अतः, अब, के6[ीय सरकार, पया(cid:31)वरण (संर<ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प$ठत पया(cid:31)वरण (संर<ण)
अिधिनयम, 1986 (1986 का 29) क& धारा 3 क& उपधारा (1) उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) )ारा (cid:10)दA
शि0य1 का (cid:10)योग करते Cए, िहमाचल (cid:10)देश रा\ य म(cid:29) सेचु तुआन नाला व6यजीव अभयारDय क& सीमा के इद(cid:31) िगद (cid:31) 0 मीटर से 1
(cid:1)कलोमीटर तक के िवEतार वाले <े(cid:26) को सेचु तुआन नाला व6यजीव अभयारDय पा$रिEथितक& संवेदी जोन (िजसे इसम(cid:29) इसके पY चात्
पा$रिEथितक& संवेदी जोन कहा गया ह)ै के Vप म(cid:29) अिधसूिचत करती ह,ै िजसके 9यौरे िन‘ानुसार ह,Q अथा(cid:31)त ्:--

के साथ अ6तररा\यीय सीमा के कारण ह ैऔर पा$रिEथितक& संवेदी जोन का <े(cid:26) 46.45 वग(cid:31) (cid:1)क.मी. ह।ै ।
(2) सेचु तुआन नाला व6यजीव अभयारDय के पा$रिEथितक& संवेदी जोन का मानिच(cid:26) उउउउपपपपााााबबबबधधंंधधंं IIII के (cid:12)प म(cid:29) उपाबM ह ै।
(3) सेचु तुआन नाला व6यजीव अभयारDय और इसके पा$रिEथितक& संवेदी जोन क& सीमा पर (cid:10)मुख Eथान1 के भ-ू िनदशi ांक उउउउपपपपााााबबबबंधंधंधंध IIIIIIII के
(cid:12)प म(cid:29) उपाबM ह।ै
(4) पा$रिEथितक& संवेदी जोन के अ6तग(cid:31)त आने वाले jाम1 क& सूची उउउउपपपपााााबबबबंधंधंधंध IIIIIIIIIIII के (cid:12)प म(cid:29) उपाबM ह ै।

म(cid:29) इस अिधसूचना के अंितम (cid:10)काशन क& तारीख से दो वष(cid:31) क& अविध के भीतर, इस अिधसूचना म(cid:29) (cid:1)दए गए अनुबंध1 का अनुपालन करत े
Cए, Eथानीय /ि0य1 के परामश(cid:31) से आंचिलक महायोजना तैयार करेगी ।
(2) इस (cid:10)कार तैयार आंचिलक महायोजना अिधसूचना म(cid:29) िविन(cid:1)द8 अनुबंध1 के अनुसार होगी ।
(3) उ0 योजना को रा\य सरकार म(cid:29) स<म (cid:10)ािधकारी )ारा अनुमो(cid:1)दत (cid:1)कया जाएगा।
(4) पा$रिEथितक& संवेदी जोन के िलए आचंिलक महायोजना रा\ य सरकार )ारा इस अिधसूचना म(cid:29) यथा िविनUद8 रीित म(cid:29) और सुसंगत
क(cid:29)[ीय और रा\य िविधय1 और क(cid:29)[ीय सरकार )ारा जारी माग(cid:31)दशc िसMांतो, य(cid:1)द कोई ह1, के सामंजE य से तैयार क& जाएगी।
(5) आंचिलक महायोजना, संबंिधत रा\य िवभाग1 के साथ परामश(cid:31) करके तैयार क& जाएगी, अथा(cid:31)त्:--
(i) पया(cid:31)वरण;
(ii) वन;
(iii) शहरी िवकास;
(iv) पय(cid:31)टन;
(v) नगरपािलका;
(vi) राजE व;
(vii) कृिष;
(viii) lसचाई;
(ix) लोक िन मा(cid:31)ण िवभ ाग; और
(x) िहमाचल (cid:10)दशे रा\य (cid:10)दषू ण िनयं(cid:26)ण बोड।(cid:31)
(6) आंचिलक महायोजना अनुमो(cid:1)दत िवOमान भू-उपयोग, अवसंरचना और (cid:1)nयाकलाप1 पर तब तक कोई िनबoधन अिधरोिपत
नह: करेगी जब तक (cid:1)क इस अिधसूचना म(cid:29) इस (cid:10)कार िविनUदP ट न हो और आचंिलक महायोजना सभी अवसंरचना और (cid:1)nयाकलाप1 म(cid:29)
जो अिधक द<ता और पा$रिEथितक& अनुकूल ह1, का संवध(cid:31)न करेगी।
