L.-33004/99 EXTRAORDINARY II— — (ii) PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY 1264] No. 1264] NEW DELHI, FRIDAY, MAY 5, 2017/VAISAKHA 15, 1939 पययावरण, वन और जलवयय ुपररवतना मत्रं यलय ऄधधसचू नय नइ ददल्ली, 5 मइ, 2017 कय.अ. 1432(ऄ).—भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की ऄधधसूचनय सं. 3029 (ऄ), तयरीख 10 , 2015 द्वयरय भयरत के रयजपत्र, ऄसयधयरण में, ईन सभी व्यधियों स,े धजनके ईससे प्रभयधवत होन े की संभयवनय थी, ईस तयरीख से, धजसको ईस रयजपत्र की प्रधतययं, धजसमें यह ऄधधसूचनय ऄतं र्ववष्ट ह,ै जनतय को ईपलब्ध करय दी गइ थी, सयठ ददन की ऄवधध के भीतर अक्षेप और सुझयव अमंधत्रत करत े हुए एक प्रयरुप ऄधधसचू नय प्रकयधित की गइ थी; और, ईि रयजपत्र, की प्रधतययं जनतय को 10 नवंबर, 2015 को ईपलब्ध करय दी गइ थीं; और, ईि प्रयरुप ऄधधसूचनय के प्रत्युत्तर में व्यधियों और पणधयररयों से कोइ अक्षेप और सुक्षयव प्रयप्त नही हुए ह;ै मंजीरय वन्यजीव ऄभययरण्य तेलगं यनय (बयद धजसे आसमें आसके पश्चयत ऄभययरण्य कहय गयय है) के मेडक धजले म ें 17.09’.45” 17.12’.15” ईत्तर ऄक्षयंि के बीच और 78° 02.15” से 78° 08.48” पूवा देियंतर के बीच ऄवधथथत ह ै और यह मंजीरय तथय ससगूर पररयोजनय बयंधों के बीच एक जलयिय ह ै । इ 20 ; और, ऄभययरण्य मगरम्छ कय धनवयस ह ै और यहयं संवर्वधत मत्सयों की पयंच प्रजयधतययं की 10 प्रजयधतययं, सररसृपों की 26 प्रजयधतययं, थतनधयररयों की 18 प्रजयधतययं और पधक्षयों की 170 से ऄधधक प्रजयधतययं पयइ जयती ह;ै और, यह जलीय पक्षी प्रयणी समूह के धलए एक महत्वपूण ा प्रयकृधतक अवयस ह ैऔर ऄनेक थथयधनक एव ं प्रवयसी पधक्षयों जैसे ओररएंटल डयटार, ब्लेक आधबस, वयआट आधबस, ग्लयसी आधबस, ब्लेक धवन्जंड थटल्ट, थरोक, ओपन धबल्ड थरोक, थपनू धबल्स, कॉम्ब टक्स, कॉटन टीलस, धवहसथलग टीलस, रेड क्रेधथटड पोकयडास, कयमन पोकयडसा , ब्रहयमनी बत्तख, ग्रे पेधल्क्न्स, बयईन हधे डड गलस, बयर हधे डड गीज, ओथपरी, मयिा हरै रयर, धडमोसेल्ल ेक्रेन्स और थवले ोस यहयं रहते ह;ैं और, मंजीरय वन्यजीव ऄभययरण्य म ें जलयिय में नौ द्ववीप धथथत ह,ैं और जो टयइफय . अइपोधमयय ., धनम्फॉटयआस हयआड्रोफयआलय, पोलीगोनम ग्लेबरम, ल्यूकस ऄथपेरय, सेन्टेल्लय एधिययरटकय, हयआधड्रलय वर्टटधसलयटय, वयधलसनेररयय थपयआररधलस और मयरधसधलयय क्वयडीफोधलयय जैसी जलमग्न और ईदगयमी वनथपधतययं धवद्यमयन ह ै और वन क्षेत्र में धवधिष्ट ईष्ण करटबन्धीय झयड़ दकथम के वन ह ैं; 2954 GI/2017 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] औ , त्रों औ औ औ औ और सरं धक्षत करनय तथय ईि पयररधथथधतक संवेदी जोन म ें ईद्योगों यय ईद्योगों के वगों के प्रचयलन तथय प्रसंथकरण करन े प्रधतधिध करनय अवश्यक ह।ै ऄतः, ऄब, केन्रीय सरकयर, पययावरण (संरक्षण) धनयम, 1986 के धनयम 5 के ईपधनयम (3) के सयथ परठत पययावरण (संरक्षण) ऄधधधनयम, 1986 (1986 कय 29) की धयरय 3 की ईपधयरय (1), ईपधयरय (2) के खंड (v) और खंड (xiv) और ईपधयरय (3) के सयथ परठत द्वयरय प्रदत्त िधियों कय प्रयोग करत े हुए, तले गं यनय रयज्य म ें मंजीरय वन्यजीव ऄभययरण्य की सीमय से एक दकलोमीटर तक के धवथ तयररत क्षेत्र को मंजीरय वन्यजीव ऄभययरण्य पयररधथ थधतक संवेदी जोन (धजस े आसमें आसके पश् चयत् पयररधथ थधतक संवेदी जोन कहय गयय ह)ै के प प म ें ऄधधसूधचत करती ह,ै धजसकय धववरण धनम्नयनुसयर ह,ै ऄथयात ् :-- 1. पयररधथथधतक संवदे ी जोन कय धवथतयर और ईसकी सीमयए-ं -(1) पयररधथथ धतक संवेदी जोन तले ंगयनय के मडे क धजल े म ें 65.28 वगा दकलोमीटर में फैलय ह ैऔर आसमें मडे क धजल ेके 12 ग्रयमों और 2 मडं ल, सदयधिपेट और पलु कल सधम्मधलत ह ै। (2) पयररधथथधतक संवेदी जोन कय धवथतयर मंजीरय वन्यजीव ऄभययरण्य की सीमय से एक दकलोमीटर तक होगय । (3) पयररधथथधतक संवेदी जोन की सीमयओं कय वणान ईपयबधं I और ग्रयमों की सूची ईपयबधं II के प प म ेंसंलग्न ह ै। (4) आस ऄधधसूचनय म ें ऄक्षयंि और देियंतर के सयथ पयररधथथधतक संवेदी जोन की सीमय कय मयनधचत्र ईपयबधं III के प प में संलग्न ह ै। 