होने की संभयवनय थी, ईस तयरीख से, धजसको ईस रयजपत्र की प्रधतययं, धजसमें यह ऄधधसूचनय ऄतं र्ववष्ट ह,ै ईपलब्ध करय दी गइ थी, सयठ ददन की ऄवधध के भीतर अक्षेप और सुक्षयव अमंधत्रत करते हुए एक प्रयरुप ऄधधसूचनय ऄधधसूचनय के पैरय 1 में धवधनर्ददष्ट ह,ैं पययावरण की दधृष्ट से पयररधथथधतक संवेदी जोन के रूप में सुरधक्षत और संरधक्षत करनय तथय ईि पयररधथथधतक संवेदी जोन में ईद्योगों यय ईद्योगों के वगो के प्रचयलन तथय प्रसंथकरण करने को प्रधतधर्द्ध करनय अवश्यक ह ै; ऄतः, ऄब, केन्रीय सरकयर, पययावरण (संरक्षण) धनयम, 1986 के धनयम 5 के ईपधनयम (3) और पययावरण (संरक्षण) ऄधधधनयम, 1986 (1986 कय 29) की धयरय 3 की ईपधयरय (2) के खंड (v) और खंड (xiv) के सयथ परठत और ईप धयरय (1) ियरय प्रदत्त िधियों कय प्रयोग करते हुए, मधणपुर रयज्य में कीबुल लमजयओ रयष्ट्रीय ईद्ययन की सीमय स े 0.64 से 8.43 दकलोमीटर तक के धवथत यररत क्षेत्र को कीबुल लमजयओ रयष्ट्रीय ईद्ययन पयररधथ थधतकीय संवेदी जोन (धजसे आसमें आसके पश् चयत् पयररधथ थधतक संवेदी जोन कहय गयय ह)ै के रूप में ऄधधसूधचत करती है, धजसकय धववरण धनम्नयनुसयर ह,ै ऄथयात् :-- 1. पयररधथथधतक सवं दे ी जोन कय धवथतयर और ईसकी सीमयएं--(1) पयररधथथधतक संवेदी जोन कीबुल लमजयओ रयष्ट्रीय ईद्ययन की सीमय से 0.64 से 8.43 दकलोमीटर पररवती क्षेत्र धवथतयररत ह ैपयररधथथधतक संवेदी जोन कय क्षेत्र 176 वगा दकलोमीटर है | (2) पयररधथथधतक संवेदी जोन पवू ा (ईपयबंध I मयनधचत्र के धबन्द ु सं. 13) की ओर 24° 31’10.266” ई ऄक्षयंि 93° 56’28.568” पू दिे यन्तर; पधिम (ईपयबंध I मयनधचत्र के धबन्द ु सं. 1) की ओर 24° 30’4.244” ई ऄक्षयंि तथय 93° 46’37.812” पू दिे यन्तर; ईत्तर (ईपयबंध I मयनधचत्र के धबन्द ु सं. 11) की ओर 24° 33’22.486” ई ऄक्षयंि और 93° 53’54.961” पू दिे यन्तर और दधक्षण (ईपयबंध I मयनधचत्र के धबन्द ुसं. 22) की ओर 24° 22’20.930” ई ऄक्षयंि तथय 93° 52’11.593” पू दिे यन्तर से धघरय हुअ ह ै। (3) ऄक्षयंि और दिे यन्तर के सयथ पयररधथथधतक संवेदी जोन की सीमय कय मयनधच त्र ईपयबधं I के रुप में ददयय गयय ह ै। (4) पयररधथथधतक संवेदी जोन कय समन्वयन ईनके ऄक्षयंि और दिे यन्तर सधहत ईपयबधं II के रुप में ईपयबद्ध ह ै| (5) पयररधथथधतक संवेदी जोन क क के मुख्य पबदओंु क भीतर अने वयले ग्रयमों की सूची ईपयबधं -III में दी गइ ह ै। 2. पयररधथथधतक सवं ेदी जोन के धलए अचं धलक महययोजनय – (1) रयज्य सरकयर, पयररधथथधतक संवेदी जोन के धलए रयजपत्र म ें ऄंधतम ऄधधसूचनय के प्रकयिन की तयरीख से दो वर्ा की ऄवधध के भीतर, थथयनीय व्यधियों के परयमिा से और आस ऄधधसूचनय में संलग्न ऄनुबंधों के सयमंजथय से अंचधलक महययोजनय तैययर करेगी । (2) रयज्य सरकयर ियरय पयररधथ थधतक संवेदी जोन के धलए अचंधलक महययोजनय आस तरह, आस ऄधधसूचनय में धवधनर्ददष् ट रूप तथय सुसंगत केंरीय और रयज्य धवधधयों के सयमंजथय और केंरीय सरकयर ियरय जयरी मयगाधनदिे ों, यदद कोइ हों, ियरय तैययर होगी । (3) अंचधलक महययोजनय, पययावरणीय और पयररधथथधतक धवचयरों को समयकधलत करने के धलए रयज्य सरकयर के सभी संबद्ध धवभयगों के परयमिा से तैययर होगी, ऄथयात्:-- (i) पययावरण; (ii) वन और वन्यजीव; (iii) कृधर् ; (iv) रयजथव ; (v) िहरी धवकयस; (vi) पयाटन; (vii) ग्रयमीण धवकयस; (viii) पसचयइ और बयढ़ धनयंत्रण; (ix) नगरपयधलकय; (x) पंचययती रयज;II (ii) 3 (xi) लोक धन मयाण धव भयग। (4) अंचधलक महययोजनय ऄनुमोददत धवद्यमयन भू-ईपयोग, ऄवसंरचनय और दरययकलयपों पर कोइ धनबंधन ऄधधरोधपत नहीं करेगी जब तक दक आस ऄधधसूचनय में धवधनर्ददष् ट न हो और अचंधलक महययोजनय सभी ऄवसंरचनय और दरययकलयपों में और ऄधधक दक्षतय और पयररधथथधतक ऄनुकूलतय कय संवधान करेगी । (5) अंचधलक महययोजनय में ऄनयच्छयददत क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकययों के संरक्षण, अवयह क्षत्रे ों के प्रबंधन, जल-संभरों के प्रबंधन, भूतल जल के प्रबधं न, मृदय और नमी संरक्षण, थथयनीय समुदययों की अवश्यकतयओं तथय पयररधथथधतक