और, उि रयजप्, क प्रधर्र्यत जनर्य को र्यरीख 15 जनवरी, 2016, को उपलब्ि करय दी गई थी; और, उि प्रयरुप अधिसूचनय के प्रत्र्ुत्तर ंें व्यधिर्ों और पणियररर्ों से कोई आक्षेप और सुक्षयव प्रयप्त नहीं हुए है; कनयाटक, धजलय बेलयरी के कुदलीजी और सतदरू र्यलुकयओं ंें गुडेकोटे रीछ अभर्यरण् र् 1 050 से 110 06 उत् र्र अक्षयति और 76037 और 550 7 पूवा दिे यतर्र ंें ध‍ थर् ह ैधजसके अतर्गार् 47.61 वगा दकलोंीटर के कुल भौगोधलक क्षे् को, अधिसूचनय सत एफईई-72 एफडब््र्ूएल-2013 ददनयतक 11.11.2013 और सत एफईई 432 एफडब््र्ूएल 2014 ददनयतक: 21-09-2016 ंुख्र् र्: सतकट्रस‍र् ‍ र्नपयर्ी रीछ के सतरक्षण के धलए अधिसूधचर् दकर्य गर्य थय; और, अभर्यरण् र् के गुफयओं के सयथ च्यनीर् धिलयखतड, झयडीदयर जतगल रीछ के धलए एक आदिा प्रयकृधर्क वयस ह।ै अभर्यरण् र् ंें लयल चतदन, फयइकस, आदद जैसी वृक्ष प्रजयधर्र्यत और रीछ, र्ेंदआु , सयल, गतदधबलयव, बनधबलयर, बनैलय सूअर, धसर्यर, सयही, ब्लैक नेपड खरगोि, नेवलय, आदद, धजनंें से कुछ अनुसूची-1 क प्रजयधर्र्यत ह ैंऔर र्ह 150 प्रजयधर्र्य त के र्यररक कछुआ, अजगर, दबोइर्य लयलरेर्ी अजगर, कोबरय आदद जैसे पधक्षर्ों और सरीसृपों के धलए एक प्रयकृधर्क वयस कय भी धनंयाण करर्य है; और, रीछ अभर्यरण् र् पररसर के सयथ सयथ पयररध‍ थधर्क सतवेदी जोन क ‍ थयपनय करके रीछ, र्ेंदआु और अन् र् सतकट्रस‍र् जीवजतर्ु जैव धवधविर्य और उसके वन् र्जीव र्थय उसके पर्यावरण को सतरधक्षर् करनय और उसक सुरक्षय करनय आव्‍ र्क हो गर्य है; अर्ः, अब, केन्रीर् सरकयर, पर्यावरण (सतरक्षण) धनर्ं, 1986 के धनर्ं 5 के उपधनर्ं (3) के सयथ परठर् पर्यावरण (सतरक्षण) अधिधनर्ं, 1986 (1986 कय 29) क ियरय 3 क उपियरय (1), उपियरय (2) के खतड (v) और खतड (xiv) और उपियरय (3) द्वयरय प्रदत्त िधिर्ों कय प्रर्ोग करर्े हुए, कनयाटक रयज्र् ंें गुडेकोटे रीछ अभर्यरण् र् क सींय से 1.0 दकलोंीटर से 7.00 दकलोंीटर के चयरों रर र्क के धव‍र् यररर् क्षे् को गुडेकोटे रीछ अभर्यरण् र् पयररध‍ थधर्क सतवेदी जोन (धजसे इसंें इसके प्‍ चयर्प पयररध‍ थधर्क सतवेदी जोन कहय गर्य ह)ै के प प ंें अधिसूधचर् करर्ी है, धजसकय धववरण धनम्नयनुसयर है, अथयर्ा प :- 1. पयररध‍थधर्क सवत दे ी जोन कय धव‍र्यर और उसक सींयएत.—(1) पयररध‍थधर्क सतवेदी जोन 120.04 वगा दकलोंीटर (िीलीर्प्पनह्ली/अपेनह्ली और सतजीवयरयर्कोट आरधक्षर् वन क्षे् और कुछ खतड-4 क्षे् सधहर्) क्षे् ंें फैलय हुआ ह ै धजसकय धव‍र् यर गुडेकोटे रीछ अभर्यरण् र् क सींय के इद ाधगद ा1.0 दकलोंीटर से 7.00 दकलोंीटर के बीच है और उस जोन क सींय कय वणान उपयबित I ंें ददर्य गर्य ह ै। (2) अक्षयति और दिे यतर्र सधहर् पयररध‍थधर्क सतवेदी जोन कय ंयनधच् उपयबित II के रुप ंें उपयबद्ध ह ै। (3) गुडेकोटे रीछ अभर्यरण् र् क सींय पर और पयररध‍थधर्क सतवेदी जोन क सींय के प्रंुख बबतदओंु के भू- धनदिे यतक उपयबित III के रुप ंें उपयबद्ध ह ै। (4) गुडेकोटे रीछ अभर्यरण् र् के आस पयस पयररध‍थधर्क सतवेदी जोन ंें आने वयले ्रसयंों और ररजवा वन क्षे् कय वणान उपयबित IV के रुप ंें उपयबद्ध ह ै। 2. पयररध‍थधर्क सवत ेदी जोन के धलए आचत धलक ंहयर्ोजनय.—(1) रयज्र् सरकयर, पयररध‍थधर्क सतवेदी जोन के प्रर्ोजन के धलए रयजप् ं ें अधिसूचनय के प्रकयिन क र्यरीख से दो विा क अवधि के भीर्र, ‍थयनीर् व्यधिर्ों के परयंिा से और इस अधिसूचनय ंें सतलग्न अनुबतिों के सयंतज‍र् से आतचधलक ंहयर्ोजनय र्ैर्यर करेगी । (2) रयज्र् सरकयर द्वयरय पयररध‍ थधर्क सतवेदी जोन के धलए आचतधलक ंहयर्ोजनय इस र्रह, इस अधिसूचनय ंें धवधनर्द‍ा ट प प र्थय सुसतगर् केंरीर् और रयज्र् धवधिर्ों के सयंतज‍र् और केंरीर् सरकयर द्वयरय जयरी ंयगाधनदिे ों, र्दद कोई हों, द्वयरय र्ैर्यर होगी । (3) आतचधलक ंहयर्ोजनय, पर्यावरणीर् और पयररध‍थधर्क धवचयरों को संयकधलर् करने के धलए रयज् र् सरकयर के सभी सतबद्ध धवभयगों के परयंिा से र्ैर्यर होगी, अथयार्प:-- (i) पर्यावरण; (ii) वन और वन्र्जीव; (iii) कृधि और बयगवयनी; (iv) रयज‍व ; (v) िहरी धवकयस; (vi) पर्ाटन सधहर् पर्यावरण पर्ाटन; (vii) ्रसयंीण धवकयस; (viii) बसतचयई और बयढ़ धनर्त्ण; (ix) नगरपयधलक और िहरी धवकयस; (x) पतचयर्र्ी रयज; और (xi) लोक धन ंयाण धव भयग। (4) आतचधलक ंहयर्ोजनय अनुंोददर् धवद्यंयन भू-उपर्ोग, अवसतरचनय और दिर्यकलयपों पर कोई धनबंिन अधिरोधपर् नहीं करेगी जब र्क दक इस अधिसूचनय ंें धवधनर्द‍ा ट न हो और आचतधलक ंहयर्ोजनय सभी अवसतरचनय और दिर्यकलयपों ंें और अधिक दक्षर्य और पयररध‍थधर्क अनुकूलर्य कय सतविान करेगी ।