उ(cid:6989) त अिधसूचना क(cid:7409) (cid:7079)ितयां जन साधारण को 25 जून, 2015 को उपल(cid:7011) ध कराई गई थी; क(cid:7286)(cid:7076)ीय सरकार (cid:7367)ारा उपरो(cid:6989) त (cid:7079)ा(cid:7272)प अिधसूचना के उ(cid:7004) तर म (cid:7286)(cid:7079)ा(cid:7009) त आ(cid:6979)पे (cid:7298) और सुझाव(cid:7298) क(cid:7409) परी(cid:6979)ा क(cid:7409) गई ह;ै अत: क(cid:7286)(cid:7076)ीय सरकार, पया(cid:6981)वरण (संर(cid:6979)ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के खंड (घ) के साथ प(cid:7407)ठत पया(cid:6981)वरण (संर(cid:6979)ण) अिधिनयम, 1986 (1986 का 29) क(cid:7409) धारा 3 क(cid:7409) उपधारा (1) और उपधारा (2) के खंड (v) (cid:7367)ारा (cid:7079)द(cid:7004) त शि(cid:6989)त य(cid:7298) का (cid:7079)योग करते (cid:7263)ए तटीय िविनयम जोन अिधसूचना, 2011 म (cid:7286) िन(cid:7013) निलिखत और संशोधन करती ह,ै अथा(cid:6981)त ्:— उ(cid:6989) त तटीय िविनयम जोन अिधसूचना, 2011 म,(cid:7286) - (क) पैरा 3 म(cid:7286), - उपपरै ा (iv) म(cid:7286) मद (क) के (cid:7021)थ ान पर िन(cid:7013) निलिखत मद रखी जाएगी, अथा(cid:6981)त ्:— “(क) प(cid:7004) तन, बंदरगाह, जेटी, घाट, जहाजी घाट, जलावतरण-मंच, पलु , सी(cid:7410)लग, ि(cid:7021) ट(cid:7016) ट पर सड़क, सुधारे (cid:7263)ए धरातल पर सड़क र(cid:6979)ा और सरु (cid:6979)ा (cid:7079)योजन(cid:7298) के िलए अिभ(cid:7079)ते और अ(cid:7008) य सुिवधा(cid:7312) जो अिधसूचना के अधीन अनु(cid:6980)ेय (cid:7408)(cid:7059)याकलाप(cid:7298) के िलए आव(cid:7019) यक ह ै जैसी तटा(cid:7061) सुिवधा(cid:7312) क(cid:7409) (cid:7021)थ ापना, िविनमा(cid:6981)ण या आधुिनक(cid:7409)करण या िव(cid:7021) तार के िलए अपेि(cid:6979)त: 5495 GI/2015 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंत ु ऐसी सड़के िव(cid:7378)मान हाइ टाइड लाइन तक ऐसी सड़क(cid:7298) के लड(cid:7286) वाड (cid:6981) साइड पर िवकास अनु(cid:6980)ात करन े हते ु यथा(cid:7079)ािधकृत नह(cid:7277) मानी जाएगी : परंतु यह और (cid:7408)क (cid:7408)कसी औ(cid:7378)ोिगक (cid:7079)चालन, मर(cid:7013) मत और अनुर(cid:6979)ण के िसवाय, सुधारी गई भूिम का उपयोग ऐसे सड़क(cid:7298) के ल(cid:7286)ड वाड(cid:6981) साइड पर सड़क(cid:7298), मास रैिपड या म(cid:7016)ट ीमॉडल (cid:7069)ांिज़ट (cid:7079)णाली, िविनमा(cid:6981)ण और (cid:7021) थापन, ऐसी (cid:7069)ांिजट या प(cid:7407)रवहन (cid:7079)णाली िजसके अंतग(cid:6981)त वै(cid:7378)ुत या इलै(cid:6989) (cid:7069)ािनक िसगनल (cid:7079)णाली, अनु(cid:6980)ात िडजाइन(cid:7298) के (cid:7069)ांिजट (cid:7021) टाक ओवर ह,(cid:7289) सभी आव(cid:7019) यक सहब(cid:7373) जनउपयोिगता(cid:7312) और अवसंरचना के िलए अनु(cid:6980)ात क(cid:7409) जा सकेगी ।”; (ख) परै ा 4 म,(cid:7286) उप परै ा (i) म(cid:7286), मद (च) के प(cid:7019) चात ् िन(cid:7013) निलिखत मद अंत:(cid:7021)थ ािपत क(cid:7409) जाएगी, अथात(cid:6981) ् :— “(छ) सीआरजैड (cid:6979)े(cid:7074) म(cid:7286) सुधार (cid:7367)ारा सड़क का िविनमा(cid:6981)ण केवल आपवा(cid:7408)दक मामल(cid:7298) म(cid:7286), सबं ंिधत तटीय जोन (cid:7079)बंधन (cid:7079)ािधकरण क(cid:7409) िसफा(cid:7407)रश पर और पया(cid:6981)वरण, वन और जलवायु प(cid:7407)रवत(cid:6981)न मं(cid:7074)ालय (cid:7367)ारा अनुमो(cid:7408)दत होगा; और य(cid:7408)द ऐसी सड़क का िनमा(cid:6981)ण क(cid:6994) छ वन(cid:7021) पित म (cid:7286) से होकर गुजर रहा हो या क(cid:6994) छ वन(cid:7021)प ित का संभािवत (cid:6979)ित प(cid:7263)चं ान े वाला हो, िविनमा(cid:6981)ण (cid:7079)(cid:7408)(cid:7059)या के दौरान (cid:6979)ित(cid:7061)(cid:7021) त क(cid:6994)छ वन(cid:7021) पित या काटी गई वन(cid:7021)प ित का तीन गुणा पुन:रोिपत (cid:7408)कया जाएगा ।”