जी.ओ. एमएस. सं. 999 वन और मत्स्ट्य पालन जवभाग तारीख 6 मइ, 1980 को सथ्यामंगलम और आरोड संभागों में तत्कालीन कोयमबटूर ईत्तर संभाग को जवभाजजत दकया गया ह।ै वन्यजीव (संरक्षण) ऄजधजनयम,1972 की धारा 26(ए) के अच्छाददत क्षेत्र को सथ्यामंगलम बाघ ररज़वा घोजित दकया गया और तत्पश्चात् जी.ओ. एमएस. सं. 93 पयाावरण और वन (एफअर V) जवभाग तारीख 11 ऄगस्ट्त, 2011 को 887.26 वगा दकलोमीटर के क्षेत्रफल को सथ्यामंगलम वन्यजीव ऄभयारण्य से जोडा गया, जो दक 1411.60 वगा दकलोमीटर का जवस्ट्तार कुल क्षेत्रफल बनाता ह।ै जी.ओ. एमएस. सं. 41 पयाावरण और वन, एफअर 5 जवभाग तारीख 15 माचा, 2013 के ऄनुसार सथ्यामंगलम वन्यजीव ऄभयारण्य में ररज़वा वन 1408.405 वगा दकलोमीटर का जवस्ट्तार कोर के रूप में 793.49331 वगा दकलोमीटर और बफर क्षेत्र के रूप म ें 614.91210 वगा दकलोमीटर के साथ सथ्यामंगलम बाघ ररज़वा घोजित दकया गया ह,ै जबदक वन व्यवस्ट्था क्षेत्र 3.20399 वगा दकलोमीटर जोडा गया, जो दक 1411.60 वग ादकलोमीटर का कुल क्षेत्रफल बनाता है; और, सथ्यामंगलम बाघ ररज़वा जलवायु पररजस्ट्थजतयों के व्यापक रेंज के कारण पयाावासों के जविमरूप मोज़ेक जैसे समतल भूजम पर झाडीदार और तटीय वन, ढलानों और पहाडी पठार पर पणापाती और जमजित पणापाती, पहाजडयों पर ईच्च ईन्नताि सावना और पहाडी ढलानों के बीच ऄध ा सदाबहार पैच स े समृद्ध ह।ै सथ्यामंगलम बाघ ररज़व ा के मुख्य जोडता ह।ै यह बाघ ररज़वा दो मुख्य भू-दश्ृ य ऄथाात ् पजश्चमी घाट और पूवी घाट के बीच सेतु का काया करता ह ै जो बाघ के जलए बृहत् क्षेत्र सुजनजश्चत करता ह ै और आस प्रकार मेटा जनसंख्या के बीच जीन के अदान-प्रदान के माध्यम स ेदीघाकाजलक संरक्षण ईपाय को बढाता ह;ै और, सथ्यामंगलम बाघ ररज़वा के चारों ओर के क्षेत्र को, जजसका जवस्ट्तार और सीमाए ं पाररजस्ट्थजतकी पयाावरणीय स े पाररजस्ट्थजतकी संवेदी जोन के रूप में पैरा 1 में जवजनर्ददष्ट ह,ैं जैव जवजवजधता की दजृ ष्ट सरु जक्षत और संरजक्षत करना और ईि पाररजस्ट्थजतकी संवेदी जोन में ईद्योगों या ईद्योगों के वगों के प्रचालन और प्रसंस्ट्करण करन े को प्रजतजिद्ध करना अवश्यक ह;ै ऄतः, ऄब, केन्रीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के साथ परठत पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) (जजसे आस ऄजधसूचना में आसके पश्चात पयाावरण ऄजधजनयम कहा गया ह)ै की4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] धारा 3 की ईपधारा (1) और ईपधारा (2) के खंड (v) और खंड (xiv) तथा ईपधारा (3) द्वारा प्रदत्त िजियों का प्रयोग करत े हुए, तजमलनाडु राज्य में आरोड जजल े के सथ्यामंगलम बाघ ररज़व ा की सीमा के चारों ओर 0 (िून्य) से 1.0 दकलोमीटर तक जवस्ट्ताररत क्षेत्र को सथ्यामंगलम बाघ ररज़व ा पाररजस्ट्थजतकी संवेदी जोन (जजसे आसम ें आसके पश् चात ् पाररजस्ट्थजतकी संवेदी जोन कहा गया ह)ै के रूप में ऄजधसूजचत करती ह,ै जजसका जववरण जनम्नानुसार ह,ै ऄथाात् :- 1. पाररजस्ट्थजतकी संवदे ी जोन का जवस्ट्तार और सीमा.-(1) पाररजस्ट्थजतकी संवेदी जोन का जवस्ट्तार सथ्यामंगलम बाघ ररज़वा की सीमा के चारों ओर 0 (िून्य) से 1.0 दकलोमीटर तक जवस्ट्तृत ह ै और पाररजस्ट्थजतकी संवेदी जोन का क्षेत्रफल 209.4634 वगा दकलोमीटर ह।ै बाघ ररज़वा की जवजभन्न ददिाओं में पाररजस्ट्थजतकी संवेदी जोन का जवस्ट्तार नीचे ददया गया ह:ै ददिाएं जवस्ट्तार ईत्तर 0 दकलोमीटर ईत्तर-पूवा 1 दकलोमीटर पूवा 1 दकलोमीटर दजक्षण-पूवा 1 दकलोमीटर दजक्षण 1 दकलोमीटर दजक्षण-पजश्चम 0 दकलोमीटर पजश्चम 0 दकलोमीटर ईत्तर-पजश्चम 1 दकलोमीटर एन्क्लेव ग्राम 0.200 दकलोमीटर राज्य सरकार द्वारा पाररजस्ट्थजतकी संवेदी ज़ोन के िून्य जवस्ट्तार को ईजचत ठहराया गया ह ै दक “ईत्तर-पूवा हबद ु टी21 से ईत्तर हबद ु टी6 और ईत्तर पजश्चम हबद ु टी1 में पाररजस्ट्थजतकी संवेदी जोन का िून्य दकलोमीटर जवस्ट्तार प्रस्ट्ताजवत दकया गया ह ै जो दक कनााटक के साथ ऄतं र-राज्यीय सीमा को समाप्त करता ह।ै पजश्चम भाग हबद ु टी58 स े दजक्षण पजश्चम हबद ु टी51 और दजक्षण हबद ु टी47 पर िन्ू य दकलोमीटर प्रस्ट्ताजवत दकया गया ह,ै यह कनााटक राज्य के बांदीपुर बाघ ररज़वा और तजमलनाडु के नीलजगरर जजल ेमें मदु मु लाइ बाघ ररज़वा के बफर ज़ोन में समाप्त होती ह।ै ” (2) सथ्यामंगलम बाघ ररज़वा और पाररजस्ट्थजतकी संवेदी जोन की सीमा का जववरण ईपाबधं -I के रूप म ेंसंलग्न ह।ै (3) सीमा जववरण और ऄक्षांि और देिांतर के साथ पाररजस्ट्थजतकी संवेदी जोन को सीमांदकत करत े हुए सथ्यामंगलम बाघ ररज़वा के मानजचत्र ईपाबधं -IIक, ईपाबधं -IIख, ईपाबधं -IIग, ईपाबधं -IIघ और ईपाबधं -IIङ के रूप म ेंसंलग्न ह।ै (4) सथ्यामंगलम बाघ ररज़वा और पाररजस्ट्थजतकी संवेदी जोन की सीमा के भू-जनदेिांकों की सूची ईपाबधं -III की सारणी क और सारणी ख में दी गइ ह।ै (5) मुख्य हबदओंु के भ-ू जनदेिाकं ों के साथ पाररजस्ट्थजतकी संवदे ी जोन के ऄंतगात अन े वाल े ग्रामों की सूची ईपाबधं -IV के रूप म ेंसंलग्न ह।