ददल्ली, 28 , 2020 का.अ. 2936(ऄ).—प्रारूप ऄजधसूचना भारत सरकार के पयाावरण, वन और जलवायु पररवतना मंत्रालय की ऄजधसूचना स.ं का.अ. 36 (ऄ), तारीख 2 जनवरी, 2018, द्वारा भारत के राजपत्र, ऄसाधारण में प्रकाजित की गइ थी जजसमें ईन सभी व्यजियों से, जजनको ईससे प्रभाजवत होने की संभावना थी, ईस तारीख से, जजसको ईि ऄजधसूचना की राजपत्र की प्रजतयां जनता को ईपलब्ध करा दी गइ थीं, साठ ददन की ऄवजध के भीतर, अपजि और सुझाव अमंजत्रत दकए गए थे; और, ईि प्रारूप ऄजधसूचना की राजपत्र की प्रजतयां जनता को 3 जनवरी, 2018 को ईपलब्ध करा दी गइ थीं; और, ईि प्रारुप ऄजधसूचना के प्रत्युिर में व्यजियों और पणधाररयों से कोइ अक्षपे और सुझाव प्राप्त नहीं हुए थ;े और, श्री पेनुजसला नरजसम्हा वन्यजीव ऄभयारण्य 1030.85 वग ा दकलोमीटर क्षेत्र म ें फैला हुअ ह ै जो अंध्र प्रदिे राज्य के दो राजस्ट्व जजलों (श्री पोट्टी श्रीरामुलु नेल्लोर और कडपा) में जस्ट्थत ह।ै श्री पेनुजसला नरजसम्हा वन्यजीव ऄभयारण्य "बडवेल- श्री पोट्टी श्रीरामुल ु नेल्लोर सड़क" के नाम से जवददत 3988 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] दो महत्वपूणा पहाड़ी दरों के बीच जस्ट्थत ह ै जो दक दजक्षण में रपूर-जचतवेल सड़क मागा, पूवा में पोडालाकूर सोमाजसला मागा, दजक्षण में कडापा राजमपेट मागा और पजिम में जसद्धवतम बडवेल मागा पर ईिर से होकर गुजरता ह।ै यह ऄभयारण्य तीन वन मंडलों ऄथाात ् गुंटूर, कुरनूल और वन्यजीव प्रबंधन मंडल जतरुपजत तथा चार वन संभागों ऄथाात ् नेल्लोर, राजमपेट, कडपा और प्रोद्दािूर में फैला हुअ ह;ै और, श्री पेनुजसला नरजसम्हा वन्यजीव ऄभयारण्य 14.161530 और 14.677480 ई ऄक्षांि और 78.984510 और 79.629500 पू दिे ांतर के बीच जस्ट्थत ह।ै ऄभयारण्य में दो बड़ े जल जनकाय ऄथाात,् कंडलेरू जलािय और सोमाजसला जलािय ह;ैं और, श्री पेनुजसला नरजसम्हा वन्यजीव ऄभयारण्य को अध्रं प्रदिे सरकार के ददनाकं 15.09.1997 के इ.एफ एडं एस.टी (III के जलए) जी. ओ एम. एस. सं. 106, के द्वारा वन्यजीव (संरक्षण) ऄजधजनयम 1972 (1972 का 53) की धारा 18 के ईपबंध के तहत वन्यजीव ऄभयारण्य घोजित दकया गया था; और, यह ऄभयारण्य ऄनन्वेजित जैव जवजवधता, जविेि रूप से लुप्तप्राय हो चुकी वनस्ट्पजतयों और ईनसे सम्बद्ध जीवजन्तुओं के जलए समृद्ध अवासीय क्षेत्र ह।ै यह ऄभयारण्य जवजवध प्रकार की वनस्ट्पजत और जीवजन्तुओं का अश्रय स्ट्थल ह ै तथा भू-रुपात्मकता के मोजेक स े ऄलंकृत ह।ै आसके ऄजधकांि क्षेत्र पहाड़ी ह ैं जजसमें पठार, चट्टान,ें घारटयां और गहरी घारटयां ह,ैं जजनमें िुष्क पणापाती वन पाये जात े ह ैं और घास कम ईगती ह।ै आसके असपास िुष्क कांटेदार और िुष्क सदाबहार वन ह;ैं और, नेल्लोर, राजमपेटा, कडपा और प्रोद्दािूर संभागों के वनों में मुख्य रूप स े बेहतर िुष्क पणापाती प्रकार के वन पाए जाते ह।ैं सवााजधक सामान्य प्रजाजतयां पेटरोकापास सैंटाजलनस, एनोजीसस लेरटफोजलया, टर्ममनजलया टोमेंटोसा, पेटरोकापास मासूाजपयम, हाडजावक आजबनटा, क्लोरोजक्जलोन स्ट्वेएटेजनअ, लैजनया ग्रैंजडस, बोसवेजलया सारााटा, डाल्बर्मगया पॅजनकुलटा, जजआजफस जीलॉपीरस, लेगरस्ट्रॉमीया पर्मवफ्लोरा अदद, ह;ैं और, ऄभयारण्य की स्ट्थलाकृजत ऐसी ह ै जो जवजभन्न सूक्ष्म और दीघ ा पयाावासों जजनमें जवजवध जीवजन्तुओं को अश्रय जमलता ह ै के ऄजस्ट्तत्व को सक्षम बनाती ह।ै उपरी पठारों, मध्य में उंचे पहाड़ी ढलानों के साथ असपास के िुष्क क्षेत्रों, ऄसंख्य पहाड़ी धाराओं, घारटयों और गहरी घारटयों, चट्टान- अश्रयों, वन भूजम, बांस के वनों का कारण यहां वन्यजीवों की जवजवध प्रजाजतयााँ रहती ह।ैं भ-ू भौगोजलक वगीकरण के ऄनुसार, यह क्षेत्र आंडो-मलायन क्षेत्र (सीअइएस-गांगेय ईप-क्षेत्र) के ऄंतगात अता ह ै और भारतीय जीवजन्तुओं जैस े दक काला जहरन (एजनलटेोप कर्मवकापरा) और चौससगा मृग (टेरासरस क्वैजडकोररन) अदद का मूल अवास ह;ै और, प्रमुख प्रजाजतयों में पेंथेरा (पेंथेरा पदसा ), जंगली कुिा (लाआकाकोन जपक्टस) अदद जैसी प्रजाजतयां ह।ैं आस क्षेत्र की प्रमुख प्रजाजतयों का ऄन्य ईदाहरण चमगादड़ है; और, श्री पेनुजसला नरजसम्हा वन्यजीव ऄभयारण्य के चारों ओर के क्षेत्र को, जजसका जवस्ट्तार और सीमाए ं आस ऄजधसूचना के पैराग्राफ 1 में जवजनर्ददष्ट ह,ैं पाररजस्ट्थजतकी और पयाावरणीय की दजृ ष्ट स े पाररजस्ट्थजतकी संवेदी जोन के रूप में सरु जक्षत और संरजक्षत करना तथा ईि पाररजस्ट्थजतकी संवेदी जोन म ें ईद्योगों या ईद्योगों की श्रेजणयों के प्रचालन तथा प्रसंस्ट्करण को प्रजतजिद्ध करना अवश्यक ह;ै और, राज्य सरकार द्वारा 28 माचा ,2019 को प्रारूप ऄजधसूचना को ऄंजतम रूप दने े के जलए ऄजतररि जानकारी प्रस्ट्तुत की गइ थी। , भारतीय जनवााचन अयोग के अदिा अचार संजहता और 1 जुलाइ, 2019 को ईपरोि प्रारूप ऄजधसूचना 545 ददन पूरी हुइ के कारण ऄजं तम ऄजधसूचना की[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3 प्रदक्रया कुछ ददनों के जलए रुकी हुइ ह।