अिधसूचना सं. का.आ. 252(अ), तारीख 27 जनवरी, 2016 (cid:7367)ारा भारत के राजप(cid:7074) असाधारण म(cid:7286) (cid:7079)कािशत की गई
थी िजसम(cid:7286) उन सभी (cid:7390)ि(cid:7334)य(cid:7298) से, िजनको उससे (cid:7079)भािवत होने की संभावना थी, उस तारीख से, िजसको उ(cid:7334)
अिधसूचना की राजप(cid:7074) की (cid:7079)ितयां जनता को उपलब्ध करा दी गई थी, साठ िदन की अविध के भीतर, आक्षेप और
सुझाव आमंि(cid:7074)त िकए गए थे;
और, उ(cid:7334) (cid:7079)ारुप अिधसूचना के (cid:7079)त्यु(cid:7275)र म(cid:7286) (cid:7390)ि(cid:7334)य(cid:7298) और पणधािरय(cid:7298) से कोई टीका िटप्पिणयां या आक्षेप
और सुक्षाव (cid:7079)ा(cid:7385) नह(cid:7277) हुए थे;
पामेड वन्यजीव अभयारण्य छ(cid:7275)ीसगढ़ के िजला बीजापुर, म(cid:7286) िस्थत ह ै और 442.23 वगर् िकलोमीटर के क्षे(cid:7074)
म(cid:7286) फैला हुआ ह।ै अभयारण्य वनस्पित एवं जीवजंतु के िविभ(cid:7382) (cid:7079)जाितय(cid:7298) के समृ(cid:7373) (cid:7079)ाकृितक वास के िलए (cid:7079)िस(cid:7373) ह।ै
मह(cid:7276)वपूणर् वनस्पित म(cid:7286) सागौन (टेक्टोना (cid:7061)(cid:7289)िडस), शीशम (डाल्बिगर्या लैिटफ़ोिलया), कुसुम ((cid:7395)ेकेचरा ऑिलओसा),
महुआ (मधुका इंिडका), त(cid:7286)द ु (डायिस्परोस मेलेनोिक्सलॉन), बांस (डेन्(cid:7071)ोकालेमास कडक), आिद ह।(cid:7289) अभयारण्य म(cid:7286)

उष्णकिटबंधीय शुष्क पणर्पाती वन, िमि(cid:7088)त वन, शुष्क सदाबहार वन, और जलीय वनस्पित से िमलकर बना ह।ै
अभयारण्य इन्दरावती (cid:7390)ा(cid:7062) िरजवर् के िलए (cid:7079)ाकृितक आवास के िवस्तार की भी (cid:7390)वस्था करता ह ै।
और, पामेड वन्यजीव अभयारण्य के चार(cid:7298) ओर के क्षे(cid:7074) को, िजसका िवस्तार और सीमाएं इस अिधसूचना के
पैरा 1 म(cid:7286) िविन(cid:7416)द(cid:7397)र् ह,(cid:7289) पािरिस्थितक और पयार्वरण की दिृ (cid:7397) से पािरिस्थितक संवेदी जोन के रूप म(cid:7286) सुरिक्षत और
संरिक्षत करना तथा उ(cid:7334) पािरिस्थितक संवेदी जोन म(cid:7286) उ(cid:7378)ोग(cid:7298) या उ(cid:7378)ोग(cid:7298) के वग(cid:7300) के (cid:7079)चालन तथा (cid:7079)संस्करण करने
को (cid:7079)ितिष(cid:7373) करना आवश्यक ह;ै
अतः, अब, केन्(cid:7076)ीय सरकार, पयार्वरण (संरक्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पिठत
पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (1), उपधारा (2) के खंड (v) और
खंड (xiv) और उपधारा (3) (cid:7367)ारा (cid:7079)द(cid:7275) शि(cid:7334)य(cid:7298) का (cid:7079)योग करते हुए, छ(cid:7275)ीसगढ़ राज् य म(cid:7286) पामेड वन्यजीव
अभयारण्य के चार(cid:7298) ओर 0 मीटर से 1 िकलोमीटर तक के िवस् तािरत क्षे(cid:7074) को पामेड वन्यजीव अभयारण्य
पािरिस् थितक संवेदी जोन (िजसे इसम (cid:7286) इसके पश् चात् पािरिस् थितक सवं ेदी जोन कहा गया ह)ै के रूप म(cid:7286) अिधसूिचत
करती ह,ै िजसके ब्यौरे िन(cid:7388)ानुसार ह,ै अथार्त ् :--
1. पािरिस्थितक सवं दे ी जोन का िवस्तार और उसकी सीमाएं--(1) पािरिस् थितक संवेदी जोन अक्षांश 18° 26’
04” उ० से 18° 11’ 31” उ० और 80° 43’ 57” पू० से 81° 03’ 57” पू० देशांतर के बीच िस्थत ह।ै अभयारण्य के
पि(cid:7391)मी िदशा के िहस्से को छोड़ते हुए, िजसकी सीमा तेलंगाना राज्य के साथ िमलती ह,ै पामेड वन्यजीव
अभयारण्य की सीमा के चार(cid:7298) ओर 1 िकलोमीटर के िवस्तार के साथ 62.73 वगर् िकलोमीटर के क्षे(cid:7074) म(cid:7286) फैला हुआ ह।ै
(2) भ-ू िनदश(cid:7287) ांक(cid:7298) के साथ-साथ पािरिस्थितक संवेदी जोन की सीमा को िवभािजत करते हुए पामेड वन्यजीव
अभयारण्य का मानिच(cid:7074) उपाबंध I के रुप म(cid:7286) संल(cid:7336) ह ै।
(3) (cid:7079)मुख िबंद(cid:7312)ु के भू-िनदश(cid:7287) ांक(cid:7298) के साथ-साथ पािरिस्थितक संवेदी जोन के अंतगर्त आने वाले (cid:7061)ाम(cid:7298) की सूची
