संभावना थी, उस तारीख से, िजसको उस राजप(cid:7074) क(cid:7409) (cid:7079)ितयां, िजसम(cid:7286) उ(cid:7334) अिधसूचना अंत(cid:7414)व(cid:6981)(cid:7397) है जनता को उपल(cid:7011)ध करा दी गई थ(cid:7277), साठ
(cid:7408)दन क(cid:7409) अविध के भीतर आ(cid:6979)ेप और सु(cid:6979)ाव आमंि(cid:7074)त (cid:7408)कए गए थे;

राज(cid:7021)थान रा(cid:6996)य के िजला िच(cid:7275)ौड़गढ और (cid:7079)तापगढ़ के दि(cid:6979)णी – पूव(cid:7278) (cid:6979)े(cid:7074) पर अवि(cid:7021)थत ह ैऔर 740 23’ पू– 74040’ पू दशे ांतर और 240

और, सीतामाता व(cid:7008)यजीव अभयार(cid:7003)य क(cid:7409) उ(cid:7275)र-पि(cid:7391)म सीमा सागौन बांस िमि(cid:7088)त वन के िलए और इसके साथ जुडे (cid:7079)जाितय(cid:7298),
वन(cid:7021)पितय(cid:7298) और जीव के सबसे (cid:7079)चुर अभयार(cid:7003)य म(cid:7286) से एक ह ै । यहां करीब सरीसृप के लगभग 50 (cid:7079)जाितया,ं उभयचर के 9 (cid:7079)जाितया,ं
पि(cid:6979)य(cid:7298) क(cid:7409) 275 (cid:7079)जाितयां और मछिलय(cid:7298) क(cid:7409) 30 (cid:7079)जाितया ं अभयार(cid:7003)य क(cid:7409) सूची म(cid:7286) सूचीब(cid:7373) ह।ै सीतामाता अभयार(cid:7003)य म(cid:7286) पौध(cid:7298) क(cid:7409) 800
(cid:7079)जाितयां ह ैिजसम(cid:7286) से 108 औषधीय पौध(cid:7298) क(cid:7409) (cid:7079)जाितयां पहले स ेही पहचानी जा चुक(cid:7409) ह,ै रा(cid:7398)ीय औषधीय पादप बोड(cid:6981), नई (cid:7408)द(cid:7016)ली (cid:7367)ारा
जारी संकटाप(cid:7382) औषधीय पौध(cid:7298) क(cid:7409) 13 (cid:7079)जाितया ंह;ै

तमाम अ(cid:7008)य जीव-ज(cid:7008)तु एवं वन(cid:7021)पित (cid:7079)जाित के िलए सू(cid:7023)म वास बनाती है और यह तमाम (cid:7079)जाितय(cid:7298) के िलए, िजनम(cid:7286) पि(cid:7391)मी घाट के त(cid:7004)व(cid:7298)
के अलावा िहमालय, इंडो-मलायन और अ(cid:7080)(cid:7409)क(cid:7409) (cid:6979)े(cid:7074)(cid:7298) स ेतमाम बाहर जाने वाली (cid:7079)जाितय(cid:7298) के िलए िविवरणा(cid:7004)मक सीमा बनाती है जो (cid:7408)क
अि(cid:7367)तीय ह;ै
और पया(cid:6981)वरण दिृ(cid:7397)कोण से सीतामाता व(cid:7008)यजीव अभयार(cid:7003)य और उसके आस पास के (cid:6979)े(cid:7074) को पा(cid:7407)रि(cid:7021)थितक संवेदी जोन घोिषत करते
(cid:7263)ए िजसम (cid:7286)वन(cid:7021)पित और जीव के संर(cid:6979)ण के िलए नुकसान प(cid:7263)चं ाने वाले कितपय (cid:7408)(cid:7059)याकलाप(cid:7298) को िनयंि(cid:7074)त करना आव(cid:7019)यक ह;ै
अतः अब के(cid:7008)(cid:7076)ीय सरकार, पया(cid:6981)वरण (संर(cid:6979)ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पया(cid:6981)वरण (संर(cid:6979)ण) अिधिनयम,
1986 (1986 का 29) क(cid:7409) धारा 3 क(cid:7409) उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) के साथ प(cid:7407)ठत उपधारा (1) (cid:7367)ारा (cid:7079)द(cid:7275)
शि(cid:7334)य(cid:7298) का (cid:7079)योग करते (cid:7263)ए, राज(cid:7021)थान रा(cid:6996)य म(cid:7286) सीतामाता व(cid:7008)यजीव अभयार(cid:7003)य क(cid:7409) सीमा से 0.5 (cid:7408)कलोमीटर से 3 (cid:7408)कलोमीटर के िव(cid:7021)तार
के (cid:6979)े(cid:7074) को सीतामाता व(cid:7008)यजीव अभयार(cid:7003)य पा(cid:7407)रि(cid:7021)थितक संवेदी जोन (िजसे इसम(cid:7286) इसके प(cid:7391)ात् पा(cid:7407)रि(cid:7021)थितक संवेदी जोन कहा गया ह)ै के