2. पयररधथथधतक संवदे ी जोन के धलए अचं धलक महययोजनय – (1) रयज्य सरकयर, पयररधथथधतक संवेदी जोन के प्रयोजन के धलए रयजपत्र म ें ऄधधसूचनय के प्रकयिन की तयरीख स े दो विा की ऄवधध के भीतर, थथयनीय व्यधियों के परयमि ा से और आस ऄधधसूचनय में सलं ग् न ऄनुबंधों के सयमंजथ य से अंचधलक महययोजनय तैययर करेगी । (2) रयज्य सरकयर द्वयरय पयररधथथ धतक संवेदी जोन के धलए अचंधलक महययोजनय आस तरह, आस ऄधधसूचनय में धवधनर्ददष् ट प प तथय सुसंगत केंरीय और रयज्य धवधधयों के सयमंजथ य और केंरीय सरकयर द्वयरय जयरी मयगाधनददेशिों, यदद कोइ हों, द्वयरय तैययर होगी । (3) अंचधलक महययोजनय, पययावरणीय और पयररधथथधतक धवचयरों को समयकधलत करन े के धलए रयज्य सरकयर के सभी संब् धवभयगों के परयमि ासे तैययर होगी, ऄथयता ्:-- (i) पययावरण; (ii) वन और वन्यजीव; (iii) कृधि औ ; (iv) रयजथ व; (v) नगर धवकयस; (vi) पययावरण पयाटन सधहत पयाटन; (vii) ग्रयमीण धवकयस; (viii) ससचयइ और बयढ़ धनयंत्रण; (ix) नगरपयधलकय औ ; (x) पंचययती रयज; (xi) लोक धन मयाण धव भयग। (4) अंचधलक महययोजनय ऄनुमोददत धवद्यमयन भू-ईपयोग, ऄवसंरचनय और दक्रययकलयपों पर कोइ धनबंधन ऄधधरोधपत नहीं करेगी जब तक दक आस ऄधधसूचनय म ें धवधनर्ददष् ट न हो और अचंधलक महययोजनय सभी ऄवसंरचनय और दक्रययकलयपों में और ऄधधक दक्षतय और पयररधथथधतक ऄनुकूलतय कय संवधान करेगी । (5) अंचधलक महययोजनय म ें ऄनय्छयददत क्षेत्रों के जीणो्यर, धवद्यमयन जल धनकययों के संरक्षण, अवयह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भूतल जल के प्रबंधन, मृदय और नमी संरक्षण, थथयनीय समुदययों की अवश्यकतयओं तथय पयररधथथधतक और पययावरण से संबंधधत ऐसे ऄन्य पहलओंू , धजन पर ध्ययन देनय अवश्यक ह,ै के धलए ईपबंध होंग े ।II (ii) 3 (6) अंचधलक महययोजनय सभी धवद्यमयन पूजय थथ लों, ग्रयमों और िहरी बंदोबथतों, वनों के प्रकयर और दकथ मों, कृधि क्षेत्रों, उपजयउ भूधम, हररत क्षत्रे जैसे ईद्ययन और ईसी प्रकयर के थथ यन, ईद्ययन कृधि क्षत्रे , फलोईद्ययन, झीलों और ऄन्य जल धनकययों कय ऄभ्यकंन करेगी और आस योजनय के मयनधचत्र द्वयरय धवद्यमयन और प्रथतयधवत भूधम के ईपयोग कय भी धववरण दकयय जयएगय । (7) अंचधलक महययोजनय थ थयनीय समुदययों की जीवकोपयजान को सुधनधश् चत करने के धलए भी पयररधथथधतक संवेदी जोन में धवकयस को पयररधथथधतक ऄनुकूल धवकयस के धलए सयरणी के सूचीब् दक्रययकलयप धवधनयधमत करेगी । (8) अंचधलक महययोजनय क्षेत्रीय धवकयस योजनय के सयथ सह-ऄंतक होगी । (9) अंचधलक महययोजनय आस ऄधधसूचनय म ें ददए गए ईपबंधों के ऄनुसयर म ें ऄपने कययों के बयहर ल े जयन े के धलए धनगरयनी सधमधत के धलए एक संदभा दथतयवेज तैययर करेगी । 3. रयज्य सरकयर द्वयरय दकए जयन े वयल े ईपयय-- रयज्य सरकयर, आस ऄधधसूचनय के ईपबंधों को प्रभयवी करने के धलए धनम्नधलधखत ईपयय करेगी, ऄथयात्:-- (1) भू-ईपयोग – ( ) पयररधथथ धतक संवेदी जोन म ें वनों, ईद्ययन-कृधि क्षेत्रों, कृधि क्षेत्रों, अमोद-प्रमोद के प्रयोजन के धलए धचधन्हत दकए गए पयकों और खुल े थथयनों कय वयधणधज्यक और औद्योधगक संब् धवकयस दक्रययकलयपों के धलए ईपयोग यय संपररवतान नहीं होगय। के सयथ में थपष्ट प प से क्षेत्रों को धनधयाररत दकयय गयय ह:ै परंत ु पयररधथथधतक संवेदी जोन के भीतर कृधि भूधम कय संपररवतान धनगरयनी सधमधत की धसफयररि पर और रयज्य सरकयर के पूवा ऄनुमोदन से, क्षेत्रीय नगर योजनय ऄधधधनयम के तहत सक्षम प्रयधधकयरी के पूवा ऄनुमोदन के सयथ और केन्रीय/रयज्य सरकयर के ऄन्य धनयमों और धवधनयमों के प प म ें लयग ू होंग,े जो थथयनीय धनवयधसयों की अवयसीय जप रतों को पूरय करन े के धलए ह,ै जैस:े - (i) धवद्यमयन सड़कों को चौड़य करनय और ईन्ह ेंसुदढृ करनय तथय नइ सड़कों कय संधनमयाण; (ii) बुधनययदी ढयंचों और नयगररक