असाधारण, भाग II, खंड 3, उपखंड स ं (ii) में उन सभी व्यधिर्ों से, धजनके उससे प्रभयधवर् होने की संभयवनय थी, र्यरीख 2 मयच,ा 2016 को उस रयजपत्र की प्रधर्र्यं, धजसमें र्ह अधिसूचनय अंर्र्वाष्ट ह,ै जनता को उपलब्ि करय िी गई थी, सयठ दिन की अवधि के भीर्र आक्षेप और सुझयव आमंधत्रर् करर्े हुए एक प्रयरुप अधिसूचनय प्रकयधिर् की गई थी; और, उि प्रयरुप अधिसूचनय अन्तर्विष्ट करन े वाल े राजपत्र की प्रततयां जनता को तारीख 4 मयचा, 2016 को उपलब्ध करा दी गई थी; और, उि प्रयरुप अधिसूचनय के उत्तर में सभी व्यधिर्ों और पणियररर्ों से प्रयप्त आक्षेपों और सुझयवों पर केंद्रीर् सरकयर द्वयरय सम्र्क् रुप से धवचयर दकर्य गर्य; प्रचयलन र्थय प्रसंस्करण करने को प्रधर्धषद्ध करनय आव्र्क ह;ै अर्ः, अब, के्द्रीर् सरकयर, पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उपधनर्म (3) के सयथ परठर् पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 3 की उपियरय (3) और उपियरय (2) के खंड (v) और खंड (xiv) और उपियरय (1) द्वयरय प्रित्त िधिर्ों कय प्रर्ोग करर् े हुए, म र् प्रििे में फैले डयर्नयसौर रयष्‍टर ीर् उन मयन की सीमय से 250 मीटर र्क के धवस् र्यर र्क के क्षत्रे को डयर्नयसौर रयष्‍टर ीर् उन मयन पयररधस्थधर्क संवेिी जोन (धजसे ससमें ससके प्च यर्् पयररधस्थधर्क संवेिी जोन कहय गर्य ह)ै के रूप में अधिसूधचर् करर्ी ह,ै धजसकय धववरण धनम्नयनुसयर ह,ै अथयार् ् :-- 1. पयररधस्थधर्क सवं िे ी जोन कय धवस्र्यर और उसकी सीमयए—ं (1) पयररधस्थधर्क संवेिी जोन कय धवस् र्यर डयर्नयसौर रयष्‍टर ीर् उन मयन स े 250 मीटर र्क होगय (2) पयररधस्थधर्क संवेिी जोन 2.0125 वगा दकलोमीटर क्षेत्र में फैलय हुआ ह ै और डयर्नयसौर रयष्‍टर ीर् उन मयन के भू- धनििे यंक और पयररधस्थधर्क संवेिी जोन कय मयनधचत्र और पयररधस्थधर्क संवेिी जोन के भू उपर्ोग उपयबिं I के रुप में संलग्न ह ै (3) पयररधस्थधर्क संवेिी जोन के अंर्गर्ा आने वयल े ग्रयमों की सूची उपयबिं II के रुप में संलग्न ह ै 2. पयररधस्थधर्क सवं ेिी जोन के धलए आचं धलक महयर्ोजनय —(1) पयररधस्थधर्क संवेिी जोन के प्रर्ोजन के धलए आंचधलक महयर्ोजनय रयजपत्र में अंधर्म अधिसूचनय के प्रकयिन की र्यरीख से िो वषा की अवधि के भीर्र, स्थयनीर् व्यधिर्ों के परयमिा से और सस अधिसूचनय में संलग् न अनुबंिों के सयमंजस्र् से रय्र् सरकयर में सक्षम प्रयधिकयरी के अनुमोिन के धलए रय्र् सरकयर द्वयरय र्ैर्यर की जयएगी (2) पयररधस्थ धर्क संवेिी जोन के धलए आचंधलक महयर्ोजनय रय्र् सरकयर द्वयरय सस अधिसूचनय म ें र्थयधवधनर्िष्‍टा ट रीधर् में और सुसंगर् केंद्रीर् और रय् र् धवधिर्ों और केंद्रीर् सरकयर द्वयरय जयरी मयगाधनििे ों धसद्धयर्ं ों, र्दि कोई हो, के सयमंजस्र् स े र्ैर्यर की जयएगी (3) आंचधलक महयर्ोजनय, पर्यावरणीर् और पयररधस्थधर्क धवचयरों को समयकधलर् करने के धलए रय् र् सरकयर के धनम्नधलधखर् धवभयगों के परयमिा से र्ैर्यर होगी, अथयार्:् — (i) पर्यावरण; (ii) वन और व्र्जीव;II (ii) 3 (iii) कृधष और बयगवयनी ; (iv) रयजस्व ; (v) िहरी धवकयस; (vi) पर्ाटन पयररधस्थधर्क पर्ाटन सधहर्; (vii) ग्रयमीण धवकयस; (viii) ससंचयई और बयढ़ धनर्ंत्रण; (ix) नगरपयधलक और िहरी धवकयस; (x) पंचयर्र्ी रयज; (xi) लोक धन मयाण धव भयग (4) आंचधलक महयर्ोजनय, अनमु ोदिर् धवन ममयन भू-उपर्ोग, अवसंरचनय और दिर्यकलयपों पर कोई धनबंिन अधिरोधपर् नहीं करेगी जब र्क दक सस अधिसूचनय में धवधनर्िष्‍टा ट न हो और आचंधलक महयर्ोजनय सभी अवसरं चनय और दिर्यकलयपों में और अधिक िक्षर्य और पयररधस्थधर्क अनुकूलर्य कय संविान करेगी (5) आंचधलक महयर्ोजनय में अनयच्छयदिर् क्षेत्रों के जीणोद्धयर, धवन ममयन जल धनकयर्ों के संरक्षण, आवयह क्षेत्रों के प्रबंिन, जल-संभरों, क्षेत्रो के प्रबंिन, भूर्ल जल के प्रबंिन, मृिय और नमी संरक्षण, स्थयनीर् समुियर्ों की आव्र्कर्यओं र्थय पयररधस्थधर्क और पर्यावरण स े संबंधिर् ऐसे अ्र् पहलुओं, धजन पर र्यन िने य आव्र्क ह,ै के धलए उपबंि होंग े (6) आंचधलक महयर्ोजनय सभी धवन ममयन पूजय स्थ लों, ग्रयमों