ईपधारा (1) के ऄधीन जारी की गइ भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की ऄजधसूचना संख्या का.
अ. 2708(ऄ) तारीख 11 ऄगस्ट्त, 2020, जो भारत के ऄसाधारण राजपत्र तारीख 11 ऄगस्ट्त, 2020, मे प्रकाजित की गइ
थी, द्वारा ईस ऄजधसूचना स े सलग्न ऄनुसूची म ें जिजनदरष्ट भूजम में कनाजटक राज्य में पेरोजलयम पदाथज पररिहन के जलए
जहन्द्दस्ट्ू तान पेरोजलयम कोपोरेिन जलजमटेड द्वारा हासन (कनाजटक) से चेरलापल्ली (तले गं ाना) पाआपलाआन जबछाने के
प्रयोजन के जलए ईपयोग के ऄजधकारी का ऄजनज के ऄपन ेअिय की घोषणा की थी ;
और ईक्त ऄसाधारण राजपत्र ऄजधसूचना की प्रजतयां जनता को तारीख 11.08.2020 तक ईपलब्ध करा दी गइ थी;
और सक्षम प्राजधकारी न,े ईक्त ऄजधजनयम की धारा 6 की ईपधारा (1) के ऄधीन केन्द्रीय सरकार को ररपोटज द े दी ह;ै
और केन्द्रीय सरकार न,े ईक्त ररपोटज पर जिचार करने के पश्चात, और यह समाधान हो जाने पर दक ईक्त भूजम
पाआपलाआन जबछाने के जलए ऄपेजक्षत ह,ै ईसमें ईपयोग के ऄजधकारी का ऄजनज करने का जिजनश्चय दकया ह ै;

ऄतः ऄब, केन्द्रीय सरकार, ईक्त ऄजधजनयम की धारा 6 की ईपधारा (1) द्वारा प्रदत िजक्तयों का प्रयोग करत े हुए,
यह घोषणा करती ह ै दक आस ऄजधसूचना स े सलग्न ऄनुसूची में जिजनदरष्ट भूजम म ें पाआपलाआन जबछान े के जलए ईपयोग के
ऄजधकारी का ऄजनज दकया जाए ;
और केन्द्रीय सरकार ईक्त ऄजधजनयम दक धारा 6 दक ईपधारा (4) द्वारा प्रदत िजक्तयों का प्रयोग करते हुये, यह
जनदेि देती ह ै दक ईक्त भूजम म ें ईपयोग का ऄजधकार आस घोषणा के प्रकािन की तारीख के केन्द्रीय सरकार म ें जनजहत होन े
के बजाए, सभी जिल्लंगमों स ेमक्तु होकर जहन्द्दस्ट्ू तान पेरोजलयम कोपोरेिन जलजमटेड में जनजहत होगा ।
पेरोजलयम और खजनज पाआपलाआन ऄजधजनयम, 1962 की धारा 10 के ऄधीन दकसी भी क्षजतपूर्तत के जलए
जहन्द्दस्ट्ू तान पेरोजलयम कोपोरेिन जलजमटेड पणू जतया ईतरदायी होगी और धारा 13 के ऄधीन पाआपलाआन से संबजन्द्धत दकसी
भी मामले पर केन्द्रीय सरकार, सक्षम प्राजधकारी और दकसी भी राज्य सरकार या कोपोरेिन के जिरुद्ध कोइ िाद या कानूनी
कायजिाही नहीं हो सकेगी ।

NOTIFICATION
New Delhi, the 8th December, 2020
S.O. 4484(E).—Whereas by a notification of the Government of India in the Ministry of Petroleum and
Natural Gas S.O. No. 2708(E) dated the 11 th August, 2020, issued under sub-section (1) of section 3 of the Petroleum
and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the
said Act), published in the Extraordinary Gazette of India dated the 11 th August, 2020 the Central Government
declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for
the purpose of laying pipeline for transportation of Petroleum Product, from Hassan (Karnataka) to Cherlapalli
(Telangana) Pipeline by Hindustan Petroleum Corporation Limited;
And whereas copies of the said Extraordinary Gazette notification were made available to the public up to
11.08.2020.
And whereas the competent authority has under sub-section (1) of section 6 of the said Act submitted report
to the Central Government;
And whereas the Central Government, after considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the
Central Government hereby declares that the right of user in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the
Central Government, vest on the date of publication of the declaration, in Hindustan Petroleum Corporation Limited,
free from all encumbrances.
Hindustan Petroleum Corporation Limited shall be exclusively liable for any compensation in terms of
Section 10 of the P&MP Act, 1962. According to Section13, no suit, or other legal proceeding would lie against the
Central Government, Competent Authority or any State Government or Corporation for any matter relating to the
pipeline.