(cid:7272)प म(cid:7286) अिधसूिचत करती ह,ै िजसका िववरण िन(cid:7388)ानुसार है, अथा(cid:6981)त ्:-
1. पा(cid:7407)रि(cid:7021)थितक संवदे ी जोन का िव(cid:7021)तार और उसक(cid:7409) सीमाए-ं -(1) पा(cid:7407)रि(cid:7021)थितक संवेदी जोन सीतामाता व(cid:7008)यजीव अभयार(cid:7003)य क(cid:7409)
सीमा के चार(cid:7298) ओर 172.45 वग(cid:6981) (cid:7408)कलोमीटर तक के (cid:6979)े(cid:7074) तक फैला (cid:7263)आ ह ैऔर इस जोन का सीमा का वण(cid:6981)न उपाबंध I म(cid:7286) (cid:7408)दया गया ह ै।
(2) पा(cid:7407)रि(cid:7021)थितक संवेदी जोन का मानिच(cid:7074) उपाबधं II के (cid:7272)प म(cid:7286) उपाब(cid:7373) ह ै।
(3) पा(cid:7407)रि(cid:7021)थितक संवेदी जोन म (cid:7286) सीतामाता व(cid:7008)यजीव अभयार(cid:7003)य के साथ जीपीएस िनदश(cid:7287) ांक के मु(cid:6990)य िब(cid:7008)द(cid:7312)ु उपाबधं III के (cid:7272)प म(cid:7286)
उपाब(cid:7373) ह ै।
(4) पा(cid:7407)रि(cid:7021)थितक संवेदी जोन म(cid:7286) राज(cid:7021)थान िजले िच(cid:7275)ौडगढ़, (cid:7079)तापगढ़ और उदयपुर के अंतग(cid:6981)त आने वाले 58 (cid:7061)ाम(cid:7298) म(cid:7286) फैला (cid:7263)आ ह।ै
(5) पा(cid:7407)रि(cid:7021)थितक संवेदी जोन के भीतर आने वाले (cid:7061)ाम(cid:7298) क(cid:7409) सूची उपाबंध IV के (cid:7272)प म(cid:7286) उपाब(cid:7373) ह ै।
2. पा(cid:7407)रि(cid:7021)थितक सवं ेदी जोन के िलए आंचिलक महायोजना – (1) रा(cid:6996)य सरकार, पा(cid:7407)रि(cid:7021)थितक संवेदी जोन के (cid:7079)योजन के िलए राजप(cid:7074) म (cid:7286)
इस अिधसूचना के (cid:7079)काशन क(cid:7409) तारीख से दो वष(cid:6981) क(cid:7409) अविध के भीतर, (cid:7021)थानीय (cid:7390)ि(cid:7334)य(cid:7298) के परामश(cid:6981) से और इस अिधसूचना म(cid:7286) संल(cid:6991) न
अनुबंध(cid:7298) के सामंज(cid:7021) य से और रा(cid:6996)य सरकार म(cid:7286) स(cid:6979)म (cid:7079)ािधकारी के अनुमोदन से आंचिलक महायोजना तैयार करेगी ।
(2) रा(cid:6996)य सरकार (cid:7367)ारा पा(cid:7407)रि(cid:7021) थितक संवेदी जोन के िलए आचंिलक महायोजना इस रीित म(cid:7286), इस अिधसूचना म(cid:7286) िविन(cid:7416)द(cid:7020)(cid:6981) ट (cid:7272)प तथा
सुसंगत क(cid:7286)(cid:7076)ीय और रा(cid:6996) य िविधय(cid:7298) के सामंज(cid:7021) य और क(cid:7286)(cid:7076)ीय सरकार (cid:7367)ारा जारी माग(cid:6981)िनदश(cid:7287) (cid:7298), य(cid:7408)द कोई ह(cid:7298), (cid:7367)ारा तैयार होगी ।
(3) आंचिलक महायोजना, पया(cid:6981)वरणीय और पा(cid:7407)रि(cid:7021)थितक िवचार(cid:7298) को समाकिलत करने के िलए रा(cid:6996) य सरकार के सभी संब(cid:7373)
िवभाग(cid:7298) के परामश(cid:6981) से तैयार होगी, अथा(cid:6981)त्:--
(i)(cid:32) पया(cid:6981)वरण;
(ii)(cid:32) वन और व(cid:7008)यजीव;
(iii)(cid:32) कृिष ;
(iv)(cid:32) राज(cid:7021) व;
(v)(cid:32) नगर िवकास;
(vi)(cid:32) पय(cid:6981)टन;
(vii)(cid:32) (cid:7061)ामीण िवकास;
(viii)(cid:32) (cid:7410)संचाई और बाढ़ िनयं(cid:7074)ण;
(ix)(cid:32) नगरपािलका;
(x)(cid:32) पंचायती राज;¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(xi)(cid:32) लोक िन मा(cid:6981)ण िव भाग।
(4) आंचिलक महायोजना अनुमो(cid:7408)दत िव(cid:7378)मान भू-उपयोग, अवसंरचना और (cid:7408)(cid:7059)याकलाप(cid:7298) पर कोई िनब(cid:7304)धन अिधरोिपत नह(cid:7277) करेगी
