का भाग II, खंड 3, ईपखंड (ii) ताररख 8 जनवरी, 2016 को प्रकाधित की गइ थी धजसमें ईन सभी व्यधियों से, धजनके ईसस े प्रभाधवत होने की संभावना थी, ईस तारीख स,े धजसको ईि ऄधधसूचना की राजपत्र की प्रधतयां जनता को ईपलब्ध करा दी गइ थी, साठ ददन की ऄवधध के भीतर, अक्षेप और सुझाव अमंधत्रत दकग गग थ;े और, ईि प्रारुप ऄधधसूचना युि राजपत्र की प्रधतयां जनता को 22 ददसम्बर,2015 को ईपलब्ध करा दी गइ थी; और, ईि प्रारुप ऄधधसूचना के प्रत्युत्तर में व्यधियों और पणधाररयों से कोइ टीका रटप्पधणयां/अक्षेप और सुक्षाव प्राप्त नहीं हुग थ;े और, वेलावेदार ब्लैक बक राष्ट्रीय ईद्यान गुजरात के भाव नगर धजले में धथथत 39.34 वगा दकलोमीटर क्षेत्र में फैला हुअ ह ै और गुजरात राज्य में भावनगर धजले के भावनगर तालुका/तहसील के ईत्तरी भाग में ऄक्षांि 4209 GI/2017 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 2156’ ह:ैं धजन्जो (ददचीथयु ुमानुलेटम), धरणट (थपोरोबोलुधथवर्ज़िधनकस), मोधत धरण्त (थपोरोबोलुसमात्रपैटेंधसस), चादकमाकी (थपोरोबोलुसकोमेंडधेलयानस), ममडडो (क्लोररस वगााटा), डले , डले ो (गयूरोपूथलोगोपाआड), कांग (सैदररयालोग्का), धंध (गरग्राधथटस जापानोधनका), थमेप (धथमेदधत्रद्र), घवली (आसामेमुगोसुम), पाडू (डक्ैटाआलोक्टेधनयममाआधजकीकुन), वदृ (आसेआलामाथाहफे ोराआड्स) अदद; और, राष्ट्रीय ईद्यान में प्रमुख जीवजन्तु जैसे प फस पुच्छ खरगोि (धलपस गनअइजीररकोधलधसफोडाडटेस), रेधगथतान खरगोि (धलपस गनअइजीक्रोधलसडनेस), भेधडया (कैधनस ल्यूपस पधल्लप्स), धसयार (कैधनस ऑररयस), भारतीय भेधडया (वुलप्सबगैंलेंधसस), सामान्य नेवला (हपेेथटेसेडडेसा), ब्लैक बेक (गन्टीपेकरवीकरपा), ब्लू बलु (बोसेलाफथरगोकेमलस), भारतीय बनैला सूऄर (सथथकोरोफा), पांच धारीदार ख्थकोली (दणनमबुलुसपेननाइ), डजे टा गेरधबल (टेरटेरेनधडका), जंगल धबल्ली (फेधलिौस), ग्रे कथतूरी ककाि (सनथकुसमुररनस), डजे टा धबल्ली (फेधलधथलब्का) अदद ह;ैं और, ब्लैक बक राष्ट्रीय ईद्यान की संपूणा प्राकृधतक आकाइ, धजसके ऄंतगात ऄविेष तटीय घास थथल पाररधथथधतकी प्रणाली और आसके सहयोगी बायोटा धजसके ऄंतगात ईच्च लुप्तप्राय प्रजाधतयों के धलग सतत सरं क्षण प्रयास भी ह।ै और, वेलावेदार ब्लैक बक राष्ट्रीय ईद्यान के चारों ओर के क्षेत्र को, धजसका धवथतार और सीमाग ं आस ऄधधसूचना के पैरा 1 में धवधनर्ददष्ट ह,ैं पयाावरण की दधृ ष्ट से पाररधथथधतक संवेदी जोन के प प में सुरधक्षत और संरधक्षत करना तथा ईि पाररधथथधतक संवेदी जोन में अनुवंधिक संसाधनों को बनाग रखने और प्रजनन कायक्रा मों के माध्यम से थथानीय प्रजाधतयों के पुनवाास, पयाावरण धिक्षा और पाररधथथधतक ऄनुसंधान को बढावा दने े और ईद्योगों या ईद्योगों के वगो के प्रचालन तथा प्रसंथकरण प्रधतधषद्ध करना अवश्यक है; ऄतः, ऄब, केन्द्रीय सरकार, पयाावरण (संरक्षण) धनयम, 1986 के धनयम 5 के ईपधनयम (3) के साथ परठत पयाावरण (संरक्षण) ऄधधधनयम, 1986 (1986 का 29) की धारा 3 की ईपधारा (1), ईपधारा (2) के खंड (v) और खंड (xiv) और ईप-धारा (3) द्वारा प्रदत्त िधियों का प्रयोग करते हुग, गुजरात राज्य में वेलावेदार ब्लैक बक राष्ट्रीय ईद्यान की सीमा के चारों ओर 1.0 दकलोमीटर से 3.70 दकलोमीटर तक के धवथ ताररत क्षेत्र को वेलावेदार ब्लैक बक राष्ट्रीय ईद्यान पाररधथथ धतक संवेदी जोन (धजस े आसमें आसके पश्च ात् पाररधथथ धतक संवेदी जोन कहा गया ह)ै के प प में ऄधधसूधचत करती ह,ै धजसका धववरण धनम्नानुसार ह,ै ऄथाात् :-- 1. पाररधथथधतक सवं ेदी जोन का धवथतार और ईसकी सीमाग-ं (1) वेलावेदार ब्लैक बक राष्ट्रीय ईद्यान के पाररधथथधतक संवेदी जोन का धवथतार 1.0 दकलोमीटर से 3.70 दकलोमीटर तक ह ै और आसका क्षेत्र 43.57 वगा दकलोमीटर में फैला हुअ ह ै |II (ii) 3 (2) वेलावेदार ब्लैक बक राष्ट्रीय ईद्यान और ईसके पाररधथथधतक संवेदी जोन तथा ऄक्षांि और दिे ान्तर के साथ का मानधच त्र ईपाबधं I क और ईपाबधं I-ख के रुप में ईपाबद्ध ह ै | (3) राष्ट्रीय ईद्यान और आसका पाररधथथधतक संवेदी जोन के साथ सीमा ब्यौरा ईपाबधं II के रुप में ईपाबद्ध ह ै | (4) संरधक्षत क्षेत्र के भू-धनदिे ांक और पाररधथथधतक संवदे ी जोन के भू-धनदिे ांक ईपाबधं III के रुप में ईपाबद्ध ह ै | (5) पाररधथथधतक संवेदी जोन में अने वाले ग्रामों की सूची ईपाबधं IV के रुप में ईपाबद्ध ह ै | 2. पाररधथथधतक सवं ेदी जोन के धलग अचं धलक महायोजना – (1) राज्य सरकार, पाररधथथ धतक संवेदी जोन के प्रयोजन के धलग राजपत्र में आस ऄधधसूचना के प्रकािन की तारीख से दो वषा की ऄवधध के भीतर, थथानीय व्यधियों के परामिा से और आस ऄधधसूचना में ददग गग ऄनुबंधों का पालन करके अंचधलक महायोजना तैयार करेगी। (2) अंचधलक महायोजना राज् य सरकार में सक्षम प्राधधकारी द्वारा ऄनुमोददत होगी । (3) पाररधथथ धतक संवेदी जोन के धलग अंचधलक महायोजना, राज् य सरकार द्वारा आस ऄधधसूचना में धवधनर्दद्‍ ट प प में ऐसी रीधत में तथा सुसंगत केंद्रीय और राज् य धवधधयों के ऄनुरुप भी तथा केंद्रीय सरकार द्वारा जारी मागाधनदिे , यदद कोइ हों, द्वारा तैयार होगी । (4) अंचधलक महायोजना, ईि योजना में पयाावरणीय और पाररधथथ धतक बातों को समाकधलत करन े के धलग राज् य के धनम्नधलधखत धवभागों के परामिा से तैयार होगी, ऄथाात्:-- (i) पयाावरण; (ii) वन और वन्यजीव; (iii) कृधष ; (iv) राजथव ; (v) नगर धवकास; (vi) पयाटन; (vii) ग्रामीण धवकास; (viii) मसचाइ और बाढ धनयंत्रण; (ix) नगरपाधलका; (x) पंचायती राज; और (xi) लोक धन मााण धव भाग। (5) ईि महायोजना म ें जब तक आस ऄधधसूचना में ऐसा धवर्जनददष्ट न हो तब तक ऄनमु ोददत धवद्यमान भू- ईपयोग, ऄवसंरचना और दक्रयाकलापों पर कोइ धनबाधन ऄधधरोधपत नहीं दकया जागगा और अंचधलक महायोजना सभी ऄवसंरचना के सुधार और ऄधधक दक्ष तथा पाररधथथधतकी ऄनुकूल होने वाले दक्रयाकलाप आस प्रकार धवधनददष्ट न हो।