का सांरक्ण और सुरक्ा करना महत्त्वपूणा ह;ै और, थिमलापुरा वन्यजीव अभयारण्य के चारों ओर के क्षत्रे को, जिसका जवस्ट्तार और सीमाए ां पाररथथिथतकी पयाावरणीय से पाररथथिथतकी सांवेदी जोर् के रूप म ें पैरा 1 में जवजनर्िष्ट का ह,ैं जैव थवथवथधता की िजृ ष्ट क सुरजक्षत और संरजक्षत करना और उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों के विों के प्रचालन और प्रसंस्ट्करण करने को प्रजतजिद्ध करना आव‍र्क ह;ै अतः, अब, केन्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परदत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (थजसे इस अथधसूचर्ा म ें इसके पश्चात पयाावरण अथधथर्यम कहा िया ह)ै की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) तिा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग[भाग II—खण ड 3(ii)] भारत का रािपत्र : असाधारण 3 करत े हुए, कनााटक राज्र् के टुमाकुरू थजल े के थिमलापुरा वन्यजीव अभयारण्य की सीमा के चारों ओर 1.00 ककलोमीटर से 2.20 ककलोमीटर तक जवस्ट्ताररत क्षेत्र को थिमलापुरा वन्यजीव अभयारण्य पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके प‍ चात पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप म ेंअजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाात :- 1. पाररजस्ट्थजतकी संविे ी िोन का जवस्ट्तार और सीमाए.ां -(1) पाररजस्ट्थजतकी संवेिी िोन का थवथतार जथमलापुरा वन्र्िीव अभर्ारण्र् के चारों ओर 1.00 ककलोमीटर से 2.20 ककलोमीटर तक थवथतृत ह ै और पाररथथिथतकी सांवेदी जोर् का क्ेत्रफल 61.80 वि ा ककलोमीटर ह।ै (2) जथमलापुरा वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का थववरण उपाबधां -I के रूप में संलग्न ह।ै (3) सीमा थववरण और अक्षािं और िेिांतर के साथ पाररजस्ट्थजतकी संवेिी िोन के सीमाांकर् को ििााते हुए जथमलापरु ा वन्र्िीव अभर्ारण्र् के मानजचत्र उपाबधं -IIक, उपाबधं -IIख और उपाबधं -IIि के रूप म ेंसंलग्न ह।ै (4) पाररजस्ट्थजतकी संवेिी िोन और जथमलापुरा वन्र्िीव अभर्ारण्र् की सीमा के भू-थर्देशाांकों की सूची उपाबधां - III की सारणी क और सारणी ख में दी िई ह।ै (5) मुख्र् सबंिओंु के भ-ू जनिेिाकं ों के साथ पाररजस्ट्थजतकी संविे ी िोन के अंतगात आन े वाल े ग्रामों की सूची उपाबधं -IV के रूप म ेंसंलग्न ह।ै (6) पाररथथिथतकी सांवेदी जोर् के अांतिात ररज़वा वर् और थिमलापुरा सांरक्ण ररज़वा क्ेत्रों का थववरण उपाबधं -V के रूप में संलग्न ह।ै 2. पाररजस्ट्थजतकी संविे ी िोन के जलए आचं जलक महार्ोिना– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिर्ों के जलए रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख से िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और राज्य के सक्म प्राथधकारी के अर्ुमोदर् के थलए इस अजधसूचना म ें दिए गए अनुबंधों का पालन करत े हुए आंचजलक महार्ोिना तैर्ार करेगी। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत से िो इस अजधसूचना म ें जवजनर्िष्ा ट दकए गए ह,ैं के अनुसार तथा सुसंगत केंरीर् और राज्र् जवजधर्ों के अनरूु प और केंरीर् सरकार द्वारा िारी मागाजनिेिों, र्दि कोई हों, द्वारा भी तैर्ार होगी । (3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् बातों को समाकजलत करने के जलए राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ासे तैर्ार होगी.- (i) पर्ाावरण; (ii) वन और वन्र्िीव; (iii) कृजि; (iv) रािस्ट् व; (v) िहरी जवकास; (vi) पर्ाटन; (vii) ग्रामीण जवकास; (viii) ससंचाई और बाढ़ जनर्ंत्रण;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ix) र्िरपाथलका; (x) पंचार्ती राि; और (xi) लोक जन मााण जव भाग। (4) आंचजलक महार्ोिना अनमु ोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नह, करेगी िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िष्ा ट न हो और आचंजलक महार्ोिना सभी अवसंरचना और दक्रर्ाकलापों म,ें िो अजधक िक्षता और पाररजस्ट्थजतकी अनुकूल हों, का संवधान करेगी । (5) आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समुिार्ों की आव‍र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण से संबंजधत ऐसे अन्र् पहलओंु , जिन पर ध्र्ान िेना आव‍र्क ह,ै के जलए उपबंध होंगे । (6) आंचजलक महार्ोिना थवद्यमार् और प्रथताथवत भूथम उपयोि थवशेषताओं के ब्लयौरों से अर्ुसमर्िात मार्थचत्र के साि सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों, कृजि क्षेत्रों, ऊपिाऊ भूजम, हररत क्षेत्र िैसे उद्यान और उसी प्रकार के स्ट् थान, उद्यान कृजि क्षेत्र, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभ्र्कंन करेगी। (7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करेगी और पैरा-4 में सारणी में सूचीबद्ध प्रजतजिद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन करेगी और स्ट् थानीर् समुिार्ों की जीथवका को सुरथक्त करर् े के थलए पाररजस्ट्थजतकी अनुकूल जवकास को सुथर्थश्चत और उसकी अथभवृथि भी करेिी। (8) आंचजलक महार्ोिना प्रादेथशक जवकास र्ोिना की सह जवस्ट्तारी होगी । (9) इस प्रकार अनुमोदित आंचजलक महार्ोिना इस अजधसूचना के उपबंधों के अनुसार थर्िरार्ी के अपन े कार्ों को करन े के जलए थर्िरार्ी सजमजत के जलए एक संिभा िस्ट्तावेि तैर्ार करेगी । 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करने के जलए जनम्नजलजखत उपार् करेगी, अथाात :- (1) भू-उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन म ें वनों, उद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मर्ोरांजर् के प्रर्ोिर्ों के जलए जचजन्हत दकए गए पाकों और खुल े स्ट्थानों का वाजणजज्र्क या आवासीय या औद्योजगक संबद्ध जवकास दक्रर्ाकलापों के जलए उपर्ोग र्ा संपररवतान नह, होगा: परंत ु पाररजस्ट्थजतकी संवेिी िोन के भीतर उपयुाक्त भाि (क) में जवजनर्िष्ट का प्रर्ोिर्ों से जभन्नों प्रर्ोिर्ों के जलए कृजि और अन्र् भूजम का संपररवतान थर्िरार्ी सजमजत की जसफाररि पर और र्था लागू और प्रािेजिक नगर र्ोिना अजधजनर्म और केन्रीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से, और इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आव‍र्कताओं को पूरा करन े के जलए अनज्ञु ात दकर्ा िाएगा, िैस:े - (i) जवद्यमान सडकों को चौडा करना और उन्ह ेंसुिढ़ृ करना तथा नई सडकों का संजनमााण; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रििू ण उत्पन्न न करने वाल े लघ ुउद्योग; (iv) कुटीर उद्योगों जिनके अंतगता ग्रामीण उद्योग भी ह;ैं सुजवधािनक भण्डार और स्ट्थानीर् सुजवधाए ां सहार्क पाररजस्ट्थजतकी पर्ाटन थजसके अन्तिता िहृ वास सजम्मजलत ह;ै और[भाग II—खण ड 3(ii)] भारत का रािपत्र : असाधारण 5 (v) पैरा 4 के अधीर् कदए िए संवर्धात दक्रर्ाकलाप: परंत ु र्ह और दक प्रादेथशक नगर र्ोिना थवथध और राज्य सरकार के अन्र् जनर्मों और जवजनर्मों के अधीर् सक्म प्राथधकारी के पूवा अर्ुमोदर् और संजवधान के अनुच्छेि 244 के उपबांधों या तत्समर् प्रवृत्त जवजध के उपबंधों के अनुपालन के जबना, जिसके अधीर् अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी ह,ै वाजणजज्र्क र्ा औद्योथिक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का उपर्ोग अनुज्ञात नह, होगा: परंत ु र्ह और भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भू-अजभलेखों म ें उपसंिात कोई िलती, थर्िरार्ी सजमजत के जवचार प्राप्त करन े के पश्चात राज्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार ठीक होगी और उि िलती के सुधार की सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह और भी दक िलती के सुधार म ें इस उप पैरा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा म ें भू-उपर्ोग का पररवतान सजम्मजलत नह, होगा; (ख) वनीकरण तथा वास िीणोद्धार दक्रर्ाकलापों सजहत अनप्रर्ुक् त र्ा अनुत् पािक कृजि क्षत्रे ों में पुन: वनीकरण करने के प्रर्ास दकए िाएंग।े (2) प्राकृजतक िल स्रोतों.