औऔऔऔरररर,,,, राAीय उBान के चार/ ओर बढ़ता मानव आवास, चल रही िवकास प!रयोजनाए ं और खनन (cid:4)Xयाकलाप/ को
बढ़ाना, दीघक(cid:28) ािलक व3यजीव संर9ण को दखे त े @ए उिचत सरु 9ा उपाय/ क% आवKयकता और इस तरह के (cid:4)Xयाकलाप/ पर
िनयं$ण रखना आवKयक ह;ै
औऔऔऔरररर,,,, गंगो$ी राAीय उBान और के चार/ ओर के 9े$ को, िजसका िवDतार और सीमा[ इस अिधसचू ना के पैरा 1 म (
िविन\द5 ह,P पया(cid:28)वरण क% दिृ5 स े पा!रिDथितक% संवेदी जोन के <प म ( सुरि9त और सरं ि9त करना और उ. पा!रिDथितक%
संवेदी जोन म (उBोग/ या उBोग/ के वग] के (cid:13)चालन और (cid:13)सDं करण करन ेको (cid:13)ितिष_ करना आवKयक ह;ै

पया(cid:28)वरण (सरं 9ण) अिधिनयम, 1986 (1986 का 29) क% धारा 3 क% उपधारा (1) और उपधारा (2) के खंड (v) और खंड
(xiv) और उपधारा (3) ’ारा (cid:13)द> शि.य/ का (cid:13)योग करत े @ए, उ>राखंड राCय म ( गंगो$ी राAीय उBान क% सीमा के चार/
ओर शू3य (cid:4)कलोमीटर स े 10 (cid:4)कलोमीटर तक िवDता!रत 9े$ को गंगो$ी राAीय उBान पा!रिDथितक% संवेदी जोन (िजस ेइसम (
इसके पKच ात ्पा!रिDथितक% सवं ेदी जोन कहा गया है) के <प म (अिधसूिचत करती ह,ै िजसके 6यौरे िनjानुसार ह,ै अथा(cid:28)त ्:--

(2) उप-बेिसन सीमाp, केदारनाथ !टहरी, उ>रकाशी और गंगो$ी राAीय उBान सीमाp, महQवपूण(cid:28) Dथान/ और
भागीरथी नदी क% मुIय सहायक न(cid:4)दय/ के साथ पा!रिDथितक% संवेदी जोन सीमा का मानिच$ उउउउपपपपााााबबबबधधंंधधंं IIII म ((cid:4)दया गया ह।ै

िलए राजप$ म ( इस अिधसूचना के (cid:13)काशन क% तारीख स े दो वष(cid:28) क% अविध के भीतर, Dथानीय -ि.य/ के परामश(cid:28) स ेऔर
राCय के स9म (cid:13)ािधकारी के अनुमोदन के िलए इस अिधसूचना म ((cid:4)दए गए अनुबंध/ का पालन करत े@ए आचं िलक महायोजना

(2) राCय सरकार ’ारा पा!रिDथितक% संवदे ी जोन के िलए आचिं लक महायोजना ऐसी रीित से जो इस अिधसूचना म (
िविन\दSट (cid:4)कए गए ह P के अनुसार तथा ससु ंगत क(aीय और राC य िविधय/ के अन(cid:15)ु प और क(aीय सरकार ’ारा जारी
माग(cid:28)िनदशq /, य(cid:4)द कोई ह/, ’ारा तैयार होगी ।
(3) आंचिलक महायोजना, उ. योजना म ( पा!रिDथितक% और पया(cid:28)वरणीय बात/ को समाकिलत करन े के िलए राC य सरकार
के िनjिलिखत िवभाग/ के परामश (cid:28)से तैयार होगी, अथा(cid:28)त:्--
(i) पया(cid:28)वरण,
(ii) वन और व3यजीव,
(iii) कृिष और बागवानी,
(iv) राजDव ,
(v) शहरी िवकास,
(vi) पा!रिDथितक% पय(cid:28)टन सिहत पय(cid:28)टन,
(vii) sामीण िवकास,
(viii) vसचाई और बाढ़ िनयं$ण,
(ix) नगरपािलका और शहरी िवकास,
(x) पंचायती राज,
(xi) लोक िन मा(cid:28)ण िवभ ाग।
(4) आंचिलक महायोजना अनुमो(cid:4)दत िवBमान भ-ू उपयोग, अवसंरचना और (cid:4)Xयाकलाप/ पर कोई िनबधw न अिधरोिपत नह=
करेगी जब तक (cid:4)क इस अिधसूचना म( इस (cid:13)कार िविन\दS ट न हो और आचिं लक महायोजना सभी अवसरं चना और
(cid:4)Xयाकलाप/ म( जो अिधक द9ता और पा!रिDथितक% अनकु ूल ह/ का संवध(cid:28)न करेगी ।
