अधिसूचनय, उन सभी व्यधिर्ों से धजनके उससे प्रभयधवर् होन े की संभयवनय थी, उि अधिसूचनय के रयजपत्र की प्रधर्र्यं,जनर्य को उपलब्ि होन े की र्यरीख स े सयठ दिन की अवधि के भीर्र आक्षेप और सुझयव आमंधत्रर् दकए गए थ;े और, उि रयजपत्र, की प्रधर्र्यं जनर्य को 8 जनवरी, 2016 को उपलब्ि करय िी गई थीं; और, उि प्रयरुप प अधिसूचनय के प्रयुर्ुतर र में दकहींहीं व्यधिर्ों और पणियररर्ों से कोई आक्षेप और सुक्षयव प्रयप्त नहीं हुए थ;े गुियवी पक्षी अभर्यरण् र् कनयाकक रय्‍ र् के धिवमोगय धजले के सोरबय र्यलकु में अवधथथर् ह ै और र्े उयुर् र अक्षयंि 14025'59 स े 14026'41 और 7506'43 से 7501'28 पूवा ििे यंर्र के बीच 0.7368 वगा दकलोमीकर क्षेत्र में फैलय हुआ ह ै ; और, र्ह क्षेत्र पधिमी घयक के सयहर्िरी पहयडी के आर्द् ा पणापयर्ी वन और िलिली जमीन स े ढकय हुआ ह,ै जो दक भव्य रूप से सुहींिर और बहुमूल्र् वन मयगा ह,ै और अयुर्यधिक अयुर्धिक वनथपधर् और जीवजंर् ु िोनों हैं इस वन में बहुमूल्र् प्रजयधर्र्याँ सधममधलर् ह-ैं चंिन, बयाँस, रोज़वुड, होन्ने, निी आदि और वहींर्जीव में जैसे- धचतर ीियर धहरण, बनलै य सूअर, बंिर मयलयबयर, धगलहरी आदि पयए जयर् े ह ैं और इस क्षेत्र में प्रचुर मयत्रय में सरीसपप और पक्षी जीवसं्र्य भी ह;ै और, र्ह पठयर क्षेत्र में वरिय निी के धलए आवयह कुंड रुप प िर्े य ह ै और र्ह क्षेत्र धभन्न मरुप े िडं ी और अमेरुप िडं ी के धलए एक धनवयस के रुप प में कयर्ा करर्य ह;ै और, अभर्यरण्र् में असं्र् जडी-बूकी, झयधडर्यं, औषिीर् पौिें और कुछ घयसें ह ै धजनकय सवेक्षण और सूचीबद्ध दकर्य गर्य ह;ै और, गुियवी पक्षी अभर्यरण्र् के चयरों रर के क्षेत्र को, धजसकय धवथर्यर और सीमयए ं इस अधिसूचनय के पैरय 1 में धवधनर्िष्टा ह,ैं पर्यावरण की िधप ष्ट से पयररधथथधर्क संवेिी जोन के रूप में सुरधक्षर् और सरं धक्षर् करनय र्थय उि पयररधथथधर्क संवेिी जोन में उद्योगों र्य उद्योगों के वगों के प्रचयलन र्थय प्रसंथकरण करने को प्रधर्धषद्ध करनय आवश्र्क ह ै ; अर्ः, अब, केहींर्द्ीर् सरकयर, पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उपधनर्म (3) के सयथ परठर् पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 3 की उपियरय (1), उपियरय (2) के खंड (v) और खंड (xiv) और उपियरय (3) द्वयरय प्रितर िधिर्ों कय प्रर्ोग करर् े हुए, कनयाकक रय्‍ र् म ें गुियवी पक्षी अभर्यरण् र् की सीमय से चयरों रर के धवथ र्यररर् क्षेत्र को गुियवी पक्षी अभर्यरण् र् पयररस ध थधर्क संवेिी जोन (धजसे इसमें इसके पश्च यर् पयररधथथ धर्क संवेिी जोन कहय गर्य ह)ै के रूप में अधिसूधचर् करर्ी ह,ै धजसकय धववरण धनम्नयनुसयर ह,ै अथयार् :-- 1. पयररधथथधर्क सवं िे ी जोन कय धवथर्यर और उसकी सीमयए-ं -(1) गुियवी पक्षी अभर्यरण्र् कय पयररधथथधर्क संवेिी जोन 14025'16.19 से 14027'51.69 उयुर् र अक्षयंि और 74059'37.91 से 75002'29.80 पूवा ििे यंर्र के बीच ह ै और इसकय क्षेत्र 18.791 वगा दकलोमीकर ह ै और इसकय धवथर् यर गुियवी पक्षी अभर्यरण्र् के चयरों रर 1.0 दकलोमीकर से 3.2 दकलोमीकर र्क ह ै और ऐसे जोन की सीमय कय वणान उपयबिं -I पर दिर्य गर्य ह।ै (2) अक्षयंि और ििे यहींर्र के सयथ पयररधथथधर्क संवेिी जोन की सीमय कय मयनधचत्र उपयबिं II के रूप में उपयबद्ध ह ैं । (3) गुियवी पक्षी अभर्यरण्र् की सीमय के सयथ पयररधथथधर्क संवेिी जोन की सीमय के प्रमुख बबंिओंु के भू- धनििे यंक की सीमय उपयबंि III के रुप प में उपयबद्ध ह ै । (4) पयररधथथधर्क संवेिी जोन में गुियवी पक्षी अभर्यरण्र् के ग्रयमों में आने वयले गयंव उपयबिं IV के रूप में उपयबद्ध ह ैं । 2. पयररधथथधर्क सवं ेिी जोन के धलए आचं धलक महयर्ोजनय – (1) रय्‍र् सरकयर, पयररधथथधर्क संवेिी जोन के धलए रयजपत्र में अंधर्म अधिसूचनय के प्रकयिन की र्यरीख स े िो वषा की अवधि के भीर्र, थथयनीर् व्यधिर्ों के परयमिा से और इस अधिसूचनय में संलग्न अनुबंिों के सयमंजथर् से आंचधलक महयर्ोजनय र्ैर्यर करेगी ।II (ii) 3 (2) पयररधथथ धर्क संवेिी जोन के धलए आचंधलक महयर्ोजनय रय्‍र् सरकयर द्वयरय इस अधिसूचनय म ें र्थयधवधनर्िष्ा क रीधर् में और सुसंगर् केंर्द्ीर् और रय्‍ र् धवधिर्ों और केंर्द्ीर् सरकयर द्वयरय जयरी मयगाधनििे ों धसद्धयर्ं ों, र्दि कोई हो, के सयमंजथर् स े र्ैर्यर की जयएगी। (3) आंचधलक महयर्ोजनय, पर्यावरणीर् और पयररधथथधर्क धवचयरों को समयकधलर् करने के धलए रय्‍ र् सरकयर के सभी संबद्ध धवभयगों के परयमिा से र्ैर्यर होगी, अथयार् :-- (i) पर्यावरण; (ii) वन और वहींर्जीव; (iii) कपधष ; (iv) रयजथव ; (v) िहरी धवकयस; (vi) पर्ाकन; (vii) ग्रयमीण धवकयस; (viii) बसंचयई और बयढ़ धनर्ंत्रण; (ix) नगरपयधलकय; (x) पंचयर्र्ी रयज; (xi) लोक धन मयाण धव भयग। (4) आंचधलक महयर्ोजनय अनुमोदिर् धवद्यमयन भ-ू उपर्ोग, अवसंरचनय और दिर्यकलयपों पर कोई धनबंिन अधिरोधपर् नहीं करेगी जब र्क दक इस अधिसूचनय में धवधनर्िष्ा क न हो और आचंधलक महयर्ोजनय सभी अवसरं चनय और दिर्यकलयपों