और पययावरण स ेसंबंधधत ऐसे ऄन्य पहलूओं, धजन पर ध्ययन दने य अवश्यक ह,ै के धलए ईपबंध होंगे । (6) अंचधलक महययोजनय सभी धवद्यमयन पूजय थ थलों, ग्रयमों और नगरीय बंदोबथतों, वनों के प्रकयर और दकथ मों, कृधर् क्षेत्रों, उपजयउ भूधम, हररत क्षेत्र जैसे ईद्ययन और ईसी प्रकयर के थ थयन, ईद्ययन कृधर् क्षेत्र, फलोईद्ययन, झीलों और ऄन्य जल धनकययों कय ऄभ्यकंन करेगी और आस योजनय के मयनधचत्र ियरय धवद्यमयन और प्रथतयधवत भूधम के ईपयोग कय धववरण दकयय जयएगय । (7) अंचधलक महययोजनय थ थयनीय समुदययों की जीवकोपयजान को सुधनधश् चत करने के धलए, पयररधथथधतक संवेदी जोन में धवकयस को पयररधथथधतक ऄनुकूल धवकयस के धलए धवधनयधमत करेगी । (8) अंचधलक महययोजनय आस ऄधधसूचनय में ददए गए ईपबंधों के सबं ंध में ऄपने कययों के बयहर ल े जयने के धलए धनगरयनी सधमधत के धलए एक संदभा दथतयवेज तैययर करेगी । 3. रयज्य सरकयर ियरय दकए जयन े वयल े ईपयय-- रयज्य सरकयर आस ऄधधसूचनय के ईपबंधों को प्रभयवी करने के धलए धनम्नधलधखत ईपयय करेगी, ऄथयात्:-- (1) भ-ू ईपयोग –पयररधथ थधतक संवेदी जोन में वनों, ईद्ययन-कृधर् क्षेत्रों, कृधर् क्षेत्रों, अमोद-प्रमोद के प्रयोजन के धलए धचधन्हत दकए गए पयकों और खुल े थथयनों कय वयधणधज्यक और औद्योधगक संबद्ध धवकयस दरययकलयपों के धलए ईपयोग यय संपररवतान नहीं होगय। के सयथ क में थपष्ट रूप से क्षेत्रों को धनधयाररत दकयय गयय ह:ै परंतु पयररधथथधतक संवेदी जोन के भीतर कृधर् भूधम कय संपररवतान धनगरयनी सधमधत की धसफयररि पर और रयज्य सरकयर के पूव ा ऄनुमोदन से, क्षेत्रीय नगर योजनय ऄधधधनयम के तहत सक्षम प्रयधधकयरी के पूव ा ऄनुमोदन के सयथ और रयज्य सरकयर के ऄन्य धनयमों और धवधनयमों के रूप में लयगू होंगे, जो थथयनीय धनवयधसयों की अवयसीय जरूरतों को पूरय करने के धलए ह,ै जैसे:- (i) धवद्यमयन सड़कों को चौड़य करनय और ईन्हें सुदढृ करनय और नइ सड़कों कय संधनमयाण; (ii) बुधनययदी ढयंचों और नयगररक सुधवधयओं कय संधनमयणा और नवीकरण; (iii) प्रदर्ू ण ईत्पन्न न करने वयले लघु ईद्योग; (iv) कुटीर ईद्योगों धजसके ऄंतगात ग्रयमीण कयरीगर हैं; सुधवधयजनक भण्डयर और थथयनीय सुधवधयओं सहययक पयररधथथधतक पयाटन में सधममधलत गृह वयस; और (v) संवर्वधत दरययकलयप और ऄनुच्छेद 4 के ऄंतगात ददयय गयय ह:ै परंतु यह और भी दक क्षेत्रीय नगर योजनय ऄधधधनयम और ऄन्य धनयमों और धवधनयमों के ऄंतगात रयज्य सरकयर के पूव ाऄनुमोदन तथय संधवधयन के ऄनुच्छेद 244 और तत्समय प्रवृत्त धवधध के ईपबंधों के ऄनुपयलन के धबनय, धजसके ऄंतगात ऄनुसूधचत जनजयधत और ऄन्य परंपरयगत वन धनवयसी (वन ऄधधकयरों की मयन्यतय) ऄधधधनयम, 2006 (2007 कय 2) भी ह,ै वयधणधज्यक यय ईद्योग धवकयस दरययकलयपों के धलए जनजयतीय भूधम कय ईपयोग ऄनुज्ञयत नहीं होगय: परंतु यह और भी दक पयररधथ थधतक संवेदी जोन के भीतर भ-ू ऄधभलेखों म ें ईपसंजयत कोइ त्रुरट, धनगरयनी सधमधत के धवचयर ऄधभप्रयप्त करने के पियत ् रयज्य सरकयर ियरय प्रत्येक मयमले में एक बयर संिोधधत होगी और ईि त्रुरट के संिोधन की संसूचनय केंरीय सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय को दने ी होगी । परंतु यह और भी दक ईपयुाि त्रुरट कय संिोधन में आस ईप पैरय के ऄधीन यथय ईपबंधधत के धसवयय दकसी भी दिय म ें भ-ू ईपयोग कय पररवतान सधममधलत नहीं होगय ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंतु यह और भी दक धजससे हररत क्षेत्र में जैसे वन क्षेत्र, कृधर् क्षेत्र अदद में कोइ पयररणयधमक कटौती नहीं होगी और ऄनप्रयुस त यय ऄनुत् पयदक कृधर् क्षेत्रों में पुन: वनीकरण करने के प्रययस दकए जयएंगे । (2) प्रयकृधतक जल स्रोत -- अचंधलक महययोजनय में सभी प्रयकृधतक जल स्रोतों की पहचयन की जयएगी और ईनके संरक्षण और पुनरुद्भूतकरण के धलए योजनय सधम मधलत होगी और रयज्य सरकयर ियरय ऐसे क्षेत्रों पर यय ईनके धनकट धवकयस दरययकलयप प्रधतधर्द्ध करने के धलए ऐसी रीधत से मयगाधनदिे तैययर दकए जयएंगे । (3) पयटा न – (क) पयररधथथधतक संवेदी जोन के भीतर पयाटन संबंधी