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (6) अंचधलक महायोजना में ऄनाच्छाददत क्षेत्रों के जीणोद्धार, धवद्यमान जल धनकायों के संरक्षण, अवाह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भू-जल के प्रबंधन, मदृ ा और नमी सरं क्षण, थथानीय समुदायों की अवश्यकताओं तथा पाररधथथधतक और पयाावरण से संबंधधत ऐसे ऄन्य पहलूओं, धजन पर ध्यान दने ा अवश्यक ह,ै के धलग ईपबंध होंगे । (7) अंचधलक महायोजना सभी धवद्यमान पूजा थथ लों, ग्रामों और नगरीय बंदोबथतों, वनों के प्रकार और दकथम ों, कृधष क्षेत्रों, उपजाउ भूधम, हररत क्षेत्र जैस े ईद्यान और ईसी प्रकार के थथ ान, ईद्यान कृधष क्षेत्र, अर्दकडों, झीलों और ऄन्य जल धनकायों का ऄभ्यकंन करेगी । (8) अंचधलक महायोजना पाररधथथधतक संवेदी जोन में धवकास को धवधनयधमत करेगी धजससे पाररधथथधतक ऄनुकूल धवकास थथानीय समुदायों की जीवकोपाजान सुरक्षा के धलग सुधनधित दकया जा सके । (9) ऐसी ऄनुमोददत अंचधलक महायोजना आस ऄधधसचू ना में ददग गग ईपबंधों के ऄनुसार ऄपने कृत्यों का पालन करन े के धलग मानीटरी सधमधत के धलग गक संदभा दथतावेज होगी । 3. राज्य सरकार द्वारा दकग जान े वाल े ईपाय--राज्य सरकार आस ऄधधसूचना के ईपबंधों को प्रभावी करने के धलग धनम्नधलधखत ईपाय करेगी, ऄथाात:् -- (1) भ-ू ईपयोग- पाररधथथधतक संवेदी जोन म ें अमोद-प्रमोद के प्रयोजन के धलग धचधन्हत दकग गग ह ैं वनों, ईद्यान- कृधष क्षेत्रों, कृधष क्षेत्रों, पाको और खुल े थथानों का वाधणधज्यक और औद्योधगक संबद्ध धवकास दक्रयाकलापों के धलग ईपयोग या संपररवतान नहीं होगा : परंतु पाररधथथधतक संवेदी जोन के भीतर कृधष भूधम का संपररवतान, मानीटरी सधमधत की धसफाररि पर और राज्य सरकार के पूवा ऄनुमोदन से, थथानीय धनवाधसयों की ऄवासीय जप रतों को पूरा करने के धलग ऄनुज्ञात होग,ें ऄथाात् :- (i) धवद्यमान सडकों को चौडा करना और ईनका सुदढृ ीकरण करना और नइ सडकों का संधनमााण; (ii) बुधनयादी ढांचों और नागररक सुधवधाओं का संधनमााण और नवीकरण; (iii) प्रदषू ण ईत्पन्न न करन े वाले लघु ईद्योग; (iv) कुटीर ईद्योगों धजनके ऄंतगात ग्रामीण ईद्योग सुधवधा भण्डार और थथानीय सधु वधाऐं और धजसके ऄंतगात सहायक पाररधथथधतक पयाटन भी ह ै तथा धजसके ऄंतगता ग्रह वास भी है; और (v) पैरा 7 के ऄधीन संवर्जधत दक्रयाकलाप में ददये गग ह:ै परंतु यह और दक राज्य सरकार के पूवा ऄनुमोदन तथा संधवधान के ऄनुच्छेद 244 या तत्समय प्रवृत्त धवधध के ईपबंधों के ऄनुपालन के धबना, धजसके ऄंतगात ऄनसु ूधचत जनजाधत और ऄन्य परंपरागत वन धनवासी (वन ऄधधकारों की मान्यता) ऄधधधनयम, 2006 (2007 का 2) भी ह,ै वाधणधज्यक या ईद्योग धवकास दक्रयाकलापों के धलग जनजातीय भूधम का ईपयोग ऄनुज्ञात नहीं होगा:II (ii) 5 परंतु यह और भी दक पाररधथथ धतक संवेदी जोन के भीतर भू-ऄधभलेखों में ईपसंजात कोइ त्रुरट, मानीटरी सधमधत के धवचार प्राप्त करन े के पिात् राज्य सरकार द्वारा प्रत्येक मामले में गक बार संिोधधत होगी और ईि त्रुरट के संिोधन की सूचना केंद्रीय सरकार के पयाावरण, वन और जलवायु पररवतना मंत्रालय को दने ी होगी : परंतु यह और भी दक ईपयुाि त्रुरट के संिोधन में आस ईप-पैरा के ऄधीन यथा-ईपबंधधत के धसवाय दकसी भी दिा में भू-ईपयोग का पररवतान सधम्मधलत नहीं होगा । (ख) वनीकरण तथा वास जीणोद्धार दक्रयाकलापों सधहत ऄनप्रयुक् त या ऄनुत् पादक कृधष क्षेत्रों में पुन: वनीकरण करने के प्रयास दकग जागगं े । (2) प्राकृधतक जल स्रोत -- अचंधलक महायोजना में सभी प्राकृधतक जल स्रोतों के ऄवाह क्षेत्रों की जागगी और ईनके संरक्षण और नवीनीकरण के धलग योजना सधम् मधलत होगी राज्य सरकार द्वारा आन क्षत्रे ों पर या ईनके धनकट धवकास दक्रयाकलापों, जो ऐसे क्षेत्रों के धलग हाधनकारक ह,ै को प्रधतधषद्ध करने के धलग ऐसी रीधत से मागाधनदिे तैयार करेगा। (3) पयटा न/पाररधथथधतक पयटा न – (क) पाररधथथधतक संवेदी जोन के भीतर सभी नग पाररधथथधतक पयाटन दक्रयाकलाप या धवद्यमान पयाटन दक्रयाकलापों का धवथतार पयाटन महायोजना के ऄनसु ार पाररधथथधतक संवेदी जोन के धलग होगा । (ख) पयाटन महायोजना, पयाटन धवभाग, द्वारा राज्य पयाावरण और वन धवभाग के परामिा से तैयार होगी । (ग) पयाटन महायोजना अंचधलक महायोजना का भाग प प में होगी । (घ) पाररधथथधतक पयाटन सबं ंधी दक्रयाकलाप धनम्नानुसार धवधनयधमत होंगे, ऄथाात् :- (i) वेलावेदार ब्लैक बक राष्ट्रीय पाका की सीमा स े गक दकलोमीटर के भीतर या पाररधथथधतक संवेदी जोन के धवथतार तक, आनमें जो भी धनकट ह,ै नये वाधणधज्यक होटल और ररसोटा ऄनुज्ञात नहीं होंगे। ईि पाका की सीमा से गक दकलोमीटर की दरू ी से परे केवल पाररधथथधतक संवेदी जोन के धवथतार तक होटलों और सैरगाहों की थथापना पूवा पररभाधषत