में और अधिक िक्षर्य और पयररधथथधर्क अनुकूलर्य कय संविान करेगी । (5) आंचधलक महयर्ोजनय में अनयच्छयदिर् क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकयर्ों के संरक्षण, आवयह क्षेत्रों के प्रबंिन, जल-संभरों क्षेत्रों के प्रबंिन, भूर्ल जल के प्रबंिन, मपिय और नमी संरक्षण, थथयनीर् समुियर्ों की आवश्र्कर्यओं र्थय पयररधथथधर्क और पर्यावरण स े संबंधिर् ऐसे अहींर् पहलूओं, धजन पर ध्र्यन िने य आवश्र्क ह,ै के धलए उपबंि होंग े । (6) आंचधलक महयर्ोजनय सभी धवद्यमयन पूजय थथ लों, ग्रयमों और नगरीर् बंिोबथर्ों, वनों के प्रकयर और दकथम ों, कपधष क्षेत्रों, ऊपजयऊ भूधम, हररर् क्षेत्र जैसे उद्ययन और उसी प्रकयर के थथ यन, उद्ययन कपधष क्षेत्र, फलोउद्ययन, झीलों और अहींर् जल धनकयर्ों कय अभ्र्कंन करेगी और र्ोजनय को प्रथर्यधवर् और धवद्यमयन भूधम उपर्ोग की धविेषर्यओं के ब्र्ौरे िर्े े हुए मयनधचत्र द्वयरय जमयर्पार् दकर्य जयएगय । (7) आंचधलक महयर्ोजनय पयररधथथधर्क संवेिी जोन में धवकयस को धवधनर्धमर् करेगी और पैरय 4 के सयरणी में सूचीबद्ध प्रधर्धषद्ध और धवधनर्धमर् कयर्ाकलयपों कय अनुपयलन करेगी र्थय थथ यनीर् समुियर्ों के पयररधथथधर्की अनुकूल धवकयस के धलए जीवकोपयजान को सुरधक्षर् करन े कय सुधनिर् दकर्य जय सकेगय। (8) आंचधलक महयर्ोजनय इस अधिसूचनय में दिए गए उपबंिों के संबंि में अपने कयर्ों के बयहर ले जयने के धलए धनगरयनी सधमधर् के धलए एक संिभा िथर्यवेज र्ैर्यर करेगी । 3. रय्‍र् सरकयर द्वयरय दकए जयन े वयल े उपयर्-- रय्‍र् सरकयर इस अधिसूचनय के उपबंिों को प्रभयवी करन े के धलए धनम्नधलधखर् उपयर् करेगी, अथयार्: --4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (1) भ-ू उपर्ोग –पयररधथथ धर्क संवेिी जोन में वनों, उद्ययन-कपधष क्षेत्रों, कपधष क्षेत्रों, आमोि-प्रमोि के प्रर्ोजन के धलए धचधहींहर् दकए गए पयकों और खुल े थथयनों कय वयधणध्‍र्क और औद्योधगक संबद्ध धवकयस दिर्यकलयपों के धलए उपर्ोग र्य संपररवर्ान नहीं होगय। परंर्ु पयररधथथधर्क संवेिी जोन के भीर्र कपधष भूधम और अहींर् भूधमर्ों कय संपररवर्ान मयनीकरी सधमधर् की धसफयररि पर और रय्‍र् सरकयर के पूवा अनुमोिन स,े जो थथयनीर् धनवयधसर्ों की आवयसीर् जरूरर्ों को पूरय करन े के धलए ह ै र्थय दिर्यकलयपों के धलए जैसे:- (i) धवद्यमयन सडकों को चौडय करनय और उहींह ें सुिढप करनय र्थय नई सडकों कय संधनमयाण; (ii) बुधनर्यिी ढयंचों और नयगररक सुधवियओं कय संधनमयाण और नवीकरण; (iii) प्रिषू ण उयुपन्न न करन े वयले लघु उद्योग; (iv) कुकीर उद्योगों धजसके अंर्गार् ग्रयमीण कयरीगर ह;ैं सुधवियजनक भण्डयर और थथयनीर् सुधवियओं सहयर्क पयररधथथधर्क पर्ाकन में सधममधलर् ग्रह वयस; और (v) संवर्िार् दिर्यकलयप और अनुच्छेि 4 के अंर्गार् दिर्य गर्य ह ैं : परंर् ु र्ह और भी दक क्षेत्रीर् नगर र्ोजनय अधिधनर्म और अहींर् धनर्मों और धवधनर्मों के अंर्गार् रय्‍र् सरकयर के पूव ा अनुमोिन र्थय सधं वियन के अनच्ु छेि 244 और र्युसमर् प्रवपतर धवधि के उपबंिों के अनुपयलन के धबनय, धजसके अंर्गार् अनुसूधचर् जनजयधर् और अहींर् परंपरयगर् वन धनवयसी (वन अधिकयरों की मयहींर्र्य) अधिधनर्म, 2006 (2007 कय 2) भी ह,ै वयधणध्‍र्क र्य उद्योग धवकयस दिर्यकलयपों के धलए जनजयर्ीर् भूधम कय उपर्ोग अनुज्ञयर् नहीं होगय: परंर् ु र्ह और भी दक पयररधथथ धर्क संवेिी जोन के भीर्र भू-अधभलेखों में उपसंजयर् कोई त्रुरक, मयनीकरी सधमधर् के धवचयर प्रयप्त करन े के पियर् रय्‍र् सरकयर द्वयरय प्रयुर्ेक मयमल े में एक बयर सिं ोधिर् होगी और उि त्रुरक के संिोिन की सूचनय केंर्द्ीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् को िी जयएगी। परंर् ु र्ह और भी दक उपर्ुाि त्रुरक कय संिोिन में इस उप पैरय के अिीन र्थय उपबंधिर् के धसवयर् दकसी भी ििय में भू-उपर्ोग कय पररवर्ान सधममधलर् नहीं होगय; परंर् ु र्ह और भी दक धजससे हररर् क्षेत्र में जसै े वन क्षेत्र, कपधष क्षेत्र आदि में कोई पयररणयधमक ककौर्ी नहीं होगी और अनप्रर्ुक् र् र्य अनुयु पयिक कपधष क्षेत्रों में पुन: वनीकरण करने के प्रर्यस दकए जयएगं े । (2) प्रयकपधर्क झरन े – आचंधलक महयर्ोजनय में सभी प्रयकपधर्क झरनों की पहचयन की जयएगी और उनके सरं क्षण और पुनरुप द्भूर्करण के धलए र्ोजनय सधम मधलर् होगी और रय्‍ र् सरकयर द्वयरय ऐसे क्षत्रे ों पर र्य उनके धनकक धवकयस दिर्यकलयप प्रधर्धषद्ध करने के धलए ऐसी रीधर् से मयगाधनििे र्ैर्यर दकए जयएगं े । (3) पर्का न – (क) पयररधथथधर्क संवेिी जोन के भीर्र पर्ाकन संबंिी दिर्यकलयप पर्ाकन महयर्ोजनय के अनुसयर होंगे जो दक आंचधलक महयर्ोजनय के भयग रूप में होगी । (ख) पयररधथथधर्की पर्ाकन महयर्ोजनय को रय्‍र् पर्ाकन धवभयग द्वयरय रय्‍र् के पर्यावरण और वन धवभयगों के परयमिा से र्ैर्यर दकर्य जयएगय । (ग) पर्ाकन महयर्ोजनय आंचधलक महयर्ोजनय के एक घकक के रूप में जयनय जयर्ेगय । (घ) पर्ाकन संबंिी दिर्यकलयप धनम नधलधखर् के अिीन धवधनर्धमर् होंगे, अथयार् :-II (ii) 5 (i) गुियवी पक्षी वहींर्जीव अभर्यरण्र् की सीमय 1 दकलोमीकर के भीर्र र्य पयररधथथधर्क संवेिी जोन कय धवथर्यर र्क, इसमें जो भी नजिीक हो होकल और के नए संधनमयाण अनुज्ञयर् नहीं होगे। र्थयधप वहींर्जीव अभर्यरण्र् की सीमय से एक दकलोमीकर की िरू ी से परे पयररधथथधर्क संवेिी जोन के धवथर्यर र्क नए होकल और ररसोकों की थथयपनय को पूवा पररभयधषर् और धवधनर्िष्टा क्षेत्रों में पयररधथथधर्की पर्ाकन महयर्ोजनय के अनुसयर अनुज्ञयर् दकर्य जयएगय; (ii) पयररधथथधर्क संवेिी जोन के भीर्र सभी नए पर्ाकन दिर्यकलयपों र्य धवद्यमयन पर्ाकन दिर्यकलयपों कय धवथर्यर केंर्द् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् के मयगिा िाक धसद्धयंर्ों के द्वयरय र्थय रयष्र ीर् ा र्यघ्र स सरं क्षण प्रयधिकरण, द्वयरय जयरी पयररधथथधर्क पर्ाकन (समर्-समर् पर र्थय संिोधिर्) मयगिा िाक धसद्धयंर्ों के अनुसयर, पयररधथथधर्क पर्ाकन, पयररधथथधर्क धिक्षय और पयररधथथधर्क धवकयस को महयुव िर्े े हुए पयररधथथधर्क संवेिी जोन की वहन क्षमर्य के अध्र्र्न पर आियररर् होगय; (iii) आंचधलक महयर्ोजनय कय अनुमोिन दकए जयने र्क, पर्ाकन के धलए धवकयस और धवद्यमयन पर्ाकन दिर्यकलयपों के धवथर्यर को वयथर्धवक थथल धवधनर्िष्टा संवीक्षय र्थय मयनीकरी सधमधर् की धसफयररि पर आियररर् संबंधिर् धवधनर्यमक प्रयधिकरणों द्वयरय अनुज्ञयर् दकर्य होगय । (4) नसै र्गका धवरयसर् -- पयररधथथधर्क संवेिी जोन में महयुवपूणा नैसर्गाक धवरयसर् के सभी थथलों जैसे सभी जीन कोि आरधक्षर् क्षेत्र, िैल धवरचनयए,ं जल प्रपयर्ों, झरनों, घयकी मयगों, उपवनों, गुफयए,ं थथलों, भ्रमण, अश्वरोहण, प्रपयर्ों आदि की पहचयन की जयएगी और उहींह ें संरधक्षर् दकर्य जयएगय र्थय उनकी सरु क्षय और संरक्षय के धलए इस अधिसूचनय के अंधर्म प्रकयिन की र्यरीख से छह मयस के भीर्र, उपर्ुि र्ोजनय बनयएगी और ऐसी र्ोजनय आंचधलक महयर्ोजनय कय भयग होगय । (5) मयनव धनर्मर्ा धवरयसर् थथ ल - पयररधथथ धर्क संवेिी जोन में भवनों, संरचनयओं, धिल्प-र्थ्र्, ऐधर्हयधसक, कलययुमक और सयंथकपधर्क महयुव के क्षेत्रों की पहचयन की जयएगी और इस अधिसूचनय के प्रकयिन की र्यरीख से छह मयस के भीर्र धवरयसर् संरक्षण की र्ोजनय र्ैर्यर की जयएगी र्थय ऐसी र्ोजनय आंचधलक महयर्ोजनय कय भयग होगी । (6) ध्व धन प्रिषू ण -- पयररधथथधर्क संवेिी जोन में ध् वधन प्रिषू ण कय धनर्ंत्रण और धनवयरण पर्यावरण (सरं क्षण) अधिधनर्म, 1986, के अिीन बनयए गए ध्वधन प्रिषू ण (धवधनर्मन और धनर्ंत्रण) धनर्म, 2000 के उपबिों के अनुसरण में दकर्य जयएगय। (7) वयर् ु प्रिषू ण – पयररधथथधर्क संवेिी जोन में, वयर् ु प्रिषू ण कय धनर्ंत्रण और धनवयरण(प्रिषू ण धनवयरण और धनर्ंत्रण) अधिधनर्म, 1981 (1981 कय 14) और उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसरण में दकर्य जयएगय । (8) बधहस्रयव कय धनथसयरण -- पयररधथथधर्क संवेिी जोन में उपचयररर् बधहस्रयव कय धनथसयरण जल (प्रिषू ण धनवयरण और धनर्ंत्रण) अधिधनर्म, 1974 (1974 कय 6) और उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसयर होगय । (9) ठोस अपधिष्ट - ठोस अपधिष्टों कय धनपकयन और प्रबंिन धनम्नधलधखर् रूप में होगय- (क) पयररधथथधर्क संवेिी जोन में ठोस अपधिष्टों कय धनपकयन और प्रबंिन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थय संिोधिर् अधिसूचनय सं. कय.आ. 1357(आ), र्यरीख 8 अप्रैल, 2016 द्वयरय प्रकयधिर् ठोस अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय ;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) थथयनीर् प्रयधिकरण जैव धनम्नीकरणीर् और अजैव धनम्नीकरणीर् संघककों में ठोस अपधिष्टों के संपपथक्कन के धलए र्ोजनयए ं र्ैर्यर करेंग े ; (ग) जैव धनम्नीकरणीर् सयमग्री को अधिमयनर्ः खयि बनयकर र्य कपधम खेर्ी के मयध्र्म स े पुनःचदिर् दकर्य जयएगय ; (घ) अकयबाधनक सयमग्री कय धनपकयन पयररधथथधर्क संवेिी जोन के बयहर पहचयन दकए गए थथ ल पर दकसी पर्यावरणीर् थवीकयर्ा रीधर् में होगय और पयररधथथधर्क संवेिी जोन में ठोस अपधिष् कों को जलयनय र्य भष्म ीकरण अनुज्ञयर् नहीं होगय । (10) जवै धचदकयुस ीर् अपधिष् क- जैव धचदकयुस ीर् अपधिष् क प्रबंिन धनम्नधलधखर् रूप में होगय— (क) पयररधथथधर्क संवेिी जोन में जैव धचदकयुसीर् अपधिष्टों कय धनपकयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं.कय.धन 343 (अ), र्यरीख 28 मयचा; 2016 द्वयरय प्रकयधिर् जैव धचदकयुसीर् अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय । (ख) पयररधथथधर्क संवेिी जोन में कोई सयमयहींर् उपचयर सुधविय र्य जलयर्य जयनय अनुज्ञयर् नहीं दकर्य जयएगय । (11) प्लयधथकक अपधिष्ट प्रबिं न: - पयररधथथधर्क संवेिी जोन में प्लयधथकक अनुसयर दकर्य जयएगय। (12) धनमयणा और धवध्वसं अपधिष्ट प्रबिं न: - पयररधथथधर्क संवेिी जोन में संधनमयाण और धवध्वंस अपधिष्ट प्रबंि कय धनपकयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं.कय.