ै आसके पररणामस्ट्वरूप, राज्य सरकार ने पयाावरण (संरक्षण) जनयम, 1986 के जनयम (5) के ईपजनयम (4) के ऄधीन ऄंजतम ऄजधसूचना प्रदि िजियों के प्रकािन के प्रस्ट्ताव पर जवचार करने का ऄनुरोध दकया; ऄतः, ऄब, केन्द्रीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) और (4) पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) (जजसे आसमे आसके पिात् पयाावरण ऄजधजनयम कहााँ गया है) की धारा (1) तथा धारा 3 र (2) र (3) के खंड (v) और खंड (xiv) द्वारा प्रदि िजियों का प्रयोग करत े हुए, जनजहत म,ें ईि जनयमों के जनयम 5 के ईपजनयम (3) के खंड (क) के ऄधीन सूचना की अवश्यकता के जबना अंध्र प्रदिे राज्य में श्री पोट्टी श्रीरामुल ु नेल्लोर और कडपा श्री पेनुजसला नरजसम्हा वन्यजीव ऄभयारण्य की सीमा के चारों ओर 2 र से 5 दकलोमीटर तक जवस्ट् ताररत क्षेत्र को श्री पेनुजसला नरजसम्हा वन्यजीव ऄभयारण्य पाररजस्ट्थजतकी संवेदी जोन (जजसे आसम ें आसके पश्च ात ् पाररजस्ट्थजतकी संवेदी जोन कहा गया ह)ै के रूप में ऄजधसूजचत करती ह,ै जजसका जववरण जनम्नानुसार ह,ै ऄथाात् :- 1. पाररजस्ट्थजतक सवं दे ी जोन का जवस्ट्तार और सीमा.- (1) पाररजस्ट्थजतकी संवेदी जोन श्री पेनुजसला नरजसम्हा वन्यजीव ऄभयारण्य की सीमा के चारों ओर 2 दकलोमीटर से 5 दकलोमीटर तक जवस्ट्तृत ह ै और पाररजस्ट्थजतकी संवेदी जोन का क्षेत्रफल 909.6147 वगा दकलोमीटर ह।ै (2) पाररजस्ट्थजतकी संवेदी जोन और श्री पेनुजसला नरजसम्हा वन्यजीव ऄभयारण्य की सीमा का जववरण ईपाबधं I के रुप में ईपाबद्ध ह।ै (3) सीमा जववरण और ऄक्षांि और दिे ांतर के साथ पाररजस्ट्थजतकी संवेदी जोन के श्री पेनुजसला नरजसम्हा वन्यजीव ऄभयारण्य का मानजचत्र ईपाबधं II के रूप में ईपाबद्ध ह।ै (4) पाररजस्ट्थजतकी संवेदी जोन और श्री पेनुजसला नरजसम्हा वन्यजीव ऄभयारण्य की सीमा के भू-जनदिे ांकों की सूची ईपाबधं III की सारणी क और सारणी ख में दी गइ ह।ै (5) मुख्य जबन्दओंु के भ-ू जनदिे ांकों के साथ पाररजस्ट्थजतकी संवेदी जोन के ऄन्तगात अन े वाले ग्रामों की सूची ईपाबधं IV के रूप में ईपाबद्ध ह।ै 2. पाररजस्ट्थजतकी सवं दे ी जोन के जलए अचं जलक महायोजना– (1) राज्य सरकार, पाररजस्ट्थजतकी संवेदी जोन के प्रयोज के जलए राजपत्र में आस ऄजधसूचना के प्रकािन की तारीख से दो विा की ऄवजध के भीतर, स्ट्थानीय व्यजियों के परामिा से और र र आस ऄजधसूचना में ददए गए ऄनुबंधों का पालन करत े हुए अंचजलक महायोजना तैयार करेगी। (2) राज्य सरकार द्वारा पाररजस्ट्थजतकी संवेदी जोन के जलए अचंजलक महायोजना ऐसी रीजत स े जो आस ऄजधसूचना म ें जवजनर्ददष् ट दकए गए के ऄनसु ार तथा ससु ंगत केंद्रीय और राज् य जवजधयों के ऄनुरूप और केंद्रीय सरकार द्वारा जारी मागाजनदिे ों, यदद कोइ हों, द्वारा तैयार होगी । (3) अंचजलक महायोजना, ईि योजना म ें पाररजस्ट्थजतकी और पयाावरणीय बातों को समाकजलत करने के जलए राज् य सरकार के जनम्नजलजखत जवभागों के परामिा से तैयार होगी, ऄथाता ्:- (i) पयाावरण; (ii) वन और वन्यजीव;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iii) िहरी जवकास; (iv) पयाटन; (v) नगरपाजलका; (vi) लोक जन मााण जव भाग; (vii) राजस्ट्व; (viii) राज्य प्रदिू ण जनयंत्रण बोड;ा (ix) ग्रामीण जवकास; (x) ससचाइ और बाढ़ जनयंत्रण; (xi) कृजि; और (xii) पंचायती राज। (4) अंचजलक महायोजना ऄनुमोददत जवद्यमान भ-ू ईपयोग, ऄवसंरचना और दक्रयाकलापों पर कोइ जनबंधन ऄजधरोजपत नहीं करेगी जब तक दक आस ऄजधसूचना में आस प्रकार जवजनर्ददष् ट न हो और अचंजलक महायोजना सभी ऄवसंरचना और दक्रयाकलापों में जो ऄजधक दक्षता और पाररजस्ट्थजतकी ऄनकु ूल हों का संवधान करेगी । (5) अंचजलक महायोजना में ऄनाच्छाददत क्षेत्रों के जीणोद्धार, जवद्यमान जल जनकायों के संरक्षण, अवाह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, जल संभर प्रबंधन, मृदा और नमी संरक्षण, स्ट्थानीय समुदायों की अवश्यकताओं तथा पाररजस्ट्थजतकी और पयाावरण से संबंजधत ऐसे ऄन्य पहलुओं, जजन पर ध्यान दने ा अवश्यक ह,ै के जलए ईपबंध होंगे । (6) अंचजलक महायोजना जवद्यमान और प्रस्ट्ताजवत भूजम ईपयोग जविेिताओं के ब्यौरों से ऄनुसमर्मथत मानजचत्र के साथ सभी जवद्यमान पूजा स्ट्थ लों, ग्रामों और नगरीय बजस्ट्तयों, वनों के प्रकार और दकस्ट्म ों, कृजि क्षेत्रों, उपजाउ भूजम, हररत क्षेत्र जसै े ईद्यान और ईसी प्रकार के स्ट्थ ान, ईद्यान कृजि क्षेत्र, फलोईद्यान, झीलों और ऄन्य जल जनकायों का ऄ कंन करेगी। (7) अंचजलक महायोजना पाररजस्ट्थजतकी संवेदी जोन में जवकास को जवजनयजमत करेगी और सारणी म ें सूचीबद्ध पैरा में प्रजतजिद्ध और जवजनयजमत दक्रयाकलापों का ऄनुपालन करेगी और स्ट्थ ानीय समुदायों की जीजवका को सरु जक्षत करने के जलए पाररजस्ट्थजतकी ऄनुकूल जवकास को सुजनजित और ईसकी ऄजभवृजद्ध भी करेगी। (8) अंचजलक महायोजना प्रादजे िक जवकास योजना की सह-जवस्ट्तारी होगी । (9) आस प्रकार ऄनुमोददत अंचजलक महायोजना आस ऄजधसूचना के ईपबंधों के ऄनसु ार मानीटरी के ऄपन े कायों को करन े के जलए मानीटर सजमजत के जलए एक संदभ ा दस्ट्तावेज तैयार करेगी । 