(क)(cid:32) उ(cid:6989) त अिधिनयम के उपबंध(cid:7298) और उसके अधीन बनाए गए िनयम(cid:7298) या (cid:7408)कसी अ(cid:7008) य िविध के अिभकिथत उ(cid:7016)ल ंघन क(cid:7409)
दशा म(cid:7286) जांच करेगा य(cid:7408)द आव(cid:7019) यक (cid:7079)तीत हो तो ऐसे (cid:7408)कसी िविन(cid:7416)द(cid:7020) ट मामल(cid:7298) म(cid:7286) उ(cid:6989) त अिधिनयम क(cid:7409) धारा 5 के
अधीन ऐसे िनदशे जारी करेगा जो (cid:7408)क न तो रा(cid:7020) (cid:7069)ीय तटीय जोन (cid:7079)बंध (cid:7079)ािधकरण (cid:7367)ारा या न ही क(cid:7286)(cid:7076)ीय सरकार (cid:7367)ारा
जारी िनदशे (cid:7298) से असंगत ह(cid:7298) ;
(ख) उ(cid:6989) त अिधिनयम के उपबंध(cid:7298) और उसके अधीन बनाए गए िनयम(cid:7298) या (cid:7408)कसी अ(cid:7008)य िविध के उ(cid:7016) लंघन(cid:7298) म(cid:7286) अंत(cid:7061)(cid:6981)(cid:7021)त
मामल(cid:7298) का पुन(cid:7414)वलोकन करेगा य(cid:7408)द आव(cid:7019) यक (cid:7079)तीत ह(cid:7298) तो रा(cid:7020) (cid:7069)ीय तटीय जोन (cid:7079)ािधकरण (cid:7367)ारा पुन(cid:7414)वलोकन करने के
िलए अपनी (cid:7407)ट(cid:7009) पिणय(cid:7298) के साथ ऐसे मामल(cid:7298) को िन(cid:7416)द(cid:7020) ट करेगा:
परंतु (cid:7079)ािधकरण उ(cid:7016) लंघन(cid:7298) के मामल(cid:7298) क(cid:7409) जांच या पुन(cid:7414)वलोकन (cid:7021)व (cid:7079)ेरणा से या (cid:7408)कसी (cid:7018) यि(cid:7020) ट या (cid:7079)ितिनिध िनकाय या
संगठन (cid:7367)ारा क(cid:7409) िशकायत के आधार पर करेगा;
4. (cid:7079)ािधकरण, िजला तटीय जोन िनगरानी सिमित के कृ(cid:7004) य(cid:7298) को िविनयिमत (cid:7272)प से पुन(cid:7414)वलोकन करेगा ।
5. (cid:7079)ािधकरण क(cid:7409) बैठक म(cid:7286) गणपू(cid:7414)त, इसके सद(cid:7021) य(cid:7298) और एक सद(cid:7021) य से िभ(cid:7008) न पदने सद(cid:7021) य कुल सं(cid:6990) या क(cid:7409) एक ितहाई होगी, क(cid:7286)(cid:7076)ीय
सरकार (cid:7367)ारा िविनि(cid:7019) चत संिनयम(cid:7298) के अनुसार भ(cid:7004) ते संद(cid:7004) त (cid:7408)कए जाएंगे ।
6. (cid:7079)ािधकरण, जब कभी इसक(cid:7409) बैठक के दौरान ऐसे सद(cid:7021) य(cid:7298) के (cid:7272)प म(cid:7286) आमंि(cid:7074)त करने अ(cid:7008) य िवशेष(cid:6980)(cid:7298) को अपेि(cid:6979)त कर सके और
या(cid:7074)ा भ(cid:7004) ता, मंहगाई भ(cid:7004) ता, आसीन फ(cid:7409)स (cid:6979)े(cid:7074) दौरा और िवशेष(cid:6980) सद(cid:7021) य(cid:7298) के अ(cid:7008) य भ(cid:7004) ते कर सकेगा जो क(cid:7286)(cid:7076)ीय सरकार (cid:7367)ारा अवधा(cid:7407)रत

8. (cid:7079)ािधकरण, तटीय िविनयमन जोन से संबंिधत पया(cid:6981)वरणीय मुदद(cid:7298) के साथ बता(cid:6981)व करेगा िजसे रा(cid:6996) य सरकार, रा(cid:7020) (cid:7069)ीय तटीय जोन
(cid:7079)बंधन (cid:7079)ािधकरण या क(cid:7286)(cid:7076)ीय सरकार (cid:7367)ारा िन(cid:7416)द(cid:7020) ट (cid:7408)कया जा सके ।