II (ii) 3 (5) आतचधलक ंहयर्ोजनय ंें अनयच्छयददर् क्षे्ों के जीणोद्धयर, धवद्यंयन जल धनकयर्ों के सतरक्षण, आवयह क्षे्ों के प्रबतिन, जल- सतभरों के प्रबतिन, भूर्ल जल के प्रबतिन, ंृदय और नंी सतरक्षण, ‍थयनीर् संुदयर्ों क आव्‍र्कर्यओं र्थय पयररध‍थधर्क और पर्यावरण स े सतबतधिर् ऐसे अन्र् पहलूओं, धजन पर ध्र्यन दने य आव्‍र्क है, के धलए उपबति होंगे । (6) आतचधलक ंहयर्ोजनय सभी धवद्यंयन पूजय ‍ थलों, ्रसयंों और िहरी बतदोब‍र्ों, वनों के प्रकयर और दक‍ ंों, कृधि क्षे्ों, ऊपजयऊ भूधं, हररर् क्षे् जैसे उद्ययन और उसी प्रकयर के ‍ थयन, उद्ययन कृधि क्षे्, फलोउद्ययन, झीलों और अन्र् जल धनकयर्ों कय अभ्र्कतन करेगी। इस र्ोजनय के ंयनधच् द्वयरय धवद्यंयन और प्र‍र्यधवर् भूधं के उपर्ोग कय भी धववरण दकर्य जयएगय । (7) आतचधलक ंहयर्ोजनय ‍ थयनीर् संुदयर्ों क जीवकोपयजान को सुधनध्‍ चर् करने के धलए भी पयररध‍थधर्क सतवेदी जोन ंें धवकयस को पयररध‍थधर्क अनुकूल धवकयस के धलए सयरणी के सूचीबद्ध दिर्यकलयप धवधनर्धंर् करेगी । (8) आतचधलक ंहयर्ोजनय क्षे्ीर् धवकयस र्ोजनय के सयथ सह-अतर्क होगी । (9) आतचधलक ंहयर्ोजनय इस अधिसूचनय ंें ददए गए उपबतिों के अनुसयर ंें अपने कयर्ों के बयहर ले जयने के धलए धनगरयनी सधंधर् के धलए एक सतदभा द‍र्यवेज र्ैर्यर करेगी । 3. रयज्र् सरकयर द्वयरय दकए जयन े वयल े उपयर्.—रयज्र् सरकयर, इस अधिसूचनय के उपबतिों को प्रभयवी करने के धलए धनम्नधलधखर् उपयर् करेगी, अथयार्प:-- (1) भ-ू उपर्ोग – (क) पयररध‍ थधर्क सतवेदी जोन ंें वनों, उद्ययन-कृधि क्षे्ों, कृधि क्षे्ों, आंोद-प्रंोद के प्रर्ोजन के धलए धचधन्हर् दकए गए पयकों और खुले ‍थयनों कय वयधणधज्र्क और औद्योधगक सतबद्ध धवकयस दिर्यकलयपों के धलए उपर्ोग र्य सतपररवर्ान नहीं होगय।: (ख) परतर्ु पयररध‍थधर्क सतवेदी जोन के भीर्र भयग (क) ंें धवधनर्दष्टा प्रर्ोजन से धभन्न प्रर्ोजन के धलए कृधि और अन्र् भूधं कय सतपररवर्ान ंयनीटरी सधंधर् क धसफयररि पर और र्थय लयगू और क्षे्ीर् नगर र्ोजनय अधिधनर्ं र्थय केन्रीर्/रयज्र् सरकयर के अन्र् धनर्ंों र्थय धवधनर्ंों के अिीन सक्षं प्रयधिकयरी के पूवा अनुंोदन से, र्थय इस अधिसूचनय के उपबतिों द्वयरय ‍थयनीर् धनवयधसर्ों क धनम्नधलधखर् आवयसीर् जप रर्ों को पूरय करने के धलए अनुज्ञयर् दकर्य जयएगय, जैसे:- (i) धवद्यंयन सडकों को चौडय करनय और उन्ह ेंसुदढृ करनय र्थय नई सडकों कय सतधनंयाण; (ii) बुधनर्यदी ढयतचों और नयगररक सुधवियओं कय सतधनंयणा और नवीकरण; (iii) प्रदिू ण उत्पन्न न करने वयले लुु उद्योग; (iv) कुटीर उद्योगों धजसके अतर्गार् ्रसयंीण कयरीगर हैं; सुधवियजनक भण्डयर और ‍थयनीर् सुधवियओं सहयर्क पयररध‍थधर्क पर्ाटन ंें सधमंधलर् गृह वयस; और (v) सतवर्िार् दिर्यकलयप और अनुच्छेद के अतर्गार् ददर्य गर्य ह:ै (ग) परतर्ु र्ह और भी दकसी जनजयर्ीर् भूधं कय उपर्ोग रयज्र् सरकयर के सतबद्ध रयज्र् धवधिर्ों और अन्र् धनर्ंों र्थय धवधनर्ंों के अिीन सक्षं प्रयधिकयरी के पूवा अनुंोदन र्थय सतधवियन के अनुच्छेद 2 प्रवृत्त धवधि के उपबतिों के अनुपयलन के धबनय, र्य र्त्संर् प्रवृत्त धवधि धजसके अतर्गार् अनुसूधचर् जनजयधर् और अन्र् परतपरयगर् वन धनवयसी (वन अधिकयरों क ंयन्र्र्य) अधिधनर्ं, 2006 (2007 कय 2) भी है, वयधणधज्र्क र्य उद्योग धवकयस दिर्यकलयपों के धलए जनजयर्ीर् भूधं कय उपर्ोग अनुज्ञयर् नहीं होगय: (ु) परतर्ु र्ह और भी दक पयररध‍ थधर्क सतवेदी जोन के भीर्र भू-अधभलेखों ंें उपसतजयर् कोई ्ुरट, धनगरयनी सधंधर् के धवचयर प्रयप्त करन े के पश्चयर्प रयज्र् सरकयर द्वयरय प्रत्र्ेक ंयंले ंें एक बयर सतिोधिर् होगी और उि ्ुरट के सतिोिन क सूचनय केंरीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान ंत्यलर् को दने ी होगी । (ङ) परतर्ु र्ह और भी दक उपर्ुाि ्ुरट कय सतिोिन ंें इस उप पैरय के अिीन र्थय उपबतधिर् के धसवयर् दकसी भी दिय ंें भू-उपर्ोग कय पररवर्ान सधमंधलर् नहीं होगय। (च) वनीकरण र्थय वयस जीणोद्धयर दिर्यकलयपों सधहर् अनप्रर्ुक् र् र्य अनुत् पयदक कृधि क्षे्ों ंें पुन: वनीकरण करने के प्रर्यस दकए जयएतगे । (2) प्रयकृधर्क जल धनकयर् —आचतधलक ंहयर्ोजनय ंें सभी प्रयकृधर्क जल स्रोर्ों, नददर्ों, चैनलों क पहचयन क जयएगी और उनके सतरक्षण और पुनरुद्भूर्करण के धलए