- आचंजलक महार्ोिना म ें सभी प्राकृजतक झरर्ों के आवाह क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीकरण के जलए र्ोिना सजम् मजलत होगी और राज्र् सरकार द्वारा ऐसे क्षेत्रों पर र्ा उनके जनकट जवकास दक्रर्ाकलाप प्रजतजिद्ध करने के बारे म ें जो ऐसे क्ेत्रों के थलए अथहतकर हो ऐसी रीजत से मािादशाक जसद्धांत तैर्ार दकए िाएंगे। (3) पर्टा न र्ा पाररथथिथतकी पयटा र्.- (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररथथिथतकी सांवेदी जोर् के जलए होगा। (ख) पाररथथिथतकी पर्ाटन महार्ोिना राज्र् पर्ाटन जवभाग द्वारा राज्र् पर्ाावरण और वन जवभाग के परामि ा स े तैर्ार होगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना के एक घटक के रूप म ेंहोगी। (घ) पयाटर् महायोजर्ा पाररथथिथतकी सांवेदी जोर् की वहर् क्मता के आधार पर तैयार की जाएिी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबधं ी दक्रर्ाकलाप जनम्नानुसार जवजनर्जमत होंगे, अिाात: - (i) सांरथक्त क्त्रे की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट ह,ै नर् ेवाजणजज्र्क होटल और ररजॉट ाके सथन्नमााण अनज्ञु ात नह, होंग:े परंत,ु यह कक सांरथक्त क्त्रे की सीमा से एक दकलोमीटर की िरू ी से परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक होटलों और ररजॉट ा का स्ट्थापर्ा केवल पूवा पररभाजित और नामजनर्िष्ट का क्षेत्रों में पर्टा न महार्ोिना के अनुसार पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए ही अनज्ञु ात होगा; (ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार केंरीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् के मागाििाक जसद्धांतों के द्वारा तथा राष्र ीर् ा र्ाघ्र स संरक्षण प्राजधकरण, द्वारा िारी पाररथथिथतकी–पयाटर्, पाररथथिथतकी-थशक्ा और पाररथथिथतकी-थवकास पर बल देते हुए (समर्- समर् पर र्था संिोजधत) जारी मागाििाक जसद्धांतों के अनुसार होगा;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iii) आंचजलक महार्ोिना का अनुमोिन दकए िाने तक, पर्टा न के जलए जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्िष्ट का संवीक्षा और थर्िरार्ी सजमजत की जसफाररि पर आधाररत संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नर्े होटल र्ा ररसोटा र्ा वाजणजज्र्क स्ट्थापर्ा का संजनमाणा अनुज्ञात नह, दकर्ा िार्ेगा । (4) नसै र्गका जवरासत.- पाररजस्ट्थजतकी संवेिी िोन म ें महत्वपूणा नैसर्गाक जवरासत के सभी स्ट्थलों िैसे िीन कोि आरजक्षत क्षत्रे , िैल जवरचनाएं, िल प्रपातों, झरनों, घाटी मागों, उपवनों, गुफाए,ं स्ट्थलों, भ्रमण, अश्वरोहण, प्रपातों आदि की पहचान की िाएगी और जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रूप में परररक्षण और संरक्षण के जलए तैर्ार की िाएगी । (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, जिल्प-तथ्र्, ऐजतहाजसक, थिापत्य, सौंदयापूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान और उनके संरक्षण के जलए जवरासत र्ोिना आंचजलक महार्ोिना के भाग के रूप म ेंतैर्ार की िाएगी। (6) ध्व जन प्रििू ण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रििू ण (जवजनर्मन और जनर्त्रं ण) जनर्म, 2000 म ें जनर्त उपबंधों के अनुसार म ेंपाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रििू ण के जनर्ंत्रण और थर्वारण का अर्ुपालर् ककया जाएिा। (7) वार् ु प्रििू ण.- पाररजस्ट्थजतकी संवेिी िोन म,ें वार्ु प्रििू ण के जनवारण और जनर्ंत्रण का वार्ु (प्रििू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार अनुपालन दकर्ा िाएगा। (8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत बजहस्राव का जनस्ट्सारण, साधारणों मानकों के उपबांधों के अर्ुसार पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आने वाले पर्ाावरणीर् प्रिूिण के जनस्ट्सारण के जलए साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक कदोर हो, के उपबंधों के अनुसार होगा। (9) दोस अपजिष्ट क.