का.अ. 2633(ऄ).—प्रारुप ऄजधसूचना भारत के राजपत्र, ऄसाधारण में भारत सरकार के पयाावरण, वन और
जलवायु पररवतना मंत्रालय की ऄजधसूचना सं. का.अ. 2682 (ऄ), तारीख 25 जुलाइ, 2019, द्वारा प्रकाजित की गइ थी
जजसमें ऐसे सभी व्यजियों से, जजनकी ईससे प्रभाजवत होने की संभावना थी, ईस तारीख से, जजसको ईि ऄजधसूचना को
ऄन्तर्ववष्ट करन े वाले राजपत्र की प्रजतयां जनता को ईपलब्ध करा दी गइ थीं, साठ ददन की ऄवजध के भीतर अक्षेप और
सुझाव अमंजत्रत दकए गए थ;े
और, ईि प्रारूप ऄजधसूचना को ऄन्तर्ववष्ट करन े वाल े राजपत्र की प्रजतया ं जनता को तारीख 26 जुलाइ, 2019,
को ईपलब्ध करा दी गइ थीं;
और, ईि प्रारूप ऄजधसूचना के प्रत्ययुतर म ें व्यजियों और पणधाररयों स े प्राप्त अक्षपे ों और सझु ावों पर राज्य
सरकार द्वारा जवचार दकया गया था;
और, भीमािंकर वन्यजीव ऄभयारण्य महाराष्ट्र राज्य के पुणे, ठाणे और रायगढ़ जजलों में जस्ट्थत ह;ै
और, भीमािंकर वन्यजीव ऄभयारण्य को महाराष्ट्र राज्य सरकार की ऄजधसूचना संख्या डब्ल्यू एल
पी.1045/सी.अर.588/(II)/एफ-5, ददनांक 16 जसतंबर, 1985 के द्वारा 130.78 वगा दकलोमीटर क्षेत्रफल म ें ऄजधसूजचत
दकया गया ह;ै
और, ईि ऄभयारण्य पक्षी-जीव के जलए जाना जाता ह ै जजसमें जजसमें भारतीय झबरा, छोटा जलकौअ, छोटा
आग्रेट, भारतीय बगुला, एजियन ओपनजबल, ब्लैक ववगट काआट, ब्राह्मणी काआट जि कारा, रेड वाटलडें रटटहरी, सामान्य
सैंडपाआपर, जचत्तीदार कबूतर, अदद सजहत पक्षी प्रजाजतयां ह;ै

और, भीमािंकर वन्यजीव ऄभयारण्य में बहुत ऄजधक जीवजंतुओं और वनस्ट्पजत की जवजवधता ह ै साथ म ें
स्ट्तनधाररयों की लगभग 22 प्रजाजतयााँ, सरीसृपों की लगभग 25 प्रजाजतयााँ, और ईभयचरों की कइ प्रजाजतयााँ पाइ जाती
ह;ैं जबदक आस क्षेत्र की वनस्ट्पजत का प्रजतजनजधत्यव “8ए/सी2 पजिमी ईप-ईष्णण्करटबंधीय पहाडी वन’’ करत े ह ै जजसमें य े
प्रजाजतयााँ पाइ जाती ह ै नेवला (मैगीफेरा आंजडका), जाम्बुल(जिजजजगयम कुजम्मनी), जपसा (एजटटनोडाफन हूकर), जििम
(डालबर्वगया लैरटफोजलया), ऄनजनी (मेमेजसटलोन), बेहडे (टर्वमनजलया बेलेररका), ऐन (टर्वमनजलया टोमेन्टोसा), मोहा
(मधुका आंजडका), पलास (बुटेया मोनोस्ट्पमाा), पंगरा (एरीथ्रीना वररआगाटा), खैर (ऄकैजिया कटेचु), काकड (गरूगा
जपन्नाटा), जििम (डालबर्वगया लैरटफोजलया), टीवास (ओजजआजनया ओयनेंजसस) अदद के ऄजतररि वृक्ष और करवांद
(कर्ररस्ट्सा करांडूस), करमती (ग्रेजवया जवल्लोसा), धायती (वूडफोरदीया फ्रूटीकोसा), करवी (करजवया कल्लोसा), जनरगुडी
(जवटेटस नेगडुंो), ऄदल्ू सा (ऄधाटोडा वाजसका) अदद के ऄलावा झाडी और घास सजम्मजलत ह;ै
और, संरजक्षत क्षेत्र महत्त्वपणू ा वन्यजीवों जैसे तेंदअु , बनजबलार, छोटा भारतीय मुसंग, धारीदार लकडबग्घा,
मुंजक, पजिमी हनुमान लगं ूर, सामान्य ग्रे नेवला, अदद का भी अश्रय प्रदान करता ह;ै
और, यह ऄभयारण्य मानव बजस्ट्तयों और चल रही जवकासात्यमक दियाकलापों के ऄजत जनकट होने से ऄभयारण्य
के जलए ईजचत सुरक्षा ईपाय करने और ऐसे दियाकलापों पर जनयंत्रण लगाने की अवश्यकता है;
और, आस ऄभयारण्य के वन वर्ाा को ऄवरूद्ध करके भूजल जलभृत को पनु भारण म ें सहायता करते ह ैं और जमट्टी के
कटाव को कम करके नददयों और धाराओं की सुरक्षा करते ह ैंऔर ऄभयारण्य में कइ धाराओं का ऄच्छा नेटवका बना हुअ ह ै
जो पूरे ऄभयारण्य म ें फैली हुइ है, लगभग सभी धाराएं मौसमी प्रकृजत की ह;ैं आनसे भीमा नदी बनती ह,ै जो दक प्रमुख बांध
चटस्ट्कामन में जाती ह,ै जबदक घोड नदी और बूबारा नदी म ेंप्रमुख बांध ह,ै जजसका बाबू गेन ूजलािय नाम ददम्भा बांध ह;ै
और, भीमािंकर वन्यजीव ऄभयारण्य के चारों ओर के क्षत्रे को, जजसका जवस्ट्तार और सीमाए ं पाररजस्ट्थजतकी
पयाावरणीय से पाररजस्ट्थजतकी संवेदी जोन के रूप में पैरा 1 में जवजनर्ददष्ट ह,ैं जैव जवजवजधता की दजृ ष्ट सुरजक्षत और संरजक्षत
करना और ईि पाररजस्ट्थजतकी संवेदी जोन में ईद्योगों या ईद्योगों के वगों के प्रचालन और प्रसंस्ट्करण करने को प्रजतजर्द्ध
करना अवश्यक ह;ै
ऄतः, ऄब, केन्रीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के साथ परठत पयाावरण
(संरक्षण) ऄजधजनयम, 1986 (1986 का 29) (जजसे आस ऄजधसूचना में आसके पिात पयाावरण ऄजधजनयम कहा गया ह)ै की
धारा 3 की ईपधारा और (1) ईपधारा (2) के खंड (v) और खंड (xiv) तथा धारा 3 की ईपधारा (3) द्वारा प्रदत्त िजियों
का प्रयोग करत े हुए, महाराष्ट्र राज्य के पणु ,े ठाणे और रायगढ़ जजला के भीमािंकर वन्यजीव ऄभयारण्य की सीमा के चारों
ओर 0.05 दकलोमीटर से 10 दकलोमीटर तक जवस्ट्ताररत क्षत्रे को भीमािंकर वन्यजीव ऄभयारण्य पाररजस्ट्थजतकी संवेदी