र्ोजनय सधम ंधलर् होगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (3) पर्टा न/पयररध‍थधर्क-पर्टा न – (क) पयररध‍थधर्क सतवेदी जोन के भीर्र पर्ाटन सतबतिी दिर्यकलयप पर्ाटन ंहयर्ोजनय के अनुसयर होंगे जो दक आतचधलक ंहयर्ोजनय के भयग प प ंें होगी । (ख) पयररध‍थधर्क पर्ाटन ंहयर्ोजनय, पर्यावरण और वन के रयज्र् धवभयगों के परयंिा , पर्ाटन धवभयग द्वयरय र्ैर्यर दकर्य जयएगय । (ग) पर्ाटन ंहयर्ोजनय आतचधलक ंहयर्ोजनय के एक ुटक के प प ंें जयनय जयर्ेगय । (ु) पर्ाटन सतबतिी दिर्यकलयप धनम नधलधखर् के अिीन धवधनर्धंर् होंगे, अथयार्प :- (i) वन्र्जीव अभर्रयण्र् क सींय से एक दकलोंीटर के भीर्र र्य पयररध‍थधर्क सतवेदी जोन के धव‍र्यर र्क, जो भी धनकट हो, दकसी होटल र्य ररसोटा कय नर्य सतधन्नंयाण अनुज्ञयर् नहीं दकर्य जयएगय । र्थयधप, वन्र्जीव अभर्यरण्र् क सींय से एक दकलोंीटर क दरू ी से परे पयररध‍थधर्क सतवेदी जोन के धव‍र्यर र्क नए होटलों और ररसोटों क ‍थयपनय पर्ाटन ंहयर्ोजनय के अनुसयर पयररध‍थधर्क पर्ाटन सुधवियओं के धलए पूवा सींयतदकर् और पदयधभधहर् क्षे्ों ंें ही अनुज्ञयर् क जयएगी; (ii) पयररध‍थधर्क सतवेदी जोन के भीर्र सभी नए पर्ाटन दिर्यकलयपों र्य धवद्यंयन पर्ाटन दिर्यकलयपों कय धव‍र्यर केंरीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान ंत्यलर् के ंयगादिाक धसद्धयतर्ों के द्वयरय र्थय रय‍ रीर् ा र्यघ्र स सतरक्षण प्रयधिकरण, द्वयरय जयरी पयररध‍थधर्क पर्ाटन (संर्-संर् पर र्थय सतिोधिर्) ंयगादिाक धसद्धयतर्ों के अनुसयर, पयररध‍थधर्क पर्ाटन, पयररध‍थधर्क धिक्षय और पयररध‍थधर्क धवकयस को ंहत्व दर्े े हुए पयररध‍थधर्क सतवेदी जोन क वहन क्षंर्य के अध्र्र्न पर आियररर् होगय; (iii) जब र्क आतचधलक ंहयर्ोजनय कय अनुंोदन नहीं कर ददर्य जयर्य ह ै जब र्क पर्ाटन सतबतिी धवकयस र्थय धवद्यंयन पर्ाटन दिर्यकलयपों कय धव‍र्यर ंयनीटरी सधंधर् के वय‍र्धवक ‍थल धवधनर्दष्टा सतवीक्षय र्थय धसफयररि के आियर पर समबतधिर् धवधनर्यंक प्रयधिकयरी द्वयरय अनुज्ञयर् दकर्य जयएगय और पयररध‍थधर्क सतवेदी जोन क्षे् के भीर्र कोई नर्य होटल/ररसोटा र्य वयधणधज्र्क ‍थयपन कय सतधन्नंयाण अनुज्ञयर् नहीं दकर्य जयर्य ह ै। ( ) नसै र्गाक धवरयसर् - पयररध‍थधर्क सतवेदी जोन ंें ंहत्वपूणा नैसर्गाक धवरयसर् के सभी ‍थलों जैसे सभी जीन कोि आरधक्षर् क्षे्, िैल धवरचनयएत, जल प्रपयर्ों, झरनों, ुयटी ंयगों, उपवनों, गुफयएत, ‍थलों, भ्रंण, अश्वरोहण, प्रपयर्ों आदद क पहचयन क जयएगी और धवरयसर् सतरक्षण र्ोजनय आतचधलक ंहयर्ोजनय के भयग के रुप ंें परररक्षण और सतपका के धलए र्ैर्यर करेगी । (5) ंयनव धनर्ंर्ा धवरयसर् ‍थ ल - पयररध‍ थधर्क सतवेदी जोन ंें भवनों, सतरचनयओं, धि्प-र्थ्र्, ऐधर्हयधसक, कलयत्ंक और सयत‍कृधर्क ंहत्व के क्षे्ों क पहचयन करनी होगी और उनके सतरक्षण क र्ोजनयएत र्ैर्यर करनी होगी र्थय आतचधलक ंहयर्ोजनय ंें भयग होगी । (6) ध्व धन प्रदिू ण – पयररध‍थधर्क सतवेदी जोन ंें धनवयरण और ध्वधन प्रदिू ण धनर्त्ण पर्यावरण (सतरक्षण) अधिधनर्ं, 1986 के अिीन ध्वधन (धवधनर्ंन और धनर्त्ण) धनर्ं 2000 के अनुसयर सतकधलर् दकर्य जयएगय । (7) वयर्ु प्रदिू ण - पयररध‍थधर्क सतवेदी जोन ंें धनवयरण और धनर्त्ण, वयर्ु (प्रदिू ण धनवयरण और धनर्त्ण) अधिधनर्ं 1981 (1981 कय 1 ) और इसके अिीन दकए गए धनर्ंों के अनुसयर सतकधलर् दकर्य जयएगय । (8) बधहस्रयव कय धन‍सयरण -- पयररध‍थधर्क सतवेदी जोन ंें उपचयररर् बधहस्रयव कय धन‍सयरण सयियरण ंयनकों के धलए पर्यावरणीर् प्रदधूिर् आच्छयददर् के धन‍सयरण के अतर्गार् पर्यावरणीर् (सतरक्षण) अधिधनर्ं, 1986 और उसके अिीन बनयए गए धनर्ंों के उपबतिों के अनुसयर होगय। (9) ठोस अपधिष्ट - ठोस अपधिष्टों कय धनपटयन और प्रबतिन धनम्नधलधखर् प प ं ेंहोगय-- (क)पयररध‍थधर्क सतवेदी जोन ंें उपचयररर् बधहस्रयव कय धन‍सयरण, संर्-संर् पर सतिोधिर् ठोस अपधि‍ ट प्रबतिन धनर्ं, 2016, जो भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान ंत्यलर् क अधिसूचनय सत कय आ 1357(अ) र्यरीख 8 अप्रैल, 2016 द्वयरय प्रकयधिर् दकए गए थे, के उपबतिों के अनुसयर दकर्य जयएगय ; अकयबाधनक सयं्रसी कय धनपटयन पयररध‍थधर्क सतवेदी जोन के बयहर पहचयन दकए गए ‍ थल पर दकसी पर्यावरणीर् ‍वीकृर् रीधर् ंें होगय; (ख) पयररध‍थधर्क सतवेदी जोन के अतर्गार् जैव-धचदकत्सय अपधिष्टों के सुरधक्षर् और पर्यावरणीर् ध्वधन प्रबतिन (ईएसएं) क पहचयन क गई र्कनीकों के उपर्ोग क धवद्यंयन धनर्ंों और धवधनर्ंों के अनुप प अनुंधर् दी जयएगी।