अजधसचू ना नई दिल्ली, 27 अक् तूबर, 2020 का.आ. 3877(अ).—भारत के रािपत्र, असाधारण, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान, मंत्रालर् की अजधसूचना स.ं का.आ. 207 (अ), तारीख 13 जनवरी, 2020, द्वारा एक प्रारुप अजधसूचना प्रकाजित की गई थी जिसमें ऐसे सभी व्यजिर्ों से, जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उक्त अजधसूचना स े युक्त रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थे; और, उि प्रारूप अजधसूचना स े युक्त रािपत्र की प्रजतर्ां िनता को तारीख 15 जनवरी, 2020, को उपलब्ध करा िी गई थी; और, प्रारुप अजधसूचना के उत्तर में व्यजिर्ों और पणधाररर्ों से कोई आक्षेप और सुझाव प्राप्त नहीं हुए; और, चपराला वन्र्िीव अभर्ारण्र् महाराष्ट्र के गढ़जचरौली जिले में जस्ट्थत ह ै और क्षत्रे का उल्लेख िजक्षणी उष्णकरिबंधीर् िुष्क सरकार की अजधसूचना संख्र्ा डब्ल्र्ूएलपी- 1085/सी.आर.75/एफ-5 तारीख 25 फरवरी, 1986 में अजधसूजचत दकर्ा गर्ा था और वन्र्िीव अभर्ारण्र् का कुल क्षेत्रफल 134.78 वगा दकलोमीिर ह;ै और, चपराला वन्र्िीव अभर्ारण्र् में बहुत उच्च िीविंतु और वनस्ट्पजत जवजवधता ह,ै जिनमें प्रवासी और िलीर् पक्षी सजहत स्ट्तनधाररर्ों की लगभग 39 प्रिाजतर्ां और पजक्षर्ों की भी लगभग 193 प्रिाजतर्ां ह।ैं इस क्षेत्र का जवजिष्ट दिर्ाकलापों के अजत जनकि होने स े अभर्ारण्र् के जलए, उजचत सुरक्षा उपार्ों और ऐसी दिर्ाकलापों पर जनर्ंत्रण करने की आवश्र्कता है; और, चपराला वन्र्िीव अभर्ारण्र् के चारों ओर के क्षत्रे को, जिसका जवस्ट्तार और सीमाए ं पाररस्थिस्तकी पयाावरणीय से पाररस्थिस्तकी संवेदी जोन के रूप में पैरा 1 में जवजनर्िष्टा ह,ैं जैव स्वस्वस्िता की िजृ ष्ट सरु जक्षत और संरजक्षत करना और उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों के वर्गों के प्रचालन और प्रसंस्ट्करण करने को प्रजतजिद्ध करना आवश्र्क ह;ै अतः, अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (स्जस े इस अस्िसूचना में इसके पश्चात पयाावरण अस्िस्नयम कहा र्गया ह)ै की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) तिा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, महाराष्ट्र राज्र् के गढ़जचरौली स्जला के चपराला वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर शून्य से 5.0 ककलोमीटर तक जवस्ट्ताररत क्षत्रे को चपराला वन्र्िीव अभर्ारण्र् पाररजस्ट्थजतकी सवं ेिी िोन (जिस े इसमें इसके पश्च ातप पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाातप :- 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमाए.ं - (1) पाररजस्ट्थजतकी संविे ी िोन का स्वथतार चपराला वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर शून्य स े 5.0 ककलोमीटर तक स्वथतृत ह ै और पाररस्थिस्तकी संवेदी जोन का क्षेत्रफल 166.55 वर्गा ककलोमीटर ह।ै (अभर्ारण्र् के पजिमी भाग पर पाररजस्ट्थजतकी-संवेिी िोन प्रणजहता निी और तले ंगाना राज्र् सीमा के कारण और िजक्षण-पजिमी भाग के अष्टी और र्ेलुर के िाम क्षेत्र के कारण िून्र् ह।ै इसके बाि, केनगंगा निी इन िामों की सीमा के साथ बहती है)। (2) चपराला वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का स्ववरण उपाबधं -I के रूप में उपाबद्ध ह।ै (3) सीमा जववरण और अक्षांशों और ििे ांतरों के साथ पाररजस्ट्थजतकी संवेिी िोन के सीमांककत होते हुए चपराला वन्र्िीव अभर्ारण्र् के मानजचत्र उपाबधं -IIक, उपाबधं -IIख और उपाबधं -IIर्ग के रूप में उपाबद्ध ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) पाररजस्ट्थजतकी संवेिी िोन और चपराला वन्र्िीव अभर्ारण्र् की सीमा के भू-जनििे ांकों की सूची उपाबधं -III के सारणी क और सारणी ख में िी गई ह।ै (5) मुख्र् गबंिओंु के भ-ू जनििे ांकों के साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगता आने वाले िामों की सूची उपाबधं -IV के रूप में उपाबद्ध ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और राज्य के सक्षम प्रास्िकारी के अनुमोदन के स्लए इस अजधसूचना में दिए गए अनुबंधों का पालन करते हुए आंचजलक महार्ोिना तैर्ार करेगी। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत स े िो इस अजधसूचना में जवजनर्िष्ा ि दकए गए ह ैं के अनुसार तथा ससु ंगत केंद्रीर् और राज् र् जवजधर्ों के अनुरुप और केंद्रीर् सरकार द्वारा िारी मागाजनििे ों, र्दि कोई हों, द्वारा तैर्ार होगी । (3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् बातों को समाकजलत करने के जलए राज् र् सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार होगी:- (i) पर्ाावरण; (ii) वन और वन्र्िीव; (iii) कृजि; (iv) रािस्ट्व ; (v) िहरी जवकास; (vi) पर्ािन; (vii) िामीण जवकास; (viii) गसंचाई और बाढ़ जनर्ंत्रण; (ix) नर्गरपास्लका; (x) पंचार्ती राि; (xi) लोक जन मााण जव भाग; और (xii) महाराष्ट्र राज्र् प्रििू ण जनर्ंत्रण बोड।ा (4) आंचजलक महार्ोिना अनुमोदित जवद्यमान भ-ू उपर्ोग, अवसंरचना और दिर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगी िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िष्ा ि न हो और आचंजलक महार्ोिना सभी अवसंरचना और दिर्ाकलापों में, िो अजधक िक्षता और पाररजस्ट्थजतकी अनकु ूल हों, का संवधान करेगी । (5) आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण से संबंजधत ऐसे अन्र् पहलुओं, जिन पर ध्र्ान िने ा आवश्र्क ह,ै के जलए उपबंध होंग े ।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (6) आंचजलक महार्ोिना स्वद्यमान और प्रथतास्वत भूस्म उपयोर्ग स्वशेषताओं के ब्यौरों स े अनुसमर्िात मानस्चत्रों के साि सभी जवद्यमान पूिा स्ट्थ लों, िामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट्म ों, कृजि क्षेत्रों, ऊपिाऊ भूजम, हररत क्षेत्र िैसे उद्यान और उसी प्रकार के स्ट्थ ान, उद्यान कृजि क्षेत्र, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभ्र्कंन करेगी। (7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करेगी और सारणी म ें सूचीबद्ध पैराग्राफ-4 में प्रजतजिद्ध और जवजनर्जमत दिर्ाकलापों का अनुपालन करेगी और स्ट्थ ानीर् समुिार्ों की जीस्वका को सुरस्क्षत करन े के स्लए पाररजस्ट्थजतकी अनुकूल जवकास को सुस्नस्श्चत और उसकी अस्भवृस्ि भी करेर्गी। (8) आंचजलक महार्ोिना प्रादस्े शक जवकास र्ोिना की सह जवस्ट्तारी होगी । (9) इस प्रकार अनुमोदित आंचजलक महार्ोिना इस अजधसूचना के उपबंधों के अनसु ार स्नर्गरानी के अपन े कृत्यों को करन े के जलए स्नर्गरानी सजमजत के जलए एक सिं भ ा िस्ट्तावेि तैर्ार करेगी । 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करन े के जलए जनम्नजलजखत उपार् करेगी, अथाातप:- (1) भ-ू उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंजन के प्रर्ोिनों के जलए जचजन्हत दकए गए पाकों और खुल े स्ट्थानों का वाजणजज्र्क या आवासीय या औद्योजगक संबद्ध जवकास दिर्ाकलापों के जलए उपर्ोग र्ा संपररवतान नहीं होगा: परंतु यह कक पाररजस्ट्थजतकी संवेिी िोन के भीतर भाग (क) में जवजनर्िष्टा प्रर्ोिनों स े जभन्न प्रर्ोिन के जलए कृजि और अन्र् भूजम का संपररवतान स्नर्गरानी सजमजत की जसफाररि पर और र्था लागू और क्षेत्रीर् नगर र्ोिना अजधजनर्म और केन्द्रीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन स,े और इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करन े के जलए अनुज्ञात दकर्ा िाएगा, िसै :े - (i) जवद्यमान सड़कों को चौड़ा करना और उन्ह ें सुिढ़ृ करना तथा नई सड़कों का संजनमााण; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रििू ण उत्पन्न न करन े वाले लघु उद्योग; (iv) कुिीर उद्योगों जिनके अंतगात िामीण उद्योग भी ह;ैं सुजवधािनक भण्डार और स्ट्थानीर् सुजवधाए ं सहार्क पाररजस्ट्थजतकी पर्ािन स्जसके अन्तर्गात र्गहृ वास सजम्मजलत ह;ै और (v) पैरा 4 के अिीन कदए र्गए संवर्धात दिर्ाकलाप: परंतु र्ह और दक प्रादस्े शक नगर र्ोिना अजधजनर्म और राज्य सरकार के अन्र् जनर्मों और जवजनर्मों के अिीन सक्षम प्रास्िकारी के पूवा अनुमोदन और संजवधान के अनुच्छेि 244 के उपबंिों या तत्समर् प्रवृत्त जवजध के उपबंधों के अनुपालन के जबना, जिसके