दरययकलयप पयाटन महययोजनय के ऄनुसयर होंगे जो दक अंचधलक महययोजनय के भयग रूप में होगी । (ख) पयाटन महययोजनय पयाटन धवभयग, ियरय पययावरण और वन धवभयग के परयमिा से तैययर होगी । (ग) पयाटन महययोजनय अंचधलक महययोजनय के एक घटक के रूप में जयनय जययेगय । (घ) पयाटन संबंधी दरययकलयप धनम नधलधखत के ऄधीन धवधनयधमत होंगे, ऄथयात् :- (i) पयररधथथधतक ऄनुकूल पयाटन दरययकलयप से संबंधधत पयाटकों के ऄथथययी ऄधधभोग के धलए वयस सुधवधय के धसवयय संरधक्षत क्षेत्र की सीमय से एक दकलोमीटर तक यय पयररधथथधतक संवेदी जोन के धवथतयर तक आनमें जो भी धनकट ह,ै नये वयधणधज्यक होटल और ररसोटा ऄनुज्ञयत नहीं होंगे। तथयधप, जहयाँ पयररधथथधतक संवेदी जोन कय धवथतयर एक दकलोमीटर से ज्ययदय ह ै वहयाँ, एक दकलोमीटर से परे और पयररधथथधतक संवेदी जोन के धवथतयर तक सभी नए पयाटक दरययकलयप यय धवद्यमयन दरययकलयप कय धवथतयर पयाटन महययोजनय के ऄनुसयर होगय; (ii) पयररधथथधतक संवेदी जोन के भीतर सभी नए पयाटन दरययकलयपों यय धवद्यमयन पयाटन दरययकलयपों कय धवथतयर केंरीय सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय के मयगदा िाक धसद्धयंतों के ियरय तथय रयष् रीय ा ययघ्र स संरक्षण प्रयधधकरण, ियरय जयरी पयररधथथधतक पयाटन (समय-समय पर यथय संिोधधत) मयगदा िाक धसद्धयंतों के ऄनुसयर, पयररधथथधतक पयाटन, पयररधथथधतक धिक्षय और पयररधथथधतक धवकयस को महत्व दते े हुए पयररधथथधतक संवेदी जोन की वहन क्षमतय के ऄध्ययन पर अधयररत होगय; (iii) अंचधलक महययोजनय कय ऄनुमोदन दकए जयन े तक, पयाटन के धलए धवकयस और धवद्यमयन पयाटन दरययकलयपों के धवथतयर को वयथतधवक थथल धवधनर्ददष्ट संवीक्षय तथय धनगरयनी सधमधत की धसफयररि पर अधयररत संबंधधत धवधनययमक प्रयधधकरणों ियरय ऄनुज्ञयत दकयय होगय । (4) नसै र्वगक धवरयसत -- पयररधथथधतक संवेदी जोन में महत्वपूणा नैसर्वगक धवरयसत के सभी थथलों जैसे सभी जीन कोि अरधक्षत क्षेत्र, िैल धवरचनयएं, जल प्रपयतों, झरनों, घयटी मयगों, ईपवनों, गुफयएं, थथलों, भ्रमण, ऄश्वरोहण, प्रपयतो अदद की पहचयन की जयएगी और ईन्ह ें संरधक्षत दकयय जयएगय तथय ईनकी सुरक्षय और संरक्षय के धलए आस ऄधधसूचनय के प्रकयिन की तयरीख स ेछह मयस के भीतर, ईपयुि योजनय बनयएगी और ऐसी योजनय अंचधलक महययोजनय कय भयग होगय । (5) मयनव धनर्वमत धवरयसत थथ लों - पयररधथ थधतक संवेदी जोन में भवनों, संरचनयओं, धिल्प-तथ्य, ऐधतहयधसक, कलयत्मक और सयंथकृधतक महत्व के क्षेत्रों की पहचयन करनी होगी और आस ऄधधसूचनय के प्रकयिन की तयरीख स ेछह मयह के भीतर ईनके संरक्षण की योजनयएं तैययर करनी होगी तथय अंचधलक महययोजनय में सधममधलत की जयएगी । (6) ध्व धन प्रदर्ू ण -- पयररधथथधतक संवेदी जोन में ध्व धन प्रदर्ू ण के धनयंत्रण के धलए रयज्य सरकयर कय पययावरण धवभयग वययु (प्रदर्ू ण धनवयरण और धनयंत्रण) ऄधधधनयम, 1981 (1981 कय 14) और ईसके ऄधीन बनयए गए धनयमों के ईपबंधों के ऄनुसरण में मयगादिाक धसद्धयंत और धवधनयम तैययर करेगय । (7) वयय ु प्रदर्ू ण -- पयररधथथधतक संवेदी जोन में, वययु प्रदर्ू ण के धनयंत्रण के धलए रयज्य सरकयर कय पययावरण धवभयग वययु (प्रदर्ू ण धनवयरण और धनयंत्रण) ऄधधधनयम, 1981 (1981 कय 14) और ईसके ऄधीन बनयए गए धनयमों के ईपबंधों के ऄनुसरण में मयगादिाक धसद्धयंत और धवधनयम तैययर करेगय । (8) बधहस्रयव कय धनथसयरण -- पयररधथथधतक संवेदी जोन में ईपचयररत बधहस्रयव कय धनथसयरण जल (प्रदर्ू ण धनवयरण तथय धनयंत्रण) ऄधधधनयम, 1974 (1974 कय 6) और ईसके ऄधीन बनयए गए धनयमों के ईपबंधों के ऄनुसयर होगय । (9) ठोस ऄपधिष्ट - ठोस ऄपधिष्टों कय धनपटयन धनम्नधलधखत रूप में होगय -II (ii) 5 (i) पयररधथथधतक संवेदी जोन में ठोस ऄपधिष्टों कय धनपटयन भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की समय-समय पर यथय संिोधधत ऄधधसूचनय सं. कय.