II (ii) 5 (10) जवै धचदकत्स ीर् अपधि‍ट .—जैव धचदकत् सीर् अपधि‍ ट प्रबतिन धनम्नधलधखर् प प ं ेंहोगय— (क) पयररध‍थधर्क सतवेदी जोन ंें जैव धचदकत्सीर् अपधिष्टों कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान ंत्यलर् क अधिसूचनय सत कय धन 3 3 (अ), र्यरीख 28 ंयचा 2016 द्वयरय प्रकयधिर् जैव धचदकत्सीर् अपधिष्ट प्रबति धनर्ं, 2016 के उपबतिों के अनुसयर दकर्य जयएगय । (ख) पयररध‍थधर्क सतवेदी जोन के अतर्गार् जैव-धचदकत्सय अपधिष्टों के सुरधक्षर् और पर्यावरणीर् ध्वधन प्रबतिन (ईएसएं) क पहचयन क गई र्कनीकों के उपर्ोग क धवद्यंयन धनर्ंों और धवधनर्ंों के अनुप प अनुंधर् दी जयएगी। (11) प्लयध‍टक अपधिष्ट प्रबित न - पयररध‍थधर्क सतवेदी जोन ंें प्लयध‍टक अपधिष्ट प्रबति कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान ंत्यलर् क अधिसूचनय सत कय धन 3 0(अ), र्यरीख 18 ंयच,ा 2016 द्वयरय प्रकयधिर् प्लयध‍टक अपधिष्ट प्रबति धनर्ं 2016 के उपबतिों के अनुसयर दकर्य जयएगय। (12) धनंयणा और धवध्वसत अपधिष्ट प्रबित न - पयररध‍थधर्क सतवेदी जोन ंें सतधनंयाण और धवध्वतस अपधिष्ट प्रबति कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान ंत्यलर् क अधिसूचनय सत कय धन 317(अ), र्यरीख 29 ंयचा, 2016 द्वयरय प्रकयधिर् सतधनंयणा और धवध्वतस प्रबति धनर्ं, 2016 के उपबतिों के अनुसयर दकर्य जयएगय। (13) ई–अपधिष्ट - पयररध‍थधर्क सतवेदी जोन ंें ई–अपधिष्ट प्रबति कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान ंत्यलर् द्वयरय प्रकयधिर् ई–अपधिष्ट प्रबति धनर्ं, 2016 के उपबतिों के अनुसयर दकर्य जयएगय। (14) र्यनीर् पररवहन - पररवहन क र्यनीर् गधर्धवधिर्यत आवयस के अनुकूल धवधनर्धंर् होंगी और इस सतबति ंें आतचधलक ंहयर्ोजनय ं ें धविेि उपबति धनर्धंर् दकए जयएतगे और आतचधलक ंहयर्ोजनय के र्ैर्यर होने और रयज्र् सरकयर के सक्षं प्रयधिकयरी द्वयरय के अनुंोददर् होने र्क, धनगरयनी सधंधर् प्रवृत्त धनर्ंों और धवधनर्ंों के अनुसयर र्यनीर् गधर्धवधिर्ों के अनुपयलन को ंयनीटर करेगी । (15) र्यनीर् प्रदिू ण - धवधिर्ों के अनुसयर वयहन प्रदिू ण क धनवयरण और धनर्त्ण कय अनुपयलन दकर्य जयएगय। ‍वच्छक ईंिन के उपर्ोग के धलए दकए गए प्रर्यस उदयहरण के धलए सीएनजी, एलपीजी, आदद ह ैं। (16) औद्योधगक ईकयइर्य त - (i) रयजप् ंें इस अधिसूचनय के प्रकयिन के पश्चयर् र्य प्रकयिन ंें, पयररध‍थधर्क सतवेदी जोन के भीर्र कोई नए प्रदधूिर् उद्योगों क ‍थयपनय क अनुज्ञय नहीं दी जयएगी। (ii) केवल गैर प्रदिू ण उद्योग, फरवरी, 2016 ंें जयरी ंयगादिाक धसद्धयतर् ंें उद्योगों के वगीकरण अनुज्ञय दी जयएगी जब र्क इस अधिसूचनय ंें धवधनर्दष्टा न हो और इसके अधर्ररि, गैर प्रदधूिर् उद्योगों को सतविाक दकर्य जयएगय। (17) पहयडी ढलयनों को सतरक्षण - पहयडी ढलयनों के सतरक्षण के धनम्नयनुसयर होगय: (क) आतचधलक ंहयर्ोजनय पहयडी ढलयनों पर क्षे्ों कय सतकेर् होगय जहयत दकसी भी सतधनंयाण क अनुज्ञय नहीं दी जयएगी । (ख) कटयव के एक उच्च धड्रसी के सयथ धवद्यंयन खडी पहयडी ढलयनों र्य ढलयनों पर दकसी भी सतधनंयाण क अनुंधर् नहीं दी जयएगी । (18) र्दद र्ह आव्‍र्क संझर्य है, इस अधिसूचनय के उपयबतिों को प्रभयवी करने ंें केन्रीर् सरकयर और रयज्र् सरकयर, अधर्ररि उपयर्ों धवधनर्दष्टा करेगय। . पयररध‍थधर्क सतवदे ी जोन ं ें प्रधर्धिद्ध और धवधनर्धंर् दकए जयन े वयले दिर्यकलयपों क सचू ी - पयररध‍थधर्क सतवेदी जोन ंें सभी दिर्यकलयप पर्यावरण (सतरक्षण) अधिधनर्ं, 1986 (1986 कय 29) के उपबतिों और र्टीर् धवधनर्ंन जोन 2011 और पर्यावरणीर् प्रभयव आकलन अधिसूचनय, 2006 और वन (सतरक्षण) अधिधनर्ं, 1980 (1980 के 69), भयरर्ीर् वन अधिधनर्ं, 1927 (1927 के 16), वन्र्जीव (सतरक्षण) अधिधनर्ं, 1972 (1972 के 53) सतिोिनों सधहर् द्वयरय ियधसर् होंग े और नीचे दी गई सयरणी ंें धवधनर्दष्टा रीधर् ं ेंधवधनर्धंर् होंगे, अथयार् प:—6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सयरणी िं स त दिर्यकलयप रटप्पणीर्य त (1) (2) (3) क. प्रधर्धिद्ध दिर्यकलयप 1. वयधणधज्र्क खनन । (क) सभी प्रकयर के नए और धवद्यंयन खनन (लुु और वृहर् खधनज), पत्थर क खयनें और उनको र्ोडने क इकयइर्यत वय‍र्धवक ‍थयनीर् धनवयधसर्ों क ुरेलू आव्‍र्कर्यओं धजसंें धनजी उपर्ोग के धलए ंकयनों के सतधनंयाण र्य ंरमंर् के धलए िरर्ी को खोदनय और ंकयन बनयने के धलए दिे ी टयइ्स र्य ईंटों कय धनंयाण करनय भी सधमंधलर् ह,ै के धसवयर् नहीं होंगी ; (ख) खनन सतदिर्यएत, ंयननीर् उच्चर्ं न्र्यर्यलर् क ररट र्यधचकय (धसधवल) सत 1995 कय 202 टी एन गौडयबंान धथरुंूलपयद बनयं भयरर् सरकयर के ंयंले ं ें आदिे र्यरीख 4 अग‍र्, 2006 और ररट र्यधचकय (सी) सत 2012 कय 435 गोवय फयउतडेिन बनयं भयरर् सरकयर के ंयंल े ंें र्यरीख 21 अप्रैल, 2014 के अतर्ररं आदिे के अनसु रण ंें सवादय प्रचयलन होगय । 