3. राज्य सरकार द्वारा दकए जान े वाल े ईपाय.- राज्य सरकार आस ऄजधसूचना के ईपबंधों को प्रभावी करन े के जलए जनम्नजलजखत ईपाय करेगी, ऄथाात्:- (1) भ-ू ईपयोग.– (क) पाररजस्ट्थजतकी संवेदी जोन में वनों, ईद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंजन के प्रयोजनों के जलए जचजन्हत दकए गए पाकों और खुल े स्ट्थानों का वाजणजज्यक या अवासीय या औद्योजगक संबद्ध जवकास दक्रयाकलापों के जलए ईपयोग या संपररवतना नहीं होगा: परंतु यह दक पाररजस्ट्थजतकी संवेदी जोन के भीतर भाग (क) में जवजनर्ददष्ट प्रयोजनों स े जभन्न प्रयोजन के जलए कृजि और ऄन्य भूजम का संपररवतान मानीटरी सजमजत की जसफाररि पर और यथा लागू और क्षेत्रीय[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 5 नगर योजना ऄजधजनयम और केन्द्रीय सरकार या राज्य सरकार के ऄन्य जनयमों तथा जवजनयमों के ऄधीन सक्षम प्राजधकारी के पूव ा ऄनुमोदन से, और आस ऄजधसूचना के ईपबंधों द्वारा स्ट्थानीय जनवाजसयों की जनम्नजलजखत अवासीय अवश्यकताओं को पूरा करन े के जलए ऄनुज्ञात दकया जाएगा, जसै े:- (i) जवद्यमान सड़कों को चौड़ा करना और ईन्ह ें सुदढ़ृ करना तथा नइ सड़कों का संजनमााण; (ii) बुजनयादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रदिू ण ईत्पन्न न करन े वाले लघु ईद्योग; (iv) कुटीर ईद्योगों जजनके ऄंतगात ग्रामीण ईद्योग भी ह;ैं सुजवधाजनक भण्डार और स्ट्थानीय सुजवधाए ं सहायक पाररजस्ट्थजतकी पयाटन जजसके ऄन्तगात वास सजम्मजलत ह;ै और (v) पैरा 4 के ऄधीन ददए गए संवर्मधत दक्रयाकलाप: परंतु यह और दक प्रादजे िक नगर योजना ऄजधजनयम और राज्य सरकार के ऄन्य जनयमों और जवजनयमों के ऄधीन सक्षम प्राजधकारी के पूव ा ऄनुमोदन और संजवधान के ऄनच्ु छेद 244 के ईपबंधों या तत्समय प्रवृि जवजध के ईपबंधों के ऄनुपालन के जबना, जजसके ऄनुसूजचत जनजाजत और ऄन्य परंपरागत वन जनवासी (वन ऄजधकारों की मान्यता) ऄजधजनयम, 2006 (2007 का 2) भी ह,ै वाजणजज्यक या औद्योजगक जवकास दक्रयाकलापों के जलए जनजातीय भूजम का ईपयोग ऄनुज्ञात नहीं होगा: परंत ु यह और भी दक पाररजस्ट्थजतकी संवेदी जोन के भीतर भू-ऄजभलेखों में ईपसंजात कोइ गलती, मानीटरी सजमजत के जवचार प्राप्त करन े के पिात् राज्य सरकार द्वारा प्रत्येक मामले में एक बार ठीक होगी और ईि गलती के सुधार की सूचना केंद्रीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय को दी जाएगी: परंत ु यह और भी दक गलती के संिोधन में आस ईप पैरा के ऄधीन यथा ईपबंजधत के जसवाय दकसी भी दिा में भू-ईपयोग का पररवतान सजम्मजलत नहीं होगा; (ख) वनीकरण तथा वास जीणोद्धार दक्रयाकलापों सजहत ऄनप्रयुक् त या ऄनुत् पादक कृजि क्षेत्रों में पुन: वनीकरण करने के प्रयास दकए जाएगं े। (2) प्राकृजतक जल स्रोतों.- अचंजलक महायोजना में सभी प्राकृजतक र के अवाह क्षेत्रों की पहचान की जाएगी और ईनके संरक्षण और नवीकरण के जलए योजना सजम् मजलत होगी और राज् य सरकार द्वारा ऐस े क्षेत्रों पर या ईनके जनकट जवकास दक्रयाकलाप प्रजतजिद्ध करन े के बारे में जो ऐसे क्षेत्रों के जलए ऄजहतकर हो ऐसी रीजत से मागादिाक जसद्धांत तैयार दकए जाएगं े । (3) पयटा न या पाररजस्ट्थजतकी पयटा न.- (क) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पाररजस्ट्थजतकी पयाटन दक्रयाकलाप या जवद्यमान पयाटन दक्रयाकलापों का जवस्ट्तार पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन के जलए होगा। (ख) पयाटन महायोजना राज्य पयाटन जवभाग द्वारा राज्य पयाावरण और वन जवभाग के परामिा स े तैयार होगी। (ग) पयाटन महायोजना अंचजलक महायोजना के एक घटक के रूप में होगी। (घ) पयाटन महायोजना पाररजस्ट्थजतकी संवेदी जोन की वहन क्षमता के अधार पर तैयार की जाएगी।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ङ) पाररजस्ट्थजतकी पयाटन सबं ंधी दक्रयाकलाप जनम्नानुसार जवजनयजमत होंगे:- (i) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट ह,ै नये वाजणजज्यक होटल और सरै गाह के सजन्नमााण ऄनुज्ञात नहीं होंगे: परंतु, यह दक सरं जक्षत क्षेत्र की सीमा से एक दकलोमीटर की दरू ी स े परे पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक होटलों और ररजॉटा का स्ट्थापना केवल पूवा पररभाजित और नामजनर्ददष्ट क्षेत्रों में पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी पयाटन सजु वधाओं के जलए ही ऄनुज्ञात होगा; (ii) पाररजस्ट्थजतकी संवेदी जोन के भीतर नए पयाटन दक्रयाकलापों या जवद्यमान पयटा न दक्रयाकलापों का जवस्ट्तार केंद्रीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय के मागादिाक जसद्धांतों के द्वारा तथा राष्र ीय व् याघ्र संरक्षण प्राजधकरण, द्वारा जारी पाररजस्ट्थजतकी–पयाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल दते े हुए (समय-समय पर यथा संिोजधत) जारी मागादिाक जसद्धांतों के ऄनुसार होगा; (iii) अंचजलक महायोजना का ऄनुमोदन दकए जान े तक, पयाटन के जलए जवकास और जवद्यमान पयाटन दक्रयाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्ददष्ट संवीक्षा और मानीटरी सजमजत की जसफाररि पर अधाररत संबंजधत जवजनयामक प्राजधकरणों द्वारा ऄनुज्ञात दकया जाएगा और पाररजस्ट्थजतकी संवेदी जोन के भीतर दकसी नये होटल या ररसोटा या वाजणजज्यक स्ट्थापना का संजनमााण ऄनुज्ञात नहीं दकया जायेगा । (4) नसै र्मगक जवरासत.