सुधवधयओं कय संधनमयाण और नवीकरण; (iii) प्रदिू ण ईत्पन्न न करने वयल े लघ ुईद्योग; (iv) कुटीर ईद्योगों धजसके ऄंतगात ग्रयमीण कयरीगर ह;ैं सुधवधयजनक भण्डयर और थथयनीय सुधवधयओं सहययक पयररधथथधतक पयाटन म ेंसधम्मधलत गृह वयस; और (v) संवर्वधत दक्रययकलयप और ऄनु्छेद 4 के ऄंतगात ददयय गयय ह:ै परंत ु यह और भी दकसी जनजयतीय भूधम कय ईपयोग रयज्य सरकयर के संब् रयज्य धवधधयों और ऄन्य धनयमों तथय धवधनयमों के ऄधीन सक्षम प्रयधधकयरी के पूवा ऄनुमोदन तथय संधवधयन के ऄन्ु छेद 244 प्रवृत्त धवधध के ईपबंधों के ऄनुपयलन के धबनय, यय तत्समय प्रवृत्त धवधध धजसके ऄंतगता ऄनुसूधचत जनजयधत और ऄन्य परंपरयगत वन धनवयसी (वन ऄधधकयरों की मयन्यतय) ऄधधधनयम, 2006 (2007 कय 2) भी ह,ै वयधणधज्यक यय ईद्योग धवकयस दक्रययकलयपों के धलए जनजयतीय भूधम कय ईपयोग ऄनुज्ञयत नहीं होगय: परंत ु यह और भी दक पयररधथ थधतक संवेदी जोन के भीतर भू-ऄधभलेखों म ें ईपसंजयत कोइ त्रुरट, धनगरयनी सधमधत के धवचयर प्रयप्त करन े के पश्चयत ् रयज्य सरकयर द्वयरय प्रत्येक मयमले में एक बयर संिोधधत होगी और ईि त्रुरट के संिोधन की सूचनय केंरीय सरकयर के पययावरण, वन और जलवयय ुपररवतान मंत्रयलय को देनी होगी । परंत ु यह और भी दक ईपयुाि त्रुरट कय संिोधन म ें आस ईप पैरय के ऄधीन यथय ईपबंधधत के धसवयय दकसी भी दिय म ें भू- ईपयोग कय पररवतान सधम्मधलत नहीं होगय । (ख) ऄनप्रयुक्त यय ऄनुत् पयदक कृधि क्षेत्रों में पनु : वनीकरण करने के प्रययस दकए जयएंग े । (2) प्रयकृधतक जल धनकयय -- अचंधलक महययोजनय म ें सभी प्रयकृधतक जल स्रोतों, नददयों, चैनलों की पहचयन की जयएगी और ईनके संरक्षण और पुनरुद्भूतकरण के धलए योजनय सधम् मधलत होगी। (3) पयटा न/पयररधथथधतक-पयटा न – (क) पयररधथथधतक संवेदी जोन के भीतर पयाटन संबंधी दक्रययकलयप पयाटन महययोजनय के ऄनुसयर होंगे जो दक अंचधलक महययोजनय के भयग प प म ेंहोगी ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) पयररधथथधतक पयाटन महययोजनय, पययावरण और वन के रयज्य धवभयगों के परयमिा , पयाटन धवभयग द्वयरय तैययर दकयय जयएगय । (ग) पयाटन महययोजनय अंचधलक महययोजनय के एक घटक के प प म ेंजयनय जययेगय । (घ) पयाटन संबंधी दक्रययकलयप धनम्न धलधखत के ऄधीन धवधनयधमत होंग,े ऄथयात ् :- (i) पयररधथथधतक ऄनुकूल पयाटन दक्रययकलयप से संबंधधत पयटा कों के ऄथथययी ऄधधभोग के धलए वयस सुधवधय के धसवयय संरधक्षत क्षेत्र की सीमय से एक दकलोमीटर तक यय पयररधथथधतक संवेदी जोन के धवथतयर तक आनमें जो भी धनकट ह,ै नय े वयधणधज्यक होटल और ररसोटा ऄनुज्ञयत नहीं होंगे। परंत,ु जहयाँ पयररधथथधतक संवेदी जोन कय धवथतयर एक दकलोमीटर से ज्ययदय ह ै वहयाँ, एक दकलोमीटर से परे और पयररधथथधतक संवेदी जोन के धवथतयर तक सभी नए पयाटक दक्रययकलयप यय धवद्यमयन दक्रययकलयप कय धवथतयर पयटा न महययोजनय के ऄनुसयर होगय; (ii) पयररधथथधतक संवेदी जोन के भीतर सभी नए पयाटन दक्रययकलयपों यय धवद्यमयन पयाटन दक्रययकलयपों कय धवथतयर केंरीय सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय के मयगादिाक धस्यंतों के द्वयरय तथय रयष्र ीय ा ययघ्र संरक्षण प्रयधधकरण, द्वयरय जयरी पयररधथथधतक पयटा न (समय-समय पर यथय संिोधधत) मयगादिाक धस्यंतों के ऄनुसयर, पयररधथथधतक पयाटन, पयररधथथधतक धिक्षय और पयररधथथधतक धवकयस को महत्व देते हुए पयररधथथधतक संवेदी जोन की वहन क्षमतय के ऄध्ययन पर अधयररत होगय; (iii) अंचधलक महययोजनय कय ऄनुमोदन दकए जयने तक, पयाटन के धलए धवकयस और धवद्यमयन पयाटन दक्रययकलयपों के धवथतयर को वयथतधवक थथल धवधनर्ददष्ट संवीक्षय तथय धनगरयनी सधमधत की धसफयररि पर अधयररत संबंधधत धवधनययमक प्रयधधकरणों द्वयरय ऄनुज्ञयत दकयय होगय । (4) नसै र्वगक धवरयसत -- पयररधथथधतक संवेदी जोन में महत्वपूणा नैसर्वगक धवरयसत के सभी थथलों जैसे सभी जीन कोि अरधक्षत क्षत्रे , िैल धवरचनयएं, जल प्रपयतों, झरनों, घयटी मयगों, ईपवनों, गुफयए,ं