- दोस अपजिष्ट क का जनपटान एवं प्रबधं न जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें दोस अपजिष्ट क का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 1357(अ), तारीख 8 अप्रलै , 2016 के अधीर् प्रकाजित दोस अपजिष्ट क प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन स े बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप दोस अपजिष्ट क का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा जा सकेिा। (10) िैव जचदकत्सा अपजिष्ट .- िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा.- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिष्ट क का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसचू ना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016 के अधीर् प्रकाजित िैव जचदकत्सा अपजिष्ट क प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्ट क का सुरजक्षत और पर्ाावरण-अनुकूल प्रबधं न अनुज्ञात दकर्ा जा सकेिा।[भाग II—खण ड 3(ii)] भारत का रािपत्र : असाधारण 7 (11) प्लाजस्ट्टक अपजिष्ट क प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट क प्रबधं र् का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक अपजिष्ट क प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (12) जनमाणा और जवध्वसं अपजिष्ट क प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन में संजनमााण और जवध्वंस अपजिष्ट क प्रबंधर् का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर अजधसूचना स.ं साां.का.जन 317(अ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा । (13) ई–अपजिष्ट क.- पाररजस्ट्थजतकी संवेिी िोन म ें ई–अपजिष्ट क प्रबंधर् का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा प्रकाजित ई–अपजिष्ट क प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) र्ानीर् यातायात.- यातायात की र्ानीर् गजतजवजधर्ां आवास के अनुकूल जवजनर्जमत होंगी और इस संबंध म ें आंचजलक महार्ोिना म ें जविेि उपबंध सथम्मथलत दकए िाएंगे और आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित होने तक, थर्िरार्ी सजमजत सुसांित अथधथर्यमों और उसके अधीर् बर्ाए िए जनर्मों और जवजनर्मों के अनुसार र्ानीर् कियाकलापों के अनुपालन को थर्िरार्ी करेगी। (15) र्ानीर् प्रििू ण.- लागू जवजधर्ों के अर्ुपालर् म ें वाहन प्रििू ण का थर्वारण और जनर्ंत्रण दकर्ा िाएगा। स्ट्वच्छक ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ा.ं- (क) राजपत्र म ें इस अथधसूचर्ा के प्रकाशर् पर या उसके पश्चात पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रिजू ित उद्योगों की स्ट्थापना की अनज्ञु ा नह, िी िाएगी। (ख) केन्द्रीय प्रदषू ण थर्यांत्रण बोडा द्वारा फरवरी, 2016 म ें जारी मािादशाक थसिान्तों म ें उद्योिों के विीकरण के अर्ुसार, जब तक कक अथधसूचर्ा म ें इस प्रकार थवथर्र्दष्टा र् हो; पाररथथिथतकी सांवेदी जोर् के भीतर केवल िैर- प्रदषू णकारी उद्योिों को अर्ुज्ञात ककया जाएिा और इसके अथतररक्त, िैर प्रदषू णकारी उद्योिों को बढ़ावा कदया जाएिा। (17) पहाडी ढलानों को सरं क्षण.- पहाडी ढलानों का संरक्षण जनम्नानुसार होगा:- (क) आंचजलक महार्ोिना पहाडी ढलानों पर क्षेत्रों का संकेत होगा िहां दकसी भी संजनमााण की अनज्ञु ा नह, िी िाएगी; (ख) कटाव के एक उच्च जडग्री के साथ जवद्यमान खडी पहाडी ढलानों र्ा ढलानों पर दकसी भी संजनमााण की अनज्ञु ा नह, िी िाएगी । 4. पाररजस्ट्थजतकी सवं िे ी िोन म ें प्रजतजिद्ध और जवजनर्जमत दकए िान े वाल े दक्रर्ाकलापों की सूची.- पाररजस्ट्थजतकी संवेिी िोन म ें सभी दक्रर्ाकलाप पर्ाावरण अजधजनर्म के उपबंधों और उसके अधीर् बर्ाए िए थर्यमों थजसके अन्तिात तटीर् जवजनर्मन िोन, 2011 और पर्ाावरणीर् प्रभाव आकलन अजधसूचना, 2006 और बनाम भारत संघ के मामले म ें तारीख 21 अप्रलै , 2014 के आिेि के अनुसरण म ेंहोगा । 