(ग) शतB 6 के िलए िनMिलिखत शतB (cid:24)ितTथािपत क(cid:30) जाएगी, अथाBत् :-¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 "6. अनुaF यान क(cid:30) लदाई िवशेष (cid:24)(cid:25)प या (cid:24)(cid:25)प XV मे अनुaF भंडारकरण प\रसरो म1 क(cid:30) जाएगी िजनम 1 टgक लारी या (cid:24)(cid:25)प XIV म1 अनुaF भंडारकरण क(cid:30) सुिवधा हो। यान य8द पे(cid:3)ोिलयम वग B ख के िलए (cid:24)(cid:25)प XIV म1 अनुaF सcवस Tटेशन से सलं h और िविनeद] तयै ार 8कए गए "े' म1 क(cid:30) जा सकती ह ैऔर इस "े' म1 सcवस Tटेशन म1 भूिमगत टgक से खीची गई कड़ी पाइप लाइन प\रदान पंप और ऐसे यान पर पाeकग Tथल होगा जो संरि"त कायi से पृथक करन े वाली दीवार क(cid:30) कुल ऊचाई 1.2 मीटर और 1.8 मीटर ऊँची को चने स े फेनिसग के साथ 60 सेमी ऊँची बाड़ के (cid:24)ंबंध के 7ारा सcवस Tटेशन के भीतर पृथक 8कए जाएगं े। पाeकग Tथल और भरण Tथान के चार< और कम से कम 4.5 मीटर खाली Tथान होगा। ऐसे भंडारकरण का आकार Gयूनतम 10मी×10मी होगा। पुनः ईधन भरने के पाeकग अनुaिF (cid:24)ािधकारी 7ारा अनुमोदन (cid:24)ाF सcवस Tटेशन म1 िविनeद] (cid:25)प से तैयार mोत के अनुaा (cid:24)दान क(cid:30) जाएगी। (घ) शतB 12 के िलए िनMिलिखत शतB (cid:24)ितTथािपत क(cid:30) जाएगी, अथातB ् :- ‘’12. यान क(cid:30) यथािTथित भारीत वाहन< के टgक या मशीनरी और Tथैितक उपTकर< म1 पुनः ईधन भरन े के दौरान 8कसी संरि"त कायB पूणB चQ से पे(cid:3)ोिलयम वगB ख हते ु Gयूनतम 6 मीटर क(cid:30) दरू ी और पे(cid:3)ोिलयम वग B क के िलए Gयूनतम 9 मीटर क(cid:30) दरू ी रखी जाएगी। परGतु वायुयान के टgक म1 पुनः ईधन भरने के मामले म1 8कसी संरि"त कायB से Gयूनतम 9 मीटर क(cid:30) दरू ी रखी जाएगी। 8कसी वायुयान के टgक भारी यान या मशीनरी और Tथैितक उपTकर म1 पुनः ईधन भरने भंडारकरण के नजदीक दशे ी भाषा और अंoेजी भाषा कोई भी धूpपान बोडB (cid:24)मुख (cid:25)प से वही लगाया जाएगा। कोई भी :ि; पुनः ईधन भरने वाल े के नजदीक म1 पे(cid:3)ोिलयम के Wवलन के कारण के धूpपान या मािचस, अिh, लाइट1, मोबाइल फोन, पदाथB या स"म पदाथB नहq लाएगा। बशतr 8क - (क) पे(cid:3)ोिलयम वगB ख के िलए तीन हजार लीटर तक क(cid:30) "मता वाले अनुaिF के पुनः ईधन भरने वाल े का ईधन भरने के दौरान 8कसी संरि"त कायB चक से Gयूनतम 4.5 मीटर क(cid:30) दरू ी पर रखेगा। दरू ी को बाड़े 7ारा रख-रखाव 8कया जाएगा ; (ख) भरने का िबGद ुतीन मीटर के समTतरीय िनकासी और 1.2 मीटर चारो और "ैितज िनकासी होगा। (ग) यान ईधन भरते समय चालन क(cid:30) िTथित स ेबाहर होगा। (घ) sविन क(cid:30) लंबाई और इले-(cid:3)ािनक (cid:25)प से लगातार होज 10 मीटर से अनिधक होगी"; (ङ) शतB 13 के खंड (ख) म1 “जैसा भी मामला हो” "श?द< के प^ात् " अuथग क(cid:30) सुिवधा सुिनि^त क(cid:30) जाएगी " श?द अंतःTथािपत 8कए जाएगं े । (च) शतB 14 के Tथान पर िनMिलिखत शतB रखी जाएगी, अथाBत् :- "14(क) पे(cid:3)ोिलयम क(cid:30) उतराई केवल पंप के माsयम से क(cid:30) जाएगी अथाBत ् यान पर आरोिपत मोटर चािलत युि; 7ारा;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) (cid:24)vयेक दखे भाल 8कसी wने या सीवर या पि?लक रोड म 1 पे(cid:3)ोिलयम के बचाव को रोकने के िलए क(cid:30) जाएगी ; (ग) पे(cid:3)ोिलयम 8कसी उपTकर म1 नहq भरा जाएगा जब उ; उपTकर (cid:24)चालन क(cid:30) िTथित मे हो ; (घ) (cid:24)vयेक "े' के िलए िविनeद] आपात योजना को आपात के मामले म1 8QयाGयवयन हते ु तैयार क(cid:30) जाएगी और ऐसे आपात योजन क(cid:30) (cid:24)ित िजला (cid:24)ािधकारी को सxप दी जाएगी। (ङ) िवTफोटक< के मुRय िनयं'क 7ारा यथा अनुमोदन (cid:24)ाF मानक (cid:24)चालन (cid:24)8Qया का इसके साथ अनुपालन 8कया जाएगा”। (छ) शतB 21 के Tथान पर िनMिलिखत शतB रखी जाएगी, अथाBत ् :- ‘’21. अनुaF यान म1 होने वाले 8कसी दघु Bटना, अिh या िवTफोटक िजसमे मानव जीवन क(cid:30) "ित :ि; या संपिK को गंभीर "ित Lई हो 8क \रपोटB तुरGत िनकटतम मिजT(cid:3)ेट या अिधका\रता रखने वाले िनकटतम पिु लस Tटेशन के भारसाधक अिधकारी को क(cid:30) जाएगी और मुRय िनयं'क को टेलीफ़ोन या फै-स या ईमेल 7ारा भी क(cid:30) जाएगी”। [फा. सं. पी-11021/01/2018-िवतरण] आशुतोष {जदल, संयु; सिचव (िवपणन) (cid:22)(cid:22)(cid:22)(cid:22)टटटट(cid:24)(cid:24)(cid:24)(cid:24)पपपपणणणण :::: मूल िनयम भारत के राजप', असाधारण, भाग, II खंड 3,उपखंड (i) अिधसूचना सं.