पदाधभधहत क्षेत्रों में पयाटन महायोजना के ऄनुसार पाररधथथधतक पयाटन सुधवधाओं के धलग ही ऄनुज्ञात की जागगी; (ii) पाररधथथधतक संवेदी जोन के भीतर सभी नग पयाटन दक्रयाकलापों या धवद्यमान पयाटन दक्रयाकलापों का धवथतार केंद्रीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय द्वारा मागादिाक धसद्धांतों तथा द्वारा जारी पाररधथथधतक पयाटन (समय-समय पर यथा-संिोधधत) मागादिाक धसद्धांतों के ऄनुसार, पाररधथथधतक पयाटन, को महत्व दते े होगा; (iii) अंचधलक महायोजना का ऄनुमोदन दकग जाने तक, पयाटन के धलग धवकास और धवद्यमान पयाटन दक्रयाकलापों के धवथतार को वाथतधवक थथल धवधनर्ददष्ट संवीक्षा तथा मानीटरी सधमधत की धसफाररि पर अधाररत संबंधधत धवधनयामक प्राधधकरणों द्वारा ऄनुज्ञात दकया जागगा और पाररधथथधतक संवेदी जोन म ें दकसी नग होटल/सरै गाह या वाधणधज्यक थथापन के संधनमााण को ऄनुज्ञात नहीं दकया जागगा। (4) नसै र्जगक धवरासत -- पाररधथथधतक संवेदी जोन में महत्वपूणा नैसर्जगक धवरासत के सभी थथलों जैस े सभी जीन कोि अरधक्षत क्षेत्र, िैल धवरचनाग,ं जल प्रपातों, झरनों, घाटी मागों, ईपवनों, गुफाग,ं थथलों, भ्रमण, ऄश्वरोहण, प्रपातों अदद की पहचान की जागगी और धवरासत संरक्षण योजना अंचधलक महायोजना के भाग के रुप में ईनके परररक्षण तथा संरक्षण के धलग तैयार की जागगी ।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (5) मानव धनर्जमत धवरासत थथ ल - पाररधथथ धतक संवदे ी जोन में भवनों, संरचनाओं, धिल्प-तथ्य, ऐधतहाधसक, कलात्मक और सांथकृधतक महत्व के क्षेत्रों की पहचान भी होगी और ईनके सरं क्षण के धलग धवरासत सरं क्षण योजना अंचधलक महायोजना के भाग के रुप में तैयार की जागगी । (6) ध्व धन प्रदषू ण -- पयाावरण (संरक्षण) ऄधधधनयम 1986 और ईसके संिोधनों के ऄधीन ध्वधन प्रदषू ण (धवधनयमन और धनयंत्रण) धनयम, 2000 के ऄनुसार पाररधथथधतक सवं ेदी जोन में ध्वधन प्रदषू ण को कायााधन्वत दकया जागगा । (7) वाय ु प्रदषू ण -- पाररधथथधतक संवेदी जोन में, वायु प्रदषू ण के धनवारण और धनयत्रं ण का वायु (प्रदषू ण धनवारण और धनयंत्रण) ऄधधधनयम, 1981 (1981 का 14) और ईसके ऄधीन बनाग गग धनयमों और ईसके संिोधनों के ऄनुसार कायााधन्वत दकया जागगा । (8) बधहस्राव का धनथसारण -- पाररधथथधतक संवेदी जोन में ईपचाररत बधहस्राव का धनथसारण पयाावरणीय (संरक्षण) ऄधधधनयम, 1986 और ईसके ऄधीन बनाग गग धनयमों के या राज्य सरकार द्वारा धनयत मानकों के ऄन्तगात अने वाले पयाावरणीय प्रदषू ण तत्वों के धनथसारण के धलग सामान्य मानकों, जो भी ऄधधक कठोर हो के ईपबधं ों के ऄनुसार होगा । (9) ठोस ऄपधिष्ट -- ठोस ऄपधिष्टों का धनपटान और प्रबंधन धनम्नधलधखत प प म ें होगा-- (i) पाररधथथधतक संवेदी जोन में ठोस ऄपधिष्ट धनपटान तथा प्रबंधन ठोस ऄपधि्‍ट प्रबंधन धनयम, 2016, जो भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की ऄधधसूचना सं. का.अ. 1357(ऄ) तारीख 8 ऄप्रैल, 2016 समय – समय पर यथा-संिोधधत, द्वारा प्रकाधित दकग गग थे, के ईपबंधों के ऄनसु ार दकया जागगा ; (ii) ऄकाबाधनक सामग्री का धनपटान पाररधथथधतक संवेदी जोन के बाहर पहचान दकग गग थथ ल पर दकसी पयाावरणीय थवीकृत रीधत में होगा; (iii) पाररधथथधतक संवेदी जोन में ठोस ऄपधि्‍ट ों को जलाना या भ्‍म ीकरण और भधू म भराव के थथापनों को ऄनुज्ञात नहीं दकया जागगा । (10) जवै धचदकत्स ीय ऄपधि्‍ ट.- जैव धचदकत्स ीय ऄपधि्‍ट प्रबंधन धनम्नधलधखत प प में होगा— (i) पाररधथथधतक संवेदी जोन में जैव धचदकत्सीय ऄपधिष्टों का धनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतना मंत्रालय की ऄधधसूचना सं.का.धन 343 (ऄ) तारीख 28 माचा 2016 समय – समय पर यथा-संिोधधत, द्वारा प्रकाधित जैव धचदकत्सीय ऄपधिष्ट प्रबंध धनयम, 2016 के ईपबंधों के ऄनुसार दकया जागगा । (ii) पाररधथथधतक संवेदी जोन में कोइ सामान्य ईपचार सुधवधा या भथमीकरण ऄनज्ञु ात नहीं दकया जागगा । (11) यानीय पररवहन: - पररवहन की यानीय गधतधवधधयां अवास के ऄनुकूल रीधत में धवधनयधमत होंगी और आस संबंध में अंचधलक महायोजना में धवधनर्ददष्ट ईपबंध समाधवष्ट दकग जागगं े और अंचधलक महायोजना के तैयार होन े और राज्य सरकार के सक्षम प्राधधकारी द्वारा ऄनुमोददत होने तक, मानीटरी सधमधत प्रवृत्त धनयमों और धवधनयमों के ऄनुसार यानीय गधतधवधधयों के ऄनुपालन को मानीटर करेगी । (12) यानीय प्रदषू ण:- लागू धवधधयों के ऄनुसार वाहन प्रदषू ण की रोकथाम और धनयंत्रण का ऄनुपालन दकया जागगा और थवच्छक ईंधन के ईपयोग के धलग दकग जान े वाले प्रयास दकग जागगे ह ैं ।II (ii) 7 (13) प्लाधथटक ऄपधिष्ट प्रबधं न: - पाररधथथधतक संवदे ी जोन में प्लाधथटक ऄपधिष्ट प्रबंध भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की ऄधधसचू ना सं.का.धन 340(ऄ), तारीख 18 माच,ा 2016 समय – समय पर यथा-संिोधधत, द्वारा प्रकाधित प्लाधथटक ऄपधिष्ट प्रबंधन धनयम 2016 के ईपबंधों के ऄनुसार दकया जागगा। (14) सधं नमाणा और धवध्वसं ऄपधिष्ट प्रबधं न: - पाररधथथधतक संवेदी जोन में संधनमााण और धवध्वंस ऄपधिष्ट प्रबंध भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की ऄधधसूचना सं.का.