(5) आंचिलक महायोजना म ( अनाGछा(cid:4)दत 9े$/ के जीण]_ार, िवBमान जल िनकाय/ के संर9ण, आवाह 9े$/ के (cid:13)बंधन,
जल-सभं र/ के (cid:13)बंधन, भूतल जल के (cid:13)बंधन, मदृ ा और नमी सरं 9ण, Dथानीय समुदाय/ क% आवKयकताp तथा पा!रिDथितक%
और पया(cid:28)वरण से संबंिधत ऐस ेअ3य पहलpु , िजन पर xयान दने ा आवKयक ह,ै के िलए उपबंध ह/गे ।
(6) आंचिलक महायोजना िवBमान और (cid:13)Dतािवत भिू म उपयोग िवशेषताp के 6यौर/ स े अनुसम4थत मानिच$ के साथ सभी
िवBमान पूजा Dथ ल/, sाम/ और नगरीय बिDतय/, वन/ के (cid:13)कार और (cid:4)कDम /, कृिष 9े$/, ऊपजाऊ भिू म, ह!रत 9े$ जैस े
उBान और उसी (cid:13)कार के Dथ ान, उBान कृिष 9े$, फलोउBान, झील/ और अ3य जल िनकाय/ का अzयकंन करेगी।
(7) आंचिलक महायोजना पा!रिDथितक% संवेदी जोन म( िवकास को िविनयिमत करेगी और सारणी म (सूचीब_ पैराsाफ-4 म (
(cid:13)ितिष_ और िविनयिमत (cid:4)Xयाकलाप/ का अनपु ालन करेगी और Dथ ानीय समदु ाय/ क% जीिवका को सरु ि9त करन े के िलए
पा!रिDथितक% अनकु ूल िवकास को सिु निkत और उसक% अिभवृि_ भी करेगी।
(8) आंचिलक महायोजना (cid:13)ादिे शक िवकास योजना क% सह िवDतारी होगी ।
(9) इस (cid:13)कार अनमु ो(cid:4)दत आंचिलक महायोजना इस अिधसूचना के उपबंध/ के अनसु ार मानीटरी के अपने काय{ को करने के
िलए मानीटर सिमित के िलए एक संदभ (cid:28)दDतावेज तैयार करेगी ।
(10) उ. महायोजना पा!रिDथितक% संवेदी जोन म ( िवकास को इस (cid:13)कार िविनयिमत करेगी िजससे Dथानीय समुदाय/ क%

3. रररराााा(cid:26)(cid:26)(cid:26)(cid:26)यययय ससससररररककककाााारररर (cid:27)(cid:27)(cid:27)(cid:27)ाााारररराााा (cid:28)(cid:28)(cid:28)(cid:28)ककककएएएए जजजजाााानननन ेे ेे ववववाााालललल ेे ेे उउउउपपपपाााायययय....---- राCय सरकार इस अिधसूचना के उपबंध/ को (cid:13)भावी करन े के िलए
िनjिलिखत उपाय करेगी, अथा(cid:28)त:्-
(1) भभभभ---ूू-ूू उउउउपपपपययययोोोोगगगग....–––– (क) पा!रिDथितक% संवेदी जोन म ( वन/, बागवानी 9े$/, कृिष 9े$/, मनोरंजन के (cid:13)योजन/ के िलए िचि3हत
(cid:4)कए गए पाक{ और खुल े Dथान/ का वािणिCयक या आवासीय या औBोिगक संब_ िवकास (cid:4)Xयाकलाप/ के िलए उपयोग या
संप!रवतन(cid:28) नह= होगा:
परंत ु यह (cid:4)क पा!रिDथितक% सवं ेदी जोन के भीतर भाग (क), म( िविन\द5 (cid:13)योजन/ से िभL (cid:13)योजन के िलए कृिष और अ3य
भिू म का संप!रवतन(cid:28) मानीटरी सिमित क% िसफा!रश पर और यथा लागू और 9े$ीय नगर योजना अिधिनयम और
के3aीय/राCय सरकार के अ3य िनयम/ तथा िविनयम/ के अधीन स9म (cid:13)ािधकारी के पूव(cid:28) अनमु ोदन स,े और इस अिधसूचना के
उपबंध/ ’ारा Dथानीय िनवािसय/ क% िनjिलिखत आवासीय ज<रत/ को पूरा करन ेके िलए अनु}ात (cid:4)कया जाएगा, जैस:े-
(i) िवBमान सड़क/ को चौड़ा करना और उ3ह (सुदढृ करना तथा नई सड़क/ का सिं नमा(cid:28)ण;
(ii) बुिनयादी ढांच/ और नाग!रक सुिवधाp का सिं नमाण(cid:28) और नवीकरण;
(iii) (cid:13)दषू ण उQपL न करन ेवाल ेलघ ुउBोग;
(iv) कुटीर उBोग/ िजनके अतं ग(cid:28)त sामीण उBोग भी ह;P सिु वधाजनक भnडार और Dथानीय सिु वधाए ं सहायक पा!रिDथितक%