- पाररजस्ट्थजतकी संवेदी जोन में महत्वपूणा नैसर्मगक जवरासत के सभी स्ट्थलों जैसे जीन कोि अरजक्षत क्षेत्र, िैल जवरचनाए,ं जल प्रपातों, झरनों, घाटी मागों, ईपवनों, गुफाए,ं स्ट्थलों, भ्रमण, ऄश्वरोहण, प्रपातों अदद की पहचान की जाएगी और जवरासत संरक्षण योजना अचं जलक महायोजना के भाग के रूप में परररक्षण और संरक्षण के जलए तैयार की जाएगी । (5) मानव जनर्ममत जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेदी जोन में भवनों, सरं चनाओं, जिल्प-तथ्य, ऐजतहाजसक, स्ट्थापत्य, सौंदयपा ूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और ईपक्षेत्रों की पहचान और ईनके संरक्षण के जलए जवरासत योजना अंचजलक महायोजना के भाग के रुप में तैयार की जाएगी। (6) ध्व जन प्रदिू ण.- पयाावरण ऄजधजनयम के ऄधीन ध्वजन प्रदिू ण (जवजनयमन और जनयंत्रण) जनयम, 2000 में जनयत ईपबंधों के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन में ध्वजन प्रदिू ण के जनयत्रं ण और जनवारण का ऄनुपालन दकया जाएगा। (7) वाय ु प्रदिू ण.- पाररजस्ट्थजतकी संवेदी जोन में, वाय ु प्रदिू ण के जनवारण और जनयत्रं ण का वाय ु (प्रदिू ण जनवारण और जनयंत्रण) ऄजधजनयम, 1981 (1981 का 14) और ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार ऄनुपालन दकया जाएगा। (8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेदी जोन में ईपचाररत बजहस्राव का जनस्ट्सारण, साधारण मानकों के ईपबंधों के ऄनुसार पयाावरणीय ऄजधजनयम और ईसके ऄधीन बनाए गए जनयमों के ऄधीन अन े वाल े पयाावरणीय प्रदिू ण के जनस्ट्सारण के जलए साधारण मानकों या राज्य सरकार द्वारा जनयत मानकों, जो भी ऄजधक कठोर हो, के ईपबंधों के ऄनुसार होगा। (9) ठोस ऄपजिष्ट.- ठोस ऄपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकया जाएगा:-[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 7 (क) पाररजस्ट्थजतकी संवेदी जोन में ठोस ऄपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की ऄजधसूचना सं. का.अ. 1357(ऄ), तारीख 8 ऄप्रैल, 2016 द्वारा प्रकाजित ठोस ऄपजिष्ट प्रबंधन जनयम, 2016, के ईपबंधों के ऄनुसार दकया जाएगा; ऄकाबाजनक पदाथो का जनपटान पाररजस्ट्थजतकी संवेदी जोन स े बाहर जचजन्हत दकए गए स्ट्थानों पर पयाावरण-ऄनुकूल रीजत स े दकया जाएगा। (ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों (ईएसएम) का ईपयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप ठोस ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनुकूल प्रबंधन ऄनुज्ञात दकया जा सकेगा। (10) जवै जचदकत्सा ऄपजिष्ट .- जैव जचदकत्सा ऄपजिष्ट का प्रबंधन जनम्नानुसार दकया जाएगा:- (क) पाररजस्ट्थजतकी संवेदी जोन में जैव जचदकत्सा ऄपजिष्ट का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की ऄजधसूचना सं.सा.का.जन 343 (ऄ), तारीख 28 माचा, 2016, द्वारा प्रकाजित जैव जचदकत्सा ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। (ख) पाररजस्ट्थजतकी संवदी जोन म ें मान्य प्रौद्योजगदकयों का ईपयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप जैव-जचदकत्सा ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनुकूल प्रबंधन ऄनुज्ञात दकया जा सकेगा। (11) प्लाजस्ट्टक ऄपजिष्ट प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन में प्लाजस्ट्टक ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना सं.सा.का.जन 340(ऄ), तारीख 18 माच,ा 2016, द्वारा प्रकाजित प्लाजस्ट्टक ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। (12) जनमााण और जवध्वसं ऄपजिष्ट प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन में संजनमााण और जवध्वंस ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना स.ं सां.का.जन 317(ऄ), तारीख 29 माचा, 2016, द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंधन जनयम, 2016 के ईपबंधों के ऄनसु ार दकया जाएगा । (13) इ–ऄपजिष्ट.- पाररजस्ट्थजतकी संवेदी जोन में इ–ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय द्वारा, समय-समय पर यथासंिोजधत, प्रकाजित इ–ऄपजिष्ट प्रबंधन जनयम, 2016, के ईपबंधों के ऄनुसार दकया जाएगा। (14) यानीय यातायात.