जब तक (cid:7408)क इस अिधसूचना म(cid:7286) िविन(cid:7416)द(cid:7020)(cid:6981) ट न हो और आचंिलक महायोजना सभी अवसंरचना और (cid:7408)(cid:7059)याकलाप(cid:7298) म(cid:7286) और अिधक द(cid:6979)ता और
पा(cid:7407)रि(cid:7021)थितक अनुकूलता का संवध(cid:6981)न करेगी ।
(5) आंचिलक महायोजना म(cid:7286) अना(cid:6994)छा(cid:7408)दत (cid:6979)े(cid:7074)(cid:7298) के जीण(cid:7299)(cid:7373)ार, िव(cid:7378)मान जल िनकाय(cid:7298) के संर(cid:6979)ण, आवाह (cid:6979)(cid:7074)े (cid:7298) के (cid:7079)बंधन, जल-संभर(cid:7298)
के (cid:7079)बंधन, भूतल जल के (cid:7079)बंधन, मृदा और नमी संर(cid:6979)ण, (cid:7021)थानीय समुदाय(cid:7298) क(cid:7409) आव(cid:7019)यकता(cid:7312) तथा पा(cid:7407)रि(cid:7021)थितक और पया(cid:6981)वरण स ेसंबंिधत
ऐसे अ(cid:7008)य पहलू(cid:7312), िजन पर (cid:7007)यान दने ा आव(cid:7019)यक ह,ै के िलए उपबंध ह(cid:7298)गे ।
(6) आंचिलक महायोजना सभी िव(cid:7378)मान पूजा (cid:7021) थल(cid:7298), (cid:7061)ाम(cid:7298) और नगरीय बंदोब(cid:7021)त(cid:7298), वन(cid:7298) के (cid:7079)कार और (cid:7408)क(cid:7021) म(cid:7298), कृिष (cid:6979)े(cid:7074)(cid:7298), ऊपजाऊ
भूिम, ह(cid:7407)रत (cid:6979)े(cid:7074) जैसे उ(cid:7378)ान और उसी (cid:7079)कार के (cid:7021) थान, उ(cid:7378)ान कृिष (cid:6979)े(cid:7074), फलोउ(cid:7378)ान, झील(cid:7298) और अ(cid:7008)य जल िनकाय(cid:7298) का अ(cid:7012)यकंन करेगी
और इस योजना के मानिच(cid:7074) (cid:7367)ारा िव(cid:7378)मान और (cid:7079)(cid:7021)तािवत भूिम के उपयोग का िववरण (cid:7408)कया जाएगा ।
(7) आंचिलक महायोजना (cid:7021) थानीय समुदाय(cid:7298) क(cid:7409) जीवकोपाज(cid:6981)न को सुिनि(cid:7019) चत करने के िलए, पा(cid:7407)रि(cid:7021)थितक संवेदी जोन म(cid:7286) िवकास को
पा(cid:7407)रि(cid:7021)थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।
(8) आंचिलक महायोजना इस अिधसूचना म(cid:7286) (cid:7408)दए गए उपबंध(cid:7298) के सबं ंध म(cid:7286) अपने काय(cid:7300) के बाहर ले जाने के िलए िनगरानी सिमित के िलए
एक संदभ(cid:6981) द(cid:7021)तावेज तैयार करेगी ।
3. रा(cid:6996)य सरकार (cid:7367)ारा (cid:7408)कए जान े वाल े उपाय-- रा(cid:6996)य सरकार इस अिधसूचना के उपबंध(cid:7298) को (cid:7079)भावी करने के िलए िन(cid:7388)िलिखत उपाय
करेगी, अथा(cid:6981)त्:--
(1) भ-ू उपयोग – (क) पा(cid:7407)रि(cid:7021) थितक संवेदी जोन म(cid:7286) वन(cid:7298), उ(cid:7378)ान-कृिष (cid:6979)े(cid:7074)(cid:7298), कृिष (cid:6979)े(cid:7074)(cid:7298), आमोद-(cid:7079)मोद के (cid:7079)योजन के िलए िचि(cid:7008)हत (cid:7408)कए
गए पाक(cid:7300) और खुले (cid:7021)थान(cid:7298) का वािणि(cid:6996)यक और औ(cid:7378)ोिगक संब(cid:7373) िवकास (cid:7408)(cid:7059)याकलाप(cid:7298) के िलए उपयोग या संप(cid:7407)रवत(cid:6981)न नह(cid:7277) होगा। मानिच(cid:7074)
के साथ आंचिलक महायोजना म(cid:7286) (cid:7021)प(cid:7397) (cid:7272)प से (cid:6979)े(cid:7074)(cid:7298) को िनधा(cid:6981)(cid:7407)रत (cid:7408)कया गया ह:ै
परंतु पा(cid:7407)रि(cid:7021)थितक संवेदी जोन के भीतर कृिष भूिम का संप(cid:7407)रवत(cid:6981)न मानीटरी सिमित क(cid:7409) िसफा(cid:7407)रश पर और रा(cid:6996)य सरकार के पूव(cid:6981)