उपाबधं II के रुप म(cid:7286) संल(cid:7336) है ।
2. पािरिस्थितक सवं दे ी जोन के िलए आंचिलक महायोजना –(1) राज्य सरकार, पािरिस् थितक संवेदी जोन के
(cid:7079)योजन के िलए, राजप(cid:7074) म(cid:7286) अंितम अिधसूचना के (cid:7079)काशन की तारीख स े दो वषर् की अविध के भीतर, स्थानीय
(cid:7390)ि(cid:7334)य(cid:7298) के परामशर् से और इस अिधसूचना म(cid:7286) िदए गए अनुबंध(cid:7298) का पालन करते हुए एक आंचिलक महायोजना
तैयार करेगी।
(2) इस (cid:7079)कार तैयार की गई आंचिलक महायोजना अिधसूचना म(cid:7286) िविन(cid:7416)द(cid:7397)र् शतर् के अनुरूप होगी और उसम(cid:7286)
पयार्वरणीय िववक्षाएं शािमल ह(cid:7298)गे।
(3) आंचिलक महायोजना का राज् य सरकार म(cid:7286) सक्षम (cid:7079)ािधकारी (cid:7367)ारा अनुमोदन िकया जाएगा ।
(4) पािरिस् थितक संवेदी जोन के िलए आंचिलक महायोजना राज्य सरकार (cid:7367)ारा ऐसी रीित से जो इस
अिधसूचना म(cid:7286) िविन(cid:7416)दष्र् ट की जाए और सुसगं त क(cid:7286)(cid:7076)ीय और राज् य िविधय(cid:7298) के और क(cid:7286)(cid:7076)ीय सरकार (cid:7367)ारा जारी
मागर्दशर्क िस(cid:7373)ांत(cid:7298), यिद कोई ह(cid:7298), के अनुरुप तैयार की जाएगी ।
(5) आंचिलक महायोजना, सभी संबंिधत राज्य िवभाग(cid:7298) के परामशर् से तैयार की जाएगी, अथार्त्:--
(i) पयार्वरण ;
(ii) वन ;
(iii) शहरी िवकास ;
(iv) पयर्टन ;

(vi) राजस् व ;
(vii) कृिष ;
(viii) छ(cid:7275)ीसगढ़ राज् य (cid:7079)दषू ण िनयं(cid:7074)ण बोडर् ;
(ix) िसंचाई; और
(x) लोक िनमार्ण िवभाग ।
(6) आंचिलक महायोजना अनुमोिदत िव(cid:7378)मान भू-उपयोग, अवसंरचनात् मक और ि(cid:7059)याकलाप(cid:7298) पर तब तक
कोई िनब(cid:7304)धन अिधरोिपत नह(cid:7277) करेगी जब तक िक इस अिधसूचना म(cid:7286) और आचंिलक महायोजना म(cid:7286) सभी अवसंरचना
और अिधक दक्ष और पािरिस् थितक अनुकूल होने वाले ि(cid:7059)याकलाप के सुधार म(cid:7286) कारक इस (cid:7079)कार िविन(cid:7416)दष्र् ट न िकए
गए ।
(7) आंचिलक महायोजना म(cid:7286) अनाच्छािदत क्षे(cid:7074)(cid:7298) के जीण(cid:7299)(cid:7373)ार, िव(cid:7378)मान जल िनकाय(cid:7298) के संरक्षण, आवाह क्षे(cid:7074)(cid:7298)
के (cid:7079)बंधन, जल-संभर(cid:7298) के (cid:7079)बंधन, जल के (cid:7079)बंधन, मृदा और आ(cid:7076)ता संरक्षण, स्थानीय समुदाय(cid:7298) की आवश्यकता(cid:7312)
तथा पािरिस्थितक और पयावर् रण के ऐस े अन्य पहलु(cid:7312), िजन पर ध्यान दने ा आवश्यक ह,ै के िलए उपबंध ह(cid:7298)ग े ।
(8) आंचिलक महायोजना सभी िव(cid:7378)मान पूजा स् थल(cid:7298), (cid:7061)ाम(cid:7298) और शहरी बिस्तय(cid:7298), वन(cid:7298) के (cid:7079)कार और िकस् म(cid:7298),
कबीले क्षे(cid:7074)(cid:7298), कृिष क्षे(cid:7074)(cid:7298), ऊपजाऊ भूिम, हिरत क्षे(cid:7074) जैसे उ(cid:7378)ान और उसी (cid:7079)कार के स् थान, उ(cid:7378)ान कृिष क्षे(cid:7074),
फलोउ(cid:7378)ान, दलदली जमीन, झील(cid:7298) और अन्य जल िनकाय(cid:7298) का अभ्यकंन करेगी और इसके साथ समथनर् कारी
मानिच(cid:7074) भी होगा योजना िव(cid:7378)मान और (cid:7079)स्तािवत भूिम के उपयोग की िवशेषता(cid:7312) के ब्यौरे दते े हुए मानिच(cid:7074)(cid:7298)
(cid:7367)ारा समिथर्त होगी ।
(9) आंचिलक महायोजना पािरिस् थितक संवेदी जोन म(cid:7286) िवकास को िविनयिमत करेगी और अिधसूचना म(cid:7286)
िविन(cid:7416)द(cid:7397)र् (cid:7079)ितिष(cid:7373), िविनयिमत तथा संविधर्त ि(cid:7059)याकलाप(cid:7298) का अनुसरण करेगी िजससे स्थानीय समुदाय(cid:7298) की
आजीिवका की सुरक्षा के िलए पािरिस्थितक अनुकूल िवकास सुिनि(cid:7391)त िकया जा सक(cid:7286)। ।
(10) आंचिलक महायोजना इस अिधसूचना म(cid:7286) िदए गए उपबंध(cid:7298) के संबंध म(cid:7286) िनगरानी के अपने काय(cid:7300) को करने के