- यातायात की यानीय गजतजवजधयां अवास के ऄनुकूल जवजनयजमत होंगी और आस संबंध म ें अंचजलक महायोजना में जविेि ईपबंध सजम्मजलत दकए जाएगं े और अंचजलक महायोजना के तैयार होन े और राज्य सरकार के सक्षम प्राजधकारी द्वारा ऄनुमोददत होन े तक, मानीटरी सजमजत सुसंगत ऄजधजनयमों और ईसके ऄधीन बनाए गए जनयमों और जवजनयमों के ऄनुसार यानीय दक्रयाकलापों के ऄनुपालन को मानीटर करेगी । (15) यानीय प्रदिू ण.- लाग ू जवजधयों के ऄनुपालन में यानीय प्रदिू ण का जनवारण और जनयंत्रण दकया जाएगा और स्ट्वच्छक ईंधन के ईपयोग के जलए प्रदिू ण करने वाले ईद्योगों की स्ट्थापना ऄनुज्ञात नहीं की जाएगं ी । (ii) केन्द्रीय प्रदिू ण जनयंत्रण बोड ा द्वारा फरवरी, 2016 में जारी मागादिाक जसद्धान्तों में ईद्योगों के वगीकरण के ऄनुसार, जब तक दक ऄजधसचू ना में आस प्रकार जवजनर्ददष्ट न हो; पाररजस्ट्थजतकी संवेदी जोन के भीतर केवल गैर-प्रदिू णकारी ईद्योगों को ऄनज्ञु ात दकया जाएगा और आसके ऄजतररि, गैर प्रदिू णकारी ईद्योगों को बढ़ावा ददया जाएगा। (17) पहाड़ी ढलानों को सरं क्षण.- पहाड़ी ढलानों का सरं क्षण जनम्नानुसार होगा:- (क) अंचजलक महायोजना पहाड़ी ढलानों पर क्षेत्रों का सकं ेत होगा जहा ं दकसी भी सजं नमााण की ऄनुमजत नहीं दी जाएगी; (ख) कटाव के एक ईच्च जडग्री के साथ जवद्यमान खड़ी पहाड़ी ढलानों या ढलानों पर दकसी भी संजनमााण की ऄनुमजत नहीं दी जाएगी । 4. पाररजस्ट्थजतकी सवं ेदी जोन म ें प्रजतजिद्ध और जवजनयजमत दकए जान े वाल े दक्रयाकलापों की सचू ी.- पाररजस्ट्थजतकी संवेदी जोन में सभी दक्रयाकलाप पयाावरण ऄजधजनयम के ईपबंधों और ईसके ऄधीन बनाए गए जनयमों जजसके तटीय जवजनयमन जोन ऄजधसूचना 2011 और पयाावरणीय समाघात जनधाारण ऄजधसूचना, 2006 और ऄन्य लाग ू जवजध के जजसमें वन (संरक्षण) ऄजधजनयम, 1980 (1980 का 69), भारतीय वन ऄजधजनयम, 1927 (1927 का 16), वन्यजीव (संरक्षण) ऄजधजनयम, 1972 (1972 का 53) सजम्मजलत ह ैं और दकये गय े संिोधनों द्वारा िाजसत होंग े और नीचे दी गइ सारणी म ें जवजनर्ददष्ट रीजत में जवजनयजमत होंग,े ऄथाात ् :- सारणी क्र. स.ं दक्रयाकलाप रटप्पणी (1) (2) (3) क. प्रजतजिद्ध दक्रयाकलाप 1. वाजणजज्यक खनन, पत्थर (क) वास्ट्तजवक स्ट्थानीय जनवाजसयों की घरेलू संवेदी जोन में फरवरी, 2016 म ें केंद्रीय प्रदिू ण जनयंत्रण बोड ा द्वारा जारी ददिाजनदिे ों में दकए गए ईद्योगों के वगीकरण के ऄनुसार केवल गैर- प्रदिू णकारी ईद्योगों की स्ट्थापना होगी और आसके ऄजतररि, गैर- प्रदिू णकारी कुटीर ईद्योगों को प्रोत्साहन ददया जाएगा। 3. बड़ी ताप जल जवद्युत लाग ू जवजधयों के ऄनुसार प्रजतजिद्ध (ऄन्यथा ईपबंजधत के पररयोजनाओं की स्ट्थापना । जसवाय) होंगे। 4. दकसी पररसंकटमय पदाथा का लाग ू जवजधयों के ऄनुसार प्रजतजिद्ध (ऄन्यथा ईपबंजधत के प्रयोग या ईत्पादन या जसवाय) होंगे। प्रस्ट्संकरण । 5. प्राकृजतक जल जनकायों या भूजम लाग ू जवजधयों के ऄनुसार प्रजतजिद्ध (ऄन्यथा ईपबंजधत के क्षेत्र भट्टों की स्ट्थापना । लाग ू जवजधयों के ऄनुसार प्रजतजिद्ध (ऄन्यथा ईपबंजधत के जसवाय) होंगे। ख. जवजनयजमत दक्रयाकलाप 10. होटलों और ररसोटो की पाररजस्ट्थजतकी पयाटन दक्रयाकलापों हते ु लघ ु ऄस्ट्थायी ु स्ट्थानीय लोगों को ऄपनी अवास सम्बन्धी जनम्नजलजखत अवश्यकताओं को पूरा करन े के जलए, पैरा 3 के ईप पैरा (1) में सूचीबद्ध दक्रयाकलापों सजहत ऄपने प्रयोग के जलए, ऄपनी भूजम में भवन ईप-जवजधयों के ऄनुसार, संजनमााण करने की ऄनुज्ञा होगी: परन्तु गैर–प्रदिू णकारी लघ ु ईद्योगों स े संबंजधत संजनमााण दक्रयाकलाप लाग ू जनयमों और जवजनयमों, यदद कोइ हों, के ऄनुसार सक्षम प्राजधकारी की पूव ा ऄनुमजत से जवजनयजमत दकए जाएगं े और वे न्यूनतम होंग े । (ख) एक दकलोमीटर से अगे ये अंचजलक महायोजना के ऄनुसार जवजनयजमत होंग े । 12. वृक्षों की कटाइ । (क) राज्य सरकार के सक्षम प्राजधकारी की पूवा ऄनुमजत के जबना वन भूजम या सरकार भूजम या राजस्ट्व भूजम या जनजी भूजम पर वृक्षों की कटाइ की ऄनुज्ञा नहीं होगी । (ख) वृक्षों की कटाइ केंद्रीय या संबंजधत राज्य के ऄजधजनयमों और ईनके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार जवजनयजमत होगी । 13. फमों, कारपोरेट, कंपजनयों द्वारा स्ट्थानीय जनता के प्रयोग के जलए लाग ू जवजधयों (ऄन् यथा ईपबंजधत के जसवाय) के ऄधीन ऄनुज्ञात होगा । बड़ े पैमाने पर वाजणजज्यक पिुधन संपदा और कुक्कुट फामों की स्ट्थापना । 14. वन ईत्पादों और गैर काष्ठ वन लाग ू जवजधयों के ऄधीन जवजनयजमत होगा । ईत्पादों का संग्रह । 15. जवद्युत और संचार टॉवर लगान,े लाग ू जवजधयों के ऄधीन जवजनयजमत होगा (भूजमगत केबल जबछाने को बढ़ावा ददया जाएगा)। तार-जबछाने तथा ऄन्य बुजनयादी ढांचे की व्यवस्ट्था । 16. नागररक सुजवधाओं सजहत यह व्यवस्ट्था लाग ू जवजधयों, जनयमों, जवजनयमों और मौजूदा बुजनयादी ढांचे की व्यवस्ट्था। ददिाजनदिे ों के ऄनुसार ईपिमन ईपायों के साथ की जाएगी। 