और नगरीर् बंिोबस्र्ों, वनों के प्रकयर और दकस्म ों, कृधष क्षेत्रों, ऊपजयऊ भूधम, हररर् क्षेत्र जैसे उन मयन और उसी प्रकयर के स्थ यन, उन मयन कृधष क्षेत्र, फलोउन मयन, झीलों और अ्र् जल धनकयर्ों कय अभ्र्कंन करेगी और र्ोजनय को प्रस्र्यधवर् और धवन ममयन भूधम उपर्ोग की धविेषर्यओं के ब्र्ौरे िर्े े हुए मयनधचत्र द्वयरय समर्थार् दकर्य जयएगय (7) आंचधलक महयर्ोजनय पयररधस्थधर्क संवेिी जोन में धवकयस को धवधनर्धमर् करेगी और पैरय 4 के सयरणी म ें सूचीबद्ध प्रधर्धषद्ध और धवधनर्धमर् कयर्ाकलयपों कय अनुपयलन करेगी र्थय स्थ यनीर् समुियर्ों के पयररधस्थधर्की अनुकूल धवकयस के धलए जीवकोपयजान को सुरधक्षर् और सवं र्िार् करने कय सुधनश्चर् दकर्य जयएगय (8) ऐसी अनुमोदिर् आंचधलक महयर्ोजनय, सस अधिसूचनय में दिए गए उपबंिों के सबं ंि में अपने कयर्ों के धनवाहन के धलए मयनीटरी सधमधर् के धलए एक संिभ ा िस्र्यवेज होगी 3. रय्र् सरकयर द्वयरय दकए जयन े वयल े उपयर्—रय्र् सरकयर सस अधिसूचनय के उपबंिों को प्रभयवी करन े के धलए धनम्नधलधखर् उपयर् करेगी, अथयार्:् — (1) भ-ू उपर्ोग —पयररधस्थ धर्क संवेिी जोन में वनों, उन मयन-कृधष क्षेत्रों, कृधष क्षेत्रों, आमोि-प्रमोि के प्रर्ोजन के धलए धचध्हर् दकए गए पयकों और खुल े स्थयनों कय वयधणध्र्क और औन मोधगक संबद्ध धवकयस दिर्यकलयपों के धलए उपर्ोग र्य संपररवर्ान नहीं होगय : परंर्ु पयररधस्थधर्क संवेिी जोन के भीर्र कृधष भूधम और अ्र् भूधमर्ों कय संपररवर्ान मयनीटरी सधमधर् की धसफयररि पर और रय्र् सरकयर के पूवा अनुमोिन स,े जो स्थयनीर् धनवयधसर्ों की आवयसीर् जरूरर्ों को पूरय करन े के धलए ह ै र्थय दिर्यकलयपों के धलए जैसे: —4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (i) धवन ममयन सड़कों को चौड़य करनय और उ्ह ें सुिढृ करनय र्थय नई सड़कों कय संधनमयाण; (ii) बुधनर्यिी ढयंचों और नयगररक सुधवियओं कय संधनमयाण और नवीकरण; (iii) प्रिषू ण उत्पन्न न करन े वयले लघु उन मोग; (iv) कुटीर उन मोगों धजसके अंर्गार् ग्रयमीण कयरीगर ह;प सुधवियजनक भण्डयर और स्थयनीर् सुधवियओं सहयर्क पयररधस्थधर्क पर्ाटन में सधम्मधलर् ग्रह वयस; और (v) पैरय 4 में दिए गए संवर्िार् दिर्यकलयपों के धलए अनुज्ञयर् दकर्य जय सकेगय: परंर् ु र्ह और भी दक क्षेत्रीर् नगर र्ोजनय अधिधनर्म और अ्र् धनर्मों और धवधनर्मों के अंर्गार् रय्र् सरकयर के पूव ा अनुमोिन र्थय सधं वियन के अनच्ु छेि 244 और र्त्समर् प्रवृत्त धवधि के उपबंिों के अनुपयलन के धबनय, धजसके अंर्गार् अनुसूधचर् जनजयधर् और अ्र् परंपरयगर् वन धनवयसी (वन अधिकयरों की मय्र्र्य) अधिधनर्म, 2006 (2007 कय 2) भी ह,ै वयधणध्र्क र्य उन मोग धवकयस दिर्यकलयपों के धलए जनजयर्ीर् भूधम कय उपर्ोग अनुज्ञयर् नहीं होगय: परंर्ु र्ह और भी दक पयररधस्थ धर्क संवेिी जोन के भीर्र भू-अधभलेखों में उपसंजयर् कोई त्रुरट, मयनीटरी सधमधर् के धवचयर प्रयप्त करन े के पश्चयर्् रय्र् सरकयर द्वयरय प्रत्र्ेक मयमले में एक बयर संिोधिर् होगी और उि त्रुरट के संिोिन की भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् को सचू नय िने ी होगीः परंर्ु र्ह और भी दक उपर्ुाि त्रुरट कय संिोिन में सस उप पैरय के अिीन र्थय उपबंधिर् के धसवयर् दकसी भी ििय में भू-उपर्ोग कय पररवर्ान सधम्मधलर् नहीं होगयः परंर्ु र्ह और भी दक धजसस े हररर् क्षेत्र म ें जैस े वन क्षेत्र, कृधष क्षेत्र आदि में कोई पयररणयधमक कटौर्ी नहीं होगी और अनप्रर्ुक् र् र्य अनत्ु पयिक कृधष क्षेत्रों में पुन: वनीकरण करन े के प्रर्यस दकए जयएगं े (2) प्रयकृधर्क जल धनकयर् — सभी प्रयकृधर्क झरनों नदिर्ों और चैनलों की वयस और जैव धवधविर्य पुनः स्थयपन की जयएगी और उनके संरक्षण और पुनरुद्भूर्करण के धलए र्ोजनय आचंधलक महयर्ोजनय में सधम् मधलर् की जयएगी (3) पर्टा न/पयररधस्थधर्क पर्टा न — (क) पयररधस्थधर्क संवेिी जोन के भीर्र सभी नई पर्ाटन संबंिी दिर्यकलयप र्य धवन ममयन पर्ाटन दिर्यकलयपों कय धवस्र्यर पर्ाटन महयर्ोजनय के अनुसयर होंगे (ख) पयररधस्थधर्क पर्ाटन महयर्ोजनय रय्र् पर्ाटन धवभयग