धन 317(ऄ), तारीख 29 माचा, 2016 समय – समय पर यथा-संिोधधत, द्वारा प्रकाधित संधनमााण और धवध्वंस प्रबंधन धनयम, 2016 के ईपबंधों के ऄनुसार दकया जागगा। (15) इ–ऄपधिष्ट:- पाररधथथधतक संवेदी जोन में इ–ऄपधिष्ट प्रबंध भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय द्वारा प्रकाधित इ–ऄपधिष्ट प्रबंध धनयम, 2016 समय – समय पर यथा संिोधधत, ईपबंधों के ऄनुसार दकया जागगा। (16) औद्योधगक इकाआया:ं - (i) पाररधथथधतक संवेदी जोन के भीतर कोइ नग प्रदषू णकारी ईद्योगों की थथापना की ऄनुमधत नहीं दी जागगी। (ii) पाररधथथधतक संवेदी जोन के भीतर केंद्रीय प्रदषू ण धनयंत्रण बोड ा द्वारा जारी ददिाधनदिे ों में फरवरी, 2016 में गैर- प्रदषू णकारी ईद्योगों को ईद्योगों के वगृकरण के ऄनुसार ऄनुमधत तब तक नहीं दी जागगी, जब तक दक आस ऄधधसूचना में ऐसी धवधनर्ददष्ट न दकया जाग । (17) पहाडी ढलानों को सरं क्षण: - पहाडी ढलानों का सरं क्षण धनम्नानसु ार होगा: (क) अंचधलक महायोजना पहाडी ढलानों पर ईन क्षेत्रों को ईपदर्जित करेगी जहां दकसी भी संधनमााण को ऄनुमधत नहीं दी जागगी । (ख) धवद्यमान खडी पहाडी ढलानों या ढलानों पर धजनमें कटाव के गक ईच्च धडग्री ह,ै के संधनमााण की ऄनुमधत नहीं दी जागगी । (18) केन्द्रीय सरकार और राज्य सरकार, यदद वह अवश्यक समझती ह,ै आस ऄधधसूचना के ईपाबंधों को प्रभावी करने में ऄन्य ईपाय धवधनर्ददष्ट करेगी। 4. प्रधतधषद्ध और धवधनयधमत सवं र्जधत दकग जान े वाल े दक्रयाकलापों की सचू ी - पाररधथथधतक संवेदी जोन म ें सभी दक्रयाकलाप पयाावरण (संरक्षण) ऄधधधनयम, 1986 (1986 का 29) के ईपबंधों तथा तदाधीन बनाग गग धनयमों धजनमें तटीय धवधनयमन जोन (सीअरजेड), 2011 और पयाावरणीय संघात धनधाारण (इअइग) ऄधधसूचना, 2006 भी ह ैं और ऄन्य लागू धवधधयां धजनमें वन (संरक्षण) ऄधधधनयम, 1980 (1980 के 69), भारतीय वन ऄधधधनयम, 1927 (1927 के 16), वन्यजीव (संरक्षण) ऄधधधनयम, 1972 (1972 के 53) तथा ईनमें दकग गग संिोधन भी ह ैं द्वारा नीचे दी गइ ताधलका में धवधनर्ददष्ट रीधत से धवधनयधमत होंगे, ऄथाात् :- सारणी क्रम स.ं दक्रयाकलाप टीका-रटप्पणी (1) (2) (3) क. प्रधतधषद्ध दक्रयाकलाप 1. वाधणधज्यक खनन । (क) सभी प्रकार के नग और धवद्यमान खनन (लघु और वृहत8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] खधनज), पत्थर की खानें और ईनको तोडने की आकाआयां वाथतधवक थथानीय धनवाधसयों की घरेलू अवश्यकताओं धजसमें धनजी ईपयोग के धलग मकानों के संधनमााण या मरम्मत के धलग धरती को खोदना और मकान बनान े के धलग दिे ी टाआल्स या ईंटों का धनमााण करना भी सधम्मधलत ह,ै के धसवाय नहीं होंगी ; (ख) खनन संदक्रयाग,ं माननीय ईच्चतम न्यायालय की ररट याधचका (धसधवल) सं. 1995 का 202 टी.गन. गौडाबमान धथरुमूलपाद बनाम भारत सरकार के मामल े में अदिे तारीख 4 ऄगथत, 2006 और ररट याधचका (सी) सं. 2012 का 435 गोवा फाईंडिे न बनाम भारत सरकार के मामल े में तारीख 21 ऄप्रैल, 2014 के ऄंतररम अदिे के ऄनुसरण में सवादा प्रचालन होगा । 2. जल, वाय,ु मृदा, ध्वधन प्रदषू ण (क) पाररधथथधतक संवेदी जोन में दकसी नग या प्रदषू ण फैलाने काररत करने वाल े ईद्योगों की वाल े ईद्योगों के धवथतार की ऄनुमधत दी जागगी। थथापना । (ख) पाररधथथधतक संवेदी जोन के भीतर, केंद्रीय प्रदषू ण धनयंत्रण बोड ा द्वारा जारी ददिाधनदिे ों फरवरी 2012के द्वारा गैर - प्रदषू णकारी वगृकरण के ऄनुसार केवल ईद्योगों को ऄनमु धत दी जा सकेगी जब तक दक आस ऄधधसूचना म ें ऄन्यथा धवधनर्ददष्ट न दकया गया हो। 3. बृहत जल धवद्युत पररयोजना लागू धवधधयों के ऄनुसार प्रधतधषद्ध (ऄन् यथा ईपबंधधत के पररयोजना की थथापना । धसवाय) होंगे । 4. दकसी पररसंकटमय पदाथों का लागू धवधधयों के ऄनुसार प्रधतधषद्ध (ऄन् यथा ईपबंधधत के ईपयोग या ईत्पादन या प्रसंथकरण। धसवाय) होंगे । 5. प्राकृधतक जल धनकायों या क्षत्रे सतही लागू धवधधयों के ऄनुसार प्रधतधषद्ध (ऄन् यथा ईपबंधधत के में ऄनुपचाररत बधहस्रावा का धसवाय) होंगे । धनथसारण । 6. ठोस ऄपधिष्ट धनपटान थथल की पाररधथथधतक संवेदी जोन में ठोस ऄपधिष्ट धनपटान की कोइ नइ थथापना और ठोस और जैव धचदकत्सा ठोस ऄपधिष्ट धनपटान थथल और ऄपधिष्ट ईपचाररत/प्रसंथकरण ऄपधिष्ट के धलग भथमीकरण की सुधवधा ऄनुज्ञात नहीं होगी । औद्योधगक प्रदक्रया और थवाथथ्य सुधवधा । थथापनों/ऄथपतालों अदद स े ईत्पन्न दकसी भी प्रकार के ठोस ऄपधिष्ट के ईपचार के धलग सामान्य या व्यधिगत भथमीकरण की सुधवधा का ऄधतररि संथथापन प्रधतधषद्ध हो । 7. फमों, कॉपोरेट, कंपधनयों द्वारा बड े थथानीय जप रतों को पूरा करने के धलग लागू धवधधयों के ऄनुसार प्रधतधषद्ध (ऄन् यथा ईपबंधधत के धसवाय) होंगे। पैमाने पर वाधणधज्यक पिुधन संपदा और कुक्कुट फामों की थथापना । 8. नइ अरा धमलों की थथापना। पाररधथथधतक संवेदी जोन के भीतर नइ और धवद्यमान अरा धमलों का धवथ तार ऄनुज्ञात नहीं होगा । 9. ईंट भट्टों की थथापना करना। लागू धवधधयों के ऄनुसार प्रधतधषद्ध (ऄन् यथा ईपबंधधत के धसवाय) होंगे ।II (ii) 9 ख. धवधनयधमत दक्रयाकलाप 10. होटलों और ररसोटों की थथापना । पाररधथथधतक ऄनकु ूल पयाटन दक्रयाकलापों से संबंधधत पयाटकों के ऄथथायी ऄधधभोग के धलग अवास के धसवाय संरधक्षत क्षेत्र की सीमा से 1 दकलोमीटर के भीतर या पाररधथथधतक संवेदी जोन नग वाधणधज्यक होटलों और धवश्रामथथलों की ऄनज्ञु ा नहीं दी जागगी तथाधप गक दकलोमीटर स े परे और पाररधथथधतक संवेदी जोन के धवथतार तक सभी नग पयाटन दक्रयाकलापों का धवथतार पयाटन महायोजना और राष्ट्रीय बाघ संरक्षण प्राधधकरण के मागादिाक धसद्धांतों के ऄनुप प होगा। 