(7) आंचिलक महायोजना म(cid:29) अनाpछा(cid:1)दत <े(cid:26)1 के जीण?Mार, िवOमान जल िनकाय1 के संर<ण, आवाह <े(cid:26)1 के (cid:10)बंधन, जल-
संभर1 के (cid:10)बंधन, भू जल के (cid:10)बंधन, मृदा और नमी संर<ण, Eथानीय समुदाय1 क& आवYयकताd तथा पा$रिEथितक& और पया(cid:31)वरण से
संबंिधत ऐसे अ6य पहलुd, िजन पर rयान दने ा आवYयक ह,ै के िलए उपबंध ह1गे ।
(8) आंचिलक महायोजना सभी िवOमान पूजा E थल1, jाम1 और नगरीय बंदोबEत1, वन1 के (cid:10)कार और (cid:1)कE म1, कृिष <े(cid:26)1,
ऊपजाऊ भिू म, ह$रत <े(cid:26) जैसे उOान और उसी (cid:10)कार के E थान, उOान कृिष <े(cid:26), फलोउOान, झील1 और अ6य जल िनकाय1 का
अtयकंन करेगी और इस योजना के मानिच(cid:26) के साथ िवOमान और (cid:10)Eतािवत भूिम उपयोग िवशेषताd का िववरण संलu होगा ।
(9) आंचिलक महायोजना पा$रिEथितक& संवेदी जोन म(cid:29) िवकास का िविनयमन करेगी और इस अिधसूचना म(cid:29) िविनUद8 (cid:10)ितिषM,
िविनयिमत और संव7धत (cid:1)nयाकलाप1 का पालन करेगी िजससे E थानीय समुदाय1 के पा$रिEथितक& अनुकूल िवकास का उनके
जीवकोपाज(cid:31)न को सुरि<त करने के िलए सुिनिvत (cid:1)कया जा सके।
(10) आंचिलक महायोजना मानीटरी सिमित के िलए इस अिधसूचना के उपबंधो के अधीन अपने कृ@य करने के िलए एक संदभ(cid:31) दEतावेजी

3. रररराााा(cid:26)(cid:26)(cid:26)(cid:26)यययय ससससररररककककाााारररर (cid:27)(cid:27)(cid:27)(cid:27)ाााारररराााा (cid:28)(cid:28)(cid:28)(cid:28)ककककएएएए जजजजाााानननन ेे ेेववववाााालललल ेे ेेउउउउपपपपाााायययय-------- रा\य सरकार इस अिधसूचना के उपबंध1 को (cid:10)भावी करने के िलए िन‘िलिखत उपाय
करेगी, अथा(cid:31)त्:--
(1) भभभभ---ूू-ूूउउउउपपपपययययोोोोगगगग –––– (क) पा$रिEथितक& संवेदी जोन म(cid:29) आमोद-(cid:10)मोद के (cid:10)योजन1 के िलए िचि6हत (cid:1)कए गए वन1, उOान-कृिष <े(cid:26)1, कृिष
<े(cid:26)1, पाकW और खुले Eथान1 का वािणि\यक और औOोिगक संबM िवकास (cid:1)nयाकलाप1 के िलए उपयोग या संप$रवत(cid:31)न नह: होगा:
परंतु पा$रिEथितक& संवेदी जोन के भीतर कृिष भूिम का संप$रवत(cid:31)न, मानीटरी सिमित क& िसफा$रश पर और रा\य सरकार के
पूव(cid:31) अनुमोदन से, Eथानीय िनवािसय1 क& आवासीय जVरत1 को पूरा करने के िलए और पैरा 4 क& सारणी के Eतंभ (2) म(cid:29) सूचीबM
(cid:1)nयाकलाप1 को करने के िलए अनुwात ह1ग,े अथा(cid:31)त् :-
(i) पा$रिEथितक& अनुकूल पय(cid:31)टन (cid:1)nयाकलाप1 के िलए पय(cid:31)टक1 के अE थायी आवासन के िलए पा$रिEथितक& अनुकूल आरामगाह
जैसे ट(cid:29)ट, लकड़ी के मकान आ(cid:1)द;
(ii) िवOमान सड़क1 को चौड़ा करना और उ6ह(cid:29) सुदढृ करना तथा नई सड़क1 का संिनमा(cid:31)ण;
(iii) (cid:10)दषू ण उ@पy न करने वाले लघु उOोग;
(iv) वषा(cid:31) जल संचय।
(v) कुटीर उOोग, िजसके अंतग(cid:31)त jामीण उOोग, सुिवधा भंडार और Eथानीय सुिवधाएं सि(cid:7)मिलत हQ;
परंतु यह और (cid:1)क रा\य सरकार के पूव(cid:31) अनुमोदन और भारत के संिवधान के अनुpछेद 244 और त@समय (cid:10)वृA िविध के