2. प्रदिू ण जल र्य वयर्ु र्य ंृदय र्य ध्व धन कयररर् कोई नर्य उद्योग र्य पयररध‍थधर्क सतवेदी जोन ंें प्रदिू ण फैलयने वयले करने वयले उद्योगों क ‍थ यपनय । उद्योगों के धव‍र्यर क अनुंधर् नहीं दी जयएगी। पयररध‍थधर्क सतवेदी जोन के भीर्र केंरीर् प्रदिू ण धनर्त्ण बोडा द्वयरय फरवरी, 2016 ंें जयरी ददियधनदिे ों ंें धसफा गैर- प्रदधूिर् उद्योगों को ‍थयपनय के अनुसयर अनुज्ञयर् दकर्य जयएगय, जब र्क दक इस अधिसूचनय ंें इस प्रकयर धवधनर्दष्टा न हो। 3. बृहर् जल धवद्युर् पररर्ोजनय क ‍थ यपनय । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबतधिर् के धसवयर्) होंगे । 4. दकसी पररसतकटंर् पदयथों कय उपर्ोग र्य लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबतधिर् के धसवयर्) उत्पयदन र्य प्र‍सतकरण । होंगे । 5. प्रयकृधर्क जल धनकयर्ों र्य भूधं क्षे् ं ें लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबतधिर् के धसवयर्) अनुपचयररर् प्रवयह के धनवाहन । होंगे । 6. फंों, कॉपोरेट, कतपधनर्ों द्वयरय बडे पैंयने पर ‍थयनीर् आव्‍र्कर्यओं को पूरय करने के धलए लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबतधिर् के धसवयर्) होंगे। वयधणधज्र्क पिुिन सतपदय और कुक्कुट फयंों क ‍थयपनय । 7. नई आरय धंलों क ‍थयपनय। पयररध‍थधर्क सतवेदी जोन के भीर्र नई और धवद्यंयन आरय धंलों कय धव‍र् यर अनुज्ञयर् नहीं होगय । 8. ईंट भ्ों क ‍थयपनय करनय। लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबतधिर् के धसवयर्) होंगे । 9. जलयवन लकधडर्ों कय वयधणधज्र्क उपर्ोग । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबतधिर् के धसवयर्) होंगे । 10. नए कय‍ ठ आियररर् उद्योग । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबतधिर् के धसवयर्) होंगे । ख धवधनर्धंर् दिर्यकलयप 11. वयधणधज्र्क होटलों और ररसोटों क पयररध‍थधर्क पर्ाटन दिर्यकलयपों सतबतिी पर्ाटकों क लुु सतरचनयओं ‍थयपनय । के धलए सतरधक्षर् क्षे् क सींय से एक दकलोंीटर र्क र्य पयररध‍थधर्क सतवेदी जोन के धव‍र्यर र्क, इनंें जो भी धनकट ह,ै नएII (ii) 7 वयधणधज्र्क होटल और ररसोटा अनुज्ञयर् होंगे, अन्र्थय नहीं । परतर्ु, जहयाँ पयररध‍थधर्क सतवेदी जोन कय धव‍र्यर एक दकलोंीटर से ज्र्यदय ह ै वहयाँ, एक दकलोंीटर से परे और पयररध‍थधर्क सतवेदी जोन के धव‍र्यर र्क सभी नए पर्ाटक दिर्यकलयप र्य धवद्यंयन दिर्यकलयप कय धव‍र्यर पर्ाटन ंहयर्ोजनय और र्थय लयगू ंयगादिी धसद्धयतर्ों के अनुरुप होगय। 12. सतधनंयणा दिर्यकलयप । (क) सतरधक्षर् क्षे् र्य पयररध‍थधर्क सतवेदी जोन जो भी धनकट हो, क सींय से एक दकलोंीटर के भीर्र दकसी भी प्रकयर कय वयधणधज्र्क सतधनंयणा अनुज्ञयर् नहीं दकर्य जयएगय: परतर्ु ‍ थयनीर् लोगों को पैरय 3 के उप पैरय (1) ंें सूचीबद्ध दिर्यकलयपों सधहर् उनके आवयसीर् उपर्ोग के धलए उनक भूधं ं ें सतधनंयणा करने क अनुंधर् भवन उपधवधिर्ों के अनुसयर दी जयएगी । (i) धवद्यंयन सडकों को चौडय करनय और उन्हें सुदढृ करनय र्थय नई सडकों कय सतधनंयाण; (ii) बुधनर्यदी ढयतचों और नयगररक सुधवियओं कय सतधनंयाण और नवीकरण; (iii) केंरीर् प्रदिू ण धनर्त्ण बोडा द्वयरय जयरी ददियधनदिे ों ंें फरवरी, 2016 के भीर्र धसफा गैर- प्रदधूिर् उद्योगों क ‍थयपनय के वगीकरण; (iv) कुटीर उद्योगों धजसके अतर्गार् ्रसयंीण उद्योग हैं; suggestions received from persons and stakeholders in response to the draft notification; AND WHEREAS, the Gudekote Sloth Bear Sanctuary situated in the Kudligi and Sandur Talukas of District Ballari, Karnataka lies between 14°50' N and 11°06' N latitude and 76°37' E and 55°7' E longitude, covering a total geographic area of 47.61 square kilometer was notified vide Notifications No. FEE-72 FWL-2013 dated 11.11.2013 and no. FEE 432 FWL 2014 dated: 21-09-2016 primarily for the conservation of the endangered mammal, the Sloth Bear.