पय(cid:28)टन िजसके अ3तग(cid:28)त sह वास सि(cid:127)मिलत ह;ै और
(v) पैरा 4 के अधीन (cid:4)दए गए संव4धत (cid:4)Xयाकलाप:
परंत ु यह और (cid:4)क (cid:13)ादिे शक नगर योजना अिधिनयम और राCय सरकार के अ3य िनयम/ और िविनयम/ के अधीन
स9म (cid:13)ािधकारी के पूव(cid:28) अनमु ोदन और सिं वधान के अनुGछेद 244 के उपबंध/ या तQसमय (cid:13)वृ> िविध के उपबधं / के अनपु ालन
के िबना, िजसके अ3तग(cid:28)त अनसु िू चत जनजाित और अ3य परंपरागत वन िनवासी (वन अिधकार/ क% मा3यता) अिधिनयम,
2006 (2007 का 2) भी ह,ै वािणिCयक या औBोिगक िवकास (cid:4)Xयाकलाप/ के िलए जनजातीय भिू म का उपयोग अनु}ात
नह= होगा:
परंत ु यह और भी (cid:4)क पा!रिDथितक% संवेदी जोन के भीतर भ-ू अिभलेख/ म ( उपसंजात कोई गलती, िनगरानी सिमित के
िवचार (cid:13)ा? करन े के पkात ् राCय सरकार ’ारा (cid:13)Qयके मामल े म ( एक बार ठीक होगी और उ. गलती के सुधार क% सूचना
क(aीय सरकार के पया(cid:28)वरण, वन और जलवाय ुप!रवत(cid:28)न मं$ालय को दी जाएगी:
परंत ुयह और भी (cid:4)क गलती के संशोधन म (इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:4)कसी भी दशा म (भू-उपयोग का
प!रवतन(cid:28) सि(cid:127)मिलत नह= होगा।
(ख) वनीकरण तथा वास जीण]_ार (cid:4)Xयाकलाप/ सिहत अन(cid:13)युO त या अनQु पादक कृिष 9े$/ म( पनु : वनीकरण करने के (cid:13)यास
(cid:4)कए जाएंगे ।
(2) (cid:30)(cid:30)(cid:30)(cid:30)ााााककककृृृृििििततततकककक जजजजलललल ोोोोतततत""""....- आचंिलक महायोजना म ( सभी (cid:13)ाकृितक जल (cid:130)ोत/ के आवाह 9े$/ क% पहचान क% जाएगी और
उनके संर9ण और नवीकरण के िलए योजना सि(cid:127) मिलत होगी और राC य सरकार ’ारा ऐसे 9$े / पर या उनके िनकट िवकास
(cid:4)Xयाकलाप (cid:13)ितिष_ करने के बारे म (जो ऐस े9े$/ के िलए अिहतकर हो ऐसी रीित से माग(cid:28)दशक(cid:28) िसदांत तैयार (cid:4)कए जाएगं े ।
(3) पपपपययययटट(cid:4)(cid:4)टट(cid:4)(cid:4) नननन अअअअथथथथववववाााा पपपपाााा(cid:14)(cid:14)(cid:14)(cid:14)ररररिििि(cid:20)(cid:20)(cid:20)(cid:20)थथथथििििततततकककक(cid:23)(cid:23)(cid:23)(cid:23) पपपपययययटट(cid:4)(cid:4)टट(cid:4)(cid:4) नननन....---- (क) पा!रिDथितक% संवेदी जोन के भीतर सभी नए पा!रिDथितक% पय(cid:28)टन
(cid:4)Xयाकलाप या िवBमान पय(cid:28)टन (cid:4)Xयाकलाप/ का िवDतार पय(cid:28)टन महायोजना के अनसु ार पा!रिDथितक% संवेदी जोन के िलए
होगा ।
(ख) पा!रिDथितक% पय(cid:28)टन महायोजना राCय पय(cid:28)टन िवभाग ’ारा राCय पया(cid:28)वरण और वन िवभाग के परामश(cid:28) स ेतैयार होगी ।¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(ग) पय(cid:28)टन महायोजना आंचिलक महायोजना के एक घटक के <प म (होगी ।
(घ) पा!रिDथितक% पय(cid:28)टन संबधं ी (cid:4)Xयाकलाप िनjिलिखत के अधीन िविनयिमत ह/गे, अथा(cid:28)त ्:-
(i) राAीय उBान क% सीमा से एक (cid:4)कलोमीटर के भीतर या पा!रिDथितक% संवेदी जोन के िवDतार तक, इनम( जो भी िनकट ह,ै
