और, बनरे घट्टा राष्ट्रीय ईद्यान 12° 34’ और 12° 50’ ईत्तरी ऄक्षांि तथा 77° 31’ और 77° 38’ पूवी
देिांतर के बीच ऄवजस्ट्थत ह ैतथा 260.51 वगा दकलोमीटर के क्षेत्र में फैला हुअ ह;ै
और, बनेरघट्टा राष्ट्रीय ईद्यान, कनााटक राज्य के दजक्षण-पूवी कोण और दजक्षण म ें कावेरी वन्यजीव
ऄभयारण्य सीमा के साथ में जस्ट्थत ह;ै ऄभयारण्य तजमलनाडु के थाली, थाली एक्सटेंिन और ज्वालाजगरर ररज़वा वन
के साथ सीमांदकत ह ै आसके दजक्षण-पूवी सीमाओं के जनकटस्ट्थ वन्यजीवों के जलए लगभग 1400 वग ा दकलोमीटर

पैरा 1 में जवजनर्ददष्ट ह,ैं पयाावरण की दजृ ष्ट से पाररजस्ट्थजतकी संवेदी जोन के रूप में सुरजक्षत और संरजक्षत करना और
ईि पाररजस्ट्थजतकी संवेदी जोन में ईद्योगों या ईद्योगों के वगो के प्रचालन और प्रसंस्ट्करण करने को प्रजतजिद्ध करना
अवश्यक ह;ै
ऄतः, आसजलए, केन्रीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के साथ
परठत पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) की धारा 3 की ईपधारा (1) और ईपधारा (2) के[भाग II— खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3
खंड (v) और खंड (xiv) और ईपधारा (3) द्वारा प्रदत्त िजियों का प्रयोग करत े हुए, कनााटक राज्य बैंगलुरू और
रामानगरा जजला में बनरे घट्टा राष्ट्रीय ईद्यान की सीमा के चारों ओर 100 मीटर स े 1.0 दकलोमीटर तक जवस्ट् ताररत
क्षेत्र बनेरघट्टा राष्ट्रीय ईद्यान को पाररजस्ट्थजतकी संवेदी जोन (जजस े आसमें आसके पश् चात् पाररजस्ट्थजतकी संवेदी जोन
कहा गया ह)ै के रूप में ऄजधसूजचत करती ह,ै जजसके जववरण जनम्नानुसार ह,ै ऄथाात ् :-
1. पाररजस्ट्थजतकी संवदे ी जोन का जवस्ट्तार और ईसकी सीमाए-ं (1) पाररजस्ट्थजतकी सवं दे ी जोन का जवस्ट्तार बनेरघट्टा
राष्ट्रीय ईद्यान की सीमा के चारों ओर 100 मीटर स े 1.0 दकलोमीटर तक जवस्ट्तृत ह ै और पाररजस्ट्थजतकी संवेदी जोन
का क्षेत्रफल 168.84 वगा दकलोमीटर ह।ै
(2) पाररजस्ट्थजतकी संवेदी जोन और बनेरघट्टा राष्ट्रीय ईद्यान की सीमा का जववरण ईपाबधं I के रुप में ईपाबद्ध ह।ै
(3) सीमा जववरण और ऄक्षािं और देिांतर के साथ पाररजस्ट्थजतकी संवेदी जोन के बनेरघट्टा राष्ट्रीय ईद्यान के
मानजचत्र ईपाबधं -IIक, ईपाबधं -IIख, ईपाबधं -IIग, ईपाबधं -IIघ और ईपाबधं -IIङ के रूप म ेंईपाबद्ध ह।ै
(4) पाररजस्ट्थजतकी संवेदी जोन और बनेरघट्टा राष्ट्रीय ईद्यान की सीमा के भू-जनदेिांकों की सूची ईपाबधं III की
सारणी क और सारणी ख म ेंदी गइ ह।ै
(5) मुख्य बबदओंु के भू जनदेिाकं ों के साथ पाररजस्ट्थजतकी संवेदी जोन के ऄंतगात अने वाल ेग्ामों की सूची ईपाबधं -IV
के रूप म ें ईपाबद्ध ह।ै
2. पाररजस्ट्थजतकी संवदे ी जोन के जलए अचं जलक महायोजना– (1) राज्य सरकार, पाररजस्ट्थजतकी संवेदी जोन के
प्रयोजनों के जलए राजपत्र म ें आस ऄजधसूचना के प्रकािन की तारीख स े दो विा की ऄवजध के भीतर, स्ट्थानीय व्यजियों
के परामि ा स े और राज्य के सक्षम प्राजधकारी के ऄनुमोदन के जलए आस ऄजधसूचना म ें ददए गए ऄनुबंधों का पालन
करते हुए अंचजलक महायोजना तैयार करेगी।
(2) राज्य सरकार द्वारा पाररजस्ट्थजतकी संवेदी जोन के जलए अचंजलक महायोजना ऐसी रीजत से जो आस ऄजधसूचना म ें
जवजनर्ददष् ट दकए गए ह ैं के ऄनुसार तथा सुसंगत केंरीय और राज्य जवजधयों के ऄनुरुप और केंरीय सरकार द्वारा जारी
मागाजनदेिों, यदद कोइ हों, द्वारा तैयार होगी ।
(3) अंचजलक महायोजना, ईि योजना म ें पाररजस्ट्थजतकी और पयाावरणीय बातों को समाकजलत करन े के जलए राज्य
सरकार के जनम्नजलजखत जवभागों के परामिा से तैयार होगी, ऄथाात्:-
(i) पयाावरण;
(ii) वन और वन्यजीव;
(iii) कृजि;
(iv) राजस्ट् व;
(v) नगर जवकास;
(vi) पयाटन;
(vii) ग्ामीण जवकास;
(viii) बसचाइ और बाढ़ जनयंत्रण;
(ix) नगरपाजलका;
(x) पंचायती राज;
(xi) लोक जन मााण जव भाग
(xii) राजमागों; और
(xiii) कनााटक राज्य प्रदिू ण जनयंत्रण बोडा।
(4) अंचजलक महायोजना ऄनुमोददत जवद्यमान भू-ईपयोग, ऄवसंरचना और दक्रयाकलापों पर कोइ जनबंधन
ऄजधरोजपत नहीं करेगी जब तक दक आस ऄजधसूचना म ें आस प्रकार जवजनर्ददष् ट न हो और अचंजलक महायोजना सभी
ऄवसंरचना और दक्रयाकलापों म ें जो ऄजधक दक्षता और पाररजस्ट्थजतकी ऄनुकूल हों का संवधान करेगी ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(5) अंचजलक महायोजना म ें ऄनाच्छाददत क्षेत्रों के जीणोद्धार, जवद्यमान जल जनकायों के संरक्षण, अवाह क्षेत्रों के
प्रबंधन, जल-संभरों के प्रबंधन, जल संभर प्रबंधन, मृदा और नमी संरक्षण, स्ट्थानीय समुदायों की अवश्यकताओं तथा
पाररजस्ट्थजतकी और पयाावरण से संबंजधत ऐसे ऄन्य पहलओंु , जजन पर ध्यान देना अवश्यक ह,ै के जलए ईपबंध होंगे ।
(6) अंचजलक महायोजना जवद्यमान और प्रस्ट्ताजवत भूजम ईपयोग जविेिताओं के ब्यौरों स े ऄनुसमर्वथत मानजचत्र के
साथ सभी जवद्यमान पूजा स्ट् थलों, ग्ामों और नगरीय बजस्ट्तयों, वनों के प्रकार और दकस्ट् मों, कृजि क्षेत्रों, उपजाउ भूजम,
हररत क्षत्रे जैसे ईद्यान और ईसी प्रकार के स्ट् थान, ईद्यान कृजि क्षत्रे , फलोईद्यान, झीलों और ऄन्य जल जनकायों का
ऄभ्यकंन करेगी।
(7) अंचजलक महायोजना पाररजस्ट्थजतकी संवेदी जोन म ें जवकास को जवजनयजमत करेगी और सारणी में सूचीबद्ध पैरा
म ें प्रजतजिद्ध और जवजनयजमत दक्रयाकलापों का ऄनुपालन करेगी और स्ट्थ ानीय समुदायों की जीजवका को सुरजक्षत करन े
के जलए पाररजस्ट्थजतकी ऄनुकूल जवकास को सुजनजित और ईसकी ऄजभवृजद्ध भी करेगी।
(8) अंचजलक महायोजना प्रादेजिक जवकास योजना की सह-जवस्ट्तारी होगी ।
(9) आस प्रकार ऄनुमोददत अंचजलक महायोजना आस ऄजधसूचना के ईपबंधों के ऄनुसार मानीटरी के ऄपने कायों को
करने के जलए मानीटर सजमजत के जलए एक संदभा दस्ट्तावेज तैयार करेगी ।
3. राज्य सरकार द्वारा दकए जान े वाल े ईपाय.- राज्य सरकार आस ऄजधसूचना के ईपबंधों को प्रभावी करन े के जलए
जनम्नजलजखत ईपाय करेगी, ऄथाात्:-
(1) भू-ईपयोग.– (क) पाररजस्ट्थजतकी संवेदी जोन म ें वनों, ईद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंजन के प्रयोजनों के
जलए जचजन्हत दकए गए पाकों और खुल े स्ट्थानों का वाजणजज्यक या अवासीय या औद्योजगक संबद्ध जवकास
दक्रयाकलापों के जलए ईपयोग या संपररवतान नहीं होगा:
परंतु यह दक पाररजस्ट्थजतकी संवेदी जोन के भीतर भाग (क) म ें जवजनर्ददष्ट प्रयोजनों स े जभन्न प्रयोजन के जलए
कृजि और ऄन्य भूजम का संपररवतान मानीटरी सजमजत की जसफाररि पर और यथा लागू और क्षेत्रीय नगर योजना
ऄजधजनयम और केन्रीय सरकार या राज्य सरकार के ऄन्य जनयमों तथा जवजनयमों के ऄधीन सक्षम प्राजधकारी के पूव ा
ऄनुमोदन स,े और आस ऄजधसूचना के ईपबंधों द्वारा स्ट्थानीय जनवाजसयों की जनम्नजलजखत अवासीय अवश्यकताओं को
पूरा करन े के जलए ऄनुज्ञात दकया जाएगा, जैस:े -
(i) जवद्यमान सडकों को चौडा करना और ईन्ह ेंसुदढ़ृ करना तथा नइ सडकों का संजनमााण;
(ii) बुजनयादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;
(iii) प्रदिू ण ईत्पन्न न करने वाल े लघ ुईद्योग;
(iv) कुटीर ईद्योगों जजनके ऄतं गात ग्ामीण ईद्योग भी ह;ैं सुजवधाजनक भण्डार और स्ट्थानीय सुजवधाएं सहायक
पाररजस्ट्थजतकी पयाटन जजसके ऄन्तगता ग्ह वास सजम्मजलत ह;ै और
(v) पैरा 4 के ऄधीन ददए गए संवर्वधत दक्रयाकलाप:
परंत ु यह और दक प्रादेजिक नगर योजना ऄजधजनयम और राज्य सरकार के ऄन्य जनयमों और जवजनयमों के
ऄधीन सक्षम प्राजधकारी के पवू ा ऄनुमोदन और संजवधान के ऄनुच्छेद 244 के ईपबंधों या तत्समय प्रवृत्त जवजध के
ईपबंधों के ऄनुपालन के जबना, जजसके ऄन्तगात ऄनुसूजचत जनजाजत और ऄन्य परंपरागत वन जनवासी (वन
ऄजधकारों की मान्यता) ऄजधजनयम, 2006 (2007 का 2) भी ह,ै वाजणजज्यक या औद्योजगक जवकास दक्रयाकलापों के
जलए जनजातीय भूजम का ईपयोग ऄनुज्ञात नहीं होगा:
परंत ु यह और भी दक पाररजस्ट्थजतकी संवेदी जोन के भीतर भू-ऄजभलेखों म ें ईपसंजात कोइ गलती, मानीटरी सजमजत
के जवचार प्राप्त करने के पिात ्राज्य सरकार द्वारा प्रत्येक मामल े म ें एक बार ठीक होगी और ईि गलती के सुधार की
सूचना केंरीय सरकार के पयाावरण, वन और जलवाय ुपररवतान मंत्रालय को दी जाएगी:
परंत ु यह और भी दक गलती के संिोधन म ें आस ईप पैरा के ऄधीन यथा ईपबंजधत के जसवाय दकसी भी दिा म ें
भू-ईपयोग का पररवतान सजम्मजलत नहीं होगा;[भाग II— खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 5
(ख) वनीकरण तथा वास जीणोद्धार दक्रयाकलापों सजहत ऄनप्रयुक् त या ऄनुत् पादक कृजि क्षेत्रों में पुन: वनीकरण करने
के प्रयास दकए जाएंगे।
(2) प्राकृजतक जल स्रोतों.- अचजं लक महायोजना में सभी प्राकृजतक जल स्रोतों नददयों और जलमागों के अवाह क्षेत्रों
की पहचान की जाएगी और ईनके संरक्षण और नवीकरण के जलए योजना सजम् मजलत होगी और राज्य सरकार द्वारा
ऐसे क्षेत्रों पर या ईनके जनकट जवकास दक्रयाकलाप प्रजतजिद्ध करने के बारे म ें जो ऐस े क्षेत्रों के जलए ऄजहतकर हो ऐसी
रीजत से मागदा िाक जसद्धांत तैयार दकए जाएंग े ।
(3) पयटा न या पाररजस्ट्थजतकी पयटा न.- (क) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पाररजस्ट्थजतकी पयाटन
दक्रयाकलाप या जवद्यमान पयाटन दक्रयाकलापों का जवस्ट्तार पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन
के जलए होगा;
(ख) पयाटन महायोजना राज्य पयाटन जवभाग द्वारा राज्य पयाावरण और वन जवभाग के परामिा से तैयार होगी;
(ग) पयाटन महायोजना अंचजलक महायोजना के एक घटक के रूप म ें होगी;
(घ) पयाटन महायोजना पाररजस्ट्थजतकी संवेदी जोन की वहन क्षमता के अधार पर तैयार की जाएगी।
(ङ) पाररजस्ट्थजतकी पयाटन संबधं ी दक्रयाकलाप जनम्नानुसार जवजनयजमत होंग:े -
(i) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनम ें जो भी
जनकट ह,ै नये वाजणजज्यक होटल और सैरगाह के सजन्नमााण ऄनुज्ञात नहीं होंग:े
परंत,ु यह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर की दरू ी से परे पाररजस्ट्थजतकी संवेदी जोन के
जवस्ट्तार तक होटलों और ररजॉटा का स्ट्थापना केवल पूव ा पररभाजित और नामजनर्ददष्ट क्षेत्रों में पयाटन महायोजना के
ऄनुसार पाररजस्ट्थजतकी पयाटन सुजवधाओं के जलए ही ऄनुज्ञात होगा;
(ii) पाररजस्ट्थजतकी संवेदी जोन के भीतर नए पयाटन दक्रयाकलापों या जवद्यमान पयाटन दक्रयाकलापों का जवस्ट्तार
केंरीय सरकार के पयाावरण, वन और जलवाय ु पररवतना मंत्रालय के मागादिाक जसद्धांतों के द्वारा तथा राष्र ीय व् याघ्र
संरक्षण प्राजधकरण, द्वारा जारी पाररजस्ट्थजतकी–पयाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल देत े
हुए (समय-समय पर यथा संिोजधत) जारी मागादिाक जसद्धांतों के ऄनुसार होगा;
(iii) अंचजलक महायोजना का ऄनुमोदन दकए जाने तक, पयाटन के जलए जवकास और जवद्यमान पयाटन दक्रयाकलापों
के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्ददष्ट संवीक्षा और मानीटरी सजमजत की जसफाररि पर अधाररत संबंजधत
जवजनयामक प्राजधकरणों द्वारा ऄनुज्ञात दकया जाएगा और पाररजस्ट्थजतकी संवेदी जोन के भीतर दकसी नय े होटल या
ररसोट ा या वाजणजज्यक स्ट्थापना का संजनमााण ऄनज्ञु ात नहीं दकया जायेगा ।
(4) नसै र्वगक जवरासत.- पाररजस्ट्थजतकी संवेदी जोन म ें महत्वपूण ा नैसर्वगक जवरासत के सभी स्ट्थलों जैसे जीन कोि
अरजक्षत क्षत्रे , िैल जवरचनाएं, जल प्रपातों, झरनों, घाटी मागों, ईपवनों, गुफाए,ं स्ट्थलों, भ्रमण, ऄश्वरोहण, प्रपातों
अदद की पहचान की जाएगी और जवरासत संरक्षण योजना अंचजलक महायोजना के भाग के रूप में परररक्षण और
संरक्षण के जलए तैयार की जाएगी ।
(5) मानव जनर्वमत जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेदी जोन में भवनों, संरचनाओं, जिल्प-तथ्य, ऐजतहाजसक,
स्ट्थापत्य, सौंदयापूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और ईपक्षेत्रों की पहचान और ईनके संरक्षण के जलए जवरासत
योजना अंचजलक महायोजना के भाग के रुप म ेंतैयार की जाएगी।
(6) ध्व जन प्रदिू ण.- पयाावरण ऄजधजनयम के ऄधीन ध्वजन प्रदिू ण (जवजनयमन और जनयंत्रण) जनयम, 2000 म ें जनयत
ईपबंधों के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन में ध्वजन प्रदिू ण के जनयंत्रण और जनवारण का ऄनुपालन दकया
जाएगा।
(7) वाय ु प्रदिू ण.- पाररजस्ट्थजतकी संवेदी जोन म,ें वायु प्रदिू ण के जनवारण और जनयंत्रण का वायु (प्रदिू ण जनवारण
और जनयंत्रण) ऄजधजनयम, 1981 (1981 का 14) और ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार

(8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेदी जोन म ें ईपचाररत बजहस्राव का जनस्ट्सारण, साधारण मानकों के
ईपबंधों के ऄनुसार पयाावरणीय ऄजधजनयम और ईसके ऄधीन बनाए गए जनयमों के ऄधीन अन े वाले पयाावरणीय
प्रदिू ण के जनस्ट्सारण के जलए साधारण मानकों या राज्य सरकार द्वारा जनयत मानकों, जो भी ऄजधक कठोर हो, के
ईपबंधों के ऄनुसार होगा।
(9) ठोस ऄपजिष्ट.- ठोस ऄपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकया जाएगा:-
(क) पाररजस्ट्थजतकी संवेदी जोन म ें ठोस ऄपजिष्ट का जनपटान और प्रबधं न भारत सरकार के पयाावरण, वन और
जलवाय ु पररवतना मंत्रालय की ऄजधसूचना स.ं का.अ. 1357(ऄ), तारीख 8 ऄप्रलै , 2016 द्वारा प्रकाजित ठोस
ऄपजिष्ट प्रबंधन जनयम, 2016, के ईपबंधों के ऄनुसार दकया जाएगा। ऄकाबाजनक पदाथो का जनपटान पाररजस्ट्थजतकी
संवेदी जोन स े बाहर जचजन्हत दकए गए स्ट्थानों पर पयाावरण-ऄनुकूल रीजत स े दकया जाएगा;
(ख) पाररजस्ट्थजतकी संवेदी जोन म ें मान्य प्रौद्योजगदकयों (इएसएम) का ईपयोग करते हुए जवद्यमान जनयमों और
जवजनयमों के ऄनुरूप ठोस ऄपजिष्ट का सरु जक्षत और पयाावरण-ऄनुकूल प्रबंधन ऄनुज्ञात दकया जा सकेगा।
(10) जैव जचदकत्सा ऄपजिष्ट .- जैव जचदकत्सा ऄपजिष्ट का प्रबंधन जनम्नानुसार दकया जाएगा:-
(क) पाररजस्ट्थजतकी संवेदी जोन में जैव जचदकत्सा ऄपजिष्ट का जनपटान भारत सरकार के पयाावरण, वन और जलवाय ु
पररवतान मंत्रालय की ऄजधसूचना स.ं सा.का.जन 343 (ऄ), तारीख 28 माच,ा 2016, द्वारा प्रकाजित जैव जचदकत्सा
ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।
(ख) पाररजस्ट्थजतकी संवदी जोन म ें मान्य प्रौद्योजगदकयों का ईपयोग करत े हुए जवद्यमान जनयमों और जवजनयमों के
ऄनुरूप जैव-जचदकत्सा ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनकु ूल प्रबंधन ऄनुज्ञात दकया जा सकेगा।
(11) प्लाजस्ट्टक ऄपजिष्ट प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन में प्लाजस्ट्टक ऄपजिष्ट प्रबधं न का जनपटान भारत
सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासिं ोजधत ऄजधसूचना स.ं
सा.का.जन. 340(ऄ), तारीख 18 माचा, 2016, द्वारा प्रकाजित प्लाजस्ट्टक ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों
के ऄनुसार दकया जाएगा।
(12) जनमाणा और जवध्वसं ऄपजिष्ट प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन म ें संजनमााण और जवध्वंस ऄपजिष्ट प्रबंधन का
जनपटान भारत सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत
ऄजधसूचना सं.सां.का.जन 317(ऄ), तारीख 29 माचा, 2016, द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंधन जनयम,
2016 के ईपबंधों के ऄनुसार दकया जाएगा ।
(13) इ–ऄपजिष्ट.- पाररजस्ट्थजतकी संवेदी जोन में इ–ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन
और जलवायु पररवतान मंत्रालय द्वारा, समय-समय पर यथासंिोजधत, प्रकाजित इ–ऄपजिष्ट प्रबधं न जनयम, 2016, के
ईपबंधों के ऄनुसार दकया जाएगा।
(14) यानीय यातायात.- यातायात की यानीय गजतजवजधयां अवास के ऄनुकूल जवजनयजमत होंगी और आस संबंध म ें
अंचजलक महायोजना में जविेि ईपबंध सजम्मजलत दकए जाएंग े और अंचजलक महायोजना के तैयार होने और राज्य
सरकार के सक्षम प्राजधकारी द्वारा ऄनुमोददत होने तक, मानीटरी सजमजत सुसंगत ऄजधजनयमों और ईसके ऄधीन
बनाए गए जनयमों और जवजनयमों के ऄनुसार यानीय दक्रयाकलापों के ऄनुपालन को मानीटर करेगी ।
(15) यानीय प्रदिू ण.- लाग ू जवजधयों के ऄनुपालन म ें यानीय प्रदिू ण का जनवारण और जनयत्रं ण दकया जाएगा और
स्ट्वच्छक ईंधन के ईपयोग के जलए प्रयास दकए जाएंगे।
(16) औद्योजगक इकाआया.ं- (i) राजपत्र म ें आस ऄजधसूचना के प्रकािन पर या ईसके पिात पाररजस्ट्थजतकी संवेदी जोन
के भीतर दकसी नए प्रदिू ण करने वाल ेईद्योगों की स्ट्थापना ऄनुज्ञात नहीं की जाएंगी ।
(ii) केन्रीय प्रदिू ण जनयंत्रण बोडा द्वारा फरवरी, 2016 म ें जारी मागादिाक जसद्धान्तों म ें ईद्योगों के वगीकरण के
ऄनुसार, जब तक दक ऄजधसूचना म ें आस प्रकार जवजनर्ददष्ट न हो; पाररजस्ट्थजतकी संवेदी जोन के भीतर केवल गरै -
प्रदिू णकारी ईद्योगों को ऄनुज्ञात दकया जाएगा और आसके ऄजतररि, गैर प्रदिू णकारी ईद्योगों को बढ़ावा ददया
जाएगा।[भाग II— खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 7
(17) पहाडी ढलानों को सरं क्षण.- पहाडी ढलानों का संरक्षण जनम्नानुसार होगा:-
(क) अंचजलक महायोजना पहाडी ढलानों पर क्षेत्रों का संकेत होगा जहां दकसी भी संजनमााण की ऄनुमजत नहीं दी
जाएगी;
(ख) कटाव के एक ईच्च जडग्ी के साथ जवद्यमान खडी पहाडी ढलानों या ढलानों पर दकसी भी संजनमााण की ऄनुमजत
नहीं दी जाएगी ।
4. पाररजस्ट्थजतकी सवं दे ी जोन म ें प्रजतजिद्ध और जवजनयजमत दकए जान े वाल े दक्रयाकलापों की सचू ी.- पाररजस्ट्थजतकी
संवेदी जोन म ें सभी दक्रयाकलाप पयाावरण ऄजधजनयम के ईपबंधों और ईसके ऄधीन बनाए गए जनयमों जजसके
ऄन्तगात तटीय जवजनयमन जोन ऄजधसूचना 2011 और पयाावरणीय समाघात जनधारा ण ऄजधसूचना, 2006 और ऄन्य
लाग ू जवजधयों के जजसम ें वन (सरं क्षण) ऄजधजनयम, 1980 (1980 का 69), भारतीय वन ऄजधजनयम, 1927 (1927
का 16), वन्यजीव (संरक्षण) ऄजधजनयम, 1972 (1972 का 53) सजम्मजलत ह ैं और दकय े गय े संिोधनों द्वारा िाजसत
होंगे और नीच ेदी गइ सारणी म ेंजवजनर्ददष्ट रीजत म ें जवजनयजमत होंगे, ऄथाात ् :-