अन्तर्गात अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी ह,ै वाजणजज्र्क र्ा औद्योस्र्गक जवकास दिर्ाकलापों के जलए िनिातीर् भूजम का उपर्ोग अनुज्ञात नहीं होगा:6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंत ु र्ह और भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भू-अजभलेखों में उपसंिात कोई र्गलती, स्नर्गरानी सजमजत के जवचार प्राप्त करन े के पिातप राज्र् सरकार द्वारा प्रत्र्ेक मामल े में एक बार ठीक होगी और उि र्गलती के सुिार की सूचना केंद्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह और भी दक र्गलती के संिोधन में इस उप पैरा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा में भू-उपर्ोग का पररवतान सजम्मजलत नहीं होगा। (ख) वनीकरण तथा वास िीणोद्धार दिर्ाकलापों सजहत अनप्रर्ुक् त र्ा अनुत् पािक कृजि क्षेत्रों में पुन: वनीकरण करने के प्रर्ास दकए िाएगं े। (2) प्राकृजतक िल स्रोतों.- आचंजलक महार्ोिना में सभी प्राकृजतक िल स्रोतों के आवाह क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीकरण के जलए र्ोिना सजम् मजलत होगी और राज् र् सरकार द्वारा ऐसे क्षेत्रों पर र्ा उनके जनकि जवकास दिर्ाकलाप प्रजतजिद्ध करने के बारे में जो ऐसे क्षेत्रों के स्लए अस्हतकर हो ऐसी रीजत से मार्गादशाक जसद्धांत तैर्ार दकए िाएगं े । (3) पर्ािन र्ा पाररस्थिस्तकी पयटा न.- (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ािन दिर्ाकलाप र्ा जवद्यमान पर्ािन दिर्ाकलापों का जवस्ट्तार पर्ािन महार्ोिना के अनुसार पाररस्थिस्तकी संवेदी जोन के जलए होगा। (ख) पाररस्थिस्तकी पर्ािन महार्ोिना राज्र् पर्ािन जवभाग द्वारा राज्र् पर्ाावरण और वन जवभाग के परामिा से तैर्ार होगी। (ग) पर्ािन महार्ोिना आंचजलक महार्ोिना के एक घिक के रूप में होगी। (घ) पयाटन महायोजना पाररस्थिस्तकी संवेदी जोन की वहन क्षमता के आिार पर तैयार की जाएर्गी। (ङ) पाररजस्ट्थजतकी पर्ािन सबं ंधी दिर्ाकलाप जनम्नानुसार जवजनर्जमत होंगे, अिाात:् - (i) संरस्क्षत क्षेत्र की सीमा से एक दकलोमीिर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकि ह,ै नर्े वाजणजज्र्क होिल और ररजॉटा के सस्िमााण अनुज्ञात नहीं होंगे: परंतु, यह कक सरं स्क्षत क्षेत्र की सीमा से एक दकलोमीिर की िरू ी से परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक होिलों और ररजॉर्ट का स्ट्थापना केवल पूव ा पररभाजित और नामजनर्िष्टा क्षेत्रों में पर्ािन महार्ोिना के अनुसार पाररजस्ट्थजतकी पर्ािन सुजवधाओं के जलए ही अनुज्ञात होगा; (ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर नए पर्ािन दिर्ाकलापों र्ा जवद्यमान पर्िा न दिर्ाकलापों का जवस्ट्तार केंद्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् के मागाििाक जसद्धांतों के द्वारा तथा राष्र ीर् ट र्ाघ्र स संरक्षण प्राजधकरण, द्वारा िारी पाररस्थिस्तकी–पयाटन, पाररस्थिस्तकी-स्शक्षा और पाररस्थिस्तकी- स्वकास पर बल दते े हुए (समर्-समर् पर र्था संिोजधत) जारी मागाििाक जसद्धांतों के अनुसार होगा; (iii) आंचजलक महार्ोिना का अनुमोिन दकए िान े तक, पर्ािन के जलए जवकास और जवद्यमान पर्ािन दिर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्िष्टा संवीक्षा और स्नर्गरानी सजमजत की जसफाररि पर[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 आधाररत संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नर् े होिल र्ा ररजॉटा र्ा वाजणजज्र्क स्ट्थापना का संजनमााण अनुज्ञात नहीं दकर्ा िार्ेगा । (4) नसै र्गका जवरासत.