नये वािणिCयक होटल और !रसोट(cid:28) के सिLमाण(cid:28) अनु}ात नह= ह/ग:े
परंतु, यह (cid:4)क राAीय उBान क% सीमा से एक (cid:4)कलोमीटर क% दरू ी स े परे पा!रिDथितक% सवं ेदी जोन के िवDतार तक होटल/
और !रसोट{ का Dथापन केवल पूव(cid:28) प!रभािषत और नामिन\द5 9े$/ म ( पय(cid:28)टन महायोजना के अनसु ार पा!रिDथितक% पय(cid:28)टन
सुिवधाp के िलए ही अनु}ात होगा;
(ii) पा!रिDथितक% संवेदी जोन के भीतर नए पय(cid:28)टन (cid:4)Xयाकलाप/ या िवBमान पय(cid:28)टन (cid:4)Xयाकलाप/ का िवDतार क(aीय
सरकार के पया(cid:28)वरण, वन और जलवाय ु प!रवत(cid:28)न मं$ालय के माग(cid:28)दशक(cid:28) िस_ांत/ के ’ारा तथा राS (cid:131)ीय (cid:132) या(cid:133) संर9ण
(cid:13)ािधकरण, ’ारा जारी पा!रिDथितक% पय(cid:28)टन पर बल देते @ए (समय-समय पर यथा सशं ोिधत) जारी माग(cid:28)दश(cid:28)क िस_ातं / के
अनसु ार होगा;
(iii) आंचिलक महायोजना का अनमु ोदन (cid:4)कए जान ेतक, पय(cid:28)टन के िलए िवकास और िवBमान पय(cid:28)टन (cid:4)Xयाकलाप/ के िवDतार

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE
NOTIFICATION
New Delhi, the 7th June, 2019
S.O. 1927(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide
notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 1727
(E), dated the16th April, 2018, inviting objections and suggestions from all persons likely to be affected thereby within
the period of sixty days from the date on which copies of the Gazette containing the said notification were made available
to the public;
AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public
on dated the 24th April, 2018;
AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to
the draft notification;
AND WHEREAS, the Gangotri National Park is situated in Uttarkashi District of Uttarakhand State. Gangotri
National Park was created on the 16th September, 1989 and covers an area of 2390.02 square kilometers. The Holy River
Ganga also originates from this National Park. The main objective of forming Gangotri National Park is to protect and
conserve various species of flora and fauna;18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
AND WHEREAS, Gangotri National Park is home to many endangered species of flora and fauna. Some of the
endangered species found in the National Park are Musk Deer (Moschus sp.), Himalayan Thar (Hemitragus jemlahicus),
Blue Sheep (Pseudois nayaur), Serow (Capricornis sp.), Snow Leopard (Panthera uncia), Himalayan Brown Bear
(Ursus arctos isabellinus), Himalayan Black Bear (Ursus thibetanus laniger), Himalayan Snow Cock (Tetraogallus
himalayensis), Monal (Lophophorus sp.), Koklas (Pucrasia macrolopha), etc. There are 37 magnificent peaks inside the