11. संधनमााण दक्रयाकलाप । (क) संरधक्षत क्षेत्र या पाररधथथधतक संवेदी जोन जो भी धनकट हो, की सीमा स े गक दकलोमीटर के भीतर दकसी भी प्रकार का वाधणधज्यक संधनमााण ऄनुज्ञात नहीं दकया जागगा: परंतु थथ ानीय लोगों को पैरा 3 के ईप-पैरा (1) में सूचीबद्ध दक्रयाकलाप भी ह ै धजसके ऄंतगात ऐसे थथानीय धनवाधसयों को ईस रुप में अवासीय अवश्यकताओं के धलग धनमााण ईपधवधधयों के ऄनुसार ऄनुज्ञात होगा, जैसे। (i) धवद्यमान सडकों को चौडा करना और ईन्ह ें सुदढृ करना तथा नइ सडकों का संधनमााण; (ii) बुधनयादी ढांचों और नागररक सुधवधाओं का संधनमाणा और नवीकरण; (iii) केंद्रीय प्रदषू ण धनयंत्रण बोड ा द्वारा जारी ददिाधनदिे ों में फरवरी, 2016 के भीतर धसफा गैर- प्रदधू षत ईद्योगों की थथापना के वगृकरण; (iv) कुटीर ईद्योगों धजसके ऄंतगता ग्रामीण ईद्योग ह;ैं सुधवधाजनक भण्डार और थथानीय सुख सुधवधाग ं जो पाररधथथधतक पयाटन, धजस में गृह वास भी ह ै में सहायता दते ी हो और (v) आस ऄधधसूचना में सूचीबद्ध संवर्जधत दक्रयाकलाप : (ख) ऐसे लघु ईद्योग जो प्रदषू ण काररत नहीं करत े हैं, से संबंधधत संधनमााण दक्रयाकलाप धवधनयधमत दकग जागगं े और लागू धनयमों और धवधनयमों, यदद कोइ हों, के ऄनुसार सक्षम प्राधधकारी की पूवा ऄनुज्ञा स े ही न्य ूनतम पर रखे जागगं े । (ग) गक दकलोमीटर से परे अंचधलक महायोजना की ऄनुसार10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] धवधनयधमत होंगे । 12. प्रदषू ण काररत नहीं करने वाले लघु फरवरी, 2016 में केन्द्रीय प्रदषू ण धनयंत्रण बोड ा द्वारा जारी ईद्योग । ईद्योगों के वगृकरण के ऄनुसार गैर-प्रदषू णकारी ईद्योग और ऄपररसंकट, लघु और सेवा ईद्योग, कृधष, पु्‍प कृधष, ईद्यान कृधष या पाररधथथधतक संवेदी जोन से दिे ी सामग्री से ईत्पादों को ईत्पन्न करने वाले कृधष अधाररत ईद्योग सक्षम प्राधधकारी द्वारा ऄनुज्ञात होंगे। 13. वृक्षों की कटाइ । (क) राज्य सरकार में सक्षम प्राधधकारी की पूवा ऄनुमधत के धबना वन, सरकारी या राजथव या धनजी भूधम पर वृक्षों की कोइ कटाइ नहीं होगी । (ख) वृक्षों की कटाइ संबंधधत केंद्रीय या राज्य ऄधधधनयम या ईसके ऄधीन बनाग गग धनयमों के ईपबंध के ऄनुसार धवधनयधमत होगी । 14. वन ईत्पादों और गैर का्‍ठ वन लागू धवधधयों के ऄधीन धवधनयधमत होंगे । ईत्पादों का संग्रहण (गनटीगफपी) । 15. धवद्युत और दरू संचार टावरों का लागू धवधधयों के ऄधीन धवधनयधमत होंगे । (भूधमगत केबल पररधनमााण और केबल धबछाना और धबछाग जाने को बढावा ददया जा सकेगा। ऄन्य बुधनयादी ढांचे । 16. नागररक सुख सुधवधाओं धजसके लागू धवधधयों के ऄनुसार न्यूनीकरण ईपायों धनयम और धवधनयों ऄन्तगात बुधनयादी ढांचे भी ह।ै और ईपलब्ध ददिाधनदिे ों के साथ दकग जागगं े। 17. धवद्यमान सडकों को चौडा करना लागू धवधधयों के ऄनुसार न्यूनीकरण ईपायों, धनयमों और और ईन्ह ें सुदढृ करना । धवधनयमों तथा ईपलब्ध ददिाधनदिे ों के साथ दकग जागगं ।े 18. पयाटन से संबंधधत ऄन्य दक्रयाकलाप लागू धवधधयों के ऄधीन धवधनयधमत होंगे । जैसे गमा वायु गुब्बारें, हले ीकाप्टर, ड्रोन, माआक्रोलाआटस अदद द्वारा पाररधथथधतक संवेदी जोन क्षेत्र के उपर से ईडना जसै े दक्रयाकलाप करना। 19. पहाडी ढालों और नदी तटों का लाग ू धवधधयों के ऄधीन धवधनयधमत होंग े । संरक्षण । 20. राधत्र में याधनक यातायात का लागू धवधधयों के ऄधीन वाधणधज्यक प्रयोजन के धलग धवधनयधमत संचलन। होंगे । 21. थथानीय समुदायों द्वारा चल रही थथानीय लोगों के ईपयोग के धलग लागू धवधधयों के ऄधीन कृधष और बागवानी प्रथाओं के साथ ऄनुज्ञात होंगे । पिुपालन, पिुपालन कृधष और मछली पालन । 22. प्राकृधतक जल धनकायों या सतही क्षेत्र जल धनकायों में प्रवेि करने के धलग ऄपधिष्ट जल/ बधहस्राव में ईपचाररत बधहस्राावों या ऄपधिष्ट ईपचाररत ईत्सजना रोकेगा। पुन:चक्रण और ऄपधिष्ट जल जल का धनथसारण । ईपचाररत पुन: ईपयोग के धलग प्रयास दकग जागगे ऄन्यथाII (ii) 11 ऄपधिष्ट जल/ बधहस्राव ईत्सजान लागू धवधध के ऄनुसार धवधनयधमत दकया जागगा। 23. सतह और भूजल का वाधणधज्यक लागू धवधधयों के ऄधीन धवधनयधमत होंगे । धन्‍कषाण । 24. खुले कुुँअ, बोर कुुँअ, अदद के धलग लागू धवधधयों के ऄधीन धवधनयधमत होंगे और दक्रयाकलाप संबधधत प्राधधकारी द्वारा मानीटरी दकग जागगे। कृधष और ऄन्य ईपयोग । 25. ठोस ऄपधि्‍ट प्रबंधन। लागू धवधधयों के ऄधीन धवधनयधमत होंगे । 26. धवदिे ी प्रजाधतयों को लाना । लागू धवधधयों के ऄधीन धवधनयधमत होंगे । 27. पाररधथथधतक पयाटन। लागू धवधधयों के ऄधीन धवधनयधमत होंगे । 28. प्लाधथटक बैग का ईपयोग । पाररधथथधतक संवेदी जोन के भीतर धवधिष्ट अवश्यकता के अधार पर पॉधलथीन बैग का ईपयोग के धलग ऄनुज्ञात दकया जा सकेगा । तथाधप यह लागू धवधधयों के ऄधीन धवधनयधमत दकया जागगा। 29. वाधणधज् यक साआनबोड ा और होडिंगडगें । लागू धवधधयों के ऄधीन धवधनयधमत होंगे । ग.सवं र्जधत दक्रयाकलाप 30. वषाा जल संचयन । सदक्र य प प से बढावा ददया जागगा । 31. जैधवक खेती। सदक्र य प प से बढावा ददया जागगा । 32. सभी दक्रयाकलापों के धलग हररत सदक्र य प प से बढावा ददया जागगा । प्रौद्योधगकी को ग्रहण करना । 