17. जवद्यमान सड़कों को चौड़ा यह व्यवस्ट्था लाग ू जवजधयों, जनयमों, जवजनयमों और मौजूदा करना, ईन्ह ें सुदढृ बनाना और ददिाजनदिे ों के ऄनुसार ईपिमन ईपायों के साथ की जाएगी। नइ सड़कों राजत्र म ें सड़क यातायात का लाग ू जवजधयों के ऄधीन वाजणजज्यक प्रयोजन के जलए संचलन । जवजनयजमत होगा । 21. प्राकृजतक जल जनकायों या भ ू जल जनकायों में ईपचाररत ऄपजिष्ट जल या बजहस्रावा के क्षेत्र में ईपचाररत ऄपजिष्ट जल जनस्ट्सारण से बचा जाएगा और ईपचाररत ऄपजिष्ट जल के या बजहस्रााव का जनस्ट्सारण । पुनचाक्रण और पुन:ईपयोग के प्रयास दकए जाएगं े ऄन्यथा ईपचाररत ऄपजिष्ट जल या बजहस्रााव का जनस्ट्सारण लाग ू जवजधयों के ऄनुसार जवजनयजमत दकया जाएगा। 22. सतही और भूजल का लाग ू जवजधयों के ऄधीन जवजनयजमत होगा । वाजणजज्यक प्रयोग एवं जनष्किाण । 23. कृजि या ऄन्य ईपयोग के जलए समुजचत प्राजधकारी द्वारा जवजनयजमत दकया जाएगा तथा प्रदिू णकारी लघ ु ईद्योग। फरवरी, 2016 में केन्द्रीय प्रदिू ण जनयंत्रण बोड ा द्वारा जारी ईद्योगों के वगीकरण के ऄनसु ार गैर-प्रदिू णकारी ईद्योग तथा ऄपररसंकटमय लघु और सेवा ईद्योग, कृजि, पुष्प कृजि, बागबानी या कृजि अधाररत ईद्योग, जो पाररजस्ट्थजतकी संवेदी जोन स े दिे ी सामजग्रयों से ईत्पाद बनाते ह,ैं सक्षम प्राजधकारी द्वारा ऄनुज्ञात होंगे।12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. रूप स े बढ़ावा ददया जाएगा । पयाावासों की बहाली । 39. पयाावरण के प्रजत जागरुकता। रूप स े बढ़ावा ददया जाएगा । 5. जनगरानी सजमजत.- केंद्रीय सरकार, पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) की धारा 3 की ईपधारा (3) द्वारा प्रदि िजियों का प्रयोग करते हुए पाररजस्ट्थजतकी संवेदी जोन की प्रभावी जनगरानी के जलए जनगरानी सजमजत गरठत करती ह,ै जो जनम्नजलजखत से जमलकर बनेगी:-- क्र. स.ं जनगरानी सजमजत का गठन पद (i) जनगरानी सजमजत आस ऄजधसूचना के ईपबंधों के ऄनुपालन की जनगरानी करेगी। (2) जनगरानी सजमजत का कायाकाल तीन वि ा या राज्य सरकार द्वारा नइ सजमजत का पुन: गठन दकए जान े तक होगा और बाद में जनगरानी सजमजत राज्य सरकार द्वारा गरठत की जाएगी। (3) जनगरानी सजमजत ईन दक्रयाकला को ऄनुज्ञात न करेगी जो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचनाओं ऄथाात् पयाावरण प्रभाव मूल्यांकन , 2006 .का.अ.1533 (ऄ), तारीख 14 जसतंबर, 2006 और जो पाररजस्ट्थजतकी संवेदी जोन की सीमा में भी अते ह ैं जजनमें आस ऄजधसूचना के पैरा-4 में दी गइ सारणी में यथाजवजनर्ददष्ट प्रजतजिद्ध दक्रयाकलाप भी । ईनकी, आस ऄजधसूचना के पैरा-4 में दी गइ सारणी में यथा जवजनर्ददष्ट प्रजतजिद्ध दक्रयाकला के जसवाय, वास्ट्तजवक स्ट्थल–जवजिष्ट दिाओं के अधार पर जनगरानी सजमजत द्वारा संवीक्षा की जाएगी और र र र, र , और र र । (4) वे दक्रयाकलाप, जो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना सं. का.अ. 1533(ऄ), तारीख 14 जसतंबर, 2006 और का.अ. 19 (ऄ), तारीख 6 जनवरी, 2011 की ऄ सूची के ऄंतगात नहीं अत े ह ैं और जो पाररजस्ट्थजतकी सवं ेदी जोन की सीमा में अते ह,ैं ईनकी, आस ऄजधसूचना के पैरा-4 में दी गइ सारणी में यथा जवजनर्ददष्ट प्रजतजिद्ध दक्रयाकला के जसवाय, वास्ट्तजवक स्ट्थल–जवजिष्ट दिाओं के अधार पर जनगरानी सजमजत द्वारा संवीक्षा की जाएगी और ईन्ह ें संबंजधत जवजनयामक प्राजधकरणों को भेजा जाएगा। (5) जनगरानी सजमजत का सदस्ट्य-सजचव या ऐसे व्यजि के जवरूद्ध, जो आस ऄजधसूचना के दकसी ईपबंध का ईल्लंघन करता ह,ै पयाावरण (संरक्षण) ऄजधजनयम, 1986 की धारा 19 के ऄधीन करन े के जलए सक्षम होगा। (6) जनगरानी सजमजत प्रत्येक मामले में अवश्यकताओं के अधार पर संबंजधत जवभागों के प्रजतजनजधयों या जविेिज्ञों, औद्योजगक संघों के प्रजतजनजधयों या संबंजधत पक्षों को र ऄपने जवचार-जवमिा में सहायता के जलए अमंजत्रत कर सकेगी। (7) जनगरानी सजमजत प्रत्येक विा 31 माचा की जस्ट्थजत के ऄनुसार ऄपनी वार्मिक कारावाइ ररपोटा राज्य के पयाावरण, वन और जलवायु पररवतान मंत्रालय वन्यजीव वाडना को, ईपाबधं V में ददए गए प्रपत्र के ऄनुसार, ईस वि ा की 30 जनू तक प्रस्ट्तुत करेगी । (8) केन्द्रीय सरकार का पयाावरण, वन और जलवायु पररवतान मंत्रालय जनगरानी सजमजत को ईसके कृत्यों के प्रभावी जनवाहन के जलए ऐसे जनदिे द े सकेगा जो वह समझ े । 7. आस ऄजधसूचना के ईपबंधों को प्रभावी बनान े के जलए केंद्रीय सरकार और राज् य सरकार, ऄजतररक् त ईपाय, यदद कोइ हों, जवजनर्ददष् ट कर सकेगी । 8. आस ऄजधसूचना के ईपबंध भारत । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 28th August, 2020 S.O. 2936(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 36(E), dated the 2nd January, 2018, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 3rd January, 2018; AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification; AND WHEREAS, the Sri Penusila Narasimha Wildlife Sanctuary spreading over an area of 1030.85 square kilometres is located in two revenue districts (Sri Potti Sriramulu Nellore District Nellore and Kadapa) in the State of Andhra Pradesh. The Penusila Narasimha Wildlife Sanctuary is located between two important hill passes known as ―Badvel – Sri Potti Sriramulu Nellore - Nellore road‖ passing on the North, Rapur – Chitvel road passing on the South, Podalakur-Somasila road on the East, Kadapa – Rajampet road on the South and Sidhavatam – Badvel road on the West. This Sanctuary spreads in three forest circles such as Guntur, Kurnool and Wildlife Management Circle, Tirupathi, four forest divisions i.e. Nellore, Rajampet, Kadapa and Proddatur; AND WHEREAS, the Sri Penusila Narasimha Wildlife Sanctuary lies between 14.161530 and 14.677480 N latitudes and 78.984510 and 79.629500 E longitudes. Two big water bodies viz., the Kandaleru Reservoir and Somasila Reservoir are exists inside the Sanctuary;[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 27 AND WHEREAS, the Sri Penusila Narasimha Wildlife Sanctuary had been declared as Wildlife Sanctuary under the provision of section 18 of the Wildlife (Protection) Act, 1972 (53 of 1972) vide Government of Andhra Pradesh, the Environment Forest and Science and Technology, (For III) G.O M.s. No. 106, dated the 15th September 1997; AND WHEREAS, this Sanctuary is a domain of rich habitat for unexplored bio- diversity, especially many endangered flora and its associated fauna. The Sanctuary is ornamented with mosaic of geo- morphological features supporting variety of flora and fauna. Most of the Sanctuary possess hilly terrain with plateaus, ridges, gorges and deep valleys which support dry deciduous forests with an under growth of grasses. Dry thorny and dry evergreen forests surround the fringe; AND WHEREAS, the forests of Nellore, Rajampeta, Kadapa and Proddatur divisions are comprised of mainly superior dry deciduous types. The most common species occurring are Pterocarpus santalinus, Anogeissus latifolia, Terminalia tomentosa, Pterocarpus marsupium, Hardwick iabinata, Chloroxylon swietenia, Lannea grandis, Boswellia serrata, Dalbergia paniculata, Zizyphus xylopyrus and Lagerstroemia parviflora, etc.; AND WHEREAS, the topography of the Sanctuary enables the occurrence of varied micro and macro habitats to shelter variety of fauna. The upper plateaus, dry tracts of fringe areas with lofty hill slopes in the centre, numerous hill streams, valleys and deep gorges, rock shelters, wood lands, bamboo forests contribute to the existence of a variety of wildlife species. Under the zoogeographic classification, this area comes under Indo-Malayan region (Cis-Gangetic sub-region) native to the true Indian fauna like the black buck (Antilope cervicapra) and four horned antelope (Tetracerus quadricornis); AND WHEREAS, among the most obvious keystone species are top predators like anther (Panthera pardus), wild dog (Lycaon pictus), etc. Bats are another example of keystone species of this area; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Sri Penusila Narasimha Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; AND WHEREAS, requisite additional information for finalisation of the draft notification was submitted by the State Government on the 28th March, 2019. However, the process of final notification was halt for few days due to Model Code of Conduct from the Election Commission of India and the above draft notification completed 545 days on 1st July, 2019. As a result, the State Government requested to consider the proposal of publication of final notification exercising powers under sub-rules (4) of the rule (5) of the Environment (Protection) Rules, 1986; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) and (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 2 kilometres to 5 kilometres around the boundary of Sri Penusila Narasimha Wildlife Sanctuary, in Sri Potti Sriramulu Nellore and Kadapa districts in the State of Andhra Pradesh as the Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) without