(जसजवल) सं. 1995 का 202 टी.एन. गौडाबमान जथरुमूलपाद बनाम
भारत संघ के मामले म ें अदिे तारीख 4 ऄगस्ट्त, 2006 और ररट
याजचका (सी) सं. 2012 का 435 गोवा फाईंडेिन बनाम भारत
संघ के मामले में तारीख 21 ऄप्रैल, 2014 के अदिे के ऄनुसरण म ें
प्रचाजलत होंगी ।
2. प्रदिू ण (जल, वायु, मृदा, ध्वजन अदद) पाररजस्ट्थजतकी संवेदी जोन में कोइ नया ईद्योग लगाने और वतामान
ईत्पन करने वाले ईद्योगों की स्ट्थापना । प्रदिू णकारी ईद्योगों का जवस्ट्तार करने की ऄनुज्ञा नहीं होगी:
परन्तु यह दक केन्रीय प्रदिू ण जनयत्रं ण बोडा द्वारा फरवरी, 2016 में
जारी माग ा दिाक जसद्धान्तों में ईद्योगों के वगीकरण के ऄनुसार जब
तक दक ऄजधसूचना में ऐसा जवजनर्ददष्ट न हों, पाररजस्ट्थजतकी संवेदी
जोन के भीतर गैर-प्रदिू णकारी ईद्योगों को ऄनुज्ञात दकया जाएगा
और आसके ऄजतररि गैर-प्रदिू णकारी कुटीर ईद्यागों को बढ़ावा
ददया जाएगा।
3. ब ृहत जल जवद्युत पररयोजना की लाग ू जवजधयों के ऄनुसार प्रजतजिद्ध (ऄन् यथा ईपबंजधत के जसवाय)
स्ट्थापना । होंग े।
4. दकसी पररसंकटमय पदाथों का ईपयोग लागू जवजधयों के ऄनुसार प्रजतजिद्ध (ऄन् यथा ईपबंजधत के जसवाय)
या ईत्पादन या प्रसंस्ट्करण। होंगे ।
5. प्राकृजतक जल जनकायों या क्षेत्र भूजम में लागू जवजधयों के ऄनुसार प्रजतजिद्ध (ऄन् यथा ईपबंजधत के जसवाय)
ऄनुपचाररत बजहस्रााव का जनस्ट्सारण । होंगे ।
6. नइ अरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेदी जोन के भीतर नइ और जवद्यमान अरा जमलों
का जवस्ट्त ार ऄनुज्ञात नहीं होगा ।
7. ईंट भट्टों की स्ट्थापना करना। लाग ू जवजधयों के ऄनुसार प्रजतजिद्ध (ऄन् यथा ईपबंजधत के जसवाय)