अनुमोदन स,े रा(cid:6996)य सरकार के अ(cid:7008)य िनयम(cid:7298) और िविनयम(cid:7298) के (cid:7272)प म(cid:7286) लागू ह(cid:7298)गे, जो (cid:7021)थानीय िनवािसय(cid:7298) क(cid:7409) आवासीय ज(cid:7272)रत(cid:7298) को पूरा
करने के िलए ह,ै जैसे:-
(i) िव(cid:7378)मान सड़क(cid:7298) को चौड़ा करना और उ(cid:7008)ह(cid:7286) सुदढ़ृ करना तथा नई सड़क(cid:7298) का संिनमा(cid:6981)ण;
(ii) बुिनयादी ढांच(cid:7298) और नाग(cid:7407)रक सुिवधा(cid:7312) का संिनमाण(cid:6981) और नवीकरण;
(iii) (cid:7079)दषू ण उ(cid:7004)प(cid:7382) न करने वाले लघु उ(cid:7378)ोग;
(iv) कुटीर उ(cid:7378)ोग(cid:7298) िजसके अंतग(cid:6981)त (cid:7061)ामीण कारीगर ह(cid:7289); सुिवधाजनक भ(cid:7003)डार और (cid:7021)थानीय सुिवधा(cid:7312) सहायक पा(cid:7407)रि(cid:7021)थितक पय(cid:6981)टन म(cid:7286)
सि(cid:7013)मिलत (cid:7061)ह वास; और
(v) संव(cid:7414)ध(cid:6981)त (cid:7408)(cid:7059)याकलाप पैरा 4 के अधीन :
परंतु यह और भी (cid:7408)क (cid:6979)े(cid:7074)ीय नगर योजना अिधिनयम और अ(cid:7008)य िनयम(cid:7298) और िविनयम(cid:7298) के अंतग(cid:6981)त रा(cid:6996)य सरकार के पूव(cid:6981) अनुमोदन तथा
संिवधान के अनु(cid:6994)छेद 244 और त(cid:7004)समय (cid:7079)वृ(cid:7275) िविध के उपबंध(cid:7298) के अनुपालन के िबना, िजसके अंतग(cid:6981)त अनुसूिचत जनजाित और अ(cid:7008)य
परंपरागत वन िनवासी (वन अिधकार(cid:7298) क(cid:7409) मा(cid:7008)यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि(cid:6996)यक या उ(cid:7378)ोग िवकास (cid:7408)(cid:7059)याकलाप(cid:7298)
के िलए जनजातीय भूिम का उपयोग अनु(cid:6980)ात नह(cid:7277) होगा:
परंतु यह और भी (cid:7408)क पा(cid:7407)रि(cid:7021) थितक संवेदी जोन के भीतर भू-अिभलेख(cid:7298) म(cid:7286) उपसंजात कोई (cid:7074)ु(cid:7407)ट, मानीटरी सिमित के िवचार (cid:7079)ा(cid:7385) करने
के प(cid:7391)ात ् रा(cid:6996)य सरकार (cid:7367)ारा (cid:7079)(cid:7004)यके मामले म(cid:7286) एक बार संशोिधत होगी और उ(cid:7334) (cid:7074)ु(cid:7407)ट के संशोधन क(cid:7409) सूचना क(cid:7286)(cid:7076)ीय सरकार के पया(cid:6981)वरण,
वन और जलवायु प(cid:7407)रवत(cid:6981)न मं(cid:7074)ालय को दने ी होगी ।
परंतु यह और भी (cid:7408)क उपयु(cid:6981)(cid:7334) (cid:7074)ु(cid:7407)ट का संशोधन म(cid:7286) इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:7408)कसी भी दशा म(cid:7286) भू-उपयोग का
प(cid:7407)रवत(cid:6981)न सि(cid:7013)मिलत नह(cid:7277) होगा । परंतु यह और भी (cid:7408)क िजससे ह(cid:7407)रत (cid:6979)े(cid:7074) म(cid:7286) जैसे वन (cid:6979)े(cid:7074), कृिष (cid:6979)े(cid:7074) आ(cid:7408)द म(cid:7286) कोई पा(cid:7407)रणािमक कटौती नह(cid:7277)
होगी और अन(cid:7079)यु(cid:6989) त या अनु(cid:7004) पादक कृिष (cid:6979)े(cid:7074)(cid:7298) म(cid:7286) पुन: वनीकरण करने के (cid:7079)यास (cid:7408)कए जाएंगे ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(2) (cid:7079)ाकृितक जल (cid:7090)ोत -- आचंिलक महायोजना म(cid:7286) सभी (cid:7079)ाकृितक जल (cid:7090)ोत(cid:7298) क(cid:7409) पहचान क(cid:7409) जाएगी और उनके संर(cid:6979)ण और