जोन (जजसे आसमें आसके पश् चात् पाररजस्ट्थजतकी संवेदी जोन कहा गया ह)ै के रूप में ऄजधसजू चत करती ह,ै जजसका जववरण
जनम्नानुसार ह,ै ऄथाात ् :-
1. पाररजस्ट्थजतकी सवं दे ी जोन का जवस्ट्तार और सीमाए.ं-(1) पाररजस्ट्थजतकी संवेदी जोन का जवस्ट्तार भीमािंकर वन्यजीव
ऄभयारण्य की सीमा के चारों ओर 0.05 दकलोमीटर से 10 दकलोमीटर तक जवस्ट्ततृ ह ै और पाररजस्ट्थजतकी संवेदी जोन का
क्षेत्रफल 101.62 वग ा दकलोमीटर ह।ै राज्य द्वारा पाररजस्ट्थजतकी संवेदी जोन का जवस्ट्तार पचास (50) मीटर न्यूनतम
ईजचत ह:ै -
(क) संरजक्षत क्षेत्र के पजिमी भाग में पजिमी घाटों का एक ईच्च ऄखडं श्रेणी ह ै जो ईत्तर दजक्षण ददिा म ें गुजरत े हुए
बसाजल्टक लावा से बना ह।ै यह कोंकण क्षेत्र में पजिम की ओर खडी ढलान/ गहरी चट्टान ें और घारटयां सजम्मजलत ह।ैं यह
चट्टाने भीमािंकर वन्यजीव ऄभयारण्य के पजिमी और ईत्तरी भाग पर प्राकृजतक ऄवरोधक/बफर के रूप म ेंकाया करती ह।ै
(ख) वन ररपोटा 2017 की जस्ट्थजत के ऄनुसार, पाररजस्ट्थजतकी सवं ेदी जोन (50 मीटर से ऄजधक) में सजम्मजलत क्षेत्र ज्यादातर
खुले वन श्रणे ी (0.4 से कम के घनत्यव के साथ) में अत े ह।ैं भीमािंकर वन्यजीव ऄभयारण्य की प्रमुख प्रजाजत भारतीय जैनट
जगलहरी ह ै जो जनरंतर कैनोपी अवरण के साथ पररवक्व और जवजवध वन पर जनभरा जगलहरी वास ह।ै पाररजस्ट्थजतकी संवेदी
जोन का 50 मीटर से ऄजधक क्षत्रे मुख्यत: खुला वन ह ैजजसमें बहुत कम जनरंतर कैनोपी अवरण ह।ै
(2) भीमािंकर वन्यजीव ऄभयारण्य और आसके पाररजस्ट्थजतकी संवेदी जोन की सीमा का जववरण ईपाबधं -I के रूप म ें
संलग्न ह।ै[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3
(3) सीमा जववरण और ऄक्षािं ों और देिांतरों के साथ पाररजस्ट्थजतकी संवेदी जोन के सीमांदकत होते हुए भीमािंकर
वन्यजीव ऄभयारण्य के मानजचत्र ईपाबधं -IIक और ईपाबधं -IIख के रूप म ें संलग्न ह।ै
(4) पाररजस्ट्थजतकी संवेदी जोन और भीमािंकर वन्यजीव ऄभयारण्य की सीमा के भू-जनदेिांकों की सूची ईपाबधं -III के
सारणी क और सारणी ख म ेंदी गइ ह।ै
(5) मुख्य वबदओंु के भ-ू जनदेिांकों के साथ पाररजस्ट्थजतकी संवेदी जोन के ऄंतगात अन े वाले ग्रामों की सूची ईपाबधं IV के रूप
में संलग्न ह।ै
2. पाररजस्ट्थजतकी सवं दे ी जोन के जलए अचं जलक महायोजना– (1) राज्य सरकार, पाररजस्ट्थजतकी संवेदी जोन के प्रयोजनों के
जलए राजपत्र म ें आस ऄजधसूचना के प्रकािन की तारीख स े दो वर्ा की ऄवजध के भीतर, स्ट्थानीय व्यजियों के परामिा से और
राज्य के सक्षम प्राजधकारी के ऄनुमोदन के जलए आस ऄजधसूचना म ें ददए गए ऄनुबंधों का पालन करत े हुए अंचजलक
महायोजना तैयार करेगी।
(2) राज्य सरकार द्वारा पाररजस्ट्थजतकी संवेदी जोन के जलए अचंजलक महायोजना ऐसी रीजत से जो आस ऄजधसूचना म ें
जवजनर्ददष्ण ट दकए गए ह ैं के ऄनसु ार तथा सुसंगत केंरीय और राज्य जवजधयों के ऄनुरुप और केंरीय सरकार द्वारा जारी
मागाजनदेिों, यदद कोइ हों, द्वारा तैयार होगी ।
(3) अंचजलक महायोजना, ईि योजना म ें पाररजस्ट्थजतकी और पयाावरणीय बातों को समाकजलत करन े के जलए राज्य
सरकार के जनम्नजलजखत जवभागों के परामि ासे तैयार होगी.-
(i) पयाावरण;
(ii) वन और वन्यजीव;
(iii) कृजर्;
(iv) राजस्ट् व;
(v) िहरी जवकास;
(vi) पयाटन;
(vii) ग्रामीण जवकास;
(viii) वसचाइ और बाढ़ जनयंत्रण;
(ix) नगरपाजलका;
(x) पंचायती राज;
(xi) महाराष्ट्र राज्य प्रदर्ू ण जनयंत्रण बोडा; और
(xii) लोक जन मााण जव भाग।
(4) अंचजलक महायोजना ऄनुमोददत जवद्यमान भ-ू ईपयोग, ऄवसंरचना और दियाकलापों पर कोइ जनबंधन ऄजधरोजपत
नहीं करेगी जब तक दक आस ऄजधसूचना में आस प्रकार जवजनर्ददष्ण ट न हो और अचंजलक महायोजना सभी ऄवसंरचना और
दियाकलापों में, जो ऄजधक दक्षता और पाररजस्ट्थजतकी ऄनुकूल हों, का संवधान करेगी ।
(5) अंचजलक महायोजना म ें ऄनाच्छाददत क्षेत्रों के जीणोद्धार, जवद्यमान जल जनकायों के संरक्षण, अवाह क्षेत्रों के प्रबंधन,
जल-संभरों के प्रबंधन, भूतल जल के प्रबंधन, मृदा और नमी संरक्षण, स्ट्थानीय समुदायों की अवश्यकताओं तथा
पाररजस्ट्थजतकी और पयाावरण से संबंजधत ऐसे ऄन्य पहलओंु , जजन पर ध्यान देना अवश्यक ह,ै के जलए ईपबंध होंगे ।
(6) अंचजलक महायोजना जवद्यमान और प्रस्ट्ताजवत भूजम ईपयोग जविेर्ताओं के ब्यौरों से ऄनुसमर्वथत मानजचत्र के साथ
सभी जवद्यमान पूजा स्ट् थलों, ग्रामों और नगरीय बजस्ट्तयों, वनों के प्रकार और दकस्ट् मों, कृजर् क्षेत्रों, उपजाउ भूजम, हररत क्षेत्र
जैसे ईद्यान और ईसी प्रकार के स्ट् थान, ईद्यान कृजर् क्षेत्र, फलोईद्यान, झीलों और ऄन्य जल जनकायों का ऄभ्यकंन करेगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(7) अंचजलक महायोजना पाररजस्ट्थजतकी संवेदी जोन में जवकास को जवजनयजमत करेगी और सारणी में सूचीबद्ध पैराग्राफ-4