द्वयरय, रय्र् के पर्यावरण और वन धवभयगों के परयमिा से र्ैर्यर की जयएगी (ग) पर्ाटन महयर्ोजनय आंचधलक महयर्ोजनय के एक घटक के रूप में होगी (घ) पर्ाटन संबंिी दिर्यकलयप धनम् नधलधखर् के अिीन धवधनर्धमर् होंगे, अथयार्् :- (i) डयर्नयसौर रयष्‍टर ीर् उन मयन की सीमय 1 दकलोमीटर के भीर्र र्य पयररधस्थधर्क संविे ी जोन कय धवस्र्यर र्क, ससमें जो भी नजिीक हो, होटल और ररसोटा के नए संधनमयाण अनुज्ञयर् नहीं होगे र्थयधप व्र्जीव अभर्यरण्र् की सीमय से एक दकलोमीटर की िरू ी से परे पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क नए होटल और ररसोटो की स्थयपनय को पूवा पररभयधषर् और अधभधहर् क्षेत्रों में पयररधस्थधर्की पर्ाटन महयर्ोजनय के अनुसयर अनुज्ञयर् दकर्य जयएगय; (ii) पयररधस्थधर्क संवेिी जोन के भीर्र सभी नए पर्ाटन दिर्यकलयपों र्य धवन ममयन पर्ाटन दिर्यकलयपों कय धवस्र्यर केंद्रीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् के मयगाििाक धसद्धयंर्ों के द्वयरयII (ii) 5 र्थय रयष्‍टर ीर् ा र्यघ्र स सरं क्षण प्रयधिकरण, द्वयरय जयरी पयररधस्थधर्क पर्ाटन (समर्-समर् पर र्थय संिोधिर्) मयगिा िाक धसद्धयंर्ों के अनुसयर, पयररधस्थधर्क पर्ाटन, पयररधस्थधर्क धिक्षय और पयररधस्थधर्क धवकयस को महत्व िर्े े हुए पयररधस्थधर्क संवेिी जोन की वहन क्षमर्य के अ र्र्न पर आियररर् होगय; (iii) आंचधलक महयर्ोजनय कय अनुमोिन दकए जयने र्क, पर्ाटन के धलए धवकयस और धवन ममयन पर्ाटन दिर्यकलयपों के धवस्र्यर को वयस्र्धवक स्थल धवधनर्िष्टा सवं ीक्षय र्थय संबद्ध मयनीटरी सधमधर् की धसफयररि पर आियररर् संबंधिर् धवधनर्यमक प्रयधिकरणों द्वयरय अनुज्ञयर् दकर्य जयएगय (4) नसै र्गका धवरयसर्.— पयररधस्थधर्क संवेिी जोन में महत्वपूणा नैसर्गाक धवरयसर् के सभी स्थलों जैसे सभी जीन कोि आरधक्षर् क्षेत्र, िैल धवरचनयए,ं जल प्रपयर्ों, झरनों, घयटी मयगों, उपवनों, गुफयए,ं स्थलों, भ्रमण, अश्वरोहण, प्रपयर्ों आदि की पहचयन की जयएगी और धवरयसर् संरक्षय र्ोजनय उनकी सरं क्षय र्ोजनय उनकी संरक्षय संरक्षण के धलए बनयई जयर्ेगी जो आचं धलक महयर्ोजनय कय भयग होगी (5) मयनव धनर्मर्ा धवरयसर् स्थ ल.— पयररधस्थ धर्क संवेिी जोन में भवनों, संरचनयओं, धिल्प-र्थ्र्, ऐधर्हयधसक, कलयत्मक और सयंस्कृधर्क महत्व के क्षेत्रों की पहचयन की जयएगी और उनके संरक्षण के धलए धवरयसर् संरक्षण की र्ोजनय र्ैर्यर की जयएगी जो आंचधलक महयर्ोजनय कय भयग होगी (6) व धन प्रिषू ण.— पयररधस्थधर्क संवेिी जोन में वधन प्रिषू ण कय धनर्ंत्रण और धनवयरण पर्यावरण (संरक्षण) अधिधनर्म, 1986, के अिीन बनयए गए वधन प्रिषू ण (धवधनर्मन और धनर्ंत्रण) धनर्म, 2000 के उपबिों के अनुसरण में दकर्य जयएगय (7) वयर् ु प्रिषू ण.— पयररधस्थधर्क संवेिी जोन में, वयर् ु प्रिषू ण कय धनर्ंत्रण और धनवयरण(प्रिषू ण धनवयरण और धनर्ंत्रण) अधिधनर्म, 1981 (1981 कय 14) और उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसरण में दकर्य जयएगय (8) बधहस्रयव कय धनस्सयरण .— पयररधस्थधर्क संवेिी जोन में उपचयररर् बधहस्रयव कय धनस्सयरण सयियरण मयनकों के धलए पर्यावरणीर् प्रिधू षर् आच्छयदिर् के धनस्सयरण के अंर्गार् पर्यावरणीर् (संरक्षण) अधिधनर्म, 1986 और उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसयर होगय (9) ठोस अपधिष्ट .— ठोस अपधिष्टों कय धनपटयन और प्रबंिन धनम्नधलधखर् रूप में होगय-- (क)पयररधस्थधर्क संवेिी जोन में उपचयररर् बधहस्रयव कय धनस्सयरण, समर्-समर् पर संिोधिर् ठोस अपधिष्‍टट प्रबंिन धनर्म, 2016, जो भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं. कय.आ. 1357(अ) र्यरीख 8 अप्रैल, 2016 द्वयरय प्रकयधिर् दकए गए थे, के उपबंिों के अनुसयर दकर्य जयएगय ; अकयबाधनक सयमग्री कय धनपटयन पयररधस्थधर्क संवेिी जोन के बयहर पहचयन दकए गए स्थ ल पर दकसी पर्यावरणीर् स्वीकृर् रीधर् में होगय; (ख) पयररधस्थधर्क संवेिी जोन के अंर्गार् जैव-धचदकत्सय अपधिष्टों के सुरधक्षर् और पर्यावरणीर् वधन प्रबंिन (ईएसएम) की पहचयन की गई र्कनीकों के उपर्ोग की धवन ममयन धनर्मों और धवधनर्मों के अनुरूप अनुज्ञयर् की जय सकेगी (10) जवै धचदकत्स ीर् अपधिष्‍टट . —जैव धचदकत् सीर् और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं.कय.धन. 343 (अ), र्यरीख 28 मयचा, 2016 द्वयरय प्रकयधिर् जैव धचदकत्सीर् अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय (ख) पयररधस्थधर्क संवेिी जोन के अंर्गार् जैव-धचदकत्सय अपधिष्टों के सुरधक्षर् और पर्यावरणीर् वधन प्रबंिन (ईएसएम) की पहचयन की गई र्कनीकों के उपर्ोग की धवन ममयन धनर्मों और धवधनर्मों के अनुरूप अनुज्ञयर् की जय सकेगी (11) प्लयधस्टक सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं.कय.धन. 317(अ), र्यरीख 29 मयचा, 2016 द्वयरय प्रकयधिर् संधनमयाण और धव वंस प्रबंि धनर्म, 2016 के उपबंिों के अनसु यर दकर्य जयएगय (13) ई–अपधिष्ट. — पयररधस्थधर्क संवेिी जोन में ई–अपधिष्ट प्रबंि कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ना मंत्रयलर् द्वयरय प्रकयधिर् ई–अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय (14) र्यनीर् पररवहन. — पररवहन की र्यनीर् गधर्धवधिर्यं आवयस के अनुकूल रीधर् स े धवधनर्धमर् होंगी और सस संबंि में आंचधलक महयर्ोजनय में धविेष उपबंि धनर्धमर् दकए जयएगं े और आंचधलक महयर्ोजनय के र्ैर्यर होन े और रय्र् सरकयर के सक्षम प्रयधिकयरी द्वयरय के अनुमोदिर् होन े र्क, मयनीटरी सधमधर् प्रवृत्त धनर्मों और धवधनर्मों के अनुसयर र्यनीर् गधर्धवधिर्ों के अनुपयलन को मयनीटर करेगी (15) र्यनीर् प्रिषू ण. — लयगू धवधिर्ों के अनसु यर र्यनीर् प्रिषू ण कय धनवयरण और धनर्ंत्रण कय अनुपयलन दकर्य जयएगय और स्वच्छक ईंिन के उपर्ोग के धलए दकए प्रर्यस, उियहरण के धलए सीएनजी, एलपीजी, आदि, दकए जयंएगे (16)औन मोधगक ईकयसर्य.ं — (i) पयररधस्थधर्क संवेिी जोन के भीर्र कोई नए प्रिषू ण कयररर् करने वयल े उन मोगों की स्थयपनय अनुज्ञयर् नहीं होगी (ii) पयररधस्थधर्क संवेिी जोन के भीर्र, के्द्रीर् प्रिषू ण धनर्ंत्रण बोड ा द्वयरय फरवरी, 2016 में जयरी दिियधनििे ों में उन मोगों के वगगीककरण के अनुसयर, जब र्क दक सस अधिसचू नय में धवधनर्िष्टा न हो, केवल गरै - प्रिषू णकयरी उन मोगों के अनुज्ञयर् दकर्य जयएगय (17) पहयड़ी ढलयनों को सरं क्षण. — पहयड़ी ढलयनों के सरं क्षण के धनम्नयनुसयर होगय: (क) आंचधलक महयर्ोजनय पहयड़ी ढलयनों पर ऐस े क्षेत्र संधगर् करेगी जहयं कोई संधनमयणा अनुज्ञयर् नहीं होगय (ख) धवन ममयन पहयड़ी ढलयनों और उच्च करेगीII (ii) 7 4. पयररधस्थधर्क सवं ेिी जोन म ें प्रधर्धषद्ध और धवधनर्धमर् दकए जयन े वयल े दिर्यकलयपों की सचू ी—पयररधस्थधर्क संवेिी जोन में सभी दिर्यकलयप, पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) के उपबंिों और र्टीर् धवधनर्मन जोन (सीआरजेड), 2011 और पर्यावरणीर् प्रभयव आकलन अधिसचू नय, 2006 और वन (संरक्षण) अधिधनर्म, 1980 (1980 के 69), भयरर्ीर् वन अधिधनर्म, 1927 (1927 के 16), व्र्जीव (संरक्षण) अधिधनर्म, 1972 (1972 के 53) और उसके दकए गए संिोिनों सधहर् द्वयरय ियधसर् होंग े और नीचे िी गई सयरणी में धवधनर्िष्टा रीधर् में धवधनर्धमर् होंग,े अथयार्् :-- सयरणी िम स.ं दिर्यकलयप टीकय-रटप्पणी (1) (2) पयररधस्थधर्क संवेिी जोन में कोई नर्य उन मोग र्य प्रिषू ण वधन, आदि) कयररर् करने वयल े फैलयने वयले उन मोगों के धवस्र्यर अनुज्ञयर् नहीं होगय उन मोगों की स् थयपनय पयररधस्थधर्क संवेिी जोन के भीर्र, के्द्रीर् प्रिषू ण धनर्ंत्रण बोड ा द्वयरय फरवरी, 2016 म ें जयरी दिियधनििे ों में उन मोगों के वगगीककरण के अनुसयर, जब र्क दक सस अधिसूचनय में धवधनर्िष्टा न हो, केवल गरै -प्रिषू णकयरी उन मोगों के अनज्ञु यर् दकर्य जयएगय (3) बृहर् जल धवन मुर् पररर्ोजनय की लयगू धवधिर्ों के अनुसयर प्रधर्धषद्ध (अ् र्थय उपबंधिर् के धसवयर्) स् थयपनय होंगे (4) दकसी पररसंकटमर् पियथों कय उपर्ोग लयगू धवधिर्ों के अनुसयर प्रधर्धषद्ध (अ् र्थय उपबंधिर् के धसवयर्) होंगे ख. धवधनर्धमर् दिर्यकलयप (12) वयधणध्र्क होटलों और ररसोटों की पयररधस्थधर्क पर्ाटन दिर्यकलयपों के धलए लघ ु