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, the Sanctuary' s rocky boulder terrain with caves, scrub jungle is an ideal habitat for the Sloth Bear and the sanctuary also has tree species such as Red Sander, Ficus, etc and fauna such as Sloth Bear, Leopard, Pangolin, Civet Cat, Jungle Cat, Wild Boar, Jackal, Porcupine, Black-naped Hare, Ruddy Mongoose, etc, some of which are Schedule-I species and it also forms a habitat for about 150 species of birds and reptiles such as Star Tortoise, Python, Russell's Viper, Red Sand Boa, Cobra, etc. AND WHEREAS, it is necessary to conserve and protect the Sloth Bear, Leopard and other endangered faunal biodiversity and wildlife therein and its environment by establishing an Eco-Sensitive Zone along the periphery of the Sloth Bear Sanctuary. AND WHEREAS, it is necessary to conserve and protect the geographical area the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of Gudekote Sloth Bear Sanctuary as Eco-sensitive Zone from ecological and environmental aspects, to conserve and protect the biodiversity and wildlife therein and its environment and to prohibit industries or class of industries and their operations and process in the said Eco-sensitive Zone; NOW THEREFORE, in exercise of the power conferred by sub section (l) and clauses (v) and (xiv) of sub-4). section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent varying from 1.0 Kilometer to 7.00 Kilometers all around the boundary of Gudekote Sloth Bear Sanctuary in the State of Karnataka as the Gudekote Sloth Bear Sanctuary Eco-sensitive Zone (herein after referred to us the Eco-Sensitive Zone) details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone.— (1) The Eco-sensitive Zone is spread over an area of 120.04 Sq Kms (including the Sheliyappanahalli / Appenahalli & Sanjivarayanakote Reserve Forest areas and some section -4 areas) with an extent varying from 1.0 Kilometer to 7.00 Kilometers around the boundary of Gudekote Sloth Bear Sanctuary and the boundary details of such Zone are given in Annexure-I. (2) The map of Eco-sensitive Zone boundary together with latitudes & longitudes is appended as Annexure II; (3) The Geo Coordinates of major points on the boundary of Gudekote Sloth Bear Sanctuary and on the boundary of Eco-sensitive Zone boundary is appended as Annexure-III. (4) Details of list of villages and Reserve Forest falling in the Eco-Sensitive Zone around Gudekote Sloth Bear Sanctuary is appended as Annexure-IV. 2. Zonal Master Plan for the Eco-sensitive Zone.— (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan: (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture & Horticulture; (iv) Revenue; (v) Urban Development; (vi) Tourism including eco-tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal & urban development; (x) Panchayati Raj; and (xi) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.II (ii) 17 (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by State Government.—The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1)Landuse: (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities. (b) Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as: (i) Widening and strengthening of existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii) Small scale industries not causing pollution; (iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) Promoted activities and given under para 4. (c) Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): (d) Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: (e) Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (f) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies: The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan. (3) Tourism/ Eco-tourism: (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan.18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (d) The activities of eco-tourism shall be regulated as under, namely:- (i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Wildlife Sanctuary or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 km from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan. (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism; (iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within ESZ area. (4) Natural Heritage: All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites: Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan. (6) Noise pollution: Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto. (7) Air pollution: Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto. (8) Discharge of effluents: Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes: Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (10) Bio-medical waste: Bio medical waste management shall be as under: (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time. (b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (11) Plastic Waste Management: The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and Demolition Waste Management: The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste: The E-Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.II (ii) 19 (14) Vehicular traffic: The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular Pollution: Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc. (16) Industrial Units: (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted. (17) Protection of Hill Slopes: The protection of hill slopes shall be as under: (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted. (18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:— S No Activity Description A. Commercial Mining (a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities. (b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012. 2. Construction activities (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or up to extent of the Eco-sensitive Zone whichever is nearer: (a) Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as: (i) Widening and strengthening of existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016; (iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays; and (v) Promoted activities listed in this Notification. (b) Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan. 13. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and non- hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority. 14. Felling of Trees (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. Monitoring Committee.— (1) In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:— (i) Regional Commissioner, Gulbarga - Chairman; (ii) Hon'ble Member of Legislative Assembly, Kudligi Constituency, Ballari District - Member; (iii) Representative of the Department of Environment, Government of Karnataka - Member; (iv) Representative of the Department of Urban Development, Government of Karnataka - Member; (v) Representative of Non-governmental Organizations working in the field of natural conservation (including heritage conservation) to be nominated by the Government of Karnataka for three years - Member;22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (vi) The Regional Officer, Karnataka State Pollution Control Board, - Member; (vii) One expert in Ecology from reputed Institution or University of the State of Karnataka to be' nominated by the Government of Karnataka for three