ै 2. पाररजस्ट्थजतकी संवदे ी जोन के जलए अचं जलक महायोजना– (1) राज्य सरकार, पाररजस्ट्थजतकी संवेदी जोन के प्रयोजनों के जलए राजपत्र म ें आस ऄजधसूचना के प्रकािन की तारीख स े दो विा की ऄवजध के भीतर, स्ट्थानीय व्यजियों के परामिा से और राज्य के सक्षम प्राजधकारी के ऄनुमोदन के जलए आस ऄजधसूचना म ें ददए गए ऄनुबंधों का पालन करत े हुए अंचजलक महायोजना तैयार करेगी। (2) राज्य सरकार द्वारा पाररजस्ट्थजतकी संवेदी जोन के जलए अचंजलक महायोजना ऐसी रीजत से जो आस ऄजधसूचना म ें जवजनर्ददष् ट दकए गए ह,ैं के ऄनुसार तथा सुसगं त केंरीय और राज्य जवजधयों के ऄनुरुप और केंरीय सरकार द्वारा जारी मागाजनदेिों, यदद कोइ हों, द्वारा तैयार होगी ।[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 5 (3) अंचजलक महायोजना, ईि योजना में पाररजस्ट्थजतकी और पयाावरणीय बातों को समाकजलत करने के जलए राज्य सरकार के जनम्नजलजखत जवभागों के परामि ासे तैयार होगी.- (i) पयाावरण; (ii) वन और वन्यजीव; (iii) कृजि; (iv) राजस्ट्व; (v) िहरी जवकास; (vi) पयाटन; (vii) ग्रामीण जवकास; (viii) हसचाइ और बाढ जनयंत्रण; (ix) नगरपाजलका; (x) पंचायती राज; (xi) भूजवज्ञान और खनन; और (xii) लोक जन मााण जव भाग। (4) अंचजलक महायोजना ऄनमु ोददत जवद्यमान भू-ईपयोग, ऄवसंरचना और दक्रयाकलापों पर कोइ जनबंधन ऄजधरोजपत नहीं करेगी जब तक दक आस ऄजधसूचना में आस प्रकार जवजनर्ददष् ट न हो और अचंजलक महायोजना सभी ऄवसंरचना और दक्रयाकलापों में, जो ऄजधक दक्षता और पाररजस्ट्थजतकी ऄनुकूल हों, का संवधान करेगी । (5) अंचजलक महायोजना म ें ऄनाच्छाददत क्षेत्रों के जीणोद्धार, जवद्यमान जल जनकायों के संरक्षण, अवाह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भूतल जल के प्रबंधन, मृदा और नमी संरक्षण, स्ट्थानीय समुदायों की अवश्यकताओं तथा पाररजस्ट्थजतकी और पयाावरण से संबंजधत ऐसे ऄन्य पहलओंु , जजन पर ध्यान देना अवश्यक ह,ै के जलए ईपबंध होंगे । (6) अंचजलक महायोजना जवद्यमान और प्रस्ट्ताजवत भूजम ईपयोग जविेिताओं के ब्यौरों से ऄनुसमर्वथत मानजचत्र के साथ सभी जवद्यमान पूजा स्ट् थलों, ग्रामों और नगरीय बजस्ट्तयों, वनों के प्रकार और दकस्ट् मों, कृजि क्षेत्रों, उपजाउ भूजम, हररत क्षेत्र जैसे ईद्यान और ईसी प्रकार के स्ट् थान, ईद्यान कृजि क्षेत्र, फलोईद्यान, झीलों और ऄन्य जल जनकायों का ऄभ्यंकन करेगी। (7) अंचजलक महायोजना पाररजस्ट्थजतकी संवेदी जोन में जवकास को जवजनयजमत करेगी और सारणी में सूचीबद्ध पैरा-4 में प्रजतजिद्ध और जवजनयजमत दक्रयाकलापों का ऄनुपालन करेगी और स्ट् थानीय समुदायों की जीजवका को सुरजक्षत करने के जलए पाररजस्ट्थजतकी ऄनुकूल जवकास को सुजनजश्चत और ईसकी ऄजभवृजद्ध भी करेगी। (8) अंचजलक महायोजना प्रादेजिक जवकास योजना की सह जवस्ट्तारी होगी । (9) आस प्रकार ऄनुमोददत अंचजलक महायोजना आस ऄजधसूचना के ईपबंधों के ऄनुसार मानीटरी के ऄपने कायों को करन े के जलए मानीटरी सजमजत के जलए एक संदभा दस्ट्तावेज तैयार करेगी । 3. राज्य सरकार द्वारा दकए जान े वाल े ईपाय.- राज्य सरकार आस ऄजधसूचना के ईपबंधों को प्रभावी करने के जलए जनम्नजलजखत ईपाय करेगी, ऄथाात्:- (1) भू-ईपयोग.– (क) पाररजस्ट्थजतकी संवेदी जोन म ें वनों, ईद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंजन के प्रयोजनों के जलए जचजन्हत दकए गए पाकों और खुल े स्ट्थानों का वाजणजज्यक या अवासीय या औद्योजगक संबद्ध जवकास दक्रयाकलापों के जलए ईपयोग या संपररवतान नहीं होगा: परंत ु पाररजस्ट्थजतकी संवेदी जोन के भीतर भाग (क) में जवजनर्ददष्ट प्रयोजनों से जभन्न प्रयोजनों के जलए कृजि और ऄन्य भूजम का संपररवतान मानीटरी सजमजत की जसफाररि पर और यथा लागू और क्षेत्रीय नगर योजना ऄजधजनयम और केन्रीय सरकार या राज्य सरकार के ऄन्य जनयमों तथा जवजनयमों के ऄधीन सक्षम प्राजधकारी के पूवा ऄनुमोदन स,े और आस6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ऄजधसूचना के ईपबंधों द्वारा स्ट्थानीय जनवाजसयों की जनम्नजलजखत अवासीय अवश्यकताओं को पूरा करन े के जलए ऄनुज्ञात दकया जाएगा, जैस:े - (i) जवद्यमान सडकों को चौडा करना और ईन्ह ेंसुदढृ करना तथा नइ सडकों का संजनमााण; (ii) बुजनयादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रदिू ण ईत्पन्न न करने वाल े लघ ुईद्योग; (iv) कुटीर ईद्योगों जजनके ऄंतगता ग्रामीण ईद्योग भी ह;ैं सुजवधाजनक भण्डार और स्ट्थानीय सुजवधाए ं सहायक पाररजस्ट्थजतकी पयाटन जजसके ऄन्तगता गहृ वास सजममजलत ह;ै और (v) पैरा 4 के ऄधीन ददए गए संवर्वधत दक्रयाकलाप: परंत ु यह और दक प्रादेजिक नगर योजना ऄजधजनयम और राज्य सरकार के ऄन्य जनयमों और जवजनयमों के ऄधीन सक्षम प्राजधकारी के पूवा ऄनुमोदन और संजवधान के ऄनच्ु छेद 244 के ईपबंधों या तत्समय प्रवृत्त जवजध के ईपबंधों के ऄनुपालन के जबना, जजसके ऄधीन ऄनुसूजचत जनजाजत और ऄन्य परंपरागत वन जनवासी (वन ऄजधकारों की मान्यता) ऄजधजनयम, 2006 (2007 का 2) भी ह,ै वाजणजज्यक या औद्योजगक जवकास दक्रयाकलापों के जलए जनजातीय भूजम का ईपयोग ऄनुज्ञात नहीं होगा: परंत ु यह और भी दक पाररजस्ट्थजतकी संवेदी जोन के भीतर भू-ऄजभलेखों म ें ईपसंजात कोइ गलती, मानीटरी सजमजत के जवचार प्राप्त करन े के पश्चात ् राज्य सरकार द्वारा प्रत्येक मामले म ें एक बार ठीक होगी और ईि गलती के सुधार की सूचना केंरीय सरकार के पयाावरण, वन और जलवाय ुपररवतान मंत्रालय को दी जाएगी: परंत ु यह और भी दक गलती के सुधार म ें आस ईप पैरा के ऄधीन यथा ईपबंजधत के जसवाय दकसी भी दिा म ें भू-ईपयोग का पररवतान सजममजलत नहीं होगा; (ख) वनीकरण तथा वास जीणोद्धार दक्रयाकलापों सजहत ऄनप्रयुक् त या ऄनुत् पादक कृजि क्षत्रे ों में पुन: वनीकरण करने के प्रयास दकए जाएंगे। (2) प्राकृजतक जल िोतों.