सा.का.िन. 204 (अ) तारीख 13 माचB 2002 7ारा और सा.का.िन. 857 (अ)1 8दसंबर 2011 7ारा (cid:24)कािशत 8कए गए थे और अंितम संशोधन अिध. स.ं सा.का.िन. 762 (अ) तारीख 10 अगTत 2018 7ारा 8कया गया था। MINISTRY OF PETROLEUM AND NATURAL GAS NOTIFICATION New Delhi, the 29th May, 2019 G.S.R. 384(E).—WHEREAS a draft Petroleum (Amendment) Rules, 2018, were published as required by sub sections (2) and (3) of section 29 of the Petroleum Act 1934 (30 of 1934) under notification of the Government of India in the Ministry of Petroleum and Natural Gas, dated, the 5th October, 2018, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number GSR 997 (E), dated the 5th October, 2018, inviting objections or suggestions from all persons likely to be affected thereby before the expiry of forty five days from the date on which notification was made available to the public; AND WHEREAS, the said notification was made available to the public on the 5th October, 2018; AND WHEREAS, objections and suggestions received from the public on the draft rules have been duly considered by the Central Government;¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 5 NOW, therefore, in exercise of the powers conferred by sections 4,5,14,21,22 and sub- section (1) of section 29 of the Petroleum Act, 1934 (30 of 1934), the Central Government hereby makes the following rules further to amend the Petroleum Rules, 2002, namely :- 1. (1) These rules may be called the Petroleum (Amendment) Rules, 2019. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Petroleum Rules, 2002,- (1) in the Second Schedule, in Form VIII,- (a) in Part A- (i) for serial number 6, the following shall be substituted, namely:- “6. Name and full postal address of users or area of operation giving details of locality, taluka, district, state and of the place where the vehicle normally will be transporting petroleum Class A or Class B for the purpose of the site refuelling of aircraft’s, heavy vehicles or machineries, stationery equipment. Particulars of heavy vehicles which are proposed to be refueled by the vehicle”; (b) in Part II- (i) in serial number 4, after the words "site plan" the words “or typical layout" shall be inserted; (ii) in serial number 5, after the words "List" the word “or Type" shall be inserted; (iii) after serial number 6 , the following item shall be inserted, namely:- "7. Standard operating procedures for filling and decantation of refueller"; (2) in Form IX, after Notes, in the entries under the heading “Documents required to be submitted with this application for a Licence in Forms XIV, XV, XVI or special Forms”, after item number (vi) the following item shall be inserted, namely:- "(vii) In case the licensed premises is to be used for parking refueller, four sets of site layout plan showing the proposed area in the premises where the refueller is to be parked."; (3) in Form XIX,- (a) in serial number 1 under Description , after the words "licensed in" the words and figures "Form XIV or" shall be inserted; (b) in serial number 2 under Description, after the words "and the" the word "type of” shall be inserted; (c) for condition 6, the following condition shall be substituted, namely:- "6. The licensed vehicle shall be loaded at a storage premises licensed in special form or Form XV having tank lorry loading facilities or premises licensed in Form XIV. The Class B licensed petroleum vehicle