उपबंध1 के, िजसके अंतग(cid:31)त अनुसूिचत जनजाित और अ6य परंपरागत वन िनवासी (वन अिधकार1 क& मा6यता) अिधिनयम, 2006
(2007 का 2) भी ह,ै के अनुपालन के िबना वािणि\यक या उOोग िवकास (cid:1)nयाकलाप1 के िलए जनजातीय भूिम का उपयोग अनुwात
नह: होगा:
परंतु यह भी (cid:1)क पा$रिEथितक& संवेदी जोन के भीतर भू-अिभलेख1 म(cid:29) (cid:10)कट कोई (cid:26)ु$ट, मानीटरी सिमित के िवचार (cid:10)ाB करने के
पvात ् रा\य सरकार )ारा (cid:10)@येक मामले म(cid:29) केवल एक बार संशोिधत होगी और उ0 (cid:26)ु$ट के संशोधन क& भारत सरकार के पया(cid:31)वरण,
वन और जलवायु प$रवत(cid:31)न मं(cid:26)ालय को सूचना दने ी होगी ।
परंतु यह और भी (cid:1)क उपयु(cid:31)0 (cid:26)ु$ट के संशोधन म(cid:29) इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:1)कसी भी दशा म(cid:29) भू-उपयोग
का प$रवत(cid:31)न सि(cid:7)मिलत नह: होगा ।
परंतु यह और भी (cid:1)क ह$रत <े(cid:26) जैसे वन <े(cid:26), कृिष <े(cid:26) आ(cid:1)द म(cid:29) कोई पा$रणािमक कटौती नह: होगी और अ(cid:10)युz त या
अनु@प ादक कृिष <े(cid:26)1 म(cid:29) पुन: वनीकरण करने के (cid:10)यास (cid:1)कए जाएंगे।
(2) (cid:30)(cid:30)(cid:30)(cid:30)ााााककककृृृृििििततततकककक झझझझररररनननन!! !!– आचंिलक महायोजना म(cid:29) सभी (cid:10)ाकृितक झरन1 क& पहचान क& जाएगी और उनके संर<ण और पुन(cid:12){भूतकरण के
िलए योजना सि(cid:7)म िलत होगी और रा\य सरकार )ारा आवाह (cid:10)बंध योजना ऐसी रीित म(cid:29) तैयार क& जाएगी िजससे आवाह <े(cid:26)1 के भीतर
िवकास (cid:1)nयाकलाप1 को (cid:10)ितिषM और िनबoिधत (cid:1)कया जा सकेगा ।
(3) पपपपाााा(cid:13)(cid:13)(cid:13)(cid:13)ररररिििि(cid:20)(cid:20)(cid:20)(cid:20)थथथथििििततततकककक(cid:23)(cid:23)(cid:23)(cid:23)----पपपपयययय(cid:4)ट(cid:4)ट(cid:4)ट(cid:4)टनननन –––– (क) पा$रिEथितक& संवेदी जोन के भीतर पय(cid:31)टन संबंधी (cid:1)nयाकलाप, पय(cid:31)टन महायोजना के अनुसार ह1गे जो
(cid:1)क आंचिलक महायोजना क& भाग होगी ।
(ख) पा$रिEथितक& पय(cid:31)टन महायोजना िवभाग, िहमाचल (cid:10)दशे सरकार, राजEव और वन िवभाग के परामश(cid:31) से िहमाचल (cid:10)देश सरकार
के पय(cid:31)टन िवभाग )ारा तैयार क& जाएगी।
(ग) पय(cid:31)टन महायोजना आंचिलक महायोजना का एक संघटक होगी ।
(घ) पय(cid:31)टन संबंधी (cid:1)nयाकलाप िन(cid:7)न िलिखत के अधीन िविनयिमत ह1गे, अथा(cid:31)त् :-
(i) सेचु तुआन नाला व6यजीव अभयारDय क& सीमा 1 (cid:1)कलोमीटर के भीतर या पा$रिEथितक& संवेदी जोन के िवEतार तक,
इसम(cid:29) जो भी िनकट हो, होटल और $रसोट (cid:31) के नए संिनमा(cid:31)ण अनुwात नह: होगे, तथािप व6यजीव अभयारDय क& सीमा से एक
(cid:1)कलोमीटर क& दरू ी से परे पा$रिEथितक& संवेदी जोन के िवEतार तक नए होटल और $रसोट? क& Eथापना को पूव(cid:31) प$रभािषत
