से, िजसको उस राजप(cid:27) क(cid:28) 1ितयां, िजसम, यह अिधसूचना अंत6व7 ह,ै जनता को उपल9ध करा दी गई थ<, साठ (cid:1)दन क(cid:28) अविध के भीतर

अतः, अब, केIaीय सरकार, पया(cid:16)वरण (संर?ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प(cid:24)ठत पया(cid:16)वरण (संर?ण)
अिधिनयम, 1986 (1986 का 29) क(cid:28) धारा 3 क(cid:28) उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) +ारा 1दE
शि/य0 का 1योग करते Aए, क,aीय सरकार इसके +ारा गGगेवाडी Iय ू Jटे इंिडयन सोहन प?ी वIय जीव अभयारLय क(cid:28) सीमा 40 मीटर से
675 मीटर तक के िवO ता(cid:24)रत ?े(cid:27) को गGगेवाडी I यू Jेट इंिडयन सोहन प?ी वIय जीव अभयारLय पा(cid:24)रिOथ ितक संवेदी जोन (िजसे इसम ,

इस अिधसूचना के अंितम 1काशन क(cid:28) तारीख से दो वष(cid:16) क(cid:28) अविध के भीतर, Oथानीय .ि/य0 के परामश(cid:16) से, इस अिधसूचना म, संलjन
अनुबंध0 के सामंजO य से आंचिलक महायोजना तैयार करेगी ।
2. उk त योजना राi य सरकार म, स?म 1ािधकारी +ारा अनुमो(cid:1)दत होगी ।
3. पा(cid:24)रिO थितक संवेदी जोन के िलए उk त महायोजना, राiय सरकार +ारा इस अिधसूचना म, िविनYदMट Tप म ,ऐसी रीित म, तथा
सुसंगत क,aीय और राi य िविधय0 के सामंजO य म, भी तथा क,aीय सरकार +ारा जारी माग(cid:16)िनदशh , य(cid:1)द कोई ह0, +ारा तैयार होगी ।
4. उk त महायोजना, इसम, पया(cid:16)वरणीय और पा(cid:24)रिO थितक िवचार0 को समाकिलत करने के िलए राiय के सभी संब^ िवभाग0 के परामश(cid:16)
से तैयार होगी, अथा(cid:16)त्: ————
(i) पया(cid:16)वरण ;
(ii) वन और वIयजीव ;
(iii) कृिष;
(iv) राजO व;
(v) शहरी िवकास;
(vi) पय(cid:16)टन;
(vii) Jामीण िवकास;
(viii) fसचाई और बाढ़ िनयं(cid:27)ण;
(ix) नगरपािलका;
(x) महाराo राiय 1दषू ण िनयं(cid:27)ण बोड(cid:16); और
(xi) लोक िनमा(cid:16)ण िवभाग ।
(5) उk त योजना अनुमो(cid:1)दत िव[मान भू-उपयोग, अवसंरचना और (cid:1)pयाकलाप0 पर कोई िनबqधन अिधरोिपत नह< करेगी जब तक
(cid:1)क इस अिधसूचना म , िविनYदM ट न हो और उk त महायोजना म, सभी अवसंरचना और (cid:1)pयाकलाप0 म, द?ता तथा पा(cid:24)रिOथ ितक(cid:28)य
अनुकूलता का संवध(cid:16)न करेगी ।
(6) उk त महायोजना म , अनाrछा(cid:1)दत ?े(cid:27)0 के जीण\^ार, िव[मान जल िनकाय0 के संर?ण, आवाह ?े(cid:27)0 के 1बंधन, जल-संभर0 के
1बंधन, भूतल जल के 1बंधन, मृदा और नमी संर?ण, Oथानीय समदु ाय0 क(cid:28) आव_यकताg तथा पा(cid:24)रिOथितक(cid:28) और पया(cid:16)वरण से संबंिधत
ऐसे अIय पहलुg, िजन पर sयान दने ा आव_यक ह,ै के िलए उपबंध ह0गे ।
(7) उk त महायोजना सभी िव[मान पूजा O थल0, Jाम0 और नगरीय बंदोबOत0, वन0 के 1कार और (cid:1)कO म0, जनजातीय ?े(cid:27), कृिष
?े(cid:27)0, ऊपजाऊ भूिम, ह(cid:24)रत ?े(cid:27) जैसे उ[ान और उसी 1कार के O थान, उ[ान कृिष ?े(cid:27), आYकड0, झील0 और अIय जल िनकाय0 का
मानिच(cid:27)0 के साथ अuयकंन करेगी और योजना को मानिच(cid:27)0 म, (cid:1)दए गए िव[मान तथा 1Oतािवत भूिम उपयोग सुिवधाg के िववरण
+ारा सम6थत (cid:1)कया जाएगा।