may be loaded at a specially prepared area attached to a service station licensed in Form XIV6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] and the area shall have rigid pipeline drawn from the underground tank in service station, delivery pump and space for parking such vehicle shall be segregated from facilities within service station by providing 60 cm brick wall with chain link fencing of total height 1.2 m and 1.8 m high brick wall segregating the same from protected works. The space for parking and filling point shall observe at least 4.5 m clearance all round within the fencing. The size of such premises shall be minimum 10 m x 10 m. Parking of the Refueller(s) shall also be permitted at specially prepared area in service station approved by the licensing authority."; (d) for condition 12, the following condition shall be substituted, namely:- "12. Vehicle shall be kept at a minimum nine metres distance for Petroleum Class A and minimum six metres distance for Petroleum Class B from any protected works all-round during refuelling the tanks of heavy vehicles or machineries and stationery equipments as the case may be: Provided that in case of refuelling of tanks of aircraft, vehicle shall be kept at a minimum nine metres distance from any protected works. Unauthorized person shall not be permitted within the distance during refuelling. No smoking board in vernacular and English shall be displayed prominently near the premises of refuelling the tanks of aircraft, heavy vehicles or machinery and stationery equipments. No person shall smoke or carry matches, fire, lights, mobile phones, articles or substance capable of causing ignition of petroleum in the vicinity of refueling: Provided that - (a) refueller of licensed capacity up to three thousand litres for Petroleum Class B shall be kept at a distance of minimum of 4.5 metres distance from any protected works all-round during refuelling. The distance shall be maintained by barricading; (b) the fill point shall be at a horizontal clearance of three metres and vertical clearance of 1.2 metres all-around; (c) the vehicle shall be in drive out position while refueling; (d) the length of the sound and electrically continuous hose shall not exceed 10 metres"; (e) in clause (b) of condition 13, after the words "as the case may be" the words "The earthing arrangements shall be ensured" shall be inserted. (f) for condition 14, the following condition shall be substituted, namely:- “14 (a) Petroleum shall be unloaded only through the pump, namely, motoring devices mounted on the vehicle; (b) Every care shall be taken to prevent escape of petroleum into any drain or sewer or public road;¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 7 (c) Petroleum shall not be filled into equipments while the said equipment is in operating condition; (d) Specific emergency plan for each site shall be prepared for implementation in case of emergency and the copy of such emergency plan shall be submitted to the District Authority. (e) Standard Operating Procedure as approved by the Chief Controller of Explosives shall be complied with”. (g) for condition 21, the following condition shall be substituted, namely:- “21. Any accident, fire or explosion occurring in the licensed vehicle, which is attended with loss of human life or serious injury to person or property shall be immediately reported to the nearest Magistrate or to the officer in-charge of the nearest police station having jurisdiction and by telephone or fax or e-mail to the Chief Controller”.