िलए िनगरानी सिमित के िलए एक संदभर् दस्तावेज होगा।
3. राज्य सरकार (cid:7367)ारा िकए जान े वाले उपाय-- राज्य सरकार इस अिधसूचना के उपबंध(cid:7298) को (cid:7079)भावी करने के िलए
िन(cid:7388)िलिखत उपाय करेगी, अथार्त् :--
(1) भू-उपयोग - पािरिस् थितक संवेदी जोन म(cid:7286) वन(cid:7298), उ(cid:7378)ान-कृिष क्षे(cid:7074)(cid:7298), कृिष क्षे(cid:7074)(cid:7298), आमोद-(cid:7079)मोद के (cid:7079)योजन(cid:7298) के
िलए अिभिनि(cid:7391)त िकए गए पाक(cid:7300) और खुल े स्थान(cid:7298) का वािणिज्यक या औ(cid:7378)ोिगक संब(cid:7373) िवकास ि(cid:7059)याकलाप(cid:7298) के
िलए उपयोग नह(cid:7277) होगा या उनके िलए क्षे(cid:7074)(cid:7298) म(cid:7286) संपिरवतर्न नह(cid:7277) होगा :
परंतु पािरिस्थितक संवेदी जोन के भीतर कृिष भूिम का संपिरवतर्न, िनगरानी सिमित की िसफािरश पर
और राज्य सरकार के पूवर् अनुमोदन स,े स्थानीय िनवािसय(cid:7298) की आवासीय जरूरत(cid:7298) को पूरा करने के िलए और पैरा
4 की सारणी के स्तंभ (2) म(cid:7286) सूचीब(cid:7373) ि(cid:7059)याकलाप(cid:7298) के िलए अनुज्ञात ह(cid:7298)गे, अथार्त् :-
(i) पािरिस् थितक अनुकूल पयर्टन ि(cid:7059)याकलाप(cid:7298) के िलए पयर्टक(cid:7298) के अस् थायी आवासन के िलए
पािरिस् थितक अनुकूल कुटीर जैसे ट(cid:7286)ट, लकड़ी के मकान आिद ;
(ii) िव(cid:7378)मान सड़क(cid:7298) को चौड़ा करना तथा उन्ह (cid:7286)मजबूत करना ;
(iii) (cid:7079)दषू ण उत्प(cid:7382) न करने वाले लघु उ(cid:7378)ोग ;
(iv) वषार् जल संचयन; और
(v) कुटीर उ(cid:7378)ोग(cid:7298) िजनके अंतगर्त (cid:7061)ामीण कारीगर भी ह।(cid:7289)4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
परंतु यह और भी िक राज्य सरकार के पूवर् अनुमोदन तथा संिवधान के अनुच्छेद 244 और तत्समय (cid:7079)वृ(cid:7275)
िविध के उपबंध(cid:7298) के अनुपालन के िबना, िजसके अंतगर्त अनुसूिचत जनजाित और अन्य परंपरागत वन िनवासी (वन
अिधकार(cid:7298) की मान्यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिज्यक और उ(cid:7378)ोग िवकास ि(cid:7059)याकलाप(cid:7298) के
िलए जनजातीय भूिम का उपयोग अनुज्ञात नह(cid:7277) होगा:
परंतु यह भी िक पािरिस् थितक संवेदी जोन के भीतर भ-ू अिभलेख(cid:7298) म(cid:7286) कोई (cid:7074)ुिट, मानीटरी सिमित के िवचार
(cid:7079)ा(cid:7385) करने के प(cid:7391)ात् राज्य सरकार (cid:7367)ारा (cid:7079)त्येक मामले म(cid:7286) एक बार संशोिधत होगी और उ(cid:7334) (cid:7074)ुिट के संशोधन की
सूचना क(cid:7286)(cid:7076)ीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मं(cid:7074)ालय को दी जाएगी ।
परंतु यह और भी िक उपयुर्(cid:7334) (cid:7074)ुिट के संशोधन म(cid:7286) इस उप पैरा के अधीन यथा उपबंिधत के िसवाय िकसी भी
दशा म(cid:7286) भू-उपयोग का पिरवतर्न सिम्मिलत नह(cid:7277) होगा।
परन्तु यह और भी िक हिरत क्षे(cid:7074) जैसे वन क्षे(cid:7074) और कृिषक्षे(cid:7074) म(cid:7286) कोई पािरणािमक कटौती नह(cid:7277) होगी और
अन(cid:7079)युक् त या अनुत् पादक कृिष क्षे(cid:7074)(cid:7298) म(cid:7286) पुन: वनीकरण करने के (cid:7079)यास िकए जाएंगे ।
(2) (cid:7079)ाकृितक जल (cid:7090)ोत(cid:7298) -- सभी (cid:7079)ाकृितक जल (cid:7090)ोत(cid:7298) के आवाह क्षे(cid:7074)(cid:7298) की पहचान की जाएगी और उनके संरक्षण
और पुनरुद्भूतकरण के िलए योजनाएं आचंिलक महायोजना सिम् मिलत की जाएंगी और राज् य सरकार (cid:7367)ारा ऐसी
क्षे(cid:7074) आवाह संबंध योजना ऐसी रीित म(cid:7286) तैयार की जाएगी िजससे आवाह क्षे(cid:7074)(cid:7298) के भीतर िवकास ि(cid:7059)याकलाप(cid:7298)
(cid:7079)ितिष(cid:7373) या (cid:7079)ितबंिधत िकया जा सके ।
(3) पािरिस्थितक पयटर् न – (क) पािरिस्थितक संवेदी जोन के भीतर पयर्टन संबंधी ि(cid:7059)याकलाप पािरिस्थितक पयर्टन