- अचंजलक महायोजना म ें सभी प्राकृजतक झरनों के अवाह क्षेत्रों की पहचान की जाएगी और ईनके संरक्षण और नवीकरण के जलए योजना सजम मजलत होगी और राज्य सरकार द्वारा ऐसे क्षेत्रों पर या ईनके जनकट जवकास दक्रयाकलाप प्रजतजिद्ध करने के बारे में जो ऐसे क्षेत्रों के जलए ऄजहतकर हो ऐसी रीजत से मागादिाक जसद्धांत तैयार दकए जाएंगे। (3) पयटा न या पाररजस्ट्थजतकी पयटा न.- (क) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पाररजस्ट्थजतकी पयाटन दक्रयाकलाप या जवद्यमान पयाटन दक्रयाकलापों का जवस्ट्तार पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन के जलए होगा; (ख) पाररजस्ट्थजतकी पयाटन महायोजना राज्य पयाटन जवभाग द्वारा राज्य पयाावरण और वन जवभाग के परामि ा स े तैयार होगी; (ग) पयाटन महायोजना अंचजलक महायोजना के एक घटक के रूप म ेंहोगी। (घ) पयाटन महायोजना पाररजस्ट्थजतकी संवेदी जोन की वहन क्षमता के अधार पर तैयार की जाएगी; (ङ) पाररजस्ट्थजतकी पयाटन संबधं ी दक्रयाकलाप जनम्नानुसार जवजनयजमत होंगे, ऄथाात:्- (i) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट ह,ै नय ेवाजणजज्यक होटल और ररजॉटा के सजन्नमााण ऄनज्ञु ात नहीं होंग:े परंत,ु यह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर की दरू ी से परे पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक होटलों और ररजॉट ा का स्ट्थापन केवल पूवा पररभाजित और नामजनर्ददष्ट क्षेत्रों में पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी पयाटन सुजवधाओं के जलए ही ऄनुज्ञात होगा;[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 7 (ii) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पयाटन दक्रयाकलापों या जवद्यमान पयाटन दक्रयाकलापों का जवस्ट्तार केंरीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय के मागादिाक जसद्धांतों के द्वारा तथा राष्र ीय ा याघ्र स संरक्षण प्राजधकरण, द्वारा जारी पाररजस्ट्थजतकी–पयाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल देते हुए (समय- समय पर यथा संिोजधत) जारी मागादिाक जसद्धांतों के ऄनुसार होगा; (iii) अंचजलक महायोजना का ऄनुमोदन दकए जाने तक, पयाटन के जलए जवकास और जवद्यमान पयाटन दक्रयाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्ददष्ट संवीक्षा और मानीटरी सजमजत की जसफाररि पर अधाररत संबंजधत जवजनयामक प्राजधकरणों द्वारा ऄनुज्ञात दकया जाएगा और पाररजस्ट्थजतकी संवेदी जोन के भीतर दकसी नये होटल या ररसोटा या वाजणजज्यक स्ट्थापना का संजनमाणा ऄनुज्ञात नहीं दकया जायेगा । (4) नसै र्वगक जवरासत.- पाररजस्ट्थजतकी संवेदी जोन म ें महत्वपूणा नैसर्वगक जवरासत के सभी स्ट्थलों जैसे जीन कोि अरजक्षत क्षत्रे , िैल जवरचनाएं, जल प्रपातों, झरनों, घाटी मागों, ईपवनों, गुफाएं, स्ट्थलों, भ्रमण, ऄश्वरोहण, प्रपातों अदद की पहचान की जाएगी और जवरासत संरक्षण योजना अंचजलक महायोजना के भाग के रुप म ें परररक्षण और सरं क्षण के जलए तैयार की जाएगी । (5) मानव जनर्वमत जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेदी जोन में भवनों, संरचनाओं, जिल्प-तथ्य, ऐजतहाजसक, स्ट्थापत्य, सौंदयापूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और ईपक्षेत्रों पहचान और ईनके संरक्षण के जलए जवरासत योजना अंचजलक महायोजना के भाग के रुप में तयै ार की जाएगी। (6) ध्व जन प्रदिू ण.- पयाावरण ऄजधजनयम के ऄधीन ध्वजन प्रदिू ण (जवजनयमन और जनयत्रं ण) जनयम, 2000 म ें जनयत ईपबंधों के ऄनुसार म ेंपाररजस्ट्थजतकी संवेदी जोन में ध्वजन प्रदिू ण के जनयंत्रण और जनवारण का ऄनुपालन दकया जाएगा। (7) वाय ु प्रदिू ण.- पाररजस्ट्थजतकी संवेदी जोन म,ें वायु प्रदिू ण के जनवारण और जनयंत्रण का वायु (प्रदिू ण जनवारण और जनयंत्रण) ऄजधजनयम, 1981 (1981 का 14) और ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार ऄनुपालन दकया जाएगा। (8) बजहिाव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेदी जोन म ें ईपचाररत बजहिाव का जनस्ट्सरण, साधारण मानकों के ईपबंधों के ऄनुसार पयाावरण ऄजधजनयम और ईसके ऄधीन बनाए गए जनयमों के ऄधीन अन े वाले पयाावरणीय प्रदिू ण के जनस्ट्सारण के जलए साधारण मानकों या राज्य सरकार द्वारा जनयत मानकों, जो भी ऄजधक कठोर हो, के ईपबंधों के ऄनुसार होगा। (9) ठोस ऄपजिष्ट.- ठोस ऄपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकया जाएगा:- (क) पाररजस्ट्थजतकी संवेदी जोन म ें ठोस ऄपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय की ऄजधसूचना सं. का.अ. 1357(ऄ), तारीख 8 ऄप्रलै , 2016 के ऄधीन प्रकाजित ठोस ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा; ऄकाबाजनक पदाथो का जनपटान पाररजस्ट्थजतकी संवेदी जोन स े बाहर जचजन्हत दकए गए स्ट्थानों पर पयाावरण-ऄनुकूल रीजत से दकया जाएगा; (ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों का प्रयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप ठोस ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनुकूल प्रबंधन ऄनुज्ञात दकया जा सकेगा। (10) जैव जचदकत्सा ऄपजिष्ट .