(8) उk त महायोजना पा(cid:24)रिO थितक संवेदी जोन म, िवकास के पा(cid:24)रिOथ ितक अनुकूल िवकास और Oथ ानीय समुदाय0 क(cid:28) आजीिवका
को सुिनि_ चत करते Aए िविनयिमत होगी ।
(9) उk त महायोजना इस अिधसचू ना म , (cid:1)दए गए उपबंध0 के संबंध म , अपने कायv के बाहर ले जाने के िलए मानीटरी सिमित के िलए एक

3. रररराााा(cid:22)(cid:22)(cid:22)(cid:22)यययय ससससररररककककाााारररर (cid:23)(cid:23)(cid:23)(cid:23)ाााारररराााा (cid:24)(cid:24)(cid:24)(cid:24)ककककएएएए जजजजाााानननन ेे ेे ववववाााालललल ेे ेे उउउउपपपपाााायययय....———— राiय सरकार अंितम अिधसूचना के उपबंध0 को 1भावी करने के िलए िनdिलिखत
उपाय करेगी, अथा(cid:16)त ्:————
(1) भभभभ--ूू--ूू उउउउपपपपययययोोोोगगगग....————पा(cid:24)रिOथितक संवेदी जोन म , वन0, उ[ान-कृिष ?े(cid:27)0, कृिष ?े(cid:27)0, आमोद-1मोद के 1योजन के िलए िचिIहत (cid:1)कए
गए पाकv और खुले Oथान0 का वािणिiयक और औ[ोिगक संब^ िवकास (cid:1)pयाकलाप0 के िलए उपयोग या संप(cid:24)रवत(cid:16)न नह< होगा ।
मानिच(cid:27) के साथ आंचिलक महायोजना म, कुछ ?े(cid:27)0 को पूरी तरह प(cid:24)रभािषत (cid:1)कया जाएगा ।
परंतु पा(cid:24)रिOथितक संवेदी जोन के भीतर कृिष और अIय भूिम का संप(cid:24)रवत(cid:16)न मानीटरी सिमित क(cid:28) िसफा(cid:24)रश पर और ?े(cid:27)ीय
नगर योजना अिधिनयम के तहत स?म 1ािधकारी के पूव (cid:16) अनुमोदन के से और यथा लागू केIaीय/राiय सरकार के अIय िनयम0 और
िविनयम0, जो Oथानीय िनवािसय0 क(cid:28) आवासीय जTरत0 को पूरा करने के िलए और पैरा 4 क(cid:28) सारणी के Oतंभ (2) के अधीन सूचीब^
(cid:1)pयाकलाप0 को पूरा करने के िलए आव_यक हG, अनुUात (cid:1)कया जा सकेगा, जैसे:-
(i) पा(cid:24)रिO थितक अनुकूल पय(cid:16)टन (cid:1)pयाकलाप0 के िलए पय(cid:16)टक0 के अOथ ायी आवासन के िलए पा(cid:24)रिOथ ितक अनुकूल आरामगाह
जैसे ट,ट, लकड़ी के मकान आ(cid:1)द;
(ii) िव[ मान सड़क0 को चौड़ा करना और सुदढ़ृ करना तथा नई सड़क0 का संिx माण(cid:16);
(iii) कुटीर उ[ोग, िजसके अंतग(cid:16)त Jामीण उ[ोग, सुिव धाजनक Oट ोर और Oथ ानीय सुिवध ाएं भी ह;G
(iv) वषा (cid:16)जल संचय; और
(v) 1दषू ण उyपx न करने वाले लघु उ[ोग;
परंतु यह और भी (cid:1)क राiय सरकार के पूव(cid:16) अनुमोदन और संिवधान के अनुrछ ेद 244 या तyसमय 1वृE िविध के उपबंध0 के
अनुपालन के िबना, िजसके अंतग(cid:16)त अनुसूिचत जनजाित और अIय परंपरागत वन िनवासी (वन अिधकार0 क(cid:28) माIयता) अिधिनयम, 2006
(2007 का 2) भी है, वािणिiयक या उ[ोग िवकास (cid:1)pयाकलाप0 के िलए जनजातीय भूिम का उपयोग अनुUात नह< होगा :
परंतु यह और भी (cid:1)क पा(cid:24)रिO थितक संवेदी जोन के भीतर भू-अिभलेख0 म , पाई जाने वाली कोई (cid:27)ु(cid:24)ट मानीटरी सिमित के िवचार
1ाF करने के पzात ् राiय सरकार +ारा 1yयेक मामले म , एक बार संशोिधत होगी और उ/ (cid:27)ु(cid:24)ट के संशोधन क(cid:28) भारत सरकार के
पया(cid:16)वरण, वन और जलवायु प(cid:24)रवत(cid:16)न मं(cid:27)ालय को सूचना दने ी होगी :
परंतु यह और भी (cid:1)क उपयु(cid:16)/ (cid:27)ु(cid:24)ट के संशोधन म , इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:1)कसी भी दशा म , भू-उपयोग