National Park. Gomukh, the holy Glacier of the origin of the river Ganga in also inside the National Park;
AND WHEREAS, Gangotri National Park is surrounded by northern temperate dry deciduous and coniferous
forest which supports a large bio-diversity;
AND WHEREAS, increasing human habitation, ongoing developmental projects, and mining activities around
the National Park, necessitate the requirement of proper safeguards and control over such activities in view of long term
wildlife conservation;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of the Gangotri
National Park which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and bio-diversity
point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive
Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-
section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this
notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules,
1986, the Central Government hereby notifies an area with an extent varying from Zero kilometers to 10 kilometers
around the boundary of Gangotri National Park in the State of Uttarakhand as Gangotri National Park Eco-sensitive Zone
(hereafter in this notification referred to as the Eco-Sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone is bounded by 31°04'11.495"N
latitude and 79°24'59.584"E longitude towards east; 79°50'30.130"E longitude and 31°7'54.646"N latitude towards north;.
30°51'30.018"N latitude and 78°43’6.514"E longitude towards west and 30°44'58.107"N latitude and 79°17 '26.661"E
longitude towards south. The area of Gangotri Nagar Panchayat (14.415 Ha.) has been kept as Special Eco-Sensitive
Zone. The extent of Eco-sensitive Zone varies from Zero kilometers to 10 kilometers around the Gangotri National Park.
Zero extent is towards the Northern side having interstate boundary with Himachal Pradesh that extends upto
international boundary with China. Zero extent is also towards Southern side adjoining Kedarnath Wildlife Sanctuary.
The area of the Eco-Sensitive Zone is 1103.08 square kilometers.
(2) The map of the Eco-sensitive Zone boundary together with sub-basin boundaries, Kedarnath, Tehri, Uttarkashi and
Gangotri National Parks boundaries, important places, and major tributaries of Bhagirathi River is at Annexure I.
(3) The list of geo co-ordinates of the boundary of the Protected Area and the Eco-Sensitive Zone is at Annexure I (A)
and I (B) respectively.
(4) The boundary description of the Eco-Sensitive Zone is appended as Annexure II.
(5) The list of villages within Gangotri National Park Eco-sensitive zone is appended as Annexure III.