अ. 1357(अ), तयरीख 8 ऄप्रैल, 2016 ठोस ऄपधिष्ट प्रबंध धनयम, 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय ; (ii) थथयनीय प्रयधधकरण जैव धनम्नीकरणीय और ऄजैव धनम्नीकरणीय संघटकों में ठोस ऄपधिष्टों के संपृथक्कन के धलए योजनयएं तैययर करेंगे ; (iii) जैव धनम्नीकरणीय सयमग्री को ऄधधमयनतः खयद बनयकर यय कृधम खेती के मयध्यम से पुनःचदरत दकयय जयएगय ; (iv) ऄकयबाधनक सयमग्री कय धनपटयन पयररधथथधतक संवेदी जोन के बयहर पहचयन दकए गए थ थल पर दकसी पययावरणीय थवीकृत रीधत में होगय और पयररधथथधतक संवेदी जोन में ठोस ऄपधिष्टों को जलयनय यय भथमीकरण ऄनुज्ञयत नहीं होगय । 10) जवै धचदकत्स ीय ऄपधिष्ट - जैव धचदकत् सीय ऄपधिष् ट प्रबंधन धनम्नधलधखत रूप में होगय— (क) पयररधथथधतक संवेदी जोन में जैव धचदकत्सीय ऄपधिष्टों कय धनपटयन भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की समय-समय पर यथयसंिोधधत ऄधधसूचनय सं.कय.धन 343 (ऄ), तयरीख 28 मयचा 2016 ियरय प्रकयधित जैव धचदकत्सीय ऄपधिष्ट प्रबंध धनयम, 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय । (ख) पयररधथथधतक संवेदी जोन में कोइ सयमयन्य ईपचयर सुधवधय यय जलययय जयनय ऄनुज्ञयत नहीं दकयय जयएगय । (11) प्लयधथटक ऄपधिष्ट प्रबधं न: - पयररधथथधतक संवेदी जोन में प्लयधथटक ऄपधिष्ट प्रबंध कय धनपटयन भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की समय-समय पर यथयसंिोधधत ऄधधसूचनय सं.कय.धन 340(ऄ), तयरीख 18 मयचा, 2016 ियरय प्रकयधित प्लयधथटक ऄपधिष्ट प्रबंध धनयम 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय। (12) धनमयणा और धवध्वसं ऄपधिष्ट प्रबधं न: - पयररधथथधतक संवेदी जोन में संधनमयाण और धवध्वंस ऄपधिष्ट प्रबंध कय धनपटयन भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की समय-समय पर यथयसंिोधधत ऄधधसूचनय सं.कय.धन 317(ऄ), तयरीख 29 मयचा, 2016 ियरय प्रकयधित संधनमयाण और धवध्वंस प्रबंध धनयम, 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय । (13) इ–ऄपधिष्ट:- पयररधथथधतक संवेदी जोन में इ–ऄपधिष्ट प्रबंध कय धनपटयन भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की समय-समय पर यथयसंिोधधत ियरय प्रकयधित इ–ऄपधिष्ट प्रबंध धनयम, 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय। (14)ययनीय पररवहन: - पररवहन की ययनीय गधतधवधधयय ं अवयस के ऄनुकूल धवधनयधमत होंगी और आस संबंध म ें अंचधलक महययोजनय में धविेर् ईपबंध ऄधधकधथत दकए जयएंग ेऔर अंचधलक महययोजनय के तैययर होने और रयज्य सरकयर के सक्षम प्रयधधकयरी ियरय के ऄनुमोददत होने तक, धनगरयनी सधमधत प्रवृत्त धनयमों और धवधनयमों के ऄनुसयर ययनीय गधतधवधधयों के ऄनुपयलन को धनगरयनी करेगी । (15) औद्योधगक इकयआययं:- (क) धसवयय धवधध के ऄनुसयर धवद्यमयन कयष्ठ अधयररत ईद्योगों पर गरठत दकयय जयएगय पयररधथथधतक संवदे ी जोन के भीतर कोइ नए कयष्ठ ईद्योगों की थथयपनय की ऄनुज्ञय नहीं दी जयएगी। (ख) प्रथतयधवत पयररधथथधतक संवेदी जोन के भीतर, जल, वययु, मृदय, ध्वधन प्रदर्ू ण कयररत नए ईद्योग की थथयपनय ऄनुज्ञय नहीं दी जयएगी । (16)पहयड़ी ढलयनों को संरक्षण: - पहयड़ी ढलयनों के संरक्षण के ऄंतगात: (क) अंचधलक महययोजनय पहयड़ी ढलयनों पर क्षेत्रों कय ईपदर्वित होगय जहयं दकसी भी संधनमयाण की ऄनज्ञु य नहीं दी जयएगी । (ख)कटयव के एक ईच्च धडग्री के सयथ धवद्यमयन खड़ी पहयड़ी ढलयनों यय ढलयनों पर दकसी भी संधनमयाण की ऄनुज्ञय नहीं दी जयएगी । (17) यदद यह अवश्यक समझतय है, आस ऄधधसूचनय के ईपयबंधों को प्रभयवी करने में केंरीय सरकयर और रयज्य सरकयर, ऄन्य ईपययों धनर्ददष्ट करेगय। 4. पयररधथथधतक सवं दे ी जोन म ें प्रधतधर्द्ध और धवधनयधमत दकए जयन े वयल े दरययकलयपों की सचू ी - पयररधथथधतक संवेदी जोन में सभी दरययकलयप पययावरण (संरक्षण) कयररत दकसी भी नए यय पयररधथथधतक संवेदी जोन में प्रदर्ू ण फैलयने वयले ईद्योगों के करने वयले ईद्योगों की थथ यपनय । धवथतयर की ऄनुज्ञय नहीं दी जयएगी । 3. नए बृहत जल धवद्युत पररयोजनय । लयगू धवधधयों के ऄनुसयर प्रधतधर्द्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे । 4. दकसी पररसंकटमय पदयथों कय ईपयोग यय लयगू धवधधयों के ऄनुसयर प्रधतधर्द्ध (ऄन् यथय ईपबंधधत के धसवयय) । ईत्पयदन । 