का प(cid:24)रवत(cid:16)न सि’मिलत नह< होगा :
अ1युk त या अनyु पादक कृिष ?े(cid:27)0 म, पुन: वनीकरण करने के 1यास (cid:1)कए जाएंग।े
(2) (cid:26)(cid:26)(cid:26)(cid:26)ााााककककृृृृििििततततकककक जजजजलललल (cid:30)(cid:30)(cid:30)(cid:30)ोोोोतततत.———— सभी 1ाकृितक जल {ोत0/न(cid:1)दय0/1णाल0 क(cid:28) पहचान क(cid:28) जाएगी और उनके संर?ण और पुनC}भूतकरण के
िलए आचंिलक महायोजना म ,सि’म िलत होगी।
(3) पपपपययययटट(cid:4)(cid:4)टट(cid:4)(cid:4) नननन////पपपपाााा(cid:8)(cid:8)(cid:8)(cid:8)ररररिििि(cid:16)(cid:16)(cid:16)(cid:16)थथथथििििततततकककक पपपपययययटट(cid:4)(cid:4)टट(cid:4)(cid:4) नननन....———— (क) पा(cid:24)रिOथितक संवेदी जोन के भीतर पय(cid:16)टन संबंधी (cid:1)pयाकलाप पय(cid:16)टन महायोजना के अनुसार ह0गे
जो (cid:1)क आंचिलक महायोजना के भाग Tप म, होगी ।
(ख) पय(cid:16)टन महायोजना पय(cid:16)टन िवभाग, +ारा पया(cid:16)वरण और वन िवभाग के परामश(cid:16) से तैयार होगी ।
(ग) पयट(cid:16) न महायोजना आंचिलक महायोजना के एक घटक के Tप म, जाना जायेगा ।
(घ) पय(cid:16)टन संबंधी (cid:1)pयाकलाप िन’ निलिखत के अधीन िविनयिमत ह0गे, अथा(cid:16)त् :-
(i) पा(cid:24)रिOथितक अनुकूल पय(cid:16)टन (cid:1)pयाकलाप से संबंिधत पय(cid:16)टक0 के अOथायी अिधभोग के िलए वास सुिवधा के िसवाय संरि?त
?े(cid:27) क(cid:28) सीमा से एक (cid:1)कलोमीटर तक या पा(cid:24)रिOथितक संवेदी जोन के िवOतार तक इनम, जो भी िनकट ह,ै नये वािणिiयक होटल
और (cid:24)रसोट(cid:16) अनुUात नह< ह0गे। तथािप, जहाँ पा(cid:24)रिOथितक संवेदी जोन का िवOतार एक (cid:1)कलोमीटर से iयादा ह ै वहाँ, एक
(cid:1)कलोमीटर से परे और पा(cid:24)रिOथितक संवेदी जोन के िवOतार तक सभी नए पय(cid:16)टक (cid:1)pयाकलाप या िव[मान (cid:1)pयाकलाप का
िवOतार पय(cid:16)टन महायोजना के अनुसार होगा;
(ii) पा(cid:24)रिOथितक संवेदी जोन के भीतर सभी नए पय(cid:16)टन (cid:1)pयाकलाप0 या िव[मान पय(cid:16)टन (cid:1)pयाकलाप0 का िवOतार क,aीय
सरकार के पया(cid:16)वरण, वन और जलवायु प(cid:24)रवत(cid:16)न मं(cid:27)ालय के माग(cid:16)दश(cid:16)क िस^ांत0 के +ारा तथा राMN ीय (cid:128)य ा(cid:129) संर?ण 1ािधकरण,
+ारा जारी पा(cid:24)रिOथितक पय(cid:16)टन (समय-समय पर यथा संशोिधत) माग(cid:16)दश(cid:16)क िस^ांत0 के अनुसार, पा(cid:24)रिOथितक पय(cid:16)टन,
पा(cid:24)रिOथितक िश?ा और पा(cid:24)रिOथितक िवकास को महyव दते े Aए पा(cid:24)रिOथितक संवेदी जोन क(cid:28) वहन ?मता के अsययन पर

(iii) आंचिलक महायोजना का अनुमोदन (cid:1)कए जान े तक, पय(cid:16)टन के िलए िवकास और िव[मान पय(cid:16)टन (cid:1)pयाकलाप0 के िवOतार
को वाOतिवक Oथल िविनYद7 संवी?ा तथा मानीटरी सिमित क(cid:28) िसफा(cid:24)रश पर आधा(cid:24)रत संबंिधत िविनयामक 1ािधकरण0 +ारा
अनुUात (cid:1)कया होगा ।
(4) ननननससैैससैै """"गगगगकककक ििििववववररररााााससससतततत....———— पा(cid:24)रिOथितक संवेदी जोन म ,महyवपूण (cid:16) नैस6गक िवरासत के सभी Oथल0 जैसे सभी जीन कोश आरि?त ?े(cid:27), शैल