- पाररजस्ट्थजतकी संवेिी िोन में महत्वपूणा नैसर्गाक जवरासत के सभी स्ट्थलों िैसे िीन कोि आरजक्षत क्षेत्र, िैल जवरचनाए,ं िल प्रपातों, झरनों, घािी मागों, उपवनों, गुफाएं, स्ट्थलों, भ्रमण, अश्वरोहण, प्रपातों आदि की पहचान की िाएगी और जवरासत सरं क्षण र्ोिना आंचजलक महार्ोिना के भाग के रुप म ें परररक्षण और संरक्षण के जलए तैर्ार की िाएगी । (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, सरं चनाओं, जिल्प-तथ्र्, ऐजतहाजसक, थिापत्य, सौंदयापूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और उपक्षेत्रों पहचान और उनके संरक्षण के जलए जवरासत र्ोिना आंचजलक महार्ोिना के भाग के रुप में तैर्ार की िाएगी। (6) ध्व जन प्रििू ण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रििू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 में जनर्त उपबंधों के अनुसार में पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रििू ण के जनर्ंत्रण और स्नवारण का अनुपालन ककया जाएर्गा। (7) वार् ु प्रििू ण.- पाररजस्ट्थजतकी संवेिी िोन में, वार् ु प्रििू ण के जनवारण और जनर्त्रं ण का वार् ु (प्रििू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार अनुपालन दकर्ा िाएगा। (8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सारण, साधारणों मानकों के उपबिं ों के अनुसार पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आन े वाल े पर्ाावरणीर् प्रििू ण के जनस्ट्सारण के जलए साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक कठोर हो, के उपबंधों के अनसु ार होगा। (9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपिान और प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपिान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् की अजधसूचना सं. का.आ. 1357(अ), तारीख 8 अप्रैल, 2016 के द्वारा प्रकाजित ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपिान पाररजस्ट्थजतकी संवेिी िोन स े बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्र् प्रौद्योजगदकर्ों का उपयोर्ग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ावा रण-अनुकूल प्रबंधन अनुज्ञात दकर्ा जा सकेर्गा। (10) िवै जचदकत्सा अपजिष्ि .- िैव जचदकत्सा अपजिष्ि का प्रबंधन जनम्नानुसार दकर्ा िाएगा.- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपिान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016 के द्वारा प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्र् प्रौद्योजगदकर्ों का उपयोर्ग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा जा सकेर्गा। (11) प्लाजस्ट्िक अपजिष्ट प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्िक अपजिष्ट प्रबंध का जनपिान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मत्रं ालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्िक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (12) सजं नमाणा और जवध्वसं अपजिष्ट प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन में सजं नमााण और जवध्वंस अपजिष्ट प्रबंध का जनपिान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसचू ना सं.सां.का.जन 317(अ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वसं प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा । (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट प्रबंध का जनपिान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत द्वारा प्रकाजित ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनसु ार दकर्ा िाएगा। (14) र्ानीर् यातायात.- यातायात की र्ानीर् गजतजवजधर्ां आवास के अनुकूल जवजनर्जमत होंगी और इस संबंध में आंचजलक महार्ोिना में जविेि उपबंध सस्ममस्लत दकए िाएगं े और आंचजलक महार्ोिना के तैर्ार होन े और राज्र् सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित होन े तक, स्नर्गरानी सजमजत सुसंर्गत अस्िस्नयमों और उसके अिीन बनाए र्गए जनर्मों और जवजनर्मों के अनुसार र्ानीर् कियाकलापों के अनुपालन को स्नर्गरानी करेगी। (15) र्ानीर् प्रििू ण.- लागू जवजधर्ों के अनुपालन में वाहन प्रििू ण का स्नवारण और जनर्ंत्रण दकर्ा िाएगा। स्ट्वच्छक ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएगं े। (16) औद्योजगक ईकाइर्ा.