ख. जवजनयजमत दक्रयाकलाप
8. वाजणजज्यक होटलों और ररसोटों की पाररजस्ट्थजतकी पयाटन दक्रयाकलापों लघ ु ऄस्ट्थायी संरचनाओं के
स्ट्थापना । जसवाय संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या
पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट ह,ै
नए वाजणजज्यक होटल और ररसोटों को ऄनुज्ञात नहीं दकया जाएगा:
परंतु यह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के परे या
पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक आनमें से जो भी जनकट हो
सभी नए पयाटन दक्रयाकलाप या जवद्यमान दक्रयाकलाप का जवस्ट्तार
पयाटन महायोजना और यथा लागू मागादिी जसद्धांतों के ऄनुरुप
होगा।
9. संजनमाणा दक्रयाकलाप । (क) संरजक्षत क्षेत्र की सीमा स े एक दकलोमीटर के भीतर या
पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट हो,
दकसी भी प्रकार के नये वाजणजज्यक संजनमााण की ऄनुज्ञा नहीं होगी:
परंतु यह दक स्ट्थानीय लोगों को ऄपनी अवास सम्बन्धी
जनम्नजलजखत अवश्यकताओं को पूरा करने के जलए, पैरा 3 के ईप
पैरा (1) में सूचीबद्ध दक्रयाकलापों सजहत ऄपने प्रयोग के जलए,
ऄपनी भूजम में भवन ईप-जवजधयों के ऄनुसार, संजनमााण करने की
ऄनुज्ञा होगी, जैसे:-
परंतु यह दक गैर–प्रदिू णकारी लघु ईद्योगों से संबंजधत संजनमााण
दक्रयाकलाप लाग ू जनयमों और जवजनयमों, यदद कोइ हों, के ऄनुसार
सक्षम प्राजधकारी की पूवा ऄनुमजत से जवजनयजमत दकए जाएंगे और व े
न्यूनतम होंग े।
(ख) एक दकलोमीटर क्षेत्र से परे ये अंचजलक महायोजना के ऄनुसार
जवजनयजमत होंग े।
10. प्रदिू ण ईत्पन्न न करने वाले लघु फरवरी, 2016 में केन्रीय प्रदिू ण जनयंत्रण बोडा द्वारा जारी ईद्योगों
ईद्योग । में वगीकरण के ऄनुसार गैर-प्रदिू णकारी ईद्योग और ऄपररसंकटमय
में, लघु और सेवा ईद्योग, कृजि, पुष्प कृजि, ईद्यान कृजि या
पाररजस्ट्थजतकी संवेदी जोन से देिी सामग्ी से ईत्पादों को ईत्पन्न
करने वाले कृजि अधाररत ईद्योग सक्षम प्राजधकारी द्वारा ऄनुज्ञात
होंगे।
11. वृक्षों की कटाइ । (क) राज्य सरकार में सक्षम प्राजधकारी की पूव ा ऄनुमजत के जबना
वन, सरकारी या राजस्ट्व या जनजी भूजम पर या वनों म ें वृक्षों की
कटाइ नहीं होगी ।
(ख) वृक्षों की कटाइ संबंजधत केंरीय या राज्य ऄजधजनयम या ईसके
ऄधीन बनाए गए जनयमों के ईपबंध के ऄनुसार जवजनयजमत होग े।
12. फमों, कंपजनयों द्वारा बड े पैमाने पर स्ट्थानीय अवश्यकताओं को पूरा करने के जलए लाग ू जवजधयों के
वाजणजज्यक पिुओं और पोल्री फामों ऄधीन जवजनयजमत (ऄन्यथा प्रदान दकए गए) होंगे ।

15. जवद्यमान सडकों को चौडा करना और न्यूनीकरण ईपायों को लाग ू जवजधयों, जनयमों और जवजनयमनों और
ईन्हें सुदढृ करना तथा नवीन सडकों ईपलब्ध मागादिाक जसद्धांतों के ऄनुसार दकया जाना।

18. राजत्र में याजनक यातायात का संचलन । लाग ू जवजधयों के ऄधीन वाजणजज्यक प्रयोजन के जलए जवजनयजमत
होंग े।
19. स्ट्थानीय समुदायों द्वारा चल रही कृजि स्ट्थानीय लोगों के ईपयोग के जलए लागू जवजधयों के ऄधीन ऄनुज्ञात
और बागवानी प्रथाओं के साथ होंग े।

20. प्राकृजतक जल जनकायों या सतही क्षेत्र जल जनकायों म ेंईपचाररत ऄपजिष्ट जल या बजहस्रााव के जनस्ट्सारण
में ईपचाररत बजहस्रााव का जनस्ट्तारण । से बचा जाएगा और ईपचाररत ऄपजिष्ट जल के पुन:चक्रण और

5. पाररजस्ट्थजतकी संवदे ी जोन की ऄजधसचू ना की मानीटरी के जलए मानीटरी सजमजत- केंरीय सरकार, पयाावरण
(संरक्षण) ऄजधजनयम, 1986 की धारा 3 की ईपधारा (3) के ऄधीन आस ऄजधसूचना के ईपबंधों की प्रभावी मानीटरी
के जलए मानीटरी सजमजत का गठन करती ह,ै जो जनम्नजलजखत से जमलकर बनेगी ऄथाात:् -

(iv) कनााटक सरकार द्वारा नाजमत प्राकृजतक संरक्षण (जवरासत सरं क्षण सजहत) के क्षत्रे म ें सदस्ट्य;
काम करने वाल ेगैर-सरकारी संगठनों के प्रजतजनजध
(v) क्षेत्रीय ऄधीकारी, मैसूर, कनााटक प्रदिू ण जनयंत्रण बोडा सदस्ट्य;
(vi) कनााटक सरकार द्वारा नाजमत राज्य संस्ट्थान के प्रजतजित संस्ट्थान या जवश्वजवद्यालय के सदस्ट्य;
पाररजस्ट्थजतकी म ें एक जविेिज्ञ
(vii) राज्य सरकार द्वारा नाजमत जैव जवजवधता का एक जविेिज्ञ सदस्ट्य;
(viii) ईपायुक् त या ईसका प्रजतजनजध, बैंगलोर िहरी जजला सदस्ट्य;
(ix) ईपायुक् त या ईसका प्रजतजनजध, रामानगर जजला सदस्ट्य;
(x) ईप वन-संरक्षक, बनेरघट्टा राष्ट्रीय ईद्यान, बैंगलरूु सदस्ट्य-
सजचव।
6. जनदेि–जनबधं न:- (1) मानीटरी सजमजत आस ऄजधसूचना के ईपबंधों के ऄनुपालन को मानीटर करेगी।
(2) मानीटरी सजमजत का कायाकाल तीन वि ा तक या राज्य सरकार द्वारा नइ सजमजत के पनु : गठन तक के जलए होगा
और तत्पिात मानीटरी सजमजत राज्य सरकार द्वारा गरठत की जाएगी।
(3) ऐस े दक्रयाकलापों की, जो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक
का.अ. 1533 (ऄ), तारीख 14 जसतम्बर, 2006 की ऄनुसूची म ें सजम्मजलत ह,ैं और जो पाररजस्ट्थजतकी संवेदी जोन म ें
अते ह,ैं जसवाय आसके जो पैरा 4 के ऄधीन सारणी म ें यथा जवजनर्ददष्ट प्रजतजिद्ध दक्रयाकलापों के, मानीटरी सजमजत
द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर सवं ीक्षा की जाएगी और ईि ऄजधसूचना के ईपबंधों के
ऄधीन पूवा पयाावरण ऄनापजत्त के जलए केरींय सरकार के पयावा रण, वन और जलवाय ु पररवतान मंत्रालय को जनर्ददष्ट
दकया जाएगा।
(4) आस ऄजधसूचना के पैरा 4 के ऄधीन सारणी म ें यथा जवजनर्ददष्ट प्रजतजिद्ध दक्रयाकलापों के जसवाय, भारत सरकार के
तत्क ालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक का.अ. 1533(ऄ), तारीख 14 जसतंबर, 2006 की
ऄजधसूचना के ऄनुसूची के ऄधीन ऐसे ऄनुसूची में दक्रयाकलापों, जजन्हें सजम्मजलत नहीं दकया गया ह,ै परंत ु
पाररजस्ट्थजतकी संवेदी जोन म ेंअते ह,ैं ऐसे दक्रयाकलापों की वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं पर अधाररत जनगरानी
सजमजत द्वारा संवीक्षा की जाएगी और ईसे संबद्ध जवजनयामक प्राजधकरणों को जनर्ददष्ट दकया जाएगा ।
(5) मानीटरी सजमजत का सदस्ट्य-सजचव या संबद्ध ईपायुि ऐस े व्यजि के जवरूद्ध, जो आस ऄजधसूचना के दकसी ईपबंध
का ईल्लघं न करता ह,ै पयाावरण ऄजधजनयम, की धारा 19 के ऄधीन पररवाद फाआल करन े के जलए सक्षम होगा।
(6) मानीटरी सजमजत मुद्दा दर मुद्दा के अधार पर ऄपेक्षाओं पर जनभार रहते हुए संबद्ध जवभागों के प्रजतजनजधयों या
जविेिज्ञों, औद्योजगक संगमों या संबद्ध पणधाररयों के प्रजतजनजधयों को ऄपन े जवचार-जवमिा म ें सहायता के जलए
अमंजत्रत कर सकेगी ।
(7) मानीटरी सजमजत प्रत्येक विा की 31 माच ा तक के ऄपन े दक्रयाकलापों की वार्विक कारावाइ ररपोटा राज्य के मुख्य
वन् यजीव वाडान को ईपाबंध V के ऄनुसार प्रोफामाा ईक्त वि ाके 30 जून तक प्रस्ट्ततु करेगी ।[भाग II— खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 11
(8) केन्रीय सरकार का पयाावरण, वन और जलवाय ु पररवतान मंत्रालय मानीटरी सजमजत को ऄपन े कृत्यों के प्रभावी
जनवाहन के जलए समय-समय पर ऐसे जनदेि दे सकेगा, जो वह ठीक समझे ।
7. ऄजतररि ईपाय.- आस ऄजधसूचना के ईपबंधों को प्रभाव दने े के जलए केंरीय सरकार और राज्य सरकार ऄजतररक्त
ईपाय, यदद कोइ हों, जवजनर्ददष् ट कर सकेंगी।
8. ईच्चतम न्यायालय, अदद के अदेि.- आस ऄजधसूचना के ईपबंध, भारत के माननीय ईच्चतम न्यायालय या
ईच्च न्यायालय या राष्र ीय हररत ऄजधकरण द्वारा पाररत दकसी अदेि या पाररत होने वाले दकसी अदेि, यदद कोइ