पर काय(cid:6981)सूची,काय(cid:6981)वृ(cid:7004) त (cid:7408)कए गए िविन(cid:7019) चय, अ(cid:7012) यावेदन प(cid:7074) उ(cid:7016) लंघन और ऐसे उ(cid:7016) लंघन(cid:7298) पर क(cid:7409) गई कार(cid:6981)वाई (cid:7008) यायालय मामले, िजसके
अंतग(cid:6981)त (cid:7008) यायालय के आदशे भी ह (cid:7289)और रा(cid:6996) य सरकार के अनुमो(cid:7408)दत तटीय जोन (cid:7079)बंध योजना को डालेगा ;
11. (cid:7079)ािधकरण तटीय जनसं(cid:6990) या संर(cid:6979)ण या अ(cid:7008) य प(cid:7407)रयोजनाएं क(cid:7409) उ(cid:7008)न ित से संबंिधत संर(cid:6979)ण प(cid:7407)रयोजनाएं या प(cid:7407)रयोजना(cid:7312) के
(cid:7408)(cid:7059)या(cid:7008) वयन के िलए सम(cid:7008) वयक होगा ।

15. रा(cid:7020) (cid:7069)ीय तटीय जोन (cid:7079)ािधकरण और पया(cid:6981)वरण, वन और जलवायु प(cid:7407)रवत(cid:6981)न मं(cid:7074)ालय के िलए भारत के राजप(cid:7074), असाधारण,
भाग-II, खंड-3, उपखंड (ii) म(cid:7286) (cid:7079)कािशत सं(cid:6990) या का.आ. 19(अ) तारीख 6 जनवरी, 2011 पया(cid:6981)वरण और वन मं(cid:7074)ालय म(cid:7286) भारत सरकार क(cid:7409)

िशकायत(cid:7286) फाइल करेगा ।
17. रा(cid:7020) (cid:7069)ीय तटीय जोन (cid:7079)ािधकरण अपने (cid:7408)(cid:7059)याकलाप(cid:7298) क(cid:7409) (cid:7407)रपोट(cid:6981) छह मास म(cid:7286) कम से कम एक बार (cid:7079)ािधकरण को (cid:7079)(cid:7021) तुत करेगा ।
18. (cid:7079)ािधकरण क(cid:7409) पूव(cid:6981)गामी शि(cid:6989) तयां और कृ(cid:7004) य क(cid:7286)(cid:7076)ीय सरकार के अधी(cid:6979)ण और िनयं(cid:7074)ण के अधीन ह(cid:7298)गे ।
19. (cid:7079)ािधकरण का (cid:6979)े(cid:7074) और अिधका(cid:7407)रता के भीतर न आने वाले (cid:7408)कसी िविन(cid:7416)द(cid:7020) ट (cid:7272)प से मामले संब(cid:7373) कानूनी (cid:7079)ािधका(cid:7407)रय(cid:7298) (cid:7367)ारा
बरता जाएगा ।

New Delhi, the 8th June, 2016
S.O. 2060(E).—Whereas, by a notification of the Government of India in the Ministry of Environment, Forests
and Climate Change, published in the Gazette of India, Extraordinary, Part – II, Section 3, Sub-section (ii), vide number
S.O. 935(E), dated the 31st March, 2015, the Central Government constituted the Kerala Coastal Zone Management
Authority for a period of one year and the term of the said Authority expired on 30th March, 2016;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
And, whereas, the Central Government is of the view that the such Authority must be reconstituted;
Now, therefore, in exercise of the powers conferred by sub-sections (1) and (3) of section 3 of the Environment
(Protection) Act, 1986 (29 of 1986) (hereinafter referred to as the said Act), and in supersession of the notification of the
Government of India in the Ministry of Environment, Forest and Climate Change, published in the Gazette of India,
Extraordinary, Part –II, Section 3, Sub-section (ii), vide number S.O. 935(E), dated the 31st March 2015, except as
respects things done or omitted to be done before such supersession, the Central Government hereby constitutes the
Kerala Coastal Zone Management Authority (hereinafter referred to as the Authority) consisting of the following
persons, for a period of three years, with effect from the date of publication of this notification in the Official Gazette,
namely:-
1.(cid:32) The Principal Secretary, Environment Department, Government of Kerala Chairman ;
2.(cid:32) The Principal Secretary, Local Self Government Department, Government of Kerala Member ;
or his nominee
3.(cid:32) The Secretary, Fisheries Department, Government of Kerala or his nominee Member ;
4.(cid:32) The Principal Secretary, Industries Department, Government of Kerala or his Member ;
nominee
5.(cid:32) The Secretary, Revenue Department, Government of Kerala or his nominee Member ;
6.(cid:32) The Secretary, Urban Affairs Department, Government of Kerala or his nominee, Member ;

