की उपधारा (1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की
अजधसूचना संख्या का. आ. 3385 (अ) तारीख 28 जसतम्बर 2020, िो भारत के असधारण रािपत्र तारीख
29 जसतम्बर 2020, में प्रकाजित की गई थी, द्वारा उस अजधसूचना से संलग्न अनुसूची में जवजनर्िष्टज भूजम म ें
हहिं स्ट्ु तान पेरोजलयम कोपोरेिन जलजमटेड द्वारा बाडमेर (रािस्ट्थान) से पालनपुर (गुिरात) तक बाडमेर-
पालनपुर पाईपलाइन के माध्यम से तैयार पेरोजलयम पिाथज के पररवहन के जलए गुिरात राज्य में पाईपलाइन
जबछाने के प्रयोिन के जलए उपयोग के अजधकार का अिनज करने के अपने आिय की घोषणा की थी ;
और उक्त असधारण रािपत्र अजधसूचना की प्रजतयां िनता को तारीख 18 अक्टूम्बर 2020 तक उपलब्ध
करा िी गई थी;
और सक्षम प्राजधकारी ने, उक्तअजधजनयम की धारा 6 की उप-धारा (1) के अधीन केंद्रीय सरकार को
ररपोटज ि े िी ह,ै

दकया ह,ै
अत: अब, केंद्रीय सरकार, उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित िजक्तयों का प्रयोग
करते हुए यह घोषणा करती ह ै दक इस अजधसचू ना से संलग्न अनुसूची में जवजनर्िष्टज भूजम में पाईपलाइन जबछाने के
जलए उपयोग के अजधकार अिजन दकया िाए,
और केंद्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित्त िजक्तयों का प्रयोग करत े
हुए यह जनििे िते ी ह ै दक उक्त भूजम में उपयोग का अजधकार इस घोषणा के प्रकािन की तारीख स े केंद्रीय सरकार
में जनजहत होन े के बिाए, सभी जवल्लंगमों स े मुक्त होकर जहन्िस्ट्ु तान पेरोजलयम कोपोरेिन जलजमटेड में जनजहत
होगा।
पेरोजलयम और खजनि पाईपलाइन अजधजनयम, 1962 की धारा 10 के अध्याधीन दकसी भी क्षजतपूर्तज के
जलए जहन्िस्ट्ु तान पेरोजलयम कोपोरेिन जलजमटेड पूणजतया उतरियी होगी और पाइपलाइन से सम्बजधत दकसी भी
मामले पर केंद्रीय सरकार के जवरुध्ि कोई वाि या कानूनी कायजवाही नहीं हो सकेगी।

NOTIFICATION
New Delhi, the 5th January, 2021
S.O. 68(E).—Whereas by a notification of the Government of India in the Ministry of Petroleum & Natural
Gas S. O. No. 3385 (E) Dated 28th September 2020, issued under sub-section (1) of section 3 of the Petroleum and
Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said
Act), published in the Extra Ordinary Gazette of India dated the 29 September 2020, the Central Government
declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for
the purpose of laying pipeline for transportation of finished petroleum product in the state of Gujarat through Barmer-
Palanpur Pipeline from Barmer (Rajasthan) to Palanpur (Gujarat) by the Hindustan Petroleum Corporation Limited.
And whereas copies of the said Extra Ordinary Gazette notification were made available to the public by
18th October 2020.
And whereas the Competent Authority has, under sub-section (1) of section 6 of the said Act, submitted
report to the Central Government;
And whereas the Central Government, after considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the
Central Government hereby declares that the right of user in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the
Central Government, vest on the date of publication of the declaration, in Hindustan Petroleum Corporation Limited
free from all encumbrances.
Hindustan Petroleum Corporation Limited shall be exclusively liable for any compensation in terms of
Section 10 of the P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government
on any matter relating to the pipeline.

NOTIFICATION
New Delhi, the 5th January, 2021
S.O. 69(E).—Whereas by a notification of the Government of India in the Ministry of Petroleum& Natural
Gas S. O. No. 3386 (E) Dated 28thSeptember 2020, issued under sub-section (1) of section 3 of the Petroleum and
Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said
Act), published in the Extra Ordinary Gazette of India dated the 29 September 2020, the Central Government
declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
the purpose of laying pipeline for transportation offinished petroleum product through Barmer - Palanpur Pipeline
from Barmer (Rajasthan) to Palanpur (Gujarat) by the Hindustan Petroleum Corporation Limited.
And whereas copies of the said Extra Ordinary Gazette notification were made available to the public
by15thOctober 2020.
And whereas the Competent Authority has, under sub-section (1) of section 6 of the said Act, submitted
report to the Central Government;
And whereas the Central Government, after considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the
Central Government hereby declares that the right of user in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the
Central Government, vest on the date of publication of the declaration, in Hindustan Petroleum Corporation Limited
free from all encumbrances.
Hindustan Petroleum Corporation Limited shall be exclusively liable for any compensation in terms of
Section 10 of the P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government
on any matter relating to the pipeline.