ं - (i) राजपत्र में इस अस्िसूचना के प्रकाशन पर या उसके पश्चात पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रिजू ित उद्योगों की स्ट्थापना की अनुमजत नहीं िी िाएगी। (ii) केन्रीय प्रदषू ण स्नयंत्रण बोर् ा द्वारा फरवरी, 2016 में जारी मार्गादशाक स्सिान्तों में उद्योर्गों के वर्गीकरण के अनुसार, जब तक कक अस्िसूचना में इस प्रकार स्वस्नर्दष्टा न हो; पाररस्थिस्तकी संवेदी जोन के भीतर केवल र्गैर-प्रदषू णकारी उद्योर्गों को अनुज्ञात ककया जाएर्गा और इसके अस्तररक्त, र्गैर-प्रदषू णकारी उद्योर्गों को बढ़ावा कदया जाएर्गा। (17) पहाड़ी ढलानों का सरं क्षण.- पहाड़ी ढलानों का सरं क्षण जनम्नानुसार होगा:- (क) आंचजलक महार्ोिना पहाड़ी ढलानों पर क्षेत्रों का संकेत होगा िहां दकसी भी संजनमााण की अनुज्ञा नहीं िी िाएगी; (ख) किाव के एक उच्च जडिी के साथ जवद्यमान खड़ी पहाड़ी ढलानों र्ा ढलानों पर दकसी भी संजनमााण की अनुज्ञा नहीं िी िाएगी ।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 4. पाररजस्ट्थजतकी सवं ेिी िोन म ें प्रजतजिद्ध और जवजनर्जमत दकए िान े वाल े पर्ाावरणीर् आकलन स्निाारण अजधसूचना, 2006 और अन्र् लागू जवजधर्ां के जिसमें वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53), सजम्मजलत ह ैं और दकर्े गर्े संिोधनों द्वारा िाजसत होंग े और नीच े िी गई सारणी में जवजनर्िष्टा रीजत में जवजनर्जमत होंग,े अथाात प :- सारणी िम स.ं दिर्ाकलाप वणना (1) (2) (3) अ. प्रजतजिद्ध दिर्ाकलाप 1. वाजणजज्र्क खनन, पत्थर उत्खनन (क) पाररजस्ट्थजतकी संवेिी िोन के अंतगात वास्ट्तजवक स्ट्थानीर् और अपघिाण इकाइर्ां । जनवाजसर्ों की घरेलू आवश्र्कताओं जिसमें मकानों के संजनमााण र्ा मरम्मत के जलए धरती को खोिना सजम्मजलत है, के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनि), पत्थर उत्खनन और अपघिाण इकाइर्ां तत्काल प्रभाव से प्रजतजिद्ध होंगी; (ख) खनन प्रचालन, 1995 की ररि र्ाजचका (जसजवल) सं. 202 में िी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामल े में माननीर् उच्चतम न्र्ार्ालर् के आदशे 4 अगस्ट्त, 2006 और 2012 की ररि र्ाजचका (जसजवल) सं. 435 में गोवा फाउंडिे न बनाम भारत संघ के मामले में तारीख 21 अप्रैल, 2014 के आििे के अनुसरण में होगा । 2. प्रििू ण (िल, वार्ु, मृिा, ध्वजन, पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान प्रििू णकारी उद्योगों का जवस्ट्तार करन े की अनुज्ञा आदि) उत्पन करने वाले उद्योगों की स्ट्थापना । नहीं होगी: परन्तु यह कक केन्रीय प्रदषू ण स्नयंत्रण बोर्ा द्वारा फरवरी, 2016 में जारी मार्ग ा दशाक स्सिान्तों में उद्योर्गों के वर्गीकरण के अनुसार जब तक कक अस्िसूचना में ऐसा स्वस्नर्दष्टा न हों, पाररस्थिस्तकी संवेदी जोन के भीतर र्गैर- प्रदषू णकारी उद्योर्गों को अनुज्ञात ककया जाएर्गा और इसके अस्तररक्त र्गैर-प्रदषू णकारी कुटीर उद्यार्गों को बढ़ावा जवस्ट् तार अनुज्ञात नहीं होगा । 7. ईंि भट्टों की स्ट्थापना करना। प्रजतजिद्ध। 8. िलावन लकड़ी का वाजणजज्र्क प्रजतजिद्ध। उपर्ोग। 9. पॉजलथीन बैग का उपर्ोग। प्रजतजिद्ध। आ. जवजनर्जमत दिर्ाकलाप 10. वाजणजज्र्क होिलों और ररसोिों की पाररजस्ट्थजतकी पर्ािन दिर्ाकलापों लघु अस्ट्थार्ी संरचनाओं स्ट्थापना । के जसवार् सरं जक्षत क्षेत्र की सीमा से एक दकलोमीिर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकि ह,ै नए वाजणजज्र्क होिल और ररसोटों को अनुज्ञात नहीं दकर्ा िाएगा: परंतु यह कक संरस्क्षत क्षेत्र की सीमा से एक ककलोमीटर के परे या पाररस्थिस्तकी संवेदी जोन के स्वथतार तक इनम ें से जो भी स्नकट हो सभी नए पर्ािन दिर्ाकलाप र्ा जवद्यमान दिर्ाकलाप का जवस्ट्तार पर्ािन महार्ोिना और र्था लागू मागाििी जसद्धांतों के अनुरुप होगा। 11. संजनमााण दिर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीिर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के स्वथतार तक, इनमें िो भी जनकि हो, दकसी भी प्रकार के नर्े वाजणजज्र्क संजनमााण की अनुज्ञा नहीं होगी: परंत ु यह कक स्ट्थानीर् लोगों को अपनी आवास सम्बन्धी जनम्नजलजखत आवश्र्कताओं को पूरा करने के जलए, पैरा 3 के उप पैरा (1) में सूचीबद्ध दिर्ाकलापों सजहत अपने उपर्ोग के जलए, अपनी भूजम में भवन उप-जवजधर्ों के अनसु ार, संजनमााण करने की अनुज्ञा होगी, जैसे: परंतु यह कक गैर–प्रििू णकारी लघ ु उद्योगों से सबं ंजधत संजनमााण दिर्ाकलाप लागू जनर्मों और जवजनर्मों, र्दि कोई[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत स े जवजनर्जमत दकए िाएगं े और वे न्र्ूनतम होंगे । (ख) एक दकलोमीिर क्षेत्र से परे ये आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे । 12. प्रििू ण उत्पन्न न करन े वाल े लघु फरवरी, 2016 म ें केन्द्रीर् प्रििू ण जनर्ंत्रण बोड ा द्वारा िारी उद्योग । उद्योगों में वगीकरण के अनसु ार गैर-प्रििू णकारी उद्योग और अपररसंकिमय में, लघु और सेवा उद्योग, कृजि, पुष्प कृजि, उद्यान कृजि र्ा पाररजस्ट्थजतकी संवेिी िोन से ििे ी सामिी स े उत्पािों को उत्पन्न करन े वाले कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे। 13. वृक्षों की किाई । (क) राज्र् सरकार में सक्षम प्राजधकारी की पूव ा अनुमजत के जबना वन, सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर र्ा वनों में वृक्षों की किाई नहीं होगी । (ख) वृक्षों की किाई संबंजधत केंद्रीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंध के अनुसार जवजनर्जमत होग े । 14. वन उत्पािों या गैर काष्ठ वन लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे । उत्पािों का संिहण । 15. जवद्युत और संचार िावरों का लागू जवजधर्ों के अधीन जवजनर्जमत होंगे (भूजमगत केबल के मार्गादशाक स्सिांतों के अनुसार ककया जाना । सड़कों का संजनमााण । 18. पर्ािन से संबंजधत अन्र् दिर्ाकलाप लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे । िैसे गमा वार्ु गुब्बारें, हले ीकाप्िर, ड्रोन, माइिोलाइिस आदि द्वारा पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से उड़ना िसै े दिर्ाकलाप करना। 19. पहाड़ी ढालों और निी तिों का लागू जवजधर्ों के अनुसार जवजनर्जमत होंग े । संरक्षण । 20. राजत्र में र्ाजनक र्ातार्ात का लागू जवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए संचलन । जवजनर्जमत । 21. स्ट्थानीर् समुिार्ों द्वारा चल रही स्ट्थानीर् लोगों के उपर्ोग के जलए लाग ू जवजधर्ों के अधीन कृजि और बागवानी प्रथाओं के साथ जलए लाग ू जवजधर्ों के अधीन जवजनर्जमत (अन्र्था प्रिान दकए गए) होंग े । वाजणजज्र्क पिुओं और कुक्कुट फामों की स्ट्थापना । 23. प्राकृजतक िल जनकार्ों र्ा सतही जल स्नकायों में उपचाररत अपस्शष्ट जल या बजहस्रााव के क्षेत्र में उपचाररत बजहस्रााव का स्नथसारण से बचा िाएगा और उपचाररत अपजिष्ट िल के स्नथतारण । पुन:चिण और पुन:उपर्ोग के जलए प्रर्ास दकए िाएगं े। अन्र्था लागू जवजधर्ों के अनुसार उपचाररत बजहस्रावा के पुनचािण या प्रवाह के जनवाहन को जवजनर्जमत दकर्ा िाएगा। 24. सतही और भूिल का वाजणजज्र्क लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे । जनष्किाण । 25. ठोस अपजिष्ट का प्रबन्धन। लागू जवजधर्ों के AND WHEREAS, major bird species recorded from the Chaprala Wildlife Sanctuary are little grebe(Podiceps ruficollis), painted stork (Mycteria leucocephala), openbill stork (Anastomus oscitans) little cormorant (Phalacrocorax niger ), little egret (Egretta garzetta ), grey heron (Ardea cinerea ), Indian shikra (Accipiter badius), grey junglefowl (Gallus sonneratii), black-winged kite (Elanus caeruleus) , common teal (Anas crecca), brahminy kite (Haliastur indus), red-naped ibis (Pseudibis papillosa), sarus crane (Antigone antigone), pheasant-tailed jacana (Hydrophasianus chirurgus), white-breasted waterhen (Amaurornis phoenicurus), stone- curlew (Burhinusoedicnemus) , common kingfisher (Alcedo atthis), house swift (Apus nipalensis), green bee-eater (Merops orientalis), Blossom-headed Parakeets (Psittacula roseata), great hornbill (Buceros bicornis), crested lark (Galerida cristata), golden oriole (Oriolus kundoo), tailorbird (Orthotomus sutorius), green munia (Amandava formosa), house sparrow (Passer domesticus), Indian