NOTIFICATION
New Delhi, the 4th November, 2019
S.O. 3985(E).—Whereas, as per Gazette Notification No. S.O. 641(E) dated 2nd March, 2015, the
Ministry has authorized the Chief Engineer (NH), State PWD. Government of Chhattisgarh (hereinafter
referred to as “Authority”) or his authorized legal representative to collect the fee from 03.03.2015 at Toll
Plaza at Km. 285/2 (near Kumhari village) for the four laned stretch from Km. 281.000 to Km. 307.600 of
NH-6 (New NH-53).
Now, in exercise of powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956),
read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, the
Central Government hereby makes following amendment to the notification of Ministry of Road Transport
and Highways, Government of India published vide S.O. No. 641(E) dated 2nd March, 2015 in the Gazette of
India, Extraordinary Part-II, Section 3, Sub-section (ii):—
Existing paragraph mentioned above the ‘Table 1’ of the said notification:—
“Now, therefore, in exercise of the power conferred by section 7 of the National Highways Act,
1956 (48 of 1956) read with rule 3 of the National Highways Fee (Determination of Rates and
Collection) Rules, 2008 published vide GSR 838(E) dated 05.012.2008 and its amendments till
date (hereinafter referred to as ‘said rules’), the Central Government hereby notifies that there shall
be levied and collected fee on the said section and authorizes Chief Engineer (NH), Government of
Chattisgarh (hereinafter referred to as “Authority”) or his authorized legal representative to collect
the fee from 0.03.2015 in accordance with sub-rule 6 (b) of rule 6 of the said rules according to
which the rate of fee shall be 40% of the rate of existing fee after the concession period is over, as
per the Schedule below and hereafter to be revised annually in accordance with the rule 5 of the
said rules.”
The above existing paragraph shall be substituted with the following paragraph:—
“Now, therefore, in exercise of the power conferred by section 7 of the National Highways Act,
1956 (48 of 1956) read with rule 3 of the National Highways Fee (Determination of Rates and
Collection) Rules, 2008 (hereinafter referred to as ‘rules’), the Central Government hereby notifies
that there shall be levied and collected fee on the said section and authorises the National
Highways Authority of India (NHAI) as Toll Collecting Agency or his authorized legal
representative to collect the fee in accordance with sub-rule 6 (b) of rule 6 of the said rules
according to which the rate of fee shall be 40% of the rate of existing fee after the concession
period is over, as per the Schedule below and hereafter to be revised annually in accordance with
the rule 5 of the said rules.”