महायोजना के अनुसार ह(cid:7298)गे जो आंचिलक महायोजना का भाग होगा ।
(ख) पयटर् न महायोजना पयर्टन िवभाग, छ(cid:7275)ीसगढ़ सरकार (cid:7367)ारा राजस्व और वन िवभाग, छ(cid:7275)ीसगढ़ सरकार के
परामशर् से तैयार होगी ।
(ग) पयर्टन महायोजना आंचिलक महायोजना के एक घटक के रूप म(cid:7286) होगी ।
(घ) पयर्टन सबं ंधी ि(cid:7059)याकलाप िन(cid:7388)ानुसार िविनयिमत ह(cid:7298)गे, अथार्त् :-
(i) पामेड वन्यजीव अभयारण्य की सीमा से एक िकलोमीटर के भीतर या पािरिस्थितक संवेदी जोन के
िवस्तार तक, इनम(cid:7286) जो भी िनकट ह,ै नये वािणिज्यक होटल और िरसोटर् का संिनमार्ण अनुज्ञात नह(cid:7277) होगा।
तथािप, वन्यजीव अभयारण्य की सीमा से एक िकलोमीटर की दरू ी से परे पािरिस्थितक संवेदी जोन के
िवस्तार तक, नए होटल(cid:7298) और सैरगाह(cid:7298) का स्थापन केवल पूवर् पिरिनि(cid:7391)त क्षे(cid:7074)(cid:7298) म(cid:7286) पयर्टन महायोजना के
अनुसार पािरिस्थितक पयटर् न सुिवधा(cid:7312) के िलए ही अनुज्ञात होगा;
(ii) पािरिस्थितक संवेदी जोन के भीतर नए पयर्टन ि(cid:7059)याकलाप(cid:7298) या िव(cid:7378)मान पयर्टन ि(cid:7059)याकलाप(cid:7298) का
िवस्तार क(cid:7286)(cid:7076)ीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मं(cid:7074)ालय (cid:7367)ारा जारी मागर्दशर्क िस(cid:7373)ांत(cid:7298) के
तथा राष् (cid:7069)ीय व् या(cid:7062) संरक्षण (cid:7079)ािधकरण, (cid:7367)ारा जारी पािरिस्थितक पयर्टन पर जोर दते े हुए मागर्दशर्क
िस(cid:7373)ांत(cid:7298) (समय-समय पर यथा संशोिधत) होगा;
(iii) आंचिलक महायोजना का अनुमोदन िकए जाने तक, पयर्टन के िलए िवकास और िव(cid:7378)मान पयर्टन
ि(cid:7059)याकलाप(cid:7298) के िवस्तार को वास्तिवक स्थल िविन(cid:7416)द(cid:7397)र् संवीक्षा तथा मानीटरी सिमित की िसफािरश पर
आधािरत संबंिधत िविनयामक (cid:7079)ािधकरण(cid:7298) (cid:7367)ारा अनुज्ञात िकया जाएगा ।¹Hkkx IIμ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(4) नसै िगर्क िवरासत -- पािरिस्थितक संवेदी जोन म(cid:7286) महत्वपूणर् नैसिगर्क िवरासत के सभी स्थल(cid:7298) जैसे सभी जीन
कोश आरिक्षत क्षे(cid:7074), शैल िवरचनाएं, जल (cid:7079)पात(cid:7298), झरन(cid:7298), घाटी माग(cid:7300), उपवन(cid:7298), गुफाएं, स्थल(cid:7298), (cid:7082)मण, अ(cid:7393)रोहण,
(cid:7079)पातो आिद की पहचान की जाएगी और उन्ह (cid:7286) संरिक्षत िकया जाएगा तथा उनकी सरं क्षा और पिररक्षण के िलए इस
अिधसूचना के (cid:7079)काशन की तारीख स े छह मास की अविध के भीतर, उपयु(cid:7334) योजना बनाएगी और ऐसी योजना
आंचिलक महायोजना का भाग होगी ।
(5) मानव िनिमतर् िवरासत स् थल(cid:7298) - पािरिस् थितक संवेदी जोन म(cid:7286) भवन(cid:7298), संरचना(cid:7312), िशल्प-तथ्य तथा ऐितहािसक
पुरातत्वीय, कलात्मक और सांस्कृितक महत्व के क्षे(cid:7074)(cid:7298) की पहचान करेगी और इस अिधसूचना के (cid:7079)काशन की तारीख
स े छह मास की अविध के भीतर उनके संरक्षण की योजनाएं तैयार की जाएंगी तथा आंचिलक महायोजना म(cid:7286)
सिम्मिलत की जाएगी ।
(6) ध्व िन (cid:7079)दषू ण – राज्य सरकार का पयार्वरण िवभाग या छ(cid:7275)ीसगढ़ राज्य (cid:7079)दषू ण िनयं(cid:7074)ण बोडर् पयार्वरण
(संरक्षण) अिधिनयम, 1986 के अधीन ध्विन (cid:7079)दषू ण (िविनयमन तथा िनयं(cid:7074)ण) िनयम, 2000 के अनुबंिधत

करेगा ।
(7) वाय ु (cid:7079)दषू ण -- पािरिस्थितक संवेदी जोन म(cid:7286) वायु (cid:7079)दषू ण के िनयं(cid:7074)ण के िलए वायु ((cid:7079)दषू ण िनवारण और
िनयं(cid:7074)ण) अिधिनयम 1981 (1981 का 14) और इसके अधीन िकए गए िविनयम(cid:7298) के अनुसार अनुपालन िकया
जाएगा ।
(8) बिह(cid:7090)ाव का िनस्सारण -- बिह(cid:7090)ाव(cid:7298) का िनस्सारण पािरिस्थितक जोन म(cid:7286) उपचािरत बिह(cid:7090)ाव का िनस्सारण