1.(cid:32) The Authority shall have the power to process all the matters, proposals received, referred to or placed before it
for coastal regulation zone clearance in accordance with the procedure laid down in the notification of the
Government of India in the Ministry of Environment Forest and Climate Change, published in the Gazette of
India, Extraordinary, Part II, Section 3, Sub-section (ii) vide number S.O. 19 (E), dated the 6th January, 2011,
and clarifications and guidelines issued by the Ministry of Environment and Forests.
2.(cid:32) The Authority shall, for the purposes of protecting and improving the quality of the coastal environment and
preventing, abating and controlling environmental pollution in the coastal regulation zone areas in the State of
Kerala, take the following measures, namely:-
(i)(cid:32) receive application for approval of project proposal and examine the same if it is in accordance with the
approved Coastal Zone Management Plan and complies with the requirement of the Coastal Regulation
Zone notification issued by the Government of India in the Ministry of Environment, Forest and
Climate Change vide number S.O. 19(E), dated the 6th January, 2011 (herein after referred to as the
said notification), and make recommendations for approval of such project to the concerned authority
as specified in the said notification, within a period of sixty days from date of receipt of such
application;
(ii)(cid:32) regulate all developmental activities in the Coastal Regulation Zone as specified in the said
notification;
(iii)(cid:32) enforce and monitor the provisions of said notification;¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(iv)(cid:32) examine the proposals received from the State Government for change or modification in the
classification of Coastal Regulation Zone and in the Coastal Zone Management Plan and make specific
recommendation thereon, to the National Coastal Zone Management Authority thereafter.
3.(cid:32) The Authority shall have power to
(a)(cid:32) inquire into cases of alleged violation of the provisions of the said Act and the rules made
thereunder or any other law which is relatable to the objects of the said Act and, if found
necessary, in any specific case, issue such direction under section 5 of the said Act as are not
inconsistent with the directions issued in that specific case either by the National Coastal Zone
Management Authority or by the Central Government;
(b) hold review of cases involving violations of the provisions of the said Act and the rules made
thereunder, or under any other law which is relatable to the objects of the said Act, and if found
necessary, refer such cases, along with its comments for review by the National Coastal Zone
Management Authority:
Provided that such review of cases of violation may be taken up by the Authority suo-motu, or on
the basis of a complaint made by any individual or representative body or organisation;
4.(cid:32) The Authority shall regularly review the functioning of the District Coastal Zone Monitoring Committees.
5.(cid:32) The quorum of the meeting of the authority shall be one-third of the total number of its Members and a Member,
other than an ex-officio Member, shall be paid allowances as per the norms decided by the Central Government.
6.(cid:32) The Authority, whenever required may invite other experts as members during its meeting and the pay and
allowances such as traveling allowance, dearness allowance, sitting fees, field visit fees and other allowances of
the expert-members shall be as determined by the Central Government.
7.(cid:32) The powers of issuing directions under section 5 of the Environment (Protection) Act, 1986, read with the
notification of the Government of India in the Ministry of Environment, Forest and Climate Change published
in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) vide number S.O. 19 (E), dated the
06th January, 2011 are delegated to the Authority and the Chairman of the Authority, and in case the directions
are issued by the Chairman, such directions shall be placed before the Authority in its next meeting along with a
report specifying the reasons for issuing of the directions and status thereof.
8.(cid:32) The Authority shall deal with environmental issues relating to Coastal Regulation Zone which may be referred
to it by the State Government, the National Coastal Zone Management Authority or the Central Government.
9.(cid:32) The Authority shall have the power to direct all concerned planning authorities, field agencies, district collector
to ensure the compliance of provisions of the notification of the Government of India in the Ministry of
Environment, Forest and Climate Change, published in the Gazette of India, Extraordinary, Part II, Section 3,
Sub-section (ii), vide number S.O. 19(E), dated the 6th January, 2011 and take suitable action in case of
violations or non-compliance
10.(cid:32) The Authority shall, for the purposes of maintaining transparency in its working create a dedicated website and
post the agenda, minutes, decisions taken, recommendation letters, acts of violations and actions taken on such
violations, court matters including the orders of the courts and the approved Coastal Zone Management Plan of
the State Government.
11.(cid:32) The Authority shall co-ordinate for implementing conservation projects or projects related to upliftment of
coastal population protection or other projects.
12.(cid:32) The State Government shall ensure that sufficient resources, manpower, funds are available to the Authority to
discharge its functions effectively as specified in this order and the said Act.
13.(cid:32) The Authority shall have its Bank Account in the National Bank to deposit the funds received from the State
Government, etc.
14.(cid:32) The Authority shall take all necessary measures and initiatives including programme execution, research,
information dissemination, training, awareness day to day functioning, and advocacy and such other measures
and adopt suitable procedures and means including raising resources, funding, and other procedures and means
for the same.
15.(cid:32) The Authority shall submit Coastal Regulation Zone maps of the coastal areas in the State as per the procedure
laid down in the notification of the Government of India in the Ministry of Environment, Forests number S.O.
19 (E), dated the 6th January, 2011, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-
section (ii) to the National Coastal Zone Management Authority and the Ministry of Environment, Forest and

16.(cid:32) The Authority shall have the power to file complaints, under section 19 of the said Act, against any person for
non-compliance of directions issued by it;
17.(cid:32) The Authority shall furnish report of its activities at least once in six months to the National Coastal Zone
Management Authority.
18.(cid:32) The foregoing powers and functions of the Authority shall be subject to the supervision and control of the
Central Government.
19.(cid:32) Any matter specifically not falling within the scope and jurisdiction of the Authority shall be dealt with by the
statutory authorities concerned.
20.(cid:32) The Authority shall have its headquarters at Thiruvananthapuram.