1. बैठकों की संख् या और तारीख ।
2. बैठकों का कायावृत् त : (कृपया मुख्य ईल्ल ेखनीय बबदओंु का ईल्लेख करें । बैठक के कायावृत् त को एक
पृथक ईपाबंध में ईपाबद्ध करें) ।
3. अंचजलक महायोजना की तैयारी की प्राजस्ट् थजत जजसके ऄंतगात पयाटन महायोजना भी ह।ै
4. भू-ऄजभलेख में सदश्ृ य त्रुरटयों के सुधार के जलए ब् यौहार दकए गए मामलों का सारांि (पाररजस्ट्थजतकी

NOTIFICATION
New Delhi, the 11th March, 2020
S.O.1036(E).—WHEREAS, a draft re-notification was published in the Gazette of
India, Extraordinary, vide notification of the Government of India in the Ministry of
Environment, Forest and Climate Change number S.O. 5639(E), dated the 30th October,
2018, inviting objections and suggestions from all persons likely to be affected thereby within
the period of sixty days from the date on which copies of the Gazette containing the said
notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the said draft notification were
made available to the public on the 30th October 2018;
AND WHEREAS, objections and suggestions were received from persons and
stakeholders in response to the aforesaid draft notification and were duly considered by the
Central Government;
AND WHEREAS, Bannerghatta National Park lies between the 12°34‟ and 12°50‟ N
latitudes and between 77°31‟ and 77°38‟ E longitudes and spread over an area of 260.51
square kilometres;
AND WHEREAS, Bannerghatta National Park, is situated in south-eastern corner of
the state of Karnataka and borders with Cauvery Wildlife Sanctuary in the South; the
Sanctuary also bordered with Thali, Thali Extension and Javalagiri Reserved Forests of
Tamil Nadu on its south-eastern boundaries that form a contiguous Wildlife Habitat of nearly
1400 square kilometers with the pockets of intact prime habitat for elephants and other
wildlife species;
AND WHEREAS, Bannerghatta National Park as a terminal point on the northern
side of “Mysore Elephant Reserve” which inhabits large Asian elephants migrate from
adjacent Thali Reserve Forest of Tamil Nadu contiguous with Cauvery Wildlife Sanctuary

AND WHEREAS, Bannerghatta National Park has breeding population of elephants
and also supports leopard, wild dogs, gaur, sambar, chital, sloth bear, slender loris, oriental
white rumped vulture, long-billed vulture, yellow throated bulbul and other important wildlife
species;
AND WHEREAS, the areas of Bannerghatta National Park are covered by dry
deciduous and scrub forests with riverine and moist deciduous habitat in the valleys; the
main vegetative species in the areas of Bannerghatta National Park includes Anogeissus
latifolia, Acacia catechu, Acacia eucopholea, Tectona grandis, Santalum album, Shorea
talura, Azadirachta indica, Terminalia paniculata, Terminalia chebula, Terminalia tomentosa,
Dalbergia latifolia, Lagerstromia lanceolata, Ziziphus jujuba, Dendrocalamus strictus, etc.;
AND WHEREAS, rare, endangered and threatened species of flora found in
Bannerghatta National Park are Kaggali (Acacia catechu), Dindiga (Anogeissus latifolia),
Muthuga (Butea monosperma), Urugalu (Chloroxylon swietenia), Beete (Dalbergia latifolia),
Kamara (Hardiwikia binata, Honne (Pterocarpus marsupium), Shrigandha (Santalum album),
Sagade (Schleichera oleosa), Matti (Terminalia paniculata), Tare (Terminalia bellerica), Aale
(Wrightia tinctoria), Jalari (Shorea roxburghii), Maavu (Mangifera indica, Dhoopa (Boswellia
serrate), etc.
AND WHEREAS, rare, endangered and threatened species of mammals and reptiles
found in Bannerghatta National Park are tiger (Panthera tigris), leopard (Panthera pardus),
Indian wild dog or dhole (Cuonal pinus), golden jackal (Canis aureus), striped hyena
(Hyaena hyaena), sloth bear (Melursus ursinus), jungle cat (Felis chaus), rusty-spotted cat
(Prionailurus rubiginosus), honey badger (Mellivora capensis), Indian porcupine (Hystrix
indica), Indian pangolin (Manis crassicaudata), small Indian civet (Viverricula indica),
common palm civet (Paradoxurus hermaphroditus), ruddy managoose (Herpestes smithii),
grey mongoose (Herpestes edwardsii), Asian elephant (Elephas maximus), gaur
(Bosgaurus), sambar (Rusa unicolor), chital (Axis axis), four horned antelope (Tetracerus
quadricornis), blackbuck (Antilope cervicapra), Wild pig (Susscrofa), Indian muntjac
(Muntiacus muntjak), Indian spotted chevrotain (Moschiola indica), southern plains grey
langur (Semnopithecus dussumieri), Bonnet macaque (Macaca radiata), black naped hare
(Lepus nigricollis), Indian giant flying squirrel (Petaurista philippensis), madras tree shrew
(Anathana ellioti), marsh crocodile (Crocodylus palustris), Indian monitor lizard (Varanus
bengalensis), Indian fox (Vulpes bengalensis), brown mongoose (Herpestes fuscus), etc.;
AND WHEREAS, rare, endangered and threatened species of birds found in the
Bannerghatta National Park are oriental white-backed vulture (Gyps bengalensis), greater
spotted eagle (Clanga clanga), long-billed vulture (Gyps indicus),Nilgiri wood
pigeon (Columba elphinstonii), yellow-throated bulbul (Pycnonotus xantholaemus), white-
bellied blue-flycatcher (Cyornis pallipes), etc.;
AND WHEREAS, Bannerghatta National Park is an important watershed area for the
river Arkavathi, Suvarnamukhi, Muthyalamadavu hole, Rayathmala hole, Hebbalahalla and
Antharagange that joins the river Cauvery;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and
boundaries of which are specified in paragraph 1, around the protected area of the
Bannerghatta National Park as Eco-sensitive Zone from ecological, environmental and
biodiversity point of view and to prohibit industries or class of industries and their operations
and processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and
clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment
(Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the
Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules,
1986, the Central Government hereby notifies an area to an extent varying from 100 meters
to 1.0 kilometer around the boundary of Bannerghatta National Park, in Bengaluru and
Ramanagara districts in the State of Karnataka as the Bannerghatta National Park Eco-
sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of