2. प्रििू ण (िल, वार्ु, मृिा, ध्वजन, आदि) पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान उत्पन करन े वाल ेउद्योगों की स्ट्थापना । प्रििू णकारी उद्योगों का जवस्ट्तार करने की अनुज्ञा नह, होगी: परन्त ु यह कक केन्द्रीय प्रदषू ण थर्यांत्रण बोडा द्वारा फरवरी, 2016 म ें जारी मािा दशाक थसिान्तों म ें उद्योिों के विीकरण के अर्ुसार जब तक कक अथधसूचर्ा म ें ऐसा थवथर्र्दष्टा र् हों, पाररथथिथतकी सांवेदी जोर् के भीतर िैर-प्रदषू णकारी उद्योिों को अर्ुज्ञात ककया जाएिा और इसके अथतररक्त िैर-प्रदषू णकारी कुटीर उद्यािों को बढ़ावा कदया जाएिा। 3. ब ृहत िल जवद्युत पररर्ोिना की प्रजतजिद्ध। स्ट्थापना । 4. दकसी पररसंकटमर् पिाि ा का उपर्ोग प्रजतजिद्ध। र्ा उत्पािन र्ा प्रसंस्ट्करण। 5. प्राकृजतक िल जनकार्ों र्ा क्षेत्र भूजम म ें प्रजतजिद्ध। अनुपचाररत बजहस्रााव का जनस्ट्सारण । 6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई और जवद्यमान आरा जमलों का जवस्ट् तार अनुज्ञात नह, होगा । 7. ईंट भट्टों की स्ट्थापना करना। प्रजतजिद्ध। 8. फमों, कंपजनर्ों द्वारा बडे पमै ाने पर प्रजतजिद्ध। वाजणजज्र्क पिुओं और कुक्कुट फामों की स्ट्थापना । 9. िलावन लकडी का वाजणजज्र्क प्रजतजिद्ध। उपर्ोग। 10. नई लकडी आधाररत उद्योग। प्रजतजिद्ध।[भाग II—खण ड 3(ii)] भारत का रािपत्र : असाधारण 9 आ. जवजनर्जमत दक्रर्ाकलाप 11. वाजणजज्र्क होटलों और ररसोटों पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों लघ ु अस्ट्थार्ी सरं चनाओं के जसवार् की स्ट्थापना । संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट ह,ै नए वाजणजज्र्क होटल और ररसोटों को अनुज्ञात नह, दकर्ा िाएगा: परांत ु यह कक सांरथक्त क्त्रे की सीमा से एक ककलोमीटर के परे या पाररथथिथतकी सांवेदी जोर् के थवथतार तक इर्म ें स,े जो भी थर्कट हो सभी नए पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान दक्रर्ाकलाप का जवस्ट्तार पर्ाटन महार्ोिना और र्था लागू मागाििी जसद्धांतों के अनुरूप होगा। 12. संजनमााण दक्रर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से 1 दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के थवथतार तक, इनमें िो भी जनकट हो, दकसी भी प्रकार के नर् ेवाजणजज्र्क संजनमााण की अनुज्ञा नह, होगी: परंत ु यह कक स्ट्थानीर् लोगों को अपनी आवास सम्बन्धी जनम्नजलजखत आव‍र्कताओं को परू ा करन े के जलए, पैरा 3 के उप परै ा (1) में सूचीबद्ध दक्रर्ाकलापों सजहत अपने उपर्ोग के जलए, अपनी भूजम में भवन उप-जवजधर्ों के अनुसार, संजनमााण करने की अनुज्ञा होगी: (i) जवद्यमान सडकों को चौडा करना और उन्ह ें सुिढ़ृ करना तथा नई सडकों का संजनमााण; (ii) बुजनर्ािी ढाचं ों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) केंरीर् प्रििू ण जनर्ंत्रण बोडा द्वारा दकए गए वगीकरण के अनुसार गैर- प्रििू णकारी लघु उद्योगों की स्ट्थापना; (iv) ग्रामीण उद्योगों सजहत कुटीर उद्योगों, सुजवधा भण्डारों और गहृ - वास सजहत पाररजस्ट्थजतकी पर्टा न म ें सहार्क स्ट्थानीर् सुजवधाओं की व्यवस्ट्था; और (v) इस अजधसूचना में सूचीबद्ध बढ़ावा दिए गए दक्रर्ाकलाप । परांत ु यह कक गैर–प्रििू णकारी लघु उद्योगों से संबंजधत संजनमााण दक्रर्ाकलाप लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनमु जत से जवजनर्जमत दकए िाएंगे और वे न्र्ूनतम होंग े । (ख) एक दकलोमीटर क्षेत्र से परे र् े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे । 13. प्रििू ण उत्पन्न न करन े वाले लघ ु फरवरी, 2016 म ें केन्रीर् प्रििू ण जनर्ंत्रण बोडा द्वारा िारी उद्योगों म ें उद्योग । वगीकरण के अनुसार गरै -प्रििू णकारी उद्योग और अपररसंकटमय में, लघ ु और सेवा उद्योग, कृजि, पुष्प कृजि, उद्यान कृजि र्ा पाररजस्ट्थजतकी संवेिी िोन से िेिी सामग्री से उत्पािों को उत्पन्न करन े वाले कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे। 14. वृक्षों की कटाई । (क) राज्र् सरकार म ें सक्षम प्राजधकारी की पूवा अनज्ञु ा के जबना वन, सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर र्ा वनों म ें मािादशाक थसिाांतों के अर्ुसार ककया जाएिा। नवीन सडकों का संजनमााण । 