थथलों, भ्रमण, ऄिरोहण, प्रपयतों अदद की पहचयन की जयएगी और धवरयसत संरक्षण योजनय अंचधलक महययोजनय के भयग के रुप में परररक्षण और संपका के धलए तैययर करेगी । (5) मयनव धनर्वमत धवरयसत थथ ल - पयररधथ थधतक संवेदी जोन म ें भवनों, संरचनयओं, धिल्प-तथ्य, ऐधतहयधसक, कलयत्मक और सयंथकृधतक महत्व के क्षेत्रों की पहचयन करनी होगी और ईनके संरक्षण की योजनयएं तैययर करनी होगी तथय अंचधलक महययोजनय म ें भयग होगी । (6) ध्व धन प्रदिू ण – पयररधथथधतक संवेदी जोन म ें धनवयरण और ध्वधन प्रदिू ण धनयंत्रण पययावरण (संरक्षण) ऄधधधनयम, 1986 के ऄधीन ध्वधन (धवधनयमन और धनयंत्रण) धनयम 2000 के ऄनुसयर संकधलत दकयय जयएगय । (7) वयय ु प्रदिू ण -- पयररधथथधतक संवेदी जोन म ें धनवयरण और धनयंत्रण, वयय ु (प्रदिू ण धनवयरण और धनयंत्रण) ऄधधधनयम 1981 (1981 कय 14) और आसके ऄधीन दकए गए धनयमों के ऄनुसयर संकधलत दकयय जयएगय । (8) बधहस्रयव कय धनथसयरण -- पयररधथथधतक संवेदी जोन म ें ईपचयररत बधहस्रयव कय धनथसयरण सयधयरण मयनकों के धलए पययावरणीय प्रदधू ित अ्छयददत के धनथसयरण के ऄंतगात पययवा रणीय (संरक्षण) ऄधधधनयम, 1986 और ईसके ऄधीन बनयए गए धनयमों के ईपबंधों के ऄनुसयर होगय। (9) ठोस ऄपधिष्ट -- ठोस ऄपधिष्टों कय धनपटयन धनम्नधलधखत प प म ेंहोगय-- (क) पयररधथथधतक संवेदी जोन म ें ठोस ऄपधिष्ट और प्रबंधन समय-समय पर संिोधधत ठोस ऄपधिष्ट प्रबंधन धनयम, 2016, जो भयरत सरकयर के पययावरण, वन और जलवययु पररवतना मंत्रयलय की ऄधधसूचनय सं. कय.अ. 1357(ऄ), तयरीख 8 ऄप्रैल, 2016 द्वयरय प्रकयधित दकए गए थे, के दक्रययन्वयन के ऄनुसयर दकयय जयएगय ; (ख) खनन संदक्रययएं, मयननीय ईच्चतम न्ययययलय की ररट ययधचकय (धसधवल) सं. 1995 कय 202 टी.एन. गौडयबमान धथरुमूलपयद बनयम भयरत सरकयर के मयमले में अदिे तयरीख 4 ऄगथत, 2006 और ररट ययधचकय (सी) सं. 2012 कय 435 गोवय फयईंडेिन बनयम भयरत सरकयर के मयमले में तयरीख 21 ऄप्रैल, 2014 के ऄंतररम अदिे के ऄनुसरण में सवादय प्रचयलन होगय । 2. जल यय वययु यय मृदय यय ध्व धन प्रदिू ण कयररत कोइ नइ यय पयररधथथधतक संवेदी जोन में प्रदिू ण फैलयने वयले ईद्योगों के करने वयले ईद्योगों की थथ यपनय । धवथतयर की ऄनुज्ञय नहीं दी जयएगी। पयररधथथधतक संवेदी जोन के केंरीय प्रदिू ण धनयंत्रण बोडा द्वयरय जयरी ददियधनदिदेश ों में फरवरी, 2016 के भीतर धसफा गैर- प्रदधूित ईद्योगों की थथयपनय के वगीकरण की ऄनुज्ञय दी जयएगी, जब तक दक आस ऄधधसूचनय में धवधनर्ददष्ट न हो। 3. नए बृहत जल धवद्युत पररयोजनय और ससचयइ लयगू धवधधयों के ऄनुसयर प्रधतधि् (ऄन् यथय ईपबंधधत के धसवयय) होंगे । पररयोजनय की थथ यपनय । 4. दकसी पररसंकटमय पदयथों कय ईपयोग यय लयगू धवधधयों के ऄनुसयर प्रधतधि् (ऄन् यथय ईपबंधधत के धसवयय) होंगे । ईत्पयदन । 5. प्रयकृधतक जल धनकययों यय भूधम क्षेत्र में लयगू धवधधयों के ऄनुसयर प्रधतधि् (ऄन् यथय ईपबंधधत के धसवयय) होंगे । ऄनुपचयररत प्रवयह के धनवाहन । 6. ठोस ऄपधिष्ट धनपटयन थथल की थथयपनय और पयररधथथधतक संवेदी जोन में ठोस ऄपधिष्ट धनपटयन की कोइ नइ ठोस सयमयन्य जलयए जयने की सुधवधय के धलए ठोस ऄपधिष्ट धनपटयन थथल और ऄपधिष्ट ईपचयररत/प्रसंथकरण सुधवधय की और जैव धचदकत्सय ऄपधिष्ट। ऄनुज्ञय नहीं ह।ै औद्योधगक प्रदक्रयय और थवयथथ्य प्रधतष्ठयन/ऄथपतयलों अदद से ईत्पन्न दकसी भी ठोस ऄपधिष्ट के ईपचयररत के धलए सयमयन्य यय व्यधिगत जलयवतरण की सुधवधय कय ऄधधकतर प्रधतधि् है । 7. फमों, कॉपोरेट, कंपधनयों द्वयरय बड़ े पैमयने पर थथयनीय जप रतों को पूरय करने के धलए लयगू धवधधयों के ऄनुसयर प्रधतधि् वयधणधज्यक पिुधन संपदय और कुक्कुट फयमों की (ऄन् यथय ईपबंधधत के धसवयय) होंगे। थथयपनय । 8. नइ अरय धमलों की थथयपनय। पयररधथथधतक संवेदी जोन के भीतर नइ और धवद्यमयन अरय धमलों कय धवथत यर ऄनुज्ञयत नहीं होगय । 9. ईंट भट्टों की थथयपनय करनय। लयगू धवधधयों के ऄनुसयर प्रधतधि् (ऄन् यथय ईपबंधधत के धसवयय) होंगे । 