1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be
to an extent of 100 meters to 1.0 kilometer around the boundary of the Bannerghatta
National Park and the area of the Eco-sensitive Zone is 168.84 square kilometres.
(2) The boundary description of Bannerghatta National Park and its Eco-sensitive Zone is
appended as Annexure-I.
(3) The maps of the Bannerghatta National Park demarcating Eco-sensitive Zone along
with boundary details and latitudes and longitudes are appended as Annexure-IIA,
Annexure-IIB, Annexure-IIC, Annexure-IID and Annexure-IIE.
(4) List of geo-coordinates of the boundary of Bannerghatta National Park and Eco-
sensitive Zone are given in Table A and Table B of Annexure-III.
(5) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates
at prominent points is appended as Annexure-IV.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the
purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two
years from the date of publication of this notification in the Official Gazette, in
consultation with local people and adhering to the stipulations given in this notification for
approval of the competent authority in the State.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State
Government in such manner as is specified in this notification and also in
consonance with the relevant Central and State laws and the guidelines issued by
the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following
Departments of the State Government, for integrating the ecological and
environmental considerations into the said plan, namely:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department;
(xii) Highways; and
(xiii) Karnataka State Pollution Control Board.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land
use, infrastructure and activities, unless so specified in this notification and the Zonal
Master Plan shall factor in improvement of all infrastructure and activities to be more
efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation
of existing water bodies, management of catchment areas, watershed management,
groundwater management, soil and moisture conservation, needs of local community
and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages
and urban settlements, types and kinds of forests, agricultural areas, fertile lands,[भाग II— खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 25
green area, such as, parks and like places, horticultural areas, orchards, lakes and
other water bodies with supporting maps giving details of existing and proposed land
use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere
to prohibited and regulated activities listed in the Table in paragraph 4 and also
ensure and promote eco-friendly development for security of local communities‟
livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the
Monitoring Committee for carrying out its functions of monitoring in accordance with
the provisions of this notification.
3. Measures to be taken by State Government.- The State Government shall take the
following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces
earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or
converted into areas for commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose
other than that specified in clause (a) above, within the Eco-sensitive Zone may be
permitted on the recommendation of the Monitoring Committee, and with the prior
approval of the competent authority under the Regional Town Planning Act and other
rules and regulations of the Central Government or State Government as applicable
and vide provisions of this notification, to meet the residential needs of the local
residents and for activities such as -
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local
amenities supporting eco-tourism including home stay; and
(v) promoted activities given in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and
industrial development activities without the prior approval of the competent authority
under the Regional Town Planning Act and other rules and regulations of the State
Government and without compliance of the provisions of article 244 of the
Constitution or the law for the time being in force, including the Scheduled Tribes and
Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of
2007):
Provided also that any error appearing in the land records within the Eco-
sensitive Zone shall be corrected by the State Government, after obtaining the views
of Monitoring Committee, once in each case and the correction of said error shall be
intimated to the Central Government in the Ministry of Environment, Forest and
Climate Change:
Provided also that the correction of error shall not include change of land use in
any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with
afforestation and habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified
and plans for their conservation and rejuvenation shall be incorporated in the Zonal
Master Plan and the guidelines shall be drawn up by the State Government in such a
manner as to prohibit development activities at or near these areas which are

(3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing
tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master
Plan for the Eco-sensitive Zone.
(b) The Tourism Master Plan shall be prepared by the State Department of Tourism
in consultation with the State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity
of the Eco-sensitive Zone;
(e) The activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one
kilometre from the boundary of the protected area or upto the extent of the
Eco-sensitive Zone, whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of
the protected area till the extent of the Eco-sensitive Zone, the establishment
of new hotels and resorts shall be allowed only in pre-defined and designated
areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the
Eco-sensitive Zone shall be in accordance with the guidelines issued by the
Central Government in the Ministry of Environment, Forest and Climate
Change and the eco-tourism guidelines issued by the National Tiger
Conservation Authority (as amended from time to time) with emphasis on
eco-tourism, eco-education and eco-development;
(iii) until the Zonal Master Plan is approved, development for tourism and
expansion of existing tourism activities shall be permitted by the concerned
regulatory authorities based on the actual site specific scrutiny and
recommendation of the Monitoring Committee and no new hotel, resort or
commercial establishment construction shall be permitted within the Eco-
sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone,
such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges,
groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage
conservation plan shall be drawn up for their preservation and conservation as a part
of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of
historical, architectural, aesthetic, and cultural significance shall be identified in the
Eco-sensitive Zone and heritage conservation plan for their conservation shall be
prepared as part of the Zonal Master Plan.
(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone
shall be carried out in accordance with the provisions of the Noise Pollution
(Regulation and Control) Rules, 2000 under the Environment Act.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall
be carried out in accordance with the provisions of the Air (Prevention and Control of
Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be
in accordance with the provisions of the General Standards for Discharge of
Environmental Pollutants covered under the Environment Act and the rules made
thereunder or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes.- Disposal and management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be
carried out in accordance with the Solid Waste Management Rules, 2016,[भाग II— खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 27
published by the Government of India in the Ministry of Environment, Forest and
Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016;
the inorganic material may be disposed in an environmental acceptable manner
at site identified outside the Eco-sensitive Zone;
(b) safe and Environmentally Sound Management (ESM) of solid wastes in
conformity with the existing rules and regulations using identified technologies
may be allowed within Eco-sensitive Zone.
(10) Bio-medical waste.– Bio-medical waste management shall be as under:-
(a) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in
accordance with the Bio-Medical Waste Management, Rules, 2016, published by
the Government of India in the Ministry of Environment, Forest and Climate
Change vide notification number G.S.R 343 (E), dated the 28th March, 2016;
(b) safe and Environmentally Sound Management of bio-medical wastes in
conformity with the existing rules and regulations using identified technologies
may be allowed within the Eco-sensitive Zone.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive
Zone shall be carried out as per the provisions of the Plastic Waste Management
Rules, 2016, published by the Government of India in the Ministry of Environment,
Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th
March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and
demolition waste management in the Eco-sensitive Zone shall be carried out as per
the provisions of the Construction and Demolition Waste Management Rules, 2016,
published by the Government of India in the Ministry of Environment, Forest and
Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016,
as amended from time to time.
(13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out
as per the provisions of the E-Waste Management Rules, 2016, published by the
Government of India in the Ministry of Environment, Forest and Climate Change, as
amended from time to time.
(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat
friendly manner and specific provisions in this regard shall be incorporated in the
Zonal Master Plan and till such time as the Zonal Master plan is prepared and
approved by the competent authority in the State Government, the Monitoring
Committee shall monitor compliance of vehicular movement under the relevant Acts
and the rules and regulations made thereunder.
(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be
incompliance with applicable laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units.– (i) On or after the publication of this notification in the Official
Gazette, no new polluting industries shall be permitted to be set up within the Eco-
sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per
the classification of Industries in the guidelines issued by the Central Pollution
Control Board in February, 2016, unless so specified in this notification, and in
addition, the non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction
shall be permitted;
(b) construction on existing steep hill slopes or slopes with a high degree of erosion