- जैव जचदकत्सा ऄपजिष्ट का प्रबंधन जनम्नानुसार दकया जाएगा.- (क) पाररजस्ट्थजतकी संवेदी जोन म ें जैव जचदकत्सा ऄपजिष्ट का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की ऄजधसूचना सं.सा.का.जन 343 (ऄ), तारीख 28 माच,ा 2016 के द्वारा प्रकाजित जैव जचदकत्सा ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा; (ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों का ईपयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप जैव-जचदकत्सा ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनुकूल प्रबधं न ऄनुज्ञात दकया जा सकेगा। (11) प्लाजस्ट्टक ऄपजिष्ट प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन में प्लाजस्ट्टक ऄपजिष्ट प्रबधं न का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजध सूचना सं.सा.का.जन 340(ऄ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक ऄपजिष्ट प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (12) जनमाणा और जवध्वसं ऄपजिष्ट प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन में संजनमााण और जवध्वंस ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना सं.सां.का.जन 317(ऄ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा । (13) इ–ऄपजिष्ट.- पाररजस्ट्थजतकी संवेदी जोन म ें इ–ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतना मंत्रालय की समय-समय पर यथासंिोजधत द्वारा प्रकाजित इ–ऄपजिष्ट प्रबधं जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। (14) यानीय यातायात.- यातायात की यानीय गजतजवजधयां अवास के ऄनुकूल जवजनयजमत होंगी और आस संबंध म ें अंचजलक महायोजना म ें जविेि ईपबंध सजममजलत दकए जाएंगे और अंचजलक महायोजना के तैयार होने और राज्य सरकार के सक्षम प्राजधकारी द्वारा ऄनुमोददत होने तक, मानीटरी सजमजत सुसंगत ऄजधजनयमों और ईसके ऄधीन बनाए गए जनयमों और जवजनयमों के ऄनुसार यानीय दक्रयाकलापों के ऄनुपालन को मानीटरी करेगी। (15) यानीय प्रदिू ण.- लाग ू जवजधयों के ऄनपु ालन म ें वाहन प्रदिू ण का जनवारण और जनयंत्रण दकया जाएगा और स्ट्वच्छक ईंधन के ईपयोग के जलए प्रयास दकए जाएंगे। (16) औद्योजगक इकाआया.ं- (क) राजपत्र म ें आस ऄजधसूचना के प्रकािन पर या ईसके पश्चात पाररजस्ट्थजतकी संवेदी जोन के भीतर कोइ नए प्रदजू ित ईद्योगों की स्ट्थापना की ऄनज्ञु ा नहीं दी जाएगी। (ख) केन्रीय प्रदिू ण जनयंत्रण बोडा द्वारा फरवरी, 2016 में जारी समय-समय पर यथा सिं ोजधत मागादिाक जसद्धान्तों म ें ईद्योगों के वगीकरण के ऄनुसार, जब तक दक ऄजधसूचना में आस प्रकार जवजनर्ददष्ट न हो, पाररजस्ट्थजतकी संवेदी जोन के भीतर केवल गैर-प्रदिू णकारी ईद्योगों को ऄनुज्ञात दकया जाएगा और आसके ऄजतररि, गैर प्रदिू णकारी ईद्योगों को बढावा ददया जाएगा। (17) पहाडी ढलानों को सरं क्षण.- पहाडी ढलानों का संरक्षण जनम्नानुसार होगा:- (क) अंचजलक महायोजना पहाडी ढलानों पर क्षेत्रों का संकेत होगा जहां दकसी भी संजनमााण की ऄनज्ञु ा नहीं दी जाएगी; (ख) कटाव के एक ईच्च जडग्री के साथ जवद्यमान खडी पहाडी ढलानों या ढलानों पर दकसी भी संजनमााण की ऄनज्ञु ा नहीं दी जाएगी । 4. पाररजस्ट्थजतकी सवं दे ी जोन म ें प्रजतजिद्ध और जवजनयजमत दकए जान े वाल े दक्रयाकलापों की सूची.- पाररजस्ट्थजतकी संवेदी जोन म ें सभी दक्रयाकलाप पयाावरण ऄजधजनयम के ईपबंधों और ईसके ऄधीन बनाए गए जनयमों जजसके ऄन्तगात तटीय जवजनयमन जोन, 2011 और पयाावरणीय समाघात जनधाारण ऄजधसूचना, 2006 और ऄन्य लागू जवजधयों के जजसमें वन (संरक्षण) ऄजधजनयम, 1980 (1980 का 69), भारतीय वन ऄजधजनयम, 1927 (1927 का 16), वन्यजीव (संरक्षण) ऄजधजनयम, 1972 (1972 का 53), सजममजलत ह ैं और दकये गये संिोधनों द्वारा िाजसत होंग े और नीच े दी गइ सारणी म ें जवजनर्ददष्ट रीजत म ेंजवजनयजमत होंगे, ऄथाात ्:- सारणी क्रम स.ं दक्रयाकलाप वणना (1) (2) (3) ऄ. प्रजतजिद्ध दक्रयाकलाप 1. वाजणजज्यक खनन, पत्थर ईत्खनन और (क) पाररजस्ट्थजतकी संवेदी जोन के ऄंतगात वास्ट्तजवक स्ट्थानीय ऄपघिणा आकाआयां । जनवाजसयों की घरेल ू अवश्यकताओं जजसम ें मकानों के संजनमााण या मरममत के जलए धरती को खोदना सजममजलत ह,ै के जसवाय सभी प्रकार के नए खनन (लघ ु और वृहत खजनज), पत्थर[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 9 ईत्खनन और ऄपघिाण आकाआयां तत्काल प्रभाव से प्रजतजिद्ध होंगी; (ख) खनन प्रचालन, 1995 की ररट याजचका (जसजवल) स.ं 202 में टी.एन. गौडाबमान जथरुमलू पाद बनाम भारत संघ के मामल े म ें माननीय ईच्चतम न्यायालय के अदिे 4 ऄगस्ट्त ,2006 और 2012 की ररट याजचका (जसजवल) स.ं 435 में गोवा फाईंडेिन बनाम भारत संघ के मामल े म ें तारीख 21 ऄप्रलै ,2014 के अदेि के ऄनुसरण म ेंहोगा । 2. प्रदिू ण (जल, वाय,ु मृदा, ध्वजन, अदद) पाररजस्ट्थजतकी संवेदी जोन म ें कोइ नया ईद्योग लगान े और वतामान प्रदिू णकारी ईद्योगों का जवस्ट्तार करने की ऄनज्ञु ा नहीं ईत्पन करन े वाल ेईद्योगों की स्ट्थापना । होगी: परन्त ु यह दक केन्रीय प्रदिू ण जनयंत्रण बोड ा द्वारा फरवरी, 2016 म ें जारी समय-समय पर यथा संिोजधत मागदा िका जसद्धान्तों में ईद्योगों के वगीकरण के ऄनुसार, जब तक दक ऄजधसूचना में ऐसा जवजनर्ददष्ट न हों, पाररजस्ट्थजतकी संवेदी जोन के भीतर गैर-प्रदिू णकारी ईद्योगों को ऄनुज्ञात दकया जाएगा और आसके ऄजतररि गरै -प्रदिू णकारी कुटीर ईद्यागों को बढावा ददया जाएगा। 