पयार्वरण (संरक्षण) अिधिनयम, 1986 तथा तदधीन बनाए गए िनयम(cid:7298) के अंतगर्त आने वाले पयार्वरणीय (cid:7079)दषू क
तत्व(cid:7298) के िनवर्हन के िलए साधारण मानक(cid:7298) के उपाबंध(cid:7298) के अनुसार होगा ।
(9) ठोस अपिश(cid:7397) -- ठोस अपिश(cid:7397)(cid:7298) का िनपटान िन(cid:7388)िलिखत रूप म(cid:7286) होगा -
(i) पािरिस्थितक संवेदी जोन म(cid:7286) ठोस अपिश(cid:7397)(cid:7298) का िनपटान भारत सरकार के पयार्वरण, वन और
जलवायु पिरवतर्न मं(cid:7074)ालय की समय समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ),
तारीख 8 अ(cid:7079)ैल, 2016 ठोस अपिश(cid:7397) (cid:7079)बंध िनयम, 2016 के उपबंध(cid:7298) के अनुसार िकया जाएगा ;
(ii) अकाबर्िनक साम(cid:7061)ी का पािरिस्थितक संवेदी जोन बा(cid:7405) पहचान की गई स्थल पर पयार्वरण
स्वीकायर् रीित म(cid:7286) (cid:7390)यन िकया जाएगा ;
(iii) ठोस अपिश(cid:7397)(cid:7298) के ज्वलन या भस्मीकरण और भराई के स्थापना को पािरिस्थितक संवेदी जोन म(cid:7286)
अनुज्ञा नह(cid:7277) की जाएगी ;
(10) जैव िचिकत्स ीय अपिशष्ट - पािरिस्थितक संवेदी जोन म(cid:7286) जैव िचिकत्सीय अपिश(cid:7397)(cid:7298) का िनपटान भारत सरकार
के पयार्वरण, वन और जलवायु पिरवतर्न मं(cid:7074)ालय की समय समय पर यथासंशोिधत अिधसूचना सं.का.िन 343
(अ), तारीख 28 माचर् 2016 (cid:7367)ारा (cid:7079)कािशत जैव िचिकत्सीय अपिश(cid:7397) (cid:7079)बंध िनयम, 2016 के उपबंध(cid:7298) के अनुसार

(13) ई–अपिश(cid:7397):- पािरिस्थितक संवेदी जोन म(cid:7286) ई–अपिश(cid:7397) (cid:7079)बंध भारत सरकार के पयार्वरण, वन और जलवायु
पिरवतर्न मं(cid:7074)ालय (cid:7367)ारा (cid:7079)कािशत और समय समय पर यथा संशोिधत ई–अपिश(cid:7397) (cid:7079)बंध िनयम, 2016 के उपबंध(cid:7298) के
अनुसार िकया जाएगा।
(14) यानीय पिरवहन: - पिरवहन की यानीय गितिविधयां आवास के अनुकूल रीित म(cid:7286) िविनयिमत ह(cid:7298)गी और इस
संबंध म(cid:7286) आंचिलक महायोजना म(cid:7286) िवशेष उपबंध समािव(cid:7397) िकए जाएंगे और आंचिलक महायोजना के तैयार होने और
राज्य सरकार के सक्षम (cid:7079)ािधकारी (cid:7367)ारा के अनुमोिदत होने तक, िनगरानी सिमित ससु ंगत िनयम(cid:7298) और त(cid:7373)ीन बनाए
गए िविनयम(cid:7298) के अधीन यानीय संचलन के अनुपालन की िनगरानी करेगी ।
(15) औ(cid:7378)ोिगक इकाइया:ं - (क) (cid:7079)स्तािवत पािरिस्थितक संवेदी जोन के भीतर नए का(cid:7399) आधािरत उ(cid:7378)ोग(cid:7298) की
स्थापना की अनुमित िविध के अनुसार स्थािपत िव(cid:7378)मान का(cid:7399) आधािरत उ(cid:7378)ोग(cid:7298) की दी जाएगी अन्यथा नह(cid:7277)।
(ख) (cid:7079)स्तािवत पािरिस्थितक संवेदी जोन के भीतर जल, वायु, मृदा, ध्विन (cid:7079)दषू ण कािरत करने वाले िकसी नए
उ(cid:7378)ोग की स्थापना को अनुमित नह(cid:7277) दी जाएगी ।
(16) यिद यह आवश्यक समझा जाए, इस अिधसूचना के उपबंध(cid:7298) को (cid:7079)भावी करने म(cid:7286) केन्(cid:7076)ीय सरकार और राज्य
सरकार, अन्य उपाय(cid:7298) को िविन(cid:7416)द(cid:7397)र् करेगी।

नए वािणिज्यक होटल और िरसोटर् अनुज्ञात ह(cid:7298)गे, अन्यथा नह(cid:7277) :
परंतु, संरिक्षत क्षे(cid:7074) की सीमा के एक िकलोमीटर से आगे या
पािरिस्थितक संवेदी जोन के िवस्तार तक सभी नए पयर्टक
ि(cid:7059)याकलाप या िव(cid:7378)मान ि(cid:7059)याकलाप का िवस्तार पयर्टन महायोजना
और यथा लागू मागर्दश(cid:7278) िस(cid:7373)ांत(cid:7298) के अनुरुप होगा।
15. संिनमार्ण ि(cid:7059)याकलाप । संरिक्षत क्षे(cid:7074) की सीमा से एक िकलामीटर के भीतर या पािरिस्थितक
संवेदी जोन के िवस्तार तक, जो भी िनकट हो, िकसी भी (cid:7079)कार का
वािणिज्यक संिनमार्ण अनुज्ञात नह(cid:7277) िकया जाएगा:
परंतु स् थानीय लोग(cid:7298) को पैरा 6 के उप पैरा (1) म(cid:7286) सूचीब(cid:7373)