िवरचनाएं, जल 1पात0, झरन0, घाटी मागv, उपवन0, गुफाएं, Oथल0, (cid:130)मण, अ(cid:131)रोहण, 1पात0 आ(cid:1)द क(cid:28) पहचान क(cid:28) जाएगी और उIह ,
संरि?त (cid:1)कया जाएगा तथा उनक(cid:28) सरु ?ा और संर?ा के िलए ऐसी योजना आंचिलक महायोजना का भाग होगी ।

महyव के ?े(cid:27)0 क(cid:28) पहचान करनी होगी और उनके संर?ण क(cid:28) योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना म , सि’मिलत क(cid:28)
जाएगी ।
(6) $$$$वव व व ििििनननन (cid:26)(cid:26)(cid:26)(cid:26)ददददषषषषूूूू णणणण.———— पया(cid:16)वरण (संर?ण) अिधिनयम 1986 के अधीन sविन 1दषू ण (िविनयमन और िनयं(cid:27)ण) िनयम, 2000 म, िनयत
उपबंध0 के अनुसार म, पा(cid:24)रिOथितक संवेदी जोन म, sविन 1दषू ण के िनयं(cid:27)ण के िलए िविनयम0 को काया(cid:16)िIवत करेगा ।
(7) ववववाााायययय ुु ुु (cid:26)(cid:26)(cid:26)(cid:26)ददददषषषषूूूू णणणण.———— पा(cid:24)रिOथितक संवेदी जोन म,, राiय सरकार के पया(cid:16)वरण िवभाग वायु (1दषू ण िनवारण एवं िनयं(cid:27)ण) अिधिनयम,
1981 (1981 का 14) और उसके अधीन बनाए गए िनयम के उपबंध0 के अनुसार वायु 1दषू ण के िनयं(cid:27)ण के िलए मानक और िविनयम
काया(cid:16)िIवत करेगा ।
(8) बबबबििििहहहह(cid:30)(cid:30)(cid:30)(cid:30)ाााावववव ककककाााा ििििनननन(cid:16)(cid:16)(cid:16)(cid:16)ससससााााररररणणणण.———— पा(cid:24)रिOथितक संवेदी जोन म , उपचा(cid:24)रत बिह{ाव का िनOसारण पया(cid:16)वरणीय (संर?ण) अिधिनयम, 1986
और उसके अधीन बनाए गए िनयम0 के अIतग(cid:16)त आने वाले पया(cid:16)वरणीय 1दषू ण के िनOसारण संबंधी साधारण मानक0 के उपबंध0 के अनुसार
होगा तथा पया(cid:16)वरण क(cid:28) सरं?ण के िलए मानक ओर अिधक कठोर बनाये जा सकते ह।G
(9) ठठठठोोोोसससस अअअअपपपपििििशशशश,,,, ....---- ठोस अपिश70 का िनपटान और 1बंधन िनdिलिखत Tप म ,होगा: ————

NOTIFICATION
New Delhi, the 31st May, 2017
S.O.1752(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide
notification of the Government of the India in the Ministry of Environment, Forest and Climate Change vide number
S.O.3014(E), dated the 5th November, 2015, inviting objections and suggestions from all persons likely to be affected
thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were
made available to the public;
AND WHEREAS, copies of the Gazette were made available to the public on the 5th November, 2015;
AND WHEREAS, no objections and suggestions were received from any person in response to the draft
notification;
AND WHEREAS the Gangewadi New Great Indian Bustard Wild Life Sanctuary is situated in Solapur and
Osmanabad Districts of Maharashtra and is spread over an area of 1.98 square kilometer The Sanctuary is known for its
wild life specially the Great Indian Bustard and Black buck apart from some other mammalian species like fox, jackal
and wolf.