4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All
activities in the Eco sensitive Zone shall be governed by the provisions of the
Environment Act and the rules made there under including the Coastal Regulation Zone,
2011 and the Environmental Impact Assessment Notification, 2006 and other applicable
laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act,
1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments
made thereto and be regulated in the manner specified in the Table below, namely:-

6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the
provisions of this notification.
(2) The tenure of the Monitoring committee shall be for three years or till the re-
constitution of the new Monitoring Committee by the State Government and
subsequently the Monitoring Committee shall be constituted by the State
Government.
(3) The activities that are covered in the Schedule to the notification of the Government
of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E),
dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for
the prohibited activities as specified in the Table under paragraph 4 thereof, shall be
scrutinised by the Monitoring Committee based on the actual site-specific conditions
and referred to the Central Government in the Ministry of Environment, Forest and
Climate Change for prior environmental clearances under the provisions of the said
notification.
(4) The activities that are not covered in the Schedule to the notification of the
Government of India in the erstwhile Ministry of Environment and Forest number S.O.
1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone,
except for the prohibited activities as specified in the Table under paragraph 4
thereof, shall be scrutinised by the Monitoring Committee based on the actual site-
specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy
Commissioner(s) shall be competent to file complaints under section 19 of the
Environment Act, against any person who contravenes the provisions of this
notification.
(6) The Monitoring Committee may invite representatives or experts from concerned
Departments, representatives from industry associations or concerned stakeholders
to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities
as on the 31st March of every year by the 30th June of that year to the Chief Wildlife
Warden in the State as per proforma appended as Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change
may give such directions, as it deems fit, to the Monitoring Committee for effective

7. Additional measures.-The Central Government and State Government may specify
additional measures, if any, for giving effect to the provisions of this notification.
8. Supreme Court, etc. orders.-The provisions of this notification shall be subject to the
orders, if any passed or to be passed by the Hon‟ble Supreme Court of India or High Court
or National Green Tribunal.

NATIONAL PARK IN THE STATE KARNATAKA
North The boundary of Eco Sensitive Zone of Bannerghatta National Park starts at a
point with GPS location 12.844 N, 77.584 E located at distance of 100 m from
the northern most boundary of Bannerghatta National Park on Pillaganahalli
Village. The boundary then moves eastwards maintaining a parallel distance of
100 mtrs along the boundary of Bannerghatta National Park through
Pillganahalli, Gottigere, Basavanpura, Hommadevanahalli and Kalkere villages.
East Then it runs southwards maintaining a parallel distance of 1.0 Kilometre from the
extreme points along the Bannerghatta National Park boundary through
Vaderahalli, Gollahalli, Bannerghatta, Byrappanahalli, Mantapa, Begihalli,
Bukkasandra, Kallabalu, Mahalingapura, Ragihalli, Sivanahalli,
Kadujakkanahalli, Bagganadoddi, Thattekere, Indlavadi, Indlavadipura,
ChikkaHosahalli, Tammanayakanahalli villages till it reaches a point on the
interstate boundary of Karnataka and Tamilnadu with co-ordinates N 120 40`
41.19`` E 770 38` 32.24``. Then the line runs southwards along the interstate
boundary till it reaches a point on the Therubeedi village boundary and further
runs in southward direction along the interstate boundary till it reaches the
Gattigunda village. From this point the line runs southwards maintaining parallel
distance of 1.0 Kilometer from the extreme points along the Bannerghatta
National Park boundary through Gattigunda, Bijjahalli, Kolagondanahalli villages
till it reaches the interstate boundary and further runs along the interstate
boundary until it reaches the Gattigunda village.
South From the above point the boundary starts runs southwards, eastwards
maintaining a parallel distance of 1.0 Kilometer from the extreme points along
the Bannerghatta National Park boundary through Ganganahalli, Hunasanahalli,
Tattekere, Balagondanahalli and Bannimukodlu villages till it reaches a common
point on the Eco-sensitive Zone boundary of Cauvery Wildlife Sanctuary and
Bannerghatta National Park and further runs on the common Eco-sensitive Zone
for some distance along north-eastward direction till it reaches a point with co-
ordinates N 120 21` 41.19`` E 770 32` 22.54``on Guddeveranahosahalli village.
West From the above pointline runs northwards maintaining a parallel distance of 100
meters from the extreme points along the Bannerghatta National Park boundary
through Guddeveranahosahalli and Salbanni villages. Further, the line runs
maintaining a parallel distance of 1.0 Kilometer from the extreme points along
the Bannerghatta National Park boundary through Anekadaburu village and then
the line runs maintaining a parallel distance of 100 meters from the extreme
points along the Bannerghatta National Park boundary through Hosadurga,
Bommasandra, Bijahalli, Tippuru and Herandyappanahallivillages. Then the line
proceeds maintaining a parallel distance of 1.0 Kilometer from the extreme
points along the Bannerghatta National Park boundary through Kengalanatta
Gollahalli, Kebbre, Hanchaguli, and Kalasuru villages. Further, the line runs
maintaining a parallel distance of 100 meters from the extreme points along the[भाग II— खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 33
Bannerghatta National Park boundary through Doddaguli village. From this point
the line runs maintaining a parallel distance of 1.0 Kilometre from the extreme
points along the Bannerghatta National Park boundary through Arkere and
Dodkaballi villages. Then the line runs maintaining a parallel distance of 100
meters from the extreme points along the Bannerghatta National Park boundary
through Garalapura village. Then the line runs maintaining a parallel distance of
1.0 Kilometer from the extreme points along the Bannerghatta National Park
boundary throughKebbehalli, Narayanapura, Bekuppe, Kerelalusandra,
Chakanhalli, Mavathur, Bacholhallidoddi, Maniyambal, Devarahalli,
Linganapura, Bhimasandra, Doddamaralavadi, Elachavadi, Katharinatha,
Kallanakuppe, Kolalagundi, Tattekere, Bilaganaguppe, Goduru, Attiguppe,
GullahattiKaval, Jakkasandra, Gottigehalli, Vaddarapalya, Tatguppe, Taralu,
Gulakamale villages. Then the line runs maintaining a parallel distance of 100
meters from the extreme points along the Bannerghatta National Park boundary
through Buthanahalli and Bilwaradahalli villages and reaches the starting point.