पुन(cid:7271)(cid:7006)भूतकरण के िलए योजना सि(cid:7013) मिलत होगी और रा(cid:6996) य सरकार (cid:7367)ारा ऐसे (cid:6979)े(cid:7074)(cid:7298) पर या उनके िनकट िवकास (cid:7408)(cid:7059)याकलाप (cid:7079)ितिष(cid:7373) करने

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE
NOTIFICATION
New Delhi, the 17th April, 2017
S.O.1191(E).—WHEREAS, a draft notification, declaring Eco-sensitive Zone around Sitamata Wildlife
Sanctuary in Rajasthan, was published in the Gazette of India, Extraordinary, (cid:118)(cid:100)(cid:105)(cid:101) notification of the Government of
India in the Ministry of Environment, Forest and Climate Change number S.O. 2871 (E), dated the 19th October 2015,
inviting objections and suggestions from all persons likely to be affected thereby within a period of sixty days from the
date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the said notification were made available to the public on the 19th
October 2015;
AND WHEREAS, objections and suggestions received from all persons and stakeholders in response to the draft
notification have been duly considered by the Central Government;
AND WHEREAS, the Sitamata Wildlife Sanctuary situated in the South-East region of the State of Rajasthan in
Chittorgarh and Pratapgarh districts at the junction of the Aravalli hill range, Vindhyan hill range and the Malwa Plateau
and lying between 740 23’ E– 74040’ E longitude and 240 04’ N to 24023’ N latitude and spread over an area of 422.94
sq.kms was notified as a sanctuary in the year 1979 vide Government of Rajasthan notification No. F 11 (9) Revenue/
Group-8/78 Jaipur, dated the 2nd January, 1979;
AND WHERAS, Sitamata Wildlife Sanctuary forms the north -west limit for the teak-bamboo mixed forest and the
species associated with it is one of the richest Sanctuary of flora and fauna; nearly 50 species of reptiles, 9 species of
Amphibians, 275 species of birds and 30 species of fishes listed so far from the said Sanctuary; Sitamata Wildlife
Sanctuary is a habitat of 800 species of plants out of which 108 species of medicinal plants are already identified
including 13 species of the endangered medicinal plants issued by the National Medicinal Plant Board, New-Delhi;
AND WHEREAS this protected area, with its comparatively less undulating terrain and three perennial (Jakham,
Sitamata and Karmoi) rivers provide habitat for the tropical moist deciduous plant species, which form micro habitat for
the Aravalli Red Spur Fowl, Grey Jungle Fowl, Flying Squirrel and several other species of flora and fauna and is
unique as it forms the distribution limit for many of species that have moved from Himalayas, Indo-Malayan and African
regions, in addition to the elements from Western Ghats;
AND WHEREAS, it is necessary to regulate certain activities detrimental to the conservation of flora and fauna in the
Sitamata Wildlife Sanctuary from environmental point of view, by declaring the Eco-sensitive Zone around it.