2. Zonal Master Plan for Eco-Sensitive Zone. - (1) The State Government shall, for the purposes of the Eco-Sensitive
Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the
Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval
of the Competent authority of State.
(2) The Zonal Master Plan for the Eco-Sensitive Zone shall be prepared by the State Government in such manner as is
specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by
the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for
integrating the ecological and environmental considerations into the said plan:-
(i) Environment,
(ii) Forest and Wildlife,
(iii) Agriculture and Horticulture,
(iv) Revenue,
(v) Urban Development,
(vi) Tourism including eco-tourism,
(vii) Rural Development,
(viii) Irrigation and Flood Control,
(ix) Municipal and Urban Development,
(x) Panchayati Raj,¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19
(xi) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and
activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all
infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture conservation,
needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and
kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards,
lakes and other water bodies and also with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-Sensitive Zone and adhere to prohibited, regulated
activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for Security of local
communities livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out
its functions of monitoring in accordance with the provisions of this notification.
(10) The said Master Plan shall regulate development in Eco-Sensitive Zone so as to ensure eco-friendly development for
Security of local communities livelihood.
3. Measures to be taken by the State Government.- The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Land use. – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational
purposes in the Eco-Sensitive Zone shall not be used or converted into areas for commercial or residential or
industrial activities:
Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a),
within the Eco-Sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with
the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations
of Central Government or State Government as applicable and vide provisions of this Notification, to meet the
residential needs of the local residents and for activities such as:-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-
tourism including home stay; and
(v) promoted activities given under paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the competent authority under Regional Town Planning Act and other
rules and regulations of the State Government and without compliance of the provisions of article 244 of the
Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest
Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-Sensitive Zone shall be corrected by
the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction
of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate
Change:
Provided also that the correction of error shall not include change of land use in any case except as provided
under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat
restoration activities;
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their
conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn
up by the State Government in such a manner as to prohibit development activities at or near these areas which
are detrimental to such areas.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within
the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-Sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with
State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometres from the boundary of
the Wildlife Sanctuary or upto the extent of the Eco-Sensitive zone whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the Wildlife Sanctuary till the
extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in
pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone
shall be in accordance with the guidelines issued by the Central Government in the Ministry of
Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger
Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism
activities shall be permitted by the concerned regulatory authorities based on the actual site specific
scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial
establishment construction shall be permitted within Eco-Sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-Sensitive Zone, such as the gene pool
reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be
identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of
the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be indentified in the Eco-Sensitive Zone and heritage conservation plan
for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution. - Prevention and control of noise pollution in the Eco-Sensitive Zone shall be complied with in
accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the
Environment Act.
(7) Air pollution.- Prevention and control of air pollution in the Eco-Sensitive Zone shall be complied with in
accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the
rules made thereunder.
(8) Discharge of effluents. - Discharge of treated effluent in Eco-Sensitive Zone shall be in accordance with the
provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment
Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes. - Disposal and management of solid wastes shall be as under:-
(i) the solid waste disposal and management in the Eco-Sensitive Zone shall be carried out in accordance with
the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of
Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016;
the inorganic material may be disposed in an environmental acceptable manner at site identified outside the
Eco-Sensitive Zone.
(ii) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and
regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-Medical Waste. – Bio-Medical Waste Management shall be as under-
(a) the Bio-Medical Waste disposal in the Eco-Sensitive Zone shall be carried out in accordance with the Bio-
Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21
Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March,
2016.
(b) safe and Environmentally Sound Management (ESM) of Bio-Medical Wastes in conformity with the
existing rules and regulations using identified technologies may be allowed within the Eco-Sensitive Zone.
(11) Plastic Waste Management. - The Plastic Waste Management in the Eco-Sensitive Zone shall be carried out
as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in
the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the
18th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management. - The Construction and Demolition Waste Management
in the Eco-Sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste
Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and
Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to
time.
(13) E-Waste. - The E-Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of
the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment,
Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and
specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal
Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring
Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and
regulations made thereunder.