; और 5.(cid:32) का. आ. 556 (अ), तारीख 17 फरवरी,2015; 6.(cid:32) का. आ. 938 (अ), तारीख 31 माच(cid:6981), 2015 7.(cid:32) का. आ. 1599 (अ), तारीख 16 जून, 2015 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 30th December, 2015 S.O. 3552(E).—Whereas, a draft notification under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 for making certain amendments in the Coastal Regulation Zone Notification, 2011, issued vide number S.O. 19(E), dated the 6th January, 2011, was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) vide number S.O. 1741(E) dated the 25th June, 2015 inviting objections and suggestions from all persons likely to be affected thereby within a period of sixty days from the date on which copies of Gazette containing the said notification were made available to the public; And whereas, copies of the said notification were made available to the public on 25th June, 2015; And whereas, the objections and suggestions received in response to the above draft notification have been examined by the Central Government;¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with clause (d) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following further amendments in the Coastal Regulation Zone Notification, 2011, namely:— In the said Coastal Regulation Zone Notification, 2011 ,- (a)(cid:32) in paragraph 3, in sub-paragraph (iv), for item (a), the following item shall be substituted, namely:- “ (a) required for setting up, construction or modernisation or expansion of foreshore facilities like ports, harbours, jetties, wharves, quays, slipways, bridges, sealink, road on stilts, road on reclaimed surface, and such as meant for defence and security purpose and for other facilities that are essential for activities permissible under the notification: Provided that such roads shall not be taken as authorised for permitting development on landward side of such roads till existing High Tide Line. Provided further that the use of reclaimed land may be permitted for roads, mass rapid or multimodal transit system, construction and installation, on landward side of such roads, of all necessary associated public utilities and infrastructure to operate such transit or transport system including those for electrical or electronic signal system, transit stopover of permitted designs; except for any industrial operation, repair and maintenance.” ; (b)(cid:32) in paragraph 4, in sub-paragraph (i), after item (f), the following item shall be inserted, namely: “(g) construction of road by way of reclamation in CRZ area shall be only in exceptional cases, to be recommended by the concerned Coastal Zone Management Authority and approved by the Ministry of Environment, Forest and Climate Change; and in case the construction of such road is passing through mangroves or likely to damage the mangroves, three times the number of mangroves destroyed or cut during the construction process shall be replanted.”; (c ) in the said notification, after Annexure-IV, Form-1, the following shall be inserted, namely:— Explanation:- For the purpose of the notification, the word “existing” used in the said notification shall mean existence of the features or regularization or norms as on 19th February, 1991 wherein CRZ notification, was notified.” [F.