10. प्ल यधथ टक के थैलों कय ईपयोग । लयगू धवधधयों के ऄनुसयर प्रधतधि् (ऄन् यथय ईपबंधधत के धसवयय) होंगे । 11. जलयवन लकड़ी कय वयधणधज्यक ईपयोग । लयगू धवधधयों के ऄनुसयर प्रधतधि् (ऄन् यथय ईपबंधधत के धसवयय) । 12. नए कयष् ठ अधयररत ईद्योग । लयगू धवधधयों के ऄनुसयर प्रधतधि् (ऄन् यथय ईपबंधधत के धसवयय) होंगे । ख. धवधनयधमत दक्रययकलयप 13. होटलों और ररसोटों की थथयपनय । पयररधथथधतक पयाटन दक्रययकलयपों संबंधी पयाटकों की लघु संरचनयओं केII (ii) 7 धलए संरधक्षत क्षेत्र की सीमय से एक दकलोमीटर तक यय पयररधथथधतक संवेदी जोन के धवथतयर तक, आनमें जो भी धनकट ह,ै नए वयधणधज्यक होटल और ररसोटा ऄनुज्ञयत होंगे, ऄन्यथय नहीं । परंतु, जहयाँ पयररधथथधतक संवेदी जोन कय सीमय एक दकलोमीटर से ज्ययदय ह ै वहयाँ, एक दकलोमीटर से परे और पयररधथथधतक संवेदी जोन के धवथतयर तक सभी नए पयाटक दक्रययकलयप यय धवद्यमयन दक्रययकलयप कय धवथतयर पयाटन महययोजनय और यथय लयगू मयगादिाक धस्यंतों के ऄनुरुप होगय। 14. संधनमयणा दक्रययकलयप । (क) संरधक्षत क्षेत्र यय पयररधथथधतक संवेदी जोन जो भी धनकट हो, की सीमय से एक दकलोमीटर के भीतर दकसी भी प्रकयर कय वयधणधज्यक संधनमयणा ऄनुज्ञयत नहीं दकयय जयएगय: परंतु थ थयनीय लोगों को पैरय 6 के ईप पैरय (1) में सूचीब् दक्रययकलयपों सधहत ईनके अवयसीय ईपयोग के धलए ईनकी भूधम में संधनमयाण करने की ऄनुमधत भवन ईपधवधधयों के ऄनुसयर दी जयएगी । (i) धवद्यमयन सड़कों को चौड़य करनय और ईन्हें सुदढृ करनय तथय नइ सड़कों कय संधनमयाण; (ii) ऄवसंरचनय ढयंचों और नयगररक सुधवधयओं कय संधनमयाण और नवीकरण; (iii) केंरीय प्रदिू ण धनयंत्रण बोडा द्वयरय जयरी ददियधनदिदेश ों में फरवरी, 2016 के भीतर धसफा गैर- प्रदधूित ईद्योगों की थथयपनय के वगीकरण; (iv) कुटीर ईद्योगों धजसके ऄंतगात ग्रयमीण ईद्योग हैं; सुधवधयजनक भण्डयर और थथयनीय सुख सुधवधयओं जो पयररधथथधतक पयाटन धजस म ें सहययक हो गृह वयस; और (v) आस ऄधधसूचनय में सूचीब् दक्रययकलयपों की सूची : (ख) परन्तु ऐसे लघु ईद्योगों जो प्रदिू ण ईत् पन् न नहीं करते हैं, से संबंधधत संधनमयणा दक्रययकलयप धवधनयधमत दकए जयएंगे और लयगू धनयमों और धवधनयमों, यदद कोइ हों, के ऄनुसयर सक्षम प्रयधधकयरी की पूवा ऄनुज्ञय से ही न् यूनतम पर रखे जयएंगे । (ग) एक दकलोमीटर से परे अंचधलक महययोजनय की ऄनुसयर धवधनयधमत होंगे । 15. प्रदिू ण ईत्पन्न न करने वयले लघु ईद्योग । पयररधथथधतक संवेदी जोन के केंरीय प्रदिू ण धनयंत्रण बोडा द्वयरय जयरी ददियधनदिदेश ों में फरवरी, 2016 के भीतर धसफा गैर- प्रदधूित ईद्योगों की थथयपनय के वगीकरण की ऄनुमधत दी जयएगी, जब तक दक आस ऄधधसूचनय में धवधनर्ददष्ट न हो । आसके ऄलयवय, गैर-प्रदधूित कुटीर ईद्योगों को प्रधतधि् दकयय जयएगय। 16. वृक्षों की कटयइ । (क) रयज्य सरकयर म ें सक्षम प्रयधधकयरी की पूवा ऄनुज्ञय के धबनय वन, सरकयरी यय रयजथव यय धनजी भूधम पर यय वनों में ककही वृक्षों की कटयइ नहीं होगी ।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) वृक्षों की कटयइ संबंधधत केंरीय यय रयज्य ऄधधधनयम यय ईसके ऄधीन बनयए गए धनयमों के ईपबंध के ऄनुसयर धवधनयधमत होगी । 17. वन ईत्पयदों और गैर कयष् ठ वन ईत्पयद लयगू धवधधयों के ऄधीन धवधनयधमत होंगे । (एन.टी.एफ.पी.) कय संग्रहण । 18. धवद्युत केबलों और दरू संचयर टयवरों कय लयगू धवधधयों के ऄधीन धवधनयधमत होंगे । भूधमगत केबल को बढ़यवय ददयय पररधनमयाण और केबल धबछयनय और ऄन्य जयएगय। बुधनययदी ढयंचे । 19. नयगररक सुधवधयओं सधहत बुधनययदी ढयंचे। लयग ू धवधधयों के ऄनुसयर न्यूनीकरण की ईपययों के सयथ, धनयम और धवधनयमन और ईपलब्ध ददियधनदिदेश धवधनयधमत होंगे। 20. धवद्यमयन सड़कों को चौड़य करनय और ईन्हें लयग ू धवधधयों के ऄनुसयर न्यूनीकरण की ईपययों के सयथ, धनयम और सुदढृ करनय । धवधनयमन और ईपलब्ध ददियधनदिदेश धवधनयधमत होंगे। 