19. पर्ाटन से संबंजधत अन्र् लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा । दक्रर्ाकलाप िैसे दक पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर स े गम ा वार्ु के गुध बारे, हले ीकाप्टर, ड्रोन, माइक्रोलाइ्स उडाना आदि। 20. पहाडी ढालों और निी तटों का लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे । संरक्षण । 21. राजत्र म ें र्ाजनक र्ातार्ात का लाग ूजवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होंग े। संचलन । 22. स्ट्थानीर् समुिार्ों द्वारा चल रही स्ट्थानीर् लोगों के उपर्ोग के जलए लाग ू जवजधर्ों के अनुसार अनुज्ञात कृजि और बागवानी प्रथाओं के ककया जाएिा। साथ दग्ु धिाला, िग्ु घ उद्योग, कृजि और मछली पालन । 23. प्राकृजतक िल जनकार्ों र्ा सतही जल थर्कायों म ें उपचाररत अपथशष्ट जल या बजहस्रााव के थर्थसारण से क्षत्रे म ें उपचाररत बजहस्रााव का बचा िाएगा 24. सतही और भूिल का वाजणजज्र्क लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे । प्रर्ोग एवं जनष्किणा । 25. दोस अपजिष्ट क का प्रबन्धन और लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे । िैव जचदकत्सा अपजिष्ट । 26. अजधजनर्म, 1986 की धारा 3 की उपधारा (3) के अधीर् इस अथधसूचर्ा के उपबांधों की प्रभावी जनगरानी के थलए जनगरानी सजमजत का िठर् करती ह,ै िो जनम्नजलजखत स ेजमलकर बनगे ी, अिाात:् - क्र.स.ं थर्िरार्ी सजमजत का प्रजतजनजध सिस्ट्र्; (iv) कनााटक सरकार के िहरी जवकास जवभाग के प्रजतजनजध सिस्ट्र्; (v) कनााटक सरकार द्वारा प्राकृजतक संरक्षण (जवरासत संरक्षण सजहत) के सिस्ट्र्; क्षत्रे म ें काम करने वाल ेगैर-सरकारी संगदनों के प्रजतजनजध (vi) प्रािेजिक अजधकारी, कनााटक राज्र् प्रििू ण जनर्ंत्रण बोड ा सिस्ट्र्; (vii) कनााट क सरकार के प्रजतजित संस्ट्थान र्ा जवश्वजवद्यालर् के सिस्ट्र्; पाररजस्ट्थजतकी म ें एक जविेिज्ञ को कनााटक सरकार द्वारा नामजनर्िष्ट का दकर्ा िाएगा। (viii) उप आ र्िु र्ा उनके प्रजतजनजध, टुमाकूरु जिला सिस्ट्र्; (ix) सिस्ट्र्, राज्र् िैव जवजवधता बोड ा सिस्ट्र्; (x) उप वन संरक्षक, टुमाकूरु प्रभाग, कार्का ाल तीन वि ा तक र्ा राज्र् सरकार द्वारा नई सजमजत के पुन: गदन तक के जलए होगा और तत्पश्चात जनगरानी सजमजत राज्र् सरकार द्वारा गरदत की िाएगी। (3) उर् कियाकलापों की, जो भारत सरकार के तत्कालीर् पयाावरण और वर् मांत्रालय की अथधसूचर्ा सांख्याांक का.आ. 1533 (अ), तारीख 14 थसतम्बर, 2006 की अर्ुसूची म ें सथम्मथलत ह,ैं और जो पाररथथिथतकी सांवेदी जोर् म ें आत े ह,ैं थसवाय इसके जो पैरा 4 के अधीर् सारणी म ें यिा थवथर्र्दष्टा प्रथतजिि कियाकलापों के, जनगरानी सथमथत द्वारा वाथतथवक थवथर्र्दष्टा थिलीय दशाओं के आधार पर सवां ीक्ा की जाएिी और उक्त अथधसूचर्ा के उपबांधों के अधीर् पूवा पयाावरण अर्ापथि के थलए केद्रींय सरकार के पयाावरण, वर् और जलवायु पररवतार् मांत्रालय को थर्र्दष्टा ककया जाएिा। (4) इस अजधसूचना के पैरा 4 के अधीन सारणी म ें र्था जवजनर्िष्ट का प्रजतजिद्ध दक्रर्ाकलापों के जसवार्, भारत सरकार के तत्क ालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अजधसूचना के अनुसूची के अधीन ऐसे अनुसूची में दक्रर्ाकलापों, जिन्हें सजम्मजलत नह, दकर्ा गर्ा ह,ै परंतु पाररजस्ट्थजतकी संवेिी िोन म ें आत े ह,ैं ऐसे दक्रर्ाकलापों की वास्ट्तजवक जवजनर्िष्ट का स्ट्थलीर् ििाओं पर आधाररत जनगरानी सजमजत द्वारा संवीक्षा की िाएगी और उसे संबद्ध जवजनर्ामक प्राजधकरणों को जनर्िष्ट का दकर्ा िाएगा । (5) जनगरानी सजमजत का सिस्ट्र्-सजचव र्ा संबद्ध उपायुक्त ऐसे व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लघं न करता ह,ै पर्ाावरण अजधजनर्म की धारा 19 के अधीन पररवाि फाइल करन ेके जलए सक्षम होगा। (6) जनगरानी सजमजत मुद्दा िर मद्दु ा के आधार पर अपेक्षाओं पर जनभार रहते हुए संबद्ध जवभागों के प्रजतजनजधर्ों र्ा जविेिज्ञों, औद्योजगक संगमों र्ा संबद्ध पणधाररर्ों के प्रजतजनजधर्ों को अपन े जवचार-जवमि ा म ें सहार्ता के जलए आमंजत्रत कर सकेगी । (7) जनगरानी सजमजत प्रत्र्ेक विा की 31 माच ा तक के अपने दक्रर्ाकलापों की वार्िाक कारावाई ररपोट ा राज्र् के