में प्रजतजर्द्ध और जवजनयजमत दियाकलापों का ऄनपु ालन करेगी और स्ट्थ ानीय समुदायों की जीजवका को सुरजक्षत करन े के
जलए पाररजस्ट्थजतकी ऄनुकूल जवकास को सुजनजित और ईसकी ऄजभवृजद्ध भी करेगी।
(8) अंचजलक महायोजना प्रादेजिक जवकास योजना की सह जवस्ट्तारी होगी ।
(9) आस प्रकार ऄनुमोददत अंचजलक महायोजना आस ऄजधसूचना के ईपबंधों के ऄनुसार मानीटरी के ऄपने कायों को करन े के
जलए मानीटर सजमजत के जलए एक संदभा दस्ट्तावेज तैयार करेगी ।
3. राज्य सरकार द्वारा दकए जान े वाल े ईपाय.- राज्य सरकार आस ऄजधसूचना के ईपबंधों को प्रभावी करन े के जलए
जनम्नजलजखत ईपाय करेगी, ऄथाात्:-
(1) भ-ू ईपयोग.– (क) पाररजस्ट्थजतकी संवेदी जोन म ें वनों, ईद्यान कृजर् क्षेत्रों, कृजर् क्षेत्रों, मनोरंजन के प्रयोजनों के जलए
जचजन्हत दकए गए पाकों और खुल े स्ट्थानों का वाजणजज्यक या अवासीय या औद्योजगक संबद्ध जवकास दियाकलापों के जलए
ईपयोग या संपररवतान नहीं होगा:
परंत ु यह दक पाररजस्ट्थजतकी संवेदी जोन के भीतर भाग (क) में जवजनर्ददष्ट प्रयोजनों स े जभन्न प्रयोजन के जलए कृजर्
और ऄन्य भूजम का संपररवतान मानीटरी सजमजत की जसफाररि पर और यथा लागू और क्षेत्रीय नगर योजना ऄजधजनयम और
केन्रीय सरकार या राज्य सरकार के ऄन्य जनयमों तथा जवजनयमों के ऄधीन सक्षम प्राजधकारी के पूवा ऄनुमोदन स,े और आस
ऄजधसूचना के ईपबंधों द्वारा स्ट्थानीय जनवाजसयों की जनम्नजलजखत अवासीय अवश्यकताओं को पूरा करन े के जलए ऄनुज्ञात
दकया जाएगा, जैस:े -
(i) जवद्यमान सडकों को चौडा करना और ईन्ह ेंसुदढ़ृ करना तथा नइ सडकों का संजनमााण;
(ii) बुजनयादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;
(iii) प्रदर्ू ण ईत्यपन्न न करने वाल े लघ ुईद्योग;
(iv) कुटीर ईद्योगों जजनके ऄंतगता ग्रामीण ईद्योग भी ह;ैं सुजवधाजनक भण्डार और स्ट्थानीय सुजवधाए ं सहायक
पाररजस्ट्थजतकी पयाटन जजसके ऄन्तगता गहृ वास सजम्मजलत ह;ै और
(v) पैरा 4 के ऄधीन ददए गए संवर्वधत दियाकलाप:
परंत ु यह और दक प्रादेजिक नगर योजना ऄजधजनयम और राज्य सरकार के ऄन्य जनयमों और जवजनयमों के ऄधीन
सक्षम प्राजधकारी के पूवा ऄनुमोदन और संजवधान के ऄनच्ु छेद 244 के ईपबंधों या तत्यसमय प्रवृत्त जवजध के ईपबंधों के
ऄनुपालन के जबना, जजसके ऄन्तगात ऄनुसूजचत जनजाजत और ऄन्य परंपरागत वन जनवासी (वन ऄजधकारों की मान्यता)
ऄजधजनयम, 2006 (2007 का 2) भी ह,ै वाजणजज्यक या औद्योजगक जवकास दियाकलापों के जलए जनजातीय भूजम का
ईपयोग ऄनुज्ञात नहीं होगा:
परंत ु यह और भी दक पाररजस्ट्थजतकी संवेदी जोन के भीतर भू-ऄजभलेखों म ें ईपसंजात कोइ गलती, मानीटरी सजमजत के
जवचार प्राप्त करन े के पिात ् राज्य सरकार द्वारा प्रत्ययेक मामले म ें एक बार ठीक होगी और ईि गलती के सुधार की सूचना
केंरीय सरकार के पयाावरण, वन और जलवाय ुपररवतान मंत्रालय को दी जाएगी:
परंत ु यह और भी दक गलती के संिोधन म ें आस ईप पैरा के ऄधीन यथा ईपबंजधत के जसवाय दकसी भी दिा म ें भू-ईपयोग
का पररवतान सजम्मजलत नहीं होगा;
(ख) वनीकरण तथा वास जीणोद्धार दियाकलापों सजहत ऄनप्रयुट त या ऄनुत्य पादक कृजर् क्षत्रे ों में पुन: वनीकरण करने के
प्रयास दकए जाएंगे।
(2) प्राकृजतक जल स्रोतों.- अचजं लक महायोजना म ें सभी प्राकृजतक जल स्रोतों के अवाह क्षेत्रों की पहचान की जाएगी और
ईनके संरक्षण और नवीकरण के जलए योजना सजम् मजलत होगी और राज्य सरकार द्वारा ऐसे क्षेत्रों पर या ईनके जनकट
जवकास दियाकलाप प्रजतजर्द्ध करने के बारे में जो ऐसे क्षेत्रों के जलए ऄजहतकर हो ऐसी रीजत स े मागादिाक जसद्धांत तैयार
दकए जाएंगे ।[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 5
(3) पयटा न या पाररजस्ट्थजतकी पयटा न.- (क) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पाररजस्ट्थजतकी पयाटन
दियाकलाप या जवद्यमान पयाटन दियाकलापों का जवस्ट्तार पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन के
जलए होगा।
(ख) पाररजस्ट्थजतकी पयाटन महायोजना राज्य पयाटन जवभाग द्वारा राज्य पयाावरण और वन जवभाग के परामि ा स े तैयार
होगी।
(ग) पयाटन महायोजना अंचजलक महायोजना के एक घटक के रूप म ेंहोगी।
(घ) पयाटन महायोजना पाररजस्ट्थजतकी संवेदी जोन की वहन क्षमता के अधार पर तैयार की जाएगी।
(ङ) पाररजस्ट्थजतकी पयाटन संबधं ी दियाकलाप जनम्नानुसार जवजनयजमत होंगे:-
(i) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट
ह,ै नय ेवाजणजज्यक होटल और ररजॉटा के सजन्नमााण ऄनज्ञु ात नहीं होंग:े