the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the said rules, in public interest; and details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of 2 kilometres to 5 kilometres around the boundary of Sri Penusila Narasimha Wildlife Sanctuary and the area of the Eco-sensitive Zone is 909.6147 square kilometres. (2) The boundary description of Sri Penusila Narasimha Wildlife Sanctuary and its Eco-sensitive Zone is appended in Annexure-I. (3) The map of the Sri Penusila Narasimha Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-II. (4) List of geo-coordinates of the boundary of Sri Penusila Narasimha Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure-III. (5) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV. 2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purposes of the Eco- sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority of State.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Urban Development; (iv) Tourism; (v) Municipal; (vi) Urban Development; (vii) Public Works Department. (viii) Revenue; (ix) State Pollution Control Board; (x) Rural Development; (xi) Irrigation and Flood Control; (xii) Agriculture; and (xiii) Panchayati Raj. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities‘ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given under paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 29 Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco- sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. (b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (10) Bio-Medical Waste.– Bio Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016. (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco- sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.- The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone; (ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 31 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act, 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents; Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 12. Felling of trees. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site- specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site- specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon‘ble Supreme Court of India or High Court or the National Green Tribunal. The GPS reading of Station No. 1 is 14.687220 N & 079.144100 E and runs towards East direction upto Station No. 5 in Proddatur Division. The GPS reading of Station No. 5 is 14.617860 N & 079.189820 E. North (Part II): The Eco-sensitive Zone boundary line starts at Station No. 5 in SPSR Nellore division in the North with GPS reading 14.617860N & 079.189820 E and runs towards North direction upto Station No. 7 along the district boundary between YSR Kadapa and SPSR Nellore, which is also the division boundary. Thence the boundary runs from Station No. 7 towards East and reaches Station No. 9 in the North- East corner. East: The Eco-sensitive Zone boundary runs from Station No. 9 whose GPS reading is 14.619530N & 079.305320E and proceeds towards South direction upto Station No. 18 in SPSR Nellore division. The GPS readings of Station No.18 are 14.268010 N & 079.609140 E. South (Part I): The Eco-sensitive Zone boundary leaves Station No. 18 and proceeds towards west upto Station No. 24 whose GPS is 14.126570N & 079.443420E. Finally meets the district boundary of YSR Kadapa at Station No. 24, which is also the division boundary of Rajampet division. South (Part II): The Eco-sensitive Zone boundary line enters Rajampeta in the South direction at Station No. 24 and runs along the District boundary. Thence the boundary runs along the South-West direction, and finally meets the YSR Kadapa division between Stations 30 and 31. South (Part III): The boundary line of the eco-sensitive zone enters YSR Kadapa division between Station Nos. 30 and 31 and proceeds towards Western direction upto Station No. 33 GPS reading is 14.305680 N & 079.043350 E. West: The Eco-sensitive Zone boundary line starts at Station No. 33 in the Western direction runs towards North direction.