ि(cid:7059)याकलाप(cid:7298) सिहत उनके उपयोग के िलए उनकी भूिम म(cid:7286) संिनमार्ण
करने की अनुमित स्थानीय िनवािसय(cid:7298) की आवासीय आवश्यकता(cid:7312) को
पूरा करने की भवन उपिविधय(cid:7298) के अनुसार दी जाएगी ।
(i) िव(cid:7378)मान सड़क(cid:7298) को चौड़ा करना और उन्ह (cid:7286)सुदढृ करना तथा नई
सड़क(cid:7298) का संिनमार्ण;
(ii) बुिनयादी ढांच(cid:7298) और नागिरक सुिवधा(cid:7312) का संिनमार्ण और
नवीकरण;
(iii) कुटीर उ(cid:7378)ोग(cid:7298) िजसके अंतगर्त (cid:7061)ामीण उ(cid:7378)ोग ह;(cid:7289) सुिवधाजनक
भण्डार और स्थानीय सुख सुिवधा(cid:7312) जो पािरिस्थितक पयर्टन
म(cid:7286) िजस म(cid:7286) गृह वास सहायक हो; और
(iv) इस अिधसूचना म(cid:7286) सूचीब(cid:7373) संविधर्त ि(cid:7059)याकलाप ।
16. वृक्ष(cid:7298) की कटाई । (क) राज्य सरकार म (cid:7286) सक्षम (cid:7079)ािधकारी की पूवर् अनुमित के िबना वन,
सरकारी या राजस्व या िनजी भूिम पर या वन(cid:7298) म (cid:7286) वृक्ष(cid:7298) की कटाई
नह(cid:7277) होगी ।
(ख) वृक्ष(cid:7298) की कटाई संबंिधत क(cid:7286)(cid:7076)ीय या राज्य अिधिनयम या उसके
अधीन बनाए गए िनयम(cid:7298) के उपबंध(cid:7298) के अनुसार िविनयिमत होगी ।
17. वािणिज्यक जल संसाधन िजसके अंतगर्त (क) भूिम के अिधभोगी के वास्तिवक कृिष उपयोग और घरेलू खपत
भू-जल संचयन भी ह ै।
के िलए ही सतही और भूिमगत जल का िनष्कषर्ण अनुज्ञात होगा ।
(ख) औ(cid:7378)ोिगक या वािणिज्यक उपयोग के िलए सतही और भूिमगत
जल के िनष्कषर्ण िजसके अंतगर्त वह भाग मा(cid:7074)ा िजसका िनष्कषर्ण
िकया जा सकती ह ै के िलए संबंिधत िविनयामक (cid:7079)ािधकारी से पूवर्
िलिखत अनुज्ञा अपेिक्षत होगी ।
(ग) सतही या भूजल का िव(cid:7059)य अनुज्ञात नह(cid:7277) होगा ।
(घ) िकसी भी (cid:7090)ोत से, िजसके अंतगर्त कृिष भी ह,ै जल के संदषू ण या

19. होटल(cid:7298) और लॉज के िव(cid:7378)मान पिरसर(cid:7298) लागू िविधय(cid:7298) के अधीन िविनयिमत ह(cid:7298)गे ।

22. िवदेशी (cid:7079)जाितय(cid:7298) को लाना । लागू िविधय(cid:7298) के अधीन िविनयिमत ह(cid:7298)गे ।
23. पहाड़ी ढाल(cid:7298) और नदी तट(cid:7298) का संरक्षण । लागू िविधय(cid:7298) के अधीन िविनयिमत ह(cid:7298)गे ।
24. (cid:7079)ाकृितक जल िनकाय(cid:7298) या सतही क्षे(cid:7074) म(cid:7286) उपचािरत उपिश(cid:7397) जल/बिह(cid:7090)ार्व के िनस्सारण से बचा जाएगा िजसम(cid:7286)
उपचािरत बिह(cid:7090)ार्व का िनस्सारण । जल िनकाय(cid:7298) म(cid:7286) जल (cid:7079)वेश न करे । उपचािरत अपिश(cid:7397) जल के

NOTIFICATION
New Delhi, 19th July, 2017
S.O. 2273(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide
notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 252
(E), dated 27th January, 2016, inviting objections and suggestions from all persons likely to be affected thereby within the
period of sixty days from date on which copies of the Gazette containing the said notification were made available to the
public;
AND WHEREAS, no comments/objections or suggestions were received from persons and stakeholders in
response to the draft notification;
AND WHEREAS, the Pamed Wildlife Sanctuary is situated in Bizapur District of Chhattisgarh and is spread
over an area of 442.23 square kilometres. The Sanctuary is known for its rich varieties of flora and fauna. Important flora
includes Teak (Tectona grandis), Sisham (Dalbergia latifolia), Kusum (Schleichera oleosa), Mahua (Madhuca indica),
Tendu (Diospyros melanoxylon), Bamboo (Dendrocalamus strictus), etc. The fauna of the sanctuary includes Leopard