spot-billed duck (Anas poecilorhyncha), osprey (Pandion haliaetus), great horned owl (Bubo virginianus), bluethroat (Luscinia svecica), yellow-footed green pigeon (Treron phoenicoptera), glossy ibis (Plegadis falcinellus), black-tailed godwit (Limosa limosa) common kestrel (Falco tinnunculus), glossy ibis (Plegadis falcinellus), yellow wagtail (Motacilla flava), baya weaver (Ploceus philippinus), magpie-robin (Copsychus saularis), etc; AND WHEREAS, rohu (Labeo rohita), bum (Anguilla anguilla), catla (Catlacatla),katva (Rita rita), magur (Clarias batrachus), patola (Notopoterus chitala), etc. are the freshwater fishes found in the Chaprala Wildlife Sanctuary; AND WHEREAS, the species of butterflies and moths available in the Chaprala Wildlife Sanctuary are spot sword tail, tailed jay, blue mormon, common mime, psyche, yellow orange trip, Indian cabbage white, the pioneer, lemon emigrant, common acacia blue, zebra blue, common cerulean, pale grass blue, the common bush brown, common hedge blue, dark band bush brown, dark evening brown, nigger, baronet, black rajah, tabby, grey pansy, angled castor, danaid egg fly, common tiger, glassy tiger, dark palm dart, grass demon, blank swift, etc; AND WHEREAS, the extremely close vicinity of the above-mentioned Sanctuary to human habitation and ongoing developmental activities, necessitate the requirement of proper safeguards and control over such activities; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Chaprala Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act)read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from zero to 5.0 kilometres around the boundary of Chaprala Wildlife Sanctuary, in Gadchiroli districts in the State of Maharashtra as the Chaprala Wildlife Sanctuary Eco-sensitive Zone (hereafterin this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of the Eco-sensitive Zone. – (1)The Eco-sensitive Zone shall be to an extent of zero to 5.0 kilometresaround the boundary of Chaprala Wildlife Sanctuaryand the area of the Eco-sensitive Zone is 166.55square kilometres. (The Eco-sensitive Zone on Western side of the Sanctuary is kept zero due to Pranhita River and Telangana State Border and on South-Western side is due to village area of Ashti and Yellur. Thereafter, Cainganga River flows along the boundary of these villages). (2) The boundary description of Chaprala Wildlife Sanctuaryand its Eco-sensitive Zone is appended in Annexure-I. (3) The maps of the Chaprala Wildlife Sanctuary demarcating the Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB and Annexure-IIC.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) Lists of geo-coordinates of the boundary of Chaprala Wildlife Sanctuaryand the Eco-sensitive Zone are given in Table A and Table B of Annexure III. (5) The list of villages falling in the proposed Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV. 2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Eco- sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority of State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue; (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayati Raj; (xi) Public Works Department; and (xii) Maharashtra State Pollution Control Board. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including home stay; and (v) promoted activities given under paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism.-(a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.-Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. -Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.-Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.-Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes.-Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (10) Bio-Medical Waste.–Bio-Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016. (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.-The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.-The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.-Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 25 (16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within the Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction shall not be permitted on existing steep hill slopes or slopes with a high degree of erosion. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco- sensitive Zone shall be governed by the provisions of the Environment (Protection) Act,1986 and the rules made thereunder including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act, 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. Setting of industries causing pollution New industries and expansion of existing polluting industries (Water, Air, Soil, Noise, etc.). in the Eco-sensitive Zone shall not be permitted: Provided that non-polluting industries shall be allowed within the Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this notification and in addition the non-polluting cottage industries shall be promoted. 3. Establishment of major hydro-electric Prohibited. project. Prohibited. 4. Use or production or processing of any hazardous substances. Prohibited. 5. Discharge of untreated effluents in natural water bodies or land area. 6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents. Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 12. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco- sensitive Zone shall be permitted by the competent Authority. 13. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. 14. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.-For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S N Constituent of the Monitoring Committee Designation (i) The District Collector , Gadchiroli Chairman, ex- officio; (ii) A representative of Non-governmental Organisation working in the field of Member; wildlife conservation to be nominated by the State Government (iii) A representative of the Department of Environment, Government of Member; Maharashtra (iv) A representative of the Town Planning Office, Gadchiroli Member; (v) One expert in Ecology and Environment from reputed institution or university Member; of the State (vi) One member of State Biodiversity Board Member; (vii) Regional Officer, Maharashtra State pollution Control Board, Mumbai Member; (viii) A representative each of Revenue/ Police/P.W.D./ Industries /Water Member; resources/urban development & Rural development of Government of Maharashtra (ix) Sub Divisional Forest Officer (Wildlife), Allapalli Member; (x) Divisional Manager, Markhanda Forest Development Corporation of Member; Maharashtra Limited (FDCM) (xi) The Deputy Conservator of Forests (Territorial), Allapalli Member-Secretary. 6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure-V. Then bends to the North Eastern direction up to Umari and Kanholi village boundary junction point of Southern site. Then it bends towards north to the C. No. 188 and then continues towards C.