NOW THEREFORE, in exercise of powers conferred in sub-section (1) read with clause (V) and clause (xiv) of sub-
section (2) and sub-section (3) of section 3 of Environment (Protection) Act, 1986 (29 of 1986) and sub-rule (3) of rule 5
of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extant of 0.5 to 3¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15
kilometers around the boundary of the Sitamata Wildlife Sanctuary as Sitamata Wildlife Sanctuary Eco-sensitive Zone
(herein after referred to as the Eco sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-Sensitive Zone is spread over an area 172.45 square
kilometers around the boundary of Sitamata Wildlife Sanctuary and the boundary description of the said Zone is given in
Annexure-I.
(2) The map of the Eco-sensitive Zone is appended as Annexure-II.
(3) The details of Geographical Positioning System coordinates of the points along the boundary of the Sitamata
Wilidlife Sanctuary and its Eco-sensitive Zone are appended as Annexure-III.
(4) The Eco-sensitive Zone is spread across 58 villages falling in Chittorgarh, Pratapgarh and Udaipur districts of
Rajasthan.
(5) The list of villages falling within Eco-sensitive Zone is appended as Annexure-IV.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive
Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the
Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for
consideration and approval of the Competent authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is
specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued
by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating
the ecological and environmental considerations into the said plan, namely:-
(i)(cid:32) Environment;
(ii)(cid:32) Forest and Wildlife;
(iii)(cid:32) Agriculture;
(iv)(cid:32) Revenue;
(v)(cid:32) Urban Development;
(vi)(cid:32) Tourism;
(vii)(cid:32) Rural Development;
(viii)(cid:32) Irrigation and Flood Control;
(ix)(cid:32) Municipal;
(x)(cid:32) Panchayati Raj;
(xi)(cid:32) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and
activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all
infrastructure and activities to be more efficient and Eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water
bodies, management of catchment areas, watershed management, groundwater management, soil and moisture
conservation, needs of local community and such other aspects of the ecology and environment that need
attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban
settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places,
horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported
by maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly
development for livelihood security of local communities.
(8) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its
functions of monitoring under the provisions of this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Land use.-
(a)(cid:32) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-
sensitive Zone shall not be used or converted into areas for commercial or industrial activities:16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Provided that the conversion of agricultural and other lands within the Eco-sensitive Zone may be permitted on
the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential needs of the local residents, and for the activities such as-
(i)(cid:32) widening and strengthening of existing roads and construction of new roads;
(ii)(cid:32) construction and renovation of infrastructure and civic amenities;
(iii)(cid:32) small scale industries not causing pollution;
(iv)(cid:32) cottage industries including village industries; convenience stores and local amenities supporting
eco-tourism including home stay; and
(v)(cid:32) promoted activities given under paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the of the State Government and without compliance of the provisions of
article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other
Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of
said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat
restoration activities.