(Panthera pardus), Nilgai (Boselaphus tragocamelus), Sambhar (Rusa unicolor), Wild boar (Sus scrofa), Wild dog
(Lycaon pictus), Wild Cat (Felis silvestris), Peacock (Pavo cristatus), Langur, Macaque Monkey (Macaque sp.), Chital
(Axis axis), Sloth Bear (Melusus ursinus), Porcupine (Hystrix indica), Jackal (Canis aureus), etc. The sanctuary is
composed of tropical moist mixed deciduous forest, tropical dry deciduous forest, mixed forest, dry evergreen forest, and
aquatic vegetation. The sanctuary also provides an extension of habitat to Indrawati Tiger Reserve.
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are
specified in paragraph 1 of this notification around the protected area of Pamed Wildlife Sanctuary as Eco-sensitive Zone
from ecological and environmental point of view and to prohibit industries or class of industries and their operations and
processes in the said Eco-sensitive Zone.
NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub-
section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3)
of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent
ranging from 0 metres to 1 km around the boundary of Pamed Wildlife Sanctuary in the State of Chhattisgarh as the
Pamed Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as
under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.-(1) The Eco sensitive Zone lies between 180 26' 04'' N to 180
11' 31'' N Latitudes and 800 43' 57'' E to 810 03' 57'' E Longitudes. The Eco-Sensitive Zone is spread over an area of
62.73 square kilometers with an extent of 1 km around the boundary of Pamed Wildlife Sanctuary excluding portion on
the Western side of the Sanctuary which shares boundary with the State of Telangana.
(2) The map of Pamed Wildlife Sanctuary demarcating the Eco-sensitive Zone boundary along with the geo co-ordinates
are appended as Annexure I.
(3) The list of villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is
appended as Annexure II.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-
sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this
notification.
(2) The Zonal Master Plan so prepared shall commensurate with the stipulation specified in the Notification and include
the environmental implications.
(3) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(4) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is
specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by
the Central Government, if any.
(5) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Chhattisgarh State Pollution Control Board;
(ix) Irrigation; and
(x) Public Works Department.
(6) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and
activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all
infrastructure and activities to be more efficient and eco-friendly.
(7) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture conservation,
needs of local community and such other aspects of the ecology and environment that need attention.
(8) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and
kinds of forests, tribal areas, agricultural areas, fertile lands, green areas such as parks and like places, horticultural areas,
orchards, lakes, wetlands and other water bodies and also with supporting maps. The Plan shall be supported by Maps
giving details of existing and proposed land use features.