3. ब ृहत जल जवद्युत पररयोजना की स्ट्थापना प्रजतजिद्ध। । 4. दकसी पररसंकटमय पदाथ ा का ईपयोग या प्रजतजिद्ध। ईत्पादन या प्रसंस्ट्करण। 5. प्राकृजतक जल जनकायों या क्षेत्र भूजम म ें प्रजतजिद्ध। ऄनुपचाररत बजहिााव का जनस्ट्सारण । 6. नइ अरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेदी जोन के भीतर नइ और जवद्यमान अरा जमलों का जवस्ट् तार ऄनज्ञु ात नहीं होगा। 7. ईंट भट्टों की स्ट्थापना करना। ऄनुसार जवजनयजमत होंगे । 11. प्रदिू ण ईत्पन्न न करन े वाले लघु ईद्योग। फरवरी, 2016 म ें केन्रीय प्रदिू ण जनयंत्रण बोडा द्वारा जारी ईद्योगों में वगीकरण के ऄनुसार समय-समय पर संिोजधत दकया जाएगा दक गैर-प्रदिू णकारी ईद्योग और ऄपररसंकटमय में, लघ ु और सेवा ईद्योग, कृजि, पुष्प कृजि, ईद्यान कृजि या पाररजस्ट्थजतकी संवेदी जोन से दिे ी सामग्री स े ईत्पादों को ईत्पन्न करने वाले कृजि अधाररत ईद्योग सक्षम प्राजधकारी द्वारा ऄनुज्ञात होंगे। 12. वृक्षों की कटाइ। (क) राज्य सरकार म ें सक्षम प्राजधकारी की पूवा ऄनुज्ञा के जबना वन, सरकारी या राजस्ट्व या जनजी भूजम पर या वनों म ें वृक्षों की कटाइ नहीं होगी । (ख) वृक्षों की कटाइ संबंजधत केंरीय या राज्य ऄजधजनयम या ईसके ऄधीन बनाए गए जनयमों के ईपबंध के ऄनुसार जवजनयजमत होंग े। 13. वन ईत्पादों या गैर काष्ठ वन ईत्पादों का लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे । संग्रहण । 14. जवद्युत और संचार टावरों का पररजनमााण लाग ू जवजधयों के ऄधीन जवजनयजमत होंगे (भूजमगत केबल के और केबलों के जबछाए जान े और ऄन्य जबछाए जाने को बढावा ददया जा सकेगा)। बुजनयादी ढांचे । 15. नागररक सुख सुजवधाओं सजहत न्यूनीकरण ईपायों को लागू जवजधयों, जनयमों और जवजनयमनों ऄवसंरचनाएं । और ईपलब्ध मागादिाक जसद्धांतों के ऄनुसार दकया जाना । 16. जवद्यमान सडकों को चौडा करना और न्यूनीकरण ईपायों को लाग ू जवजधयों, जनयमों और जवजनयमनों ईन्ह ें सुदढृ करना तथा नवीन सडकों का तथा ईपलब्ध मागदा िाक जसद्धांतों के ऄनुसार दकया जाएगा । संजनमााण । 17. पयाटन से संबंजधत ऄन्य दक्रयाकलाप जैस े लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे । गम ा वायु गुब्बारें, हले ीकाप्टर, ड्रोन,[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 11 माआक्रोलाआटस, अदद द्वारा पाररजस्ट्थजतकी संवेदी जोन क्षत्रे के उपर से ईडना जैस ेदक्रयाकलाप करना। 18. पहाडी ढालों और नदी तटों का संरक्षण । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे । 19. राजत्र म ेंयाजनक यातायात का संचलन । लाग ू जवजधयों के ऄधीन वाजणजज्यक प्रयोजन के जलए जवजनयजमत होंगे । 20. स्ट्थानीय समुदायों द्वारा चल रही कृजि स्ट्थानीय लोगों के ईपयोग के जलए लाग ू जवजधयों के ऄधीन और बागवानी प्रथाओं के साथ ऄनुज्ञात होंगे। दग्ु धिाला, दग्ु घ ईद्योग, कृजि और मछली पालन । 21. फमों, जनगम और कंपजनयों द्वारा बडे स्ट्थानीय अवश्यकताओं को परू ा करने के जलए लागू जवजधयों के ऄधीन जवजनयजमत (ऄन्यथा ईपबंजधत के जसवाय) होंग े । पैमाने पर वाजणजज्यक पिओंु और कुक्कुट फामों की स्ट्थापना । 22. प्राकृजतक जल जनकायों या सतही क्षत्रे म ें जल जनकायों में ईपचाररत ऄपजिष्ट जल या बजहिााव के ईपचाररत बजहिााव का जनस्ट्तारण । जनस्ट्सरण से बचा जाएगा और ईपचाररत ऄपजिष्ट जल के पुन:चक्रण और पनु :ईपयोग के जलए प्रयास दकए जाएंगे। ऄन्यथा लागू जवजधयों के ऄनुसार ईपचाररत बजहिााव के पुनचक्रा ण या प्रवाह के जनवाहन को जवजनयजमत दकया जाएगा। 23. सतही और भूजल का वाजणजज्यक लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे । जनष्किाण । 24. प्राकृजतक संरक्षण (जवरासत संरक्षण सदस्ट्य; सजहत) के क्षत्रे म ें काम करने वाले गैर-सरकारी संगठनों के दो प्रजतजनजध (vii) एक ज विय जविेिज्ञ पाररजस्ट्थजतकी संवेदी जोन के बारे म ें जानकार सदस्ट्य; (viii) क्षत्रे क े वररि नगर जनयोजक सदस्ट्य; (ix) भूजवज्ञान और खनन जवभाग का प्रजतजनजध सदस्ट्य; (x) राजमागा जवभाग का प्रजतजनजध सदस्ट्य; (xi) जजला वन ऄजधकारी और ईप जनदेिक, सथ्यामंगलम सदस्ट्य-सजचव। 6. जनदेि–जनबधं न.- (1) मानीटरी सजमजत आस ऄजधसूचना के ईपबंधों के ऄनुपालन को मानीटरी करेगी। (2) मानीटरी सजमजत का कायाकाल ऄगले अदेि होन े तक दकया जाएगा, परंत ु यह दक सजमजत के गैर-सरकारी सदस्ट्यों को समय-समय पर राज्य सरकार द्वारा नामजनर्ददष्ट दकया जाएगा। (3) ईन दक्रयाकलापों की, जो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक का.अ. 1533 (ऄ), तारीख 14 जसतमबर, 2006 की ऄनुसूची म ें सजममजलत ह,ैं और जो पाररजस्ट्थजतकी संवेदी जोन म ें अत े ह,ैं जसवाय आसके जो परै ा 4 के ऄधीन सारणी म ें यथा जवजनर्ददष्ट प्रजतजिद्ध दक्रयाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर संवीक्षा की जाएगी और ईि ऄजधसूचना के ईपबंधों के ऄधीन पूवा पयाावरण ऄनापजत्त के जलए केरींय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय को जनर्ददष्ट दकया जाएगा। (4) ईन दक्रयाकलापों की, जो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक का.