5. प्रयकृधतक जल धनकययों यय भूधम नहीं होगय । 8. जलयवन लकड़ी कय वयधणधज्यक ईपयोग । लयगू धवधधयों के ऄनुसयर प्रधतधर्द्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे । 9. तेल, प्रयकृधतक गैस, जैव ईंधन के पररवहन के लयगू धवधधयों के ऄनुसयर प्रधतधर्द्ध (ऄन्यथय ईपबंधधत के धसवयय) । धलए भूधमगत पयआपलयआन। धवधनयधमत दरययकलयप 10. होटलों और ररसोटों की थथयपनय । पयररधथथधतक पयाटन दरययकलयपों संबंधी पयाटकों की लघु संरचनयओं के धलए संरधक्षत क्षेत्र की सीमय से एक दकलोमीटर तक यय पयररधथथधतक संवेदी जोन के धवथतयर तक, आनमें जो भी धनकट ह,ै नए वयधणधज्यक होटल और ररसोटा ऄनुज्ञयत होंगे, ऄन्यथय नहीं । परंतु, जहयाँ पयररधथथधतक संवेदी जोन कय धवथतयर एक दकलोमीटर स े ज्ययदय ह ै वहयाँ, एक दकलोमीटर से परे और पयररधथथधतक संवेदी जोन के धवथतयर तक सभी नए पयाटक दरययकलयप यय धवद्यमयन दरययकलयप कय धवथतयर पयाटन महययोजनय और यथय लयगू मयगादिी धसद्धयतं ों के ऄनुरुप होगय।II (ii) 7 11. संधनमयणा दरययकलयप । (क) संरधक्षत क्षेत्र यय पयररधथथधतक संवेदी जोन जो भी धनकट हो की सीमय स े एक दकलोमीटर के भीतर दकसी भी प्रकयर कय वयधणधज्यक संधनमयाण ऄनुज्ञयत नहीं दकयय जयएगय: परंतु थथयनीय लोगों को ईनके अवयसीय ईपयोग के धलए ईनकी भूधम में संधनमयणा धजसके ऄंतगात अंचधलक महययोजनय के ऄनुसयर पैरय 3 के ईपपैरय (1) में सूचीबद्ध दरययकलयप भी ह,ैं को करने के धलए ऄनुज्ञयत दकयय जयएगय । (ख) यह और दक ऐसे लघु ईद्योगों जो प्रदर्ू ण नहीं करते ह,ैं से संबधं धत संधनमयाण दरययकलयप धवधनयधमत दकए जयएंगे और लयगू धनयमों और धवधनयमों, यदद कोइ हों, के ऄनुसयर सक्षम प्रयधधकयरी की पूवा ऄनुमधत से ही न् यूनतम पर रखे जयएंगे । (ग) एक दकलोमीटर से ग अचं धलक महययोजनय की ऄनुसयर धवधनयधमत होंगे । 12. प्रदर्ू ण ईत्पन्न न करने वयले लघु ईद्योग । पयररधथ थधतक संवेदी जोन से गैर प्रदर्ू ण, गैर पररसंकटमय, लघु और सेवय ईद्योग कृधर्, पुष् प कृधर्, ईद्ययन कृधर्, यय कृधर् अधयररत ईद्योग दिे ीय मयल से औद्योधगक ईत्पयदों कय ईत्पयदन ईद्योग और जो पययावरण पर कोइ प्रधतकूल प्रभयव नहीं डयलते ह,ैं ऄनुज्ञयत होंगे । 13. ईंट भट्टों की थथयपनय करनय। लयगू धवधधयों के ऄनुसयर धवधनयधमत (ऄन् यथय ईपबंधधत के धसवयय) होंगे । 14. सुरक्षय बल धिधवर। लयगू धवधधयों के ऄधीन धवधनयधमत होंगे । 15. वृक्षों की कटयइ । (क) रयज्य सरकयर में सक्षम प्रयधधकयरी की पूवा ऄनुमधत के धबनय वन, सरकयरी यय रयजथव यय धनजी भूधम पर यय वनों में ककही वृक्षों की कटयइ नहीं होगी । (ख) वृक्षों की कटयइ, संबंधधत केंरीय यय रयज्य ऄधधधनयम यय ईसके ऄधीन बनयए गए धनयमों के ईपबंधों के ऄनुसयर धवधनयधमत होगी । 16. वन ईत्पयदों और गैर कयष् ठ वन ईत्पयदों कय लयगू धवधधयों के ऄधीन धवधनयधमत होंगे । संग्रहण । 17. धवद्युत केबलों और दरू संचयर टयवरों कय लयगू धवधधयों के ऄधीन धवधनयधमत होंगे । भूधमगत केबल को बढ़यवय ददयय पररधनमयाण और केबल धबछयनय और ऄन्य जयएगय। बुधनययदी ढयंचे। 18. बुधनययदी ढयंचों और नयगररक सुधवधयओं कय लयग ू धवधधयों के ऄनुसयर न्यूनीकरण की ईपययों के सयथ, धनयम और संधनमयणा और नवीकरण। धवधनयमन और ईपलब्ध ददियधनदिे धवधनयधमत होंगे। 19. धवद्यमयन सड़कों को चौड़य करनय और ईन्हें लयग ू धवधधयों के ऄनुसयर न्यूनीकरण की ईपययों के सयथ, धनयम और सुदढृ करनय । धवधनयमन और ईपलब्ध ददियधनदिे धवधनयधमत होंगे। 20. पयाटन से संबंधधत दरययकलयप जैसे गमा वययु लयगू धवधधयों के ऄधीन धवधनयधमत होंगे । गुब्बयरें, हेलीकयप्टर, ड्रोन, मयआरोलयआटस और ऄन्य पयाटन दरययकलयप । 21. पहयड़ी ढयलों और नदी तटों कय संरक्षण । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे । 22. रयधत्र में ययधनक ययतयययत कय संचलन । लयगू धवधधयों के ऄधीन वयधणधज्यक प्रयोजन के धलए धवधनयधमत होंगे । 