33. कुटीर ईद्योग धजसके ऄतं गात ग्रामीण सदक्र य प प से बढावा ददया जागगा । कारीगर भी ह ैं। 34. नवीकरणीय उजाा स्रोत और ईंधन का बायोगैस, सौर प्रकाि आत्य ादद को सदक्रय रुप से बढावा ददया ईपयोग । जागगा । 35. कृधष वाधनकी । सदक्र य प प से बढावा ददया जागगा । 36. पाररधथथधतक ऄनकु ूल पररवहन का सदक्र य प प से बढावा ददया जागगा । ईपयोग । 37. कौिल धवकास । सदक्र य प प से बढावा ददया जागगा । 38. धनम्नीकृत भूधम या वन या का सदक्र य प प से बढावा ददया जागगा । जीणोद्धार । 39. पयाावरणीय जागरुकता । सदक्र य प प से बढावा ददया जागगा । 5. मानीटरी सधमधत- केंद्रीय सरकार, पयाावरण (संरक्षण) ऄधधधनयम, 1986 की धारा 3 की ईप-धारा (3) के ऄधीन आस ऄधधसचू ना के ईपबंधों को प्रभावी प प स े मानीटरी करने के धलग गक मानीटरी सधमधत का गठन करती ह,ै जो धनम्नधलधखत से धमलकर बनेगी, ऄथाात:् - (क) कलेक्टर, भावनगर- ऄध्यक्ष; (ख) क्षेत्रीय ऄधधकारी, गुजरात राज्य प्रदषू ण धनयंत्रण बोड,ा भावनगर- सदथय; (ग) क्षेत्र का वररष्ठ नगर योजनाकार- सदथय;12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (घ) गुजरात सरकार के वन और पयाावरण धवभाग का कोइ प्रधतधनधध- सदथय; (ङ) गुजरात सरकार द्वारा नामधनर्दद्‍ ट प्रत्येक मामले में तीन वष ा की ऄवधध सदथय; के धलग, (च) सदथय राज्य जैव धवधवधता बोड ा सदथय; (छ) सहायक वन सरं क्षक (ब्लैक बक राष्ट्रीय ईद्यान का प्रभारी), भावनगर- सदथय- सधचव । 6. धनदिे धनबधं न (1) मानीटरी सधमधत आस ऄधधसूचना के ईपाबंध का ऄनुपालन मानीटरी सधमधत करेगी। (2) मानीटरी सधमधत की ऄवधध आस ऄधधसूचना के प्रकािन की तारीख से तीन वषा होगा । (3) पाररधथथधतक संवेदी जोन में भारत सरकार के तत् कालीन पयाावरण और वन मंत्रालय की ऄधधसचू ना सं. का.अ. 1533(ऄ), तारीख 14 धसतबं र, 2006 की ऄनुसूची के ऄधीन सधम्मधलत दक्रयाकलापों और आस ऄधधसचू ना के परै ा 4 के ऄधीन सारणी में धवधनर्दद्‍ ट प्रधतधषद्ध गधतधवधधयों के धसवाय अने वाले ऐसे दक्रयाकलापों की दिा में वाथतधवक धवधनर्ददष्ट थथलीय दिाओं पर अधाररत मानीटरी सधमधत द्वारा संवीक्षा की जागगी और ईि ऄधधसूचना के ईपबंधों के ऄधीन पूवा पयाावरण के धलग केन्द्रीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय को धनर्ददष्ट की जागगी । (4) आस ऄधधसूचना के पैरा 4 के ऄधीन यथा धवधनर्ददष्ट प्रधतधषद्ध दक्रयाकलापों के धसवाय, भारत सरकार के तत् कालीन पयाावरण और वन मंत्रालय की ऄधधसूचना संख्यांक का.अ. 1533(ऄ), तारीख 14 धसतंबर, 2006 की ऄधधसूचना के ऄनुसूची के ऄधीन ऐसे दक्रयाकलापों, धजन्ह ें सधम्मधलत नहीं दकया गया है, परंतु पाररधथथधतक संवेदी जोन में अते हैं, ऐसे दक्रयाकलापों की वाथतधवक धवधनर्ददष्ट थथलीय दिाओं पर अधाररत मानीटरी सधमधत द्वारा संवीक्षा की जागगी और ईसे संबद्ध धवधनयामक प्राधधकरणों को धनर्ददष्ट दकया जागगा । (5) मानीटरी सधमधत का सदथय-सधचव या संबद्ध कलक्टर या संबंधधत ईद्यान ईप वन संरक्षक ऐस े व्यधि के धवप द्ध, जो आस ऄधधसूचना के दकसी ईपबंध का ईल्लंघन करता ह,ै पयाावरण (संरक्षण) ऄधधधनयम, 1986 की धारा 19 के ऄधीन पररवाद फाआल करन े के धलग सक्षम होगा । (6) मानीटरी सधमधत मुद्दा दर मुद्दा के अधार पर ऄपेक्षाओं पर धनभार रहते हुग संबद्ध धवभागों के प्रधतधनधधयों या धविेषज्ञों, औद्योधगक संगमों या संबद्ध पणधाररयों के प्रधतधनधधयों या धविेषज्ञों को ऄपने धवचार-धवमिा में सहायता के धलग अमंधत्रत कर सकेगी । (7) मानीटरी सधमधत प्रत्येक वषा की 31 माचा तक राज् य के मुख् य वन् यजीव वाडना को ऄपने दक्रयाकलापों की ऄपनी वार्जषक कारावाइ ररपोटा ईपाबधं V में संलग्न में ईक्त वष ा के 30 जून तक प्रथततु करेगी । (8) केन्द्रीय सरकार का पयाावरण, वन और जलवायु पररवतान मंत्रालय धनगरानी सधमधत को ऄपने कृत्यों के प्रभावी धनवाहन के धलग समय-समय पर ऐसे धनदिे द े सकेगा, जो वह ठीक समझे । 7. आस ऄधधसूचना के ईपबंधों को प्रभावी करने के धलग केंद्रीय सरकार और राज् य सरकार ऄधतररक् त ईपाय, यदद कोइ हों, धवधनर्दद्‍ ट कर सकेंगी ।II (ii) 13 8. आस ऄधधसूचना के ईपबंध, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section(ii), dated the 8th January, 2016, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 67, dated the 22nd December, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 22nd December, 2015; AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification; AND WHEREAS, the Velavedar Black Buck National Park spread is over an area of 39.34 square kilometers and located between latitude 2156’ longitude 7010’, in the Northern part of Taluka/Tehsil of Bhavnagar of Bhavnagar District in the State of Gujarat and notified with the prime aim of long-term protection and conservation of Black Buck and the rare and endangered biological diversity; AND WHEREAS, Reserve Forest categorised as Coastal Grassland Ecosystem and Rajwada Bio-geographical Province supports rich biodiversity, and also a variety of mammals, reptiles, insects and avifauna;II (ii) 19 AND WHEREAS, major flora in the said National Park are Jinjvo (Dichanthiumannulatum), Dharant (Sporobolusvirginicus), Moti Dharant (Sporobolusmadraspatensis), Chakimaki (Sporoboluscoromandelianus), Mindado (Chloris virgata), Dale, Delo (Aeuropuslagopoides), Kang (Setariaglauca), Dhundh (Eragrostis japonica), Smeru (Themedatriendra), Ghavli (Ischaemunrugosum), Padu (Dactylocteniumaegypticun), Vardi (Iseilemaanthephoroides) etc.; AND WHEREAS, major fauna in the aforesaid National Park are Rufus tailed hare (Lepus nigricollisruficaudatus), Desert hare (Lepus nigricollisdayanus), Wolf (Canis lupus pallipes), Jackal (Canis aureus), Indian Fox (Vulpesbengalensis), Common mongoose (Herpestesedwardsi), Black buck (Antilopecervicapra), Bluebull (Boselaphustragocamelus), Indian wild boar (Sasscrofa), Five striped khiscoli (Funambuluspennanae), Desert gerbille (Merioneshurricanae), Indian gerbille (Tateraindica), Jungle cat (Felischaus), Grey musk shrew (Suncusmurinus), Desert cat (Felislibyca), etc.; AND WHEREAS, the whole natural entity of the Velavedar Black Buck National Park, including the relic coastal grassland ecosystem and its associate biota including the highly endangered species, call for sustained conservation efforts; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification, around the protected area of Velavedar Black Buck National Park as Eco- sensitive Zone from ecological and environmental point of view by habitat management aiming at improving and preserving the genetic resources of Velavedar Black Buck National Park, reintroduction and rehabilitation of local species through breeding programmes, promote environmental education and ecological research and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW THEREFORE, in exercise of the power conferred by sub section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 1.0 Kilometer to 3.70 Kilometers around the boundary of Velavedar Black Buck National Park in the State of Gujarat as the Velavedar Black Buck National Park Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone shall be with a peripheral area 43.57 square kilometer with an extent varying from 1.0 kilometer to 3.70 kilometers around the boundary of Velavedar Black Buck National Park. (2) The map Velavedar Black Buck National Park alongwith its of the Eco-sensitive Zone and latitudes and longitudes is appended as Annexure- IA and Annexure-IB. (3) The boundary details of the said National Park and its Eco-sensitive Zone are given in Annexure-II. (4) Geo-coordinates of Protected Area and Geo-coordinates of Eco-sensitive Zone are appended on Annexure III. (5) The list of villages falling in Eco-sensitive Zone is appended as Annexure-IV. 2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (4) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said Plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue, (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal ; (x) Panchayati Raj ; and (xi) Public Works Department.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development and livelihood security of local communities. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Landuse.- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities: Provided that the conversion of agricultural and other lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government to meet the residential needs of the local residents, and for the activities such as- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including home stay; and (v) promoted activities given in paragraph 4. Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism/ Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b)The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The activities of eco-tourism shall be regulated as under, namely:- (i) no new construction of hotels and resorts shall be allowed within one kilometer from the boundary of the Velavedar Black Buck National Park or upto the extent of the Eco-sensitive Zone whichever is nearer. However, beyond the distance of one kilometer from the boundary of the said park till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan.II (ii) 21 (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism; (iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within ESZ area. (4) Natural Heritage.