परंत,ु यह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर की दरू ी से परे पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक
होटलों और ररजॉट ा का स्ट्थापना केवल पूवा पररभाजर्त और नामजनर्ददष्ट क्षेत्रों में पयटा न महायोजना के ऄनुसार
पाररजस्ट्थजतकी पयाटन सुजवधाओं के जलए ही ऄनज्ञु ात होगा;
(ii) पाररजस्ट्थजतकी संवेदी जोन के भीतर नए पयाटन दियाकलापों या जवद्यमान पयाटन दियाकलापों का जवस्ट्तार केंरीय
सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय के मागादिाक जसद्धांतों के द्वारा तथा राष्णर ीय ा याघ्र स संरक्षण
प्राजधकरण, द्वारा जारी पाररजस्ट्थजतकी–पयाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल देते हुए (समय-
समय पर यथा संिोजधत) जारी मागादिाक जसद्धांतों के ऄनुसार होगा;
(iii) अंचजलक महायोजना का ऄनुमोदन दकए जाने तक, पयाटन के जलए जवकास और जवद्यमान पयाटन दियाकलापों के
जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्ददष्ट संवीक्षा और मानीटरी सजमजत की जसफाररि पर अधाररत संबंजधत जवजनयामक
प्राजधकरणों द्वारा ऄनुज्ञात दकया जाएगा और पाररजस्ट्थजतकी संवेदी जोन के भीतर दकसी नये होटल या ररजॉटा या
वाजणजज्यक स्ट्थापना का संजनमाणा ऄनुज्ञात नहीं दकया जायेगा ।
(4) नसै र्वगक जवरासत.- पाररजस्ट्थजतकी संवेदी जोन म ें महत्यवपूणा नैसर्वगक जवरासत के सभी स्ट्थलों जैसे जीन कोि अरजक्षत
क्षत्रे , िैल जवरचनाएं, जल प्रपातों, झरनों, घाटी मागों, ईपवनों, गुफाएं, स्ट्थलों, भ्रमण, ऄश्वरोहण, प्रपातों अदद की
पहचान की जाएगी और जवरासत संरक्षण योजना अंचजलक महायोजना के भाग के रूप में परररक्षण और संरक्षण के जलए
तैयार की जाएगी ।
(5) मानव जनर्वमत जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेदी जोन में भवनों, संरचनाओं, जिल्प-तथ्य, ऐजतहाजसक, स्ट्थापत्यय,
सौंदयापूरक और सांस्ट्कृजतक महत्यव के क्षेत्रों की और ईपक्षेत्रों पहचान और ईनके संरक्षण के जलए जवरासत योजना अंचजलक
महायोजना के भाग के रुप में तयै ार की जाएगी।
(6) ध्व जन प्रदर्ू ण.- पयाावरण ऄजधजनयम के ऄधीन ध्वजन प्रदर्ू ण (जवजनयमन और जनयत्रं ण) जनयम, 2000 म ें जनयत
ईपबंधों के ऄनुसार म ेंपाररजस्ट्थजतकी संवेदी जोन में ध्वजन प्रदर्ू ण के जनयंत्रण और जनवारण का ऄनुपालन दकया जाएगा।
(7) वाय ु प्रदर्ू ण.- पाररजस्ट्थजतकी संवेदी जोन म,ें वायु प्रदर्ू ण के जनवारण और जनयंत्रण का वायु (प्रदर्ू ण जनवारण और
जनयंत्रण) ऄजधजनयम, 1981 (1981 का 14) और ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार ऄनुपालन दकया
जाएगा।
(8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेदी जोन म ें ईपचाररत बजहस्राव का जनस्ट्सारण, साधारणों मानकों के
ईपबंधों के ऄनुसार पयाावरणीय ऄजधजनयम और ईसके ऄधीन बनाए गए जनयमों के ऄधीन अने वाले पयाावरणीय प्रदर्ू ण
के जनस्ट्सारण के जलए साधारण मानकों या राज्य सरकार द्वारा जनयत मानकों, जो भी ऄजधक कठोर हो, के ईपबंधों के
ऄनुसार होगा।
(9) ठोस ऄपजिष्ट.- ठोस ऄपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकया जाएगा:-
(क) पाररजस्ट्थजतकी संवेदी जोन म ें ठोस ऄपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पयाावरण, वन और जलवाय ु
पररवतान मंत्रालय की ऄजधसूचना सं. का.अ. 1357(ऄ), तारीख 8 ऄप्रैल, 2016 के द्वारा प्रकाजित ठोस ऄपजिष्ट प्रबंधन
जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। ऄकाबाजनक पदाथो का जनपटान पाररजस्ट्थजतकी संवेदी जोन से बाहर
जचजन्हत दकए गए स्ट्थानों पर पयाावरण-ऄनुकूल रीजत से दकया जाएगा;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(ख) पाररजस्ट्थजतकी संवेदी जोन म ें मान्य प्रौद्योजगदकयों (इएसएम) का ईपयोग करत े हुए जवद्यमान जनयमों और जवजनयमों के
ऄनुरूप ठोस ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनुकूल प्रबधं न ऄनुज्ञात दकया जा सकेगा।
(10) जवै जचदकत्यसा ऄपजिष्णट .- जैव जचदकत्यसा ऄपजिष्णट का प्रबंधन जनम्नानुसार दकया जाएगा.-
(क) पाररजस्ट्थजतकी संवेदी जोन म ें जैव जचदकत्यसा ऄपजिष्ट का जनपटान भारत सरकार के पयाावरण, वन और जलवायु
पररवतान मंत्रालय की ऄजधसूचना सं.सा.का.जन 343 (ऄ), तारीख 28 माच,ा 2016 के द्वारा प्रकाजित जैव जचदकत्यसा
ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।
(ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों का ईपयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप
जैव-जचदकत्यसा ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनुकूल प्रबधं न ऄनुज्ञात दकया जा सकेगा।