और िविनUद8 <े(cid:26)1 म(cid:29) पा$रिEथितक& पय(cid:31)टन काय(cid:31)कलापो के िलए पय(cid:31)टन महायोजना के अनुसार अनुwात (cid:1)कया जाएगा;
(ii) पा$रिEथितक& संवेदी जोन के भीतर सभी नए पय(cid:31)टन (cid:1)nयाकलाप1 या िवOमान पय(cid:31)टन (cid:1)nयाकलाप1 का िवEतार के6[ीय
सरकार के पया(cid:31)वरण, वन और जलवायु प$रवत(cid:31)न मं(cid:26)ालय तथा राP }ीय ~ या(cid:127) संर<ण (cid:10)ािधकरण, )ारा जारी (समय-समय पर
यथा संशोिधत) (cid:1)दशािनदशi 1 के अनुसार होगा िजसम(cid:29) पा$रिEथितक& पय(cid:31)टन पर बल (cid:1)दया जाएगा;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(iii) आंचिलक महायोजना का अनुमोदन (cid:1)कए जान ेतक, पय(cid:31)टन के िलए िवकास और िवOमान पय(cid:31)टन (cid:1)nयाकलाप1 के िवEतार
को वाEतिवक Eथल िविनUद8 संवी<ा तथा मानीटरी सिमित क& िसफा$रश पर आधा$रत संबंिधत िविनयामक (cid:10)ािधकरण1
)ारा अनुwात (cid:1)कया होगा ।
(4) ननननैसैसैसैस$$$$गगगगकककक ििििववववररररााााससससतततत -------- पा$रिEथितक& संवेदी जोन म(cid:29) मह@वपूण(cid:31) नैस7गक िवरासत के सभी Eथल1 जैसे सभी जीन कोश आरि<त <े(cid:26), शैल
िवरचनाएं, जल (cid:10)पात1, झरन1, घाटी मागW, उपवन1, गुफाएं, Eथल1, (cid:128)मण, अ(cid:129)रोहण, (cid:10)पात1 आ(cid:1)द क& पहचान क& जाएगी और उ6ह (cid:29)
संरि<त (cid:1)कया जाएगा तथा उनक& सुर<ा और संर<ा के िलए इस अिधसूचना के अंितम (cid:10)काशन क& तारीख से छह मास के भीतर,
उपयु0 योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) ममममााााननननवववव ििििनननन$$$$ममममतततत ििििववववररररााााससससतततत (cid:20)(cid:20)(cid:20)(cid:20)थथ थथ लललल ---- पा$रिEथितक& संवेदी जोन म(cid:29) भवन1, संरचनाd, िश(cid:3)प-त(cid:130)य, ऐितहािसक, कला@मक और सांEकृितक
मह@व के <े(cid:26)1 क& पहचान क& जाएगी और इस अिधसूचना के (cid:10)काशन क& तारीख से छह मास के भीतर उनके संर<ण क& योजना तैयार
करनी होगी तथा आंचिलक महायोजना म(cid:29) सि(cid:7)मिलत क& जाएगी ।
(6) &&&&वव वव ििििनननन (cid:30)(cid:30)(cid:30)(cid:30)ददददषषषषूूूू णणणण -- पा$रिEथितक& संवेदी जोन म(cid:29) r विन (cid:10)दषू ण के िनयं(cid:26)ण के िलए रा\ य सरकार का पया(cid:31)वरण िवभाग या िहमाचल
(cid:10)दशे िनयं(cid:26)ण बोड (cid:31) पया(cid:31)वरण (संर<ण) अिधिनयम, 1986, के अधीन rविन (cid:10)दषू ण (िविनयमन और िनयं(cid:26)ण) िनयम 2000 के अनुसार
िविनयम1 के (cid:1)nयाि6वत करेगा ।
(7) ववववाााायययय ुु ुु (cid:30)(cid:30)(cid:30)(cid:30)ददददषषूूषषूू णणणण – पा$रिEथितक& संवेदी जोन म(cid:29), वायु (cid:10)दषू ण का िनयं(cid:26)ण वायु ((cid:10)दषू ण िनवारण और िनयं(cid:26)ण) अिधिनयम, 1981
(1981 का 14) और उसके अधीन बनाए गए िनयम1 के उपबंध1 के अनुसार होगा।

NOTIFICATION
New Delhi, the 28th September, 2017
S.O. 3193(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide
notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O.