धन 317(अ), र्यरीख 29 मयचा, 2016 द्वयरय प्रकयधिर् संधनमयाण और धवध्वंस प्रबंि धनर्म, 2016 के उपबंिों के अनसु यर दकर्य जयएगय। (13) ई–अपधिष्ट:- पयररधथथधर्क संवेिी जोन में ई–अपधिष्ट प्रबंि कय धनपकयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् द्वयरय प्रकयधिर् ई–अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय। (14) र्यनीर् पररवहन: - पररवहन की र्यनीर् गधर्धवधिर्यं आवयस के अनुकूल धवधनर्धमर् होंगी और इस संबंि में आंचधलक महयर्ोजनय में धविेष उपबंि अधिकधथर् दकए जयएगं े और आंचधलक महयर्ोजनय के र्ैर्यर होन े और रय्‍र् सरकयर के सक्षम प्रयधिकयरी द्वयरय के अनुमोदिर् होन े र्क, मयनीकरी सधमधर् प्रवपतर धनर्मों और धवधनर्मों के अनुसयर र्यनीर् गधर्धवधिर्ों के अनुपयलन को मयनीकर करेगी । (15) र्यनीर् प्रिषू ण:- र्यनीर् प्रिषू ण कय धनवयरण और धनर्ंत्रण लयगू धवधिर्ों के अनसु यर दकर्य जयएगय और थवच्छ ईंिन कय उपर्ोग करने के प्रर्यस दकए जयएगं े, जैसे सीएनजी आदि। (16) औद्योधगक ईकयइर्य:ं - (i) पयररधथथधर्क संवेिी जोन के भीर्र प्रिषू ण कयररर् करने वयले नए उद्योगों की थथयपनय अनुज्ञयर् नहीं की जयएगी। (ii) पयररधथथधर्क संवेिी जोन के केंर्द्ीर् प्रिषू ण धनर्त्रं ण बोड ा द्वयरय जयरी दिियधनििे ों में फरवरी, 2016 के भीर्र धसफा गैर- प्रिधू षर् उद्योगों की थथयपनय के वगीकरण की अनुमधर् िी जयएगी, जब र्क दक इस अधिसूचनय में धवधनर्िष्टा न हो। इसके अलयवय, गैर-प्रिधू षर् कुकीर उद्योगों को प्रधर्धषद्ध दकर्य जयएगय। (17) पहयडी ढलयनों को सरं क्षण: - पहयडी ढलयनों के सरं क्षण के अंर्गार्:II (ii) 7 (क) आंचधलक महयर्ोजनय पहयडी ढलयनों पर क्षेत्रों कय सकं ेर् होगय जहयं दकसी भी सधं नमयाण की अनुमधर् नहीं िी जयएगी । (ख) ककयव के एक उच्च धडग्री के सयथ धवद्यमयन खडी पहयडी ढलयनों र्य ढलयनों पर दकसी भी संधनमयाण की अनुमधर् नहीं िी जयएगी । 4. पयररधथथधर्क सवं िे ी जोन में प्रधर्धषद्ध और धवधनर्धमर् दकए जयन े वयल े दिर्यकलयपों की सचू ी - पयररधथथधर्क संवेिी जोन में सभी दिर्यकलयप पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) के उपबंिों द्वयरय ियधसर् होंग े और नीच े िी गई सयरणी में धवधनर्िष्टा रीधर् में धवधनर्धमर् होंग,े अथयार् :-- सयरणी िम सं. दिर्यकलयप कीकय-रकप्पणी (1) (2) (3) प्रधर्धषद्ध दिर्यकलयप 1. वयधणध्‍र्क खनन, पयुथर उयु खनन और (क) (लघु और वपहर् खधनज), पयुथर उयुखनन और उनको र्ोडने की इकयइर्यं उनको र्ोडने की इकयइर्यं । वयथर्धवक थथयनीर् धनवयधसर्ों की घरेलू आवश्र्कर्यओं के धसवयर् नहीं होगी धजसमें धनजी उपर्ोग के धलए मकयनों के संधनमयणा र्य मरम मर् के धलए भूधम को खोिनय और मकयन बनयने के धलए ििे ी कयइल् स र्य ईंकों कय धनमयाण भी सधम मधलर् ह।ै (ख) खनन संदिर्यएं, मयननीर् उच्चर्म हींर्यर्यलर् की ररक र्यधचकय (धसधवल) सं. 1995 कय 202 की.एन. गौडयबमान धथरुप मूलपयि बनयम भयरर् सरकयर के मयमले में आििे र्यरीख 4 अगथर्, 2006 और ररक र्यधचकय (सी) सं. 2012 कय 435 गोवय फयउंडेिन बनयम भयरर् संघ के मयमल े में र्यरीख 21 अप्रैल, 2014 के अंर्ररम आििे के अनुसयर सवािय की जयएंगी । 2. प्रिषू ण (जल र्य वयर्ु र्य मपिय र्य ध्व धन) (क) पयररधथथधर्क संवेिी जोन में नए उद्योग और उद्योगों में धवद्यमयन प्रिषू ण कयररर् करने वयले उद्योगों की थथ यपनय । कय धवथर्यर अनुज्ञय नहीं होगी। (ख)फरवरी, 2016 में जब र्क दक इस प्रकयर अधिसूचनय में धवधनर्िष्टा न हो, केंर्द्ीर् प्रिषू ण धनर्ंत्रण बोडा द्वयरय जयरी दिियधनििे ों में उद्योगों के वगीकरण के अनुसयर पयररधथथधर्क संवेिी जोन के भीर्र केवल गैर- प्रिषू ण कुकीर उद्योगों की अनुज्ञय िी जयएगी। 3. बपहर् जल धवद्युर् पररर्ोजनय की लयगू धवधिर्ों के अनुसयर प्रधर्धषद्ध (अहीं र्थय उपबंधिर् के धसवयर्) होंगे । थ थयपनय । 4. दकसी पररसंककमर् पियथों कय उपर्ोग र्य लयगू धवधिर्ों के अनुसयर प्रधर्धषद्ध (अहीं र्थय उपबंधिर् के धसवयर्) होंगे । उयुपयिन । 5. प्रयकपधर्क जल धनकयर्ों र्य भूधम क्षेत्र में लयगू धवधिर्ों के अनुसयर प्रधर्धषद्ध (अहीं र्थय उपबंधिर् के धसवयर्) होंगे । अनुपचयररर् बधहस्रयवों कय धनथसयरण । 6. ठोस अपधिष्ट धनपकयन थथल की थथयपनय पयररधथथधर्क संवेिी जोन में ठोस अपधिष्ट धनपकयन की कोई नई ठोस अपधिष्ट और सयमयहींर् जलयए जयने की सुधविय के धनपकयन थथल और अपधिष्ट उपचयररर्/प्रसंथकरण सुधविय की अनुज्ञय नहीं है। धलए ठोस और जैव धचदकयुसय अपधिष्ट। औद्योधगक प्रदिर्य और थवयथथ्र् प्रधर्ष्ठयन/अथपर्यलों आदि स ेउयुपन्न दकसी भी ठोस अपधिष्ट के उपचयररर् के धलए सयमयहींर् र्य व्यधिगर् जलयवर्रण की सुधविय कय अधिकर्र प्रधर्धषद्ध है । 7. फमों, कंपधनर्ों, द्वयरय बड े पैमयने पर थथयनीर् आवश्र्कर्यओं को पूरय करने के धलए लयगू धवधिर्ों के अनुसयर प्रधर्धषद्ध (र्थय अहीं र्थय उपबंधिर् के धसवयर्) होंगे अहींर्थय नहीं। वयधणध्‍र्क पिुिन और कुक्कुक फयमों की थथयपनय । 8. नई आरय धमलों की थथयपनय। पयररधथथधर्क संवेिी जोन के भीर्र नई र्य धवद्यमयन आरय धमलों कय धवथर् यर अनुज्ञयर् नहीं होगय । 