अस्थयर्ी स्थयपनय संरचनयओं के धसवयर् सरं धक्षर् क्षेत्र की सीमय स े एक दकलोमीटर के भीर्र र्य पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क, सनमें जो भी धनकट ह,ै कोई वयधणध्र्क होटल और ररसोटा अनुज्ञयर् नहीं होगय परंर्ु संरधक्षर् क्षेत्र की सीमय के एक दकलोमीटर के परे र्य पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क, जो भी समीप हो, सभी नए पर्ाटन दिर्यकलयप र्य धवन ममयन दिर्यकलयपों कय धवस्र्यर पर्ाटन महयर्ोजनय और लयग ू मयगाििाक धसद्धयंर्ों के अनुरुप होगय (13) संधनमयाण दिर्यकलयप (क) संरधक्षर् क्षेत्र की सीमय से एक दकलोमीटर के भीर्र र्य पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क, जो भी धनकट हो, दकसी भी प्रकयर कय वयधणध्र्क संधनमयाण अनुज्ञयर् नहीं होगय: परंर्ु, स्थ यनीर् लोगों को धजसके अंर्गर्ा उनके आवयसीर् उपर्ोग के धलए उनकी भूधम में संधनमयाण करने पैरय 3 के उप पैरय (1) में सूचीबद्ध दिर्यकलयपों भवन उपधवधिर्ों के अनुसयर अनुज्ञयर् होगय, अथयर्ा ्- (i) धवन ममयन सड़कों को चौड़य करनय और उ्ह ें सुिढृ करनय र्थय नई सड़कों कय संधनमयाण; (ii) बुधनर्यिी ढयंचों और नयगररक सुधवियओं कय संधनमयाण और नवीकरण; (iii) केंद्रीर् प्रिषू ण धनर्ंत्रण बोड ा द्वयरय फरवरी, 2016 में जयरी दिियधनििे ों में उन मोगों के वगगीककरण के अनुसयर केवल गैर- प्रिषू णकयरी उन मोग; (iv) कुटीर उन मोगों, धजसके अंर्गार् ग्रयमीण उन मोग भी ह;प सुधवियजनक भण्डयर और स्थयनीर् सुख सुधवियऐंII (ii) 9 पयररधस्थधर्क पर्ाटन को बढ़यवय िने े वयली धजस के अ्र्गार् गृह वयस भी ह;ै और (v) सस अधिसूचनय में सूचीबद्ध संवर्िार् दिर्यकलयप : (ख) पर्र्ु र्ह और दक ऐसे लघु उन मोग जो प्रिषू ण कयररर् नहीं करर्े धवधनर्धमर् दकए जयएगं े और लयगू धनर्मों और धवधनर्मों, र्दि कोई हों, के अनुसयर सक्षम प्रयधिकयरी की पूवा अनुज्ञय से ् र्ूनर्म रखे जयएगं े (ग) एक दकलोमीटर से परे र्ह आंचधलक महयर्ोजनय की अनुसयर धवधनर्धमर् होंगे (14) गैर-प्रिषू णकयरी लघु उन मोग के्द्रीर् प्रिषू ण धनर्ंत्रण बोड ा फरवरी, 2016 में जयरी दििय धनििे ों में उन मोगों में वगगीककरण के अनुसयर, केवल गैर- प्रिषू णकयरी उन मोग और अपररसंकटमर् लघु और सेवय उन मोग, कृधष, पुष्‍टप कृधष, उन मयन कृधष र्य पयररधस्थधर्क संवेिी जोन से ििे ी सयमग्री से उत्पयिों को उत्पन्न होने वयले कृधष आियररर् उन मोग, सक्षम प्रयधिकयरी द्वयरय अनुज्ञयर् होंगे (15) वृक्षों की कटयई (क) रय्र् सरकयर में सक्षम प्रयधिकयरी की पूवा अनुज्ञय के धबनय वन, सरकयरी र्य रयजस्व र्य धनजी भूधम पर र्य वनों में ककंही वृक्षों की कटयई नहीं होगी (ख) वृक्षों की कटयई संबद्ध केंद्रीर् र्य रय्र् अधिधनर्म र्य उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसयर धवधनर्धमर् होगी (16) वन उत्पयिों और गैर कयष्‍टठ वन लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे उत्पयिों कय संग्रहण (एनटीएफपी) (17) प्रवयसी चरवयहय लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे (18) धवन मुर् और िरू संचयर टयवरों कय लयगू धवधिर्ों के अिीन धवधनर्धमर् होंग े (भूधमगर् केबल पररधनमयाण और केबल धबछयनय और धबछयए जयने को बढ़यवय दिर्य जयएगय) अ्र् दिर्यकलयप जैसे गम ा लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े वयर्ु गुब्बयरें, हले ीकयप्टर, ड्रोन, मयसिोलयसटस और अ्र् पर्ाटन दिर्यकलयप आदि द्वयरय पयररधस्थधर्क संवेिी जोन क्षेत्र के ऊपर से उड़नय जैस े प्रित्त िधिर्ों कय प्रर्ोग करर्े हुए, र्ीन वष ा की अवधि के धलए मयनीटरी सधमधर् कय गठन पयररधस्थधर्क संवेिी जोन की प्रभयवी मयनीटरी के धलए, करर्ी ह ै जो धनम्नधलधखर् से धमलकर बनेगी, अथयर्ा ्:- (i) प्रभयगीर् आर्ुक्र् , संिौर -अ र्क्ष ; (ii) मुख् र् वन संरक्षक, संिौर -सिस्र् ; (iii) धजलय कलक् टर, ियर धजलय -सिस् र् ; (iv) कयर्ापयलक संजीधनर्र, लोक धनमयाण धवभयग, ियर -सिस् र् ; (v) कयर्ापयलक संजीधनर्र, सयवजा धनक स् वयस्थ् र् धवभयग, ियर -सिस् र् ; (vi) मुख् र् कयर्ापयलक अधि कयरी, धजलय पंचयर्र्, ियर -सिस् र् ; (vii) म र् प्रििे प्रिषू ण धनर्ंत्रण बोड ा कय प्रधर्धनधि -सिस् र् ; (viii) रय्र् जैव-धवधविर्य बोड ा कय सिस्र् - सिस्र् ; (ix) पर्यावरण के क्षेत्र में कयर्ा करने वयले दकसी गैर-सरकयरी संगठन कय, म र् प्रििे रय्र् सरकयर द्वयरय, प्रत्र्ेक मयमलों में र्ीन वषा की अवधि के धलए, नयम धनर्िष्टा दकर्य जयने वयलय एक प्रधर्धनधि -सिस् र्; (x) म र् प्रििे सरकयर द्वयरय नयमधनर्िष्‍टा ट दकर्य जयन े वयलय प्रत्र्ेक मयमल े में र्ीन वष ा की अवधि के धलए रय्र् में दकसी धवश्वधवन मयलर् के सुधवख्र्यर् संस्थयन से पयररधस्थधर्क और पर्यावरण क्षेत्र कय एक धविेषज्ञ – सिस् र्; (xi) प्रभयगीर् वन अधि कयरी, ियर – सिस् र्-सधचव 6. धनििे धनबिं न.- (1) मयनीटरी सधमधर् कय कयर्ाकयल र्ीन वषों की अवधि के धलए होगय (2) पयररधस्थधर्क संवेिी जोन सधमधर् सस अधिसूचनय के उपबंिों के अनुपयलन को मयनीटर करेगी (3) पयररधस्थधर्क संवेिी जोन में भयरर् सरकयर के र्त् कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय सं. कय.आ. 1533(अ) र्यरीख 14 धसर्ंबर, 2006 की अनुसूची में के अिीन सधम्मधलर् दिर्यकलयपों और सस अधिसूचनय के पैरय 4 के अिीन प्रधर्धषद्ध गधर्धवधिर्ों के धसवयर् आने वयल े ऐसे दिर्यकलयपों की ििय में वयस्र्धवक धवधनर्िष्टा स्थलीर् िियओं पर आियररर् मयनीटरी सधमधर् द्वयरय संवीक्षय की जयएगी और उि अधिसूचनय के उपबंिों के अिीन पूवा पर्यावरण धनकयसी के धलए कें्द्रीर् सरकयर के पर्यावरण और वन मंत्रयलर् को धनर्िष्टा की जयएगी (4) सस अधिसूचनय के पैरय 4 के अिीन र्थय धवधनर्िष्टा प्रधर्धषद्ध दिर्यकलयपों के धसवयर्, भयरर् सरकयर के पर्यावरण और वन मंत्रयलर् की अधिसूचनय संख्र्यंक कय.आ. 1533(अ) र्यरीख 14 धसर्ंबर, 2006 की अधिसूचनय के अनुसूची के अिीन ऐसे दिर्यकलयपों, धज्ह ें सधम्मधलर् नहीं दकर्य गर्य ह,ै परंर् ु पयररधस्थधर्क संवेिी जोन में आर्े ह,प ऐसे दिर्यकलयपों की वयस्र्धवक धवधनर्िष्टा स्थलीर् िियओं पर आियररर् 2669(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, part II, section 3, sub-section (ii), dated the 4th March, 2016, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 658(E), dated 2nd March, 2016, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, copies of the Gazette containing the said notification were made available to the public on the 4th March, 2016; AND WHEREAS, objections and suggestions received from persons and stakeholders in response to the draft notification were duly considered by the Central Government; AND WHEREAS, the Dinosaur National Park is located in Dhar District of Madhya Pradesh and is spread over an area of 0.897 square kilometres; AND WHEREAS, the said National Park is rich in Flora and fauna Fossils, it has been classified in in group 5 of champion and Seth classification; the floral Fossils include Gymnosperm, Araucaria, Podocarpus, Jack fruit, Palm tree species, and Blue Green algae; the Faunal Fossils include Dinosaur Bones, Eggs, Scat, Echinodermata, Mollusca, fish and Porifera Species that have been recorded in the Dinosaur Fossils National Park Bagh; and the said National Park is inhabited by all the usual animals of the region, such as Jackal (canisaureus), Indian fox (Vulpesbengalensis), Striped hyaena (Hyaenahyaena) can also be seen in the Dinosaur National Park; AND WHEREAS, the Dinosaur National Park has the fossil remains of Dinosaur eggs, bones and scat and also other faunal fossils such as Echinoderms, Molluscs, Fishes and Poriferans and floral fossils of Gymnosperms, Aurocaria, Podocarpus, Jack Fruit, Palm tree species and blue green algae; AND WHEREAS, the National Park has flora and fauna which is characteristic to the region and include animal species such as Jackal, Fox and Striped Hyeana; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification, around the Dinosaur National Park as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area up to an extent of 250 meters from the boundary of Dinosaur National Park as the Dinosaur National Park Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone), details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone.- (1)The extent of Eco-Sensitive Zone is 250 meters from the boundary of Dinosaur National Park. (2) The Eco-sensitive Zone is spread over an area of 2.0125 square kilometers and the co-ordinates of the Dinosaur National Park and Eco-sensitive Zone, map and landuse in the Eco-sensitive Zone is appended as Annexure-I. (3) The list of villages within Eco-sensitive Zone is appended as Annexure-II. 2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture and Horticulture; (iv) Revenue; (v) Urban Development; (vi) Tourism including eco-tourism; (vii) Rural Development; (viii) Irrigation and Flood Control;II (ii) 17 (ix) Municipal and urban development; (x) Panchayati Raj; (xi) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities. (8) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Landuse.- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities: Provided that the conversion of agricultural and other lands, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government to meet the residential needs of the local residents and for activities such as- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given in paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat and biodiversity restoration activities. (2) Natural water bodies.- The catchment areas of all natural springs, rivers and channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan. (3) Tourism/ Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco- sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (b)The eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The activities of eco-tourism shall be regulated as under, namely:- (i) no new construction of hotels and resorts shall be permitted within 1 km from the boundary of the Dinosaur National Park or upto the extent of the Eco-sensitive Zone, whichever is nearer and beyond the distance of 1 km. from the boundary of the said National Park till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan. (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism. (iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel or resort or commercial establishment construction shall be permitted within the Eco-sensitive Zone. (4) Natural heritage.— All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.— Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan. (6) Noise pollution.— Prevention and Control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986. (7) Air pollution.— Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder. (8) Discharge of effluents.— Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government. (9) Solid wastes.— Disposal and management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. (b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (10) Bio-medical waste.- Bio medical waste management shall be as under: (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March, 2016. (b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.II (ii) 19 (11) Plastic waste management.