(2) Natural springs.- The catchment areas of all natural springs shall be identified and plans for their conservation
and rejuvenation shall be incorporated in the Zonal Master Plan and the guidlines shall be drawn up by the State
Government in such a manner as to prohibit development activities at or near these areas as which are detrimental to such
areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-Sensitive Zone shall be as per the Tourism Master
Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of
Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of Eco-tourism shall be regulated as under, namely:-
(i)(cid:32) no new construction of hotels and resorts shall be allowed within one kilometers from the boundary of
the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer:
Provided that beyond the distance of one kilometers from the boundary of the Wildlife Sanctuary
till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted
only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in
accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and
Climate Change and the Eco-tourism guidelines issued by National Tiger Conservation Authority (as amended
from time to time) with emphasis on Eco-tourism, Eco-education and Eco-development and based on carrying
capacity study of the Eco-sensitive Zone;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities
shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and
recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and
preserved and plan shall be drawn up for protection and conservation, within six months from the date of publication of
this notification in the official Gazette and such plan shall for part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be
prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17
(6) Noise pollution.- The Environment Department of the State Government or State Pollution Control Board shall
implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of
the Noise Pollution (Regulation And Control) Rules, 2000 made under the Environment (Protection) Act, 1986.
(7) Air pollution.- The Environment Department of the State Government or State Pollution Control Board shall
draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the
provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974) and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid
Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and
Climate Change (cid:118)(cid:100)(cid:105)(cid:101) notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable
components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-
sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in
accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of
India in the Ministry of Environment, Forest and Climate Change (cid:118)(cid:100)(cid:105)(cid:101) notification number G.S.R 343 (E), dated the 28th
March, 2016, as amended from time to time.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per
the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of
Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016, as
amended from time to time.
(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the
Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management
Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide
notification number G.S.R 317 (E), dated the 29th March, 2016, as amended from time to time.
(13) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and
specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master
plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall
monitor compliance of vehicular movement under the relevant Act and the rules and regulations made thereunder.
(14) Industrial units.- (i) No new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries may be allowed be established within Eco-sensitive Zone in accordance with the
Central Pollution Control Board’s categorisation.
(15) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction may be permitted.
(b) No construction on steep hill slopes or slopes with a high degree of erosion shall be permitted.
4. Prohibited, Regulated and Promoted Activities.- All activities in the Eco sensitive Zone shall be governed by
the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and be regulated in
the manner specified in the Table below, namely:-

12. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted
within one kilometer of the boundary of the protected
area or up to the extent of Eco-sensitive Zone, whichever
is nearer, except for small temporary structures for Eco-
tourism activities:
Provided that, beyond one kilometer from the boundary
of the protected area or upto the extent of Eco-sensitive
Zone whichever is nearer, all new tourist activities or
expansion of existing activities shall be in conformity
with the Tourism Master Plan and guidelines as
applicable.
13. Construction activities. (a) No new commercial construction of any kind shall be
permitted within one Kilometers from the boundary of
the protected area or upto extent of the Eco-sensitive
Zone whichever is nearer:
Provided that, local people shall be permitted to
undertake construction in their land for their use
including the activities listed in sub paragraph (1) of
paragraph 3 as per building byelaws.
(b) The construction activity related to small scale
industries not causing pollution shall be regulated and
kept at the minimum, with the prior permission from the
competent authority as per applicable rules and¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19
regulations, if any.
14. Extraction of ground water Regulated under applicable laws to meet the drinking
water or agricultural requirement of locals.
15. Felling of trees. (a) There shall be no felling of trees on the forest or

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective
monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(i) District Collector, Pratapgarh - (cid:104)(cid:67)(cid:97)(cid:109)(cid:97)(cid:114)(cid:105)(cid:110)(cid:59)
(ii) District level officer of Public Works Department - Member;
(iii) District level officer of Town Planning Department - Member;
(iv) District level officer of Industries Department - Member;
(v) Regional officer, Rajasthan State Pollution Control Board - Member;
(vi) An expert in the area of ecology and environment to be
nominated by the Government of Rajasthan for a period
of three year. - Member;
(vii) A representative of Non-Governmental Organisation working in
the field of environment to be nominated by the Government of
Rajasthan for a period of one year - Member;
(viii) Member of State Biodiversity Board- - Member;
(ix) Honorary wild life warden - Member(cid:59)
(x) Deputy Conservator of Forests, Sitamata Wildlife Sanctuary - Member-Secretary

6. Terms of reference.- (1) The tenure of the Monitoring Committee shall be for three years.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in
the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,
shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to
the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental
clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21
falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph
4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and
referred to the concerned Regulatory Authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Collectors or the concerned park
Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment
(Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned departments, representatives
from industry associations or concerned stakeholders to assist in its deliberations depending on the
requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of
every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at
Annexure-V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or the National Green Tribunal.