9. ईंक भट्टों की थथयपनय करनय। लयगू धवधिर्ों के अनुसयर प्रधर्धषद्ध दिर्यकलयपों संबंिी पर्ाककों की लघु संरचनयओं के धलए संरधक्षर् क्षेत्र की सीमय से एक दकलोमीकर र्क र्य पयररधथथधर्क संवेिी जोन के धवथर्यर र्क, इनमें जो भी धनकक ह,ै नए वयधणध्‍र्क होकल और ररसोका अनुज्ञयर् होंगे, अहींर्थय नहीं । परंर्ु, जहयाँ पयररधथथधर्क संवेिी जोन कय धवथर्यर एक दकलोमीकर से ्‍र्यिय है वहयाँ, एक दकलोमीकर से परे और पयररधथथधर्क संवेिी जोन के धवथर्यर र्क सभी नए पर्ाकक दिर्यकलयप र्य धवद्यमयन दिर्यकलयप कय धवथर्यर पर्ाकन महयर्ोजनय और र्थय लयगू मयगाििी धसद्धयंर्ों के अनुरुप प होगय। 13. संधनमयणा दिर्यकलयप । (क) संरधक्षर् क्षेत्र र्य पयररधथथधर्क संवेिी जोन जो भी धनकक हो, की सीमय से एक दकलोमीकर के भीर्र दकसी भी प्रकयर कय वयधणध्‍र्क संधनमयाण अनुज्ञयर् नहीं दकर्य जयएगय: परंर्ु थ थयनीर् लोगों को पैरय 6 के उप पैरय (1) में सूचीबद्ध दिर्यकलयपों सधहर् उनके आवयसीर् उपर्ोग के धलए उनकी भूधम में संधनमयणा करने की अनुमधर् भवन उपधवधिर्ों के अनुसयर िी जयएगी । परहींर्ु र्ह और दक ऐसे लघु उद्योगों जो प्रिषू ण उयु पहीं न नहीं करर्े ह,ैं से संबंधिर् संधनमयाण दिर्यकलयप धवधनर्धमर् दकए जयएंगे और लयगू धनर्मों और धवधनर्मों, र्दि कोई हों, के अनुसयर सक्षम प्रयधिकयरी की पूवा अनुमधर् से ही हीं र्ूनर्म पर रखे जयएंगे । (ख) एक दकलोमीकर से आगे आंचधलक महयर्ोजनय की अनुसयर धवधनर्धमर् होंगे । 14. प्रिषू ण उयुपन्न न करने वयले लघु उद्योग । फरवरी, 2016 में केहींर्द्ीर् प्रिषू ण धनर्ंत्रण बोडा द्वयरय जयरी उद्योगों में वगीकरण के अनुसयर गैर-प्रिषू णकयरी उद्योग और अपररसंकक में, लघु और सेवय उद्योग, कपधष, पुष्प कपधष, उद्ययन कपधष र्य पयररधथथधर्क संवेिी जोन से ििे ी सयमग्री से उयुपयिों को उयुपन्न करने वयले कपधष आियररर् उद्योग सक्षम प्रयधिकयरी द्वयरय अनुज्ञयर् होंगे। 15. वपक्षों की ककयई । (क) रय्‍र् सरकयर में सक्षम प्रयधिकयरी की पूव ाअनुमधर् के धबनय वन, सरकयरी र्य रयजथव र्य धनजी भूधम पर र्य वनों में ककंही वपक्षों की ककयई नहीं होगी । (ख) वपक्षों की ककयई संबंधिर् केंर्द्ीर् र्य रय्‍र् अधिधनर्म र्य उसके अिीन बनयए गए धनर्मों के उपबंि के अनुसयर धवधनर्धमर् होगी । 16. वन उयुपयिों और गैर कयष् ठ वन उयुपयिों कय लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । संग्रहण (एनकीएफपी) । 17. धवद्युर् और संचयर कयवरों कय पररधनमयाण लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । भूधमगर् केबल को बढ़यवय दिर्य और केबल धबछयनय और अहींर् अवसंरचयनयएं जयएगय। । 18. नयगररक सुधवियओं सधहर् बुधनर्यिी ढयंचे लयग ू धवधिर्ों के अनुसयर हींर्ूनीकरण की उपयर्ों के सयथ, धनर्म और और सडको की संधनमयाण। धवधनर्मन और उपलब्ि दिियधनििे धवधनर्धमर् होंगे। 19. धवद्यमयन सडकों को चौडय करनय और उहींहें लयग ू धवधिर्ों के अनुसयर हींर्ूनीकरण की उपयर्ों के सयथ, धनर्म और सुिढप करनय । धवधनर्मन और उपलब्ि दिियधनििे धवधनर्धमर् होंगे। 20. पर्ाकन से संबंधिर् दिर्यकलयप जैसे गमा वयर्ु लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । गुब्बयरें, हले ीकयप्कर, ड्रोन, मयइिोलयइकस और अहींर् पर्ाकन दिर्यकलयप आदि द्वयरय पयररधथथधर्क संवेिी जोन क्षेत्र के ऊपर से उडनय जैसे दिर्यकलयप करनय। 21. पहयडी ढयलों और निी र्कों कय संरक्षण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । 22. रयधत्र में र्यधनक र्यर्यर्यर् कय संचलन । लयगू धवधिर्ों के अिीन वयधणध्‍र्क प्रर्ोजन के धलए धवधनर्धमर् होंगे ।II (ii) 9 23. थथयनीर् समुियर्ों द्वयरय चल रही कपधष और थथयनीर् लोगों के उपर्ोग के धलए लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । बयगवयनी प्रथयओं के सयथ डेर्ररर्ों िग्ुघ उयुपयिन जल कपधष और मयुथर् पयलन। 24. प्रयकपधर्क जल धनकयर्ों र्य सर्ही क्षेत्र में उपचयररर् बधहस्रयाव के पुनचिा ण को प्रोयुसयधहर् करने और अवमल र्य ठोस उपचयररर् बधहस्रयाव कय धनथसयरण । अपधिष्टों के धनपकयन के धलए धवद्यमयन धवधनर्मों कय अनुपयलन दकर्य जयएगय, अहींर्थय लयगू धवधिर्ों के अिीन उपचयररर् बधहस्रयाव के पुनचिा ण/प्रवयह के धनवाहन को धवधनर्धमर् दकर्य जयएगय। 25. सर्ह और भूजल के वयधणध्‍र्क लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । धनष्कषाण । 