अ. 1533 (ऄ) तारीख 14 जसतंबर, 2006 की ऄनुसूची में सजममजलत नहीं ह,ै और जो पाररजस्ट्थजतकी संवेदी जोन में अते हैं, जसवाय आसके पैरा 4 के ऄधीन सारणी में यथाजवर्वनष्ट प्रजतजिद्ध दक्रलाकलापों के मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर संवीक्षा की जाएगी और ईसे संबंद्ध जवजनयामक प्राजधकरणों को जनर्ददष्ट दकया जाएगा। (5) मानीटरी सजमजत का सदस्ट्य-सजचव या संबद्ध ईपायिु ऐसे व्यजि के जवरूद्ध, जो आस ऄजधसूचना के दकसी ईपबंध का ईल्लघं न करता ह,ै पयाावरण (संरक्षण) ऄजधजनयम, 1986 की धारा 19 के ऄधीन published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 1910 (E), dated the 31st May, 2019, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 31st May, 2019; AND WHEREAS, objections and suggestions were received from persons and stakeholders in response to the aforesaid draft notification were duly considered in the Ministry; AND WHEREAS, the Sathyamangalam Tiger Reserve is spread over an area of 1411.6094 square kilometres which also includes 3.20399 square kilometres of forest settlement area and is located in Sathyamangalam Taluk / Tehsil of Erode District in the state of Tamil Nadu; AND WHEREAS, the Sathyamangalam Forest Division was formed on 22nd August, 1980 vide G.O. Ms. No. 999 Forests and Fisheries Department dated 06th May, 1980 bifurcate the erstwhile Coimbatore North Division into Sathyamangalam and Erode Divisions. The southern portion of the division covering an area of 524.34 square kilometres has been declared as Sathyamangalam Wildlife Sanctuary, vide G. O. Ms. No.122 Environment & Forest (FR V) department dated 03rd November, 2008 under section 26(A) of the Wildlife (Protection) Act, 1972 and22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] subsequently an area of 887.26 square kilometres has been further added to Sathyamangalam Wildlife Sanctuary vide G.O. Ms. No. 93 Environment & Forest (FR V) department dated 11th August, 2011 making the total area to an extent of 1411.60 square kilometres. As per G.O. Ms. No. 41 E & F, FR 5 dept. dated 15th March, 2013 an extent of 1408.405 square kilometres of Reserved Forest in Sathyamangalam Wildlife Sanctuary has been declared as Sathyamangalam Tiger Reserve with 793.49331 square kilometres as core and 614.91210 square kilometres as buffer areas, while 3.20399 square kilometres added forest settlement area making the total area of 1411.60 square kilometres; AND WHEREAS, the Sathyamangalam Tiger Reserve is richly endowed with heterogeneous mosaic of habitats such as scrub and riparian forests on the plains, deciduous and mixed deciduous on the slopes and hill plateau, high altitude savannah on the hills and semi evergreen patches between hill slopes, due to wide range of climatic conditions. The major flora of the Sathyamangalam Tiger Reserve are Australian wattle (Acacia auriculiformits), velvelam (Acacia leucophloea), vagai (Albizia lebbeck), mundiri (Anacardium occidentale), pali eechi (Antidesma menasu), palaa (jack fruit) (Artocarpus heterophyllus), malai athi (Bauhinia malabarica), kumancham (Boswellia serrata), vettilai-pattai (Callicarpa tomentosa), kondarai (Cassia fistula), savukku (Casuarina equisetifolia), pancu mul kiluvai (Commiphora berryi), railpoondu (Croton oblongifolius), mayirkonrai (Delonix regia), tumbika (Diospyros malabarica), karippalai (Drypetes roxburghii), mulumurukku (Erythrina suberosa), kalli (Euphorbia nivulia), kallal (Ficus drupacea), savukkumaram (Grevillea robusta), parpatagam (Hedyotis corymbosa), vendai (Kydia calycina), cembavu (Meliosma simplicifolia), nuna (Morinda coreia), arali (Nerium indicum), kolarmavu (Persea macrantha), kallimandarai (Plumeria rubra), vaengai, (Pterocarpus marsupium), nir nochi (Salix tetrasperma), puvam (Schleichera oleosa), sombupattai (Soymida febrifuga), ambu (Stereospermum colais), sonnapatti (Tecoma stans), kadukkai (Terminalia chebula), amparuthi, mena. (Trema oreientalis), nirnocchi (Vitex leucoxylon), etc; AND WHEREAS, major fauna available in the Sathyamangalam Tiger Reserve are bonnet macaque (Macaca radiate), common or Hanuman langur (Semnopithecus entellus), slender loris (Loris tardigradus), tiger (Panthera tigris), leopard (Panthera pardus), leopard cat (Felis bengalensis), fishing cat (Felis viverrina), jungle cat (Felis chaus), small Indian civet (Viverrricula india), common palm civet or toddy cat (Paradoxurus hermaphroditus), common mongoose (Herpestes edwardsi), stripe necked mongoose (Herpestes vitticollis), smooth coated otter (Lutra perspicillata), striped hyena (Hyaena hyaena), jackal (Canis aureus), wild dog or dhole (Cuon alpinus dukhunensis), sloth bear (Melursus ursinus), Malabar giant squirrel (Ratufa indica), three striped palm squirrel (Funambulus palmarum), field mouse (Mus boduga), Indian bush rat (Golunda elliotti), common house rat (Rattus rattus), bandicoot rat (Bandicota indica), house mouse (Mus musculus), Indian porcupine (Hysteris indica), black naped hare (Lepus nigricollis nigricollis), Asian elephant (Elephus maximus), gaur (Bos gaurus), four horned antelope or chowsingha (Tetracerus quadricornis), blackbuck (Antilope cervicapra), sambar (Cervus unicolor), chital or spotted deer (Axis axis), muntjak or barking deer (Muntiacus muntjak), Indian chevrotain or mouse-deer (Tragulus meminna), wild boar (Sus scrofa), Indian pangolin (Manis crassicaudata), etc; AND WHEREAS, major avifauna recorded from the Sathyamangalam Tiger Reserve are little grebe (Tachybatus ruficollis), purple heron (Ardea purpurea), glossy ibis (Plegadis falcinellus), black kite (Milvus migrans), lesser kestrel (Falco naumanni), yellow legged button quail (Turnix tanki), marsh sandpiper (Tringa stagnatilis), spotted dove (Spilopelia chinensis), rose ringed parakeet (Psittacula krameri), small green billed malkoha (Phaenicophaeus tristis), blue bearded beeeater (Nyctyornis athertoni), white checked barbet (Psilopogon viridis), heart spotted woodspecker (Hemicircus canente), forest wagtail (Dendronanthus indicus), scarlet minivet (Pericrocotus speciosus), Eurasian blackbird (Turdus merula), jungle babbler (Turdoides striata), bootedwarbler (Iduna caligata), verditer blue flycatcher (Eumyias thalassinus), velvet fronted nuthatch (Sitta frontalis), little spider hunter (Arachnothera longirostra), brahminy starling (Sturnia pagodarum), white bellied drongo (Dicrurus caerulescens), etc; while butterfly, insects, reptiles recorded from the Tiger Reserve are tawny coster (Acraea violae), glassy blue tiger (Parantica aglea), rustic (Cupha erymanthis), common sailer (Neptis hylas), common lascar (Pantoporia hordonia), grey pansy (Junonia atlites), common five-ring (Ypthima baldus), lime blue (Chilades lajus), common silverline (Spindasis vlucanus), monkey puzzle (Rathinda amor), blue mormon (Papilio polymnestor), common gull (Cepora nerissa), white orange tip (Ixias marianne), crimson tip (Colotis danae), great orange tip (Hebomia glaucippe), paintbrush swift (Baoris farri), Indian skipper (Spialia galba), rice swift (Borbo chinnara), etc; AND WHEREAS, owing to its large contiguous forests and connectivity with adjoining forest areas, this Sathyamangalam Tiger Reserve has plethora of rare, endangered and threatened (RET) species such as striped hyena (Hyaena hyaena), jackal (Canis aures), white backed vulture (Gyps africanus), gyps (Gyps indicus), tiger (Panthera tigris), leopard (Panthera pardus), elephant (Elephas maximus), Indian gaur (Boss gaurus), black buck (Antilope cervicapra), four horned antelope (Tetracerus quadricornis), hyena (Hyaena hyaena), sloth bear (Melursus ursinus), mugger crocodile (Crocodylus palustris), white backed vulture (Gype africanus), rusty-spotted cat (Prionailurus rubiginosus). While rare, endangered and threatened (RET) species of plants available in the Sathyamangalam Tiger Reserve are kadukkai (Terminalia chebula), kungiliyam (Boswellia Serrata), entha panai (Cycas circinalis), peru malli (Isonandra villosa), porasu (Chloroxylon swietenia), cryptocarya (Cryptocarya beddomei), cryptocarya (Cryptocarya stocksii), enthai panai (Cycas circinalis), eetti (Dalbergia latifolia);[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 23 AND WHEREAS, the Sathyamangalam Tiger Reserve has numerous endemic species which includes seemai velvel (Acacia ferruginea), chokkala (Aglaia elaeagnoidea), kasukkoti (Alysicarpus monilifer), chalindi veru chedi (Anisochilus scaber), striped hyena (Hyaena hyaena), jackal (Canis aures), honey badger (Mellivora capensis), rusty-spotted cat (Prionailurus rubiginosus), leopard cat (Prionailurus bengalensis), etc; AND WHEREAS, Sathyamangalam Tiger Reserve is highly critical to accommodate the spill over population of tigers from the Mudumalai Tiger Reserve, Bandipur Tiger Reserve and Nilgiri North Forest Division through Moyar valley on one hand and similarly Bandipur Tiger Reserve and Kollegal Forest Divisions connecting on the other side with Hassanur Range. This Tiger Reserve