21. पयाटन से संबंधधत दक्रययकलयप जैसे गमा वययु लयगू धवधधयों के ऄधीन धवधनयधमत होंगे । गुब्बयरें, हले ीकयप्टर, ड्रोन, मयआक्रोलयआटस और ऄन्य पयाटन दक्रययकलयप अदद द्वयरय पयररधथथधतक संवेदी जोन क्षेत्र के उपर से ईड़नय जैसे दक्रययकलयप करनय। 22. पहयड़ी ढयलों और नदी दकनयरों कय संरक्षण । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे । 23. रयधत्र में ययधनक ययतयययत कय संचलन । लयगू धवधधयों के ऄधीन वयधणधज्यक प्रयोजन के धलए धवधनयधमत होंगे । 24. थथयनीय समुदययों द्वयरय चल रही कृधि और थथयनीय लोगों के ईपयोग के धलए लयगू धवधधयों के ऄधीन धवधनयधमत बयगवयनी प्रथयओं के सयथ पिुपयलन, पिुपयलन होंगे । कृधि और मछली पयलन । 25. प्रयकृधतक जल धनकययों यय सतही क्षेत्र में ईपचयररत बधहस्रयाव के पुनचाक्रण को प्रोत्सयधहत करने और ऄवमल यय ठोस ईपचयररत बधहस्रयाव कय धनथसयरण । ऄपधिष्टों के धनपटयन के धलए धवद्यमयन धवधनयमों कय ऄनुपयलन दकयय जयएगय । ऄन्यथय लयगू धवधधयों के ऄधीन ईपचयररत बधहस्रयाव के पुनचक्रा ण/प्रवयह के धनवाहन को धवधनयधमत दकयय जयएगय। 26. सतह और भूजल के वयधणधज्यक धनष्किाण । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे । 27. खुले कुअ, बोर कुअ, अदद के धलए कृधि और धवधनयधमत और ईपयुि प्रयधधकयरी द्वयरय दक्रययकलयपों की सख्ती से ऄन्य ईपयोग । धनगरयनी की जयएगी। 28. ठोस ऄपधिष् ट प्रबंधन। लयगू धवधधयों के ऄधीन धवधनयधमत होंगे । 29. धवदिे ी प्रजयधतयों को लयनय । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे । 30. पयररधथथधतक पयाटन। लयगू धवधधयों के ऄधीन धवधनयधमत होंगे । 31. वयधणधज्य क सयआनबोडा और होर्डडग । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे । ग. सवं र्वधत दक्रययकलयप 32. विया जल संचयन । सदक्र य प प से बढ़यवय ददयय जयएगय । 33. जैधवक खेती। सदक्र य प प से बढ़यवय ददयय जयएगय । 34. सभी गधतधवधधयों के धलए हररत प्रौद्योधगकी को सदक्र य प प से बढ़यवय ददयय जयएगय । ऄंगीकृत करनय । 35. कुटीर ईद्योगों धजसके ऄंतगात ग्रयमीण कयरीगर भी सदक्र य प प से बढ़यवय ददयय जयएगय । ह ैं।II (ii) 9 36. नवीकरणीय उजया स्रोत कय ईपयोग । बययोगैस, सौर प्रकयि अदद को बढ़यवय ददयय जयनय ह ै। 37. कृधि वयधनकी । सदक्र य प प से बढ़यवय ददयय जयएगय । 38. पयररधथथधतक ऄनुकूल पररवहन कय ईपयोग । सदक्र य प प से बढ़यवय ददयय जयएगय । 39. कौिल धवकयस । सदक्र य प प से बढ़यवय ददयय जयएगय । 40. धनम्नीकृत भूधम यय वन यय अवयस प्रत्ययवतान । सदक्र य प प से बढ़यवय ददयय जयएगय । 41. पययावरणीय जयगरुकतय । सदक्र य प प से बढ़यवय ददयय जयएगय । 5. धनगरयनी सधमधत- केंरीय सरकयर, पययावरण (संरक्षण) ऄधधधनयम, 1986 (1986 कय 29) की धयरय 3 की ईपधयरय (3) द्वयरय प्रदत्त िधियों कय प्रयोग करते हुए तीन विा की ऄवधध के धलए धनगरीनी सधमधत गरठत करती ह,ै पयररधथथधतक संवेदी जोन की धनगरयनी प्रभयवी के धलए धजसमें धनम्नधलधखत से धमलकर बनेगी:-- (क) धजलय कलक्टर, मडे क - ऄध्यक्ष ; And Whereas, copies of the Gazette were made available to the public on the 10th November, 2015; And Whereas, no objections and suggestions received from persons and stakeholders in response to the draft notification; And Whereas, the Manjeera Wildlife Sanctuary (hereinafter referred to as the Sanctuary) is situated in the Medak District in Telangana between 17.09’.45” to 17.12’.15” North latitude and between 78.02’.15” to 78.04’.48” East longitude and it is water body between two dams Manjeera and Singoor projects. The area of Sanctuary is 20 square kilo meters; And Whereas, the Sanctuary is abode for the mugger crocodile and home to five species of cultured fishes, 10 species of amphibians, 26 species of reptiles, 18 species of Mammals and over 170 species of bird species; And Whereas, the