(15) Vehicular pollution. - Prevention and control of vehicular pollution shall be incompliance with applicable laws
and efforts shall be made for use of cleaner fuel like CNG, LPG, etc.
(16) Industrial units. – (a) On or after the publication of this notification in the Official Gazette, no new polluting
industries shall be permitted to be set up within the Eco-Sensitive Zone.
(b) Only non-polluting industries shall be allowed within Eco-Sensitive Zone as per the classification of
Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified
in this notification and in addition, the non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes. - The protection of hill slopes shall be as under:-
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) Construction shall not be permitted on existing steep hill slopes or slopes with a high degree of erosion.
(18) The Central Government and the State Government shall specify other additional measures, if it considers
necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated within the Eco-Sensitive Zone.- All activities in the Eco-
Sensitive Zone shall be governed by the provisions of the Environment Act and the rules made thereunder
including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and
other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927
(16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated
in the manner specified in the Table below, namely:-

Provided that, local people shall be permitted to undertake
construction in their land for their use including the activities listed
in sub-paragraph (1) of paragraph 3 as per building bye-laws to
meet the residential needs of the local residents, such as:-
(i) widening and strengthening of existing roads and construction
of new roads;
(ii) construction and renovation of infrastructure and civic
amenities;
(iii) small scale industries not causing pollution as per the
classification done by the Central Pollution Control Board;
(iv) cottage industries including village industries; convenience
stores and local amenities supporting eco-tourism including
homestays; and
(v) promoted activities listed in this notification:
Provided that the construction activity related to small scale
industries not causing pollution shall be regulated and kept at the
minimum, with the prior permission from the competent authority
as per applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the Zonal Master
Plan.

5. Monitoring Committee for Monitoring the Eco-Sensitive Zone Notification. - For effective monitoring of
the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986,
the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely: -
(1) District Magistrate, Uttarkashi -Chairman, ex-officio
(2) A representative nominated by the Forest and Environment Department of Uttarakhand -Member,¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 25
(3) One representative of non-Governmental Organisation (working in the field of environment including
heritage conservation) to be nominated by the State Government - Member,
(4) Representative, Uttarakhand Environment Protection and Pollution Control Board -Member,
(5) An expert in Biodiversity to be nominated by the State Government -Member,
(6) An expert in Ecology and environment to be nominated by the State Government -Member,
(7) Deputy Director, Gangotri National Park, Uttarkashi - Member-Secretary.
6. Terms of Reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this
notification.
(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by
the State Government and subsequently the Monitoring Committee shall be constituted by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-
sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be
scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central
Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the
provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-
sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be
scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned
regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent
to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this
notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from
industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to
issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every
year by the 30th June of that year to the Chief Wildlife Warden in the State as per performa given in Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it
deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this notification.
8. The provisions of this notification are subject to the orders, if any passed or to be passed by the Hon’ble Supreme
Court of India or the High Court or the National Green Tribunal.

North: State Boundary with Himachal Pradesh extending up to International Boundary with China.
South: Boundary with Gangi block of Tehri Forest Division, Kedarnath Forest Division & Nanda Devi Biosphere
Reserve.
East: Starting from Peak at 7138m moving to the un-named peak at 6275m to 5501m to 4820m to 5244m to reach the
junction of Satopanth Bank Glacier with Bhagirathi Glacier and then climbing up to the peak at 5288m (Pawegarh Peak)¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 29
to 5594 m to 5918m to 6180 m to 6352 m to 6193 m to 5430 m and then climbing down to Arwa Nadi before reaching
the peak at 5919m. From here the boundary travels along various un-named peaks at 6052m , 5835m, 5584m, 5728m,
5764m, 6324m until the international boundary.
West: Block boundary of Pilang, Bhuki, Hurri Jalari, Dharali, Gangotri, Patangani, Jangala, Harsil and Karchha Block of
Uttarkashi Forest Division.