AND WHEREAS, certain reptiles, amphibians, butterflies, spiders and invertebrates inhabit this wild life
sanctuary;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are
specified in paragraph 1 of this notification, around the protected area of Gangewadi New Great India Bustard Wildlife
Sanctuary as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of
industries and their operations and processes in the said Eco-sensitive Zone.
NOW THEREFORE, in exercise of the powers conferred by sub section (1) and clauses (v) and (xiv) of sub-
section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3)
of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent
from 40 metres to 675 metres around the boundary of Gangewadi New Great India Bustard Wildlife Sanctuary in
Maharashtra as the Gangewadi New Great India Bustard Wildlife Sanctuary Eco-sensitive Zone (herein after referred to
as the Eco-sensitive Zone) details of which are as under, namely:—
1. Extent and Boundaries of Eco-sensitive Zone.— (1) The Eco-Sensitive Zone is spread over an area of 7.14 square
kilometer with an extent from 40 metres to 675 metres around the boundary of Gangewadi New Great India Bustard
Wildlife Sanctuary.
(2) The map of the Sanctuary along with the Eco-sensitive Zone showing salient features along the boundary is appended
as Annexure-I. The list of Geo Co-ordinates of the sanctuary and the Eco Sensitive Zone is annexed as Annexure-I (A).
(3) The boundary description of the Eco Sensitive Zone is given in Annexure-II.
(4) The list of four villages namely Gangewadi falling in Solapur district and Dhotri, Devkurli and Pimpla Bk., in
Osmanabad district within the Eco-sensitive Zone along with geo co-ordinates is appended as Annexure-III.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 13
2. Zonal Master Plan for Eco-Sensitive Zone.— 1. The State Government shall, for the purpose of the Eco-sensitive
Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the
Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for
consideration and approval of the Competent Authority in the State Government.
2. The said Plan shall be approved by the Competent Authority in the State Government.
3. The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is
specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by
the Central Government, if any. The Zonal Master Plan shall be approved by the Competent Authority in the State
Government.
4. The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the
ecological and environmental considerations into the said plan:
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Maharashtra State Pollution Control Board; and
(xi) Public Works Department.
(5) The said Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless
so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities
to be more efficient and eco-friendly.
(6) The said Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of
catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local
community and such other aspects of the ecology and environment that need attention.
(7) The said Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of
forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and
other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and
proposed land use features.
(8) The said Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development for livelihood
security of local communities.
(9) The said Plan shall be a reference document for the Monitoring Committee for carrying out its functions of
monitoring vide the provisions of this notification.
3. Measures to be taken by State Government.— The State Government shall take the following measures for giving

(1) Land use.— Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or industrial activities. Such
areas shall be clearly defined in the Zonal Master Plan along with maps;
Provided that the conversion of agricultural and other lands within the Eco-sensitive Zone may be permitted on
the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under
Regional Town Planning Act and other rules and regulations of Central/State Government as applicable, to meet the
residential needs of the local residents, and for the activities listed in column (2) of the Table in paragraph 4, namely:—
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly
tourism activities;
(ii) Widening and strengthening of existing roads and construction of new roads;
(iii) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism
including home stay;
(iv) Rain water harvesting, and
(v) Small scale industries not causing pollution;
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the of the competent authority under Regional Town Planning Act and other rules
and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the
law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of
Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said
error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph.
Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat
restoration activities.