26. खुले कुआ, बोर कुआ, आदि के धलए कपधष और धवधनर्धमर् और उपर्ुि (1) केंर्द्ीर् सरकयर, पयररधथथधर्क संवेिी जोन के प्रभयवी मयनीकरी के धलए एक मयनीकरी सधमधर् कय गठन करेगी जो धनम्नधलधखर् से धमलकर बनेगी, अथयार् :- (i) क्षेत्रीर् आर्ुक् र्, मैसूर - अध्र्क्ष; (ii) मयननीर् लोक सभय धवियन सभय, सोरयबय धनवयचा न क्षेत्र, धिवमोगय धजलय-सिथ र्; (iii) कनयाकक सरकयर के पर्यावरण धवभयग कय प्रधर्धनधि - सिथ र्; (iv) कनयाकक सरकयर के िहरी धवकयस धवभयग कय प्रधर्धनधि - सिथ र्; (v) पर्यावरण (धजसके अंर्गार् धवरयसर् संरक्षण भी ह)ै के क्षेत्र में कयर् ा करन े वयल े गैर सरकयरी संगठनों कय कनयाकक रय्‍र् सरकयर द्वयरय प्रयु र्ेक मयमले में र्ीन वषा के धल ए नयमधनर्िष्टा एक प्रधर्धनधि सिथ र्; (vi) क्षेत्रीर् अधिकयर, कनयाकक रय्‍र् प्रिषू ण धनर्ंत्रण बोड,ा धिमोगय- सिथ र्; (vii) पर्यावरण के क्षेत्र में एक धविेषज्ञ धजसे कनयाकक रय्‍ र् सरकयर द्वयरय प्रयुर्ेक मयमले में र्ीन वष ा के धलए नयमधनर्िष्ा क पयररधथथधर्क संवेिी जोन में भयरर् सरकयर के र्यु कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय सं. कय.आ. 1533(अ), र्यरीख 14 धसर्ंबर, 2006 की अनुसूची में के अिीन सधममधलर् दिर्यकलयपों और इस अधिसूचनय के पैरय 4 के अिीन सयरणी में र्थय धवधनर्िष्टा प्रधर्धषद्ध गधर्धवधिर्ों के धसवयर् आने वयल े ऐस े दिर्यकलयपों की ििय में वयथर्धवक धवधनर्िष्टा थथलीर् िियओं पर आियररर् मयनीकरी सधमधर् द्वयरय संवीक्षय की जयएगी और उि अधिसूचनय के उपबंिों के अिीन पूव ा पर्यावरण अनयपधतर के धलए केहींर्द्ीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ना मंत्रयलर् को धनर्िष्टा की जयएगी। (4) इस अधिसूचनय के पैरय 4 के अिीन सयरणी में र्थय धवधनर्िष्टा प्रधर्धषद्ध दिर्यकलयपों के धसवयर्, भयरर् सरकयर के र्यु कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय सं्र्यंक कय.आ. 1533(अ), र्यरीख 14 धसर्ंबर, 2006 की अधिसूचनय के अनुसूची के अिीन ऐसे दिर्यकलयपों, धजहींह ें सधममधलर् नहीं दकर्य गर्य ह,ै परंर् ु पयररधथथधर्क संवेिी जोन में आर् े ह,ैं ऐसे दिर्यकलयपों की वयथर्धवक धवधनर्िष्टा थथलीर् िियओं पर आियररर् धनगरयनी सधमधर् द्वयरय संवीक्षय की जयएगी और उसे संबद्ध धवधनर्यमक प्रयधिकरणों को धनर्िष्टा दकर्य जयएगय । (5) मयनीकरी सधमधर् कय सिथर्-सधचव र्य संबद्ध कलक्कर संबद्ध पयका उपवन संरक्षक कय ऐसे व्यधि के धवरूद्ध, जो इस अधिसूचनय के दकसी उपबंि कय उल्लंघन करर्य ह,ै पर्यावरण (संरक्षण) अधिधनर्म, 1986 की ियरय 19 के अिीन पररवयि फयइल करन े के धलए सक्षम होगय । (6) मयनीकरी सधमधर् मुद्दय िर मुद्दय के आियर पर अपेक्षयओं पर धनभार रहर् े हुए संबद्ध धवभयगों के प्रधर्धनधिर्ों र्य धविेषज्ञों, औद्योधगक संगमों र्य संबद्ध पणियररर्ों के प्रधर्धनधिर्ों को अपने धवचयर-धवमिा में सहयर्र्य के धलए आमंधत्रर् कर सकेगी । (7) मयनीकरी सधमधर् प्रयुर्ेक वषा की 31 मयचा र्क की अपनी वयर्षाक कयरावयई ररपोका रय्‍र् के मु्र् वहींर्जीव वयडना को उपयबिं V म ें उपबंधिर् रूप धवियन के अनुसयर उक् र् वषा के 30 जून र्क प्रथर्ुर् करेगी । (8) केहींर्द्ीर् सरकयर कय पर्यावरण, वन of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O 68 (E), dated the 08th January, 2016 inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; And Whereas, the copies of the Gazette containing the draft notification were made available to the public on the date 08th January, 2016; And Whereas, no objections and suggestions were received from persons and stakeholders in response to the draft notification; And Whereas, the Gudavi Bird Sanctuary situated in Sorba Taluk of Shivamogga district of the State of Karnataka lies between the North Latitude 14025’59” to 14026’41” and East Longitude 750 6’43” to 7501’28” and is spread over anarea of 0.7368 square kilometres; And Whereas, the area is covered by moist deciduous forests and wet lands of Sahyadri hills of Western Ghats, which is a magnificent piece of beautiful and valuable forest track and in spite of severe biotic pressure, parts of the sanctuary have been able to retain its pristine, dense and diverse vegetation; AND WHEREAS, it is absolutely essential to ensure that the existing resources are not only effectively conserved but appropriate steps are also initiated to further improve the resources; AND WHERAS, the Sanctuary is immensely rich in flora and fauna both in variety and diversity as these forests consist of valuable species including Sandal, Bamboo, Rosewood, Honne, Nandi, etc., and harbor wildlife like Spotted deer, Wild Boar, Monkeys, Malabar, Squirrel, etc., and the area is also very rich in reptiles and avifauna population;II (ii) 15 And Whereas, The Plateau Area Forms The Catchment Basin For Varada River And The Area Serves As An Abode For Many Vertebrates And Invertebrates; And Whereas, The Sanctuary Has Innumerable Herbs, Shrubs, Medicinal Plants And Grasses Some Of Which Are Yet To Be Surveyed And Listed; And Whereas, It Is Necessary To Conserve And Protect The Area, The Extent And Boundaries Of Which Are Specified In Paragraph 1 Of This Notification Around The Protected Area Of Gudavi Bird Sanctuary As Eco-Sensitive Zone From Ecological And Environmental Point Of View And To Prohibit Industries Or Class Of Industries And Their Operations And Processes In The Said Eco-Sensitive Zone. Now Therefore, in exercise of the powers conferred by sub section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 1.0 kilometre to 3.2 kilometres around the boundary of Gudavi Bird Sanctuary in the State of Karnataka as the Gudavi Bird Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone.— (1) The Eco-sensitive Zone of Gudavi Bird Sanctuary lies between North Latitudes 140 25’16.19” to 14027’51.69” and the East Longitude 740 59’37.91” to 750 02’29.80 comprising of an total geographical area of 18.791 square kilometers with an extent varying from 1.0 kilometer to 3.2 kilometers around the boundary of Gudavi Bird Sanctuary and the boundary details of such Zone is given in Annexure-I. (2) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-II. (3) The Geo-coordinates of major points on the boundary of Gudavi Bird Sanctuary and on the boundary of Eco-sensitive Zone boundary is appended as Annexure-III. (4) The list of villages falling within the Eco-sensitive Zone of the Gudavi Bird Sanctuary are appended as Annexure- IV. 2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue; (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayati Raj; (xi) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management,16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities. (8) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities: Provided that the conversion of agricultural and other lands, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government to meet the residential needs of the local residents, and for activities such as:- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given under paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green areas, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.- The catchment areas of all natural springs, rivers and channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism.- (a) All new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b)The Tourism Master Plan shall be prepared by State Department of Tourism in consultation with State Departments of Environment and Forests.II (ii) 17 (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The activities of tourism shall be regulated as under, namely:- (i) no new construction of hotels and resorts shall be allowed within one kilometer from the boundary of the Gudavi Bird Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer provided that beyond the distance of 1 one kilometer from the boundary of the said Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of Eco-sensitive Zone; (iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4). Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation within six months from the date of publication of this notification in the official Gazette and such plan shall form part of the Zonal Master Plan. (5). Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared within six months from the date of publication of this notification in the official Gazette and such plan shall form part of the Zonal Master Plan. (6). Noise pollution.- Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation And Control) Rules, 2000 made under the Environment (Protection) Act, 1986. (7). Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder. (8). Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (prevention and control of pollution) Act, 1974 (6 of 1974) and rules made thereunder. (9). Solid wastes: Disposal and management of solid wastes shall be as under:- (a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time; (b) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non- biodegradable components; (c) the biodegradable material shall be recycled preferably through composting or vermiculture; (d) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone. (10). Bio-medical waste.- Bio-medical waste management shall be as under:- (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time.18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (b)No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone. (11). Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12). Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13). E-waste.- The E- waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time. (14). Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15). Vehicular pollution.- Prevention and control of vehicular pollution shall be carried out in accordance with applicable laws and efforts shall be made for use of cleaner fuel for example CNG, etc. (16). Industrial Units.- (i) No new polluting industries shall be permitted to be set up within the Eco- sensitive Zone. (ii) Only non-polluting industries may be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this notification.- (17). Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under, and be regulated in the manner specified in the Table below, namely:- TABLE S.No. Activity Description (1) (2) (3) Prohibited Activities 1. Setting of industries causing (a) No new industries and expansion of existing polluting industries in the pollution (water, air, soil, noise, Eco-sensitive zone shall be permitted. etc.) (b) Only non-polluting industries may shall be permitted within Eco- sensitive zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this notification. 3. Establishment of major Prohibited (except as otherwise provided) as per applicable laws. hydroelectric project 4. Establishment of large-scale Prohibited (except as otherwise provided) as per applicable laws except commercial livestock and for meeting local needs. poultry farms by firms, companies, etc. 8. Setting of new saw mills No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone. 9. Setting up of brick kilns Prohibited (except as otherwise provided) as per applicable laws. 10. Commercial use of fire wood Prohibited (except as otherwise provided) as per applicable laws. 11. New wood based industry Prohibited (except as otherwise provided) as per applicable laws. Regulated Activities 12. Commercial establishment of hotels No new commercial hotels and resorts shall be permitted within one and resorts kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for eco-tourism activities: Provided that, beyond one kilometre from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable. 13. Construction activities (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents. Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan. 14. Small scale non polluting industries Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non- hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent authority.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 15. Felling of trees (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:- (i) Regional Commissioner, Mysore-Chairman; (ii) *Hon’ble Member of Legislative Assembly, Soraba Constituency, Shivamogga District– Member; (iii) Representative of the Department of Environment, Government of Karnataka -Member; (iv) Representative of the Department of Urban Development, Government of Karnataka -Member; (v) Representative of Non-Governmental Organisations working in the field of nature conservation (includingheritage conservation) to be nominated by the Government of Karnataka for three years -Member; (vi) Regional Officer, Karnataka State Pollution Control Board, Shivamogga-Member; (vii) One expert in Ecology from reputed Institution or University of the State of Karnataka to be nominated by the Government of Karnataka for three years -Member; (viii) Deputy Commissioner or his representative, Shivamoggaa, -Member (ix) Member, State Biodiversity Board -Member; (x)Deputy Conservator of Forests, Wildlife Division, Shivamogga - Member. Secretary. *(Subject to the State Government of Karnataka obtaining relevant approvals inter alia including permission from theSpeaker of Legislative Assembly, Karnataka, if required) 6. Terms of reference:- (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring Committee shall be three years. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended as Annexure-V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7.