years - Member; (viii) The Deputy Commissioner or his representative, Ballari District - Member; (ix) Member, State Biodiversity Board -Member; (x) The Deputy Conservator of Forests, Ballari Division, Ballari Member- Secretary. Note: Subject to the State Government of Karnataka obtaining relevant approvals inter alia including permission from the Speaker of Legislative Assembly, Karnataka, if required 6. Terms of Reference:- (1)The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco- sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (3) The activities that are not covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco- sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (4) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-V. (7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F. No. 25/145/2015-ESZ] LALIT KAPUR, Scientist ‘G’ ANNEXURE –I Boundary description of Eco-sensitive zone around Gudekote Sloth Bear Sanctuary The point number -1( N 140 54’ 40.40” E 760 38’ 08.90”) is located at the crossing of Road Shaliyappanahalli- Appenahalli Road with Shaliyappanahalli Reserve forest boundary near Shaliyappanahalli village then the boundary line runs west all along the boundary of the Shaliyappanahalli Reserve forest boundary through point no.2 to 17 and up to point no. 18 (N 140 56’ 22.29” E 760 40’ 14.52”), then the boundary line moves west corner of Sanjivarayanakote Reserve Forest Boundary of Molakalmuru Range Chitradurga District through point no 19 to 24 and meets Appenahalli Reserve Forest boundary, then boundary line turns towards east at point no. 25 and runs north side to point no. 26 then the boundary moves in south direction up to point no. 27 which is located on Road Appenahalli- Gudekote, then boundary line moves along the road up to point no-28, then the boundary line runs towards south-east along nallah up to point no. 29 Halasagara Village settlement then the boundary line runs towards east through point no. 30 and up to point no. 31, then the boundary line runs along the nallah leading to the Rayapura Tank through point no. 32, 33 and up to point 34 located on the southern edge of the Rayapura Tank Bund, then the boundary line runs south up to point no. 35, then the boundary line turns towards west through point no. 36 and up to point no. 37 and then boundary line runs south to reach point no 38 located at the turn of Road Talvarhalli to chikkerhalli , then the boundary line moves west to reachII (ii) 23 Hangal-Gudekote Road and moves along the road up to point no. 39 located at the crossing of Road and sidlihalla (nallah), then the boundary line runs along the sidlihalla nallaha upto the point no. 40 loacted on the boundary of the Sidegallu Reserve Forest, then the boundary line runs along the Sidegallu Reserve Forest boundary to reach point no. 41, located at the crossing of Sidegallu RF boundary and Road leading to Gudekote, then the boundary line turns north and runs along the Road to reach point no. 43, then the boundary moves towards east direction and reach point no. 44 and then moves north-west direction through point no. 45, and to reach point no-46 located on the Gudekote Tank Bund , then the boundary line runs along the tank boundary through point no-47 and to reach point no. 48 then the boundary line moves in north-west direction through point no-49, 50,and to reach point no. 51 located on the Ramdurga- Shaliyappanahalli Road, then the boundary line runs through point no. 52, 53, 54 and reach point no. 56 along the Ramdurga- Shaliyappanahalli Road, then the boundary line runs outside the Shaliyappanahalli village settlement and then along the Road to reach starting point no. 1.