(11) प्लाजस्ट्टक ऄपजिष्ट प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन में प्लाजस्ट्टक ऄपजिष्ट प्रबंध का जनपटान भारत सरकार के
पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना सं.सा.का.जन 340(ऄ),
तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।
(12) जनमाणा और जवध्वसं ऄपजिष्ट प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन में संजनमााण और जवध्वंस ऄपजिष्ट प्रबंध का
जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना
सं.सां.का.जन 317(ऄ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंधन जनयम, 2016 के ईपबंधों के
ऄनुसार दकया जाएगा ।
(13) इ–ऄपजिष्ट.- पाररजस्ट्थजतकी संवेदी जोन में इ–ऄपजिष्ट प्रबंध का जनपटान भारत सरकार के पयाावरण, वन और
जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत द्वारा प्रकाजित इ–ऄपजिष्ट प्रबधं न जनयम, 2016 के ईपबंधों
के ऄनुसार दकया जाएगा।
(14) यानीय यातायात.- यातायात की यानीय गजतजवजधयां अवास के ऄनुकूल जवजनयजमत होंगी और आस संबंध म ें
अंचजलक महायोजना म ें जविेर् ईपबंध सजम्मजलत दकए जाएंगे और अंचजलक महायोजना के तैयार होने और राज्य सरकार
के सक्षम प्राजधकारी द्वारा ऄनुमोददत होने तक, मानीटरी सजमजत सुसंगत ऄजधजनयमों और ईसके ऄधीन बनाए गए जनयमों
और जवजनयमों के ऄनुसार यानीय दियाकलापों के ऄनुपालन को मानीटर करेगी ।
(15) यानीय प्रदर्ू ण.- लागू जवजधयों के ऄनुपालन म ें वाहन प्रदर्ू ण का जनवारण और जनयंत्रण दकया जाएगा। स्ट्वच्छक ईंधन
के ईपयोग के जलए प्रयास दकए जाएंगे।
(16) औद्योजगक इकाआया.ं- (i) राजपत्र में आस ऄजधसूचना के प्रकािन पर या ईसके पिात पाररजस्ट्थजतकी संवेदी जोन के
भीतर कोइ नए प्रदजू र्त ईद्योगों की स्ट्थापना की ऄनुमजत नहीं दी जाएगी।
(ii) केन्रीय प्रदर्ू ण जनयंत्रण बोडा द्वारा फरवरी, 2016 में जारी मागादिाक जसद्धांतों में ईद्योगों के वगीकरण के
ऄनुसार, जब तक दक ऄजधसचू ना म ें आस प्रकार जवजनर्ददष्ट न हो; पाररजस्ट्थजतकी संवेदी जोन के भीतर केवल गैर-
प्रदर्ू णकारी ईद्योगों को ऄनुज्ञात दकया जाएगा और आसके ऄजतररि, गैर-प्रदर्ू णकारी ईद्योगों को बढ़ावा ददया
जाएगा।
(17) पहाडी ढलानों को सरं क्षण.- पहाडी ढलानों का सरं क्षण जनम्नानुसार होगा:-
(क) अंचजलक महायोजना पहाडी ढलानों पर क्षेत्रों का संकेत होगा जहां दकसी भी संजनमााण की ऄनुमजत नहीं दी जाएगी;
(ख) कटाव के एक ईच्च जडग्री के साथ जवद्यमान खडी पहाडी ढलानों या ढलानों पर दकसी भी संजनमााण की ऄनुमजत नहीं दी
जाएगी ।
4. पाररजस्ट्थजतकी सवं दे ी जोन म ें प्रजतजर्द्ध और जवजनयजमत दकए जान े वाल े दियाकलापों की सचू ी.- पाररजस्ट्थजतकी संवेदी

ईत्यपन करन े वाल ेईद्योगों की स्ट्थापना । वतामान प्रदर्ू णकारी ईद्योगों का जवस्ट्तार करन े की ऄनुज्ञा नहीं
होगी:
परन्तु यह दक केन्रीय प्रदर्ू ण जनयंत्रण बोड ा द्वारा फरवरी,
2016 में जारी मागा दिाक जसद्धान्तों में ईद्योगों के वगीकरण के
ऄनुसार जब तक दक ऄजधसचू ना में ऐसा जवजनर्ददष्ट न हों,
पाररजस्ट्थजतकी संवेदी जोन के भीतर गरै -प्रदर्ू णकारी ईद्योगों
को ऄनज्ञु ात दकया जाएगा और आसके ऄजतररि गैर-
प्रदर्ू णकारी कुटीर ईद्यागों को बढ़ावा ददया जाएगा।
3. ब ृहत जल जवद्युत पररयोजना की स्ट्थापना । लागू जवजधयों के ऄनुसार प्रजतजर्द्ध (ऄन् यथा ईपबंजधत के
जसवाय) होंगे ।
4. दकसी पररसंकटमय पदाथ ा का ईपयोग या लागू जवजधयों के ऄनुसार प्रजतजर्द्ध (ऄन् यथा ईपबंजधत के
ईत्यपादन या प्रसंस्ट्करण। जसवाय) होंगे ।
5. प्राकृजतक जल जनकायों या क्षत्रे भूजम म ें लागू जवजधयों के ऄनुसार प्रजतजर्द्ध (ऄन् यथा ईपबंजधत के
ऄनुपचाररत बजहस्रााव का जनस्ट्सारण । जसवाय) होंगे ।
6. नइ अरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेदी जोन के भीतर नइ और जवद्यमान अरा
जमलों का जवस्ट् तार ऄनज्ञु ात नहीं होगा ।
7. ईंट भट्टों की स्ट्थापना करना। लागू जवजधयों के ऄनुसार प्रजतजर्द्ध (ऄन् यथा ईपबंजधत के
जसवाय) होंगे ।
8. नए ऄजतिमण और वन भूजम पर ईनका लागू जवजधयों के ऄनुसार प्रजतजर्द्ध (ऄन् यथा ईपबंजधत के

स्ट्थापना । जसवाय संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या
पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनम ें जो भी जनकट
ह,ै नए वाजणजज्यक होटल और ररसोटों को ऄनुज्ञात नहीं दकया
जाएगा:
परंतु यह दक सरं जक्षत क्षेत्र की सीमा से एक दकलोमीटर के
परे या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक आनमें स े जो
भी जनकट हो सभी नए पयाटन दियाकलाप या जवद्यमान
दियाकलाप का जवस्ट्तार पयाटन महायोजना और यथा लाग ू
