle and geographically, it is located between 84°16’43.7” and 84°26’28.1” East Longitude and between 19°12’6.4” and 19°23’41.9” North Latitude and the total area of the Sanctuary is 185.87 square kilometers; AND WHEREAS, catchment area of Ramnadi and Ghodahada River, rich floral and faunal biodiversity, notable rock features, recreational panoramic landscape, and elephant, a mega herbivore and the flagship animal, giant Indian squirrel are inter alia considered as the factors of significance and both Ramnadi and Ghodahada rivers being the source of potable and domestic useable water and irrigation for agriculture crop owe the drainage from the Sanctuary and become a source of sustenance for local people and the lifeline of the locality; AND WHEREAS, the Lakhary Valley Wildlife Sanctuary comprises about 97 species of trees, 28 species of shrubs and herbs, 16 species of climbers, 14 species of grasses, 38 species of ferns, 26 species of orchids, 33 species of mammals, 90 species of birds, 05 species of amphibians, 31 species of reptiles and 17 species of fishes and hence exhibiting the rich floral and faunal biodiversity; AND WHEREAS, the important flora recorded from the Sanctuary includes Emblica officinalls (amla), Terminalia arjuna (arjun), Saraca indica (ashok), Ficus religiosa (aswastha (papal), Terminalia bellerica (bahada), Fiscus religiosa (bara), Aegle marmelos (bei), Santalum album (chandan), Michelia champaca (champa), Fiscus glomerata (dimiri), Ailanthus excels (gohira), Terminalia checula (harida), Azardirachta india (neem), Butea monsperma (palasa), Soymida febrifuge (rohini), Streblus asper (sahada), Hemidesmus indicus (Anantamula), Curcuma spp. (bana haldi), Phyllanthus niruri (badianla), Andrographis paniculata (bhui neem), Woodfordia furticosa (dhatuki), Nyctanthes arbortristis (gangasiui), Smilax macrophylla (muturi), Gymneva sylvestris (gudmari), Asparagus racemosus (satabari), Cuscuta reflexa (nirmuli), Cyonodon dactylon (duba), Cymbopogon citrates, Vanda testaceae (rasna), etc.; AND WHEREAS, the major fauna of the Lakhary Valley Wildlife Sanctuary are Pterosus giganteus (badudi), Manis crassicaudata (bajrakapta), Cunon alpines (balia kukur), Felis chaus affinis (Banabiradi (katash), Sus scrofa (barha), Rautfa bicolor (beleramusa), Melursus ursinus (bhalu), Elephas maximum (hati), Hyaena hyaena (Hetabagha), Hystrix india (jinka), Panthera pradus (Kalarapatiria bagha), Muntiacus muntijak (kutrua), Herpestes edwardsi (neula hatia), Herpestes auropunctatus (neula (kuji), Lutura perspicillata (odha), Canis Lupus (ramasiala), Viverrucula indica (saliapanti), Cervus Unicolor (sambar), Megalaima zeylanica (baya), Merops orientails (tiya), Racophorus lencamystax (katha benga), Batagur Baska (nadi kaincha), Lissemys punctatta (pokhari kaincha), Gavialis gangeticus (thantia kumbhira), Chameleon zeylanicus (bahurupi endua), varanus falvescens (matia godhi), Eryx johni (Do-mundia boa) , Python molurus molurus (ajagara), chrysopelea ornate (udanta sapa), Bungarus fasciatus (rana sapa), Naja Oxiana (kala naga), Ophiophagus Hannah (ahiraj), Wallagonia attu (balia), Clarias batrachus (magura), etc.; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Lakhary Valley Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of 3 (three) kilometres uniform around the boundary of Lakhary Valley Wildlife Sanctuary, in Gajapati district in the State of Odisha as the Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of 3 (three) kilometres uniform around the boundary of Lakhary Valley Wildlife Sanctuary and the area of the Eco-sensitive Zone is 244 square kilometres. (2) The boundary description of Lakhary Valley Wildlife Sanctuaryand its Eco-sensitive Zone is appended in Annexure-I. (3) The maps of the Lakhary Valley Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB, Annexure-IIC, Annexure-IID and Annexure-IIE.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) List of geo-coordinates of the boundary ofLakhary Valley Wildlife Sanctuaryand Eco-sensitive Zone are given in Table A andTable B of Annexure III. (5) The list of villages falling in the proposed Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV. 2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Eco- sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority of State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Tourism; (iv) Irrigation and Works Department (Roads and Building); (v) Revenue Department and Odisha State Pollution Control Board (vi) Agriculture; (vii) Revenue; (viii) Urban Development; (ix) Rural Development; (x) Municipal; (xi) Panchayati Raj; and (xii) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and similar places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified in this clause, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 25 Committee, and with the prior approval of the competent authority under Regional Town Planning laws and other rules and regulations of the Central Government or State Government as applicable and under the relevant provisions of this Notification, to meet the residential needs of the local residents and for activities such as:- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given under paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning laws and other rules and regulations of the State Government and without compliance of the provisions of Article 244 of the Constitution or any other law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner so as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism.-(a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per the Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.-All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution.- Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.-Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.-Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes.-Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed of in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (10) Bio-Medical Waste.–Bio-Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016. (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016. (12) Construction and demolition waste management.-The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016. (13) E-waste.-The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.-Prevention and control of vehicular pollution shall be in compliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 27 (ii) Only non-polluting industries shall be allowed within the Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Protection Act, 1986 and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE Sl. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents: Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 11. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority. 12. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. 13. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.-For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S N Constituent of the Monitoring Committee Designation (i) Collector, Gajapati Chairman, ex officio (ii) Representative of Collector, Ganjam Member; (iii) Superintendent of Police, Gajapati Member; (iv) Representative of Superintendent of Police, Ganjam Member; (v) A representative of Non-governmental Organisation working in the field of Member; wildlife conservation to be nominated by the State Government (vi) An expert in Biodiversity nominated by the State Government Member; (vii) One expert in Ecology from reputed institution or university of the State Member; (viii) DFO, Berhampur Forest Division Member; (ix) Divisional Forest Officer-cum-Wildlife Warden, Paralakhemundi Forest Member-Secretary. Division 6. Terms of reference.–(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to the provisions of this notification. 8. The provisions of this notification shall be subject to the orders, if any, passed or to be passed by the Hon’ble Supreme Court of India or High Court or National Green Tribunal. [F.