— The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016. (12) Construction and demolition waste management.— The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016. (13) E-waste.— The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change. (14) Vehicular traffic.— The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.-— Prevention and control of vehicular pollution shall be carried out in accordance with applicable laws and the efforts shall be made for use of cleaner fuel for example CNG, etc. (16) Industrial Units.— (i) No new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be permitted within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise specified in this notification. (17) Protection of hill slopes.— The protection of hill slopes shall be as under:- (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted. (18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:— TABLE S. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone. 8. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws. 9. Use of polythene bags. Prohibited (except as otherwise provided) as per applicable laws. 10. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws. 11. New wood based industry. Prohibited (except as otherwise provided) as per applicable laws. B. Regulated Activities 12. Commercial establishment of hotels No new commercial hotels and resorts shall be permitted within one and resorts. kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for eco-tourism activities: Provided that, beyond one kilometre from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable. 13. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or up to extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub- paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as: (i) Widening and strengthening of existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016; (iv) Cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including home stays; andII (ii) 21 (v) Promoted activities listed in this Notification. (b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan. 14. Small scale non polluting industries. Monitoring Committee:— In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone, which shall comprise of, namely:— (i) Divisional Commissioner, Indore Chairman; (ii) Chief Conservator of Forests, Indore Member ; (iii) District Collector, Dhar district Member; (iv) Executive Engineer Public Work Department, Dhar Member; (v) Executive Engineer, Public Health Dept.Dhar Member; (vi) Chief Executive Officer of District Panchayat,Dhar Member; (vii) Representative of the Madhya Pradesh Pollution Control Board Member; (viii) Member, State Biodiversity Board Member; (ix) One representative of Non Governmental Organisation Member; working in the field of environment to be nominated by the Government of Madhya Pradesh for a term of three years year in each caseII (ii) 23 (x) One expert in the area of ecology and environment from a Member; reputed institution of University in the State to be nominated by the Government of Madhya Pradesh for a term of three years in each case (xi) Divisional Forest Officer, Dhar Member Secretary. 6. Terms of reference.— (1) The tenure of the Monitoring Committee the shall be for a period of three years. (2) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure III. (8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal. [F.