मागादिी जसद्धांतों के ऄनरूु प होगा।
10. संजनमााण दियाकलाप । (क) संरजक्षत क्षेत्र की सीमा स े एक दकलोमीटर के भीतर या
पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट
हो, दकसी भी प्रकार के नय े वाजणजज्यक संजनमााण की ऄनुज्ञा
नहीं होगी:
परंत ु यह दक स्ट्थानीय लोगों को ऄपनी अवास सम्बन्धी
जनम्नजलजखत अवश्यकताओं को परू ा करन े के जलए, पैरा 3 के
ईप पैरा (1) में सूचीबद्ध दियाकलापों सजहत ऄपने ईपयोग के
जलए, ऄपनी भूजम में भवन ईप-जवजधयों के ऄनुसार, संजनमााण
करने की ऄनुज्ञा होगी, जैसे:-
परंतु यह दक गरै –प्रदर्ू णकारी लघ ु ईद्योगों स े संबंजधत
संजनमााण दियाकलाप लागू जनयमों और जवजनयमों, यदद कोइ
हों, के ऄनुसार सक्षम प्राजधकारी की पूवा ऄनुमजत स े
जवजनयजमत दकए जाएंगे और वे न्यूनतम होंगे ।
(ख) एक दकलोमीटर क्षेत्र स े परे य े अंचजलक महायोजना के
ऄनुसार जवजनयजमत होंगे ।
11. प्रदर्ू ण ईत्यपन्न न करन े वाले लघु ईद्योग । फरवरी, 2016 में केन्रीय प्रदर्ू ण जनयंत्रण बोडा द्वारा जारी
ईद्योगों में वगीकरण के ऄनुसार गैर-प्रदर्ू णकारी ईद्योग और
ऄपररसंकटमय में, लघु और सेवा ईद्योग, कृजर्, पुष्णप कृजर्,
ईद्यान कृजर् या पाररजस्ट्थजतकी संवेदी जोन स े दिे ी सामग्री से
ईत्यपादों को ईत्यपन्न करने वाल े कृजर् अधाररत ईद्योग सक्षम
प्राजधकारी द्वारा ऄनुज्ञात होंगे।
12. वृक्षों की कटाइ । (क) राज्य सरकार म ें सक्षम प्राजधकारी की पूवा ऄनुमजत के
जबना वन, सरकारी या राजस्ट्व या जनजी भूजम पर या वनों म ें
वृक्षों की कटाइ नहीं होगी ।
(ख) वृक्षों की कटाइ संबंजधत केंरीय या राज्य ऄजधजनयम या
ईसके ऄधीन बनाए गए जनयमों के ईपबंध के ऄनुसार
जवजनयजमत होंगे।
13. वन ईत्यपादों या गैर काष्णठ वन ईत्यपादों का लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
संग्रहण ।
14. जवद्युत और संचार टावरों का पररजनमााण लागू जवजधयों के ऄधीन जवजनयजमत होंगे (भूजमगत केबल के
और केबलों के जबछाए जान े और ऄन्य जबछाए जाने को बढ़ावा ददया जा सकेगा)।

19. राजत्र म ेंयाजनक यातायात का संचलन । लाग ू जवजधयों के ऄधीन वाजणजज्यक प्रयोजन के जलए
जवजनयजमत ।
20. स्ट्थानीय समुदायों द्वारा चल रही कृजर् और स्ट्थानीय लोगों के ईपयोग के जलए लागू जवजधयों के ऄधीन
बागवानी प्रथाओं के साथ दग्ु धिाला, दग्ु घ ऄनुज्ञात ।
ईद्योग, कृजर् और मछली पालन ।
21. फमों, कंपजनयों द्वारा बडे पैमाने पर स्ट्थानीय अवश्यकताओं को परू ा करन े के जलए लाग ू जवजधयों के
वाजणजज्यक पिुओं और कुटकुट फामों की ऄधीन जवजनयजमत (ऄन्यथा प्रदान दकए गए) होंगे ।

22. प्राकृजतक जल जनकायों या सतही क्षत्रे म ें जल जनकायों म ें ईपचाररत ऄपजिष्ट जल या बजहस्रााव के
ईपचाररत बजहस्रााव का जनस्ट्तारण । जनस्ट्सारण से बचा जाएगा और ईपचाररत ऄपजिष्ट जल के
पुन:चिण और पनु :ईपयोग के जलए प्रयास दकए जाएंगे।
ऄन्यथा लाग ू जवजधयों के ऄनुसार ईपचाररत बजहस्रााव के
पुनचिा ण/प्रवाह के जनवाहन को जवजनयजमत दकया जाएगा।
23. सतही और भूजल का वाजणजज्यक लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

24. ठोस ऄपजिष्ट का प्रबन्धन। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

5. पाररजस्ट्थजतकी सवं दे ी जोन की ऄजधसचू ना की मानीटरी के जलए मानीटरी सजमजत- केंरीय सरकार, पयाावरण (संरक्षण)
ऄजधजनयम, 1986 की धारा 3 की ईपधारा (3) के ऄधीन आस ऄजधसूचना के ईपबंधों की प्रभावी मानीटरी के जलए
मानीटरी सजमजत का गठन करती ह,ै जो जनम्नजलजखत स ेजमलकर बनगे ी, ऄथाात:् -
ि.स. मानीटरी सजमजत का गठन पद
(1) (2) (3)
(i) जजला कलेटटर, पुणे पदेन, ऄध्यक्ष;
(ii) कलेटटर ठाणे / रायगढ़ के प्रजतजनजध सदस्ट्य;
(iii) ईप वन संरक्षक, (वन्यजीव), पुणे या ईनके प्रजतजनजध सदस्ट्य;
(iv) ईप वन संरक्षक, रायगढ़ / ठाण ेया ईनके प्रजतजनजध। सदस्ट्य;
(v) नगर जनयोजन कायाालय ठाण े/ रायगढ़ / पुण े के प्रजतजनजध) सदस्ट्य;
(vi) पयाावरण जवभाग, महाराष्ट्र सरकार के प्रजतजनजध। सदस्ट्य;
(vii) प्रजत जित संस्ट्थान या दकसी भी राज्य जवश्वजवद्यालय से पाररजस्ट्थजतकी म ें एक सदस्ट्य;
जविेर्ज्ञ।
(viii) वन्य जीव संरक्षण के क्षत्रे म ें काम करन े वाल े गैर-सरकारी संगठन (एनजीओ) के सदस्ट्य;

6. जनदिे –जनबधं न.- (1) मानीटरी सजमजत आस ऄजधसूचना के ईपबंधों के ऄनुपालन को मानीटर करेगी।
(2) मानीटरी सजमजत का कायाकाल तीन वर् ा तक या राज्य सरकार द्वारा नइ सजमजत के पुन: गठन तक के जलए होगा और
तत्यपिात मानीटरी सजमजत राज्य सरकार द्वारा गरठत की जाएगी।
(3) ईन दियाकलापों की, जो भारत सरकार के तत्यकालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक का.अ.