23. थथयनीय समुदययों ियरय चल रही कृधर् और थथयनीय लोगों के ईपयोग के धलए धनगरयनी सधमधत कय गठन करेगी जो धनम्नधलधखत स ेधमलकर बनेगी, ऄथयात ्:- (क) वनों के संरक्षक/ईपवन संरक्षक और वन (वन्यजीव) ईद्ययन और ऄभययरण्य, मधणपुर सरकयर - ऄध्यक्ष; (ख) क्षेत्र कय वररष्ठ नगर योजनयकयर, -सदथय; (ग) वररष्ठ पययावरण आंजीधनयर, मधणपरु रयज्य प्रदर्ू ण धनयंत्रण बोडा, आमफयल -सदथय; (घ) पययावरण के क्षेत्र में कयया करने वयले गैर सरकयरी संगठनों (धजसके ऄंतगात धवरयसत संरक्षण भी ह)ै कय प्रत्येक मयमले में तीन वर् ाकी ऄवधध के धलए मधणपुर रयज्य सरकयर ियरय नयमधनर्ददष्ट एक प्रधतधनधध -सदथय;II (ii) 9 (ङ) मधणपुर सरकयर ियरय नयमधनर्ददष् ट पयररधथ थधतक और पययावरण क्षेत्र प्रत्येक मयमले में तीन वर्ा की धसतंबर, 2006 की ऄनुसूची में के ऄधीन सधममधलत दरययकलयपों और आस ऄधधसूचनय के पैरय 4 के ऄधीन प्रधतधर्द्ध गधतधवधधयों के धसवयय अन े वयले ऐसे दरययकलयपों की दिय में वयथतधवक धवधनर्ददष्ट थथलीय दियओं पर अधयररत धनगरयनी सधमधत ियरय संवीक्षय की जयएगी और ईि ऄधधसूचनय के ईपबंधों के ऄधीन पूव ा पययावरण धनकयसी के धलए केन्रीय सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय को धनर्ददष्ट की जयएगी । (4) ऐसे दरययकलयपों, धजन्हे भयरत सरकयर के तत्कयलीन पययावरण और वन मंत्रयलय की ऄधधसूचनय संख्ययंक कय.अ. 1533(ऄ) तयरीख 14 धसतंबर, 2006 की ऄधधसूचनय के ऄनुसूची के ऄधीन सधममधलत नहीं दकयय गयय है, ईसके पैरय के ऄधीन सयरणी म ें यथय धवधनर्ददष्ट प्रधतधर्द्ध दरययकलयपों के धसवयय, पयररधथथधतक संवेदी जोन म ेंअते हैं, वयथतधवक धवधनर्ददष्ट थथलीय दियओं पर अधयररत धनगरयनी सधमधत ियरय संवीक्षय की जयएगी और ईसे संबद्ध धवधनययमक प्रयधधकरणों को धनर्ददष्ट दकयय जयएगय । (5) धनगरयनी सधमधत कय सदथय-सधचव यय संबद्ध ईपययुसत , ऐसे व्यधि के धवरूद्ध, जो आस ऄधधसूचनय के दकसी ईपबंध कय ईल्लंघन करतय ह,ै पययावरण (संरक्षण) ऄधधधनयम, 1986 की धयरय 19 के ऄधीन पररवयद फयआल करने के धलए सक्षम होगय । (6) धनगरयनी सधमधत मुद्दों के अधयर पर ऄपेक्षयओं पर धनभार रहते हुए संबद्ध धवभयगों के प्रधतधनधधयों यय धविेर्ज्ञों, औद्योधगक संगमों यय संबद्ध पणधयररयों के प्रधतधनधधयों को ऄपने धवचयर-धवमिा में सहययतय के धलए अमंधत्रत कर सकेगी । (7) धनगरयनी सधमधत प्रत्येक वर्ा की 31 मयच ातक की ऄपनी वयर्वर्क कयरावयइ ररपोटा रयज्य के मुख्य वन्य जीव वयडान को ईपयबधं IV म ेंईपबंधधत रूप धवधयन के ऄनुसयर ईस त वर्ा के 30 जून तक प्रथतुत करेगी । (8) केन्रीय सरकयर कय पययावरण, वन और जलवययु पररवतान मंत्रयलय धनगरयनी सधमधत को ऄपने कृत्यों के प्रभयवी धनवाहन के धलए समय-समय पर ऐसे धनदिे द ेसकेगय, जो वह notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O.3337(E), dated 9th December, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 9th December, 2015; AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the aforesaid draft notification; WHEREAS, the Keibul Lamjao National Park in the State of Manipur was formed in 1977 for conservation of its unique ecosystem where the floating mass of entangled vegetation, formed by the accumulation of organic debris and biomass with soil particles (locally known as Phumdi) provides for major habitat of a very high faunal and floral diversity and is well known as the floating National Park in the World; AND WHEREAS, Keibul Lamjao National Park has got a varied floral and faunal diversity including Fauna: Sangai (Cervus eldii eldii), Hog Deer (Axis procinus), Wild Boar (Sus scrofa), Common Otter (Luthra luthra), India civet Cat (Viverriculata indica), Rusell’s Viper (Viper russellii), Cobra (Naja naja), Rock Python (Python molurus), etc. Migratory birds: Pochard (Aythya ferina), Baer’s Pochard (Aythya baeri), Maldarin Duck (Aix galericulata), Bar-headed Goose (Anser indicus), Ruddy Shelduck (Tadorna ferrguinea), Shaveller (Anas strepera), Gadwall (Astrepera