2276 (E), dated the 1st July, 2016, inviting objections and suggestions from all persons likely to be affected thereby
within the period of sixty days from date on which copies of the Gazette containing the said notification were made
available to the public;
AND WHEREAS, the copies of the Gazette containing the draft notification were made available to the public
on the 1st July, 2016;
AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to
the draft notification;
AND WHEREAS, the Sechu Tuan Nala Wildlife Sanctuary is situated in the Chamba District of Himachal
Pradesh and is spread over an area of about 390.29 square kilometers;
AND WHEREAS, the flora and fauna represent rich biological significance of this sanctuary; floral species
include Kail (Pinus wallichiana), Spruce (Picea smithiana), Silver Fir (Abies pindrow), etc; the Sanctuary is the habitat
of Snow leopard (Panthera uncia), Leopard cat (Prionailurus bengalensis), Musk deer (Moschus sp.), Brown Bear
(Ursus arctos), Langoor, Himalayan Thar (Hemitragus jemlahicus), Goral (Naemorhedus sp.), etc., and pheasants like
Monal (Lophophorus impejanus), Koklash (Pucrasia macrolopha), Kaleej (Lophura leucomelanos), Cheer (Catreus
wallichii), etc. also inhabit the Sanctuary;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are
specified in paragraph 1 of this notification, around the protected area of Sechu Tuan Nala Wildlife Sanctuary as Eco-
sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of
industries and their operations and processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub-section(1), clauses (v) and (xiv) of sub-
section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), read with sub-rule
(3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an
extent ranging from 0 metres to 1 kilometre around the boundary of the Sechu Tuan Nala Wildlife Sanctuary in the
State of Himachal Pradesh as the Sechu Tuan Nala Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as
the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.-(1) The extent of Eco-sensitive Zone varies from 0 metres to 1
kilometre from the boundary of Sechu Tuan Nala Wildlife Sanctuary, 0 Eco-Sensitive Zone towards North, South and
Eastern sides is due to inter-State boundary with Jammu and Kashmir and high altitude areas and the area of the Eco-
sensitive Zone is 46.45 sq. km.
(2) The map of Sechu Tuan Nala Wildlife Sanctuary demarcating the Eco-sensitive Zone is appended as
Annexure I.
(3) The Geo Co-ordinates of prominent locations of the boundary of Sechu Tuan Nala Wildlife Sanctuary and its
Eco-Sensitive Zone is appended as Annexure II.
(4) The list of villages falling within the Eco-Sensitive Zone is appended as Annexure III.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-
sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this
notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this
notification.
(2) The Zonal Master Plan so prepared shall be commensurate with the provisions specified in this notification.
(3) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(4) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is
specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued
by the Central Government, if any.
(5) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;

(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Irrigation;
(ix) Public Works Department; and
(x) Himachal Pradesh State Pollution Control Board.
(6) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and
activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all
infrastructure and activities to be more efficient and eco-friendly.
(7) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture conservation,
needs of local community and such other aspects of the ecology and environment that need attention.
(8) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and
kinds of forests, tribal areas, agricultural areas, fertile lands, green areas such as parks and like places, horticultural
areas, orchards, lakes, wetlands and other water bodies with supporting maps and the Plan shall be supported by maps
giving details of existing and proposed land use features.
(9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and shall follow prohibited, regulated and
promoted activities specified in this notification so as to ensure Eco-friendly development for livelihood security of
local communities.