1533 (ऄ), तारीख 14 जसतम्बर, 2006 की ऄनुसूची म ें सजम्मजलत ह,ैं और जो पाररजस्ट्थजतकी संवेदी जोन म ें अत े ह,ैं
जसवाय आसके जो परै ा 4 के ऄधीन सारणी म ें यथा जवजनर्ददष्ट प्रजतजर्द्ध दियाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक
जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर संवीक्षा की जाएगी और ईि ऄजधसूचना के ईपबंधों के ऄधीन पूवा पयाावरण
ऄनापजत्त के जलए केरींय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय को जनर्ददष्ट दकया जाएगा।
(4) ईन दियाकलापों की, जो भारत सरकार के तत्यकालीन और वन मंत्रालय की ऄजधसूचना संख्यांक का. अ. 1533 (ऄ)
तारीख 14 जसतंबर, 2006 की ऄनुसूची में सजम्मजलत नहीं है, और जो पाररजस्ट्थजतकी संवेदी जोन में अते ह,ै जसवाय आसके पैरा
4 के ऄधीन सारणी में यथाजवजनर्ददष्ट प्रजतजर्द्ध दियाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के
अधार पर संवीक्षा की जाएगी और ईसे संबंद्ध जवजनयामक प्राजधकरणों को जनर्ददष्ट दकया जाएगा।
(5) मानीटरी सजमजत का सदस्ट्य-सजचव या संबद्ध ईपायुि ऐसे व्यजि के जवरूद्ध, जो आस ऄजधसूचना के दकसी ईपबंध का
ईल्लघं न करता ह,ै पयाावरण (संरक्षण) ऄजधजनयम, 1986 की धारा 19 के ऄधीन पररवाद फाआल करने के जलए सक्षम
होगा।
(6) मानीटरी सजमजत मुद्दा दर मद्दु ा के अधार पर ऄपेक्षाओं पर जनभार रहत े हुए संबद्ध जवभागों के प्रजतजनजधयों या
जविेर्ज्ञों, औद्योजगक संगमों या संबद्ध पणधाररयों के प्रजतजनजधयों को ऄपन े जवचार-जवमि ा म ें सहायता के जलए अमंजत्रत
कर सकेगी ।
(7) मानीटरी सजमजत प्रत्ययेक वर्ा की 31 माचा तक के ऄपने दियाकलापों की वार्वर्क कारावाइ ररपोटा राज्य के मुख्य
वन् यजीव वाडान को ईपाबंध V म ेंसंलग्न प्रपत्र में ईटत वर्ा के 30 जून तक प्रस्ट्तुत करेगी ।
(8) केन्रीय सरकार का पयाावरण, वन और जलवाय ुपररवतान मंत्रालय मानीटरी सजमजत को ऄपन े कृत्ययों के प्रभावी जनवाहन
के जलए ऐस ेजनदेि दे सकेगा, जो वह ठीक समझे ।
7. ऄजतररि ईपाय - आस ऄजधसूचना के ईपबंधों को प्रभावी बनाने के जलए केंरीय सरकार और राज्य सरकार, ऄजतररटत
ईपाय, यदद कोइ हों, जवजनर्ददष्ण ट कर सकेंगी।
8. ईच्चतम न्यायालय के अदिे - आस ऄजधसूचना के ईपबंध भारत के माननीय ईच्चतम न्यायालय या ईच्च न्यायालय या
राष्णर ीय हररत ऄजधकरण द्वारा पाररत दकए गए या पाररत दकए जाने वाल ेअदेि, यदद कोइ हो, के ऄध्यधीन होंगे ।

Climate Change number S.O. 2682 (E), dated the 25th July, 2019, inviting objections and suggestions from
all persons likely to be affected thereby within the period of sixty days from the date on which copies of the
Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the said draft notification were made available
to the public on the 26th July, 2019;
AND WHEREAS, objections and suggestions were received from persons and stakeholders in
response to the aforesaid draft notification were duly considered by the Central Government;
AND WHEREAS, the Bhimashankar Wildlife Sanctuary is located in Pune, Thane and Raigad
Districts in the State of Maharashtra;
AND WHEREAS, the Bhimashankar Wildlife Sanctuary was notified vide notification of the State
Government of Maharashtra number WLP. 1045/C.R.588/ (II)/F-5, dated the16th September, 1985, over an
area 130.78 square kilometers;
AND WHEREAS, the said Sanctuary is known for avifauna with species of birds including Indian
shag, little cormorant, little egret, Indian pond heron, Asian openbill, black winged kite, brahmny kite
shikra, red wattled lapwing, common sandpiper, spotted dove, etc;
AND WHEREAS, the protected area of the said sanctuary has very high faunal and floral
diversity with about 22 species of mammals, about 25 species of reptiles and many species of amphibian
are found; while the flora of this area is represented by “8A/C2 Western sub tropical hill forests” including
species like mango (Magifera indica), jambhul (Schyzigium cummini), pisa (Actinodaphne hooker), sisam
(Dalbergia latifolia), anjani (Memecyclon), behada (Terminalia belerica), ain (Terminalia tomentosa),
moha (Madhuca indica), palas (Butea monsperma), Pangara (Erythrina variegata), Khair (Acacia catechu),[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 37
kakad (Garuga pinnata), Shisham (Dalbergia latifolia), tiwas (Ougeinia ouieinensis) etc. among trees and
karwand (Carrissa carandus) karmati (Grewia villosa), dhayti (Woodfordia fruticosa), karvi (Carvia
callosa), nirgudi (Vitex negundo), adulsa (Adhatoda vasica) etc. among shrubs and grasses;
AND WHEREAS, the said protected area also supports important wildlife such as common
leopard, Jungle cat, small Indian civet, striped hyena, barking deer, western hanuman langur, common grey
mongoose, etc;
AND WHEREAS, the extremely close vicinity of the above-mentioned Sanctuary to human
habitation and ongoing developmental activities, necessitate the requirement of proper safeguards and
control over such activities;
AND WHEREAS, the forests of this Sanctuary intercept rainfall and help recharge ground water
aquifer and protect rivers and streams against siltation by minimising soil erosion and the Sanctuary has a
well knit network of many streams spreading throughout the Sanctuary, almost all streams are of seasonal
nature, they form Bhima River, which drains into major dam Chaskaman, whereas Ghod River, and Bubara
River having major dam Dimbha Dam named as Babu Genu reservoir;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of
which are specified in paragraph 1 around the Bhimashankar Wildlife Sanctuary as Eco-sensitive Zone
from ecological, environmental and biodiversity point of view and to prohibit industries or class of
industries and their operations and processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and
(xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of
1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of
the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent
varying from 0.05 kilometres to 10 kilometres around the boundary of the Bhimashankar Wildlife
Sanctuary, in Pune, Thane and Raigad Districts in the State of Maharashtra as the Bhimashankar Wildlife
Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of
which are as under, namely: -
1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of
0.05 kilometres to 10 kilometres around the boundary of the Bhimashankar Wildlife Sanctuary and the
area of the Eco-sensitive Zone is 101.62 square kilometres. Fifty (50) metres minimum extent of Eco-
sensitive Zone was justified by the State as:
(a) The western side of the protected area has a high unbroken ridge of the Western Ghats composed of
Basaltic lava passing in a north south direction. It comprises steep slopes/deep cliff and valleys towards the
west in the Konkan region. These cliffs act as a natural barrier/buffer on western and northern side of the
Bhimashankar Wildlife sanctuary.