Sanctuary is an important habitat for aquatic avifauna and a number of resident and migratory birds such as Oriental Darter, Black Ibis, White Ibis, Glossy Ibis, Black winged Stilt, Painted Storks, Open billed Storks, Spoon bills, Comb ducks, Cotton teals, Whistling teals, Red crested Pochards, Common Pochards, Brahminy Ducks, Grey Pelicans, Brown Headed Gulls, Bar headed Geese, Osprey, Marsh harrier, Demoiselle Cranes and Swallows stay here;14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] And Whereas, the Manjeera Wildlife Sanctuary has reservoir which is dotted with nine islands and support submergent and emergent vegetation such as Typa sp. Ipomea sp. Nymphoides hydrophylla, Polygonum glabrum, Leucas aspera, Centella asiatica, Hydrilla verticillata, Vallisneria spiralis and Marsilea quadrifolia and the forest tracts have typical tropical scrub forest type; And Whereas, it is necessary to conserve and protect the area around the Manjeera Wildlife Sanctuary and to propagate improvement and development of the wildlife therein and its environment. AND WHEREAS, it become necessary to specify certain areas around the Manjeera Wildlife Sanctuary as Eco-sensitive Zone and to prohibit industries, operations or processes or class of industries, operations or processes in the said Eco-sensitive Zone. Now, therefore, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of sub–section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub- rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of upto one kilometer from the boundary of the protected area of Manjeera Wildlife Sanctuary in the State of Telangana, as the Manjeera Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:- 1. Extent and boundary of Eco-sensitive Zone.-(1) The Eco-sensitive Zone is spread over an area of 65.28 square kilometer in Medak District of Telangana and includes 12 villages of 2 Mandals viz. Sadasivapet and Pulkal in Medak District. (2) The of Eco-sensitive Zone extends up to one kilometer from the boundary of Manjeera Wildlife Sanctuary. (3) The boundary description of the Eco-sensitive Zone is annexed as Annexure I and the list of villages are given in Annexure-II. (4) The map of Eco-sensitive Zone boundary together with latitudes –longitudes is annexed to this notification as Annexure III. 2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture & Horticulture; (iv) Revenue; (v) Urban Development; (vi) Tourism including eco-tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal & urban development; (x) Panchayati Raj; (xi) Public Works Department.II (ii) 15 (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Landuse.- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities: Provided that the conversion of agricultural and other lands, for the purpose other within the Eco- sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the relevant State laws and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents under- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including home stay; and (v) promoted activities and given under para 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the relevant State laws and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat and biodiversity restoration activities.