- Natural Heritage- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan. (6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto. (8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes. - Disposal and management of solid wastes shall be as under:- (i) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time; (ii) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco- sensitive Zone; (iii) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone. (10) Bio-medical waste.- Bio medical waste management shall be as under: (i) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time. (ii) no common treatment facility or incineration shall be permitted within the Eco Sensitive Zone. (11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Vehicular pollution.- Prevention and control of vehicular pollution shall be carried out in accordance with applicable laws and efforts shall be made for use of cleaner fuel for example CNG, etc. (13) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016 as amended from time to time. (14) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (15) E-waste.- The E- Waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time. (16) Industrial Units.- (i) No new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ii) Only non-polluting industries may be permitted within the Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise specified in this notification. (17) Protection of hill slopes.- The protection of hill slopes shall be as under.- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted; (18) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification. 4. Prohibited, regulated and promoted activities All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S No Activity Description (1) (2) (3) A. (b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 04 August, 2006 in the matter of T.N. GodavarmanThirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012. 2. Setting of industries causing (a) No new industries and expansion of existing polluting industries in pollution (water, air, soil, noise, the Eco-sensitive zone shall be permitted. etc.). (b) Only non-polluting industries may be permitted within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise specified in this notification. 3. Establishment of major Prohibited (except as otherwise provided) as per applicable laws. hydroelectric project. 4. Use or production or processing Prohibited (except as otherwise provided) as per applicable laws. of any hazardous substances. 5. Commercial establishment of hotels No new commercial hotels and resorts shall be permitted within one and resorts. kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for eco-tourism activities: Provided that, beyond one kilometre from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable. 11. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as: (i) Widening and strengthening of existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016; (iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including homestays; and (v) Promoted activities listed in this Notification. (b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan. 12. Small scale non-polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and non- hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent authority. 13. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder. 14. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this Notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 comprising of the following, namely:- (a) Collector, Bhavnagar Chairperson; (b) Regional Officer, Gujarat State Pollution Control Board, Bhavnagar Member; (c) Senior Town Planner of the area Member; (d) A representative of the Department of Forests and Environment, Member; Government of Gujarat (e) One expert in the area of Ecology and Environment to be nominated by Member; the State Government for a period of three year in each case (g) Member State Biodiversity Board Member; (h) Assistant Conservator of Forests (In-Charge of the Velvadar Black Buck Member Secretary. National Park), Bhavnagar 6. Terms of reference.- (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the monitoring committee shall be for three years from date of publication of this notification in the official Gazette. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (5) The Member Secretary of the Monitoring Committee or the concerned Collector (s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-V.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