(b) As per state of forest report 2017, the areas included in the Eco-sensitive Zone (beyond 50 meters) fall
mostly in the open forest category (with the density of less than 0.4). The flagship species of Bhimashankar
Sanctuary is Indian Giant Squirrel which is a harboreal squirrel dependent on mature and diverse forest
with continuous canopy cover. The area beyond 50 meters of the Eco-sensitive Zone is mainly of open
forest which has very less continuous canopy cover.
(2) The boundary description of the Bhimashankar Wildlife Sanctuary and its Eco-sensitive Zone is
appended as Annexure-I.
(3) The maps of the Bhimashankar Wildlife Sanctuary demarcating Eco-sensitive Zone along with
boundary details and latitudes and longitudes are appended as Annexure-IIA and Annexure-IIB.
(4) Lists of geo-coordinates of the boundary of the Bhimashankar Wildlife Sanctuary and Eco-sensitive
Zone are given in Table A and Table B of Annexure-III.
(5) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent
points is appended as Annexure-IV.
2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the
Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of
publication of this notification in the Official Gazette, in consultation with local people and adhering to
the stipulations given in this notification for approval of the competent authority in the State.38 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in
such manner as is specified in this notification and also in consonance with the relevant Central and
State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the
State Government, for integrating the ecological and environmental considerations into the said
plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Maharashtra State Pollution Control Board; and
(xii) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use,
infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall
factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing
water bodies, management of catchment areas, watershed management, groundwater management,
soil and moisture conservation, needs of local community and such other aspects of the ecology and
environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban
settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks
and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps
giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited
and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly
development for security of local communities’ livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee
for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.- The State Government shall take the following
measures for giving effect to the provisions of this notification, namely:-
(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for
recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for
commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purposes other than that specified in
clause (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the
Monitoring Committee, and with the prior approval of the competent authority under Regional Town
Planning Act and other rules and regulations of the Central Government or State Government as applicable
and vide provisions of this notification, to meet the residential needs of the local residents and for activities

(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities
supporting eco-tourism including home stay; and
(v) promoted activities given in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the competent authority under Regional Town Planning Act and
other rules and regulations of the State Government and without compliance of the provisions of article 244
of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other
Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected
by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the
correction of said error shall be intimated to the Central Government in the Ministry of Environment,
Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as
provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and
habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for
their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the
guidelines shall be drawn up by the State Government in such a manner as to prohibit development
activities at or near these areas which are detrimental to such areas.
(3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism
activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-
sensitive Zone.
(b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation
with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-
sensitive Zone.
(e) The activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometre from the
boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is
nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected
area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts
shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per
Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-
sensitive Zone shall be in accordance with the guidelines issued by the Central
Government in the Ministry of Environment, Forest and Climate Change and the eco-
tourism guidelines issued by National Tiger Conservation Authority (as amended from
time to time) with emphasis on eco-tourism, eco-education and eco-development;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of
existing tourism activities shall be permitted by the concerned regulatory authorities based
on the actual site specific scrutiny and recommendation of the Monitoring Committee and
no new hotel, resort or commercial establishment construction shall be permitted within the

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene
pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides,
cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their
preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical,
architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and
heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be
carried out in accordance with the provisions of the Noise Pollution (Regulation and Control)
Rules, 2000 under the Environment Act.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried
out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981
(14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance
with the provisions of the General Standards for Discharge of Environmental Pollutants covered
under the Environment Act and the rules made thereunder or standards stipulated by State
Government, whichever is more stringent.
(9) Solid wastes.- Disposal and management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in
accordance with the Solid Waste Management Rules, 2016, published by the Government of
India in the Ministry of Environment, Forest and Climate Change vide notification number
S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an
environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the
existing rules and regulations using identified technologies may be allowed within Eco-
sensitive Zone.
(10) Bio-medical waste.– Bio-medical waste management shall be as under:-
(a) the Bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance
with the Bio-Medical Waste Management Rules, 2016, published by the Government of India
in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R.
343 (E), dated the 28th March, 2016;
(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the
existing rules and regulations using identified technologies may be allowed within the Eco-
sensitive Zone.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be
carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the
Government of India in the Ministry of Environment, Forest and Climate Change vide notification
number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition waste
management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction
and Demolition Waste Management Rules, 2016, published by the Government of India in the
Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E),
dated the 29th March, 2016, as amended from time to time.
(13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the
provisions of the E-Waste Management Rules, 2016, published by the Government of India in the
Ministry of Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly
manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till
such time as the Zonal Master plan is prepared and approved by the competent authority in the
State Government, the Monitoring Committee shall monitor compliance of vehicular movement

(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be in compliance with the
applicable laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new
polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within the Eco-sensitive Zone as per the
classification of Industries in the guidelines issued by the Central Pollution Control Board in
February, 2016, unless so specified in this notification, and in addition, the non-polluting
cottage industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be
permitted;
(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be
permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco
sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there
under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment
Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of
1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and
amendments made thereto and be regulated in the manner specified in the Table below, namely:-

including the activities mentioned in sub-paragraph (1)
of paragraph 3 as per building bye-laws to meet the
residential needs of the local residents:
Provided further that the construction activity related to
small scale industries not causing pollution shall be
regulated and kept at the minimum, with the prior
permission from the competent authority as per
applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per
the Zonal Master Plan.
11. Small scale non polluting industries. Non polluting industries as per classification of
industries issued by the Central Pollution Control Board
in February, 2016 and non-hazardous, small-scale and

6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of
this notification.
(2) The tenure of the Monitoring Committee shall be for three years or till the re-constitution of the new
Monitoring Committee by the State Government and subsequently the Monitoring Committee shall
be constituted by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September,
2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the
Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the
actual site-specific conditions and referred to the Central Government in the Ministry of
Environment, Forest and Climate Change for prior environmental clearances under the provisions of
the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in
the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September,
2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the
Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the
actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s)
shall be competent to file complaints under section 19 of the Environment Act, against any person
who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments,
representatives from industry associations or concerned stakeholders to assist in its deliberations
depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st
March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per
proforma appended at Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional measures.- The Central Government and State Government may specify additional
measures, if any, for giving effect to provisions of this notification.
8. Supreme Court, etc. orders.- The provisions of this notification shall be subject to the orders, if any
passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green
Tribunal.