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (2) Natural water bodies.- The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan. (3) Tourism/ Eco-tourism.- (a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b)The Eco-tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The activities of Eco-tourism shall be regulated as under, namely:- (i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer and beyond the distance of 1 km. from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan. (ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism. (iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within Eco-sensitive Zone area. (4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan. (6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder. (8) Discharge of effluents.- Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under:- (a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. (b)No burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco- sensitive Zone.II (ii) 17 (10) Bio-medical waste.- Bio medical waste management shall be as under: (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016. (b)No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone. (11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016,. (12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016,. (13) E-waste.- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change. (14) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular Pollution.- Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws and the efforts to be made for use of cleaner fuel for example CNG, LPG, etc. (16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted. (17) Protection of Hill Slopes.- The protection of hill slopes shall be as under:- (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted. (18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:-18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] TABLE S. Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as: (i) Widening and strengthening of existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016; (iv) Cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including home stays; and (v) Promoted activities listed in this Notification. Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan. 15. Monitoring Committee:- (1) In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone, which shall comprise of, namely:- (a) District Collector, Medak - Chairman; (b) One representative of Non Governmental Organisation working in the field of environment to be nominated by the Government of Telangana for a term of three years in each case -Member; (c) One expert in the area of ecology and environment to be nominated by the Government of Telangana for a term of three years in each case – Member; (d) Regional Officer,State Pollution Control Board, Medak – Member; (e) Senior Town Planner of the area – Member; (f) Divisional Forest Officer (T), Medak – Member; (g) Revenue Divisional Officer of the area – Member; (h) Member, Biodiversity Board-Member; and (i) District Wildlife Warden, Medak – Member Secretary. Terms of Reference: (2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure IV. (8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. F.