is acting as a bridge between the two major landscapes i. e. Western Ghats and Eastern Ghats which ensures a vast territory for Tiger and thus enhancing long term conservation measure through exchange of genes between meta populations; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Sathyamangalam Tiger Reserve which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0 (zero) to 1.0 kilometres around the boundary of Sathyamangalam Tiger Reserve, in Erode District in the State of Tamil Nadu as the Sathyamangalam Tiger Reserve Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of the Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of 0 (zero) to 1.0 kilometres around the boundary of Sathyamangalam Tiger Reserve and the area of the Eco-sensitive Zone is 209.4634 square kilometres. The extent of Eco-sensitive Zone at various different direction of the Tiger Reserve are given below: Directions Extents North 0 kilometre North-East 1 kilometre East 1 kilometre South-East 1 kilometre South 1 kilometre South-West 0 kilometre West 0 kilometre North-West 1 kilometre Enclave villages 0.200 kilometre Zero extent of Eco-sensitive Zone was justified by State government as “Zero kilometre extent of Eco- sensitive Zone has been proposed in the north east point T21 to North point T6 and North West point T1 which abuts the inter-state boundary with Karnataka. On the West side point T58 to South West point T51 and South point T47 has been proposed as zero kilometre since, it abuts the Bandipur Tiger Reserve of Karnataka State and Buffer Zone of Mudumalai Tiger Reserve in Nilgiri District of Tamil Nadu.”. (2) The boundary description of Sathyamangalam Tiger Reserve and its Eco-sensitive Zone is appended as Annexure-I. (3) The maps of the Sathyamangalam Tiger Reserve demarcating the Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB, Annexure-IIC, Annexure-IID and Annexure-IIE. (4) Lists of geo-coordinates of the boundary of Sathyamangalam Tiger Reserve and the Eco-sensitive Zone are given in Table A and Table B of Annexure-III. (5) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Eco- sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue; (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayati Raj; (xi) Geology and Mining; and (xii) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities;[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 25 (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given in paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph; (b) efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; (b) the Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests; (c) the Tourism Master Plan shall form a component of the Zonal Master Plan; (d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone; (e) the activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by the State Government, whichever is more stringent. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016; (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 27 (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE Sl. Setting of industries causing pollution New industries and expansion of existing polluting (Water, Air, Soil, Noise, etc.). industries in the Eco-sensitive Zone shall not be permitted: Provided that non-polluting industries shall be allowed within the Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition the non-polluting cottage industries shall be promoted. 3. Establishment of major hydro-electric Prohibited. project. 4. Use or production or processing of any Prohibited. hazardous substances. 5. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents: Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 11. Small scale non polluting industries. Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent authority. 12. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. 13. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:-30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Sl. Member; (x) A representative from Department of Highways Member; (xi) District Forest Officer and Deputy Director, Sathyamangalam Member-Secretary. 6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the State Government from time to time. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. Supreme Court, etc. orders.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon‟ble Supreme Court of India or High Court or the National Green Tribunal.