(10) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions
under the provisions of this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development
activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential needs of local residents, and for the activities listed in column (2) of the Table in paragraph 4, namely:-
(i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for eco-friendly tourism
activities;
(ii) widening and strengthening of existing roads and construction of new roads;
(iii) small scale industries not causing pollution;
(iv) rain water harvesting; and
(v) cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of article 244 of
the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest
Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of
said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and
rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan shall be drawn up by

(3) Eco-Tourism.-(a)The activity relating to tourism within the Eco-sensitive Zone shall be as per Eco-Tourism Master
Plan, which shall form part of the Zonal Master Plan.
(b) The Eco-Tourism Master Plan shall be prepared by the Department of Tourism, Government of Himachal Pradesh in
consultation with Department of Revenue and Forests, Government of Himachal Pradesh.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities relating to tourism shall be regulated as under, namely.-
(i) no new construction of hotels and resorts shall be permitted within 1 km from the boundary of the Sechu Tuan Nala
Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer, however, beyond the distance of 1
km from the boundary of the said Wildlife Sanctuary till the extent of the Eco-Sensitive Zone, the establishment of new
hotels and resorts shall be permitted only in pre-defined and designated areas for eco-tourism facilities as per Tourism
Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in
accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate
Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to
time) with emphasis on eco-tourism;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be
permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the
Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and
preserved and plan shall be drawn up for their protection and conservation, within six months from the date of
publication of this notification in the official Gazette and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic,
and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared
within six months from the date of publication of this notification in the official Gazette and incorporated in the Zonal
Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Himachal Pradesh State Pollution
Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance
with the provisions of the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection)
Act, 1986.
(7) Air pollution.- The control of air pollution in the Eco-Sensitive Zone shall be in accordance with the provisions of
the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental
(Protection) Act, 1986 and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste
Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate
Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Eco-
sensitive Zone;
(iii) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive
Zone.
(10) Bio-medical waste.- (i) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the
provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of
Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as
amended from time to time.
(ii) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone;
(iii) Individual hospitals or private health centres already existing within the Eco Sensitive Zone shall provide waste
treatment system to avoid adverse impact on the Protected Area.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per
the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016, as
amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition waste management in the
Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management
Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide
notification number G.S.R 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste.- The e- waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-
Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and
Climate Change and as amended from time to time.
(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is
prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Industrial units.- (a) No establishment of new wood based industries within the Eco-sensitive zone shall be
permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, and noise pollution within the Eco-sensitive
Zone shall be permitted.
(16) The Central Government and the State Government shall specify other measures, if it considers necessary, in
giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.- All activities
in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986)
and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:

within one kilometre from the boundary of the Protected Area or
upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake
construction in their land for their use including the activities
listed in sub paragraph (1) of paragraph 3 as per building byelaws
to meet their residential needs.
15. Trenching ground. Establishment of new trenching ground shall be prohibited and
old trenching grounds shall be regulated under applicable laws.

5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee for effective
monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(i) Concerned District Magistrate -Chairman;
(ii) An expert in the area of ecology and environment to be nominated by the
Government of Himachal Pradesh for a period of three years -Member;
(iii) One representative of non-Governmental Organisation (working in the field of
environment including heritage conservation) to be nominated by the
Government of Himachal Pradesh for a period of three years -Member;
(iv) Member Secretary or Member, Himachal Pradesh State Biodiversity Board -Member;
(v) Executive Engineer, Himachal Pradesh State Pollution Control Board -Member;
(vi) Sub-Divisional Magistrate, Pangi -Member;
(vii) Divisional Forest Officer (Territorial) -Member;
(viii) Divisional Forest Officer (Wildlife) -Member-Secretary.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17
Terms of Reference.-
(1) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by
the State Government and subsequently the Monitoring Committee would be constituted by the State Government.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the
Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be
scrutinized by the Monitoring Committee based on the actual site specific condition and referred to the Central
Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearance under the
provisions of the said notification. Only white categories of industries shall be considered as specified in the guidelines
issued by the CPCB for “classification of Industries, 2016”.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-
sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be
scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned
Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file
complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who
contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives
from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on
issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every
year by 30th June of that year to the Chief Wild Life Warden of the State as per proforma appended at Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as
it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or the National Green Tribunal.