मुख्र् वन् र्िीव वाडान को उपाबंध VI म ें संलग्न प्रोफामाा में उक्त विा के 30 िून तक प्रस्ट्ततु करेगी । (8) केन्रीर् सरकार का पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् जनगरानी सजमजत को अपन े कृत्र्ों के प्रभावी जनवाहन के जलए समर्-समर् पर 2020 S.O. 3497(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, Part II, section 3, sub-section (ii), vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 1322(E), dated the 23rd April, 2020, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 23rd April, 2020; AND WHEREAS, objections and suggestions were received from persons and stakeholders in response to the aforesaid draft notification were duly considered by the Central Government; AND WHEREAS, Thimlapura Wildlife Sanctuary situated in the Madhugiri and Koratagere Talukas of District Tumakuru, Karnataka lies between 13°34' N and 13°39' N indica, Asparagus racemosus, Boerhavia diffusa, Bombax ceiba, Boswellia serrata, Buchanania axillaris, Butea monosperma, Calotropis gigantea, Canthium coromandelicum, Caralluma adscendens, Careya arborea, Cassia auriculata, Cassia fistula, Cassia mimosoides, Cassia tora, Diospyros melanoxylon, Dodonaca viscosa, Eupatorium odoratum, Euphorbia hirta, Evolvulus alsinoides, Feronia clephantum, Thimlapura Wildlife Sanctuary’s rocky terrain, scrub jungle is an ideal habitat for the wildlife such as sloth bear, leopard, pangolin, civet cat, jungle cat, wild boar, jackal, porcupine, black-naped hare, ruddy mongoose, etc, some of which are Schedule-I species and it also forms a habitat for about 150 species of birds and reptiles such as tortoise, russell's viper, red sand boa, cobra, etc; AND WHEREAS, the major fauna available in the Thimlapura Wildlife Sanctuary are Indian mole rat ( Bandicota bengalensis), jackal (Canis aureus), Indian fox (Canis lupus), sambar (Cervus unicolor), short nosed fruit bat (Cynopterus sphinx), jungle cat (Felis chaus), three striped palm squirrel (Funambulus palmarum), Indian bush rat (Goluda ellioti), common indian mongoose (Herpestes edwardsii), Indian porcupines (Hystrix Indica), striped hyena (Fyaena hyaena), blacknaped hare (Lepus nigricollis), bonnet macaque (Macaca radiate), Indian pangolin (Manis crassicaudata), sloth bear (Melursus ursinus), barking deer (Muntiacus muntjak), house mouse (Mus musculus), Indian field mouse (Mus booduga), common leopard (Panthera pardus), Indian flying bat (Pteropus giganteus), rat (rattus rattus), Indian wild boar (Sus scrofa), etc; AND WHEREAS, it is important to conserve and protect the sloth bear, leopard and other endangered faunal biodiversity and wildlife therein and its environment by establishing an Eco-sensitive Zone along the periphery of the Thimlapura Wildlife Sanctuary; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Thimlapura Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 1.00 kilometre to 2.20 kilometres around the boundary of Thimlapura Wildlife Sanctuary, in Tumakuru district in the State of Karnataka as the Thimlapura Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) the details of which are as under, namely: - 1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of 1.00 kilometre to 2.20 kilometres around the boundary of Thimlapura Wildlife Sanctuary and the area of the Eco- sensitive Zone is 61.80 square kilometres. (2) The boundary description of Thimlapura Wildlife Sanctuary and its Eco-sensitive Zone is