streperal), Little Grebe (Tachybaotus rificollis), Northern Pintail (Anas acuta) and Baikal Teal (Anas formosa); Flora: Alpinia galanga, Arundo donax, Cynodon dactylon, Dioschoria bulbifera, Eiranthus arundinaceus, Eiranthus procerus, Hedychium coronarium, Saccharum bengalensis, Saccharum munja, Phragmitis karka, Zizania latifolia, etc.; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of the Keibul Lamjao National Park as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1), clause (v) and clause (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0.64 kilo meters to 8.43 kilo meters from the boundary of the Keibul Lamjao National Park in the State of16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Manipur as the Keibul Lamjao National Park Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone), details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone. – (1)The extent of Eco-sensitive Zone varies from 0.64 kilometres to 8.43 kilometres from the boundary of the Keibul Lamjao National Park and the area of Eco-sensitive Zone is 176 square kilometres. (2) The Eco-sensitive Zone is bounded by 24º31’10.266"N latitude and 93º56’28.568”E longitude towards east (point No.13 of Annexure I map); 24º30’4.244"N latitude and 93º46’37.812"E longitude towards west (point No.1 of Annexure I map); 24º33’22.486"N latitude and 93º53’54.961”E longitude towards north (point No.11 of Annexure I map) and 24º22’20.930"N latitude and 93º52’11.593"E longitude towards south (point No.22 of Annexure I map). (3) The map of Eco-sensitive Zone boundary together with its latitude and longitude is appended as Annexure I. (4) The coordinates of Eco-sensitive Zone with its latitudes and longitudes is appended as Annexure II. (5) The list of the villages falling within Eco-sensitive Zone along with coordinates of the prominent points is appended as Annexure III. 2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the Competent Authority in the State Government. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue, (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayati Raj ; (xi) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and Eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure and promote Eco- friendly development and livelihood security of local communities. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities :II (ii) 17 Provided that the conversion of agricultural and other lands, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government to meet the residential needs of the local residents, and for activities such as: (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting Eco-tourism including home stay; and (v) promoted activities and given under paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.- The catchment areas of all natural springs, rivers and channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. 3. Tourism.- (a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The activities of tourism shall be regulated as under, namely:- (i) no new construction of hotels and resorts shall be allowed within one kilometer from the boundary of the Wildlife Sanctuary or upto the extent of the ESZ whichever is nearer, however, beyond the distance of one kilometer from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan. (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the Eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on Eco-tourism, Eco-education and Eco-development and based on carrying capacity study of the Eco- sensitive Zone; (iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. 4. Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan. 5. Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 6. Noise pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder. 7. Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. 8. Discharge of effluents.- Discharge of treated effluents in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made thereunder. 9. Solid wastes: Disposal and management of solid wastes shall be as under:- (i) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time; (ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) the inorganic material shall be disposed in an environmental acceptable manner at site identified outside the Eco- sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone. (10) Bio-medical waste.- Bio medical waste management shall be as under: (i) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time. (ii) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone. (11) Plastic Waste Management: The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and Demolition Waste Management: The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste: The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time. (14) Vehicular traffic: The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the law. (b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive zone shall be permitted. (16) Protection of hill slopes.- The protection of hill slopes shall be as under: (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted. (17) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and be regulated in the manner specified in the Table below, namely:-II (ii) 19 TABLE S. (c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan. 12. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:- (a) The Conservator of Forests / Deputy Conservator of Forests (Wild Life) Park and Sanctuary, Government of Manipur - Chairman; (b) Senior Town Planner of the area - Member; (c) Senior Environment Engineer, Manipur State Pollution Control Board, Imphal -Member; (d) A representative of Non-governmental Organisations working in the field of environment (including heritage conservation) to be nominated by the Government of Manipur for a term of three years – Member; (e) One expert in the area of ecology and environment to be nominated by the Government of Manipur for a term of three years in each case - Member; (f) Member State Biodiversity Board -Member (g) Divisional Forest Officer (National Park) - Member Secretary. Terms of reference: (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring Committee shall be three years. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Conservator of Forests / Park and Sanctuaryshall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1886) against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State per proforma appended at Annexure IV. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 7. The provisions of this notification shall be subject to the orders, if any, passed or to be passed by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
