6. 2ािधकरण, Aरण या अपचय के िलए अिधक सहजभेT तटीय Aे(cid:28)G क: पहचान करेगा और ऐस े पहचान े गए Aे(cid:28)G के िलए Aे(cid:28) िविनdद]ट 2बंधन योजना तैयार करेगा तथा उसके काया(cid:15)(cid:12) वयन के िलए िवpपोषण का 2बंध करेगा। 7. 2ािधकरण, तटीय िविनयमन जोन म > आhथक oप से मह(cid:22)व पणू (cid:12) िहR सG क: पहचान करेगा और उसके िलए एक:कृत तटीय 2बंधन जोन योजनाएं तयै ार करेगा। 8. 2ािधकरण पूवq( पैरा 4, परै ा 6 और पैरा 7 के अधीन तयै ार क: गई योजनाए ं और उनम> उपातं रणG को राnीय तटीय जोन 2बंध 2ािधकरण को जांच और उसके अनमु ोदन के िलए 2Rतुत करेगा। 9. 2ािधकरण, अनमु ो(cid:4)दत गुजरात राUय तटीय 2बंध जोन योजना और भारत सरकार के राजप(cid:28) असाधारण भाग- II धारा-3, उप धारा (ii) म >2कािशत अिधसूचना स.ं का.आ. 19 (अ) तारीख 6 जनवरी, 2011 म >अिधकिथत सभी िविशc शतs के अनपु ालन को सुिनिDच त करेगा। 10. 2ािधकरण, अपन े (cid:4)IयाकलापG क: Vरपोट(cid:12) तटीय जोन 2बंधन 2ािधकरण तथा पया(cid:12)वरण, वन और जलवायु पVरवत(cid:12)न मं(cid:28)ालय, को छह मास म> कम से कम एक बार 2Rततु करेगा । 11. 2ािधकरण क: बैठकG क: गणपhू त कुल सदR यG क: कुल संMय ा के एक-ितहाई से होगी । 12. 2ािधकरण, राUय सरकार, िवpरोषण अिभकरणG या पVरयोजना 2ािधकाVरयG आ(cid:4)द स े 2ाZत िनिधयां या फ:सG को जमा करने के िलए (cid:4)कसी राnीय बuक म> अपना खाता रखेगा। 13. राUय सरकार यह सिु निvत करेगी (cid:4)क इस आदशे और उ( अिधिनयम म> यथा िविनdद]ट इसके कृ(cid:22)यG का 2भावी wप से िनव(cid:12)हन करने के िलए 2ािधकरण को पया(cid:12)a मा(cid:28)ा म> ससं ाधन, मानव शि(, िनिधयां उपलOध हG। 14. 2ािधकरण, सभी आवDयक उपाय और पहल करेगा, िजसम > कायI(cid:12) म का िन]पादन, अनुसंधान, सूचना 2सार, 2िशAण, (cid:4)दन-2ित(cid:4)दन के कृ(cid:22)यG के 2ित जागoकता और समथन(cid:12) आ(cid:4)द सि_मिलत ह ैऔर ऐस ेउपयु( 2ित(cid:4)Iयाj और साधनG को अंगीकृत करेगा िजसम >उसके िलए ससं ाधन जुटाना, िवpपोषण आ(cid:4)द भी सि_मिलत ह u। 15. 2ािधकरण, पया(cid:12)वरण और वन मं(cid:28)ालय, के(cid:15)(cid:16)ीय सरकार क: भारत के राजप(cid:28) असाधारण भाग-2 धारा-3, उप -धारा (ii) म> 2कािशत अिधसूचना सं. का.आ. 19 (अ), तारीख 6 जनवरी, 2011 म> अिधकिथत 2(cid:4)Iया के अनुसार राUय के तटीय Aे(cid:28)G के तटीय िविनयमन जोन का मानिच(cid:28) तैयार करेगा और उसे राnीय तटीय जोन 2बधं 2ािधकरण और पया(cid:12)वरण, वन और जलवायु पVरवत(cid:12)न मं(cid:28)ालय, के(cid:15)(cid:16)ीय सरकार को 2Rतुत करेगा। 16. 2ािधकरण, िजला तटीय जोन मानीटरी सिमितयG के कृ(cid:22)यG का िनयिमत oप से पुवhवलोकन करेगा। 17. 2ािधकरण, सभी संबx योजना 2ािधकाVरयG, Aे(cid:28) अिभकरणG, िजला कले?टरG को भारत के राजप(cid:28), असाधारण भाग-2 धारा-3, उप धारा (ii) म > 2कािशत अिधसूचना सं. का.आ. 19 (अ) तारीख 6 जनवरी, 2011 के सभी उपबंधG के अनुपालन को सिु निvत करेगा और उ(cid:6)ल घं नG या अननुपालन के मामल ेम >समिु चत कार(cid:12)वाई करने का स े न आने वाला कोई िवषय संबिं धत कानूनी 2ािधकाVरयG ,ारा िनपटाया जाएगा। 21. 2ािधकरण, भारत के राजप(cid:28), असाधारण, भाग 2, खंड 3, उपखंड (ii) म> 2कािशत भारत सरकार के पया(cid:12)वरण और वन मं(cid:28)ालय क: अिधसूचना का.आ.स.ं 19(अ), तारीख 6 जनू , 2011 म> अिधकिथत 2(cid:4)Iया के अनसु ार तटीय िविनयमन जोन िनकासी के िलए उसके समA 2ाZत (cid:4)कए गए, उसको िनdद]ट (cid:4)कए गए या उसके समA रख े गए सभी िवषयG 2R तावG तथा पया(cid:12)वरण और वन मं(cid:28)ालय ,ारा जारी सभी Rप ] टीकरणG और माग(cid:12)दश‘ िसxातं G पर कार(cid:12)वाई करेगा । 22. पया(cid:12)वरण (सरं Aण) अिधिनयम, 1986 क: घारा 5 के साथ पVठत भारत के राजप(cid:28) असाधारण भाग- धारा-3, उप II धारा (ii) म> 2कािशत अिधसचू ना सं. का.आ. 19 (अ) तारीख 6 जनवरी, 2011 के अधीन िनदशे जारी करने क: शि(या ं अPयA और 2ािधकरण के अPयA को 2(cid:22)यायोिजत क: जाती ह uऔर अPयA ,ारा िनदशे जारी करने क: दशा म,> 2ािधकरण क: अगली बैठक म,> ऐसे िनदशे G को, िनदशे जारी करन े के कारणG और उनक: 2ा:िRथित को िविनdदc करने वाली Vरपोट(cid:12) सिहत 2ािधकरण के समA रखा जाएगा । 23. तटीय जोन 2बंध 2ािधकरणG क: काय(cid:12)2णाली म> 2ादhशता बनाए रखने के िलए तटीय जोन 2बंध 2ािधकरण का यह उpर दािय(cid:22)व होगा (cid:4)क वह एक समhपत वेबसाइट का सजृ न करे और उस पर कायस(cid:12) चू ी, काय(cid:12)वृत, (cid:4)कए गए िविनvय अनापिp प(cid:28), उ(cid:6)लघं न, उ(cid:6)लघनG पर कार(cid:12)वाई और (cid:15)यायालय मामले िजसम> माननीय (cid:15)यायालय के आदशे स_मिलत ह u तथा संबंिधत राUय सरकार क: अनमु ो(cid:4)दत तटीय जोन 2बंध योजना भी डालेगा। 24. 2ािधकरण क: पूव(cid:12)गामी शि(यां और कृ(cid:22)य क>(cid:15)(cid:16)ीय सरकार के अधीAण और िनयं(cid:28)ण के अधीन हGगे। 25. 2ािधकरण का मMु यालय गांधीनगर म> िRथत होगा । Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 2507(E), dated 16th October, 2012, the Central Government constituted the Gujarat Coastal Zone Management Authority for a period of three years and the term of the said Authority has expired on 15th October, 2015; And, whereas, the Central Government is of the view that the such Authority shall be reconstituted; Now, therefore, in exercise of the powers conferred by sub-sections (1) and (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereinafter referred to as the said Act), and in supersession of the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 2507(E), dated the 16th October 2012, except as respects things done or omitted to be done before such supersession, the Central Government hereby reconstitutes the Gujarat Coastal Zone Management Authority (hereinafter referred to as the Authority) consisting of the following persons, for a period of three years, with effect from the date of publication of this order in the Official Gazette, namely:— 1. Additional Chief Secretary/ Principal Secretary/Secretary, Forests and Environment Chairman Department, Government of Gujarat, Sachivalaya, Block No-14/8 Gandhinagar 2. The Principal Chief Conservator of Forests (Wild Life), Aranya Bhavan, Member Sector-10 A, Gandhinagar. 3. The Authority shall have the power to take the following measures for protecting and improving the quality of the coastal environment and preventing, abating and controlling environmental pollution in areas of the State of Gujarat, namely:— (i) examination of proposals for changes or modifications in classification of Coastal Regulation Zone areas and in the Coastal Zone Management Plan received from the State Government of Gujarat and making specific recommendations from Coastal Regulation Zone point of view as per the provisions of the notification of the Government of India in the Ministry of Environment and Forests number S.O. 19 (E), dated the 06th January, 2011 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii); (ii) (a) inquiry into cases of alleged violation of the provisions of the said Act or the rules made thereunder or any other law which is relatable to the objects of the said Act and, if found necessary in a specific case, issuing directions under section 5 of the said Act, in so far as such directions are not inconsistent with any direction issued in that specific case by the National Coastal Zone Management Authority or by the Central Government; (b) review of cases involving violations of the provisions of the said Act and the rules made thereunder or under any other law which is relatable to the objects of the said Act, and if found necessary referring such cases, with comments, for review to the National Coastal Zone Management Authority: Provided that the Authority may take up the cases under clauses (a) and (b) of this sub-paragraphs, suo motu or on the basis of complaint made by an individual or an representative body or an organisation; (iii) filing complaints, under section 19 of the said Act, in cases of non-compliance of the directions issued by it under sub-paragraphs (i) and (iv) to take action under section 10 of the said Act to verifry the facts concerning the issues arising from sub-paragraphs (i) and (ii). 3. The Authority shall deal with environmental issues relating to Coastal Regulation Zone which may be referred to it by the State Government of Gujarat, the National Coastal Zone Management Authority or the Central Government, as the case may be. 4. The Authority shall identify ecologically sensitive areas in the Coastal Regulation Zone and formulate area-specific management plans for such identified areas.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 5. The Authority shall co-ordinate for implementing conservation projects or projects related to upliftment of coastal population protection, etc. 6. The Authority shall identify coastal areas highly vulnerable to erosion or degradation and formulate area-specific management plans for such identified areas and arrange for funding for the implementation of the same. 7. The Authority shall identify critical stretches in the Coastal Regulation Zone and prepare Integrated Coastal Zone Management Plans for the same. 8. The Authority shall submit the plans prepared by it under paragraphs 4, 6 and 7 above and modifications thereof to the National Coastal Zone Management Authority for examination and approval. 