(9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and shall follow prohibited, regulated and
promoted activities specified in the Notification so as to ensure Eco-friendly development for livelihood security of local
communities.
(10) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions
with respect to the provisions given in this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential needs of local residents, and for the activities listed in column (2) of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for Eco-friendly tourism
activities;
(ii) Widening and strengthening of existing roads;
(iii) Small scale industries not causing pollution;
(iv) Rainwater harvesting; and
(v) Cottage industries including village artisans.
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without
the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or
the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of
Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of
said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and
rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan shall be drawn up by the
State Government in such a manner as to prohibit or and restrict development activities within the catchment areas.
(3) Eco-Tourism.-(a)The activity relating to tourism within the Eco-sensitive Zone shall be as per Eco-Tourism Master
Plan, which shall form part of the Zonal Master Plan.
(b) The Eco-Tourism Master Plan shall be prepared by the Department of Tourism, Government of Chhattisgarh in
consultation with Department of Revenue and Forests, Government of Chhattisgarh.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities relating to tourism shall be regulated as under, namely.-
(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Pamed
Wildlife Sanctuary or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 km from the
boundary of the Wildlife Sanctuary till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts
shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be
in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate
Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time)
with emphasis on eco-tourism;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism
activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and
recommendation of the Monitoring Committee.18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and
preserved and plan shall be drawn up for their protection and conservation, within six months from the date of
publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts areas and precincts of historical, architectural, aesthetic,
and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared
within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Chhattisgarh State Pollution Control
Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the
provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection)
Act, 1986.
(7) Air pollution.- Regulations for the control of air pollution in the Eco-Sensitive Zone in accordance with the
provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder shall be
complied with.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental
(Protection) Act, 1986 and rules made therein. –
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste
Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate
Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-
sensitive Zone;
(iii) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the
provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of
Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as
amended from time to time.
(i) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone;
(ii) Individual hospitals or private health centres already existing within the Eco Sensitive Zone should provide adequate
waste treatment system to avoid adverse impact on the Protected Area.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per
the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of
Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016, as
amended from time to time.
(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the
Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management
Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide
notification number G.S.R 317(E), dated the 29th March, 2016, as amended from time to time.¹Hkkx IIμ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 19
(13) E- waste.- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-
Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and
Climate Change and as amended from time to time.
(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is
prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Industrial units.-
(a) No establishment of new wood based industries within the proposed Eco-sensitive zone shall be permitted
except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-
sensitive Zone shall be permitted.
(16) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving
effect to the provisions of this notification.
4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.- All activities in
the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and
the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:-

Protected Area or upto extent of the Eco-sensitive Zone
whichever is nearer:
Provided that, local people shall be permitted to undertake
construction in their land for their use including the
activities listed in sub paragraph (1) of paragraph 6 as per
building byelaws to meet the residential needs of the local
residents such as.-
(i) Widening and strengthening of existing roads and
construction of new roads;
(ii) Construction and renovation of infrastructure and civic
amenities;
(iii) Cottage industries including village industries;
convenience stores & local amenities supporting eco-
tourism including home stays; and
(iv) Promoted activities listed in this notification.
16. Felling of Trees. (a) There shall be no felling of trees on the forest or

5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee for effective
monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(a) Divisional Commissioner, Jagdalpur- Chairman;
(b) Collector, Bijapur Distict- Member;
(c) Deputy. Director, Indravati National Park, Bijapur- Member;
(d) Chief Executive Officer, District Panchayat, Bijapur- Member;
(e) Superintendent Engineer PWD, Jagdalpur- Member;
(f) Superintendent Engineer PHE, Jagdalpur - Member;
(g) One expert in ecology to be nominated by the Government of Chhattisgarh for a period of three years-
Member;

(i) Representative of Non-Governmental Organisation working in the field of natural conservation
(including heritage conservation) to be nominated by the Government of Chhattisgarh for a period of
three years- Member;
(j) Representative of the Town and Country Planning Department- Member;
(k) Representative of Chhattisgarh Pollution Control Board- Member;
(l) Chief Conservator of Forest (Wildlife) and Project Director, Indrawati National Park, Jagdalpur-
Member Secretary.
6. Terms of Reference:
(1) The tenure of the Monitoring Committee shall be for a period of three years from the date of issue of Notification.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the notifications of the
Government of India in the erstwhile Ministry of Environment and Forests namely Environmental Impact Assessment,
2006 vide S.O. 1533 (E), dated the 14th September, 2006, and Coastal Regulation Zone, 2011 vide S.O. No. 19(E)
dated 6th January, 2011 and subsequent amendments therein, and are falling in the Eco-sensitive Zone, including the
prohibited activities as specified in the Table under paragraph 4 thereof. Only white categories of industries shall be
considered as specified in the guidelines issued by the CPCB for “classification of Industries, 2016”.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and S.O. 19 (E) dated
6th January, 2011 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table
under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions
and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file
complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who
contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives
from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on
issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every
year by 30th June of that year to the Chief Wild Life Warden of the State under intimation to this Ministry as per
proforma appended at Annexure III.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it
deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal.