(2) Natural water bodies.—The catchment areas of all natural springs/rivers/ channels shall be identified and plans for
their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3) Tourism/Eco-Tourism.—(a) All new eco-tourism activities or expansion of existing tourism activities within the
Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of
Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:—
(i) No new construction of hotels and resorts shall be allowed within 1 kilometre from the boundary of the
Wildlife Sanctuary or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 kilometre from
the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and
resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone (beyond
1 kilometre) shall be in accordance with the guidelines issued by the Central Government in the Ministry of¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15
Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation
Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism
activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and
recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is
permitted within ESZ area.
(4) Natural Heritage.— All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a
heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man- made Heritage Sites.— Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their
conservation shall be prepared as part Zonal Master Plan.
(6) Noise Pollution.— Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in
accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986
and amendments thereto.
(7) Air Pollution.— Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in
accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made
thereunder and amendments thereto.
(8) Discharge of Effluents.— Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental
(Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more
stringent.
(9) Solid Wastes.— Disposal and Management of solid wastes shall be as under:—
(a) The solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the
Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment,
Forests and Climate Change vide notification number S.O. 1357(E), dated 8th April, 2016 as amended from time to
time;
(b) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the
Eco-sensitive Zone;
(c) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-
sensitive Zone.
(10) Bio Medical Wastes.— Bio medical waste management shall be as under:
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-
Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest
and Climate Change vide Notification number G.S.R. 343(E), dated the 28th March, 2016 as amended from time to time.
(b) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.
(11) Plastic Waste Management.— The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per
the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of
Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as

(12) Construction and Demolition Waste Management.—The Construction and Demolition Waste Management in the
Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management
Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide
notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) Electronic Waste.— The Electronic Waste (E-Waste) Management in the Eco-sensitive Zone shall be carried out as
per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of
Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular Traffic.— The vehicular traffic movement shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is
prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular Pollution.— Prevention and control of Vehicular Pollution shall be complied with in accordance with
applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc.
(16) Industrial Units.— (a) On or after the publication of this notification in the Official Gazette, no new polluting
industries shall be allowed to be set up within the Eco-sensitive Zone.
(b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries
in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification.
4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.— All activities in the Eco
sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules
made thereunder, and be regulated in the manner specified in the Table below, namely:—

the activities listed in sub paragraph (1) of paragraph 6 as
per building byelaws to meet the residential needs of the
local residents such as:
(i) Widening and strengthening of existing roads and
construction of new roads;
(ii) Construction and renovation of infrastructure and civic
amenities;
(iii) Cottage industries including village industries;
convenience stores & local amenities supporting eco-
tourism including home stays; and
(iv) Promoted activities listed in this Notification.
16. Trenching ground. Establishing of new trenching ground is prohibited. Old
trenching grounds are to be regulated under applicable
laws.
17. Vehicular emissions. Regulated under applicable laws.
18. Noise pollution. Regulated under applicable laws.
19. Felling of trees. (a) There shall be no felling of trees on the forest or

5. Monitoring Committee.- The Central Government hereby constitutes a committee to be called the Monitoring
Committee, to monitor the compliance with the provisions of this notification, which shall comprise of the following
namely:—
(1) District Collector, Osmanabad. Chairman;
(2) Representative of District Collector, Solapur. Member;
(3) A representative of Zilla Parishad, Osmanabad. Member;
(4) A representative of Zilla Parishad, Solapur. Member;
(5) One representative of Non-Governmental Organisation Member;
(working in the field of environment and heritage
conservation) to be nominated by the State Government for a
period of one year.
(6) One expert in the area of ecology and environment to be Member;
nominated by the State Government for a period of one year.
(7) Regional Officer, Maharashtra State Pollution Control Member;
Board, Osmanabad.
(8) Town Planning Officer, Osmanabad. Member;
(9) Town Planning Officer, Solapur. Member;
(10) Member of State Biodiversity Board. Member;
(11) Representative of Conservator of Forest, Solapur Forest Member; and
Division.
12. Divisional Forest Officer, Osamabad. Member-Secretary .
6. Terms of Reference.-
(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2) The tenure of the Monitoring Committee shall be for a period of three years from the date of issue of
Notification
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in
the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,
shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to
the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental
clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are
falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph
4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and
referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park
Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment
(Protection) Act, 1986 against any person who contravenes the provisions of this notification.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives
from Industry Associations or concerned stakeholders to assist in its deliberations depending on the
requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of
every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at
Annexure-IV.
(8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal.