appended in Annexure-I. (3) The maps of the Thimlapura Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB and Annexure-IIC. (4) List of geo-coordinates of the boundary of Thimlapura Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure III. (5) The list of villages falling in the proposed Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV. (6) Details of Reserved Forest and Thimlapura Conservation Reserve Areas within Eco-sensitive Zone are appended as Annexure-V 2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Eco- sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with the local people and adhering to the stipulations given in this notification for approval of the competent authority in the State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue; (v) Urban Development;24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayati Raj; and (xi) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, which are required for local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given in paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include any change of land use in any case except as provided under this sub-paragraph.[भाग II—खण ड 3(ii)] भारत का रािपत्र : असाधारण 25 (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by the State Government, whichever is more stringent. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016. (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016. (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. B. Regulated Activities 11. Construction activities. (a) No new commercial construction of any kind shall be permitted within 1 km from the boundary of the Thimlapura Wildlife Sanctuary or upto the extent of Eco- sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their residential and local commercial use including the activities listed in sub paragraph (1) of paragraph 3 as per building bye-28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] laws to meet the residential needs of the local residents such as: (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution termed as per classification done by the Central Pollution Control Board; (iv) cottage industries including village industries; convenience stores and local amenities supporting Eco-tourism including homestays; and (v) promotional activities listed in this notification. (b) Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (c) Beyond one kilometer it shall be regulated as per Zonal Master Plan. 13. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco- sensitive Zone shall be permitted by the competent authority. 14. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. 15. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- Sl. (vi) The Regional Officer, Karnataka State Pollution Control Board Member; One expert in ecology from reputed Institution or University of the State (vii) Member; of Karnataka to be' nominated by the Government of Karnataka. (viii) The Deputy Commissioner or his representative, Tumakuru District M e m b e r ; (ix) Member, State Biodiversity Board Member; (x) The Deputy Conservator of Forests, Tumakuru Division, Tumakuru Member-Secretary. 6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Monitoring Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure VI. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. Supreme Court, etc. Orders.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