9. The Authority shall ensure compliance of all specific conditions that are laid down in the approved Coastal Zone Management Plan of Gujarat and the notification of the Government of India in the Ministry of Environment and Forests number S.O. 19(E), dated the 06th January, 2011 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii). 10. The Authority shall furnish report of its activities at least once in six months to the National Coastal Zone Management Authority and the Ministry of Environment, Forest and Climate Change. 11. The quorum of the meeting of the Authority shall be one third of the total number of the members. 12. The Authority shall have its Bank Account in the National Bank to deposit the funds or fees received from the State Government, funding agencies or project authorities, etc. 13. The State Government shall ensure that sufficient resources, manpower, funds are available to the Authority to discharge its functions effectively as specified in this order and the said Act. 14. The Authority shall take all necessary measures and initiatives including programme execution, research, information dissemination, training, awareness day to day functioning, and advocacy etc. and adopt suitable procedures and means including raising resources, funding, etc., for the same. 15. The Authority shall prepare and submit Coastal Regulation Zone maps of the coastal areas in the State as per the procedure laid down in the notification of the Government of India in the Ministry of Environment and Forests number S.O. 19 (E), dated the 06th January, 2011 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) to the National Coastal Zone Management Authority and the Ministry of Environment, Forest and Climate Change. 16. The Authority shall regularly review the functioning of District Coastal Zone Monitoring Committees. 17. The Authority shall direct all concerned planning authorities, field agencies, District Collector to ensure the compliance of provisions of the notification of the Government of India in the Ministry of Environment and Forests number S.O. 19(E), dated the 06th January, 2011 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) and take suitable action in case of violations or non- compliance 18. The pay and allowances such as Traveling Allowance, Dearness Allowance, Seating Fees, Field visit fees, etc., shall be as per the norms decided by the Central Government. 19. The Authority, whenever required shall invite other experts as members during its meetings. 20. Any matter specifically not falling within the scope and jurisdiction of the Authority shall be dealt with by the statutory authorities concerned. 21. The Authority shall process all the matters, proposals received, referred to or placed before it for Coastal Regulation Zone Clearance as per the procedure laid down in the notification of the Government of India in the Ministry of Environment and Forests number S.O. 19(E), dated the 06th January, 2011 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) and clarifications and guidelines issued by Ministry of Environment and Forests. 22. The powers of issuing directions under section 5 of the Environment (Protection) Act, 1986, read with the notification of the Government of India in the Ministry of Environment and Forests number S.O. 19(E), dated the 06th January, 2011 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) are delegated to the Authority and the Chairman of the Authority, and in case the directions are issued by the Chairman, such directions shall be placed before the Authority in its next meeting along with a report specifying the reasons for issuing of the directions and status thereof. 23. To maintain transparency in working of the Coastal Zone Management Authority, it shall be the responsibility of the Authority to create a dedicated website and post the agenda, minutes, decisions taken, clearance letters,¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7 violations, action taken on violations and court matters including the Orders of the Court and National Green Tribunal, and also the approved Coastal Zone Management Plan of the State Government. 24. The foregoing powers and functions of the Authority shall be subject to the supervision and control of the Central Government. 25. The Authority shall have its headquarters at Gandhinagar. [F.
